he SCRHA continues to wait for the judge's ruling in its lawsuit after the initial hearing on June 21. While we wait for this ruling, we continue to do what we do best - advocate and educate on behalf of rental housing providers throughout Southern California. The Association has been busy on many fronts representing our industry and sharing our message, but we can't do it alone. Your voice is a critical component in helping our elected representatives and the community understand our experiences. We continue to hear from owners and property managers who find it increasingly difficult to provide a healthy and safe environment for all residents under San Diego County's onerous eviction moratorium. Share your story with SCRHA and share news clips and content from the Association with your network of family, friends, and colleagues. Everyone must understand how this law is a threat to all residents and all neighborhoods. While we continue the fight against the County of San Diego, SCRHA is also focused on helping our members comply with AB 832: California Eviction Moratorium Extension. Forms have been updated and are available on the website, and SCRHA is hosting a class to make sure housing providers have the tools they need to comply with the new law. e've all seen incredible changes in how we work and connect with others since we first went on lockdown in March 2020. The fact that we were able to continue our mission to advocate and educate for the rental housing industry despite travel restrictions, social distancing, and other mandates is a testament to the resiliency and adaptability of the industry. Make no mistake about it, our industry has been hard hit by the pandemic, and its effects will continue to affect us as the country reopens and gets back to business as usual. There will be no business as normal for us while owners and property managers navigate rental assistance programs and contend with ongoing eviction moratoriums. In the face of all these challenges, SCRHA was able to keep you updated on changing laws, updated forms, and crucial information by using the incredible technology at hand. As you may have experienced, our website and member portal changed in March of this year. This change allows us to offer you an upgraded user experience with greater security. The new system makes it easier for you to access your member benefits, such as upcoming classes, industry updates, and open invoices from a single dashboard. It's also changed how you access our rental forms and white papers. These resources are available at no additional cost to you. However, the process for downloading the content has changed. n a hot market, you may think your marketing does not matter as much. But it does matter, and you will want to make sure you don’t make these common marketing mistakes:
Advertising a home that is not ready to show or move in.
Using old pictures in advertisements.
Choosing not to paint, clean, or update the home before posting.
Refusing to use social media.
Not responding to prospects ASAP
Not having a video.
Not leaving it to the professionals to handle.
Prospective residents have extraordinarily little patience for your marketing mistakes, lack of skill, or knowledge. Think about the above before you post. The days of just getting the property online are over. It needs to be clean, crisp, and attractive. The advertisement and the home. This initial marketing can and does set the tone for the whole relationship. How you write your
ad and the picture you choose show the prospect how much you care and how you will treat them. Before posting, ensure your property is presentable for showings, you know the neighborhood and are highlighting that in the ad. Keep your ad updated with new pictures and information. A marketing title and description can help.
Consider posting flyers in the neighborhood. Make sure your landscape is nice- curb appeal matters. Always remember that your rental property is a business, not a hobby. San Diego Spends Millions to Comply with New Recycling Law
City of San Diego made another big investment to comply with California’s new organics recycling law which takes effect at the beginning of next year. San Diego and every local government are scrambling to meet the statute of SB 1383. SB 1383, which takes effect January 1, 2022, will require residents and businesses to increase their commitment towards organic recycling. The law, among other rules, will require Californians to separate food waste and food soiled products from other trash to discard in green recycling bins or to be used for composting. California’s recycling laws already require most businesses and multifamily properties to recycle green waste such as grass clippings and yard cuttings. San Diego announced last month that it is spending $30 million to purchase approximately one quarter million green recycling bins. Local governments are already working with waste haulers throughout California to have their recycling rules in place before the law takes effect. However, the process of complying with the new recycling law has been costly for San Diego so far. On top of rising equipment and labor costs of providing trash service, San Diego’s People’s Ordinance requires the city to provide free trash service to most

