I’m excited to roll up my sleeves and continue the work of leading the Association with my second term as President of Southern California Rental Housing Association. Looking ahead at the year, I know that we will come together as a community to continue our work of providing quality housing despite the many obstacles that we face. We must continue to work together through advocacy, education, and collaboration to create a thriving housing community. Even though Southern California Rental Housing Association is a membership organization, our efforts have a profound effect on the communities that we serve. It’s important to remember that rental housing is integral to a robust community and healthy economy. Challenges on the Horizon
T
he start of the new year is a wonderful time to reflect on what we’ve overcome and how best to carry those lessons with us into the new year. All of us at Southern California Rental Housing Association were proud to be a trusted resource for members navigating a year filled with eviction moratoriums, changing requirements, and rental assistance programs, as well as the traditional challenges of resident screenings, day-to-day operations, and maintenance. As Executive Director, I’m proud to share that in 2021, our Association supported our members, and the industry as a whole, with the following accomplishments: • Hosted 89 Classes and Webinars • Sent Out 12 Action Alerts (26 Action Alerts in 2020) • Filed Federal Lawsuit Against the County of San Diego With our growth of 2,400+ new members throughout San Diego, Imperial, and southern Riverside Counties, we are stronger than ever to represent the interests of our members and advocate for legislation that supports housing in Southern California. As your advocate at local, state, and federal levels, Southern California Rental Housing Association is fully prepared to continue our efforts to educate and advocate in the new year. Even though rental housing providers have been under incredible scrutiny throughout the pandemic, they have continued to provide essential housing to our communities despite legislative challenges in addition to the typical operational trials. While I would love to see a future of sunshine and roses for our members who provide housing, you must know now that this will be a critical year for our industry.
As we move into the new year, rental housing providers will face an onslaught of additional tenant protection proposals and eviction protections on both local and state levels of government. Rest assured that we are fully prepared to represent your interests and have already gotten to work meeting with elected officials to share our perspective. However, we can’t do this alone. 5G Not going the last mile in multifamily communities
By Quantum Fiber There's an old saying that "the longest mile is the last mile home." If you've been on a long road trip, you know it’s true. Traveling from one major city to another, most of the journey is probably on the interstate, moving at high speeds. Reaching your destination—the last mile of the trip—is often more complex. It means exiting the super-highway and winding through a maze of side streets, traffic lights, and congestion. For some multifamily property owners, "last mile" internet connectivity might seem just as complicated. It's that final communications hand-off bridging an internet provider's network and the residents of
a multi-dwelling community. It's important to note that the majority of fiber-enabled properties receive fiber all the way to the premises or living unit—making for a much smoother last mile. For some communities, though, there may be other technologies involved and different challenges. Recently, some of the last mile discussion has shifted toward what role 5G might play. Wireless but not limitless Like any wireless technology, 5G uses radio signals to send data and information back and forth through the air. And, just like any radio signal, 5G signals become weaker as they travel further away from their transmitter. In fact, the high-density characteristics of
5G waves cause them to dissipate quickly. What's worse is that the signal breaks down even further when it hits solid walls, Low-E glass, building materials like concrete or steel, or even environmental landscapes like dense foliage. For multifamily owners, it's essential to remember just what 5G is—and what it is not. While advanced, 5G is still cellular phone technology. If a building has indoor coverage problems with earlier cellular systems (2G, 3G, 4G), 5G won't perform differently. Due to these types of interference issues, property owners won't find outdoor, over-the-air 5G networks to be reliable

solutions for providing service or connectivity inside their buildings. If a community doesn't have a managed WiFi system inside its walls, residents may find staying connected while using their phones or smart devices difficult. As they roam from outdoor spaces back inside their apartments, they will likely run into signal drops. These lapses in coverage will be glaringly obvious (and frustrating) for anyone streaming content or making video calls as they move around. For the time being, it seems, WiFi will continue to be the primary indoor solution for transmitting data and voice.

