Natural shoreline is property line Ohio Supreme Court hands down decision in dispute between property owners, state In a legal dispute between the state and owners of private property bordering Lake Erie, the Supreme Court of Ohio has reaffirmed court decisions dating back to 1878 and legislation enacted in 1917 by holding that the territory of the lake over which
the state holds a public trust “extends to the natural shoreline, which is the line at which the water usually stands when free from disturbing causes.” In a 7-0 decision authored by Justice Terrence O’Donnell, the Court reversed a ruling by the
11th District Court of Appeals that lakeside owners’ property rights extend to whatever point on shore is in contact with the waters of the lake on any given day, but also rejected arguments by the state that its public trust over the lake extends to the “ordi-
nary high water mark” on shore as established by a U.S. Army Corps of Engineers survey in 1985. In resolving two procedural issues that arose during litigation of the underlying dispute, the Court also 1) reversed the 11th
District’s ruling that the state did not have independent standing to appeal the trial court’s decision in the case after the Department of Natural Resources chose not appeal that decision; and 2)

Harvest Festival kicks off Friday

The party runs from 5 p.m. to 10:30 a.m. Friday, 11 a.m. to 11 p.m. Saturday and 9 a.m. to 4:30 p.m. Sunday. Entertainment will be offered under the big top throughout the weekend. There is no charge and cold beer will be available for those 21 and older with an ID. • 6:30 to 10:30 p.m. Friday — Motown Show with Denny R & Smooth Groove. Come sing along to all your favorite Motown classics including “My Girl,” “Kansas City,” “Duke of Earl” and many more. • 2 to 6:30 p.m. Saturday — Ted Riser Whipping Post — Allman Brothers Tribute with guest appearance by Michael Allman. • 8 to 11:30 p.m. Saturday — The Earthquakers. The Earthquakers have been together since 1994, hailing from The Meadville/Erie, Pa., and Champion, Ohio area. They are simply a crowd favorite. • 1 to 4 p.m. Sunday — Mariachi Band Zelaya, Indianapolis. This group travels to around the region doing their best to honor the Mariachi style of music. This band is sponsored by our very own Port Clinton resident Juanita Persley. Other special events Saturday include a pancake breakfast served by Magruder Relay for Life Team from 8 to 11 a.m., special kids events from 1 to 4 p.m. and Sit Means Sit dog training — as seen on Aminal Planet — will be offered at various times throughout the day.

Construction continues ... Last week we told you about ODOT doing work at the intersection of Ohio 53 and 163 east of Port Clinton. There’s more: they will be resurfacing Ohio 163 east from Ohio 269 to Church Road. Also, beginning today through Monday, Oct. 10, Ohio 163 between 269 and Englebeck Road will be closed for culvert repair, although local access will be maintained. They expect to be finished with that project in November. nnn

The cases were later consolidated and subsequently certified as a class action on behalf of all owners of private property directly adjoining Lake Erie within the borders of Ohio. With regard to the boundary issue, Justice O’Donnell wrote in the last week’s decision: “More than 130 years ago, in Sloan v. Biemiller (1878) ... we determined that when a real estate conveyance calls for Lake Erie as the
boundary, the littoral owner’s property interest ‘extends to the line at which the water usually stands when free from disturbing causes. “Our decision today reaffirms this court’s previous determination that the territory of the public trust in Lake Erie extends to the natural shoreline, which is the line at which the water usually stands when free from disturbing causes ...,” the decision states. Justice O’Donnell’s opinion was joined by Justices Paul E. Pfeifer, Evelyn Lundberg Stratton, Robert R. Cupp and Yvette McGee Brown. Chief Justice Maureen O’Connor and Justice Judith Ann Lanzinger concurred in judgment and the syllabus holdings.

She has accepted the position of Professor in the School of Design, Art, Architecture and Planning with the University of Cincinnati. Carpenter-Fearing presently resides in Norwood with her husband, Chris Fearing, and she recently opened her graphic/web design cooperative in Hyde Park. As part of her research studies, Carpenter-Fearing traveled to Tanzania, Africa, and she has worked cooperatively with the Village Life Foundation. The conferring of her degree followed her successful written thesis and oral defense titled: “Design Principles for Developing Nonprofit Identities and Visual Materials.”