of its single-family residences. While most singlefamily homes enjoy free trash service, businesses, apartments, and condominiums must pay for their trash service. Despite the large purchase of the new green bins, approximately 90,000 customers still will not have the new green bins by 2022. The cost of providing trash service continues to increase annually. San Diego states the cost of providing the service will exceed $40 million annually. San Diego will be delivering the green bins by fall 2022; the city has delivered food pail buckets to most customers in the city. Several City Council members have criticized the People’s Ordinance arguing that lower income communities are subsidizing the cost provided for free to higher income communities. All local governments and waste hauler companies must be compliant with SB 1383 by January 1. Entities that are non-compliant could face fines by the state up to $10,000 per day. San Diego officials state they have been communicating with the state on its progress in hopes that it will not be fined. Elsinore Valley Municipal Water District Proposing New Water Rates Increases The Elsinore Valley Municipal Water District (EVMWD) mailed notices last April announcing that its Board of Directors will vote on a proposed yearover-year water rate increase in a public hearing on June 24. The Water District has been holding public workshops and presentations since January on the findings of its 2021 Water Rate Study. The water district conducted a similar study in 2019 to evaluate Fiscal Years 2020 and 2021, proposing an increase in its rates back then but decided not to adopt the rate increase because of the COVID-19 pandemic. The 2021 Water Rate Study concluded that EVMWD can cover its administrative costs, expenses, and maintenance through Fiscal Year 2024. However, the agency’s costs and expenses will exceed its revenues beginning in Fiscal Year 2025. The study concluded the EVMWD will need to impose a series of rate increases for drinking, recycled and sewer
services starting in FY2022 until FY2025 – proposing an increase of 5.5% for all services starting in 2022 for the next two years and a smaller increase of 4.5% in 2024 for the following two years. The increases would be applied to monthly fixed water charges based on water meter size and to commodity rate charges for drinking, recycled water and sewer services for each customer class and tier service level. The study also recommended a fee increase for Dedicated Fire Lines and Pumping Services each year until FY2025. The area covering the Agency’s Temescal Division also would see similar rate increases. For example, monthly fixed rate for ¾-inch water meter would increase from the current rate of $28.70 to $34.90 by FY 2025. Commodity rates, based on tier level and class, would increase in all categories. Residential Class Tier 1 would increase from the present rate of $2.43/HCF to $2.99/HCF in FY2025; Tier 4 would increase from the current rate $7.52/ HCF to $9.16/HCF during the same period.

Formed in December 1950, the EVWMD provides drinking water, recycled water and wastewater services to the cities and communities in its 97 square mile territory providing water and sewer service to Canyon Lake, La Cresta, Lake Elsinore, Wildomar and parts of Murrieta. The new rates will take effect July 1 if the Board of Directors vote to approve the plan.
Diego violated the state housing law when it entered into an agreement to redevelop the 48-acre parcel in the Midway District where the Sports Arena is currently located. The agreement could subject San Diego to fines by the state if it continues with the agreement.
Hemet to Hold Special Election After Court Annuls Recent Council District Election
On May 27, a Riverside Superior Court Judge nullified the results of Hemet’s Council District 4 election held in November 2020. The judge ruled that Council Member Joe Males was technically not a resident of the district before he obtained the candidate documents to run for the district seat. Males won the district seat with 56.7% majority vote. According to Males, the City Clerk’s website provided incomplete information on the requirements to run for city council causing the technicality. City and state law require Council Members to be a resident of the district to serve their constituents. The Hemet City Council on June 8 voted to hold a special election for the district in response to the judge’s decision. The Council considered a separate motion to appoint a person to act as interim Council Member, but that motion failed on a 2-2 vote. District 4 covers the southern Hemet, south of Stetson Avenue and west of State Street. The Special Election will take place this November 2. Joe Males is expected to run for the seat, but no other person announced their candidacy at the time this article was written.
State Agency says, “Not so fast” to San Diego over Sports Arena Redevelopment
California’s Department of Housing and Community Development (HCD) determined in June that City of San
City of San Diego and Brookfield properties entered into a ground lease agreement permitting the developer to revitalize the Sports Arena six-parcel property. The property would be redesigned to provide 5 acres of parks, 590,000 square feet to commercial and retail space, and 2,100 new homes. However, the project did not address affordable subsidized housing. HCD reviewed the ground lease deal and determined the agreement’s process and how it was devised violated the state’s Surplus Land Act. Amended in 2019, the Surplus Land Act requires all governmentowned surplus land first to be made available for affordable housing. According to HCD, San Diego violated the law by failing to declare the land as surplus or as surplus exempt land. The city also did not properly advertise the property to affordable developers, and that the current agreement did not disclose if the property would have any affordable housing. HCD ruled that San Diego either take corrective steps to restart the process essentially dismantling the existing agreement or be fined millions of dollars by the state.

