The fight continues...
O
n July 27 we received the disappointing, but not unexpected news, that our motion for a preliminary injunction against the County of San Diego Eviction Ban was denied. Within an hour of receiving the decision, SCRHA filed an appeal with the United States Court of Appeals for the Ninth Circuit. The opening brief and excerpts of record are due no later than August 24, 2021; the answering brief is due September 21, 2021, or 28 days after service of the opening brief, whichever is earlier. Given this timeline, it is unlikely that there will be a quick resolution and that our fight will continue. Southern California Rental Housing Association did not undertake this lawsuit lightly. It was filed after much consideration and once it was deemed necessary to protect our members and all housing providers in San Diego County. While the state is reimbursing missed rent due to COVID hardship, this lawsuit made it impossible for housing providers to protect the community from residents who pose a threat to health and safety. Even though the ordinance states there is an exception for imminent threats, it is not clear what that means, and that ambiguity leaves housing providers at risk. As a member of the Southern California Rental Housing Association, you are our partner in these efforts. Your membership dues support our lobbying efforts, and your contributions to the Industry Defense Fund help make this fight possible. These are essential to our mission to advocate for our industry, but we are also asking you to share the full story of housing providers. We know what the industry is and what we do. We are essential workers and stayed onsite to help our residents and communities during the COVID-19 pandemic. As our residents had to shelter in place
and work from home, we were onsite to settle neighbor disputes and fix maintenance emergencies, all while implementing new COVID protocols and navigating ever-changing ordinances and complex rental assistance programs. Now is the time to make sure the community at large understands the integral role we play in providing safe housing to help our friends and family understand what’s truly at stake as our industry continues to face eviction moratoria and other overreaching policy proposals. Not only is SCRHA sharing the countless stories of our members who have been adversely affected by these policies with the greater community, but we are also sharing the inspiring experiences and achievements of our members with Member Spotlights. We need to tell our full story. When you see or hear SCRHA in the news, share it with your friends and family. Share the member spotlights and help the community get to know who we are and what we do. While we were the first to fight back, we are not the only organization fighting against these policies and we will support the efforts of CalRHA and the National Apartment Association as they file suit aimed at state and federal policies that prevent the recovery of our industry. Many of you have asked what the Voluntary Dues are for, so here is a quick description: • Legal Defense Fund—Provides funding for litigation against actions that threaten the rental housing industry, including rent control, fees, and other regulations. Contributions to the legal defense fund ARE deductible for income tax purposes as a business expense. • Industry Defense Fund—Another prong in a multi-tiered approach to protecting the rental housing industry. Funds are used to seed and/ or support campaigns to stop Rent Control ballot measures, and other onerous legislation. • Political Action Committee—Your best defense against local and state government efforts to impose excessive fees, taxes, and restrictions that limit your property rights. one that wasn’t particularly popular pre-pandemic—storage. But as people created impromptu offices at home, they may have needed to store other furniture, or they may have been looking to clear away clutter as they spent more time at home. In any case, “storage” saw a 92 percent increase in searches and added an average of $53 to a listing’s value.
Having a garden was the most desired of these outdoor spaces, adding an average of $144 a month to a listing’s value, according to the report. A roof deck only added an average of $68 and a balcony was only $35 more on average.
For those in the Generation Z age group, the storage search was even more specific. These 18-to24-year-olds really prioritized “walk-in closets” in their searches, as well as air conditioning and dishwashers. They were less interested in parking however, as this age group is the least likely to own their own cars.
Parking and in-unit laundry were popular pre-pandemic and the hunt for these amenities has only increased. “Garage parking” search rates were up 73 percent and added an average of $149 to a listing. “In-unit laundry” searches were up 64 percent and is an even more valuable amenity, adding an average of $170 to a listing’s value. One of the top search terms was
Millennials also really wanted walk-in closets—this search term was up 300 percent for this age group, making it the number-one amenity request for 25-to-40year olds. Millennials were also the only age group to prioritize hardwood floors.
While all ages wanted outdoor space, Gen Xers were all about the pool. The 41-to-56-yearolds also wanted furnished apartments, maybe because they were downsizing from big family homes, according to Zumper. Finally, Baby Boomers were uniquely interested in central heat and had the largest increase in “in-unit laundry” searches of all the age groups. Outdoor space in all of its forms topped the list of most-desired apartment amenities, according to a new report from listing site Zumper. “Outdoor space” searches were up 143 percent between December 2019 and December 2020, with “roof deck,” “balcony”, “garden,” “deck,” and “swimming pool” all showing major search increases as well.