Reunion Oak Harbor Class of 1945 Twenty-one members and their guests of the Oak Harbor High Class of 1945 enjoyed a pleasant afternoon at the Elmore Legion Hall Aug. 18 celebrating their 66th reunion. Letters were read from Marguerite (Deppensmith) Poorman in Napels, Fla., and John Krueger, in Germany, who could not be here. Pat Stevens Sherron and Kingston Ganske had called, leaving messages to be relayed to the class. Forty-one deceased members were remembered in prayer. A Trivia Contest from the ’40s and ’50 s was won by Kathryn Genzman. The rest of the afternoon was spent visiting and looking at pictures and mementos of our school days. The first shipment of influenza vaccine recently arrived at the Ottawa County Health Department. “We purchase some and we get some from the Ohio Department of Health,” said Ottawa County Health Commissioner Nancy Osborn. Department staff is now scheduling seasonal flu shot appointments. Flu shots are $20 per person. A highdose flu shot is available to people age 65 and over at a cost of $40 each. Mom and baby swim lessons start Sept. 26 Danbury Local Schools, through its Community Education program will be offering Mom and Baby Swim Lessons beginning Sept. 26. This two-week session will run Monday through Thursday from 4 to 4:30 p.m. Fee for the class is $28. Checks should be made payable to Danbury Local Schools. Baby swim lessons can be valuable learning and bonding time for both children and parents. Children who are enrolled in baby swim lessons will learn fundamental water skills that will help make it easier for
them to learn to swim when they are older. Simple skills like blowing bubbles, floating, kicking their legs and moving their bodies in the water will be learned in baby swim lessons. Baby swim lessons will teach and emphasize water safety to the parents so that they can keep children safe near water. Morning swim at Port Clinton High School Port Clinton High School is once again hosting the Morning Swim program for the community beginning in the PCHS Natatorium. Morning swim has the same hours as in the past, 6:15 to 7:45 a.m., Monday through Friday, when school is in session. The cost for a semester pass

Young people like Stevie are the future of our township. I’m thrilled we were able to implement her idea to create such a wonderful amenity for our residents and visitors.” Also on hand Sunday were representatives from the Humane Society of Ottawa County and local veterinary offices. Rozak said since the park opened, many people have called to thank her for supporting it and some even stopped by to give her a hug. “As Commissioner Sass and his dog left the park today he thanked me and said we did a very good thing. That comment has been repeated by many people who told me this is the best thing we’ve ever done,” Rozak said. The park is for anyone who wants their dog to enjoy a bit of freedom. Rinaldo is working to secure funding to purchase a roadside identification sign and landscaping for the park. Donations will also be accepted by the township to provide further amenities such as benches, trees and a shade structure. She attended medical school at Siriraj Hospital, Mahidol University, Bangkok, Thailand, and did her residency training in Pediatrics and Children’s Hospital of Michigan, Wayne State University, Detroit. She is currently doing her fellowship training: Allergy/Immunology, Children’s Hospital of Michigan, Wayne State University. Randy is a graduate of Pandora-Gilboa High School. Local author presents ‘Elmore and Genoa’ at Ida Rupp Author Jennifer Fording will visit the Ida Rupp Public Library at 7 p.m. Thursday, Sept. 22, to introduce her new book, “Elmore and Genoa.” Fording wrote this book on behalf of the Harris-Elmore Public Library, where she is the local history librarian. She maintains the library’s online digital archives and is the Webmaster for the Ohio Library Council’s Small Library Division blog. Copies of the book are available for sale at the circulation desk of the Ida Rupp Public Library. The villages of Elmore and Genoa have
held a friendly rivalry since the 1860s. Though each has made its own name in Ottawa County, both share a rich heritage that instills small-town curiosities with a strong sense of community pride. Contract awarded for Waterworks demolition The city has awarded a contract to Baumann Enterprises, of Garfield Heights, for the demolition of the former water treatment plant at the corner of East Perry and Jefferson streets. According to Port Clinton Mayor Debbie Hymore-Tester, Baumann was the lowest bidder of the six bids that were received by the city. Baumann’s bid was $56,780. The bid includes the removal of the water treatment building, including its foundation, with the area filled with proper material to raise the finish grade of the site to 578.50’. Baumann Enterprises hopes to be able to
crush the concrete from the building and reuse it on site. The water treatment plant was constructed in the late 1800s. Tester said she is pleased that the bids were less than the engineer’s estimate. BEC Associates projected the demolition cost at $65,000. Baumann hopes to start of the project in early October and estimates the building will be down in a few days, but cleanup will take several weeks. According to the mayor, the demolition of the building will make the entrance to the property more attractive to future developers.

