Located North of Phnom Penh, Oudong is the former royal capital of Cambodia up until it moved to Phnom Penh in the 1800s. Important remnants on the temple sight include the burial sites of Khmer kings as well as religious artifacts dating back more than a hundred years. In one of the Oudong Temples there is a known large Buddha statue which was damaged during skirmishes with the Khmer Rouge who had the hill as one of their last strongholds. DAY 6 PHNOM PENH Wake up in Cambodia’s capital, Phnom Penh. The city was once known as the “Pearl of Asia”, but it was almost entirely evacuated by the Khmer Rouge in 1975. This morning, we learn more about the Khmer Rouge and the darkest days of Cambodian history. A short drive will take you to the Killing Fields at Choeung Ek where you can walk through the fields. This afternoon, you will visit the majestic Royal Palace with its gardens and Central Market. This evening, take an EmeraldPLUS tuk-tuk ride through Phnom Penh ending on a rooftop terrace with great views of the city. Formerly called the Presidential Palace, images of the building were seen around the world on April 30, 1975 when tanks stormed the gates as Saigon fell to the North Vietnamese. DAY 10 HO CHI MINH CITY Drive away from Ho Chi Minh City, watching the city skyline fade into the distance as the road winds through rice paddies, villages and other scenes typical to southern Vietnam. Hear how the residents constructed an intricate, underground network of tunnels during the French and American Wars. Hear incredible tales about the unusual foods the residents ate to survive and much more. Once above ground, see other ingenious items used by the residents to defend themselves such as bamboo traps and camouflaged pits. Subject to availability, we will confirm your holiday by issuing a confirmation invoice to the party leader who confirms they have authority on behalf of the Booking Party including minors (under the age of 18) and are responsible for obtaining and providing all information and payments required by us in accordance with these booking conditions. 2. Payment. To secure a booking, you must pay the applicable deposit of a minimum of $500 per person or full payment if booking 90 days or less before the start of the tour. The deposit or full payment, as applicable, must be received at the time of booking to ensure a place on the tour is held. 3. Your contract. A binding contract comes into existence when we issue the confirmation invoice. This invoice will be sent to the lead name on the booking (“Lead Name”) or your Travel Agent. 4. Special requests. Must be advised at the time of booking. Unless specifically confirmed by us in writing, all special requests are subject to availability. 5. Changes by you. Any amendments and transfers we agree after issue of the confirmation invoice will cost $50 per person plus any costs incurred by us and or charged by our suppliers. A change of holiday dates is a cancellation of the original booking and the cancellation charges in clause 7 apply. All costs must be paid before the transfer can be effected. 6. Risk and Travel Insurance. You acknowledge and agree that there are general risks associated with traveling, which are beyond Emerald’s control and, as such, Emerald is not liable for any loss, cost or damage you may incur as a result thereof. Such general risks include, but are not limited to, tour variations or interruptions caused by road, river or weather conditions; national or local holidays affecting the closure of public buildings and attractions; strikes, civil disturbances and advices by governments, and other Force Majeure Events (as defined below); hazards associated with traveling in undeveloped areas; travel by boat, train, automobile, aircraft and other means of transportation; high water levels; low water levels; flooding; lock closures; unscheduled vessel or vehicle maintenance or for any other circumstances beyond Emerald’s control; forces of nature; illness; flight schedule changes or cancellations; loss of luggage; epidemics or pandemics; political unrest; accidents; acts of terrorism or other criminal acts; and any changes to government visa or travel requirements. Furthermore, it is your sole responsibility to make your own inquiries regarding your trip, including any relevant government travel safety warnings. You are urged to arrange comprehensive travel insurance to cover any unforeseen circumstances that may occur during the tour. Emerald is not liable in any regard for your
failure to adequately insure yourself, and you agree to indemnify and hold Emerald harmless for any expenses or delays incurred as a result of your failure to adequately insure yourself. For your convenience, Emerald offers its clients the opportunity to purchase travel protection through TripMate, Inc. We act as a broker. Once purchased, the Travel Protection Plan premium is non-refundable. 7. Cancellation by you. You may cancel your booking by notice to us in writing and payment of the applicable cancellation fee as shown below. Cancellation notifications are not effective until received by us in writing (if received by us on a weekend day or public holiday the notification will be treated as having been received by us on the next working day). The following cancellation fees apply to each person(s) canceling and where shown as a percentage are based on the total cost of the arrangements which are being canceled excluding any insurance premiums, amendment fee or previously incurred cancellation charges which are all non-refundable in the event of your cancellation: Cancellation period Fee per person 90 days and over Loss of Deposit 89 days to 60 days 35% of tour price 59 days to 30 days 50% of tour price 29 days or less 100% of tour price. 