San Diego County approves new changes to its General Plan Update
Last month, the San Diego County Board of Supervisors adopted new policies to the County’s general plan update. The new changes address housing and safety and add a new environmental justice element to the general plan. The new Environmental Justice Element to the general plan will focus on improving air quality and lowering other forms of pollution in communities identified as high risk. County staff will be responsible for drafting a policy to evaluate and determine if communities have higher than acceptable levels of pollution. County staff will develop the policy and organize public workshops in autumn 2021 to get feedback from the public. The Board of Supervisors also approved changes to the county’s housing element. Last year, the San Diego Association of Governments adopted the most recent iteration of its Regional Housing Needs Assessment (RHNA). All 18 cities and the County in the San Diego region are responsible for adding approximately 172,000 new homes over the next eight years. The San Diego region built less than 20 percent of the needed housing in the previous RHNA cycle. San Diego County alone will be responsible for planning or building approximately 6,700 new homes

designated for very-low – up to above moderateincome households between 2021 – 2029. The Board’s action makes the County compliant with state housing law. The County will be eligible to apply for state grants once the CA Housing & Community Development Agency approves the County’s updated element. Otherwise, San Diego County would be ineligible for the grants and potentially risk losing state funding for roads and other infrastructure if it does not approve its Housing Element by August 21, 2021. The new Housing Element includes 236 new sites for housing in more developed or “village” areas in the County’s unincorporated areas. The identified sites are located close to transit and water infrastructure. Adding new homes in more developed communities will increase reliance on mass transit and existing road networks, reduce congestion, and lower carbon emissions. The amendment will include policies to encourage developers to build affordable and market-rate projects in those areas. At the same time, new housing proposed in more rural areas in the backcountry could see higher fees. Housing developments in lesser developed communities may have to pay more in fees for providing roads and fire protection. The County will work on improving its emergency policies for August 2021 socalrha.org | 9
communities vulnerable to wildfires and other emergencies. In a separate, but related, issue, the County Board of Supervisors agreed to establish a Regional Sustainability Plan Framework to have the County achieve zero carbon emissions by 2035, and new policy recommendations for the County’s Climate Action Plan (CAP). County staff will consult several outside organizations to develop a strategy and policies to address areas such as the economy, community health, and development to reach that goal.
Thousands of returning UC San Diego Students in search of Housing this Fall
University of California, San Diego (UCSD) is resuming classes on September 23 and as many as 41,000 students are expected to return. However, UCSD will not have enough housing available for thousands of returning students. Despite UCSD’s attempt to develop more on-campus housing, UCSD accepted many more students than it can house.
UCSD, during the pandemic, decided to eliminate almost 2,100 beds leaving affected students in search for housing. The university states as many as 3,100 sophomore and graduate students are waiting for campus housing with little chance given that UCSD reserved most of its housing for incoming Freshman. According to San Diego Union Tribune article from data obtained by CoStar, students pay approximately $1,400 and $1,900 during the academic year for on-campus housing, but the average rent for an apartment in University City is $2,745; the average monthly rent countywide is $2,009 in the second quarter 2021. Many students have spent months looking for apartments but are not finding many due to pandemic conditions and already high demand for rentals. San Diego Mayor unveils Initiative to Increase Home Building
City of San Diego Mayor Todd Gloria held a press conference on July 19 to announce a new plan that would build more homes in the city called “Homes For All of Us” initiative. The package of policies is aimed at building more homes for San Diegans affected by the housing crisis. The package concentrates on building more low- to moderateincome housing at lower cost and in less time. Among the proposals introduced is “Blueprint San Diego” which would streamline the Community Planning Update process. One of the criticisms of updating Community Plans is the time and cost of updating each plan. Gloria proposes to shorten the time to develop and implement Community Plan Updates from 4-5 years to 2-3 years. Updated plans would plan for more transit options, build more and higher density projects close to transit that is “climate friendly,” and implement policies to hasten the construction of infrastructure needed for those communities.
San Diego will need to triple the number of homes it needs to build over the next ten years to keep up with current demand. In July 2020, the San Diego Association of Governments adopted its 6th cycle of its Regional Housing Needs Assessment (RHNA). San Diego is responsible for planning 108,036 new homes between 2021 – 2028. San Diego is responsible for planning a specific number of units for each incomelevel. The city’s Development Services Department will develop and send the proposed policies to be vetted by the city council.

Another major initiative is the focus to build more workforce, or moderate-income, housing. Gloria wants to ensure housing is available to middleincome workers who earn 80 – 120 percent of the Area Median Income (AMI) such as firefighters and tradespersons. A
s of this writing, the California Legislature is on their month-long summer recess (July 15 – August 16). Once they return, we will be on the backstretch of the 2021 legislative year that ends September 10. Prior to the Legislature going on their summer recess, they found the time to pass AB 832 – a three-month extension of California’s COVID-19 eviction moratorium. As you may recall, SB 91 was set to expire on June 30, 2021. However, with the sunset date rapidly approaching and rental assistance dollars not flowing out as fast as expected, the Legislature backed tenant activists’ push for an extension. While tenants rights groups wanted the moratorium to be extended through the remainder of the year, it was only extended through the end of September. The SCRHA fought hard for changes to AB 832, and some were included, however, they did not go far enough and SCRHA remained opposed to the bill. Since AB 832 runs through the end of September and the Legislature adjourns September 10, this should be the end of the statewide protections for non-payment of rent as a result of COVID-19 and associated eviction protections.
amended AB 889 that would impose a statewide rental registry. I know, didn’t we already kill the several rental registry bills introduced this year? The answer is yes (AB 1199), however, Assembly Member Gipson, undeterred, wanted another bite of the apple. The new bill would require limited liability companies and limited partnerships owning single-family or multifamily rental properties to report specific information annually to the Secretary of State’s Office. The state would then make that information available on a searchable public database. We argued, when the bill was heard in Senate Judiciary, that the bill was unnecessary, costly, and overly burdensome. Fortunately, we won the day and AB 889 failed to garner the requisite number of votes for passage. When the Legislature returns, we fully expect to see several more bills gut-and-amended to address issues relevant to the rental housing industry. The SCRHA will be reviewing these bills and opposing when necessary to protect the interests of SCRHA and its members.

