Welcome to the Elizabeth Bence School of Fashion The Elizabeth Bence School of Fashion is a registered training organisation with Australian Skills Quality Authority ( ASQA) for the delivery of training and assessment services in: LMT41007 Certificate IV in Applied Fashion Design and Technology LMT50307 Diploma of Applied Fashion Design and Technology LMT60307 Advanced Diploma in Applied Fashion Design and Technology Our goal is to be the No 1 fashion school for future designers and for you to emerge from our school capable of competing in the world fashion market. We have been established since 1997 providing individualised training in the area of fashion design including drawing, colour, textiles, pattern making, garment construction and couture dressmaking. The training is open to students desirous of developing creative and technical skills to enter or further their opportunities in the field of fashion design. Mrs Bence is the Director/Principal of the school. She is a graduate of the artistic institute of fashion Mariagoni-Milan and holds advanced diplomas in draping, tailoring and fashion illustration from Ecole Superieure des Arts et Techniques de la Mode in Paris. Mrs Bence is a qualified trainer. Jan Page, an experienced and qualified trainer, who provides students with individual tutorial support, assists her. Joan Theodore is the Office Manager/Administrator responsible for the administrative and financial management of the school.

The ESOS Framework

The Elizabeth Bence School of Fashion is committed to providing you with quality education and protecting your rights. The Australian Government requires overseas students in Australia to have a safe, enjoyable and rewarding place to study. Australia’s laws promote quality education and consumer protection for overseas students. These laws are known as the ESOS framework and they include the Education Services for Overseas (ESOS) Act 2000 and the National Code. 3.1

Protection for Overseas Students

As an overseas student on a student visa, you must study with an education provider and in a course that can be found on the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS)at www. cricos.deewr.gov.au. CRICOS registration guarantees that the course and the education provider at which you study meet the high standards necessary for overseas students. Please check carefully that the details of your course – including location – match the information on CRICOS. 3.2

Your Rights

The ESOS framework protects your rights, including: 

Your right to receive, before enrolling, current and accurate information about the courses, fees, modes of study and other information from your provider and your provider’s agent. If you are under 18, to ensure your safety, you will be granted a visa only if there are arrangements in place for your accommodation, support and welfare

Your right to sign a written agreement with your provider before or as you pay fees, setting out the services to be provided, fees payable and information about refunds of course money. You should keep a copy of your written agreement

Your right to get the education you paid for. The ESOS framework includes consumer protection that will allow you to receive a refund or to be placed in another course if your provider is unable to teach your course

Your right to know: - How to use your provider’s student support services - Who the contact officer is for overseas students - If you can apply for course credit - When you enrolment can be deferred, suspended or cancelled - What your provider’s requirements are for satisfactory progress in the courses you study - If attendance will be monitored for those courses - What will happen if you change providers - How to use your provider’s complaints and appeals process.

Management. School Location

The Elizabeth Bence School of Fashion is located on the second floor, 741 Pacific Highway, Gordon about 14 km from the centre of Sydney on the leafy North Shore railway line. The school is maintained as an authentic fashion and design workplace environment with facilities and equipment set-up to ensure effective and efficient operation. Regular public transport services link the school with the city of Sydney, offering all the attractions of a capital city. Sydney is approximately 14km from Gordon by train and the school is a short 1 minute walk from Gordon railway station. There is also ample street parking available nearby. 4.2

Course Timetable

The academic year is divided into two semesters of approximately 21 weeks each. Semester 1 commences the first week in February and concludes the last week in June. Semester 2 commences the first week in August and concludes the week prior to Christmas. Our courses are conducted for 20 hours per week (9.00am to 2.30pm) for four days per week (Monday, Tuesday, Wednesday and Friday). The course dates for are as follows: Semester 1: 1st week of February – last week of June Semester 2: 1st week of February – last week of December 4.3

Attendance Requirements

International students must attend on a fulltime basis. This means you must be in attendance at the college each day of the course for a total of at least 20 hours per week. You must maintain a minimum of 80% attendance. Your attendance will be recorded daily. If you cannot attend a class you are required to notify the school in advance on 02 9498 7240. Students who are absent from class due to illness must provide a doctor’s certificate. No consideration can be given to extended absences for any other reason and they will be reported to the Department of Immigration & Citizenship (DIAC). Students must continue to actively participate in the learning and assessment activities to achieve competency in the Training Package qualification in which they are enrolled. Unsatisfactory progress will be reported to DIAC. If a student is deemed Not Yet Competent in a unit of competency they may enroll part-time in their final semester to repeat this unit. A student is not permitted to repeat a unit of study more than once. Students must keep the school informed of their address and contact details at all times. If you change your address and contact details at any time during your period of study with us you must advise us within 7 days. Failure to comply with these requirements will be reported to DIAC and could result in automatic cancellation of your student visa.