8. Changes or cancellations by us. We plan holidays many months in advance. Occasionally for reasons of force majeure or other circumstances beyond our control it is necessary to make alterations to the arrangements. We reserve the right to alter or cancel itineraries, accommodation or other arrangements at any time. 9. Force majeure Except where otherwise expressly stated in these terms and conditions we regret we cannot accept liability or pay any compensation where the performance or prompt performance of our obligations under our contract with you is prevented or affected by or you otherwise suffer any damage, loss or expense of any nature as a result of Force Majeure. “Force Majeure” means any event which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events are likely to include (whether actual or threatened) war, terrorism, exceptionally high or low water levels, lock closures, fire, flooding, unusual weather conditions, loss of power, epidemics or pandemics, industrial disputes, slow-downs or other strike activities, riots or civil disturbances, acts of government, government agencies or other authorities, inability to obtain any necessary license or consent through no fault of ours and any other event or circumstances beyond the control of us or any supplier of any part of your tour. 10. Conditions of suppliers. You are bound by the terms and conditions and conditions of carriage of our suppliers and independent contractors which we incorporate into these booking conditions which may limit or exclude liability to you. 11. Passport/Visas. You must have a passport valid for six months past the expected end date of your tour. It is also your responsibility to obtain valid entry visas for all countries where so required, prior to departure. Failure to obtain correct documentation may affect your participation in all or any portion of the tour. Emerald will not provide any refunds if you are not able to participate in the tour, or any part thereof. You will be responsible for any costs you incur as a result of your failure to obtain the required documentation including, without limitation, any costs associated with rejoining the tour or returning home. 12. State Department Travel Advisories. The U.S. Department of State publishes regularly updated travel information on its website https:// travel.state.gov which we recommend you consult.
tour and loss of the Tour Price. Internal flights may be included if listed on your itinerary. 14. Air Reservations/Ticketing. Payment in full is required for all airfares at the time of booking. 15. Airline Seating & Special Requests. Seats are limited in our contracted class of service and may not be available on every flight. Emerald does not hold block space on any airline and therefore does not provide any assurance of seat availability for every single tour departure date. Seat assignments and meal preferences may be requested at time of booking but remain subject to availability on a first come first served basis. Emerald does not assure any such requests will be granted. Not all airlines offer pre-assigned seats and some may impose additional charges for pre-assigned seats. Any additional charge imposed by any airline will be at your sole expense. Seating is solely under the control of the airline, as are the itinerary changes resulting from flight delays and schedule changes. Flight cancellations, delays and schedule changes are the sole responsibility of the airline and Emerald accepts no responsibility or liability for such delays or rescheduling. 16. Airline Fuel Surcharges, Taxes, Fees and Restrictions. All airfares quoted at the time of your booking, will be based on round trip purchase and will include air-related taxes, fees and fuel surcharges imposed by the airlines. Any additional fees charged by the airlines such as checked baggage fees, seat selections and/or any other services are your sole responsibility. 17. Cancellations. The cancellation fees listed above do not include any cancellation fees that may be imposed by the airlines. In cases when paper tickets are issued, no refund will be made for canceled air tickets until tickets are returned to Emerald. Non-refundable tickets cannot be refunded under any condition. Please ensure that any returned airline tickets are sent by certified or registered mail. Lost ticket replacement can take up to one year and processing fees may be assessed. 18. Health and safety. You must attend all mandatory safety briefings and drills at the commencement of the holiday and any subsequent briefings or drills required during the holiday by any carrier or supplier. 19. Indemnity. You must indemnify us and the carrier for all penalties, fines, charges, losses or expenses incurred or imposed upon us, the carrier or our suppliers by virtue of an act or violation of law by you and or any breach of these terms and conditions or any carrier’s or suppliers terms and conditions of conditions of carriage. 20. Medical facilities. There are no doctors on board any of the ships, yachts. Should you require medical attention during your holiday then local medical services can be contacted for emergency treatment. The cost of such treatment is your sole responsibility. In relation to your own medical equipment, there are limited storage facilities on board ships and in hotels. You must check prior to booking if the equipment is allowed on board aircraft, ships or hotels. Scooters cannot be carried on board ships due to space limitations and reasons of safety. 21. Mobility. During our holidays, we visit many historical sites and often enjoy walking tours of various places of interest. Some holidays, therefore, may not be suitable for clients of impaired mobility. 13. Air Travel. Although designated air travel may or may not be included, you are responsible for timely arrival at the gateway for your tour. Failure to arrive at the gateway in a timely fashion may result in cancellation of your
