SDCAA is quickly approaching the 99th anniversary of its founding, and as with all passing years, we’d like to take time to reflect on our accomplishments and contributions. Over the many decades, there have been many accomplishments made by the SDCAA and its members. Formed in response to trash collection fees in 1919 to the rent control battles of the 80s, we have been the voice of the rental housing industry throughout San Diego County, Imperial County, and Riverside County.

That tradition continues today with our advocacy efforts that take place in city hall, Sacramento, and Washington, DC. While we are proud of our storied history, we are also proud of our continuing contributions to the San Diego region, especially with our annual Charity Golf Classic.

This year the Charity Golf Classic will be on September 27, 2018, at Coronado Municipal Golf Course to benefit Veterans Village of San Diego. The event includes a catered lunch and dinner reception with a raffle. Not only does the raffle give you a chance to win great prizes donated by our generous members, but the proceeds will support local veterans.

Even though it is necessary to defeat Proposition 10, we need to take the time to give back to our community and celebrate the many achievements of our members.

A

s Californians, we see news of the housing crisis in the news every day. As members of the rental housing industry, we are critical partners in alleviating the housing shortage. Our members actively contribute to the housing supply by providing residential rental homes throughout San Diego County, Imperial County, and Riverside County.

Unfortunately, many groups believe that housing providers are part of the problem, and seek legislative solutions that endanger our ability to provide housing.

Most notably, we see this with the rent control initiative on the November ballot in National City and the proposed addition of Section 8 as a protected source of income heard by the San Diego City Council at the end of July.

A proponent of rent control in National City, Rafael Bautista, was quoted in the San Diego UnionTribune as saying, "if National City’s measure passes, it is only a matter of time before it [rent control] spreads around San Diego County." This quote exemplifies the reason that we are calling on our members throughout the region to lend their full support to defeating the rent control initiative in National City.

In addition to the initiative to

bring rent control and stronger just cause ordinances to National City, the San Diego City Council will consider adding Section 8 and other forms of housing assistance to the definition of a protected source of income.

If this measure passes, it will effectively create a mandate for landlords to accept Section 8.

Participation in Section 8 will no longer be voluntary, and owners or managers will be required to accept Section 8 income and comply with all the procedures associated with the program.

SDCAA staff spent the month of July meeting with council members to share our concerns regarding this proposed measure.

While at press time, we don't know what the outcome will be of the hearing on July 31, we are certain that we will continue our all-out efforts to protect our members from over-regulation.

In addition to attending meetings and hearings at City Hall, SDCAA hosted our annual Reverse Trade Show. This popular event brings together property management companies and suppliers to raise funds for the SDCAA-PAC. The Reverse Trade Show is a unique event that brings together property management companies and supplier members with the intention of new relationships for growth and success while also benefiting the SDCAA-PAC.

As you return from your summer vacation and enjoy the remaining days of summer, it’s vital for you to remember that the November election will be here before you know it. I need to be clear: rental property owners and managers are facing increasingly tough legislative challenges.

While the SDCAA will continue our legacy of advocacy and education, we are calling on our members to join the fight by donating to the Industry Defense Fund. Your contribution will support our efforts to fight legislative attacks against the industry.

Fires in Southern California: Better Safe Than Sorry!

Though so many people think fire season is in the late summer and fall, southern California’s fire season is year round. There is an emphasis on continually being prepared and following the right procedures when faced with wildfires. In June, a vegetation fire in the lower hills of Del Cerro and College area North of Interstate 8 closed down the freeway for more than four hours and threatened homes in the area.

Much of California is vulnerable to fires due to the climate and landscape. There is a need for vigilance to clear brush, keep vegetation from becoming dry, and creating defensible space, especially in hot dry conditions such as these and Santa Ana Winds. Fires can occur anywhere at anytime.

As the state grows, areas at high fire risk are also the areas with a growing population density.1 Here are the quick statistics of SDCAA Counties: County

Be Prepared Preparing for fires is simple and straightforward. Do it now to avoid panic and confusion in the moment.