English Language

Our courses are conducted in English by qualified and experienced trainers who have years of experience in the national and international fashion design industry. If English is not your first language you need to provide certified evidence of your English language proficiency at IELTS level 5.5 or TOEFL level 550. The Australian Government has an extensive network of Education and Training Counsellors, Australian Educations Centres and education advisers around the world providing reliable and impartial advice on study opportunities in Australia. Orientation to the Course

Our trainers will organise your orientation to the Elizabeth Bence School of Fashion. On your first day at our school your trainers will welcome you, answer your questions and give you information about: 

4.6

Teaching Methods

Our teaching methods include face-to-face instruction to small groups of students and oneto-one individual support, attention and assistance. All instruction is in English. The college is set-up as an authentic fashion design and couture dressmaking workplace with industry standard facilities which provide plenty of opportunity and ample space for you to practice and develop skills in fashion design, pattern making and garment construction. 4.7

Students with learning difficulties beyond our areas of expertise are referred to external specialist agencies. Mrs Bence and Jan Page are available to discuss and support you with any concerns you may have during your studies with us. Feel free to talk to them about your adjustment to student life and study in Australia and any other problems that may be affecting your studies. They will advise or refer you appropriately.

Course Progress and Support Strategy

The Elizabeth Bence School of Fashion has procedures in place for assessing, approving and recording a deferment of the commencement of study. All matters relating to the student enrolment are recorded on the student’s file. Deferral or cancellation of a student’s enrolment may affect the student visa and any change will be reported to DEEWR via PRISMS. Where the Elizabeth Bence School of Fashion finds it necessary to terminate or cancel a student’s enrolment, the student has 20 working days to access the complaints and appeals process. During the period of the internal complaints and appeals process the student’s enrolment status will not be affected except in extenuating circumstances. 5.1

Course Progress

The Elizabeth Bence School of Fashion monitors students’ attendance and academic performance in each qualification. Support structures are in place to assist students to successfully achieve the course outcomes. Trainers monitor students’ progress continuously. Students are provided with feedback on their progress and offered additional time and trainer support as required. 5.2

Course Progress Requirements

Students are expected to achieve the following requirements in order to meet the satisfactory course progress requirements and be allowed to re-enrol without restriction: 

A mark of Competent in all assessment tasks in the qualification in which the student is enrolled.

Not failing a unit more than once.

Satisfactory attendance at scheduled classes.

The consequences of failure to meet two or more of the requirements for satisfactory course progress are as follows: Students who fail to achieve a mark of Competent in an assessment task are provided with the opportunity for re-assessment. Students who fail to achieve an overall mark of Competent for all assessment tasks for a unit of competency will be allowed to continue their enrolment but will be considered at risk of not making satisfactory progress for the semester

following the one in which they were deemed Not Yet Competent. Students considered to be ‘at risk’ will be notified and asked to make an appointment to see the Principal who will establish an additional program of support. It is the student’s responsibility to maintain attendance at the Elizabeth Bence School of Fashion during this time. Students who fail a unit of competency a second time must seek the permission of the Principal before being permitted to participate in that unit for a third time. This permission will only be granted in exceptional circumstances. The program of support implemented by the Elizabeth Bence School of Fashion may include: 

Attending counseling regarding learning

Receiving individual coaching

Attending additional lectures

Attending additional opportunities to practice relevant skills development

Referral to suitable agencies to assist with personal issues that may be affecting progress.

