Downtown Santa Barbara is not the only place with parklet problems.

Five miles down the road in Montecito, the main thoroughfare, Coastal Village Road, is the focus of an us-vs-them battle between restaurants and merchants over the outdoor eateries — only in this case, the one and only complaint is about parking, or lack thereof.

Twenty-five Montecito businesses and seven Montecito landlords sent a petition to Santa Barbara Mayor Randy Rowse, city council members, City Administrator Rebecca Bjork

and City Attorney Ariel Calonne, demanding that the Coast Village Road parklets be removed, or else be forced to comply with Santa Barbara parking regulations.

“We, the undersigned, are writing in support of restoring equity to all businesses on Coast Village Road (CVR) and Coast Village Circle (CVC),” they wrote.

“The rationale for this is simple; the conditions that created (the) parklet’s temporary existence, namely, indoor dining restrictions, haven’t been present since June 15, 2021 and thus are no longer required.”

The Children’s Fiesta Parade, now in its 90th year, returned to Santa Barbara for the first time since 2019 on Saturday. The parade was led by the Spirit of Fiesta Tara Mata and Junior Spirit of Fiesta Layla Gocong.

“The atmosphere was festive, fun and spirited!

Everyone was in great spirits and the weather was perfect. Everyone was anxious to see their little ones dress up or walk with their little ones in the parade, with flowers and confetti along the way,” said Parade Coordinator Michelle McDonnell, recreation supervisor of community services for the Santa Barbara Parks and Rec. Dept.

“Wherever you went you heard laughter and fun being had by all.”

The parade has been a community tradition for generations of children. Each year, new families join families who have proudly participated in the Children’s Fiesta Parade for more than five generations.

“It went very, very well. We had over 1,900 participants and 80 entries. It was a beautiful day along the waterfront here in SB. It made for a great festive event. It was toward the end of the Please see PARADE on A5

The sergeant said he disagreed with reports that Lucky’s was not honoring the commitments made

by Mr. Schwartz.

“It is important to understand the valet company is contracted by the restaurant,” Sgt. Ragsdale said. “Communication from the police department to Lucky’s to the valet company can take time to disseminate to every employee.”

He confirmed that the city painted two corners red near Lucky’s and posted “no stopping” signs to cut back on future parking violations. In addition, he confirmed that white cones have been placed along the restaurant parklet’s exterior perimeter. “We are still evaluating to see if the traffic engineering safety improvements have been effective.”

“The two officers who came to talk to me could not have been nicer or more cordial,” Mr. Schwartz told the News-Press.

“They found a way to resolve this without being inflammatory.”

As far as the red curbs and “no stopping” signs are concerned, “we’re thrilled,” he said, adding that Lucky’s put the cones in place themselves. He said they also talked to the valet company “to tighten up things, so to speak.”

to Santa Barbara’s. Montecito merchants and landlords on Coast Village Road and Coast Village Circle, they said, “do not have the benefit of public parking structures to support themselves as businesses downtown do, resulting in a pre-pandemic parking shortage.

“Businesses on CVR and CVC count on public street parking to support them, including restaurants that do not have parklets,” they wrote.

“Therefore removing 20 percent of the available public street parking spaces on CVR to build a handful of ‘temporary’ outdoor parklets was never sustainable for most businesses in the area, has exacerbated the preexisting parking shortage, and compromises public safety.”

“I understand that people on the street are unhappy by the loss of parking,” said Leonard Schwartz, the general manager of Lucky’s, one of the restaurants the petitioners contend abuse parking regulations by extending too far into the street.

“I absolutely understand the frustration on the part of our neighbors, but we’re dealing with unusual circumstances (brought on by COVID-19),” he told the News-Press. “We’re abiding with what the city asked us to do.”

In addition, Mr. Schwartz said, “we are providing way more additional outside dining for people at a time when the virus is still mutating and more contagious than ever. More than half the people who dine at Lucky’s insist on being outside.

“We’re pleasing some people and upsetting others. I get it,” he said. “But we’re following the rules. As far I know, we are in compliance.”

Many Santa Barbara residents might wonder what Montecito’s parking controversy has to do with Santa Barbara, and why the petitioners chose to contact their neighbors up north to demand relief. Especially when the city is struggling to resolve its own parklet situation on State Street, including issues of portability, rent, regulations and sewer drainage.

The answer is that Montecito’s Coast Village Road and Coast Village Circle are within the city limits of Santa Barbara.

Mayor Rowse said he feels for the merchants.

“I haven’t seen the petition, but I am aware of it,” he told the NewsPress. “I know the signatories.

Obviously if I was one of those guys, I’d probably feel the same way. On Coast Village Road, the most valuable commodity happens to be parking.”

At the same time, Mr. Rowse, a former restaurant owner, said he understands the needs of restaurants, too, which were allowed to build the parklets because of COVID and the resulting restrictions on indoor dining. The city had no choice but to stop enforcing its existing dining and parking regulations “just to keep these businesses alive,” he said.

“It was the right thing to do,” Mr. Rowse said. “We passed an emergency ordinance to deal with stuff already in place where they don’t enforce the rules in place, but that’s got to end sometime. We didn’t officially say, ‘Get rid of the rules.’ We just didn’t apply them.”

The mayor said he also feels for building owners and landlords forced to deal with the parklets and their resulting loss of parking spaces.

“The property owners say, ‘The conditions under which I bought my properties or lease them to tenants have changed,’ “ Mr. Rowse said. “Now there’s a structure blocking visibility for the storefront and parking is limited all day long. I see the gripes. I understand what they’re feeling and going through.”

Added Brian Bosse, the Santa Barbara Public Works Department’s downtown team manager, “From the beginning of this process, the city has endeavored to be flexible with businesses and expanded outdoor business areas in an effort to assist them in getting through the many restrictions brought on by the COVID-19 pandemic.

“We work with our business community to educate first and then enforce if an issue of access or safety arises,” he told the NewsPress The issue, Mayor Rowse said, boils down to what to do about the parklets now the pandemic has eased and indoor dining is allowed, especially since the city has failed to come up with interim rules and regulations for restaurants to follow.

“In the operational part of the interim plan, we focus on

“On Coast Village Road, parklets are allowed to be built a bit deeper than the 6 feet because the angled parking spaces create a wider parking lane than does a parallel-type parking space,” he said.

But if a parklet in a parallel parking space or angled parking space extends beyond the parking area and into a travel lane or bike lane, “we would visit the business owner and require that they immediately remove the parklet from the travel lane or bike lane.

“In previous visits to Coast Village Road, staff did not find any parklets extending beyond the parking area and into a travel lane or bike lane,” Mr. Bosse said. On the other hand, “we have found that there were issues with vehicles being parked, by valet or otherwise, in the bike lane and even into the travel lane. We worked with our Police Department and Transportation staff to install additional signage and painted red curbs in an effort to eliminate these abuses.”

While Santa Barbara police have not seen the petition, it is concerned about reported parking violations and has taken steps to enforce them, Sgt. Ethan Ragsdale, the department’s public information officer, told the NewsPress.

“As far as public safety concerns, we did receive information about there being a parking safety issue in the 1200 block of Coast Village Road pertaining to vehicles being parked, blocking a bike/traffic lane, as well as some other vehicles parking in the area that could cause visibility issues,” he said. “That problem has since been resolved to my knowledge.

“We were able to work with the businesses productively, employed the assistance of Public Works for extra signs and some curb painting. There have also been parking enforcement officers on Coast Village Road to enforce all parking violations on the entire portion of CVR.” He confirmed that police received a call about a parking problem near Lucky’s and that a police officer responded. “A verbal reminder was given to the valets, reminding them not to block the bike or vehicle lanes,” he said. “I can’t comment on whether the vehicles were moved back to the parking location in question because I was not there. There was no formal ‘cease and desist.’ “ Sgt. Ragsdale confirmed that police met with Mr. Schwartz and had a “very productive”

I’m an advocate of neighborhood autonomy and their having authority over their area, but they (Montecito businesses and landlords) need to be proactive about it.”

Which is exactly what the businesses and landlord say they’ve done with the petition sent a week ago via email.

Whatever the city does in response, it had better be soon, they say, because the overreach by some restaurants and their parklets extending into the street is threatening their livelihoods by removing the number of parking spaces available for their customers.

“The parking problem on CVR and CVC is compounded when you consider the impact of adding 253 restaurant parklet seats, many of which are in violation of the sizing guidelines posted on the city’s website,” they wrote in their petition to the city. “Using the city’s own municipal code requirement of one parking space per three restaurant seats, 84 parking spaces are required to support this added seating. “(But) rather than adding 84 parking spaces, parklets have subtracted 28 parking spaces resulting in a net deficit of 112 parking spaces. To put these numbers in perspective, there are only a total of 117 parking spaces available on CVR today.

“The overall parking problem is further exacerbated with the reduction of parking on Coast Village Circle caused by the ongoing 101-freeway construction.

Has the impact of the upcoming roundabout construction at Olive Mill Road and CVR been considered?”

And, they say, the shortage of parking isn’t the only problem.

“The public safety issues noncompliant parklets create are numerous,” they wrote.