Have A Plan: Keep your Emergency Ready Profile for your business or Family Disaster Plan for your home in a place where you can easily find it. These are clear, concise, digital or hard copy plans will help you identify key contacts and your evacuation plan.

Have Evacuation Kit/Box Ready: Don’t forget, your emergency kit should include water, non-perishable food, a firstaid kit and medications. Review the needs of your family to make sure you have all necessary items.

Defensible Space: San Diego Fire & Rescue Station 45 and

Captain Joe Amador emphasized the importance of defensible space. California state updated the law in 2005 to require 100 feet of defensible space separating the property from any tree canopies and vegetation. Vegetation should be cleared of any dry materials.

This includes vegetation on the surrounding slopes and hills of the property. Dry winds can carry sparks that ignite vegetation and increase the square footage of the fire, impacting homes and communities.

Property Maintenance: Keep eaves, gutters, roofs, and property cleared of dry brush, needles, and leaves that could easily ignite from a spark. Any vegetation that does exist around the property needs to be watered on a regular basis.

Smoke Alarms: Federal law in conjunction with California state updated Senate Bill 745 in July 2014 stating that all smoke alarms are to have a nonreplaceable, non-removable battery capable of powering device for a minimum of 10 years. All alarms should be checked yearly to verify they are in working order; the responsibility is on the owner and property manager,

not the tenant. Additionally, commercial alarms are set up to notify local fire authorities within minutes of activation.

Fire Extinguishers: “Fire extinguishers are the first line of defense against a fire. Fires grow up very quickly when they start and a portable extinguisher is a safeguard, to get the fire under control very quickly in the first 15 seconds,” President of Metro™ Fire & Safety, Janet McCormack stated.

She also shared that “portable fire extinguishers should be serviced every year. Though the chemicals in the tank do not go bad, servicing is to make sure these chemicals are free flowing and internal mechanisms work properly.”

“Since [fire extinguishers, fire sprinklers and smoke alarms] are regulated, it is vital for property managers to regularly follow through on the service equipment and instill these safeguards. There is a loophole with insurance companies, if an event should occur and it is found that the alarms were not maintained to proper working standards, insurance claims may not be processed due to negligence. [Property] managers, managing properties for homeowners need to take the same precaution as that of a commercial property.” Janet McCormack

Evacuations It doesn’t matter if the fire is residential, commercial or a wildfire, it is important to evacuate with your emergency kit according to your emergency plan.

No one should ever fight a fire that is taller than they are or that has a lot of smoke. Smoke kills, if you can’t see where you need to go, exit immediately and get out. At this point you are only breathing in toxic vapors.

The Aftermath After the flames are extinguished and you are allowed back into the property, it will be overwhelming to see what was ravaged by flames, smoke, and the water used to stop the fire. The first 48 hours after fire damage can make the difference between replacing and restoring your items. There are some important things to remember at this point: • Contact a trusted professional to assist with recovery.

• Contact your insurance company to start the claims process.

• Don’t touch anything without gloves; the oils from our hands can cause permanent stains.

• Wear a mask to keep the soot out

of your lungs.

• Limit movement within the property to prevent soot from being embedded in the flooring.

Lay down clean towels on high traffic zones.

• HVAC systems will need to be cleaned and checked for damage.

San Diego Fire & Rescue will provide you with a recovery handbook, The Red Guide to Recovery, to help you through this process. There will be a backdraft of emotions sweeping over everyone and it will take time to process your loss.

Fire Sprinklers: In 2010, through the efforts of the National Fire Protection Association, California adopted new building codes that mandated sprinkler systems be installed into one-bedroom and two-bedroom homes. They are required in business and commercial properties. The law also states that on commercial properties these systems must be checked annually and inspected every five years.

Low-Cost Advertising: How to Maximize Your Craigslist Apartment Listing

With so many advertising sources for apartments out there it is difficult to determine what sources will be the most effective for you at the lowest cost. Of course, everybody wants to be able to spend nothing to reach their occupancy goals. Using free listing services can be highly beneficial if you’re willing to invest the time in making your listing look as good as possible.

Craigslist may be the one everybody knows the most and people typically experience drastically different results.