Records of the implementation of the additional program of support are kept in the student’s file. 5.2.1

Unsatisfactory Course Progress

Unsatisfactory course progress is failure to meet two or more of the requirements Under Section 20 of the Education Services for Overseas Students Act 2000 (ESOS Act) the Elzabeth Bence School of Fashion is required to report students to the Department of Immigration and Citizenship who fail to meet two or more of the requirements for satisfactory course progress in a semester. Whether or not to report a student is determined at the end of each semester by the Principal who will consider each case on its merits and in light of any compassionate or compelling circumstances. 5.2.2

Notification and Appeal

The Principal will notify the students in writing of the school’s intention to report a student for unsatisfactory course progress and/or unsatisfactory course attendance. See Appendix I. Students have the right to appeal all consequences imposed for failing to meet the requirements for course progress. This should be in accordance with the School’s Complaints and Appeals Policy and Procedures. Complaints and appeals must be lodged in writing and addressed to the Principal within twenty days of the date of the student being notified of the school’s intent. The process will commence within 10 working days from the date of receipt of the student’s appeal. 5.3

Withdrawal from a Unit

Students may only withdraw from a unit if they suffer a misadventure or illness. The illness should be documented with a medical certificate and should be of sufficient severity that it interrupts the student’s work significantly in that particular unit. Misadventure is defined as an event which is beyond the student’s control and which disrupts the student’s academic work. Students should see the Principal or their trainer if they require help in documenting cases of illness or misadventure.

5.4

Deferring a semester

Deferral of studies by international students is permitted only in compassionate or compelling circumstances such as serious illness, death in the family or for some other reason. Students will be required to provide evidence of the compassionate or compelling circumstances. Students who need to defer their studies must first speak to the Principal.

Transfer of International students from and to another RTO.

The Elizabeth Bence School of Fashion will not enrol international students transferring from their principal course (ie. the main course of study or the highest qualification indicated on the student’s current visa) with another RTO before they have completed 6 months of their principal course with that RTO unless the student has a valid letter of release from that RTO agreeing to the transfer. The Elizabeth Bence School of Fashion will release a current student from their principal course and provide a letter of release before they have completed 6 months of that course where it can be demonstrated that the student: 

Has not commenced their principal program

Has an realistic and accurate understanding of what the transfer represents to their study options

Can no longer be provided with the training delivery and assessment services in the principal course by the Elizabeth Bence School of Fashion.

The Elizabeth Bence School of Fashion will not release a current student from their principal course and provide a letter of release before they have completed 6 months of that course where it can be demonstrated that the student:

6.1

Has not made satisfactory academic progress and is seeking a transfer to avoid being reported to DEEWR

Has not attended the course as required and is seeking a transfer to avoid being reported to DEEWR

Has not paid all course fees. Procedure for assessing applications for transfer in to the Elizabeth Bence School of Fashion

The Elizabeth Bence School of Fashion receives an application from a student who is onshore and who has indicated that they are currently studying at another institution. The Director/Principal uses PRISMS to decide if the student has completed 6 months of their principal course. They also use the copy of the student visa in the passport to ascertain what the principal course is and when they arrived in Australia. Where the above is satisfied, the Elizabeth Bence School of Fashion application process proceeds as for all off-shore students. Where the above is not satisfied, they are asked to provide an appropriate letter of release in support of their application. They may be provided with a “conditional” offer which clearly states that an offer of a place is contingent on their obtaining a letter of release.

Where the student provides a letter of release and they have no outstanding fees to be paid to the prior institution or other outstanding matters of concern, the application proceeds as for all off-shore applicants. Where a satisfactory letter of release is not provided, the application process is halted and the student informed that they are unable to transfer at this time. They are welcome to reactivate their application when the 6 month period has passed. Note: In the very rare circumstances where the original institution or course has ceased to be registered, or sanctions have been placed on the original institution by the Australian government which do not allow the student to continue with the course, no letter of release is required. 6.2

Procedure for assessing applications for transfer out of the EBSF

Students make a written request (eg. an email) to the Elizabeth Bence School of Fashion to transfer to another provider. The student is asked to provide a valid offer of enrolment from the new RTO. - Where the student is under 18, their parent or guardian must support this request in writing. - Where the student is under 18, they must also provide written evidence that the new provider will accept responsibility for their accommodation and welfare. With these documents sighted, the Elizabeth Bence School of Fashion will assess the transfer request in consideration of the following questions: - Does the student have any outstanding fees payable? - Is the student fully aware of the study issues involved in the transfer? - Is the student trying to avoid being reported to DEEWR for lack of course progress or poor attendance? Where the answers to these questions are satisfactory, the letter of release will be granted at no charge to the student. The student will also be advised of the need to contact DIAC and obtain a new visa if the course they transfer to is not a Higher Education/VET course. The Director/Principal reports the student’s termination of studies through PRISMS. The Director/Principal will decide to refuse or grant the letter of release and inform the student. If the Director/Principal decides to refuse a letter of release the student will be advised in writing providing the reasons for refusal and indicating that the student may access the student complaints and appeals process outlined in the Student Handbook if they want a review. The Director/Principal of the Elizabeth Bence School of Fashion will make any final decision regarding the issuance or refusal of a letter of release for any student. Where the student has provided all the necessary documentation regarding letters of release the assessment will be made within 48 hours. All requests, considerations, decisions and copies of letters of release are placed on student’s file. The approval of transfer of a student to another institution does not indicate the agreement to provide any refund. Refunds are governed by the Elizabeth Bence School of Fashion refund policy as outlined in the written agreement. See Appendix J.