Chula Vista developing Tenant and Anti-Harassment Protection Policy
In November 2021, the SCRHA Legislative Steering Committee met with Chula Vista city staff to provide initial feedback on a proposed Tenant and AntiHarassment Protection Policy. City staff met with stakeholders to get comments on the proposals before they presented their recommendations to the city’s Housing Advisory Commission on December 8. Having received additional direction from the Commission, city staff will again meet with stakeholders and present a draft ordinance to the Housing Advisory Commission in January. The Chula Vista City Council on October 26 directed city staff to draft the tenant and anti-harassment policy and return to the council for additional consideration or adoption in January 2022. The council was responding to several complaints from tenants and a tenants rights’ organization, the Alliance of Californians for Community Empowerment (ACCE) regarding the nature of several recent tenant evictions. The policy will address issues regarding 1) Substantial rehabilitation, 2) Removal (of a unit) from rental market, 3) Harassment/Retaliation (by a landlord), and 4) City Remedies & Enforcement.
California law already addresses these issues, but several Chula Vista City Council Members believed the city should have greater protections in place for tenants. City staff reported on their research of other city ordinances and on their meetings with stakeholder groups such as the SCRHA. Riverside County adopts new district maps, but Legislative and Legal conflict loom in the future
The Riverside County Board of Supervisors voted to approve new Supervisor district maps for the next decade on December 14. While the maps will remain in effect until 2030, several organizations are unhappy with the county’s redistricting process and final maps and may take legal action or change the process through legislation. Riverside County, like all cities, counties, and states in the United States, must redraw their electoral district maps every ten years according to data from the U.S. Census, while following state and federal voting right laws. Each Riverside County Supervisor District must represent approximately 486,000 residents and ensure all residents will be equally represented. County Supervisors voted 4-1 on December 7 and again on December 14 to adopt proposed maps under Option F. Riverside County added approximately 300,000 new residents over the past decade. Over half of the new residents identified themselves as Latino, becoming the largest demographic group in the county. Several advocacy groups and elected officials have argued the new district maps should be drawn to reflect the Latino majorities in each district. Several Latino advocacy groups, and the Americans for Civil Liberties Union (ACLU) of California, submitted letters and statements dissatisfied with the redistricting process. The organizations proposed the County should either add several new district maps or alter draft maps in ways to increase Latino
representation. Known as Map 1.4, the groups proposed that two brand new Supervisor Districts be added in between Districts 1, 2, and 3. However, Supervisors and rural residents complained that incorporating those new districts between existing ones would split the electoral maps of cities of Riverside, Corona, Hemet, Eastvale, and Menifee. Significant changes have been made to districts 1, 2, and 3. County Supervisor District 2 still includes the City of Eastvale but now extends south to include Temescal Valley and Lake Elsinore almost to the City of Wildomar. District 2 now covers all the City of Riverside, Jurupa Valley and extends south to include the City of Perris but loses Lake Elsinore and Temescal Valley to District 2. The new District 3 map shifts west and north covering the cities of Murrieta, Menifee, Temecula, and Temecula Valley Wine Country as far east as the Anza community but loses the City of Hemet to District 5. District 5 map covers the cities of Moreno Valley, Banning and now the City of Hemet but no longer includes the mountain communities of Idyllwild and surrounding neighborhoods. District 4 remains the largest district in the county geographically beginning west with Palm Springs and Idyllwild going east to Blythe on the California-Arizona Border. The groups and one state Assemblymember have vowed to legally challenge or legislatively change the county’s redistricting process in the future. The ACLU and Latino groups say they will sue the county for not complying with state and federal voting rights act. To date, the groups have not yet filed suit. CA Assemblymember Sabrina Cervantes, 60th District, introduced AB 1307 last February which would change Riverside County’s current redistricting process for 2030. The bill creates a 14-member independent redistricting commission; each commissioner must meet certain criteria to oversee the process. The bill, if enacted, would strip the Board of Supervisors’ sole authority to redraw their districts. AB 1307 is scheduled to be heard in committee this month. Riverside County Supervisors, while not opposed to AB 1307, say the bill is not the best solution.