Craigslist has a reputation for being untrustworthy and full of scams which is why it is so much more important that you create a trustworthy listing for your apartment. Now I know you’re wondering, “Well how do I do that?” Let’s start with your headlines.

When creating a headline, make sure you don’t have any characters or multiple exclamation marks. That makes your listing look like a scam. Make sure you are straightforward, and you provide the necessary information someone is looking for, so they want to click your listing. Additionally, make sure it is enticing as you want people to click your listing amongst the

multiple other ones they are searching.

“Newly Renovated North Park 2 Bedroom Apartment with AC” This headline is simple and direct. You want your headline to feature an amenity (AC), location (North Park), floorplan specifying whether it’s a condo, apartment, townhome, etc. (2 Bedroom Apartment), and a small detail about the apartment (Newly Renovated). Another example: “Charming 1 Bedroom Condo in Encinitas near Moonlight Beach with In-Home Washer/Dryer” Now the headline is not everything. Probably the most important thing is to make sure you have AT LEAST six photos.

You want to be able to show the kitchen, bedroom(s), bathroom(s), and living room at a minimum.

Other things you may want to feature is closets, patio/ balcony, and parking situation. Bonus points if you can provide a photo of the floorplan. Kitchens are the highest performing photo on any listing so make sure you always put the kitchen first and invest time into taking a great photo! No out of focus photos or bad lighting. Open the windows and try to capture the apartment

with natural light if possible. Bad photos can also make your listing look like a scam.

Providing a bunch of information about the apartment is the key to making your listing appear authentic, genuine, and trustworthy. List price, square footage, deposit amount, application fees, special, pets allowed, and everything included in the rent like water, sewer, trash, parking spot. The more information you provide, the better the listing.

People are more likely to schedule a tour if they feel like they have a good idea of the apartment. It’s all about the story you tell! Provide a brief description of the location. It should go without saying that you should include the address of the apartment. People want to know what the neighborhood is like where they are moving. Include nearby restaurants, bars, freeways, and parks. You don’t have to be an amazing writer to accomplish this.

Just be honest!

End with your call to action: call to schedule a tour/ viewing.

Now go out and maximize those Craigslist listings!

Rent Control initiative qualified for National City Ballot

On July 5, the San Diego County Registrar of Voters announced that a proposed National City initiative that would impose rent control on rental properties located in the city qualified to be placed on the city’s November ballot. Because of the Registrar’s announcement, National City decided to drop its lawsuit it filed against the measure in May. Last May, supporters of the rent control initiative submitted signatures to place the measure on the city ballot. National City filed a lawsuit soon after to declare the proposed measure invalid because it violated state law. But after the Registrar’s stated the initiative had qualified, National City said it would dismiss the lawsuit and vote on July 17 to decide if it should place the proposed initiative on the November ballot or to adopt the initiative. The city council seemed inclined to let city residents decide in the election rather than vote on the initiative themselves.

If approved, the rent control measure would cap all rent increases to five percent a year, require landlords to provide relocation assistance when

removing units from the rental market before a landlord can terminate or evict a tenant. The SDCAA is working to defeat the measure in November.

The SDCAA also is forming a regional strategy and monitoring to see if rent control discussions are taking shape in other cities throughout the San Diego region. Rafael Bautista, with San Diego Tenants United who asked the San Diego City Council to adopt an emergency rent control ordinance in April recently commented that if National City adopts rent control, similar measures could proliferate in cities throughout the San Diego region.

The SDCAA asks members that have rent controlled units in other cities to contact the SDCAA. We want to hear your stories of how rent control has affected your rental properties. If members learn about proposed rent control measures in their city, they should call the SDCAA immediately at (858) 278-8070.

Proposed “Source of Income” ordinance advances to SD City Council

On June 27, the San Diego City Council’s Smart Growth and Land Use Committee forwarded a

proposed code amendment that would make it illegal for landlords to discriminate against tenant applicants who use Section 8 vouchers or other housing subsidies. The San Diego City Council will hear the amendment.