“Alleys, bike lanes, sidewalks and driveways are being blocked (and) cars are double- and triple-parked on a daily basis. At least two serious automobile accidents have resulted directly from parklets on the 1200 block of CVR. Bicycles are constantly being forced from established bike lanes and into traffic lanes due to noncompliant parklets extending as much as 21 feet from the curb.

“The substantial reduction in parking enforcement also compounds the problem, and further differentiates CVR and CVC from downtown Santa Barbara,” they wrote. “The negative environmental and public safety impact of distracted automobile drivers circling the block looking for parking must also be considered.”

“What we do know is that white sharks, particularly juveniles, have aggregation hot spots and the hot spots move from location to location each summer. There was an aggregation of about 40 off Carpinteria for two years. We are developing monitoring tools; and setting up a camera running on Government Point near Pt. Conception which is now part of the Dangermond Preserve. The camera is to count seals on the beach, and see how many there are,” Dr. Chris Lowe, professor and director of the CSULB Shark Lab and one of the leading experts on white sharks in the Santa Barbara area, told the News-Press.

“White sharks are found throughout California year round. At different times of the year, there are more adult sharks in specific regions, like the Farallon Islands, and juvenile sharks in other areas, mostly to the south. That said, juveniles appear to be spending more time in California than they did in previous decades,” John Ugoretz, environmental program manager for the California Department of Fish and Wildlife, told the NewsPress in an email.

Other reasons that could be impacting the shark migration patterns include water temperature. The aggregation of white sharks near Carpinteria likely occurred due to the occurrence of red tide last year,

according to Dr. Lowe. Red tide is a harmful algal bloom that takes the oxygen out of the water.

“Juveniles and adults migrate differently. Juveniles migrate to Baja when water temperatures dip below 60 degrees. Elephant seals start showing up in the summer to molt, mate, birth and then migrate. The elephant seals start migrating out to sea about February and it seems that when the elephant seals go out to sea the sharks do as well,” said Dr. Lowe.

“Elephant seals are pretty savvy and swim pretty fast and are pretty adept at avoiding sharks.

They are very well adapted for ocean life and very nimble in the water. With an increased white shark population, many are getting exposed to sharks earlier in life and must learn to avoid them. The adult sharks hunt the elephant seals but the juveniles are not large enough or skilled enough to hunt the seals. Juvenile sharks are about 8-9 feet long and adult sharks are 10-12 feet. It’s not just size, it’s experience. It could take a shark years to learn to hunt and take down a seal. But even

an unskilled white shark might be able to take down a sick or wounded seal,” said Dr. Lowe.

“It seems the pups and juveniles are much farther north than expected. They are usually at Venice Beach and they are now all the way to Monterey Bay. The migration shift is related to warm waters,” Peter Howorth, former News-Press columnist, collaborator with the Shark Research Committee and director of the Santa Barbara Marine Mammal Center, as well as the senior scientist and a principal in the Marine Mammal Consulting Group, told the News-Press.

“The juveniles feed on grunion, surf smelt and other small schooling fish. As for the adults, one of their favorite things to feed on are the northern elephant seals,” according to Mr. Howorth and Dr. Lowe.

“White sharks, when they are born, are called pups. They are about four feet long and come fully equipped with teeth. There are drone shots of schools of fish and white sharks among them, with the fish going crazy. As they

get bigger they start going after bigger prey and can tolerate colder water. There is more food value in bigger prey. They also scavenge whale carcasses,” said Mr. Howorth.

“I think the important thing is that the white shark population is coming back. People should assume that there could be white sharks nearby but that doesn’t mean you’re at risk.” said Dr. Lowe.

“The chance of experiencing an incident with a white shark at California Beaches is extremely low. That said, the ocean is a wilderness and, just as you might encounter a bear in the woods or a mountain lion on a trail, you may encounter a shark in the ocean,” said Mr. Ugoretz.

“We used to pick up sharkbitten seals and sea lions year round. The seasonality is people’s foolishness … They are part of the ocean environment and it’s wise if you see a shark advisory sign or there has been a sighting or attack … to go to another place.

But that doesn’t guarantee there won’t be an attack. They are really huge creatures; a 20 ft shark can weigh two and half tons,” said Mr. Howorth.

“Sometimes the sharks will bite out of self-defense, but sometimes they bite humans because they mistake them for food. So what we need to realize is that sometimes sharks make a mistake. There will be a Celebration for Leslie with a Mass at Trinity Episcopal Church, S.B. at 1:00pm on Saturday 8/20/22. Loud sneakers encouraged. Afterwards, there will be a reception on the patio. All are welcome.

Leslie leaves her daughter Kirsten, her granddaughter Nikki, her great-grandsons Christian and Jayden and their Grandpa Joe, her sister-in-law Sandy, her nieces Meghann (and her son Calvin) and Tara (and her son Cillian), her nephew Heath, her life-long friends both here and abroad, and her companions Lynn, Luigi and cats.

Leslie loved life. Born in Conn., she traveled the world. MULLINS, John Eugene January 15, 1938 - July 3, 2022

John was a local boy who grew up on a horse ranch in Montecito, and attended local schools. He graduated from Santa Barbara High School, class of 1956 and then attended Oregon State on a football scholarship, playing for legendary coach Tommy Prothro, on a team that went to the 1956 Rose Bowl.

John was known to “hot rod” around Santa Barbara in the 1950s, so it was no surprise that he would make a career in the automotive business that would continue for RYHU \HDUV VWDUWLQJ ÀUVW ZLWK WKH &KHYUROHW GLYLVLRQ RI General Motors in Van Nuys. While living there, he met the love of his life, Lauren Leventhal, and they married in 1963. He spent the ‘60s and early ‘70s with GM, which took KLP WR 6DQ 'LHJR DQG :DVKLQJWRQ VWDWH ZLWK &KHYUROHW Having enough of the corporate life, John decided to YHQWXUH RXW RQ KLV RZQ WR VWDUW 0LVVLRQ &LW\ /HDVLQJ LQ 1975. The family picked up from San Diego and moved to his hometown of Santa Barbara. He also owned the local &KHYUROHW GHDOHUVKLS )LYH 6WDU &KHYUROHW IRU D SHULRG RI WLPH LQ WKH PLG V 0LVVLRQ &LW\ $XWR &HQWHU ZDV D ORQJWLPH À[WXUH RQ ORZHU 6WDWH 6WUHHW LQ WKH V DQG WKHQ ODWHU RQ +ROOLVWHU $YHQXH DV D VHOOHU RI ZRUN WUXFNV Many customer became friends and would stop by to just shoot the breeze with “Papa John.”

In his spare time, when John wasn’t out chopping wood and collecting western memorabilia he was an amazing silversmith. Taught by his father Dean Mullins, John made beautiful silver and gold western belt buckles, money clips, hat bands and earrings for family and friends.

PARISOTTO, Fausto Mario February 2, 1935 - July 28, 2022

Fausto Mario Parisotto of Solvang, CA, passed away on Thursday, July 28, 2022, at the age of 87. After a brief illness, Fausto passed at home surrounded by his beloved wife Melvia, daughter Debbie, son Fausto Jr., daughterin-law Paula, and son-in-law Earl.

Fausto was born in Spineda Di Riese Pio X, Italia, on February 2, 1935 to father Giorgio Parisotto and mother, Genoveffa Perizzolo Parisotto. The middle of three sons, Fausto began his career as an electrical apprentice at the age of 14. At 19, he left the farm and his family to journey to the United States, where he began his formal training to become a well respected and highly knowledgeable electrical contractor. Parisotto Electric continues to this day under the capable hands of his son, Fausto Jr. In 1956, to all our good fortune, Fausto met Melvia at an Italian dance in Santa Barbara. Listening to her mother’s excellent advice, they began dating, and the rest is history. Melvia and Fausto were married at Our Lady of Guadalupe, on June 22, 1958; a love story that spanned 66 years and created a legacy of love, faith and family.

Forever the entrepreneur, Fausto, Melvia, Giovannina and Arnold Pauletto began P & P lighting, which they ran together for over 20 years, and at the end, ran with daughter Debbie and son-in-law Earl. Fausto was very involved in many clubs; IABC, Sons of Italy, Italian Catholic Federation, Unico, and was president of Trevisiani del Mondo.

Never one to sit idle, Fausto had many hobbies; gardening, his chickens, traveling, hunting, Àshing, and playing cards with the girls 9ery important to Fausto was his faith and giving back to the community. He ushered at Our Lady of Mt. Carmel and Mission Santa Ines for many years. Fausto visited friends and family, always with a smile and hug that conveyed his selÁess and loving nature. Being a Nonno was so very important, and his grandchildren, and great-grandchildren always knew their Nonno understood, supported, gave good advice and loved them unconditionally.

Fausto was preceded in death by his parents, his brother Paul Parisotto, his in-laws, Luciano and Teresa Stagnaro, who loved him like a son, sisters-in-law Gigetta and Maria Parisotto, and brother-in-law Michael DeGarimore. He is survived by Melvia Stagnaro Parisotto, his wife of 64 years; children Debbie (Earl), Fausto (Paula); grandchildren Jenn (Mike), Anna (Sean), Isa, Frankie (Alex), Anthony (Morgan), Brandon (Maila), Cody (Charlie), Treven (Alla); great-grandchildren Odin, Marlow, Sean, Leo, Rai, Beau, Liora, Anya, and Hailey, brother Adriano Parisotto, sister-in-law Orietta DeGarimore, and many nieces, nephews, cousins, and godchildren.

