Opportunity Zone housing markets continue to keep up with broader price gains across nation in third quarter ATTOM has released its third-quarter 2023 report analyzing qualified lowincome Opportunity Zones targeted by Congress for economic redevelopment in the Tax Cuts and Jobs Act of 2017 (see full methodology below). In this report, ATTOM looked at 3,465 zones around the United States with sufficient data to analyze, meaning they had at least five home sales in the third quarter of 2023. The report found that median singlefamily home and condo prices rose from the second quarter of 2023 to the third quarter of 2023 in 54 percent of Opportunity Zones around the country and rose at least 5 percent in close to half. The price improvements in and around low-income neighborhoods where the federal government offers tax breaks to spur economic revival, again tracked closely with a nationwide rebound from a temporary dip in home values that hit last year. The renewed price growth also continued a long-term trend of home values inside Opportunity Zones following along with broader market gains for at least the last three years – an ongoing sign of economic strength inside some of the country’s most distressed communities. Opportunity Zone markets even showed signs again, by one key measure, of doing slightly better than other neighborhoods around the country during the third quarter of this year. A slightly larger
portion of Opportunity Zones versus other locations saw median values rise annually at a faster pace than they did nationwide. “The third-quarter price data shows that many of the country’s lower-income neighborhoods continue to come back from the brief downturn we saw last year, right along with the rest of the U.S. housing market. While there were exceptions, Opportunity Zones overall saw no extended backslide and continued to benefit from the boom that has spiked home values around the nation for more than a decade,” said Rob Barber, CEO for ATTOM. “That trend is likely connected to financially marginal house hunters getting priced out of more expensive locations and turning to places like Opportunity Zones for affordable homes. This should give investors looking to take advantage of Opportunity Zone tax breaks more welcome news about the potential for those neighborhoods.” Opportunity Zones are defined in the Tax Act legislation as census tracts in or alongside low-income neighborhoods that meet various criteria for redevelopment in all 50 states, the District of Columbia and U.S. territories. Census tracts, as defined by the U.S. Census Bureau, cover areas that have 1,200 to 8,000 residents, with an average of about 4,000 people. As they have historically, typical home values in most Opportunity Zones fell well below those in other neighborhoods
around the nation in the third quarter of 2023. Median third-quarter prices were less than the U.S. median of $350,000 in 81 percent of Opportunity Zones. That was about the same portion as in earlier periods over the past year. In addition, median prices fell below $200,000 in 49 percent of the zones during the third quarter of 2023. Considerable price volatility also continued in Opportunity Zones, with median values either dropping or increasing by at least 5 percent in more than three-quarters of those locations from the second quarter of 2023 to the third quarter of 2023. That again likely reflected the small number of sales in many zones. Still, the latest trends marked the second straight quarter in which Opportunity Zone home values, in general, erased losses seen during the downturn that lasted from the middle of 2022 into early 2023. That highlighted an extended scenario of home-price runups across the U.S. leaving a significant cluster of potential buyers with limited resources and few choices other than the lowestpriced communities. The apparently healthy demand in the third quarter continued even as home-mortgage rates climbed back up toward 8 percent for 30year fixed-rate loans over the Summer,

Construction sector adds 23,000 jobs in October as unemployment rate falls to 4.0 percent The construction industry added 23,000 jobs in October as unemployment rates for the sector hovered near the all-time low for the month, according to an analysis of new government data the Associated General Contractors of America released today. Association officials said the construction industry would likely have hired even more workers to keep pace with strong demand for construction. “Despite the fact pay for hourly craft workers in construction is rising faster than for production employees, contractors are still struggling to find enough skilled workers,” said Ken Simonson, the association’s chief economist. “Both residential and nonresidential construction employers want to hire even more workers.”
