ATTOM has released a Special Housing Risk Report spotlighting county-level housing markets around the United States that are more or less vulnerable to declines, based on home affordability, foreclosures and other measures in the fourth quarter of 2022. The report shows that inland California, Illinois, New Jersey, and Delaware continued to have some of the highest concentrations of the most-at-risk markets in the country, with the biggest clusters in the New York City and Chicago metropolitan areas. Southern and midwestern states remained less exposed.

The fourth-quarter patterns – based on gaps in home affordability, underwater mortgages, foreclosures, and unemployment - revealed that New Jersey, Illinois, and California had 31 of the 50 counties most vulnerable to potential declines around the U.S. That was roughly the same as the 28 more-at-risk markets that were in those states in the third quarter of last year. During a time when the broader U.S. housing market boom stalled, those concentrations dwarfed other parts of the country.

The 50 most at-risk included seven in the Chicago metropolitan area, five in and around New York City, three in or near Cleveland, OH, and 13 spread through northern, central, and southern California. The rest were clustered mainly in other parts of the East Coast, including two of the three counties in Delaware.

At the other end of the risk spectrum, the South, Midwest, and western areas outside California continued to have the biggest concentration of markets considered least vulnerable to falling housing markets.

off considerably since the middle of last year, some areas of the country continue to show signs of being more at risk of a larger downturn than others. That’s based on several key factors that can either boost or damage local housing markets, including unusually high home ownership costs, foreclosures, and relatively weak homeowner equity,” said Rob Barber, chief executive officer at ATTOM. “It remains important to note that we are not identifying markets headed for an imminent fall, just those that look to be more exposed to market troubles. Heading into the peak buying season of 2023, we will keep monitoring those areas closely to see if anything changes.”

Counties were considered more or less at risk based on the percentage of homes facing possible foreclosure, the portion with mortgage balances that exceeded estimated property values, the percentage of average local wages required to pay for major home ownership expenses on median-priced single-family homes and condos, and local unemployment rates. The conclusions were drawn from an analysis of the most recent home affordability, equity and foreclosure reports prepared by ATTOM. Unemployment rates came from federal government data. Rankings were based on a combination of those four categories in 581 counties around the United States with sufficient data to analyze in the fourth quarter of 2022. Counties were ranked in each category, from lowest to highest, with the overall conclusion based on a combination of the four ranks.

The ongoing wide disparities in risks throughout the country remained in place during a time when the overall U.S. housing market had one of its worst second-half

performances in more than a decade. Key measures showed the national median home value decreasing 8 percent (down 4 percent specifically in the fourth quarter), while home-seller profits dipped lower, homeowner equity stopped growing, foreclosures continued to increase and mortgage lending plummeted to its lowest level in almost nine years.

That happened as 30-year mortgages rates climbed close to 7 percent, inflation remained at a 40-year high and the stock market fell. Each of those forces cut into what home buyers could afford.

Thirty of the 50 U.S. counties considered most vulnerable in the fourth quarter of 2022 to housing market troubles (from among 581 counties with enough data to be included in the report) were in the metropolitan areas around Chicago, IL, New York, NY, and Cleveland, OH, as well as in Delaware and California. California markets on the list remained mostly inland, away from the coast.

Construction spending dips 0.1 percent

Total construction spending decreased by 0.1 percent in January, as declines in single-family homebuilding and public construction offset marginal gains from private nonresidential construction, according to an analysis by the Associated General Contractors of America today of new federal data. Association officials said a lack of clear guidance from officials in Washington is delaying expenditures on much-needed infrastructure and energy projects.

“Laws enacted more than six months ago created unprecedented funding and tax credits for a wide range of transportation, environmental, energy and manufacturing projects,” said Ken Simonson, the association’s chief economist. “But few contractors have actually won contracts yet.”

Construction spending, not adjusted for inflation, totaled $1.826 trillion at a seasonally adjusted annual rate in January, 0.1 percent below the December rate, which was revised up from the initial estimate a month ago. Spending on private residential construction decreased for the eighth consecutive month in January, by 0.6

Elsewhere, California had 13 counties in the top 50 list: Butte County (outside Sacramento), Humboldt County (Eureka), San Joaquin (Stockton), Solano County (outside Sacramento) and Shasta County (Redding) in the northern part of the state; Fresno County, Madera County (outside Fresno), Merced County (outside Modesto), Stanislaus County (Modesto) and Tulare County (outside Fresno) in central California, and Kern County (Bakersfield), Riverside County and San Bernardino County in the southern part of the state.