A mass is planned for Fausto at Mission Santa Ines; 1760 Mission Dr., Solvang, on Wednesday, August 17, 2022, at 11:00 a.m. A reception in the church hall will follow, with opportunities to speak and share your favorite memory. LOSEE, William “Bill” Heaven welcomed its newest ukulele player, William “Bill” Henry Losee Jr., who passed away peacefully on July 27th at the age of 89, surrounded by his family.

Bill moved to Santa Barbara from Fresno in 2007. On 6DWXUGD\ DIWHUQRRQV \RX FRXOG ÀQG KLP SHUIRUPLQJ ZLWK the Santa Barbara Ukelele Club at the harbor. He worked as a volunteer at the Granada, the Santa Barbara Visitors Center at the beach, and the Santa Barbara Newcomers Club, where he helped residents make new friends and learn about their hometown. He was an active resident of the Samarkand Community, where he lived with his loving companion and spiritual partner, artist Susan Fridley. Together, they enjoyed concerts, art galleries, and museums in town. Bill’s greatest joy in life was his family and his deep faith in God. His optimism and resilience made him an inspiration to all.

Born in Ogden, Utah in 1933 to William Henry Losee and Virginia Losee (Loughran), he was the oldest of four siblings. He graduated from Fresno State in 1955 and was drafted into the Navy where he spent two years based in Japan. He married his college sweetheart, Myra (Zahlis), in 1957 in Carmel Valley, a highlight of his life.

They settled in San Rafael and raised three sons prior to moving to Fresno where Bill bought the local Avis truck rental franchise. He was a successful businessman who supported his community as a Rotarian and an avid Fresno State Bulldog supporter.

Bill was preceded in death by his wife Myra Losee (Zahlis), son Kevin Losee, and granddaughter Kendall Kay Losee.

He is survived by his sons Craig Losee and Eric Losee, grandchildren Hunter Losee, Jackson Losee, and Paige Losee, as well as brother Dan Losee, sisters Beth Fahlstrom (Losee), JuDee Peterson (Losee) and many loving cousins, nieces, and nephews.

On Wednesday, Goleta Planning Commissioner Sam Ramirez will run more than three miles, from the end of the second district to Goleta City Hall, to hand deliver his candidate filing papers for City Council District 2. Mr. Ramirez is running to show his commitment to healthy lifestyle programs for Goleta and to raise awareness of diabetes and heart disease in the latino community.

“The 2nd District has some of the highest levels of diabetes and heart disease on the Central Coast. These conditions take a tremendous toll on people and on our economy, but we can lower these levels by making healthier lifestyle choices and providing for better infrastructure,” Mr. Ramirez said in a press release.

“As a Goleta City Councilmember, I will be a driving force in support of a more walkable, bikeable

community and healthy lifestyle programs, especially for young people.”

He continued, “People don’t need to run from one end of the district to the other, but they can add more physical activity to their day and reduce their chances of diabetes and heart disease.”

Along the way on Wednesday’s run, Mr. Ramirez will be collecting signatures for his candidate filing papers. Doris Joyce (Shoemaker) Goodale passed away in Solvang, CA, on the morning of July 2, 2022 at 90 years of age with her children and future son-in-law at her bedside.

Doris was born November 6, 1931 in Peoria, Illinois to Clara Wiley Shoemaker and William Shoemaker. Shortly after the start of the Great Depression, the family moved to her grandparents’ farm in Spirit Lake Iowa, where Doris and her brother attended school in a 2-room school house, worked on the farm, and enjoyed many fun times at the Arnold’s Park Amusement Park. Following the sale of the farm in 1941, the family moved to Chicago. Doris attended and graduated from Hyde Park High school, where she participated in cheerleading and civic club.

After high school, Doris went to work for an insurance Àrm in Chicago. When they opened a branch in Los Angeles in the early 1950s Doris decided that it was time to leave the blustery winters of Chicago behind. With her brother in the military and her father deceased, Doris and her mother drove across country to start a new life on the west coast, settling down in Pasadena. Doris attended Pasadena City College and continued working, eventually moving to Newport Beach. This move was transitional as it was not only the start of her career in the aerospace industry, but it was also where Doris would meet Don Goodale, her future husband. They were married in Pasadena in 1962 and relocated to Santa Barbara where Don was then employed as an electrical engineer. Both their son and daughter were born in Santa Barbara.

For 30-plus years Doris made a career in the aerospace and defense industries and involved with such notable projects as the Space Shuttle and the B1-B. During and after her career she and other friends with whom she worked, known as “The Board,” would get together for lunch, coffee, and drinks and discuss all manner of topics including family, work, and current events.

In retirement, Doris pursued genealogy with a great passion, making multiple trips to the Family History Library in Salt Lake City and to the east coast in search of relatives’ headstones and records. Through these pursuits, she was able to provide the ancestral history required to join the Daughters of the American Revolution as well as Colonial Dames. She was active in both the Conejo Valley Chapter of the DAR, and the Aquila Chase Chapter of the Colonial Dames until January, 2020, when she moved to Solvang in order to live closer to her daughter. In retirement, Doris also enjoyed puttering around in her gardens, walking, and watching Jeopardy. In 1997 and again in 2020 she became a grandmother and could never spend enough time with her two grandsons through the years as they grew to adulthood.

Doris is survived by her husband Donald Goodale, daughter Susan Goodale, son David Goodale (Monica) and their 2 sons, her brother Bill Shoemaker, niece Carol Shoemaker Schuster (Jim) and their children and grandchildren, niece Linda Shoemaker Turner (John) and their daughter, niece Sharon Shoemaker Muller and her children and grandchildren, niece Barbara Shoemaker Watson (Ed) and their children, niece Peggy Shoemaker, and cousins Wilma Helm, Orla Wiley, Sarah Salois, Marilyn Joul, Eleanor Medberry, and Patricia Steenhausen The family would like to extend its thanks to Doris’s team of health care providers at Atterdag Village, whose caring and expertise helped support her Ànal years.

At Doris’s request, who was never much for celebration or liked to be fussed over, no funeral or memorial service is planned.

In 1967, Don accepted a job transfer, so Doris packed up their belongings in Santa Barbara and the family moved to the newly incorporated, one-trafÀc-light town of Thousand Oaks. As the children became of age to start elementary school, she became involved in Meadows Elementary School PTA and served as co-troop leader for her daughter’s Tres Condados Girl Scout Troop #269.

EMMELUTH, Bruce Palmer

1940-2021 Bruce was joyfully welcomed into Heaven a year ago on August 11, 2021 in Santa Barbara, CA. Although he struggled with many medical issues for the last few years of his life, his devoted wife, Canda, was his greatest champion and always at his side.

A TRUE GENTLEMAN ... to be emulated. Deeply faithful.

Never taking a day off from excellence. Honor and dignity were his core values. Generous with his time, wisdom, and resources. Kind, fair and loyal. Strong work ethic and commanding personal presence identify him as a leader.

He was born November 30, 1940 in Los Angeles to parents Bill and Betty and big brother Jay. He fondly remembers his childhood of camping under the stars with family and friends in Baja Peninsula, Catalina Island, Carpinteria. He enjoyed numerous activities with the Boy Scouts and Sea Scouts. In 1956 his family moved to Santa Barbara, where he was proud to be a Don at SB High School. Bruce was accepted into Claremont McKenna College. He was Associated Student Body, Athletic Chair, Appleby Social Chairman, member of Junior Class Council and the Knickerbocker Social Club. He merited the Academic Roll of Honor. Bruce considered this excellent educational experience to be four of the most important years of his life. He graduated in 1963 with a Bachelor of Arts in Economics. He went on to earn an MBA in Finance UCLA and was elected into Beta Gamma Sigma.

Bruce proudly enlisted in the Army National Guard. He became a sharpshooter with 0 ULÁH DQG FRPSOHWHG 6(2+ 12& /HDGHUVKLS 6FKRRO In 1963 he married Cheryl Miller and had three children: Bill, Brett and Carrie.

He was an accomplished Financial Executive. His expertise included investment banking, mergers and acquisitions, public offerings, private placements and venture capital. He was a member for the Association of Corporate Growth, Board of Advisors, Entrepreneurial Studies Program at the John E. Anderson Graduate School of Management.

His amazing career spanned Prudential Insurance Co. of America as a Senior Investment Analyst. Then to Seidler Companies Inc. as Senior Vice President of Corporate Finance DQG %RDUG RI 'LUHFWRUV 2Q WR 9DQ .DVSHU DQG &RPSDQ\ DV 0DQDJLQJ 'LUHFWRU RI Corporate Finance, member of the Executive Committee and Board of Directors. He retired his career with Wells Fargo Securities, LLC as Executive Vice President, Senior Managing Director of Investment Banking.