Construction employment in October totaled 8,033,000, seasonally adjusted, an increase of 23,000 or 0.3 percent from September. The sector has added 219,000 jobs during the past 12 months, a gain of 2.8 percent. Residential building and specialty trade contractors added 13,700 employees in October and 55,600 (1.7 percent) over 12 months. Employment at nonresidential construction firms— nonresidential building and specialty trade contractors along with heavy and civil engineering construction firms— climbed by 8,400 positions for the month and 163,300 (3.6 percent) since October 2022. The unemployment rate among jobseekers with construction experience was 4.0 percent in October, one of the lowest October rates in the 24-
year history of the data. A separate government report released earlier this week reported that there were a record-high 438,000 job openings in construction at the end of September, far exceeding the number hired that month and a further sign of contractors’ difficulty in finding qualified workers. Average hourly earnings for production and nonsupervisory employees in construction—covering most onsite craft workers as well as many office workers— climbed by 5.4 percent over the year to $34.64 per hour. Construction firms in September provided a wage “premium” of nearly 19 percent compared to the average hourly earnings for all privatesector production employees. Association officials noted that efforts underway in Congress to exclude the
construction industry from the H-2B visa program would only add to the industry’s labor shortages and undermine its ability to complete infrastructure and economic development projects. They urged Congress to boost investments in career and technical education programs and ways to increase the number of visas available for people with construction skills. “Contractors are trying to keep pace with demand for new infrastructure, clean energy and development projects, among others,” said Stephen E. Sandherr, the association’s chief executive officer. “Limiting to who can work in construction will only undermine the sector’s ability to deliver projects on time and on budget.” Staff report

Medians also were up from the third quarter of 2022 to same period this year in 1,880 (58 percent) of those zones with sufficient data. (Among the 3,465 Opportunity Zones included in the report, all had enough data to generate usable median-price comparisons from the second quarter of 2023 to the third quarter of 2023; 3,258 had enough data to make comparisons between the third quarter of 2022 and the third quarter of 2023). • But in a sign that Opportunity Zones again did a bit better than the rest of the country, median prices grew quarterly and annually by at least 5 percent in a higher portion of those areas. Typical values went up at least 5 percent
quarterly in 44 percent of Opportunity Zones with enough data to analyze and annually in 49 percent. • In addition, typical price increases exceeded national gains annually in a slightly larger portion of Opportunity Zones than elsewhere. The median single-family home value rose, year over year, by more than the national figure in 47 percent of Opportunity Zones tracts but just 43 percent of tracts outside the zones. (The nationwide median rose 6.1 percent from the third quarter of 2022 to the third quarter of 2023.) • Of the 3,465 zones in the report, 1,124 (32 percent) had median prices in the third quarter of 2023 that were less than $150,000. That was down from 35 percent of those zones a year earlier. Another 564 zones (16 percent) had medians in the third quarter of this year ranging from $150,000 to $199,999.
• Median values in the third quarter of 2023 ranged from $200,000 to $299,999 in 827 Opportunity Zones (24 percent) while they topped the nationwide thirdquarter median of $350,000 in just 670 (19 percent). • The Midwest continued in the third quarter of 2023 to have larger portions of the lowest-priced Opportunity Zone tracts. Median home prices were less than $175,000 in 66 percent of zones in the Midwest, followed by the Northeast (47 percent), the South (41 percent) and the West (6 percent). • Median household incomes in 87 percent of Opportunity Zones analyzed were less than the medians in the counties where they were located. Median incomes were less than three-quarters of county level figures in 54 percent of those zones and less than half in 14 percent. Staff report

NC Housing Finance Agency executive director reelected to National Council of State Housing Agencies’ 2024 board of directors
Scott Farmer, the executive director of the NC Housing Finance Agency, has been reelected to serve as a director on the National Council of State Housing Agencies’ (NCSHA) 2024 board of directors. NCSHA is a nonprofit, nonpartisan organization created to advance, through advocacy and education, the efforts of the nation’s state housing finance agencies and their partners to provide affordable housing to those who need it. Farmer was reelected during NCSHA’s 2023 Annual Conference and Showplace in Boston, Massachusetts. Directors are nominated from among, and voted on by, the executive directors of the member state housing finance agencies. Farmer leads the NC Housing Finance Agency, a self-supporting public agency with a mission to provide safe, affordable housing opportunities to enhance the quality of life of North Carolinians. Farmer has been with the Agency for 23 years, serving as executive director since January 2017 and as director of rental investment from 2005–2016. “I am honored to be reelected to serve on the NCSHA board of directors in 2024,” Farmer said. “I look forward to working with the other directors to drive positive change for our industry to help meet the nation’s affordable housing needs.”