Counties most at-risk of downfalls seeing elevated levels of unaffordable housing, underwater mortgages, foreclosures and unemployment

Major home ownership costs (mortgage payments, property taxes and insurance) on median-priced single-family homes and condos consumed more than one-third of average local wages in 34 of the 50 counties that were most vulnerable to market problems in the fourth quarter of 2022. The highest percentages in those markets were in Kings County (Brooklyn), NY (114.6. percent of average local wages needed for major ownership costs); Richmond County (Staten Island), NY (70.1 percent); Riverside County, CA (70 percent); San Joaquin County (Stockton), CA (63.6 percent) and Passaic County, NJ (outside New York City) (59.6 percent). Nationwide, major expenses on typical homes sold in the fourth quarter required 32.3 percent of average local wages.

At least 7 percent of residential mortgages were underwater in the fourth quarter of 2022 in 25 of the 50 most at-risk counties. Nationwide, 5.9 percent of mortgages fell into that category, with homeowners owing

percent. Spending on private nonresidential construction increased 0.9 percent in January, while public construction investment declined 0.6 percent.

Spending varied among large nonresidential segments. The biggest component, manufacturing plants, increased 5.9 percent. Commercial construction— comprising warehouse, retail, and farm construction—decreased 3.1 percent in January. Highway and street construction decreased 1.0 percent. Spending on power construction rose 0.9 percent.

Among other categories that are expected to receive funding or tax credits under federal legislation, investment in transportation facilities rose 1.7 percent. Outlays for sewage and waste disposal construction declined 2.5 percent, while spending on water treatment infrastructure decreased 5.9 percent.

Residential spending shrank due to a 1.7 percent contraction from December in singlefamily homebuilding. That outweighed increases of 0.4 percent in multifamily construction and 0.3 percent in additions and renovations to owner-occupied houses.

Association officials expressed

more on their mortgages than the estimated value of their properties. Those with the highest underwater rates among the 50 most at-risk counties were Peoria County, IL (18.5 percent underwater); Tangipahoa Parish, LA (outside New Orleans) (16.3 percent); Rock Island County (Moline), IL (16.1 percent); Saint Clair County, IL (outside St. Louis, MO) (15.5 percent) and Kankakee County, IL (outside Chicago) (14.6 percent).

More than one of every 1,000 residential properties faced a foreclosure action in the fourth quarter of 2022 in 44 of the 50 most at-risk counties. Nationwide, one in 1,549 homes were in that position. The highest foreclosure rates in the top 50 counties were in Saint Clair County, IL (outside St. Louis, MO) (one in 126 residential properties facing possible foreclosure); Cumberland County, NJ (outside Philadelphia, PA) (one in 376); Sussex County, NJ (outside New York City) (one in 435); Madison County, IL (outside St. Louis, MO) (one in 469) and Will County, IL (outside Chicago) (one in 523).

The November 2022 unemployment rate was higher than the national 3.7 percent level in 41 of the 50 most at-risk counties. The highest levels among the top 50 counties were in Tulare County, CA (outside Fresno) (8.6 percent); Merced County, CA (outside Modesto) (7.3 percent); Kern County (Bakersfield), CA (6.8 percent); Fresno County, CA (6.6 percent) and Madera County, CA (outside Fresno) (6.3 percent).

Midwest and South continue to have larger concentrations of less at-risk markets

Seventeen of the 50 counties least vulnerable to housing-market problems from among the 581 included in the fourthquarter report were in the Midwest, while another 15 were in the South. Just nine were in the West and nine were in the Northeast.

Land Real Estate Survey: Rural land to see mild correction this year

National Land Realty, the nation’s fastest-growing real estate land brokerage company—specializing in farm, ranch, country homes, timber, recreational, and commercial development properties—today released its 3rd annual land real estate agent and broker survey. Among the key findings are that while 2022 was a year with many properties appreciating, many agents see 2023 becoming a year of stabilization and limited depreciation, yet only a very small number of agents [7.54%] foresee a depreciation of more than 5%.