Facilities and Equipment

The Elizabeth Bence School of Fashion is maintained as an authentic fashion and design workplace environment. Facilities and equipment are set-up, checked and maintained regularly to ensure effective, efficient and safe operation. 

Students have access to necessary instructional and assessment facilities, materials and equipment. Training facilities include:

Suitable tables for designing, drafting and cutting

Suitable machines and equipment set up safely and securely

Adequate acoustics, ventilation and lighting

Amenities for coffee and lunch breaks

Toilet facilities

Accessible references and resources

Reference books.

7.1

School Relocation

In the event of the planned relocation of the school we will notify DIAC and our students at least three weeks prior to the relocation taking place. 7.2

Morning/Afternoon Tea and Lunch Break Facilities

A lunch and morning tea room and facilities are available for you to use during breaks. Please keep this room clean and tidy.

8

Fees and Charges

Fees Schedule Programs are conducted over two semesters each year. Each semester is for 21 weeks. Semester 1 commences in the first week of February and Semester 2 commences in the first week of August. The Elizabeth Bence School of Fashion is a member of ACPET and contributes to the Overseas Student Tuition Assurance Scheme (OSTAS). Overseas students must enroll on a fulltime 20 hrs per week basis. The course fees are $A27,000.00 for the Certificate IV over 63 weeks, $A36,00 for the Diploma over 84 weeks and $A50,200 for the Advanced Diploma over 117 weeks. This includes a non-refundable administration fee of $250.00. A refundable deposit of $A2,000 is required on application to secure a place in the course. The balance can be paid either: 

Full payment two weeks before course commencement

An equal payment of the outstanding balance at least 2 weeks before commencement of each semester.

For example, full fees for enrolment in the Advanced Diploma are $A50,200.00 and the optional fee schedule is as follows: Administration fee $A 250.00 Deposit $A 2,000.00 Semester 1 21 weeks $A 7,000.00 Semester 2 21 weeks $A 9,000.00 Semester 3 21 weeks $A 9,000.00 Semester 4 21 weeks $A 9,000.00 Semester 5 33 weeks $A14,200.00 International students are required to sign a written agreement on payment of fees which sets out the services to be provided, fees payable and information about refunds of course money. Fees are reviewed annually and may increase each year. If an increase in fees occurs students will be informed in writing of the new fees at least 4 weeks prior to the start of the next Semester. Additional charges: Completion of the course involves the use of drafting paper, special equipment and calico. For convenience these are available for purchase from the school. The payment of all fees and charges is receipted and dated at the time of payment. Records of fees receipted and dated are maintained and secured. Please note: When students choose to pay by credit card an additional cost equivalent to 4% of the amount is required. Please note that any school aged dependants accompanying you to Australia will be required to pay full fees if they are enrolled in either a government or non-government school. 8.1

Additional Costs

Completion of the course involves the use of drafting paper, special equipment and calico. For your convenience drafting paper and equipment is available for purchase from the school. Calico can be purchased locally. You should budget for approximately $2,500.00 per course to cover the costs of these items. 8.2

Fees Refund Policy

If the Elizabeth Bence School of Fashion cancels any training session you are entitled to transfer to replacement training sessions at our school. If you are not granted a Student Visa then all fees will be refunded less the enrolment fee ($A250.00). You will need to provide evidence from the relevant Australian Government Department that the Visa was refused. If you withdraw your application for enrolment before the course commences we will refund all fees paid (excluding the $A250.00 enrolment charge). No refund will be granted to a student whose enrolment is terminated for failure to comply with the Elizabeth Bence School of Fashion’s policies and procedures and the requirements of their visa by DIAC.