SANDAG approves 2050 Regional Transportation Plan, and possibly new taxes to pay for it
The San Diego Association of Governments (SANDAG) Board of Directors approved its 2050 Region Transportation Plan (RTP) last month. The 2050 RTP envisions how the San Diego region will achieve its future transportation needs. The 2050 RTP anticipates the region will need $160 billion to expand roads and highways, but the plan would primarily focus on expanding rail and bus transit to connect cities and communities while achieving the region’s climate action objectives. The plan is also predicating that voters will accept several sales tax increases and potentially a vehicle mileage tax to pay for the RTP’s implementation. The RTP plans for the construction of 800 additional miles of carpool or managed lanes on highways and funding to improve traffic light synchronization to ease traffic flows. It proposes double tracking of San Diego’s coastal rail corridor, connecting existing rail lines and
building new stations in OId Town San Diego, San Diego International Airport, and the Otay Mesa port of entry. The RTP includes the purchase of zeroemission buses and the building of new bus hubs at train stations to expand the region’s rapid transit bus system. The plan will build more electric vehicle (EV) charging stations and include outreach encouraging the purchase of more EVs. While the plan has been approved, it remains controversial. Critics of the RTP believe funding should focus on existing road and highway infrastructure rather than building new rail projects. Critics add expanding rail will not increase ridership and point out that construction of massive transportation projects could trigger long legal challenges from groups opposed to the projects. The SANDAG Board of Directors were initially to vote on the 2050 RTP that would include the Board’s adoption of the two sales tax increases and the vehicle mileage tax called the “road charge” fee. The sales tax increases would be placed on the ballot in 2022 and 2028; the separate road charge tax would take effect in 2030, but due to rising criticism

over the “road charge” fee, several SANDAG Board Members decided to withdraw their support of the proposed vehicle mileage before the vote on the RTP. The controversial proposed road charge fee would have charged drivers a tax when using an automobile. The tax rate fluctuates depending on how far a driver travels and when they travel using an automobile; drivers would pay a 4 cent per mile tax in conjunction with the state’s vehicle mileage fee beginning in 2030. A group of city mayors and San Diego County Supervisor Jim Desmond announced their opposition to the road charge early on. Just prior to the SANDAG Board’s vote on the 2050 RTP, the Mayors of Chula Vista, Encinitas, San Diego, and National City, who sit on the SANDAG Board, withdrew their support of the road charge tax. San Diego Mayor Todd Gloria asked SANDAG staff to research other funding alternatives to the road charge tax. The first sales tax increase is expected to be placed on the ballot later in 2022 with a similar sales tax increase measure to slated for 2028 ballot.
San Diego County Supervisors adopt plan to attach Community Benefit Agreements with Development Projects
In mid-December, the San Diego Board of Supervisors unanimously moved forward with a proposed Community Benefit Agreements (CBA). The policy would allow builders to provide additional services and amenities with their projects in exchange for additional community support and/or to receive public subsidies. County staff say more local governments are adopting CBA policies. The CBA policy could require or add incentives to projects that provide additional benefits to the community such as providing employment training, hiring companies that use local labor, or contributing to education and workforce training programs. CBAs also could ask projects to include additional public amenities like parks and libraries or incorporate renewable energy or other components addressing climate change. While the details of the CBA policy are under development, all types of commercial, industrial, and residential projects including energy facilities and hospitals could be affected by the policy.
County staff has 180 days to develop the plan and return to the Board of Supervisors. Despite the Supervisors’ unanimous support for moving forward with developing the policy, there was concern that the policy could potentially create more obstacles to new projects. SCRHA will provide a future update when the draft policy is available.
Court stops San Diego ability to increase building height limit in its Midway Community
In mid-December, a San Diego Superior Court judge ruled that the City of San Diego may not implement Measure E to its Midway District Community Plan approved by city voters in November 2020. Measure E allows San Diego to raise the 30-foot height limit on projects built in the Midway District. The judge in her ruling stated that San Diego should have performed environmental analysis of buildings higher than 30 feet prior to placing Measure E on the November 2020 ballot. While the city attorney’s office made the argument that the Midway Community Plan Update environmental analysis does address impacts like housing density, traffic, air quality and climate change, the judge said San Diego failed to demonstrate that it studied the specific visual impacts of buildings taller than 30 feet. San Diego says it will appeal the Superior Court ruling, but it jeopardizes the city’s ability to approve taller buildings and builders’ ability to develop higher more dense projects in the Midway area until a higher court reverses the ruling.