U.S. foreclosure activity remains steady in October 2023
ATTOM has released its October 2023 U.S. Foreclosure Market Report, which shows there were a total of 34,472 U.S. properties with foreclosure filings — default notices, scheduled auctions or bank repossessions — down 6 percent from a month ago but up 6 percent from a year ago. “Foreclosure filings continue to paint a concerning picture,” said Rob Barber, CEO at ATTOM. “With foreclosure filings ranging from 31,557 in January 2023 to 34,472 in October 2023, it’s evident that challenges in the housing market persist. While we anticipate a likely decline in the coming months due to the holiday season and other seasonal patterns, we do foresee a continued uptick in 2024 as foreclosure filings make their way through the pipeline.”
Delaware, Ohio and New Jersey post highest foreclosure rates
Nationwide one in every 4,051 housing units had a foreclosure filing in October 2023. States with the highest foreclosure rates were Delaware (one in every 2,432 housing units with a foreclosure filing); Ohio (one in every 2,492 housing units); New Jersey (one in every 2,550 housing units); Maryland (one in every 2,565 housing units); and South Carolina (one in every 2,569 housing units). Among the 223 metropolitan statistical areas with a population of at least 200,000, those with the highest foreclosure rates in October 2023 were Cleveland, OH (one in every 1,403 housing units with a foreclosure
filing); Atlantic City, NJ (one in every 1,547 housing units); Spartanburg, SC (one in every 1,708 housing units); Bakersfield, CA (one in every 1,785 housing units); and Jacksonville, NC (one in every 1,848 housing units). Those metropolitan areas with a population greater than 1 million with the worst foreclosure rates in October 2023, including Cleveland, OH, were: Miami-Fort Lauderdale, FL (one in every 2,180 housing units); Riverside, CA (one in every 2,254 housing units); Houston, TX (one in every 2,269 housing units); and Philadelphia, PA (one in every 2,323 housing units).
Greatest numbers of foreclosure starts in Texas, California, and Florida
Lenders started the foreclosure process on 23,343 U.S. properties in October 2023, down 7 percent from last month but up 7 percent from a year ago. States that had the greatest number of foreclosure starts in October 2023 included: Texas (2,966 foreclosure starts); California (2,747 foreclosure starts); Florida (2,319 foreclosure starts); New York (1,405 foreclosure starts); and Georgia (1,054 foreclosure starts). Those major metropolitan areas with a population greater than 1 million that had the greatest number of foreclosure starts in October 2023 included: New York, NY (1,412 foreclosure starts); Houston, TX (1,132 foreclosure starts); Miami-Fort Lauderdale, FL (941 foreclosure starts); Los Angeles, CA (808 foreclosure starts); and Chicago, IL (705 foreclosure starts).