To comply with state law, San Diego must determine if the land is surplus land or exempt surplus land. CA HCD will review the city’s decision and issue its decision allowing affordable housing developers 60 days to respond if they are interested in the property. City and all interested affordable developers then undergo another 90-day period to negotiate before the city can invite market developers interested in the property. HCD also requires government-owned property to dedicate at least 25 percent for deed restricted affordable housing. San Diego Mayor Todd Gloria reacted stating he is committed to beginning the process over again. City Council is expected to vote in July to initiate the process.

North Park (92104), Kensington, Talmage, and University Heights (92116) By Terry Moore, CCIM
The investors who bought in these zip codes a decade ago with 40% down and a loan for the balance, quadrupled their equity! San Diego County has about 100 ZIP Codes. For more than a generation 92104 & 92116 have been among the most desirable and most active apartment ZIP Codes. Values have more than doubled. Why these areas are popular These areas are walkable, convenient to downtown, Balboa Park, five freeways and within 15-minutes of colleges that educate more than 60,000 students. Many beaches and the airport are within a 20-minute drive. Sixty percent of San Diego County’s apartment buildings above four units are 5-to-10-unit buildings. These two ZIP Codes have a
disproportionate share of lowdensity communities. Roughly 11,000 households own fourplexes or bigger in San Diego County. More of them are in these two ZIP Codes than any other three ZIP Codes in the county combined. These ZIP Codes are comfortable for both owners and renters. This article is the third time in the last generation that I’ve analyzed these submarkets with approximately a decade’s perspective. In the last 30 years San Diego County apartments have increased in value almost 10% annually on average. These two ZIP Codes have traditionally had lower risk, and more upgrades than most of the county’s other areas. During the condo conversion craze, nearly a third of the newer buildings with the majority of two bedrooms were converted to condos. Those $30k- $40k per unit
upgrades improved the housing stock. Thousands of condo owners, many who were formerly tenants, stabilized the broader community. 92104 North Park North Park goes from Balboa Park on the south, to Cherokee Avenue, between 36th and 37th, to the east, to a block north of El Cajon Boulevard and then on the west of Georgia Street. About 24,000 households with just over 50,000 people, live in North Park. Median income is $76,718 almost same as the county average of $79,079. 92104 has 750 apartment parcels containing roughly 11,400 apartments in triplexes and larger buildings. The median age of apartment buildings is 1970, slightly older than the rest of the County. Most apartments have their original kitchens and bathrooms. magazine ranked North Park in the top 15 zip codes nationally as a hipster neighborhood. The major criteria included walkability, locally owned shops, residents in artistic occupations, and appeal to millennials. These features make North Park a sought-after community to live in. North Park has a disproportionate number of younger and higher income renters. Over the last decade, North Park properties have become more expensive than 92116, the zip code to the north. California has decided that people are more important than parking. California’s 2018 density bonus law allows garages to be converted to residential use. The city of San Diego seems to be the county’s most flexible jurisdiction in terms of allowing more rental housing. Investors and appraisers measure value at least three ways. Two are especially relevant when considering value over a decade, as rents rise. North Park Dollars/ SF climbed from $183 to $452, an increase of 147%. Dollars/Unit

went from $122,103 to $327,041, a boost of 168%. Averaging the $/ SF and $/Unit shows an average annual increase of 17% from January 2012 to April 2021. GRM increased from 10.6 to 16.7, up 58%. Rent increases make GRM less helpful in measuring value change. Think about Ivan Investor who bought a building worth $1 million at the start of this period. He put $400,000 down, 40% of the purchase price, and borrowed $600,000. Today his property is worth almost $2,600,000. The loan has paid down to $435,000 That means his equity is now $2,165,000. So, his wealth more than quadrupled for an annual average above 40%! 92116: Kensington, Normal Heights, Talmage & University Heights These are four neighborhoods north of North Park. About 34,000 people live in this lower density area. The median household income is about $75,000. A higher