Agents are looking forward to 2023 being another busy year where they expect buyers to make use of opportunities offered by a limited price correction. They remain positive about their business prospects this next year with almost two-thirds [64%] either somewhat or very optimistic.

“Even with the macroeconomic headwinds on the horizon, most of our agents continue to be positive about their business prospects over the next year,” said Jason Walter, CEO of National Land. “Buyers continue to look for investments that offer stability in economically volatile times and land continues to be appreciated by investors for the stability it offers.”

The survey showed that there was a notable land appreciation in the rural land real estate sector in 2022 with almost two-thirds [64%] of agents seeing a slight to an often significant increase in land values, with recreational, farmland, and residential being the standout types.

“What is significant is that while our agents are seeing a positive business outlook in 2023, they are nonetheless expecting a softening of land appreciation with almost a third of them not expecting any appreciation at all,” said Walter.

Last year, brokers saw recreational land increase the most [49.07%], followed by farmland [20.37%]. Residential came in third with 17.59% of brokers saying that this type of land increased the most. Timberland [7.41%] and ranch land [4.63%] rounded out the top five.

Expert panel expects home prices will grow at a steady pace starting in 2024

Home prices nationally should bottom out in 2023 then return to a more normal growth rate, according to a Zillow® survey of housing experts.

Economists and housing experts polled in the latest Zillow Home Price Expectation (ZHPE) survey expect home prices to fall 1.6% through Dec. 2023. Affordability challenges are still

dragging down demand for homes – lower mortgage costs in January translated into sales that tracked pre-pandemic trends, but higher rates in February have since dampened buyers’ enthusiasm.

Starting next year, however, the panel foresees price growth picking back up, at an average clip of 3.5% per year through 2027 – the same rate that prices grew in the relatively stable period from 19871999, before the housing boom and bust cycle in the 2000s.

Zillow’s latest in-house forecast calls for typical U.S. home values to be nearly flat, rising 0.2% over the course of 2023. The largest declines are forecast in expensive California metros.

“The sheer number of people in the firsttime homebuyer age range and a lack of inventory should limit price declines. A return to more normal growth would be welcome after the rollercoaster ride that home prices have been on lately.”

Sales of existing homes are forecast to fall to 4.2 million in 2023 – up slightly from November and December’s seasonally adjusted annual rate of sales, but lower than 5.0 million sales in the course of calendar year 2022.

New construction – also expected to see sales decline this year – will likely play an expanded role to meet the need for inventory, said Tucker. Existing homeowners have been reluctant to list their properties and builders are giving buyers some significant financial incentives to help overcome affordability constraints.

The panel also expects mortgage rates to trend downward after the first quarter. Asked when rates for 30-year fixed loans will be highest between now and 2025, nearly two thirds (63%) pointed to Q1 of 2023. A distant second was the second quarter of 2023 at 22%, and subsequent quarters earned 6% or less. Falling rates are far more helpful for affordability than falling home prices, at least at the scale of recent movements. The median respondent projected a 6% rate for 30year fixed-rate mortgages at the end of 2023.

“The majority of experts are now predicting an outright decline in U.S. home prices in 2023,” said Terry Loebs, founder of Pulsenomics. “Although mortgage rates have moderated and are expected to remain close to the 6% level at year-end, the 2022 rate spike – and the record-high mortgage costs it ushered in – continues to shake home price expectations and market psychology.”

ENNICO: Before you start your business opportunity (part 2 of 2)

As part of the application process, some states will require you to submit financial statements (income statement, balance sheet and statement of changes in financial condition) for your most recently completed fiscal year. If more than three months have elapsed since the end of your most recent fiscal year, you may be required to submit updated financial statements for the current year-to-date.

In most states, your financial statements do not need to be reviewed or audited. A handful of states, however, require all financial statements to be audited, a process which may cost you as much as $10,000 to $15,000 in accounting fees.

If you are making claims that purchasers will earn at least a specific amount of money, or if you guarantee purchasers a return of their money at some point, some states will require you to post a surety bond, letter of credit or some other guaranty that you will be able to honor those claims when the time comes. (Kentucky requires a $75,000 bond from all registered business opportunities.)

A number of states limit the amount of

money you can accept from purchasers until they complete their training. If you require purchasers to pay the entire fee up front, you will have to put most of this money into escrow until you have delivered the training you promised.