Seven Insurance Reviews for 2022
By Snapp Risk Management, Snapp & Associates Insurance Services, Inc. You know the drill — New Year’s means resolutions. For business owners and managers, the new year also means an opportunity to examine all the ways you might want to better protect all that you have worked for in year ahead. Below are a number of reviews you should resolve to check off your list to mitigate overall risk. 1. Liability Levels Whatever existing business policies you have in place, they all come with various levels of professional or business liability coverage (if you make a mistake, injure someone, cause harm, etc.). However, those liability levels might have been set years ago and don’t reflect the current economic situation. You may also have more business (and personal) assets you need to protect as the result of an error. Make a point of scheduling a liability level review with your broker or agent as soon as possible in the new year.
2. Replacement Value The 2021 word of the year could easily be “inflation.” You’ve seen it no doubt as you purchase supplies, pay for equipment and even deal with higher employee wages. Don’t forget to factor in the costs of goods and services for any replacement value levels on your existing policies. While you may have had an accurate cost forecast for replacing your building or equipment in 2021 or even 2020, everything has increased, sometimes by a factor of 30 – 50% or more. If you face a loss, be sure you aren’t short when it comes to the necessary cash to replace losses at current market prices. 3. Loss of Use An important part of your overall insurance package is ensuring that you are covered if you are unable to use your business or facility. Whether by natural disaster or even just an external issue that makes you unable to open or operate (such as
something like a nearby gas leak), you may not be able to generate any income. However, hard costs continue to accumulate and a Loss of Use provision gives you compensation to help manage recurring expenses. The new year is a good time to review your Loss of Use coverage and raise limits if necessary. 4. Examine How New Laws Affect Your Liability Every January 1 brings new laws that affect business owners across the board. 2022 will be no different and be sure you are up to date on new regulations that might open you up to new liability issues. For instance, some California business owners (warehouses and distribution centers) will now need to follow state AB 701, which deals with employee quotas and breaks and meals. quota caused a violation of their right to a meal or rest period or required them to violate any occupational health and safety law or standard, they have the right to request, and the employer is required to provide, a written description of each quota to which the employee is subject and a copy of the most recent 90 days of the employee’s own personal work speed data.” (per AB 701 text) This means an employer may be exposed to litigation risks if they do not manage reasonable quota levels allowing for legally mandated break and meal times. 5. Discuss New Options With Your Broker Insurance carriers also use the new year to roll out new products and offerings. Whether it is time for your renewal or not, it’s not a bad idea to schedule time with
your broker or agent to look at any new policies or rider/add-on coverages you may want to add to your suite of products in 2022. 6. Identify Ways to Reduce Overall Cost In addition to looking at options to add to your policy, also take the time to examine ways to potentially remove unnecessary riders or coverages to reduce your overall premium expense. For example, if you are paying an add-on rider to cover a piece of equipment that you may replace with something else or not even use, consider removing that rider off your policy to lower your annual premium.

