appy 2018! I hope you and your family had a great holiday season. I thank the SDCAA membership for giving me the opportunity to be this year’s President. 2018 could be potentially the most challenging year for the Rental Housing Industry – So, I encourage all members and their staff to subscribe to SDCAA communications and sign up to receive SDCAA alerts. If you haven’t noticed, there is local group trying to push an effort to have the San Diego City Council impose rent control, and an effort statewide to gather signatures needed to place a ballot initiative on November 2018 election asking voters to repeal state’s Costa-Hawkins Rental Housing Act. By the time you read this message, it is quite possible the group could have the signatures necessary to place the measure on the November ballot. If the initiative is placed on the ballot, we will need your help. But really, it shouldn’t matter if the initiative is placed on the ballot or not - we need you to tell your neighbors, clients, and elected officials that rent control or repealing Costa-Hawkins is the worst possible approach to solve California’s housing crisis. If you are not concerned as a voter, you should be deeply concerned if you are parent. The repeal of Costa Hawkins or implementing rent control ensures your children and grandchildren will be living out the region or out of state.

Out of control housing costs and rents affects us too! None of us can avoid the black hole of California’s housing crisis - It affects our employees, our businesses, and way of life. Slapping rent control on housing will not solve CA’s housing affordability crisis. What will solve the crisis are meaningful policies that will stimulate housing production of all income levels. There are many groups and elected officials who agree with our position that rent control is not the answer; but, we as employers, employees, concerned citizens, and family members need to step up and say – we need more housing now, and more housing is a better solution. If we don’t offer an alternative answer or speak loudly enough, someone else will make decision for us. We need your help – as much as you can offer. We understand SDCAA members have professional and personal lives too, but we can achieve more with more people contributing. SDCAA has hundreds of volunteers, but it would be much better if we had thousands of volunteers. Let’s make SDCAA stronger and louder. Each email, phone call, or visit with an elected official makes a difference. With your help, 2018 will be another great year!

The task becomes even more difficult once the tenant is gone since the tenant’s incentive to remain in the property no longer exists. This is particularly true when the tenant is unconcerned with his or her credit or if his or her credit is already poor. At this point, a former tenant has little incentive to pay at all.

This question is answered with a short discussion of the most commonly used judicial enforcement techniques: wage garnishments, the bank levies, and judgment debtor examinations. But, please be aware. In order to pursue these avenues, it is necessary to obtain a money judgment against your tenant during the eviction case.

law firms regularly pursue wage garnishments, bank levies, and judgment debtor examinations. Law firms that specialize in collecting unlawful detainer judgments enjoy a huge advantage over collection agencies. Law firms can collect from former tenants who have no intention of cooperating by using the court system to force payment. Wage Garnishments Provided that a place of employment can be discovered, a wage garnishment can be the simplest and most direct way

to enforce a judgment. In some cases, depending upon a debtor’s financial situation, a wage garnishment may be the only way to collect. In California, 75% of a defendant’s wages are automatically exempt from garnishment. Therefore, most often, a judgment creditor is entitled to 25% of a defendant’s wages. In order for a wage garnishment to be effective, the defendant must be an employee and not work as an independent contractor. The first step in pursuing a wage garnishment is to apply to the court for a writ of execution. There can be only one writ of execution outstanding, per county, for a case at any given time. Once the writ of execution has been issued, the creditor must complete an official form approved by the Judicial Council to apply for the earnings withholding order. Once the order is issued, the creditor must serve the garnishment papers on the defendant’s employer. It is important to include enough information on the application for earnings withholding order so that the employer can sufficiently identify the defendant. The defendant’s social security number is most effective but date of birth, home address, and other identifying information may be used as well. A wage garnishment is effective

10 calendar days after service and remains in effect until the judgment is satisfied or until the employee is terminated.

is located. Creditors can use either the County Sheriff or a registered process server to serve bank levies.

While the process of obtaining and serving the garnishment can be relatively simple, there are three potential obstacles.

A bank levy can be exceptionally effective since creditors may reach all monies in the account up to the judgment amount with interest. However, a bank levy is often thought of as a “one shot deal” since almost all defendants close their bank accounts once a levy has been served. If there is little or no money in the account at the time of service, the creditor has effectively “tipped the defendant off” and many defendants will quickly try to hide or transfer remaining assets.

