APPENDIX A GOVERNOR QUALIFICATIONS AND DISQUALIFICATIONS (REGULATION 20 AND SCHEDULE 6 OF THE CONSTITUTION REGULATIONS) A Governor must be aged 18 or over at the time of their election of appointment. A person cannot hold more than one Governorship at the same School.

A person is disqualified from being a Governor or Associate Member if they: 1

are under the age of 18;

have a mental disorder and are liable to be detained under the Mental Health Act 1983;

3

have failed to attend the Governing Body meetings for a continuous period of six months, beginning with the date of the first meeting they failed to attend, without the consent of the governing body. This provision does not apply to the Headteacher;

4

are bankrupt;

5

are subject to a disqualification order under the Company Directors Disqualification Act 1986 or to an order made under section 429 (2) of the Insolvency Act 1986;

6

have been removed from the office of charity trustee or trustee for a charity by the Charity Commissioners or High Court on grounds of any misconduct or mismanagement, or under section 7 of the Law Reform (Miscellaneous Provisions) (Scotland) Act 1990 from being concerned in the management or control of any body;

are included in the list of teachers or workers prohibited or restricted from working with children or young people (List 99);

are disqualified from working with children;

9

are disqualified from being an independent school proprietor, teacher or employee by the Secretary of State;

10

have been sentenced to 3 months or more in prison (without the option of a fine) in the 5 years before becoming a Governor or since becoming a Governor;

11

have received a prison sentence of 2 ½ years or more in the 20 years before becoming a Governor;

12

have been convicted of any offence resulting in a sentence of imprisonment for a period of 5 years or more;

13

have been convicted within the last 5 years prior to or since appointment or election as Governor of an offence under Section 547 of the Education Act 1996 (nuisance or disturbance on school premises and grounds) and sentenced to a fine;

14

refuses a request by the Clerk to the Governing Body to make an application under section 113 of the Police Act 1997(c) for a criminal records certificate.

School Government Regulations 2003 Schedule(6) paragraph(5) also states that a Foundation Governor (other than an ex officio foundation member), LEA Governor, Community Governor, Partnership Governor or Sponsor Governor who has been disqualified as a Governor of a School is not qualified for election nomination or appointment as a Governor of any category at that School during the twelve months immediately following his/her disqualification.
