Check Those Aging Pipes

Complying With AB3182 is Manageable

Question: My wife and I are finally in escrow and hope to take title to our first home in a few weeks. The house is in a genuinely nice neighborhood in Goleta which seems to be mostly occupied by seniors, but a few young families like us have moved in and we think it would be a good area to raise our family. The seller is the original owner, the house was built in 1962, the kitchen and bathrooms are original and not a whole lot has been done in the way of improvements, but the house appears to be in solid shape. We are in the process of having a home inspection scheduled but are worried that something may get missed and we will have little money left over for repair work. What kinds of problems should we be looking for that might get missed in the inspection? Your HandYman: Congratulations on your new home and you are smart to be on the lookout for unexpected repairs that may cause financial strains to your family budget. Most of the tract homes in Goleta were built in the late 1950’s and the 1960’s coinciding with the completion of Lake Cachuma to provide water to Goleta, and UCSB and Delco expanding to provide high paying local jobs. At that time when a house was built, the drain lines from the kitchen, bathrooms and laundry were for the most part made from cast iron and were buried in the ground under the cement foundation. The lateral sewage pipe that connected the house to the main sewer line in the street was usually made from red clay much like a mission style roofing tile. These cast iron and clay pipes worked fine for many years but now that these homes are approaching their 60th and 70th birthdays, these pipes are at best in poor condition and often are failing. Cast iron pipes of course are prone to rusting and it is not uncommon for a plumber to remove an old 2”-3” exterior diameter iron pipe and to find corrosion clogging the pipe to the extent that a pencil can barely be inserted. Cast iron pipes when buried can rust away and partially collapse allowing soil and tree roots to fill sections of the pipe. The red clay pipes connected with a sort of bell-shaped opening on one end that slid over the opposing narrow end of the next

pipe. These connections leaked to some degree and quickly attracted tree roots that slowly broke the joints apart as the roots sought the moisture and fertilizers in the sewer pipe. Like any type of clay or ceramic product these clay pipes were brittle and cracked when compressed by a tree root or pressured by shifting soil. Large amounts of money will be spent by homeowners in these Goleta housing tracts with local plumbers over the next 10-15 years as house by house the sewer lines will fail and need to be replaced or repeatedly repaired. Replacing a drain line that is buried under your foundation is not an easy thing to do and usually requires cutting into the foundation inside the house, digging up the old cast iron pipe and installing new black plastic ABS pipe. ABS pipe and fittings came into wide use in about 1970, are made from a super tough thermoplastic resin called Acrylonitrile-Butadiene-Styrene (ABS for short) and will likely survive until the end of time if installed properly. When the lateral sewer line to the street is replaced it can either be dug up in the same manner or most plumbers now offer what is often called “trenchless technology” where basically a new polyethylene pipe is pulled through the old pipe, sparing the homeowner the problems caused by having a trench dug across the front yard. As part of doing the due diligence in inspecting your potential new home, I suggest that you hire a plumbing contractor to run a video camera scope down your drain lines so that the actual condition of the pipes can be completely inspected. These remote video scopes have been around for some years now and most plumbing contractors own one. It may very well be that the home’s pipes are not immediately failing, but it could also be that you document an expensive and inconvenient future repair project that otherwise may have come as a very unwelcome surprise. If expensive work is required be sure to get at least quotes from at least two plumbers. I also recommend that an inline video inspection be done prior to a kitchen or bathroom remodel if the homeowner is not already aware of the condition of the pipes that will lie under their beautiful new cabinets and tile work.

This year in Sacramento only one major HOA bill, Assembly Bill 3182, passed to become law effective January 1, 2021. The bill creates a new Civil Code Section 4741 banning “unreasonable” HOA rental restrictions. The new law creates some uncertainties but is mostly manageable. The new Section 4741(a) prohibits HOA governing documents from containing anything which prohibits, has the effect of prohibiting, or unreasonably restricts rentals of homes, accessory dwelling units (“ADU’s”), or junior ADU’s (“JADUs”). It is clear what “prohibiting” rentals means, but the terms “effect of prohibiting” and “unreasonably restricting” are less clear. Most likely, these two terms are close to synonymous. Is a rental restriction a thinly veiled effort to halt rentals, or is there an explanation showing a legitimate purpose? This will be the critical question when evaluating present and future governing documents rental requirements. Associations should be cautious regarding rental restrictions because unreasonable restrictions could result in a $1,000 civil penalty and attorney fees to the complaining party. One positive result of the new Section 4741 is its approval of rental caps as low as 25% of the HOA (excluding ADUs or JADU’s). The law allows caps of 25% or higher, so HOAs with a rental maximum of 25% or more are unaffected. Another helpful addition in Section 4741(c) is its confirmation that HOAs may ban short term rentals (30 days or less). It is not yet completely clear if this will have any impact on HOAs that have lease term minimums in their documents regarding normal non-vacation rentals (often 6 months or one-year initial lease term). However, since short term rentals are considered non-residential use by