After course commencement if you withdraw from the course for whatever reason you will not be entitled to any refund. Every effort will be made to negotiate the transfer of training in the event of a prolonged illness or personal hardship. This will be at the school’s convenience and with the approval of DIAC. Requests for refund should be made in writing to the Principal with documented evidence of the reason for withdrawal. Eligible refunds will be made within 4 weeks after receipt of the claim. If the Elizabeth Bence School of Fashion defaults, that is, if the course does not start on the agreed starting date or the course ceases to be provided before it is completed, we will make every effort to transfer the students’ enrolment to another college. If this is unsuitable the school will pay a refund of the total amount of the course money received from the student. This refund will be paid to students within 2 weeks of the default day with a statement explaining how the refund amount has been calculated. This fees refund policy, and the availability of our complaints and appeals processes, does not remove your right to take further action under the Australian Consumer Protection laws.

9.1

Trainer Qualifications

The Elizabeth Bence School of Fashion trainers have the relevant qualifications required by the National Skills Standards Council . These include: 

Qualifications in fashion design and illustration, drafting, garment construction, tailoring and draping

Qualifications in training and assessment

Vast experience in the Fashion Industry.

9.2

Student Recruitment

Recruitment to the Elizabeth Bence School of Fashion is carried out in an ethical manner in accordance with Access and Equity principles. All enquiries for participation are provided with the Elizabeth Bence School of Fashion Information Pack. Access to the courses is open to all applicants subject to payment of fees and the extent to which the course outcomes and pre-requisites match the needs of the student. Enrolment is on-going where places are available. Once an international student has enrolled at the Elizabeth Bence School of Fashion they cannot defer commencement of their studies or suspend their studies except on the grounds of illness, supported by a doctor’s certificate, or other exceptional compassionate circumstances beyond the control of the student for example, bereavement. 9.3

Your Training Record Book provides self-assessment checklists and records of competence for each unit of competency. We encourage you to check the development of your skills and knowledge and indicate to your trainer when you are ready for assessment. The outcomes of assessment are Competent or Not Yet Competent. If you are assessed as Not Yet Competent you can request a re-assessment. During the course your individual assessment records are maintained by you in your Training Record Book and by your trainer in hard and soft copy. 9.7

Recognition of Prior Learning (RPL)/ Recognition of Current Competency (RCC)

If you believe you already have the skills and knowledge required to demonstrate competency you can request RPL/RCC. It does not matter whether you acquired your skills and knowledge through formal learning, work experience and/or life experiences. To request RPL/RCC you will need to:      

Read your Training Record Book and talk to the Principal if there is anything you need explained Collect and complete the Request for Recognition of Prior Learning form from the office Check your skills and knowledge for each unit of competency. These are outlined in the Record Book in the sections marked Self Assessment Checklists and Assessor’s Assessment Collect your evidence to show your competence. Your evidence must be valid (as described in the unit of competency), sufficient (enough), current (up-to-date) and authentic (your own work). List the types of evidence you have for each unit of competency Present your evidence and the list of evidence to the Principal for assessment.

The assessor may ask you to undergo a challenge test. You will be provided with a written report on the outcomes of assessment of your application for RPL which you will be required to counter sign. This report will be filed in your personal file. You must pay the cost for RPL. Where RPL is granted the Elizabeth Bence School of Fashion will notify DIAC and provide, where possible, meaningful learning activities for the student for the resulting change of the course duration ensuring a full-time 20 hr per week load. 9.8

Assessment Appeals

If you are dissatisfied with a Not Yet Competent decision you can appeal the decision. This involves speaking to the assessor within 10 days of receiving the assessment result and feedback and requesting a review of the evidence. The Principal may organise a re-assessment and depending on the circumstances this may be with an independent assessor.

If it is necessary for you to repeat a unit of competency because you have been deemed Not Yet Competent you may do so only once in your final semester on a part-time basis. 9.9

National Recognition

The Elizabeth Bence School of Fashion recognizes relevant AQF qualifications and / or Statements of Attainment issued by any other RTO. We reserve the right to verify the authenticity of such documents as required and to determine the currency of the units of competency/modules indicated on the testamur. 9.10 Evaluation As part of our continuous improvement procedures you will be asked to complete a Course Evaluation survey. This is your opportunity to provide us with feedback on the course, the trainers and assessors, the course administration, the training facilities, the training activities, resources and materials and the assessment procedures. Your comments enable us to make sure that your expectations are being met and to improve our services. 9.11 Issuance of Qualifications On successful completion of all units of competency you will be issued with a LMT07 Textile, Clothing and Footwear Training Package qualification. If you do not complete the entire course of study a Statement of Attainment will be issued for successful completion of individual units of competency.