Finally, a number of states require you to give purchasers up to three business days after signing your contract to change their mind and get their money back.

Do not attempt to set up a business opportunity without the assistance of a good lawyer AND a good accountant. You will need them.

You have built a successful business and have set up a training program to teach people how to start and run that business successfully. They don’t have to use your name, nor will they be given assigned territories. But they will have to pay a sizable upfront fee for the training program, and pay additional amounts for annual refresher courses, one-on-one coaching or consulting, and other services.

Congratulations, you will not be considered a franchise for legal purposes.

But condolences, you may have a business opportunity on your hands, and you will have to comply with a crazy quilt of regulations in 25 states.

Last week’s column focused on how to figure out when a business training program becomes a business opportunity. Once you know it is a business opportunity, here’s what you have to do.

First, you need to find out if you must give each participant in your program the disclosure statement required by the Federal Trade Commission. Check out the following webpage on the FTC’s website: www.ftc.gov/tips-advice/ business-center/guidance/selling-workhome-or-other-business-opportunityrevised-rule.

The FTC Business Opportunity Rule (16 CFR Part 437) dealing with “business opportunity ventures” regulates only one type of business opportunity -- the sale of vending machines or rack displays if you help purchasers find customers or locations. The rule defines a business opportunity venture as: (1) the seller sells goods or services which are supplied by the seller or a person affiliated with the seller; (2) the seller assists the buyer in any way with respect to securing accounts for the buyer or servicing accounts for the buyer or securing locations or rates for vending machines or rack displays, or

providing the services of a person able to do either; and (3) the buyer is required to make a payment of $500 or more to the seller or a person affiliated with the seller at any time before or within six months after the business opens.

If you fall within the FTC’s definition of a business opportunity venture, you must give each prospective customer a disclosure statement on the FTC’s printed form, which is available online at business.ftc.gov/ businessopportunitydisclosure.

If you do not come under the FTC’s jurisdiction, you may still have to comply with the laws of 25 states that regulate business opportunities. At the present time, those states are: Alaska, California, Connecticut, Florida, Georgia, Illinois, Indiana, Iowa, Kentucky, Louisiana, Maine, Maryland, Michigan, Minnesota, Nebraska, New Hampshire (for vending rack-type programs only), North Carolina, Ohio, Oklahoma, South Carolina, South Dakota, Texas, Utah, Virginia and Washington.

Virtually all of these states require you to prepare a disclosure statement conforming to the state’s requirements and deliver it to prospective purchasers at least X days before you take their money. (The “X” will vary from three to 10 business days.)

The good news is that the state requirements are fairly uniform: If your attorney does a good job preparing a disclosure statement for one of these states, the same statement probably will satisfy the requirements in other states with only a minimum of tweaking.

Some states require that you register your business opportunity with state regulators. This will involve preparing an application form, a disclosure statement and certain other documents, and submitting them for filing along with a fee, which is usually in the $100 to $500 range.

Some children are influenced by their parents’ conversations and know what they want to be when they grow up. Some make wild statements about their future from out of nowhere which miraculously come true. Others haven’t a clue as to what work means to their parents and to themselves. They announce a list of professions that leave their parents shaking their heads over what inspired their kids to think such things: A 5-year-old boy wants to be a firefighter because his dad talked about how a brave firefighter saved the family from burning. A 10-year-old girl watches the Academy Awards with her parents and wants to be a movie star. A quiet, lonely child with bizarre parents turns to making jokes as a way to shield himself from feeling his family is odd and becomes a comedian.

Children absorb far more than many parents acknowledge -- both good and bad, subtle and obvious behavior. Everyone has, at one time or another, been subjected to the spoiled child (now a rude co-worker) whose parents never taught positive discipline and manners, or the child whose parents offered nothing but criticism (now the micromanager). Athina D. had a choice in high school. She applied to a vocational school program where she would spend half the school day pursuing a technical education in cosmetology. After 1500 hours of in-class education, she would be eligible to test for a license. She attended for 3 1/2 hours a day, five days a week, and over spring and summer breaks. Between junior and senior year, she spent eight hours a day, five days a week in cosmetology school. She received her license in the summer of 2017, while she was still 18. With a realistic view of what it takes to own one’s own business, she decided she wanted to work for a large company. Since, by some estimates, the U.S. beauty and cosmetics industry made $49.2 billion in revenue for 2020, Athina will be a prime candidate for any marketing job in it.