COVID-19 Non-Payment of Rent & Eviction Compliance QUICK GUIDE • Send Notice of Rent Delinquency (Form 401) no later than July 31, 2021. o On or before July 31, 2021, a housing provider must provide, in at least 12-point type, specific notice to any resident who as of July 1, 2021, has not paid one or more rental payments that came due between March 1, 2020, and September 30, 2021. o This means owners and managers need to provide Form 401 to all residents with past-due rent between March 2020 and July 2021, no later than July 31, 2021. ■ Notice may be provided via Personal service, substituted service, post and mail, or via U.S. mail. For U.S. mail, housing providers should mail no later than July 26. (This date includes the required additional five days allowance for mailing.) • Use updated 15-Day Notice to Pay or Quit (Form 403) effective July 1, 2021. Use for rental arrears due July 1 through September 30, 2021. • Include Declaration of COVID-19 Related Financial Distress, updated Form 299, with Form 403. (Note this form was updated as of June 30, 2021.) • Tenants must pay 25% of past due rent by September 30 to avoid eviction. • Modified 3-Day to Pay or Quit Process effective October 1, 2021, through March 31, 2022. • Court actions to recover COVID-19 rental debt may begin November 1, 2021. • Rental Assistance payments will increase to cover 100%. • If you have already received 80% of rental assistance you do not need to reapply to receive the remaining 20% rent owed. EVICTION PROTECTIONS/NOTICING • Extends, until September 30, 2021, COVID-19 unlawful detainer (eviction) protections established originally by AB 3088 and extended by SB 91. • Provides that tenants who attest to experiencing COVID-19 financial distress during the transition time period cannot be: o Found guilty of unlawful detainer for nonpayment of rent or other financial obligations under the tenancy prior to October 1, 2021; and o Subject to an unlawful detainer action for the transition time period rent if, by September 30, 2021, they pay 25% of missed rent and other financial obligations under the tenancy which accrued during that period. • Allows unlawful detainer cases based on causes other than non-payment of rent or other financial obligations under the tenancy to be brought as long as the basis for terminating the tenancy is one of the following: o An at-fault just cause for eviction, as defined in Civil Code Section 1946.2(b)(1); or o A no-fault just cause for eviction, as defined in Civil Code Section 1946.2(b)(2), except that specified extra conditions apply to unlawful detainer cases based on intent to demolish or to substantially remodel the residential real property. o PLEASE NOTE: San Diego County Ordinance in effect until August 15 prevents termination of tenancy and eviction unless a tenant is an “imminent health and safety threat.” Contact July 2021 socalrha.org | 23
your legal counsel if you wish to pursue an Unlawful Detainer. • Extends preemption of local city and county nonpayment eviction ordinances through March 31, 2022, continuing the policy of prohibiting changes to local non-payment eviction rules after August 19, 2020. • Makes permanent the policy of providing limited access to the court file (i.e., “masking”) for Unlawful detainer cases filed between March 4, 2020, and September 30, 2021, based on alleged nonpayment of rent; and Actions to recover COVID-19 rental debt. • Extends, until October 1, 2021, the temporary prohibition on landlords selling or assigning a tenant’s COVID-19 rental debt and establishes a permanent prohibition on selling or assigning a tenant’s COVID-19 rental debt if the person’s household income was at or below 80% of the area median income (AMI) for the 2020 or 2021 calendar year. Effective October 1, 2021, under the COVID-19 Rental Housing Recovery Act, the content of notices demanding that a residential tenant (including a mobilehome park tenant) either pay COVID-19 recovery period rental debt or vacate the premises
(3-Day to Pay or Quit), is altered in the following ways: • The notice must provide tenants at least 3 days (excluding Saturdays, Sundays, and other judicial holidays) to pay the amount due or vacate. • The notice must include specified language informing the tenant about how to apply for rental assistance, including a telephone number that the tenant may call and a website that the tenant may access in order to start an application for government rental assistance. • The notice must include the following warning: “DO NOT DELAY! IF YOU DO NOT COMPLETE YOUR APPLICATION FOR RENTAL ASSISTANCE WITHIN 15 BUSINESS DAYS, YOUR LANDLORD MAY BE ABLE TO SUE TO OBTAIN A COURT ORDER FOR YOUR EVICTION.” • Requires any landlord who negotiated a rental agreement in Spanish, Chinese, Tagalog, Vietnamese, or Korean to provide the tenant with the notice under 11) in that language. Also requires the Business, Consumer Services, and Housing Agency to make available on its website an official translation of the notice into these languages, no later than September 15, 2021. https://housing.ca.gov/ • Between October 1, 2021, and March 31, 2022,