SDCAA staff and members that testified at the committee hearing asking the committee not to support the proposed amendment. The SDCAA has long promoted to landlords to consider having tenants with Section 8 vouchers as a voluntary option but opposed any effort making accepting residents with Section 8 a requirement. Staff and members contended what discourages many landlords from participating in Section 8 and other housing programs requirements is the cumbersome and bureaucratic process, not the tenants themselves.

Delays in processing paperwork and inspections cause many landlords to wait long periods of time before they receive their rental payments. Members also expressed deep concerns that the proposal could lead to a sharp rise of housing discrimination claims filed against landlords.

Despite the concerns raised at the hearing, the amendment proceeded to the city council under city law in a 2-2 tie vote. Councilmembers Georgette Gomez and David Alvarez voted to support while Councilmembers Scott Sherman and Lorie Zapf voted to oppose it. Shortly after the committee vote, the SDCAA scheduled meetings with Councilmembers and their staff to share concerns with the proposal.

At the time this article was written, the San Diego City Council was expected to vote on the proposal on July 31.

Encinitas' legal troubles could continue with the adoption of a housing plan

In June, the Encinitas City Council narrowly adopted its first ever housing element after a marathon eight-hour city hearing. But, the council’s action could expose Encinitas to more legal problems in the future.

In a 3-2 decision, Councilmembers Tony Kranz, Mark Muir, and Joe Mosca voted yes with Mayor Catherine Blakespear, and Councilmember Tasha Boerner Horvath voted no to accept its housing element. But, as the Encinitas Council adopted its housing element,

it also removed two proposed higher-density housing sites from its inventory of potential housing projects leaving the city with less than the 1,600 affordable housing units required to comply with state housing requirements and as recommended from the city’s outside legal counsel. The decision leaves the city in violation of state rules requiring that 50 percent of the possible sites selected for development be vacant and increases the possibility that the State’s Department of Housing and Community Development could rescind its certification of Encinitas’ housing plan. The action leaves the city vulnerable to its ongoing legal problems.

The lawsuits were filed separately by the Building Industry Association (BIA) and San Diego Tenants United both contending Encinitas is not complying with state’s housing element requirements. In April, San Diego Superior Court Judge Ronald Frazier decided to postpone a hearing on two lawsuits filed against the city until November 13 to give Encinitas voters the opportunity to vote on the proposed housing element on November 6.

However, Judge Frazier also ordered Encinitas to attend a hearing on August 17 to provide evidence that it is proceeding with its housing element on the November ballot. By removing the two housing sites from the housing, the judge might be inclined to allow the pending lawsuits against the city to move forward, render a decision against the city, or lead to more lawsuits filed against the city. The SDCAA will provide another update after the August 17 hearing.

CAPITOL NEWS The Legislature is currently on summer recess and will return August 6th to wrap-up the legislative year that ends August 31st. SDCAA and the rental housing industry faced a number of very difficult bills that sought to significantly alter the way you do business in the state (these bills were previously reported on in the last few issues, so I won’t go into detail). Fortunately, through our efforts, these bills were either killed and/or significantly amended so as not to affect the industry in a meaningful way. So we will focus on the remaining bills we are working on and a little overview of the state budget that was passed on June 15th.

Costa-Hawkins

The Assembly Housing and Senate Judiciary Committees held an informational hearing on Proposition 10, the initiative to repeal the Costa-Hawkins

Rental Housing Act. The hearing consisted of three panels of three, support, opposition and informational. The opponents testified to the fact that If CostaHawkins is repealed; cities will be authorized to apply rent control to single-family homes and new multifamily housing. They’ll also be able to make rent caps permanent, even after changes in tenancy.

These policy changes would reduce the existing stock of rental housing, increase rents in neighboring communities, and increase blight and homelessness.

While the committee room was crowded and overflow rooms were needed, the hearing itself was lacking in legislative representation. The hearing was purely informational number one, and many legislators already heard the arguments for and

against earlier in the year when AB 1510 was defeated. Still, it was interesting to note that spirited support for and against is alive which should lead to vigorous campaigning this fall as electionday nears.

Budget

The budget bill was passed on June 15, thereby meeting the Constitutional deadline and meeting the requirements of Proposition 25 that suspended legislators’ pay if a budget is not enacted on or before the constitutional deadline.