Litter crews cleaning up local roadways Discarded trash in our communities and along our roadways is ugly and unwanted. It can also be costly in time and maintenance of equipment for township and county road crews when they are working along our roadways. Litter is also a hazard for animals in their natural habitats. The crews for 2011 have been working hard this year, so far cleaning approximately 700 miles of District roadways and collecting a total of 320 bags of trash. Their efforts weigh in at just over 1 ton of trash removed from area roadways. Crew members also learn a valuable lesson in addition to the cost of littering, by spending a little extra time separating the recyclable items found along the roadway to reduce the amount of trash going to our local landfills. In addition to the ton of trash removed, the crew has collected 415 bags of recyclable items (typically aluminum cans, glass and plastic bottles) weighing just under 1 ton, or 1,991 pounds. All statistics are based on materials collected from April 1-July 31. Second annual Royal Rebellion Purity Retreat The second annual Royal Rebellion Purity Retreat will be taking place Sept. 30-Oct. 2 at Camp Sobroske, 4405 N. Toussaint North, Oak harbor. The retreat is a time for teens grades 6-12 to come together and learn about God’s priceless gift of purity. They will be challenged to live life as royalty and to rebel against the culture of today and its standards for purity. They will experience lessons and teachings inspired by the Word of God and other resources including “Moral Revolution” by Kris Valloton and “The Bride Wore White” by Dannah Gresh. They will also take part in worship services with leaders such as Ryan Lane of Brownsville School of Ministry and Derek Slaughterbeck from the School of Worship, Teen Mania Honor Academy. Teens will learn about modesty by experiencing a fashion show and will be given helpful tips that will help them understand how to wear today’s fashions modestly. They will be encouraged to remain sexually pure until marriage and to respect life in all its stages, including the unborn.
They will be educated on sexually transmitted diseases, the reality of abortion and the threat of sex trafficking in our area. No one who attends this retreat will leave the same. The cost of the weekend is $65, families with more than one child attending will receive a $15 discount per child. There is an additional cost if teens choose to purchase a purity ring. The purity rings are given out and covenants are signed on the final night when teens’ families and friends are present to witness and agree with their stand for purity. Laurie Mann Memorial Golf Scramble in its 14th year The Laurie Mann Memorial Golf Scramble will be held at the Oak Harbor Golf Course on Sunday, Oct. 2. The four-person scramble will cost $280 per team with $20 additional for the skins game. The tournament has a 9 a.m. shotgun start and is limited to the first paid 36 teams. The entry fee will include a gift prior to the tournament, a steak dinner, top team, door and hole prizes, drink tickets, lunch at the turn and a great time. We will also be raffling a 32” LCD TV, Bosch tools and autographed Dustin Johnson Hat and Ben Richmond prints. In its 14th year, the Laurie Mann Memorial Tournament has continued to run in loving memory of Laurie Mann. Laurie was a standout student athlete at Port Clinton, is a member of the Port Clinton Athletic Hall of Fame and still holds many sports records at the High School. She continued her basketball career on a full scholarship to the University of Massachusetts Lowell, where an annual
award is given in her honor. Laurie passed away from a rare brain tumor in 1998, but her will to live and her zest for life has never been forgotten. The proceeds from this year’s tournament will go to the Make-A-Wish Foundation, Stein Hospice and the Laurie Mann Memorial Scholarship given annually at the PCHS. To support the tournament and cause, donations can be made in monetary values with hole sponsors costing $100 in cash or the equivalent in merchandise or services offered. Funds handed out from K. of C. Measure Up Campaign The Port Clinton Knights of Columbus Council 1750 distributed funds collected during their Measure Up campaign to the Arc of Ottawa County. Bobbi Beck and Debbie Cook from the Arc of Ottawa County attended a meeting of the Port Clinton K. of C. and received a check for $1,395, which was collected during this year’s Measure Up Campaign. The campaign is conducted each year throughout the state of Ohio to provide assistance to
citizens with disabilities. The local council collects donations outside local participating merchants. The Arc promotes and protects the human rights of people with intellectual and developmental disabilities and actively supports their full inclusion and participation in the community throughout their lifetimes. Fred Agnello was once again the top money collector for the campaign.