the following procedures should be used for any unlawful detainer action for recovery of residential real property due to nonpayment of rental debt that accumulated due to COVID-19 hardship: o No summons may be issued unless a landlord files one of the following: ■ A statement, under penalty of perjury, that the landlord completed an application for government rental assistance to cover the amount demanded from the tenants in the case, and that the application was denied; and (2) a copy of the final decision from the pertinent government rental assistance program denying the application. ■ A statement, under penalty of perjury, verifying that all of the following are true: • Before filing the complaint, the landlord submitted a completed application for rental assistance to the pertinent governmental rental assistance program to cover the rental debt demanded from the defendants in the case. A “completed application” is defined under the Health and Safety Code as one in which the applicant has provided all necessary contact information and documentation required for a government rental assistance program to initiate a review of the application for eligibility. • 20 days have passed since the later of (1) the date the landlord submitted the application or (2) the date the landlord served the tenant with the three-day notice to pay rent or vacate that is the basis of the unlawful detainer case. • The landlord has not received notice or obtained verification from the pertinent government rental assistance program indicating that the tenant has submitted a completed application for rental assistance to cover the rental debt demanded in the case. • The landlord has received no communication from the tenant that the tenant has applied for government rental assistance to cover the rental debt demanded in the case. ■ A statement, under penalty of perjury, that the rental debt demanded in the complaint accumulated under a tenancy that was initially established on or after October 1, 2021. A summons that issues on a complaint based on this statement is not subject to the requirements of the COVID-19 Rental Housing Recovery Act. • The court may not issue a judgment or default judgment for unlawful detainer unless the court reviews the pleadings and evidence and finds that
the requirements were satisfied. In any contested case, the landlord has the burden of proving these requirements were met. • For rental debt that accumulated due to COVID-19 hardship that was incurred on or after October 1, 2021, and before March 31, 2022, a landlord must be compensated for all of the unpaid rent demanded in the notice that forms the basis of the complaint. • For rental debt that accumulated due to COVID-19 hardship that was incurred on or after September 1, 2020, and before September 30, 2021, a landlord must be provided 25% of the unpaid rent demanded in the notice that forms the basis of the complaint. • Establishes a process for a tenant to avoid forfeiting their lease or rental agreement. The tenant may initiate this process by submitting verification to the court that a government rental assistance program has approved an application for rental assistance, corresponding to all or part of the rental debt demanded in an unlawful detainer complaint. The verification must be submitted before the property is restored to the landlord. In the case of partial rental assistance, the tenant must make the additional payments necessary to satisfy the full amount of rental debt demanded in the complaint. If, after a hearing, the court determines that the necessary conditions have been met, then it must grant the tenant’s application for relief, set aside any judgment in the case, and dismiss the case. • Sunsets the provisions of the COVID-19 Rental Housing Recovery Act effective September 30, 2024. RENTAL ASSISTANCE • Eliminates the requirement that a landlord must accept 80% payment and forgive the remaining 20% of a tenant’s rental debt as a condition of receiving assistance and instead provides 100% payment of an eligible tenant’s missed rent since April 1, 2020. • Increases rental assistance payments to tenants whose landlords refuse to participate in the program from the existing 25% to instead cover 100% of an eligible tenant’s missed rent since April 1, 2020. o Specifies that, if payment is provided directly to a tenant, the tenant must provide the full amount of rental arrears to the landlord in full within 15 business days of receiving the funds. o Provides that, if a tenant receiving payment does not provide payment in the timeline specified, the landlord may charge a late fee not to exceed the amount charged for one late rental payment under the Continued on page 27>>> July 2021 socalrha.org | 25