The budget both stores some of the state's windfall in its rainy day fund, and increases spending on assistance for people living in poverty as well as programs combatting homelessness. The surplus is the state's largest since at least 2000

California's nearly $200 billion total budget includes $138.6 billion in general fund spending, $57.1 billion in special funds that must be spent for specific purposes and $3.9 billion in money from bonds. The budget, which boosts spending 9 percent for the fiscal year beginning July 1, was approved with support mainly from Democrats.

Governor Brown and the Legislature are using that windfall to fill the rainy day fund to the maximum allowed under the state constitution and boost other savings, producing $16 billion in total reserves. Nearly $14 billion of that will be in the rainy day fund, which can only be spent during a budget emergency caused by a natural disaster or a decline in revenue.

Housing

Emergency Aid Block Grants for Homelessness. The budget includes a one-time allocation of $500 million for block grants to local governments to fund a variety of homelessness services—such as shelter services, rental assistance, outreach, and construction of affordable housing. $150 million of the grants is divided among the state’s 11 most populous cities based on their homeless populations. The remainder is divided among Continuums of Care—local entities that administer housing assistance programs with a particular area, often covering a county or group of counties—roughly based on their homeless populations.

No Place Like Home. The budget package places the No Place Like Home (NPLH) program before the voters for their approval at the November 2018 election. In 2016, the Legislature created the NPLH program to construct and rehabilitate permanent supportive housing for those with mental illness who are homeless.

The program authorizes the issuance of bonds backed by personal income tax revenues raised under the Mental Health Services Act (Proposition 63 of 2004). Before these bonds can be issued, the state must complete a validation process whereby the courts determine whether issuance of the bonds is legal. The validation action is pending. If NPLH is approved by voters, the state would be able to issue the bonds without going through the validation process.

Other Funding for Homelessness.

The budget also includes a

collection of homelessnessrelated funding augmentations for outreach, mental health services, and assistance targeted to CalWORKs families, seniors, youth, and victims of domestic violence.

These augmentations total $109 million in 2018 19. More detail on these augmentations can be found in the “Health and Human Services” sections of this report.

Legislation

SB 1427 (Hill) – requires landlords to accept Veterans Affairs Supportive Housing (HUDVASH) vouchers and prohibits discrimination in housing accommodations based on military or veteran status and defines as a source of income which cannot be refused under the Fair Employment and Housing Act (FEHA). SDCAA took a supportif-amended position on the bill requesting that it apply only to landlords who already accept Section 8 vouchers.

Public Housing Authorities (PHAs) – the entities that administer housing assistance programs such as HUD-VASH – lack the resources and funding to efficiently administer the Section 8 program. They note that because PHAs are required to certify that any potential rental units are inspected to ensure that they meet certain basic health and safety criteria, this inspection process could lead to delays in renting a unit, and thus lost revenue for landlords and property owners.

Additionally, if any deficiencies are discovered in the inspection process, then repairs to the units would need to take place before it could be rented to a HUD-VASH voucher recipient, ensuring

further delays.

SB 1427 requires property owners to participate in the voluntary VASH program and adhere to all of the program’s rules and regulations regardless of their desire to participate in what is a voluntary program. The bill forces owners to contract with the federal government, whether they want to or not.

SDCAA suggested amending the bill to require those landlords that already accept Section 8 vouchers to accept HUD- VASH vouchers since they have already gone through the certification process and meet all the PHA’s criteria for participation.

We also noted that SDCAA continues to actively support regional efforts to house the homeless. In 2016, SDCAA established a goal to encourage members to help house 200 homeless veterans. Since then, SDCAA continues to partner with local government, housing authorities, community organizations and more to assist in efforts to get homeless individuals and their families into a stable environment.

To accomplish this task, the

San Diego Housing Commission provides incentives for landlords with properties in the City of San Diego. Incentives include preinspections of units; payments of $500 for the first apartment rented to a homeless family or individual and $250 for each additional unit; a contingency fund to help landlords cover expenses upon move-out; and more. We believe this is a better approach than forcing landlords to participate in a voluntary program in which they may not want to participate.

We are still working on the bill seeking amendments to address SDCAA's concerns.