First, the employer may not voluntarily comply with the garnishment. Employer noncompliance typically occurs when the employer has a special relationship with the defendant (i.e. a friend or family member.) It is surprising how often an employer will seek to “cover” for the defendant by denying that the defendant is an employee or by paying the defendant “under the table.” In this instance, it may be necessary to file suit against the employer. Second, the defendant’s wages may already be garnished by another creditor. If a garnishment is served while a prior order is in effect, the garnishment is not effective. Garnishments for unpaid taxes and child or spousal support take priority over other judgments. Third, the defendant may quit or be terminated. If the wage garnishment is effective, it is the responsibility of the employer to pay garnished monies to the County Sheriff on a monthly basis or at the close of each pay period. Bank Levies In order levy a bank account, a writ of execution is required for the county in which the account

Levies must be served at the branch where the account is held or at a centralized location designated by the bank. Most firms that specialize in debt collection have sophisticated techniques for discovering a defendant’s place of banking. Law firms that specialize in debt collection often pursue not only checking and savings accounts but property held in safe deposit boxes as well. To seize property in safe deposit boxes, a special court order is required. After service of the levy, the bank may not allow an account holder to make withdrawals of the levied funds. In effect, the account monies are “frozen.” Additionally, the financial institution may not honor a check drawn on the levied monies. Judgment Debtor Examinations In the event that a creditor does not know where a defendant works or banks, the judgment creditor may apply to the court January 2018 RentalOwner | 7

for an order for appearance of the judgment debtor (commonly referred to as a judgment debtor examination.) Unlike many other judicial processes, the order must be personally served upon the judgment debtor 10 days prior to the court hearing. If the defendant can be served, the judgment debtor examination is the equivalent of post-judgment discovery. In court and under oath, the defendant must disclose his or her assets. An interesting nuance of the judgment debtor examination is that, upon service, a “secret lien” is created upon all of the defendant’s nonexempt personal property. The lien is effective for one year. Any property transferred by the debtor within

this one year period remains subject to the lien. If a defendant does not cooperate or comes to court unprepared, the attorney taking the examination may request a continuance in order to obtain additional information. A subpoena can be served requiring a defendant to bring documentation that will assist in collection (pay stubs, bank records, etc.) If a defendant is properly served and fails to appear, a bench warrant may be issued for the defendant’s arrest. Each court has its own process for handling failure to appear cases. Some courts provide an additional opportunity for the defendant to appear while others issue bench warrants at the time of hearing.

LEGISLATIVEUPDATE Superior Court decision says mini-dorm ordinances were unconstitutional

Last month, Superior court Judge Ronald Styn ruled that two City of San Diego ordinances that restricted so-called mini-dorms in the City of San Diego were unconstitutional because the ordinances discriminated against adult university students living in the area. In November 2016, the San Diego City Council approved an ordinance that added new restrictions on existing rooming houses and essentially stopped the development of new rooming houses in the SDSU College Area. Judge Styn ruled that the new ordinance and the preexisting Residential High Occupancy Permit (RHOP) Ordinance were unconstitutional and that the City of San Diego immediately stop enforcing the ordinances. Under the RHOP, landlords of a rooming house were required to pay $1,000 a year to get a parking permit if there are five or more people over the

age of 18 residing at a single-family house. The parking permit required all occupants, except one, to park off street and all off-street parking within 30 feet of the property line was prohibited. In response to ordinances, a group of homeowners and students filed a lawsuit against the city contending the ordinances were discriminating against adult students.

In June 2017, the Superior Court imposed an injunction on both ordinances stopping the city from enforcing those rules until the court made its ruling permanent - The December decision renders the ordinances unenforceable unless the City of San Diego decides to appeal the ruling to the State Court of Appeals – the city had not decided if it would appeal the decision at the time this article was written. The SDCAA had long opposed the ordinances and tried to convince the city to provide a more equitable solution to the student housing problem in the College Area that didn’t put landlords in jeopardy of violating fair housing rules. Additionally, the SDCAA cautioned that not enforcing the ordinances January 2018 RentalOwner | 9

equitably could be a problem since technically the RHOP applied to owner-occupied homes as well. The SDCAA will continue to monitor the issue.

San Diego City Council President Changes Committee Leadership

In early December, the San Diego City Council re-appointed Councilmember Myrtle Cole (District 4) as Council president. In that role, Cole also appoints councilmembers to committees and selects the leadership of council committees. It was announced that Councilmember Georgette Gomez will now serve as Chair of the Smart Growth & Land Use Committee. The committee has been chaired by Councilmember Scott Sherman for the last year. Sherman, working

across the aisle with his Vice Chair, Councilmember David Alvarez, has helped champion many policies that would ease the approval process for new housing and was planning on more changes to help with the housing crisis. Gomez has been a member of the committee since taking office in 2017 and has been mostly supportive of the policy changes Sherman and Alvarez brought forward. However, it remains to be seen if the other policies priorities Sherman outlined in 2017 will be addressed. Gomez will be responsible for setting the committee agenda and work plan. At the time of writing this, the committee selections still needed to be approved by the full city council.