In 1985, it was destiny that Bruce met Canda, the love of his life, while visiting 0DXL 7KH\ ZHUH MR\IXOO\ PDUULHG LQ 7KH\ OLYHG LQ 3DFLÀF 3DOLVDGHV ZKHUH WKH\ thoroughly enjoyed the community. Bruce was a member of the Jonathan Club since 1972. In 2003 they moved to Santa Barbara.

Bruce was an active member of El Montecito Presbyterian Church. He had a deep faith and belief that God actively moved in his life. He demonstrated his faith through acts of kindness and generosity throughout his lifetime.

Bruce was an incurable dog lover and supported numerous animal and environmental causes across the country. He was known for his wonderful sense of humor and quick wit. He led by example, made time for his family and friends and was a man of his word. Above all, he will be most remembered as extremely loyal and supportive to those he loved, generous to all he encountered...he was kind, steadfast, a consummate Gentleman.

He will be greatly missed and always remembered by those he held most dear--Canda, his devoted wife of 35 years, his children, Brett (Jamie) Emmeluth, Carrie (Kirk) Landau DQG ÀYH JUDQGFKLOGUHQ -DGHQ .XU\Q (PPHOXWK .\OLH &KDVH DQG &ROH /DQGDX +H was proceeded in death by his parents, his brother Jay and son Bill.

Alternate route sees parade march down Cabrillo Blvd.

The young ladies are wearing their dancing costumes: twirling, dancing, and handing out flowers. Everything is nonmotorized. Nice homemade floats, which usually had a strong man behind pulling them. This year, instead of the traditional route up State Street, an alternate route was pursued up Cabrillo Blvd. from Garden St. to Calle Puerto Vallarta, where each child who participated received an ice cream treat sponsored by MarBorg Industries. The route change was due to restaurants on State Street still having side cafes, a holdover from the height of the pandemic.

“We got great feedback on the location. The location was more spacious and open with the ocean on one side and mountains on the other.

Everyone was gearing up ready to go early this morning,” said Ms. McDonnell.

Parents, families and friends create and decorate their own floats, carts and wagons for their children.

The News-Press asked Ms. McDonnell how it felt to be back in person on Saturday for the first time in two years: “Wonderful!

The News-Press asked Ms. McDonnell if there were any notable or favorite floats: “There were several with so much work put into them. Some were more sizable than others, but all floats were so creative not one float was more of a showstopper than another. Some of the smaller wagons were the cutest ones, with the children asleep in the float and their cowboy boots peeking over the side.

“I think what’s important was the fact that there was so much excitement and energy put into this event because we know how much people wanted to get out of the house and celebrate the culture of Santa Barbara and represent Santa Barbara well.

Sgt. Ragsdale, meanwhile, stressed that police parking enforcement is not confined to Lucky’s.

“Parking enforcement has been doing enforcement on the entire portion of Coast Village Road and issued some citations for parking violations to include double parking, over time, red zone, etc.,” he said.

Asked to comment on the parklet/ parking unrest, Interim Police Chief Marylinda Arroyo said she agreed with Sgt. Ragsdale’s comments.

“The police department responds to calls for service 24/7 – 365, based upon priorities, the highest being imminent life and death situations,” she added. “Public safety in reducing harm is a mission strategy that includes enforcement as well as education citywide. Engineering, policies and code creation are key components that interact with the community and how we provide that service.”

So what happens now?

Sgt. Ragsdale said the city will continue enforcing its parking regulations.

“I believe it is the goal of everyone involved to handle these parking issues as quickly and professionally as possible,” he said. “We are all working together to solve these problems. The police department as well as other departments in the city responded quickly to these safety concerns. We are watching the situation closely.”

Mr. Bosse said the city will continue to address the parklet situation.

“The city will be initiating additional outreach to Coast Village Road merchants, the Coast Village Association, Coast Village Road restaurants, Coast Village Road employees and Coast Village Road patrons in the coming weeks in an effort to better assess the entire parklet situation,” he said.

Mayor Rowse said it’s time for the city — finally — to decide all issues concerning the parklets by adding new rules and regulations to the city’s parklet ordinance.

“There have to be some kinds of standards for what they were supposed

to be,” he said. “Coastal Village Road is a completely different animal than State Street but it falls under the same ordinance.”

The council’s ad hoc subcommittee, tasked to come up with them, is due to report back to the full council next month with its recommendations.

Councilmember Kristen Sneddon, a subcommittee member, told the NewsPress the panel is preparing to do just that.

“I have not seen the petition, but I have heard from merchants, and we are already in process of scaling the parklets back,” she said.

Coastal Village Road merchants and landlords propose a much simpler — and quicker — solution: Get rid of the parklets.

“The quantifiable infrastructural differences between Coast Village Road and downtown Santa Barbara ... require different treatment with respect to parklets,” they wrote in their petition.

“Extending parklets on CVR to the end of 2023 with only half of the parking required by the city’s municipal code

is unacceptable. Doing so will continue to negatively impact the majority (92 percent) of businesses, continue the current inequity on the street and further jeopardize public safety.

“We understand that adding 112 required parking spaces is impossible in the short term for many reasons, thus we request for the removal of parklets from the public right of way on CVR.” But according to Mayor Rowse, that’s easier said than done.

“It’s tough to take away something once you’ve given it to people,” he said. “I always say putting the genie back in the bottle is going to be a trick ... but it’s going to have to be done.”

Lucky’s general manager, meanwhile, said the restaurant is standing firm. “The city told all of the restaurateurs that we are good with the parklets through March 2023, and we’re counting on them to abide by that,” Mr. Schwartz said.

He suggested the city consider providing public parking in the area, pointing out the “huge lot” behind CVS, and space on Coast Village Circle that could be turned into municipal parking lots. “It would be amazingly wonderful,”

he said. “It would change the whole nature of things.”

At this point, Mayor Rowse said, there doesn’t appear to be anything the city can do immediately to address the petitioners’ demands or ease their concerns.

Allowing restaurants to add the parklets, he said, “is basically a tacit granting of extra seating that other people don’t get to enjoy,” he said. “Even if the restaurants are paying rent, it may make it more fair, but it does not help others who need parking.

“I don’t know how to replace parking for the other folks who want it,” Mayor Rowse said, “(but) this can’t stand. They both make a point practically and legally as far as I’m concerned. There may be a compromise out there. I’m not really sure.

“We’re a community and we all have to do great or none of us are doing great,” he said. “Retail is important to restaurants and restaurants are important to retail. We’ve all got to get along.” email: nhartstein@newspress.com

Each proposal must be submitted on the proposal form furnished with said documents. Each bid must be accompanied by a bid guarantee in the amount of not less than 10% of the amount bid, payable to the Goleta Cemetery District, and guaranteeing that the bidder will enter into a Contract in accordance with the terms of the bidding documents if award is made. The Contractor shall possess a valid State of California Class A, General Architect/Engineering Contractor’s License or California Class B, General Building Contractor’s License at the time of bidding and at the time of signing the Agreement for the work. The Contractor shall provide certification of license and expiration date on the proposal form.

Contractors and subcontractors who bid or work on public works projects must be registered with the California Department of Industrial Relations. [Labor Code Sections 1725.5, 1771.1] Note: This registration with the Department is separate and apart from the Contractors State Licensing process.

The Contractor will be required to furnish a Performance Bond and a Payment Bond, each in the amount of 100% of the Contract price.

Pursuant to the provisions of the Labor Code of the State of California, the Department of Industrial Regulations of the State has ascertained and determined the general prevailing rate of wages for each craft, classification or type of workers needed in the execution of Contracts under the jurisdiction of the Goleta Cemetery District. The Contractor and any subcontractor under him shall pay not less than the therein specified prevailing rate of per diem wages to all workers employed in the execution of the Contract. California part-timers may have tax obligations to the state

W

e know a bunch of folks in Santa Barbara County who seem to believe that if they are six months and one day absent from California, they have no obligation to file a tax return in this state but only in the state where they own or rent their first (or second) home.

This is known in tax law circles as “The Six-Month Presumption.”

Turns out, these half-year residents are not only badly mistaken but have rendered themselves potentially liable to penalties and interest going all the way back to when they first arrived in The Golden State.

Local myth: If you reside in California for one day less than six months, you do not have to file an income tax return with this state’s Tax Franchise Board.

Reality: “The Six-Month Presumption” is only that, a presumption. The true test for deciding whether the FTB considers you a resident is what Chris Manes, a Palm Springsbased California tax law specialist, calls “The Plurality Rule.”

This is how that principle works, according to Mr. Manes: “Let’s say you spend four months in California, three months in what you consider your home state and spend the rest of the year traveling. The FTB would determine that you are a resident of California and must pay California income tax on the basis that you spend more time in California than what you call your primary home elsewhere.

“A special division of the FTB has for years systematically targeted seasonal ‘part-time’ residents — nonresidents who spend part of the year here — for audit. If the FTB finds significant taxable income coupled with meaningful contacts with California (such as a vacation home or long visits to the state), it can lead to the launch of a fullblown residency audit, which can fill state coffers with tens of thousands of dollars in back taxes — and years of legal wrangling.”

In other words, the FTB can determine that persons who consider themselves non-residents are, in fact, residents for the purposes of income tax, based not on time spent in the state but on the FTB’s “Closest Connection Test.”