SB721 (Hill) – SDCAA Oppose Establishes minimum inspection requirements for the exterior elevated elements, including balconies and decks, of buildings with three or more multifamily

dwelling units.

Specifically, the bill requires existing exterior elevated elements, as defined, in certain building, as specified, to be inspected at least every 6-years by certain licensed persons, to determine that the exterior elevated elements and their associated waterproofing elements are in a generally safe conditions, adequate working order, and free from any hazardous conditions, as specified. This bill also requires any identified repairs to be made within a designated timeframe and provides penalties for building owners who do not complete the required repairs.

SDCAA is still concerned with some aspects of the bill regarding the exclusion of some inspectors from doing the work and that a licensed contractor cannot bid or do the work if they do the inspection.

AB 2219 (Ting) – SDCAA Support – Requires landlords to allow a tenant to pay rent through a third party, subject to specified limitations.

• Specifies the language of a form acknowledgment that landlords may, but are not required, to provide for use by third parties when rent is tendered to a landlord on behalf of a tenant.

• Provides that failure by a third party to provide a signed acknowledgment to the landlord or landlord's agent shall void the obligation of a landlord or landlord's agent to accept a tenant's rent tendered by a third party.

• Allows a landlord or the landlord's agent to require a signed acknowledgment for each rent payment made by the third party, and to agree with the third party that one acknowledgment shall be sufficient for when the third party will be making more than one rent payment during a period of time.

• Clarifies that none of these provisions shall be construed to require a landlord or landlord's agent to enter into a contract in

connection with a federal, state, or local housing assistance program, including, but not limited to, the federal housing assistance voucher programs under Section 8 of the United States Housing Act of 1937 (42 United States Code (U.S.C.) Section 1437f).

• Clarifies that none of the above provisions enlarge or diminish a landlord's or landlord's agent's legal right to terminate a tenancy, nor are intended to extend the due date for any rent payment or require a landlord or landlord's agent to accept tender of rent beyond the expiration of the 3-day period to pay or quit under Code of Civil Procedure Section 1161(2).

• Clarifies that none of these provisions shall be construed to prohibit the tenant and landlord or agent to mutually agree that the rent payments may be made in cash or by an electronic funds transfer, so long as another form of payment is also authorized that is neither cash nor electronic funds transfer.

• Requires a landlord or landlord's agent to allow a tenant to pay rent through a third party, except there is no requirement to accept the rent payment tendered by a third party, unless the third party has provided a signed acknowledgment stating that they are not currently a tenant of the premises for which the rent payment is being made, and that acceptance of the rent payment does not create a new tenancy with the third party.

The system as it is set up now reflects five levels of priority, which in turn dictates what is addressed first. It would all depend on the situation and demands on our officers at that time.

If the police are notified of the fumigation, a police patrol can make a point of driving by to check on things during his patrol, but we would need to know fumigation is taking place.

Graffiti, some of these works are so elaborate and huge one would think it would have taken a lot of time to complete. How is that possible? And what should we do to help stop this? Lucinda Lilley VP, FBS Property Management, AMO® Chief Nisleit: Graffiti comes in three different camps: gang, artisan, and taggers. Most of the graffiti is not gang related, and it falls into the other two camps. The Department has a team dedicated to graffiti abatement, prosecution, categorizing, and identifying. The Graffiti Strike Force aggressively goes after these taggers and seek restitution and or prosecution.

If your property is tagged call the department to send out the Graffiti Strike Force, they will take pictures and document the offense. The most important action one can take is to cover it up as soon as we have done our part.

Chief Nisleit: In the Starbucks situation those officers were put in a tight spot as the business manager was requesting these men to vacate. The police would have done this regardless of the person's race or color. As for the San Diego Police Department, I can say with confidence that we are well ahead of the curve on this.

Training on situational awareness and Procedural Justice starts in the academy, continues in advance officer training, and we teach our officers how to recognize one’s bias. Training is always ongoing.

San Diego is currently one of the safest cities for its size. Why do most people, when asked, seem to think crime is out of control?