Americans’ faith in banks low after failures: AP-NORC poll

WASHINGTON (AP) — Only 10% of U.S. adults say they have high confidence in the nation’s banks and other financial institutions, a new poll finds. That’s down from the 22% who said they had high confidence in 2020.

Following the collapse of Silicon Valley Bank this month, the poll from The Associated Press-NORC Center for Public Affairs Research also finds that a majority say the government is not doing enough to regulate the industry.

The underwhelming assessment of America’s banks and bank regulation comes after a series of shocks brought back disturbing memories of the 2008-2009 financial crisis.

Silicon Valley Bank, the nation’s 16thbiggest, failed March 10 after making risky bets in the bond market. Two days later, regulators closed New York-based Signature Bank, which had gotten involved in cryptocurrencies. Across the Atlantic Ocean, long-troubled Credit Suisse was acquired by rival UBS on Sunday in a shotgun marriage designed to restore confidence in global financial institutions.

In the United States, the tumult has raised questions among policymakers about 2018 legislation that rolled back strict regulations put in place after the financial crisis.

The poll suggests the U.S. public shares that concern: 56% say the government

“It’s like they have free rein to do whatever they want with money,’’ said Metscher, a Republican.

The poll finds that in addition to the 10% of Americans saying that they have high confidence in the nation’s banking institutions, 57% do have some confidence; 31% have hardly any.

Though confidence in banks and financial institutions has decreased even since the last time that question was asked on an AP-NORC poll in 2020, low confidence among Americans in their public institutions is nothing new — the General Social Survey, which has tracked trends in public opinion for decades, shows that confidence in institutions ranging from the financial industry to organized religion and from the news media to Congress has declined substantially since the 1970s. The new poll shows few Americans have high confidence in any branch of the U.S. government.

There’s been little change in the already glum assessment of the U.S. economy since a month ago, before the recent banking system turmoil, the poll shows. Only a

About half of U.S. adults describe their personal financial situations as good, a drop from last year when about 6 in 10 said that. About 6 in 10 Democrats and about half of Republicans give positive assessments of their current finances.

With a Democrat in the White House, Republicans are more likely than Democrats (36% versus 15%) to say their finances will get worse over the next year; 38% of Democrats say they expect their finances to improve, versus 22% of Republicans.

Overall, about half of U.S. adults expect U.S. economic conditions to deteriorate over the next year. Again, there’s a political divide: About three-quarters of Republicans but only a third of Democrats expect the national economy to worsen.

American households have been hit hard by inflation, which began to pick up in the spring of 2021. Adjusted for inflation, U.S. hourly wages have fallen for 23 straight months compared to a year earlier.

“You never know what’s going on. It’s paycheck to paycheck,’’ said Metscher in Sacramento. “I’m looking at food prices, gas prices. It reminds me of being a kid growing up’’ during the high-inflation 1970s.

Tyronda Springer, 28, a mother of two in Banks, Alabama, who works in a warehouse loading trucks, is struggling with the cost of living.

“I get paid every two weeks,’’ she said.

“It’s a financial house of cards,’’ said Bryan Martin, 49, of Westfield, New York, who works at a sewage treatment plant.

“The Fed is stuck,’’ said Martin, who does not identify with either political party but leans Republican. The central bank has to raise interest rates to fight inflation, but higher rates are hurting the financial system. “These banks,’’ he said, “are starting to fail.’’

Darlene Brady, 72, a retired nurse’s aide in Butler, Pennsylvania, has limited confidence in banks. Still, Brady, a Democrat, is not worried about her own bank savings, thanks to federal deposit insurance that covers up to $250,000.

Upon termination of a rental agreement, the tenant is liable for rent due under the rental agreement prorated to the effective date of the termination.

If the trustee is unable to convey title to this property for any reason, the sole remedy of the purchaser is the return of the deposit. Reasons of such inability to convey include, but are not limited to, the filing of a bankruptcy petition prior to the confirmation of the sale and reinstatement of the loan without the knowledge of the trustee. If the validity of the sale is challenged by any party, the trustee, in their sole discretion, if they believe the challenge to have merit, may request the court to declare the sale to be void and return the deposit.