Senior quarterback Lucas Kennedy completed 12-of-13 passes for 170 yards and three touchdowns, plus he ran for 188 yards on 24 carries and additional three touchdowns to account for 358 total yards and play a part in all six Laker touchdowns. Because of only one incompletion, his completion percentage was an outof-this-world 92 percent. The win pushes Kennedy to more than 1,000 total yards this season — 533 passing and 533 rushing. He has completed 33-of-60 passes with five touchdowns and ran with the football 63 times for an average of 7.7 yards per carry. After trailing early, 7-6, Danbury scored three second-quarter touchdowns to take a 26-13 lead at halftime. Danbury scored first on a 14-yard touchdown pass from quarterback

The Catawba Island Club’s Women’s Golf Association held its annual Club Championship on Thursday, Sept. 15. Originally, the event was to be a twoday gross score competition, but with a cancellation because of rain, it was just a one-day event. Approximately 30 18-hole golfers and 10 nine-hole golfers competed for the coveted trophy. The blustery weather made for some challenging golf. This year’s Nine-Hole Champion was Dolly Kresge. She won in a sudden death playoff on the second hole against runner-up Debbie Furber. The 18-Hole Champion was Karen Coffin. She will work with tenants, lease units, partner with the social service agencies and programs as needed, and work collaboratively with the Ottawa County Board of DD to continue developing a long-term housing plan for persons with developmental disabilities. Nicole will also assist our organization in managing our local application process for the Section 8 Housing Choice Voucher Program on behalf of Sandusky Metropolitan Housing Authority. Nicole enters ORSI with a positive attitude and many creative ideas. She has already accomplished goals that prior to her arrival seemed out of reach for ORSI. Through the utilization of technology, Nicole has enhanced ORSI’s services by designing a web-based work order system that allows ORSI’s staff to access mainte-
nance requests or review completed services from any location that has internet access. This allows our maintenance staff to enter real-time activities on a Galaxy Tablet in the field which can then be reviewed immediately in the main office. This process has completely eliminated needless piles of paperwork and allows ORSI to better serve tenants and service partners via a continuously updated tracking system of the work completed at each property. Nicole has also created a web-based tenant contact database and waiting list system, that assists her in maintaining a 100 percent occupancy rate at all of the properties ORSI owns and operates. This is the first time in the history of the organization this has been accomplished. With new systems in place, Nicole has turned her focus to enhancing ORSI’s web presence by updating our website and designing a Facebook page to keep current and potential tenants apprised of our services and activities. In the short four months Nicole has worked at ORSI, she has brought fresh ideas to our organization and a unique perspective which has allowed ORSI to reach goals and serve individuals in new and exciting ways. Dames Bond opens local chapter Dames Bond, a professional networking community for passionate women, planted its roots in Central Ohio in 2006. Founder and CEO Mary B. Safety Council presents training opportunity Confined Space Training will be presented by Scott Goodwin, of Confined Space Training Services, on Wednesday, Nov. 9. The four-hour class runs from 8 a.m. to noon and is broken into approximately two hours of classroom and two hours of hands-on training. The classroom portion discusses the OSHA requirements and discusses typical problems and violations that commonly occur. The hands-on portion of the class uses some of the students in the class to demonstrate typical confined space entry scenarios and shows common mistakes.
During the hands-on training, students are informed of the various types of equipment and how each piece is to be used. There is a limit of four people from each business. The event is sponsored by the Ottawa County, Sandusky County and Sandusky Area Safety Councils and is free to safety council members. The fee for nonmembers is $10 and can be paid at the door.