Further specifies that failure to pay the late fee shall not be grounds for an unlawful detainer. • Automatically applies the 100% payment provisions to tenants and landlords who already received rental assistance funds. • Allows rental assistance payments to cover rent debt in situations where a tenant no longer occupies the residential unit and prioritizes the provision of such payments to cases where the tenant’s landlord agrees to participate and receive payment. • Requires all rental assistance programs, by September 15, 2021, to include the capacity to provide landlords, tenants, and the courts with specified information about rental assistance applications. DEFINITIONS: • “Rental debt” means unpaid rent or other unpaid financial obligation of a tenant that has come due. • “COVID-19 rental debt” means unpaid rent or any other unpaid financial obligation under a tenancy that came due between March 1, 2020, and September 30, 2021. • “COVID-19 recovery period rental debt” means rental debt of a tenant that came due between October 1, 2021, and March 31, 2022. • “Rental debt that accumulated due to COVID-19 hardship” means COVID-19 rental debt, COVID-19 recovery period rental debt, or a combination of both, if it accumulated during a tenancy initially established before October 1, 2021. For purposes of this definition, a tenancy is deemed to have been initially established when the tenant first lawfully occupied the premises. • “Government rental assistance program” means any rental assistance program authorized pursuant to the Health and Safety Code provisions that establish the State Rental Assistance Program. • “Pertinent government rental assistance program” means a government rental assistance program for the city, county, or city and county in which the property at issue is located. • “Approved application” means an application for rental assistance for which a government rental assistance program has verified the applicant’s eligibility, and the requested funds have been obligated to be paid to the applicant. • “Final decision” means that a government rental assistance program has made either of the
following determinations regarding an application for rental assistance: the application is an approved application, or the application has been denied for any of the following three reasons: o The tenant is not eligible for government rental assistance. o The government rental assistance program no longer has sufficient rental assistance funds to approve the application. o The application remains incomplete for 15 days (excluding Saturdays, Sundays, and other judicial holidays) after the landlord properly completed the portion of the application that was the landlord’s responsibility, due to the tenant’s failure to properly complete the portion of the application that is the tenant’s responsibility. o The following outcomes are excluded from the definition of “final decision”: o Rejection of an application as either incomplete or improperly completed by the landlord. o Notification that an application is temporarily pending further action by the government rental assistance program or the applicant. o Notification that the landlord applied to the wrong government rental assistance program for the property or rental debt at issue. The Rex household is typically the hub for the holidays, family gatherings, Sunday BBQs, and pool time in the summer. We love hosting family and friends, Rex said. Rex is most passionate about food and enjoys cooking. Abigail Rex has worked for American Assets Trust for almost four years, currently serving as their Director of Multifamily. Rex has been involved with SCRHA for the past 10 years and now serves at the board level as presidentelect for the association.
“I can’t bake, but I love to cook savory foods,” said Rex. “I can taste something once, without knowing the ingredients, and I can pick up on the spices and flavors and do a pretty close recreation.”.

never actually thought would happen. And now, transitioning to SCRHA, I never thought I would be an officer on the board.” Those experiences have given Rex great leadership development skills. “I hope it gives my team members something to look forward to for themselves,” explained Rex. “I want to be a leader for the industry and a mentor for my team. Serving, leading, and learning in our industry has been a great accomplishment.” Rex feels blessed to work for Ernest Rady, CEO of American Assets Trust. Rady is someone she has come to admire deeply since joining their team. “He (Rady) is a philanthropist in San Diego, and I am so lucky to
work for him and his company,” Rex said. “He does so much good for the community and for San Diegans. I enjoy learning from him and his perspective on business and life.” Rex offered one piece of advice, in particular, that has stuck with her through the years. “The speed of the leader, the speed of the pack,” Rex said, describing a quote Rady once shared with her. “That has resonated with me and it’s something I share with my own team members because it’s true,” said Rex. “As a leader, I need to be in front of everything- I need to be well versed, well trained, and understand what is going on in the industry, not waiting for opportunities to fall into my lap.”