By Southern California Rental Housing Association SB 655 went into effect January 1, 2016. The law adds mold to the list of substandard housing conditions under Civil Code Section 1941.7 and amends the Health and Safety code sections 17920 and 17920.3 as it relates to housing standards suitable for habitation. The law states that, if a part or an entire structure is found to have conditions unsuitable for human habitation, the building is considered substandard or uninhabitable. For example, a structure is considered substandard if part of or all of it lacks proper sanitation, lighting, heating, or other condition deeming it unsuitable for human living. Mold is defined as microscopic organisms or fungi that can grow in damp conditions in the interior
of a building. SB 655 specifies that visible mold growth in a structure is a substandard condition unsuitable for human living conditions if determined as such by a health or code enforcement officer. However, the rental unit will not be deemed substandard by a health or code enforcement officer if the presence of mold is determined to be only minor and found on surfaces that typically accumulates moisture as part of their proper and intended use such as a kitchen/bathroom sink, shower/bathtub, and toilet.
1. The landlord has no notice of the problem of mold, or 2. The tenant fails to keep the property clean and sanitary, or the tenant’s own improper use of the plumbing fixtures contributed substantially to the mold problem.

Should the landlord fail to maintain or resolve the problems making the property substandard, the tenant may take legal action for compensation and damages, withhold rent, terminate their rental agreement, and deduct expenses from their rent.
officer determines that visible mold growth could compromise a tenant’s health, safety, and wellbeing. The landlord is required to repair or remediate the issue when mold has been detected. However, a landlord is not held responsible for mold growth if the tenant does not keep the unit sanitary or if the tenant commits another violation of the rental agreement under Civil Code Section 1941.2. This section covers the tenant’s responsibilities in the rental dwelling such as keeping the property clean, discarding trash and waste, proper use of utilities and fixtures and not damaging property. Landlords are advised to include provisions, or add an addendum such as the SCRHA’s Form 269 – Mold and Mildew Addendum, in their rental agreements making the tenant contractually responsible for taking reasonable measures to reduce dampness and limit mold growth, require the tenant to notify the landlord immediately of any plumbing overflows or leaks if the tenant sees any mold growth, list some common practices to help tenants prevent or limit mold growth, and include language indemnifying or holding the landlord harmless if the tenant fails to comply with the terms of the rental agreement to limit or prevent mold growth. Landlords also should provide full disclosure to the tenant(s) of any issues regarding mold with the property. The SCRHA strongly opposed SB 655 while it was under consideration in the Legislature. The SCRHA voiced strong concerns about a number of risk
management issues created by the bill, such as: • SB 655 does not provide a workable standard for code enforcement or for property owners who want to stay in compliance with the law. • The reference to “any visible mold” is inconsistent with the existing substandard housing code sections, which require that a listed condition must exist to an extent that it endangers health. • There is no standard relative to how much mold endangers health. At the same time, the terms “inappropriate housekeeping practices” and “improper use of natural or mechanical ventilation” are too vague to be enforceable. Unfortunately, a few real estate organizations removed their opposition to the bill leaving the SCRHA and its California Rental Housing Association (CalRHA) allies as the only apartment associations working to oppose this flawed measure. Rental Providers Must Provide Mold Booklet Effective January 1, 2022 Rental Housing Providers must begin providing written disclosure to all prospective tenants of the potential health risks and the health impact that may result from exposure to mold by distributing a consumer-oriented booklet. The Booklet, “Information on Dampness and Mold for Renters in California,” must be provided to prospective residents prior to entering into the rental agreement. BREAKING DOWN $1 DOLLAR OF RENT There exists a misconception that rental housing owners enjoy large margins and can continue operating in the absence of rent payments. With so much discussion around rent payments during COVID-19, the rental housing industry would like to explain the breakdown of $1 dollar of rent.
Only 9 cents of every $1 are returned to owners, including the many apartment owners who are themselves small businesses and rely on this revenue to make ends meet, and investors, which include public pensions and 401ks, on which many Americans rely—whether or not they reside in rental housing.
Approximately 39 cents of every $1 pays for the mortgage on the property. Roughly two-thirds of the apartment industry has private lenders and are ineligible for federal mortgage forbearance via the CARES Act. This is a critical expense, as mortgage foreclosures put all residents at risk of losing their housing.
10 cents of every $1 is spent
on capital expenditures, including roof and HVAC replacement and other important repairs that help ensure quality housing for America’s 40 million rental housing residents.
27 cents of every $1 covers payroll expenses, including paying employees who operate and maintain the property, ongoing maintenance, utilities, insurance and the like.
14 cents of every $1 goes to property taxes, which in turn supports the community through financing for schools, teachers, emergency services and other important local needs.
Between mortgage payments and investor returns, which help support many Americans’ retirement plans, and dollars put back into the apartment community to ensure quality living for residents, a rent payment is much more important than one might otherwise realize. By Southern California Rental Housing Association With the end of the statewide eviction moratorium on September 30, housing providers must now serve a new notice when rent is not paid and be prepared for new court procedures for Unlawful Detainer cases. Housing providers are encouraged to apply for Emergency Rental Assistance on behalf of residents who have not applied on their own if they have not done so already. Every effort with regard to rental assistance must be made before the courts will issue a summons in an Unlawful Detainer or a judgement in Small Claims. SCRHA members may now access the new 3-Day Notice to Pay or Quit form for the COVID-19 Recovery Period, Form 404. Because the Unlawful Detainer process that came into effect on October 1 is brand new, members are strongly encouraged to consult with an attorney if considering an eviction. Effective October 1, 2021, under the COVID-19 Rental Housing Recovery Act, the content of notices demanding that a residential tenant (including a mobilehome park tenant) either pay COVID-19 recovery period rental debt or vacate the premises (3-Day to Pay or Quit), is altered in the following ways: • The notice must provide tenants at least 3 days