The FTB’s website explains its underlying theory of residency: “Since your residence is usually the place where you have the closest ties, you should compare your ties with California with your ties elsewhere. It is the strength of your ties, not the number of ties.”

FACTORS FOR DETERMINING YOUR STATUS • Amount of time you spend in California.

• Location of your principal residence.

• Where your driver’s license was issued.

• Where your vehicle is registered.

• Where you are registered to vote.

• Where you keep your pets.

• Location of your healthcare providers, accountants and attorneys.

To this list, Mr. Manes adds The Plurality Rule and another determination: “How large is your home in California compared to your home in another state?”

Bottom line, said Mr. Manes, “If your stay in California is not of temporary or transitory nature… you are taxed on your income from all sources.”

DIRECT FROM THE FRANCHISE TAX BOARD A Public Affairs staffer from the FTB told The Investigator: “It is noteworthy that a taxpayer can be a resident of more than one state for income tax purposes.”

We offered the FTB two hypothetical cases for their view on what, if any, California tax obligations would exist: Hypothetical Case No. 1: Subject is retired and comes from another state, where he still has a home. He lives in the other state for five to six months of the

He files an income tax return in the state where he is from but not in California.

FTB response: “The issue is not necessarily whether a taxpayer is a resident of another state, but whether he is a California nonresident. That being said, residency cases are very fact intensive, and each case varies.

Generally, it’s not as simple as counting days. When a taxpayer is a nonresident of California, they will still have a California tax obligation if they have Californiasourced income.”

Hypothetical Case No, 2: Subject is a sculptor who has departed California, bought a house in another state, and intends to reside outside of California full time. However, subject continues to market his work through a California-based gallery.

FTB response: “When a taxpayer is a nonresident of California, they will still have a California tax obligation if they have California-sourced income.”

TOUGHER THAN THE IRS Last month Forbes magazine reported, “It seems like any connection to California is enough to get you taxed there,” adding, “the Franchise Tax Board is even tougher than the IRS.” Manes Law, again: “FTB auditors may appear out of nowhere to interview neighbors.

They can subpoena a taxpayer’s utility bills and credit card statements. Or you may receive the dreaded 4600 Notice demanding an income tax return as a prelude to a full-blown audit.”

“GENDER QUEER” Parents in Santa Barbara are in an uproar over a particular book available in the library of Santa Barbara High School that they consider to be under-age pornographic material. They further believe that the book in question, “Gender Queer,” violates state and federal obscenity laws because it contains obscene graphic images of minors.

One parent complained to the Santa Barbara’s County Sheriff’s Office, citing California Penal Code Part 1 Title 9 Chapter 7.5 Obscene Matter 311.1 (a): “Every person who brings into this state or possesses any obscene matter knowing that the matter depicts a person under the age of 18 years personally engaging in or personally simulating sexual conduct shall be punished either by imprisonment in the state prison, by a fine not to exceed $10,000, or by fine and imprisonment.”

The Sheriff’s Office determined that because SBHS is in the city, the Santa Barbara Police Department has jurisdiction to investigate, not county law enforcement.

So the parent took “Gender Queer” and a copy of the penal code to SBPD and showed both to Police Officer Mark Corbett who, after viewing the material, concurred that it appeared to violate California’s penal code (said the parent), wrote up a report and sent it to the Investigation Section where it was issued a case number: 22-30769.

Three weeks later (this past Wednesday), the parent learned that Sgt. Mike Brown of SBPD decided not to pursue an investigation.

The book, by Maia Kobabe, who describes herself as “a binary, queer author,” is panned on Amazon by one reviewer as “perverted, coarse, unadulterated pornography targeted to children.

This is pedophilia. Evil.”

It is therefore no surprise that Bay Area Reporter, which serves the LGBTQ community in San Francisco, gleefully calls “Gender Queer” the “most banned” book in the USA. They wrote: “School boards in Virginia, Florida, North and South Carolina began pulling the book from library collections” due to “nude characters and sexual scenarios that they deem inappropriate for children.”

Last month, “Gender Queer” was removed from the library of Fairview High School in

Pennsylvania.

Christy Lozano, a local educator who ran unsuccessfully for Santa Barbara County superintendent of schools earlier this year, told The Investigator: “This material is pornography and has no place in the hands of children. In all my years, I have never been handed a book with descriptive pictures of a man and woman engaging in this type of sexual behavior but all of the sudden somehow it’s OK when it is two males. No, it is absolutely NOT OK. The school board members should be held responsible for allowing such materials in our schools; it is they who approved it.”

We reached out to Sherri Bryan and Elise Simmons, librarian and principal, respectively, of SBHS, for an explanation. We were referred to Nick Masuda, chief of communications for the Santa Barbara Unified School District.

Despite having provided threeand-a-half weeks for a response, we heard nothing back.

We reached out to SBPD for comment on how and why Sgt. Brown reached his decision not to investigate.

The public information officer, Sgt. Ethan Ragsdale, told The Investigator, “We did accept a citizen counter report about the matter. The report was reviewed and determined there was no crime according to California law.

The case is now closed.”

POLONIUM PUTIN THE POISONER PUNISHES ANEW? The latest Putin poisoning victim appears to be Anatoly Chubais, the 67-year-old former Putin adviser who abruptly resigned from his top job and fled Russia soon after Putrid Putin’s brutal invasion of Ukraine earlier this year.

A few days after Mr. Chubais’ departure, Russian President Vladimir Putin blasted Russians “who can’t live without foie gras or oysters.”

In a threatening message that seems to have been aimed directly at the Kremlin’s former chiefof-staff (and who, in 1996, gave Mr. Putin his first Kremlin), the Russian dictator announced that his nation “will always be able to distinguish true patriots from scum and traitors and will simply spit them out like an insect in their mouth, spit them onto the pavement.”

Mr. Chubais was admitted to a hospital in Sardinia last Sunday after falling ill from a rare neurological disorder that caused his arms and legs to go numb along with facial paralysis.

Italian intelligence services are said to be awaiting blood test results to determine if Mr. Chubais has been spat onto the pavement like an insect by Putin the Poisoner.

Meantime, the usual bozos in Washington, D.C., are actually considering a prisoner swap: Viktor Bout for WNBA player Brittney Griner.

The White House is counting on the voting public not noticing the difference between a highly dangerous man known as “The Merchant Death” who was sentenced to 25 years in a maximum-security penitentiary for, among other crimes, “conspiracy to kill U.S. nationals” and a basketball player who brought less than a gram of cannabis oil into Russia, for which she was harshly sentenced earlier this week to nine years in prison.

If released, Mr. Bout will pose a huge threat to the national security of the United States.

Does anyone at the White House care?

No. Asked to choose between national security and what they hope will be a public relations success, well, for this administration, that’s no contest.

Such an unbalanced trade will serve only to incentivize the putrid Putin regime into taking new hostages for future swaps while providing Mr. Putin (who is laughing at the United States for its sheer stupidity) a major victory.

Live programs and exhibits are being offered this month to watch local bats — close to 300 — come to feed at two bat boxes, which are artificial roosts designed to encourage bats into areas where there are few roosting sites.

Led by Nature Center hosts, “Going Batty” presentations take place at 7:45 p.m. Saturday, 7:35 p.m. Aug. 20 and 7:25 p.m.

Aug. 27 at the center, 2265 State Route 154.

Admission is free, but donations are appreciated.

Paul Collins, a biologist with the Santa Barbara Museum of Natural History, has completed a two-year research project on the bats, which he has identified as Myotis Californicus Bats, which are considered micro bats.

His research reveals the following information: • Their body length is from 1½ to 2 inches, and they weigh less than an ounce, but their wingspan is from 6 to 9 inches, tip to tip. The females are slightly larger than the males.

• Bats are mammals and birth one pup a year, usually in May or June. Pups feed on mother’s milk for several weeks.

• Bats stay in the canopy of trees eating mosquitoes and other insects and moths. They must eat about 1/3 to ½ their weight, and they can live from 20 to 30 years.

• For their sense of hearing, bats rely on an echo of sound transmitted back to them called echolocation. This is Please see BATTY on B4

ullies are not just limited to the schoolyard.

Workplace bullies are all too common, as are bullies at home. And of course, there is no shortage of social media bullies, or those who like to make their demands known publicly. We also have — and there are those who even applaud — a few celebrity bullies. Not exactly a good example to set for the children of the world.

A bully may claim they love their family, yet they will harm those closest to them when they don’t get their way. A bully may save their negative, pent-up projections for their fellow employees and turn into Atilla the Hun at work. But bullies can take less obvious forms as well.

Even road rage is a form of bullying from people who just can’t hack it when they don’t get their way.

If someone is bullying you, there is a solution. You can usually find a way to make them stop.

Here’s an example. A group of employees was feeling undervalued at work because the self-proclaimed group leader kept taking full credit for the others’ work. If anyone confronted him, the bully would make some kind of threat, akin to blackmail, until the person who was trying to fix the problem backed off.

Finally, the group did its own work without including the bully and then presented their work to the boss.

The boss immediately recognized what had been going on, which solved the problem. The bully was later fired.