SUMMARY California enacted the California Global Warming Solutions Act in 2006 to significantly reduce or possibly eliminate greenhouse gas emissions coming from manmade sources. California enacted laws in subsequent years to promote, educate and require businesses and multifamily properties to adopt recycling practices. California State Government enacted several bills AB 341, AB 1826 and SB 1383 requiring local governments, businesses and multifamily properties with 5 or more dwelling units to arrange for recycling services for organic and solid wastes. In 2016, California enacted additional targets to reduce greenhouse gases even further. In 2018, SB 1383 was enacted to set new goals to significantly reduce emissions of “Short-Lived Climate Pollutants” (SCLP) by requiring the state to reduce organic waste disposal and increase consumption of surplus food by 2025. Beginning in 2022, all local jurisdictions must provide collection services
to recycle organic waste to businesses and residents and are required to use recycled organic material. Multifamily properties with 5 or more units will be required to participate in curbside organic recycling programs and provide an adequate number of bins for employees and tenants or participate in composting or collection activity programs. Multifamily properties must provide information to tenants and ensure waste is properly sorted into the correct containers.
State law defines organic waste as food waste, food-soiled paper, green waste, landscape and pruning waste, and non-treated, hazardous wood waste. Non-food organic waste is green waste, landscape and pruning waste, and nonhazardous wood waste. Any business, commercial or public entity, including multifamily dwellings of five or more units, that generates solid waste is subject to the state’s mandatory organic recycling rules (PRC Section 42649.1).
BACKGROUND According to California's Department of Resources Recycling and Recovery (CalRecycle), California disposes approximately 30 million tons of waste in landfills each year, more than 30 percent could be recycled for compost or mulch, or even used as a source for alternative fuels. Mandatory recycling of organic waste is one step to help California achieve its recycling and greenhouse gas (GHG) emission goals under AB 32, California Global Warming Solutions Act of 2006.
AB 341 AB 341 (Chesbro), enacted in 2011, requires local and state governments and private entities to recycle solid waste and expand recycling services and facilities in California. Businesses, governments, public facilities, multifamily residential properties producing four or more cubic yards of commercial solid waste per week must recycle organic services through composting or reuse or make services available to have recyclable materials to be recycled. • July 1, 2012, Local Jurisdiction Commercial Recycling Program Implementation: All jurisdictions must enact education, outreach and monitoring programs focused on recycling.
• August 2014, CalRecycle Review: CalRecycle must begin reviewing progress reports submitted by jurisdictions every two or four years depending on each jurisdiction’s review status.
• July 1, 2012, Commercial Recycling Requirements: Beginning July 1, 2012, businesses, and multifamily residential properties with 5 or more units producing four cubic yards or more of commercial solid waste per week must recycle or make such services available.
• July 1, 2020, Commercial Recycling Requirements: Beginning July 1, 2020, AB 341 and AB 1826 require businesses under the law to provide organics and recycling containers on site to collect waste generated on its premises (AB 827, McCarty). Containers must be visible, clearly marked, and placed next to trash containers.
• August 2013, Jurisdiction Annual Reports: Jurisdictions must provide an annual progress report to the state to report the status of commercial recycling, education, outreach and monitoring programs, and provide the progress report electronically under Section 41821.