(excluding Saturdays, Sundays, and other judicial holidays) to pay the amount due or vacate. The notice must include specified language informing the tenant about how to apply for rental assistance, including a telephone number that the tenant may call and a website that the tenant may access in order to start an application for government rental assistance. The notice must include the following warning: “DO NOT DELAY! IF YOU DO NOT COMPLETE YOUR APPLICATION FOR RENTAL ASSISTANCE WITHIN 15 BUSINESS DAYS, YOUR LANDLORD MAY BE ABLE TO SUE TO OBTAIN A COURT ORDER FOR YOUR EVICTION.” Requires any landlord who negotiated a rental agreement in Spanish, Chinese, Tagalog, Vietnamese, or Korean to provide the tenant with the notice under 11) in that language. Also requires the Business, Consumer Services, and Housing Agency to make available on its website an official translation of the notice into these languages, no later than September 15, 2021 Between October 1, 2021, and March 31, 2022, the following procedures should be used for any unlawful detainer action for recovery of residential real property due to nonpayment of January 2022 socalrha.org | 35
rental debt that accumulated due to COVID-19 hardship: • No summons may be issued unless a landlord files one of the following: • A statement, under penalty of perjury, that the landlord completed an application for government rental assistance to cover the amount demanded from the tenants in the case, and that the application was denied; and (2) a copy of the final decision from the pertinent government rental assistance program denying the application. • A statement, under penalty of perjury, verifying that all of the following are true: • Before filing the complaint, the landlord submitted a completed application for rental assistance to the pertinent governmental rental assistance program to cover the rental debt demanded from the defendants in the case. A “completed application” is defined under the Health and Safety Code as one in which the applicant has provided all necessary contact information and documentation required for a government rental assistance program to initiate a review of the application for eligibility. • 20 days have passed since the later of (1) the date the landlord submitted the application or (2) the date the landlord served the tenant with the three-day notice to pay rent or vacate that is the basis of the unlawful detainer case. • The landlord has not received notice or obtained verification from the pertinent government rental assistance program indicating that the tenant has submitted a completed application for rental assistance to cover the rental debt demanded in the case. • The landlord has received no communication from the tenant that the tenant has applied for

