With a Polar Class 6 rating, forward bow thrusters and an electronic Azipod propulsion system, Scenic Eclipse is able to safely navigate through Arctic and Antarctic waters.

Scenic Eclipse uses custom-built stabilisers that are 50% larger than those of other ships and will provide greater stability as it navigates the waters.

Scenic is also a proud member of the International Association of Antarctica Tour Operators (IAATO) and the Association of Arctic Expedition Cruise Operators (AECO). Autumn

January and February see the longest days of summer with nearly 24 hours of daylight and the temperature rising to a balmy 1 or 2 degrees Celsius (33-35F). The ice starts to break further south and it is playtime for the wildlife.

In late March and early April the sun sinks further below the horizon, nightly darkness returns, temperatures are still above zero although you may experience cold Antarctic nights that deliver beautiful patterns of thin sea ice. South Georgia and the Falkland Islands are teeming with unbelievable concentrations of wildlife.

Terms & Conditions Scenic Tours Ltd. Terms and Conditions including Ocean Cruises, River Cruises and Package Tours 1. Agency agreement 1.1 By registering, Scenic offers the passenger the arrangement of a binding travel contract. The registration can be made in writing or verbally. 1.2 The registration is made by the lead passenger but also for all other passengers listed in the booking. The passenger shall be liable for the obligations of all other passengers as well as for his own. 1.3 The travel contract is concluded, when the passenger receive the travel confirmation in written. If the content of the travel confirmation by Scenic deviates from the content of the booking, this shall constitute a new offer by Scenic, by which Scenic is bound for a period of ten days. The contract is concluded based on this new offer, as far as Scenic has informed the customer of the change regarding the new offer and has fulfilled its pre-contractual information obligations and if the customer approves, by making a payment.

Cancellation fees are due immediately. In the case of deviating cancellation conditions and cancellation cost regulations of external service providers involved in the journey, their cancellation conditions apply, if explicitly stated in the booking confirmation. 7.7 Scenic reserves the right, instead of the flat-rate compensation to request a higher, concrete compensation, so far as Scenic proves, that Scenic had essential higher costs as covered by the flat-rate. In this case, Scenic has to prove the requested compensation, considering the savings. 8. Rebooking and withdrawal by Scenic/unforeseen circumstances In the following cases, Scenic may withdraw from the travel contract in whole or in part, before the beginning of the journey or terminate the travel contract in whole or in part after the journey has commenced. 8.1 In the case of failure to reach a prescribed minimum number of participants, if Scenic has specified the minimum number of participants in the respective travel description and specified a time by which the customer must have received the declaration before the contractually agreed start of travel, and indicates in the travel confirmation the minimum number of participants and the latest withdrawal period, or refers to the corresponding information in the travel advertisement. Scenic is obliged to immediately notify the customer of the cancellation of the trip if it is clear that the trip will not be carried out due to the minimum number of participants having failed to reach. Withdrawal is to be notified to the customer no later than 20 days before departure for journeys longer than 6 days, until 7 days before departure for journeys of 2-6 days (up to 48 hours). Should it be apparent at an earlier date that the minimum number of participants cannot be achieved, Scenic will immediately exercise its rights to withdraw. If the trip is not carried out for this reason, the passenger will receive back the payments made, within 14 days after cancellation. 8.2 In the case of non-payment of the tour price after the due date and unsuccessful reminders 8.3 If the passenger seriously disturbs the conduct of the trip despite a warning from Scenic or acts in breach of contract to such an extent that the immediate cancellation of the contract is justified. If one of these reasons is proven, Scenic reserves the right to keep the travel price; the value of any saved expenses and any benefits that Scenic may incur from any other use of services not used will be taken into account. Any additional costs incurred for the return journey will be borne by the passenger. 8.4 Both the customer and Scenic have the right to terminate the travel contract, if the journey is considerably more difficult, dangerous or impaired due to unavoidable circumstances. If the return journey cannot be safely guaranteed, Scenic shall bear the costs of a necessary overnight of the passenger for a period not exceeding 3 nights, if possible in accommodation equivalent to that agreed in the contract. 9. Guarantee 9.1 If a travel service is not provided or not in accordance with the contract, the passenger can request a solution within a certain time period. Scenic is entitled to solve the situation by providing a substitute service of equal or greater value. The passenger is responsible for setting Scenic a reasonable deadline to resolve this issue. However, Scenic can refuse the query if it requires a disproportionate effort. 9.2 If a trip is significantly impaired as a result of a defect and Scenic does not resolve the situation within a reasonable period of time, the passenger may, in their own interest and with reasons of proof, terminate the travel contract in accordance with the statutory provisions. A deadline for the solution is not necessary if the query is impossible to solve,