AB 1826 AB 1826 (Chesbro), signed into law October 2014, took effect in April 2016 phasing in new recycling requirements for organic materials over the next five years for businesses and multifamily
properties. Businesses and multifamily properties with 5 or more dwelling units that generate enough solid waste per week must arrange for recycling services for organic waste. AB 1826 requires the following: • January 1, 2016 - City and County governments must adopt organic waste recycling programs. Local governments must identify, educate, and inform businesses on how to recycle organic waste. • April 1, 2016 - Multifamily dwellings generating 8 cubic yards of non-food organic waste must arrange for organic waste recycling. • January 1, 2017 - Multifamily dwellings generating 4 cubic yards of non-food organic waste must arrange for organic waste recycling. • August 1, 2017 - Jurisdictions must provide an annual report of their organic waste recycling programs and submit it to CalRecycle. • Fall 2018 - After the annual reports have been submitted by August 1, 2018, CalRecycle must perform a formal 2-year review of city and county governments. • January 1, 2019 - Multifamily dwellings generating 4 cubic yards of solid waste per week must arrange for organic waste recycling services for green waste, landscape and pruning waste, nonhazardous wood waste. • January 1, 2020 - After its first 2-year review, if CalRecycle determines that the disposal of organic waste has not been reduced by 50 percent statewide by 2014 levels, businesses that generate 2 cubic yards or more a week must recycle its organic waste. If the 50 percent reduction target continues to be unmet, then state may remove additional exemptions from homes and businesses. • September 2020 – CalRecycle in September 2020 performed an evaluation of its two- and fouryear review cycles. The agency determined that all businesses producing 1 or more cubic yards of organic waste a week must recycle organic waste. • January 1, 2022 – All businesses are required to recycle organics under no exceptions; however, a city or county with a population of 70,000 or less people can apply for an exemption. SB 1383 SB 1383 (Lara) was enacted in 2016
to reduce the creation of shortlived climate pollutants more potent than carbon dioxide. The law increases the percentage of organic material to be recycled or reused and increases requirements for surplus food not to be thrown away. Disposal of organic material is to be reduced 50 percent by 2020 and 75 percent by 2025. Businesses will be required to donate 20 percent of its unused surplus food to food banks to be consumed rather than discarded as waste. SB 1383 goes into effect January 1, 2022. Under SB 1383, local jurisdictions must provide information about self-hauling requirements to businesses, residences or properties that decide to self-haul their organic waste. Businesses, multifamily properties and singlefamily residences must follow new collection and recycling requirements. Single-family homes and Multifamily Residences with 4 or less units • Must subscribe and participate in their jurisdiction’s curbside collection service. • Must properly sort their organic waste and discard into the proper containers. Multifamily Complexes and Residents • Owners or Managers of multifamily properties must provide information about organic waste collection service to tenants and employees. • Owners and Managers must provide an adequate number and correctly sized and colored containers that must be visible,
conveniently located, and clearly marked with correct markings. • Each year, managers and owners must educate tenants and employees on how to properly sort waste into the correct bins and provide tenants notice on how to sort organic waste properly to tenants within 14 days of their occupancy. • Residents also must properly sort their waste into the proper containers. Commercial property and Businesses • Business and Commercial Property also must enroll and participate in their jurisdiction’s organic recycling programs. • Commercial properties and businesses that choose to self-haul must follow protocols regarding disposal of organic waste to a composting facility or participate in community composting or collection programs. • Employees, tenants, customers are responsible for properly sorting waste into the appropriate containers. • Businesses and commercial properties will be responsible for placing proper bin containers in locations where waste containers are already placed on the property with exception of restrooms. • Businesses that typically do not produce organic waste on the property that would be collected on the property do not have to provide a specific bin container. Once you are on a monthto-month tenancy, either party can terminate it by serving a Thirty Day Notice at any time. They are, however, responsible for the rent up to the date the Thirty Day Notice expires, so they would owe pro rata rent for the following month.

I had to go through an eviction to regain possession
of one of my rentals. I also received a judgment for the rent, court costs and my attorneys’ fees. How can I collect this judgment? Do I have to go back to court?

The law provides for a variety of ways to collect the judgment. Recording an abstract of judgment, wage garnishments, bank levies, attachment of personal property and judgment debtor examinations are formal ways to collect monetary judgments. Receiving accurate information on the rental application allows optimal opportunity to collect.

One of my tenants vacated the property and left his roommate behind. Both signed the rental agreement and now the tenant who vacated is demanding July 2021 socalrha.org | 45
his share of the security deposit be returned to him. Is he right? What should I do?
A
You are not required to return or account for the use of the security deposit until you regain possession of the property after all of the tenants have vacated. California requires the deposit be accounted for in writing and sent to the last known address of the tenants no later than 21 days following the return of possession unless the lease requires an earlier time frame. The tenant who vacated early should work out an arrangement with his former roommate. You are under no obligation to account for the deposit at this time.

California law requires that a person be named as agent for receiving payment in person on the notice, the address, telephone number, and hours/ days of availability of this person be provided, but there is no requirement that this person sign the notice. However, it is a good