Sometimes the bully in the family is the 3-year-old who may have become too used to getting their own way. In this case, simply valuing, teaching, and rewarding kindness — and doing it consistently — can shift the family dynamic. It takes a total family effort and, trust me, it’s worth it.

When kindness starts at home, it prevents the roots of bullying from taking hold.

Once a bully sees they can get what they want through physical power or intimidation of some kind, they like the feeling that comes with it. They feel empowered, and those of us who have suffered at their hands have to learn to take our own power back.

Sometimes that may mean taking a loss or walking away from the relationship, whether personal or professional.

Bullies are abusers, and abusers won’t get the message until they lose something big.

Depending on the situation, you may need to quit your job and reinvent yourself or leave your home and find a new life somewhere safe and supportive. If physical abuse is going on, this is your best option.

In other cases, you can often fight and win something back from

the bully. When you stand up for yourself and you win, it changes your life.

Maybe you don’t win it all. You don’t need to profit or get even from this process; you just need to get free, so keep that focus. Look at yourself and understand that you don’t deserve to be treated this way by anyone.

Please stand in your power and take it back from whoever tries to take it from you. This is your essence as a human being, so don’t let it be hijacked.

And you don’t have to do this alone. Many support groups offer answers. Just ask the Google gods.

Botanic garden’s virtual lecture series continues Aug. 19, Sept. 16

Two online talks remain in Santa Barbara Botanic Garden’s 2022 Summer Virtual Lecture Series, which explores research and conservation work of leading researchers and garden staff about biodiversity, climate change, and California’s native plants, birds and insects.

Registration is now open for lectures on Aug. 19 and Sept. 16, both held online from 6:30 to 7:30 p.m. The cost for the public is $12 and $10 for garden members.

“Climate Change and Drought Extremes: A Critical Perspective from Ancient Trees in California” will be presented Aug. 19 by Dr. Daniel Griffin, assistant professor of geography, University of Minnesota. How is extreme drought in California connected to climate change and human activities? What can be learned about past and future climate using tree rings from old growth forests in California?

Dr. Griffin, a dendrochronologist (scientist who studies tree rings), connects the dots between humans, climate change, extreme drought and native plants in the Golden State.

a perceptual system where ultrasonic sounds are emitted by the bat specifically to produce echoes. The delay of the returning echoes gives the bat the ability to estimate the range of their prey. Microbats use echolocation for navigation and finding prey.

• Small, mouse-eared bats have small feet, and their fur is pale brown, sometimes with a yellow cast.

• Bats are found in caves, mines, rocky hillsides and under tree bark and shrubs from British Columbia and through the west coast of the U.S., Mexico and Guatemala.

They may migrate in winter and roost alone or in small groups in

warmer months.

“There are two bat boxes at the Nature Center,” said Julie Anne McDonald, executive director. “The first was designed, built and erected in October 2013 by Michael Marlow, a volunteer. It is suspended between two poles 16 feet off the ground. It is located behind the garage of the Nature Center in the native garden.

“Mr. Marlow built a second bat ‘condo’ five years later to accommodate the expanding bat population. Guano under the bat boxes accumulate over time, and it is important to not go near the guano.”

Two Nature Center volunteers counted 272 bats flying out of the box at dusk on Sept. 28, 2015, and 238 on May 10, 2016. The bat population since then has continued to expand.

“Neal Taylor Nature Center is located within Cachuma Recreational Area in a picturesque old ranch house,” said Ms. McDonald. “Developed and operated by a corps of committed volunteers, it offers exhibits on the local valley and mountain environment for all ages, emphasizing hands-on exhibits for children.” email: mmcmahon@newsspress. com

Brian Kelly, the mastermind behind the Funk Zone, was never offered any money by the city of Santa Barbara to help with the downtown planning and design. Imagine if they had offered Mr. Kelley even $250,000 to help them fix State Street, way back when?

No, what they did was pay Kosmont $84,000 for an analysis. Then they hired Jason Harris for $182,000, for the economic development of State Street.

Mr. Harris comes from Santa Monica, with its threeblock horizontal Third Street Promenade, NOT the one-mile vertical being proposed for State Street, which spills out directly onto the beach.

Still, nothing happens.

Lastly, the city creates the State Street Advisory Committee and hires this San Francisco Company (MIG) for $800,000-plus.

When will we get a workable plan?

Santa Barbara, be aware that the American Institute of Architects has been relentlessly advising the city for everything to which THEY want to change Santa Barbara downtown. Which is taking our parking lots for high-rise, highdensity housing units, which will change its skyline and the ambiance,and destroy the charm forever.

Remember Rob Dayton, the former head of transportation, who said that we needed a shuttle to bring the people and employees to the Funk Zone because of a lack of parking?

Recall also when the city was put on notice because the tour buses parking on Montecito Street endangered the drivers as they crossed into oncoming traffic? Then Mr. Dayton proposed the e-bikes would move in and receive free land to park their bikes, taking away the shuttle space. And now the shuttle is gone ...

Do you remember Michael Rosenfeld, who built the Hotel Californian, only getting approval after he paid to increase the sidewalks on lower State Street and remove a driving lane? And he was also required to build and provide a city parking lot. Why then is the developer with the project at 121 E. Mason St. allowed to build without a city parking lot in the Funk Zone without having to pay to build the pedestrian sidewalks there?

But a bad precedent has been set by the “development agreement” the city made for the approval of the behemoth 4-story (52-foot), 82-unit building approved at 701 N Milpas St. Now for the 121 E. Mason project, the city is also considering a “development agreement.” And according to staff, the project moves with the “development agreement.”

Campaign promises or performances?

he approaching of the season of the bombardment of the campaign promises brings with it the question. Should we base our votes on campaign promises or performances?

Consider the campaign promises by presidential candidate Joseph Biden Jr., which he repeated on his Inauguration Day of Jan. 21, 2021, of “I will shut down the virus, not the economy.

We’re mounting an aggressive, coordinated, equitable and professional response to get the virus under control as soon as possible.”

Have these happened?

On a lighter note, his use of the four modifiers of “aggressive, coordinated, equitable and professional” reminds me of the words of Mark Twain’s “I didn’t have the time to write you a short letter, so I wrote you a long one.”

On a serious note: How has he applied these modifiers to the virus and the economy?

The performance of the candidates was a choice between one whose 40-plus years in government was, well, to be kind, “nondescript,” with his major successes being his involvement with his son Hunter’s businesses, versus a candidate who “aggressively, coordinated, equitably, and professionally” during a presidency where the U.S became energy independent (for the first time), along with a full Strategic Petroleum Reserve and inflation of only 1.4%, after spending 40-plus years building and running multiple successful businesses while employing his sons, rather than vice versa.

My election to the Assembly, from our local district that had long been part of the Democratic majority in the Assembly, was one of the surprises that gave the Republicans a brief majority in 1994. As he rightly states, a long struggle, very ably led by Assemblymember Willie Brown, brought back the majority to the Democrats, which they have held ever since. I was the last local Republican elected to state office after my two terms in the Assembly.

By the way, WIllie Brown was an exceptional leader and politician, who I believe would be concerned about the policies and leadership that control our state these days.

We all know the Democrats, currently, have the Republicans well beaten locally, in organization, funding, registration and ambitious candidates. I can only hope the voters take a long and careful look at the state of California and the country before giving the present leadership their vote this year.

SBCC’s COVID-19 policies exclude people

his is a letter I wrote to the trustees at Santa Barbara City College: I’m writing today to bring attention to your egregious COVID-19 policies that you are still enforcing on your campus and how it is negatively affecting the students and community.

There really is something rotten going on at Santa Barbara City College. Knowing that the school claims to care greatly about “equity and inclusion,” due to even my own experience attending the school from 20172020, I am seriously disturbed

that your commitment to these virtues does not actually include everyone.

I am part of the marginalized, and shunned group of the “unvaccinated”,” “untested” and “unmasked.” Because of this, many theater supporters, friends and myself were unable to attend your summer musical even though we have been big supporters in the past and have friends in the cast. We find it necessary to boycott your production and stop supporting your department due to your illegal policies.

My friends and I also boycotted last year’s music production and plays. We are very sad that you have forced us to miss out on what used to be some very good performances, and unfortunately, you will continue to see fewer audience members and less income as time goes on.

Regarding income, you are also losing out on state funding, with attendance down 50% since before COVID started, and I would think you would care about that, too. (I am also not taking classes, either, and am not able to finish the classes for my interior design degree until these policies are lifted.)

The reason these policies are illegal is that: 1. Only a licensed medical professional is qualified to give medical advice such as wearing a mask, which negatively affects the respiratory, neurological and immune systems. I have a medical exemption for mask wearing due to my medical issues, and SBCC has no accommodations for my disability that are acknowledged for entrance to the theater. It is not up to the teacher’s union or the Board of Trustees to decide what medical procedures I must take.

2. Practicing medicine without a license is an offense punishable by law.

3. There is no law in California that requires anyone to wear a mask into any business establishment, take an emergency use authorized only injection, or take an invasive test.

Guidelines are not laws.

4. Equal access into, and accommodations for us at any business establishment, whatsoever, are protected by law.

No citizen may be discriminated against based on a health condition under CA Civil Code 51(b).