Foreclosure completion numbers remain unchanged from last month
Lenders repossessed 3,332 U.S. properties through completed foreclosures (REOs) in October 2023, down less than 1 percent from last month and down 20 percent from last year. States that had the greatest number of REOs in October 2023, included: Pennsylvania (297 REOs); Illinois (273 REOs); Ohio (231 REOs); California (219 REOs); and Michigan (216 REOs). Those major metropolitan statistical areas (MSAs) with a population greater than 1 million that saw the greatest number of REOs in October 2023 included: Chicago,

MARGENAU: ‘60 Minutes’ and Social Security Overpayments The CBS news program “60 Minutes” ran a story this past Sunday that was critical of the Social Security Administration and the way the agency handles overpayments -money sent to Social Security beneficiaries that they were not due. I’m going to address that issue in today’s column. But before I do, I’ve got to put things in perspective. If you watched the news story, you could come away thinking something like this: “Those dumb bureaucrats. They can’t do anything right. They are sending millions of dollars in incorrect payments to people every year!” But here is the dose of perspective you need to understand. Social Security is a $1.3 trillion per year program. And those millions of dollars in overpayments make up just one-half of 1% of the program’s annual payout. Or to turn that around, 99.5 percent of the time, people are being paid correctly. So, overpayments are a problem. But nowhere near as big a problem as sensational news stories would have you believe. Still, millions of dollars are millions of dollars. And the Social Security overpayment problem is an issue that needs to be dealt with. Why do people get overpaid? The biggest reason has to do with a simple law that needs to be changed. More about that in a minute. But first, let’s briefly deal with the main issue discussed in the “60 Minutes” story. Once it’s been decided that someone has been overpaid, should the SSA take the money back? “60 Minutes” essentially charged that the agency was being too ruthless in its overpayment collection efforts. In a nutshell, one part of the overpayment recovery rules says the incorrect benefits must be repaid if the person who got the extra money was at fault in causing the overpayment. Most people probably would agree that part of the rules makes sense. But what if the overpayment was the agency’s fault? On the one hand, you could argue that even though the SSA made a mistake, the overpaid person still got money he or she was not due and the money should be repaid. But others would argue that the government screwed up and they should write off the overpayment as a loss. The rulebook actually says that even if the overpayment was the SSA’s fault, it must be repaid IF the overpaid person can afford to repay it. And carrying out that rule can really get messy and be subject to different interpretations.
And on that issue, let me make this point. Many years ago, the SSA interpreted that part of the law much more liberally and was writing off (“waiving” is the legal term) many overpayments. And guess what? There were news stories critical of the agency for “wasting the taxpayers’ money” by not more aggressively collecting overpayments. So, you can understand why an old civil servant like me might be inclined to throw up his hands and say: “OK, people, what do you want? Do you want us to collect these overpayments or do you want us to write them off?” But we wouldn’t have to answer that question if a big part of the problem could be eliminated. So how do we do that? By getting rid of the No. 1 cause of overpayments: a provision of Social Security law that is rather archaically called the “annual earnings test.” It is sometimes also called the “retirement test.” (More about where those terms come from in a minute.) But I call it the Social Security earnings penalty. And I’ve never liked this law. Before I explain why, let me clarify what I am talking about. The rules say that if you are a Social Security beneficiary who is under full retirement age and still working, one dollar must be deducted from your Social Security checks for each two dollars you earn over a limit that changes annually. It’s currently $21,240. (Once you reach your full retirement age, that penalty goes away.) On the surface, the law seems pretty straightforward and you may wonder why it causes so many overpayments. Well, it’s because when you scratch beneath the surface, it is an absolute mess to administer. To illustrate, I’ll use my own mother as an example. Back in the 1970s, she was getting Social Security retirement benefits but she was working part time to supplement her rather meager monthly check. She would start out the year reporting her anticipated earnings to her local Social Security office. They would adjust her benefits accordingly, applying the one-dollar deduction for each two dollars earned. Then inevitably, as the year went on, she’d work a little overtime or pick up a couple extra hours of work. She would dutifully report her change in anticipated earnings to the Social Security people, and further adjustments would be made to her monthly retirement checks. More often than not, she’d be charged with an overpayment and be asked to return