Your trainer will talk to you about emergency evacuation procedures during the first lesson. In an emergency situation you are to make your way quickly and calmly to the nearest exit and meet your trainer and other students on the corner of Pacific Highway and MacIntyre St for a roll call check. No Smoking is allowed in any area of the school. If you wish to smoke you must leave the premises. A First Aid Kit is located in the front office. You are responsible for: 

Always conducting yourself in a safe and healthy manner

Ensuring the prevention of injury and disease to yourself, your trainers and your fellow students

Identifying and reporting to your trainer any possible hazards from equipment, facilities and the environment

Refraining from smoking

Refraining from drinking and/or eating in the workrooms.

10.5 Privacy and Personal Information Protection Act 1988 The Elizabeth Bence School of Fashion complies with the Privacy and Personal Information Protection Act 1988 which provides guidance on the collection, storage, use and disclosure of personal information. The Elizabeth Bence School of Fashion will not disclose information about you to anyone outside the school without your written consent. Your student records are confidential and available to you only and on request. Accurate and up-to-date student personal records including contact details, fee payments, attendance, assessment outcomes and qualifications issued are kept secured in a locked cabinet. Where students are unable to present at the school to request access to their records they must apply in writing providing evidence of their identity. Students should be aware that the Elizabeth Bence School of Fashion is obliged to provide information to the Australian Government and designated authorities and, if relevant, the Tuition Assurance Scheme and the ESOS Assurance Fund Manager. This information includes student personal and contact details, course enrolment details and changes, and the circumstance of any suspected breach of a student visa condition. 10.6 Child Protection (Prohibited Employment) Act 1998 Child Protection (Prohibited Employment) Act 1998 makes it an offence for a prohibited person to apply for, undertake or remain in child related employment. A prohibited person is a person convicted of committing a serious sex offence or a “registrable person”. A

It also recognises the www.training.gov.au database as the key public tool for accessing information on training and training organizations. 10.8 Copyright Act 1968 Under the Copyright Act 1968, the Elizabeth Bence School of Fashion must seek and gain permission from the copyright owner for the use of published works, academic texts, journals, reports, research papers, newspaper articles, photographs, illustrations, graphs and promotional images to support the teaching/learning and assessment process. 10.9 ESOS Act 2000, ESOS Regulations 22001 and the National Code 2007 The provision of education and training for international students studying in Australia is regulated by the Commonwealth legislation administered by the Commonwealth Department of Education, Science and Training and a National Code www.dest.gov.au All States and Territories of Australia operate within this legislative framework. Its purpose is to protect the interests of people coming to Australia on student visas by providing them with tuition and financial assurance. The ESOS Act also ensures a nationally consistent approach to the approval of providers on the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS). The Elizabeth Bence School of Fashion complies with the ESOS Act, ESOS Regulations and the provisions of the National Code and is listed on CRICOS. Our Code of Practice outlines the ethical manner in which we operate.

11 Records Maintenance It is an Australian Government requirement that we keep records of each student’s current residential address (as supplied by the student), the student’s full name, date of birth, nationality , the start and completion day of the student’s course, attendance and academic performance details of payments received, information on international student health cover, level of English language proficiency and the student’s passport and visa numbers. We must also keep a record of the reason for a student’s termination of studies Accurate and up-to-date student personal records including contact details, fee payments, attendance, assessment outcomes and qualifications issued are kept secured in a locked cabinet. Where students are unable to present at the school to request access to their records they must apply in writing providing evidence of their identity. We keep copies of your records for a period of 30 years.

12 Student Complaints and Appeals The Elizabeth Bence School of Fashion welcomes your feedback and suggestions on our services. We respond in a constructive and timely manner to all substantiated complaints and appeals against decisions made by us. The Elizabeth Bence School of Fashion ensures that: 

Each complaint and appeal and its outcome is recorded in writing

Each appeal is heard by an independent person or panel

Each appellant has an opportunity to formally present their case and is given a written statement of the appeal outcome including the reasons for the decision.