Requiring that I, or anyone else, be “vaccinated,” tested, or masked for participation in any activity at the school is a violation of federal law. These are merely guidelines and should have been used as such since the beginning.

Again, preventing entry into your theater based on someone’s appearance, (bare-faced), or health condition, (“unvaccinated”, or untested), violates several laws under the authority of: • The Constitution of this state.

• The United States Constitution.

• Federal civil rights law (Title 11, Section 2000) • This state’s civil rights laws that prohibit discrimination.

It is against the law to refuse entry to your establishment, which is open to the public.

Declaring this is your school policy does not absolve you from your violation of the law. You are personally responsible for these

infractions. We are also no longer in a “state of emergency,” and NO EMERGENCY supersedes anyone’s rights.

It is my hope that you will take this seriously, and immediately cancel all of your COVID protocols. Not even the state of California has any of these mandates anymore, and it is even allowing concerts of over 1,000 people to go freely with no precautions. Please live up to your commitment to equality for all people and students, not just some preferred, underrepresented groups.

In the last two years, estimates are that enough fentanyl has been introduced into our country to kill every single person.

Most foreigners being trafficked are Mexicans and Central Americans (mostly from Honduras, Guatemala, and San Salvador), but it is not unusual to find people arriving at our southern border from all over the world. Recently, more than 9,000 Russians arrived there.

For Ukrainians displaced by war, it is easier to purchase transport from a cartel to enter the U.S.A. than to try to enter legally as refugees. In March of this year 3200 Ukrainians arrived at the southern border.

The traffickers run a wellorganized business with the complicity of many officials in Mexico. No country would allow millions of individuals, many of them foreigners, to pass through up to 1,000 miles of their territory without some level of complicity.

AOC is putting together another You Tube video hoping this one will garner real sympathy that making about $200,000 is not enough money, and all the while she continues to ponder how did old Nancy become a multimillionaire working a government job?

Meanwhile, Rep. Liz Cheney is leaning over her bathroom sink, staring in the mirror trying to relax her permanent smirk because she’s been so proud of herself. And President Joe Biden is whispering in Dr. Jill Biden’s ear, “Is it Taco Tuesday yet?”

What do the above have in common?

They are all clueless to the world they created from the sheltered life in which they live.

Each week I struggle to write my column, not because I don’t have something to write about, I have too much to write about.

I get OCD bouncing from one chaotic issue to another.

But one thing for sure, I will continue to harp on what I still consider the biggest crisis our country is facing today, and that’s our open border. This week I’m going to narrow it down to something I recently learned that made my jaw drop.

There have been gangs in one form or another in this country since its inception. Over time they’ve expanded, and a large majority of stabbings, shootings and murders today are gangrelated, and we’ve just come to accept them.

I’ve worked for nearly 50 years farming, and some of my best friends have been my Mexican partners. Over the years, things changed for them, their trips to Mexico became less and less. They were frightened to go. Thirty years ago they never thought twice about driving across the border to visit family.

That stopped when some had their cars stolen by bandits. It wasn’t worth the risk anymore.

We’re all well aware how the cartels control Mexico and the amount of people they kill is staggering. Some 35,000 people were murdered in 2020, and more than 11,000 have been killed so far this year.

We’ve heard the stories of busloads of kids being kidnapped, then people found mass graves. Or there were heads sticking to poles warning others you could be next. Cartels have become so powerful you can longer put that genie back in the bottle.

Which brings me to the crux of this column. We are allowing it to happen here. When the Democrats opened our border, we were annexed to Mexico.

So when I learned how Mexican and Chinese cartels set up pot farms in the forests of Northern California, I wasn’t entirely surprised. What surprised me was the enormity of those farms and the utter lack of available law enforcement to do something about it. Local

aybe there’s a small glimmer of hope for the Left Coast after all. First, San Francisco voters recalled George Soros-funded District Attorney and crimeenabler Chesa Boudin. Now, even liberal Oregonians have kicked an East Coast media elitist to the curb and slapped “return to sender” on the carefully crafted package of Nicholas Kristof’s selfserving phony baloney.

Digging in his clown-shoe heels, Mr. Kristof lambasted the “failing political establishment” for exposing his fake candidacy.

But for all his bloviating about how much he considered Yamhill County his home, Kristof confessed to Politico that he didn’t even know who the mayor of the city of Yamhill was. She, however, certainly knew him and what he was up to: “There’s a sense here that we’re being used,” Yamhill Mayor Yvette Potter told Politico. “He’s using us to achieve a personal goal.”

Indeed. Kristof raked in $2.5 million within two months of announcing his candidacy last fall. Among his top out-of-state donors: Melinda French Gates, Angelina Jolie, former Facebook bigwig Sheryl Sandberg’s fiance,

and former Goldman Sachs vice president David Cohen. Mr. Kristof’s wife (who snagged a plum position with the Oregon Public Broadcasting board of directors after hubby’s campaign train was derailed) will now oversee nearly $1 million in unspent campaign funds funneled into a new political action committee called “Oregon Strong.”

Oh, and while wifey returns to New York, Mr. Kristof will hang out in Shamhill a little while longer to maintain the appearance of being a good ol’ Oregon farm boy — and to finish his next book, a “journalistic memoir” soon to be hailed by The New York Times and to top the New York Times bestselling book list for far longer than he was a consultantmanufactured gubernatorial candidate.

Chalk up the whole Kristof clown adventure as yet another noble public-service sacrifice on behalf of the downtrodden and voiceless. Get woke, never go broke.

Tens of thousands have applied for the exemption, and applications tripled last year.

YouTube star Logan Paul moved his show from California to Puerto Rico to take advantage of the tax deal.

Investor Peter Schiff says, “I did it for the obvious benefit of being able to keep most of what I own ... It’s too bad that Puerto Rico didn’t do this decades ago. They wouldn’t be in the economic trouble they are today.”

Given that this tax break is so big, it’s surprising that most Americans haven’t heard about it.

“People just don’t really talk about it much,” says Ms. DaSilva. “There’s this fear that people from the state side are going to come down and take over everything.”

Why Is everyone talking about the Claremont Institute?

n Wednesday, Elisabeth Zerofsky of The New York Times Magazine published a lengthy essay titled, “How the Claremont Institute Became a Nerve Center of the American Right.”

Ms. Zerofsky’s piece was well-researched, honest and measured, but the same cannot necessarily be said for other recent fulminations against the California-based conservative think tank. Less than two weeks ago, The Washington Post published one such sordid entry, disproportionately focused on the Jan. 6, 2021, jamboree at the U.S. Capitol, titled, “The Claremont Institute Triumphed in the Trump Years. Then Came Jan. 6.”

Other examples abound.

Claremont’s alumni ranks include national television and radio hosts, a sitting U.S. senator, numerous federal judges and many other notable conservative activists. Its flagship publication, the cerebral Claremont Review of Books, has existed for over two decades.

But Claremont clearly has made gains in stature, clout and the depth and breadth of its institutional reach over the past half-decade or so. From an intellectual perspective, that is attributable to the fact that many leading Claremonsters have been, and continue to be, defenders of former President Donald Trump and/or proponents of the sort of nationalist and conservativepopulist policies that now anchor the “New Right” challenge to the conservative establishment’s regnant right-liberal “Fusionism.”

The American Mind, Claremont’s online journal founded in 2018 as an edgier complement to the CRB, has quickly emerged as a leading organ of the young online Right.

Meanwhile, the ABR ticked off reasons it wasn’t “all wrong” on its compatibility checklist —the most egregious being “not obstructing public views.” This is priceless.

The very hypocrisy was when the ABR member asked the project manager, “Tell me again why the property is oriented at an angle?”

The project manager blatantly replied, “For the views.” Oh, for the very views, the ABR continues to aver are NOT a factor.

During this same ABR meeting, 150 letters of protest were received against this project for the 45 feet — asking for 60 feet in height, 155 units. Numerous speakers at the podium begged the ABR to deny the project as is. They noted it’s too large, unattractive, out of scale, blocking mountain views, exceeds the height limits, would dominate the Funk Zone, and displaces users of commercial fishing. CPA Citizens Planning Association spoke against it, and others said the Castagnola legacy would be lost rather than protected and revered.

We know what is going on here.

As a community, we just seem unwilling to stand up to stop it.

a mishmash of riff-raff lean-tos, more reminiscent of a Middle Eastern bazaar. It’s a mess.

And the State Street Committee has just received shy of $800,000 for a “plan only,” which won’t be up and running for 18 months – 2-3 years? Or perhaps not even until 2030.

It seems hard to fathom what will hold attraction for State Street in the meantime. Sounds like the financing isn’t a done deal, except for the “Measure C”

Santa Barbara’s State Street could command the same notoriety as other famous world destinations. The Champ-Elysée in Paris, Park Avenue in New York City, Canal Street and St. Charles Avenue in New Orleans, Avenida Corrientes in Buenos Aires, Pennsylvania Avenue in Washington, D.C., and even the other State Street, the one in Chicago.

Imagine any of these famous boulevards with random parklets,

blocking traffic and cluttering their stately beauty.

And, unfortunately, the whole “promenade” question has become super politicized.