many cities, there is a strong likelihood that minimum lease term requirements will be defensible if HOAs can show the requirement is reasonable. New Civil Code Section 4741(f )’s requirement that all HOAs must amend their governing documents to conform to the law by the end of 2021 has received major attention in the legal community. Many lawyers are already advising that HOAs must amend their CC&Rs, but this is a misreading of the statute which exposes HOAs to expense and possible frustration. Per Civil Code Section 4150, operating rules are also “governing documents.” As such, associations can adopt rule changes complying with the law and contradicting any illegal CC&R provisions. Such rules would not violate the CC&Rs since illegal CC&R provisions are overridden by the law. Passing rule changes is far easier and less expensive than seeking member approval upon CC&R amendments. One very problematic part of this law change is in an amendment to Government Code Section 65852.2. This statute will now provide that if a public agency does not respond to an application to build an ADU or JADU within 60 days, the application is automatically deemed “approved.” Associations subject to creation of ADUs (primarily planned developments) should adopt solid architectural standards (which among other things incorporate local building codes) in case a building permit is approved due to inaction of the agency. Of course, HOAs also must be vigilant and prompt in responding to such applications to avoid having its own approval issued by default. While there is still uncertainty, reasonable associations led by competent professional managers and attorneys should be able to handle this new law.

By Ed Del Grande Question: Dear Ed: I have a bathroom with a smaller round-style toilet bowl. It’s not a big bathroom, but I do have the room to install the longer toilet style that I have seen in other bathrooms. Should the plumbing connections be the same? — Bill Answer: Two popular toilet bowl styles are round-front, where the bowl rim is circleshaped, and elongated, where the bowl rim is a little longer and shaped like an egg. Many people find the elongated bowl to be a little more comfortable. However, because of tight bathroom spaces or door swing clearances, some bathrooms have round-front toilets installed. But I have seen jobs where round-front toilets are installed simply because of budget reasons.

So if you have the space to install a new elongated toilet and all the water and drain line setups are standard, in most cases the new longer toilet should line up with same plumbing connections. I recommend you consult with a licensed plumber to avoid any confusion before you buy the new toilet. Also, check that you can get an exact color match as well, so your new toilet won’t bowl over your bathroom with clashing colors. Question: What can I do if my tenant used their security deposit as their last month’s rent and then left the property damaged? – Brenda Answer: The security deposit is supposed to be used to offset potential damage to your rental property and should not be used as rent. Many landlords will collect both a security deposit and the last month’s rent when beginning a new lease to avoid this problem. The landlord must keep these deposits in a separate bank account and tell their tenant where the money is held. When the time comes, the property owner may transfer the advance rent from that account to their “operating” account to be used as rent but may not transfer the security deposit to pay the rent if their tenant falls behind. In your situation, when your tenant did not pay the final month, you could have de-

manded payment or started an eviction. Many property owners opt to do what you did because it seems to make sense only to find the home damaged, leaving them with the choice to eat the cost or sue their former tenant for the repair costs. There is a common misconception that the tenant is only responsible for repairs up to the security deposit amount. The reality is that tenants are responsible for the cost of repairing any damage they caused. In your case, you will need to sue your tenant for any unpaid rent and the repairs. If a landlord does not follow the correct procedure at the end of the lease or does not return the unused portion of the security deposit, the tenant can sue to force their landlord to return the funds. Finally, if the last month’s rent is being held and the tenant breaks the lease early, the landlord can usually keep the funds to help make up for their tenant’s breach of the lease agreement. Frost your poinsettia for a Christmas remembered

By Norman Winter Tribune News Service There is an excitement in the air about Christmas this year and it appears to be as contagious as ... you know. Right now, it doesn’t seem to be about presents or shopping, though that will probably come. It seems to have a focus on tradition, on family, a return to what is important. The beauty of the season seems to have achieved a status that has been unprecedented for a while. In 2020 decorating indoors has become the so-called “frosting on the cake.” In case you have not ever thought about that term, it means taking something great and making it better. The poinsettia is no doubt the most

loved flower for the Christmas season. There are so many colors, variegations of both leaves and flowers, and even varieties with differing textures like curled or rosette. While they have breathtaking beauty, they too can have the addition of a wonderful frosting. This frosting comes via a plant combination. We make plant partnerships every spring in flower beds, containers on the porch, patio or deck and even in floral arrangements for the dining table. When it comes to the poinsettia, however, many retreat to monoculture, or perhaps add little greenery, which is OK. Know though that the poinsettia has a cousin that will add a sparkle that will be long remembered by friends and family who visit.

You probably know this cousin as the toughest flower in the summer garden that you have ever grown. It may be the most awarded plant of all time but this is a challenge hard to quantify. You know it as Diamond Frost euphorbia. That is right, both the poinsettia and Diamond Frost are euphorbias. While we let Diamond Frost sizzle in mixed containers or planters, it is a rare gardener that has tried it indoors, where it is very adaptable. To partner with your holiday poinsettias, you may want to shop now at garden centers or online. Your indoor containers and size of poinsettias will dictate how many Diamond Frost you will need. The look will be as if the red bracts of the poinsettia are resting on a bed of frost. No matter the color of poinsettia, your design will look as though it has been enhanced by a floral artist. This year there was a new euphorbia selection introduced called Diamond Snow. This euphorbia will skyrocket in popularity as it sports double flowers and in the case of the poinsettia partnership it will look as though the bracts are sitting on a fresh bed of snow. As if this could not get any

better, last year a florist had me mesmerized with their special take that not only featured the plant combination but the addition of a little fake ice drizzle on the poinsettia bracts.