Learn more about his professional and what his experience becoming a Certified Apartment Maintenance Technician. Tell us about how you started working in the multi-housing industry? What motivated you? Since I love working in the construction field, I was introduced to the multi-housing industry by teaming up with property management completing final walk through when handing over new apartment units. My motivation was customer service and working as a team to provide results. How long have you been in maintenance? I have been in the apartment maintenance industry for 16 years. What made you decide to get your credential? The maintenance field has a vast array of credentials and new technology. One must keep themselves up to date in order to stay competitive. Knowledge is power. Attaining a new credential
brings positive changes to the workplace. What was the experience like? The course was very informative and detailed. There are many takeaways for everyone. Breaking down each maintenance category was helpful by comparing old technology and the future. Also, providing a breakdown of rules and regulations only makes individuals more effective in the maintenance field. What was the exam like? The exam was a breeze thanks to an excellent instructor having prepared us with great information and teaching materials. Would you advise co-workers/ colleagues to get the CAMT? I highly advise anyone in the maintenance field taking the course. The course is very informative for all maintenance levels.

I have an ongoing unlawful detainer against one of my tenants but he is continuing to create a disturbance at the property. Is there any way that the unlawful detainer can be expedited?
A
Unfortunately, no. However, a restraining order may be available in certain situations. If the tenant is engaging in a serious or criminal disturbance, call the police.

One of my tenants attempted to tape record our conversation explaining that they have a right to do this for legal purposes. Is that true?

My tenant was just evicted and the majority of his/her items are still in the unit. Do I need to give him/her another notice to retrieve their belongings?
Your tenant has no legal right to tape record you without your express consent in conversations wherein you have an expectation of privacy. Further, surreptitious tape recording – tape recordings without your knowledge, when you have an expectation of privacy – is a misdemeanor under California state law.

Yes, you may restrict parking at your apartment
complex to residents only. Make sure you have complied with the requirements of Vehicle Code Section 22658 so that unauthorized vehicles can be towed according to the rules of the code section. Also, be sure that your lease or rules have been appropriately modified so that this policy is enforceable as a condition of tenancy.

I have an applicant who wants to bring her cat with her to the apartment. Can I require her to de-claw the cat before bringing it onto my rental property?
A
No. California law prohibits a landlord from requiring a resident to have a pet de-clawed or de-vocalized as a condition of occupancy.

I have had numerous problems with residents who smoke tobacco, including complaints from neighbors,

damage to the rental unit, etc. Can I institute a policy that my rental property is smoke-free?
A
Generally, yes. California law permits a landlord to designate their property as smokefree. But seek legal advice if you want to change smoking rules in a unit for an existing tenant protected by just cause or rent control, or who occupies property under a term lease.

Am I entitled to use a deceased tenant’s security deposit?
A
You are entitled to use a deceased tenant’s security deposit to cover unpaid rent, pay for damage beyond normal wear and tear, and to perform necessary cleaning to the unit.

We evicted one of our tenants and obtained a monetary judgment. Now we find that they have moved to Arizona. Can I collect against them since they moved out of state?
A
If you have a judgment against a former tenant and they move out of state, you can have the judgment recognized by that state as a valid judgment which would allow you to proceed to levy against their bank accounts or garnish their wages in the state they now live.

Can an owner/property manager require that a tenant secure renters insurance?
A
Generally, yes, to protect the property and assets, landlords can require the tenant obtain renters insurance as a

covenant and condition of the lease. Be sure to seek attorney advice for subsidized housing, or if changing the terms of a tenant protected by just cause or rent control. Learn more about his professional experience and how he earned his CAMT designation. Tell us about how you started working in the multi-housing industry? What motivated you? I got started because of my dad. He was a maintenance manager in a property in Clairemont. When I was old enough, he got me a job there as porter. He motivated me to learn as much as possible so I would be successful in property management. I am now a senior maintenance manager with HG Fenton, a great company to work for! How long have you been in maintenance? I’ve been in this line of work for 20+ years.
What was the experience like? It was like being back at school. I had to attend classes go over study guides. Literally preparing for a final exam. What was the exam like? The exam is timed and it’s done online. It’s multiple choice and there are 100 questions and it covers HVAC, electrical, fair housing, pools, make ready, curb appeal. Everything we do but in detail. I finished in under 2 hours. Would you advise co-workers/ colleagues to get the CAMT? Absolutely! You learn the fundamentals of our line of work. The instructor is very knowledgeable. It looks great when looking for further growth.
What advice would you give someone who wants to get their credential? Make sure you make time to get prepared for the test.