some of her Social Security funds. Then maybe she’d be laid off for a time, and her earnings would go down, and she’d file yet another report with SSA and there would be more adjustments to her benefits. Sometimes the SSA owed her some extra money. Eventually, once the year was over with and she got her W-2 form, she would make a final report of her earnings to the Social Security office leading to yet another benefit adjustment -- usually another overpayment. And on top of that, they would ask for an estimate of her anticipated earnings for the new year, yet more adjustments would be made, and the whole vicious cycle would start over again. Even though my mom’s story took place in the 1970s, the same rules still apply today and the same problems still crop up today with millions of Social Security beneficiaries who are under their full retirement age but working. I’ve always been puzzled by the earnings penalty law. From a philosophical perspective, I just don’t understand why someone should be punished if they try to work and earn a little money to supplement their Social Security benefits. Having voiced that philosophical concern, I should point out that I know the practicality of the law. It goes back to the very beginning of Social Security in the
1930s. Retirement benefits were intended to replace earnings a person loses when he or she retires. Or to put that another way, a person had to retire to get “retirement” benefits. And this provision of the law was a “test” of their retirement status. (Thus, the term “retirement test.”) Initially, the law said you had to be completely retired. But over the years, Congress eased up on that restrictive nature of the original law. They said people over FRA could work full time and get benefits. But they set up the messy earnings “penalty” for anyone under FRA. So, get rid of that penalty and you will get rid of millions of dollars in overpayments every year. GOLDMAN: Swipe Right for the Perfect Job It’s frustrating! The perfect job is out there. You just don’t know how to find it. On the positive side, you do know where to look. It’s the same place you went to find your perfect partner. And the perfect place to live. And the perfect outfit to wear in the perfect place to live with your perfect partner. (So, OK, the cargo pants were a mistake, but nobody’s perfect.) It’s the internet, of course. On the last day of September this year there were approximately 9.55 million jobs posted online. One of them has to be perfect for you. The problem is: How do you find the needle of a perfect job in a digital haystack? Tom Dowd can help. Dowd is a Career Development Officer and Director of Career Coaching at Guild. He is also the author of a recent article in Fast Company titled “4 Things Many Job Seekers Get Wrong About Finding (and Landing) the Right Role. Only four things? The man is clearly an optimist. With so many open positions, you need a code book to translate what an employer really wants -- not easy to do when it’s likely the employer doesn’t know itself. This brings us to those four pesky mistakes you don’t want to make before
swiping right on your perfect job. No. 1: Putting too much emphasis on job titles Don’t be intimidated just because a job comes with a lofty title, like Director of Something-or-Other or Vice President of Whatchamacallit. The actual job duties that go with those fancy-schmancy titles may well be in your wheelhouse. If you doubt me, ask our Chief Asset Disposal Officer when he’s back from emptying the garbage cans. To determine the actual work that will be expected, “try matching the action verbs in your resume with what their employees are doing -- executing, managing, implementing.” The action words you are looking for are dozing, disappointing and making excuses. Newfangled “new age” titles like Number Ninja and Senior Enthusiasm Director can help. Companies that use such titles are clearly out of their corporate gourds and you should grab that job for Chief Goofing-Off Officer before they go out of business, which will be soon. No. 2: Using the job description as a checklist Don’t be intimidated by job descriptions that list 15 or 20 required skills, none of which you have. These must-have requirements are an “employer’s wish list.” Sure, they would
like to have a PhD in Computer Science and Information Technology from MIT, but they could settle for a BA in Cheese Management from Babybel University. Also, don’t be discouraged when you see “apparent entry-level positions that require one to three years of prior experience to apply.” Experience means nothing. You’ve worked at your current job for years and still have no idea what you’re doing. No. 3: Create an experience-based resume Technology continues to accelerate change in the workplace, especially with the implementation of wonderful, powerful and totally harmless artificial intelligence. (Note: The previous sentence was written by Bobbot, the AI program that my “loyal readers” have demanded take over this column.) The velocity of change means you must demonstrate your willingness to join “an adaptable, nimble workplace that can roll with waves of change.” Highlight your “capacity to learn and grow” with 100% true statements of principle, like, “I will be Silly Putty In your hands. You can squeeze me and squish me to implement your dumb ideas and I will never complain,” and “Bend me. Twist me. Hiring me is like hiring Gumby.” No. 4: Not going after what you want
Be aggressive. Tom Dowd recommends that you “put on your detective hat. Do some searching on LinkedIn for profiles of people who already work in positions that intrigue you.” I recommend you put on your detective hat and your detective shoes, too. Once you’ve identified your targets, follow them on- and off-line. Bump into them at their favorite coffee shop. (Spilling your pumpkin spice latte on their laptop is a great way to “meet cute.”) Follow up with a coincidental meeting in their therapist’s waiting room. On Saturdays, drop in at their homes for brunch. Bring a suitcase, as you will probably be invited to stay for the week-end. With an on-line connection you could get a referral, but with an off-line, reallife connection you could get something even more valuable -- a restraining order.