government rental assistance to cover the rental debt demanded in the case. • A statement, under penalty of perjury, that the rental debt demanded in the complaint accumulated under a tenancy that was initially established on or after October 1, 2021. A summons that issues on a complaint based on this statement is not subject to the requirements of the COVID-19 Rental Housing Recovery Act. The court may not issue a judgment or default judgment for unlawful detainer unless the court reviews the pleadings and evidence and finds that the requirements were satisfied. In any contested case, the landlord has the burden of proving these requirements were met. For rental debt that accumulated due to COVID-19 hardship that was incurred on or after October 1, 2021, and before March 31, 2022, a landlord must be compensated for all of the unpaid rent demanded in the notice that forms the basis of the complaint. For rental debt that accumulated due to COVID-19 hardship that was incurred on or after September 1, 2020, and before September 30, 2021, a landlord must be provided 25% of the unpaid rent demanded in the notice that forms the basis of the complaint. Establishes a process for a tenant to avoid forfeiting their lease or rental agreement. The tenant may initiate this process by submitting verification to the court that a government rental assistance program has approved an application for rental assistance, corresponding to all or part of the rental debt demanded in an unlawful detainer complaint. The verification must be submitted before the property is restored to the landlord. In the case of partial rental assistance, the tenant must make the additional payments necessary to satisfy the full amount of rental debt demanded in the complaint. If, after a hearing, the court determines that the necessary conditions have been met, then it must grant the tenant’s application for relief, set aside any judgment in the case, and dismiss the case Sunsets the provisions of the COVID-19 Rental Housing Recovery Act effective September 30, 2024.

DEFINITIONS • “Rental debt” means unpaid rent or other unpaid financial obligation of a tenant that has come due. • “COVID-19 rental debt” means unpaid rent or any other unpaid financial obligation under a tenancy that came due between March 1, 2020, and September 30, 2021. • “COVID-19 recovery period rental debt” means rental debt of a tenant that came due between October 1, 2021, and March 31, 2022. • “Rental debt that accumulated due to COVID-19 hardship” means COVID-19 rental debt, COVID-19 recovery period rental debt, or a combination of both, if it accumulated during a tenancy initially established before October 1, 2021. For purposes of this definition, a tenancy is deemed to have been initially established when the tenant first lawfully occupied the premises. • “Government rental assistance program” means any rental assistance program authorized pursuant to the Health and Safety Code provisions that establish the State Rental Assistance Program. • “Pertinent government rental assistance program” means a government rental assistance program for the city, county, or city and county in which the property at issue is located. • “Approved application” means an application for rental assistance for which a government rental assistance program has verified the applicant’s eligibility, and the requested funds have been obligated to be paid to the applicant. • “Final decision” means that a government rental assistance program has made either of the following determinations regarding an application for rental assistance: the application is an approved application, or the application has been denied for any of the following three reasons: • The tenant is not eligible for government rental assistance. • The government rental assistance program no longer has sufficient rental assistance funds to approve the application. • The application remains incomplete for 15 days (excluding Saturdays, Sundays, and other judicial holidays) after the landlord properly completed the portion of the application that was the landlord’s responsibility, due to the tenant’s failure to properly complete the portion of the
application that is the tenant’s responsibility. The following outcomes are excluded from the definition of “final decision”: • Rejection of an application as either incomplete or improperly completed by the landlord. • Notification that an application is temporarily pending further action by the government rental assistance program or the applicant. • Notification that the landlord applied to the wrong government rental assistance program for the property or rental debt at issue. Do I always have to give written notice to our resident before making a repair? They called yesterday and we simply made an appointment for the plumber to meet them at the property next week.
A
Normally, you would have to give a written 24 hour notice, but if the tenant and the landlord orally agree to an entry to make repairs or supply services for a specific date and time, and the entry is within one week from the date of the agreement, no written notice is required. Also, in cases of emergency or abandonment, the landlord is not required to give written notice.
Q
Can a resident legally drink alcohol in the outdoor common areas of an apartment community?
A
Landlords have the right to restrict the drinking of alcohol in the common areas of the premises.
Q
My tenant vacated and has damaged the unit more than the security deposit will cover. The tenant had a co-signer on the agreement. I have written the tenant and co-signer with no response after 30 days. Do I file a small claims action against both the tenant and the co-signer or should they be separate lawsuits?
A
You can file against both of them in the same small claims court suit.
Q
This month’s rent check from a tenant had a second name printed below the tenant’s name on the upper left corner of the check. If I cash the check for this month’s
rent, am I changing the terms of tenancy?
A
The mere fact that another person is listed on the check does not change the terms of the tenancy. You should inquire about the other person or find other ways to determine if there is an unauthorized occupant, and if so, either have the extra person apply for residency or serve a 3-day notice to perform covenants or quit.
Q
I am considering selling a duplex I own. Both sides are rented under one year leases. A potential buyer said he would need to move into one side of the unit and could not wait for the lease to expire. If there is a sale, doesn’t that terminate any lease I have with the tenants? A voluntary sale of leased property does not terminate the rental agreement or lease; the new owner steps into the shoes of the former owner and has the same rights and obligations of the former owner.
Q
One of our single tenants who was renting a small one bedroom unit recently died. There are still three months remaining on his lease. What should I do with the security deposit?
A
Generally, a tenancy for a specified term does not terminate on the death of either the landlord or the tenant. Once the executor or administrator of the decedent’s estate returns possession, you should account for the use of the deposit and direct the accounting to the administrator or executor.