Chief Nisleit: San Diego is a very safe city. San Diego is enjoying tremendous ebb in crime. But because of the media reporting on crimes, all day long, one will see a crime that may not have been committed in our city or even our state, yet you see it, and thus you are aware of it. This is a matter of information overload and

perception rather than reality.

How can property managers and landlords help?

Chief Nisleit: Address issues like trash keep your properties clean, graffiti-free, beautify them, address noise, provide great service to your residents. Reach out and develop a relationship with your local officer and reach out to your CRO as well as have open lines of communications with your resident and fellow property managers around you.

What would you like to say to our industry?

We are one San Diego. One community. Seek out and foster a relationship with the force, we are here to help you and your community. If you need us, call us.

Multifamily Fee Survey 2018 The SDCAA’s annual Multifamily Fee Survey tracks existing and increasing fees assessed by cities and the county on multifamily properties in the San Diego Region.

In May, the SDCAA mailed questionnaires to the County of San Diego and each city in the San Diego Region. The questionnaire asked each jurisdiction about its housing stock and current rates on sewer, trash, and water fees for multifamily properties. The questionnaire also asked if those rates will change, and if so by how much during the fiscal year beginning July 1 or January 1 for the Calendar Year 2018-2019.

If you like win/win situations, then this article is for you! I’ll start with the bad news: If you’re not doing ADA compliant repairs every year then you’re leaving $20,000 a year in federal subsidies on the table!

Here is the good news: The federal government wants to financially help you make your property more accessible for the disabled.

These subsidies are a win/win for you and your tenants because they pay for repairs that can reduce risks for both you and for them.

The ADA (Americans with Disabilities Act) requires all properties open to the public to implement changes that allow greater access to the disabled whenever capital improvements are made or the fixes are “readily achievable1.” The IRS provides yearly subsidies in the form of a $5,000 tax credit and $15,000 in special deductions to incentivize businesses to implement a plan of

regular ADA changes.

Typical changes required by the ADA include: entryways that provide access for the disabled, accessible routes to the entry, disabled parking and signage, accessible bathrooms and counters.

If you haven't used this federal windfall yet, I suggest you use it first to perform ADA compliant repairs on your walkways and there are two reasons why this should be your priority. First, the second priority recommended by the ADA is creating accessible routes2. An accessible route is one that connects sidewalks, streets and parking areas with a facility3.

Second, removing trip hazards from your walkways lowers your risk of injury, lawsuits or settlements both with the disabled and those without disabilities.

Whatever repairs you choose, the key is ensuring that they comply

with ADA requirements so that you can take advantage of the subsidy. In the case of walkway repairs, this means ensuring that the repairs maintain a 1 to 12 slope and a smooth surface from edge to edge that allows easy passage to those in wheelchairs or with canes.

Once ADA-compliant repairs are complete, your accountant should use the IRS code section 44, disabled access credit form to claim up to $5,000 in tax credits.

There is a $250 deductible taken off the total cost of the repair after which you can claim ½ of the cost of the repair up to a total of $5,000. Any remaining portion of the repair cost not covered by credit can be covered by a special deductible up to $15,000 a year.

This deductible is special because the full amount of the repair up to $15,000 is claimable in the year the repairs are done. Most deductions require the amortization of repairs over the lifetime of the repairs.

Here is an example: if you spent $20,000 on ADA-compliant repairs, then you would deduct the initial $250, leaving you with $19,750.

You divide this in half, and you have $9,875. Since this number is greater than the maximum credit of $5,000 you would get the entire $5,000 tax credit. Meanwhile, you would subtract this $5,000 credit from your total costs of $20,000, and you would be left with $15,000, of which you could take the entire $15,000 as the special deduction.

Are there any catches? Yes and no. All organizations that file taxes, even nonprofits can take advantage of the $15,000 deduction. The $5,000 credit is available to any organization with 30 or fewer full-time employees OR that make revenue of less than $1 million a year. And, no. There aren't any ADA police who will be

notified to check your property for any other ADA violations once you take the subsidy on your taxes. (We’ve checked this with ADA advisors in Washington!) If you are selected by the IRS for auditing you simply show your receipts and that the repairs were ADA compliant and you are good!