CAPITOL NEWS Rent Control Bill On Deck for January

2018 will be another busy year for SDCAA and its lobbyists. Already we know that while we were able to stall AB 1506 (Bloom), the bill to repeal the Costa-Hawkins Rental Housing Act, it will likely be back in January. The bill must get out of its policy committee, Assembly Housing & Community Development, by January 19. From there, it must be approved by the Assembly and sent to the Senate no later than January 31. Assemblymember Bloom has been candid about the controversy surrounding the bill. When he pulled the bill last year, he stated he wanted more time to work with all the stakeholders. Despite pressure from tenantâ&#x20AC;&#x2122;s rights

groups and others who support the repeal of Costa-Hawkins, neither Assemblymembers Bloom or Chiu, who chairs the housing committee, have openly discussed setting a hearing for the bill once session picks back up in January.

Expect to hear from SDCAA in January when the bill is scheduled to be heard. We will do a callto-action asking you to contact Assembly Members to ask them to vote against the bill. Make sure you receive SDCAA emails and follow us on Facebook and Twitter for news on the subject and ways you can help. What next? Even if the bill does not meet its January deadlines and dies, the industry will still have a ballot measure to contend with,

The filers of the ballot initiative, which is essentially the same as AB 1506, have stated that while they think the legislature should address the repeal of Costa-Hawkins (meaning passing AB 1506 and sending it to the Governor for signature), they are prepared to take the measure all the way to the November ballot. It remains to be seen if they mean it. Either way, there are groups of people out there who think that repealing Costa-Hawkins and allowing unfettered rent control is a good idea.

Harassment Claims Lead to Vacant Seats

At the time of writing this (midDecember), three members of the Legislature had been accused of sexual harassment or misconduct. January 2018 RentalOwner | 11

Assemblymember Raul Bocanegra (D-Pacoima) stepped down in November after several women accused him of unwanted sexual advances. Assemblymember Bocanegra served on the Housing committee and could usually be relied upon to understand the rental industry’s stance on bills, often times providing a key vote. Senator Tony Mendoza (D-Artesia) is under investigation for improper behavior with staff members and was stripped of his leadership posts. Assemblymember Matt Dababneh (D-Woodland Hills) stated he would resign by the end of December after being accused of inappropriate behavior by a female lobbyist. While he denies any wrong doing, he stated he would not be able to represent his district in the current environment.

The resignation of the two Assembly Democrats means the democrats no longer have a supermajority. They are likely to reclaim those seats once the special elections occur. The primary election to replace Raul Bocanegra will take place April 3, with a June 5 run-off. The dates for the election to replace Dababneh had not yet been decided.

It’s not 2018 yet, but political parties and challengers alike are hoping they will be victorious in November. Assembly Member Marc Steinorth, CA 40th District, will face two challengers in the June primary. A local Democrat Mark Parker announced that he will file paperwork to challenge Steinorth, but no new information has emerged regarding Parker’s candidacy. Most recently, San Bernardino Unified School District Teacher and Democrat Libbern Cook announced in November that he intends to run against Steinorth. Representing a district that has become majority democratic and Steinorth angering many Republicans for his vote to extend the California’s Cap

& Trade program earlier this year, observers believe Steinorth could face a difficult reelection in 2018. However, head of CA Republican Party Jim Brulte said the organization will spend additional resources to help with Steinorth’s reelection campaign. Steinorth has been Assembly Member since 2014 So far, three republican candidates announced they will challenge Democrat incumbent Congressman Raul Ruiz for the CA36st District in 2018. Ruiz was first elected in 2012 when he defeated long-time Republican Mary Bono. Soap Opera Actress Kimberlin Brown Pelzer announced her candidacy to run against Ruiz in October. Former Desert News TV anchor Dan Ball announced his candidacy to run against Ruiz in September. Another lesser known Republican Stephen Wolkowicz, a Finance Director for a hotel in

Desert Springs, also made claims that he would challenge Ruiz. California Republican Party Chairman Jim Brulte stated earlier this year that the Party will target Democrat Sabrina Cervantes to win back the 60th Assembly District in 2018. Assembly Member Cervantes was elected in 2016, defeating Republican Eric Linder. The CA Republican Party believes it can take back the 60th Assembly District, which was once considered a strong Republican district. Brulte believes Cervantes, who voted to approve the recent increase in gas taxes and car registration fees, is a vulnerable target. Corona Councilmember Randy Fox, a Republican and former Treasurer for the City of Corona, announced early in the year he planned to challenge Cervantes. January 2018 RentalOwner | 13