What is a request for a reasonable accommodation?
A reasonable accommodation is a change or exception to the property’s rules, policies, practices or services that is necessary to afford a person with a disability full and equal use and enjoyment of the rental property.

I understand that if a building contains 16 or more units, there must be a resident manager. I have given some responsibilities to an on-site maintenance person, but I do not call him a resident manager. Does this situation comply with the law?
A
The California Administrative Code requires that a building containing 16 or more units on a parcel must
have a person who lives on site and is responsible for representing the owner of the property. The person does not, however, have to be called a “resident manager.”
Q
How can we enforce the entry rules clause in our lease? One of our residents is refusing to show the rental unit to a prospective purchaser of the building.
A
California’s Civil Code specifically requires residential tenants to allow the landlord to show the rental unit to prospective purchasers and their agents. Failure to comply could lead to an action for unlawful detainer after service of a 3-Day Notice to Perform or Quit if the resident refused to give reasonable dates and times for the entry.

I have a tenant who is driving everyone in the apartment complex nuts. He plays his stereo and television all day and all night and keeps everyone up. We call the police constantly but they can only do so much. I want to evict him but he signed a one-year lease. None

If the tenant is causing major and continual disturbances to the quiet enjoyment of the neighboring property and it is severe enough, the court could allow you to evict the tenant after service of a 3-day notice to vacate This notice does not allow the tenant to cure anything. Writing warning letters and documenting the disturbances can bolster your case if the tenant does not stay quiet.

Tips for Advertising Your Property By Southern California Rental Housing Association Craft Engaging Content Use an Interesting and Professional Headline A headline is often the first thing that leads a potential resident to open an online posting for a new home. Make sure to use professional language and grammar in addition to having a quick and catchy title for your post. Use Pictures for Visual Appeal Portraying your property in a visually appealing manner goes a long way towards hooking an interested renter with an online posting. The best postings use their photos to give a true-tolife sense of what the space feels and looks like. First impressions are important; don’t skimp on showing off what your asset has to offer. Use Easy-to-Understand Language Making your posting easy to read and detailed is an excellent tactic to be conscientious and honest. Give potential residents a clear description of the property, its
positive aspects and any potential drawbacks. Make sure to include information on your personal policies in regards to important topics like smoking, pets, parking and guests. It is common courtesy to consider a potential resident’s time and energy spent on looking for a new home and better to provide an honest description than mislead them and have a frustrated renter walk out on signing a lease.
Protect Your Posting Track Your Ad Create a Google Alert or similar online tracker to monitor any copies of your posting being created. Make sure to monitor for any specific language that you used in your posting and keep track of the images you uploaded being recycled for scam advertisements.