Some city council members recently suggested that they cannot support anything less than a closed downtown State Street, or they will lose the local Democratic. Central Committee’s endorsement in their next election.

How many registered Democrats who voted for this present city council and the last mayor are aware that those elected must acquiesce to represent that party’s agenda rather than to serve the needs of this very rare and unique community? Some of the contributors to this column are registered Democrats, and they didn’t realize it. And if they didn’t realize it, as involved as they are in city politics, how many other registered Democrats would be aware of this?

“Promenade” failures in both European and American cities are documented as far back as the 1970s.

According to Alan Ehrenhalt, “you don’t take cars out of downtown and expect people to flood in.”

Who besides developers in this city wants to build high density and to block views? Who wants to permanently reduce State Street to a series of parklets and bicycle lanes?

We can only imagine it is those elected who want to stay elected at any cost, forever changing Santa Barbara as we know it.

Cartels are stealing the precious water

Sheriff Matt Kendall of Mendocino County estimated there are at least 10,000 illicit grows.

There are only 21 deputies to cover 3,500 square miles. And here’s the kicker, even if it is illegal, it’s just a misdemeanor in California no matter how big the “farm” is. And unless you have proof they caused harm or killed someone, you likely can’t even get a warrant.

Gov. Gavin Newsom plays a big role in this with his sanctuary state. While he’s admiring his teeth and getting the right amount of gel in his hair, “his” state is going the way of Mexico. You won’t hear him say anything about cartels taking over vast swaths of land destroying his precious climate-controlled

environment.

He won’t be telling you that these cartels are knocking down trees in old growth forests to make way for more pot. Or the amount of trash and human feces covering the pristine landscape.

Or how pesticides brought from Mexico are poisoning animals and contaminating the soil. Nor, during a drought no less, how these cartels are stealing the precious water from the farmers and residents, thereby also having a major impact on the balance of nature for the spotted owls, deer, bears and the rest of the wildlife.

I would have to also assume there are diesel generators spewing the dreaded carbon throughout these once quiet woodlands. I think it’s high time the environmentalists march into those forests and give those cartel guys a piece of their mind.

Mike Sena, executive director of Northern California’s High Intensity Drug trafficking task force, which oversees 22 federally funded forces, said, “The number of missing people is insane.”

He added, “It’s the Wild West.

We’ve got people in gunfights on a regular basis over marijuana.”

The cartels have moved into America unhindered. They fear nothing. We’re not playing with fire, but a flame thrower. Mexican cartels don’t stop with drugs; they’d taken over the Mexican avocado farms years ago. If cartels can control the amount of guacamole to hit the market, you can bet these brazen killers have their tendrils in more places than we know in our American landscape.

We can thank all those Democrats nestled comfortably behind their walls eating ice cream and sipping coffee with their armed guards for putting us all in danger. And even if they have a clue, they’re not going to admit it, because they don’t think they’re doing anything wrong.

You want America to continue down the road of hell? Then keep voting in these people. You can cover your eyes and pretend there’s nothing to see here. But this is serious stuff.

We’re already paying big time for the lethal drugs the cartels are killing our kids with. Soon, turf wars will erupt. Ironically, Americans are fleeing to Mexico because it’s getting more dangerous here.

In many cases, people who have previously illegally crossed our border and are safely living here help by paying the full or part of the cartel fee, knowing well that they will share some of the newcomer’s benefits and in a short time be repaid with interest.

So far, the effort from our government to stop this criminal activity has been minimal.

President Joe Biden selected Vice President Kamala Harris to develop a plan to solve the illegal immigration problem. Her

only effort has been to visit some Central American countries and ask the people not to attempt the perilous journey. This tepid proposal was seen as a green light by the cartel and people planning to illegally come to our country, thus greatly accelerating the rate of arrivals at our southern border.

Unless our government supports immigration laws that require people to apply and receive permission to enter the country legally, it will continue to support and import criminal activity, enrich the cartel and kill many of our legal citizens!

“The precise nature of these complaints was not disclosed,” Christy says in a statement she sent to me, “nor were the names of those who made them. What is clear is that those who have complained are, at best, willfully

uninformed or, at worst, have agendas that do not include highquality educational outcomes for low-income, first-generation children. The fact that anyone would stoop so low as to pressure a renowned organization like United Boys and Girls Club to withhold educational opportunities for disadvantaged youth is unconscionable.”

Of course, she’s right about that, but my guess is that whoever those “anonymous” callers, texters, and/ or e-mailers are, they probably have a stake in maintaining the disgraceful educational status quo.

Ms. Lozano has asked for the opportunity to hold another public meeting to address misinformation, complaints, and concerns, but — at least as of this writing — Michael Baker, the executive director of the United Boys and Girls Clubs of Santa Barbara County, has declined to set aside a date or a meeting place, although he did promise Ms. Lozano that he would revisit the matter and share the goals of H.E.L.P. with his board members

on Aug. 16.

Christy says her hope is “that either the United Boys and Girls Club or another such organization will partner with H.E.L.P. to bring high-quality, proven educational outcomes to the most underserved.”

Her goal is both ambitious and noble. It won’t be easy — her detractors are determined and powerful — but I wish her great success in this endeavor as I don’t believe you’ll find a more dedicated, sincere and earnest supporter of good solid childhood education than Christy Lozano.

In November 2008, agreement was achieved on far-reaching trade accords, including direct shipping, expansion of weekly passenger flights from 36 to 108, and introduction of up to 60 cargo flights per month.

In 2010, the bilateral Economic Cooperation Framework Agreement was concluded. This has remained a major triumph for thenPresident Ma Ying-jeou.

His election as Taiwan chief executive in 2008 and 2012 greatly furthered cooperation with Beijing.

Taiwan is an essential investor for the economic revolution on the mainland.

I am very far from neutral on the question of the Claremont Institute. I am a proud Claremont alumnus, a regular participant in their alumni programs and a frequent American Mind contributor.

I was struck by Chris Rufo’s poignant description of Claremont, in Ms. Zerofsky’s Times essay this week, as a “brotherhood.” Mr. Rufo is spoton. And in that “brotherhood” sense — from an intellectual, professional and activist perspective — there is really no other organization on the Right quite like Claremont.

Perhaps most important, though, Claremonsters recognize — to use a phrase that itself has Claremont-world provenance — “what time it is” in America. We understand that the questions that now divide our fellow countrymen are not prosaic ones pertaining to tax rates or regulatory red tape, but the most foundational questions of all.

What are men and women? What is justice and injustice? Are America’s Founding principles and animating spirit, for that matter, just or unjust?

These are the kind of heady questions that are less Bush versus Gore than they are Lincoln versus Douglas. These are defining questions of human anthropology and the very basic

building blocks of civilization.

Amidst that sober, “Flight 93 Election”-esque societal backdrop, the political stakes very quickly become very high.

Inspired by the Harry Jaffapenned Barry Goldwater quip that “moderation in pursuit of justice is no virtue,” Claremonsters recognize that the time is now to reject the “principled loserdom” of the decadent old guard and command the battle stations in pursuit of outright victory over our recalcitrant foes in America’s roiling culture wars.

In our late-stage republic, there is simply no more time to waste.

Perhaps that, above all, is why Claremont has garnered so much attention of late. The fact that Claremont “knows what time it is,” and has been proven capable of operationalizing that sentiment at the highest levels of the American Right despite its modest institutional size, poses a unique threat to the ruling class and its corrupt regime.

The more success Claremont has, then, the more scathing the future hit pieces may become.

So be it — such is a small price to pay to salvage the American way of life from the ruling class’s treacherous talons.

But these new Puerto Ricans aren’t exactly conquerors.

They’re a mix of entrepreneurs, tax haters, crypto millionaires and ordinary people who just want to keep more of their money. By bringing wealth and skills to Puerto Rico, they create opportunities for Puerto Ricans. One report says they have already created 40,000 new jobs.

“If you don’t pay taxes, aren’t you hurting Puerto Rico?” I ask Ms. DaSilva.

“I do pay taxes,” DaSilva replies. “I provide other things as well.” She sells digital art and donates part of her sales to local nonprofits.

Billionaire Brock Pierce moved to Puerto Rico and now helps run the charity Toys for Tots. He also is renovating a hotel that was abandoned after Hurricane Maria. That’s expected to create 300 jobs.

Others are building hurricaneresistant farms, tech companies and schools.

But some people always see such investment as a problem.

Rep. Alexandria Ocasio-Cortez, D-N.Y., calls the tax incentive

“horrifying.”

“It’s an example of the continued colonization of the people of Puerto Rico,” she complains. “We are essentially importing a ruling class.”

She seems to think that if someone makes money, others must lose, as if there are only winners or losers. This is zerosum thinking.

It’s true in politics. But it’s not true in most of life. Wherever markets are free, new wealth gets created. Then almost everyone wins.

Ms. DaSilva has an answer to Rep. Ocasio-Cortez’s zero-sum thinking: “All ships rise with a tide,” she says. “Let’s all grow with this.”

Puerto Rico has tried big government, strict regulations, high taxes on businesses, handouts to favored groups, heavy borrowing and declaring bankruptcy.

I bet tax breaks work better.