or the query will be denied or if immediate termination of the contract is justified, in the special interest of the traveller. If the contract is terminated, Scenic reserves the right to the agreed travel price with regard to the travel services rendered and still to be provided and to terminate the package holiday; passenger claims regarding price reduction and compensation remain unaffected. Travel services no longer provided, must be reimbursed to the passenger by the tour operator. 9.3 For the duration of a non-execution of the trip, the passenger may demand a corresponding reduction in the travel price after the end of travel, provided the passenger has reported and proved a defect. 9.4 If Scenic is accountable for a circumstance, which leads to a defect , the customer is entitled irrespective of the reduction or cancellation of the contract to demand compensation. 10. Statute of Limitations Passenger claims due to travel defects expire in 2 years, starting with the day on which the journey should end according the contract. 11. Liability 11.1 According to the travel contract, Scenic’s liability for physical damage of Scenic is limited to three times the price of travel, providing the damage was not culpably caused by Scenic. 11.2 Liability of Scenic for damages shall be excluded or limited to the extent that it is excluded or limited by applicable international law or regulations based on performance to be provided by a service provider, whose liability is also excluded or limited. If the passenger is entitled to compensation or reimbursement of any amount overpaid as a result of a reduction, the passenger must be credited with the amount due to the same event as compensation or reimbursement as a result of a reduction under international conventions. 11.3 Scenic cannot be held liable for any damages caused by the passenger or due to unavoidable circumstances beyond our control. Scenic is also not liable for damages for breakdowns, personal injury and damage of property damage in connection with third-party services providing goods or services during the cruise (eg excursions, sporting events, exhibitions, visits). Thus, for the passengers clearly not part of the travel services of Scenic and insofar as the respective damage was unforeseeable or preventable for Scenic. Any claims of the passenger for reduction of the travel price or termination remain unaffected. 11.4 In so far as Scenic is in the position of a contractual carrier, the liability of Scenic shall depend on which provisions apply under the Aviation Act, EC law, the Warsaw Convention in the version of The Hague or any other version or the Montreal Convention. See also “Communications to International Traveling Passengers about Limitation of Liability” and “Notes on Baggage Liability Limitations”. Incidentally, the valid general and special conditions of carriage of the carrying airline apply to all offered air travel. 12. Information/passport, visa and health regulations 12.1 Scenic complies with the information requirements before the travel booking, according to Art.5 of the EU-Package Travel Directive 2015/2302 (in particular Scenic informs essential features of travel, travel price, deposit and final payment, minimum number of participants, compensation for resignation or compensation, form for package holidays etc.), if not already done by the travel agent. 12.2 Scenic will inform the customer/passenger about general passport and visa requirements as well as health formalities of the country of destination, including the approximate deadlines for obtaining any necessary visas prior to contract formation and any changes that may occur prior to departure. 12.3 Scenic cannot be held liable for the issue and receipt of necessary visas by the respective diplomatic representation, even if the passenger has commissioned Scenic with the procurement, unless Scenic is responsible for the delay. The passenger is responsible for compliance with the legal provisions that are important for carrying out the journey. All disadvantages arising from their non-compliance are at the expense of the passenger, except where caused by culpable misinformation by Scenic. 13. Travel Cancellation Insurance 13.1 The customer is hereby expressly advised that it is recommended to conclude a cancellation and travel insurance. However, cancellation and travel insurance is not included in the respective travel price. 13.2 Scenic strongly recommends that passengers purchase comprehensive travel insurance from a reputed insurance company that protects the passenger against the risks associated with the cruise, including coverage for lost baggage, medical expenses, costs and expenses incurred by the passenger due to cancellation, delay or other disruptions or medical evacuation which may occur in remote areas. 14. Obligation to assist If passengers are in difficulty such as Art. 13 Paragraph 7 of the EU-Package Travel Directive 2015/2302 or for any other reasons, Scenic must grant them immediate and appropriate assistance, in particular: 14.1 Provide suitable information 14.2 Information on health services, local authorities and consular assistance, support in the production of remote communication links 14.3 Assistance in finding other travel options remains unaffected. If the passenger has culpably caused the circumstances

requiring assistance, Scenic may demand reimbursement of expenses if and insofar as they have occurred reasonably and effectively. 15. Data Protection Under data protection law, Scenic is responsible for the processing of the personal data of the passenger for the purpose of the contract execution acc. Art. 6 para. 1 lit. b EU-GDPR. The personal data will be processed exclusively for the execution and processing of the trip. Personal data will not be disclosed to third parties for purposes other than performance of the contract without the passengers consent. The data will be deleted as soon as they are no longer necessary for the purpose of their processing, unless Scenic is required under Art. 6 para. 1 lit. c EU-GDPR is obliged to store for longer periods due to tax and commercial requirements, for storage and documentation or the passenger is obliged to make further changes in accordance with Art. 6 para. 1 lit. a EU-GDPR and has consented. The applicable data protection law grants passengers the following rights concerning the processing of their personal data to Scenic: Right to information acc. Art. 15 EU-GDPR, right to rectification acc. Art. 16 EU-GDPR, right to cancellation in accordance with Art. 17 EU-GDPR, right to restriction of processing in accordance with Art. Art. 18 EU-GDPR, right to information acc. Art. 19 EU-GDPR, right to data portability acc. Art. 20 EU-GDPR, right to revoke granted consent acc. Art. 7 para. 3 EU-GDPR and the right to complain to the supervisory authority pursuant to Art. Art. 77 EU-GDPR. The passenger may turn to the below address of the tour operator in matters of data protection. 16. Dispute Settlement Procedure Scenic does not participate in dispute settlement procedures before a consumer arbitration board and is not required to do so by law. 17. Maps, pictures and images 17.1 Maps: Maps or cruise itinerary depictions contained in Cruise Brochures or any other brochures are intended as an indication only and should not be relied upon as the actual route to be taken during the Cruise. The actual routing is shown in the travel documents. 17.2 Images: All images represent typical scenes and descriptive detail for each cruise; however, the particular subject matter may not be seen or experienced on the cruise.