Students with a problem or complaint with another student should use the following procedure: Step 1: 

Identify and discuss the complaint or grievance with the other party

Discuss the best outcome to the complaint or grievance

Agree to act to resolve the complaint or grievance.

Step 2: If the complaint or grievance is unresolved talk to the trainer who will try to remedy the problem. Step 3: If after talking to the trainer the complaint or grievance remains unresolved you should approach the Principal who will mediate to resolve the problem. Step 4: If you are dissatisfied with the outcome of the mediation you may appeal the decision in writing and request an external independent arbiter. This gives you the

opportunity to formally present your case. This may be at no cost or a minimal cost to you. You may be accompanied and assisted by a support person. The Elizabeth Bence School of Fashion will provide you with a written statement of the appeal outcome. If you have a problem or complaint with the trainer, the course content, the facilities or any component of the course you should use the following Elizabeth Bence School of Fashion procedure: Step 1: In the first instance, talk to the trainer or tutor. Step 2: If you feel it is not appropriate for you to talk to the trainer then you should talk to the Principal or put the complaint in writing and address the letter to the Principal. Step 3: The Principal will respond to the written complaint within 5 working days. Step 4: If you are dissatisfied with the Principal’s response you can appeal the decision by requesting to have the matter referred to an external independent arbiter. This gives you the opportunity to formally present your case. This may be at no cost or minimal cost to you. You may be accompanied and assisted by a support person. The Elizabeth Bence School of Fashion will provide you with a written statement of the appeal outcome. The Elizabeth Bence School of Fashion will not tolerate inappropriate behaviour of any kind. If you are being bullied or harassed by anyone while you are at the college or in the field you should use the following procedure: Step 1: Tell the person you don’t like being bullied or harassed and ask them to stop. Step 2: If the inappropriate behaviour continues talk to the trainer or tutor who will try to remedy the problem. Step 3: If after talking to the trainer or tutor the inappropriate behaviour continues you should approach the Principal who will mediate to resolve the problem. Step 4: If you are dissatisfied with the outcome of the mediation you may appeal the decision by requesting an external independent arbiter. This gives you the opportunity to formally present your case. This may be at no cost or minimal cost to you. You may be accompanied and assisted by a support person. The Elizabeth Bence School of Fashion will provide you with a written statement of the appeal outcome. In situations where an external independent arbiter is required this person will be qualified and experienced in the particular area of the complaint and appeal and may include: 

A qualified trainer/assessor external to Elizabeth Bence School of Fashion

An independent NVR training consultant

A representative of ACPET

A representative of the relevant independent body eg. Community Justice Service, Department of Fair Trading, Anti Discrimination Board.

Where, the outcome of the internal and external complaints and appeals process, supports you, the Elizabeth Bence School of Fashion will implement the decision or corrective action as soon as possible and advise you accordingly.

13 Student Responsibilities While you remain a student at the Elizabeth Bence School of Fashion it is your responsibility: 

To attend class regularly and punctually

To advise the school of any absences

To keep the school informed of your address and other contact details at all times whilst in Australia

To conduct yourself in a safe and healthy manner

To behave in a manner which prevents injury and disease to you, your trainer and fellow students

To identify and report to your trainer any possible hazards from equipment, facilities and the environment

To comply with and assist in the school’s emergency procedures

To refrain from smoking anywhere in the school building

To refrain from drinking and/or eating in the workrooms

To comply with the Assessment Information outlined in the Student Handbook and the Training Record Book

To register complaints, disputes or grievances with your trainer

To ensure non-discriminatory or harassing behaviour at all times to other students, staff or visitors to the school

To report any discriminatory behaviour or harassment to your trainer

To refrain from unacceptable behaviour including the use of bad language, alcohol and drugs

To refrain from the use of devices which may disrupt classes eg. mobile phones and pagers.

Students who choose not to comply with the Student Responsibilities will be given a verbal warning in the first instance, a written warning in the second instance and dismissal in the third and final instance. In this instance no course fees will be refunded. Where a student’s behaviour is considered to be extreme the Principal/Director has the right to dismiss the student without notice. Examples of extreme behaviour may be, but are not limited to, being under the influence of alcohol, being in possession of illicit drugs, using abusive language to the trainer and/or fellow students. Where an international student’s extreme behaviour results in their dismissal from the school, DIAC will be notified immediately.
