Dear SDCAA Member: We need to inform you of two crises the industry is facing RIGHT NOW. First is the battle to defend the Costa Hawkins Act from being repealed in the November election, Proposition 10 (a.k.a.

The Affordable Housing Act). The second issue is a National City Rent Control ballot measure.

What you need to know about the Costa Hawkins Act and why we must defeat Proposition 10 If your jurisdiction doesn’t have rent control, you likely don’t know how important Costa Hawkins is to the industry.

After Rent Control was approved in Berkeley and Santa Monica in the 1970s, the rules became so burdensome that all development and investments stopped, and owners were at risk of going out of business. The bi-partisan Costa Hawkins Act reigned in draconian rules imposed by overzealous cities.

Costa Hawkins Act: • Limits Rent Control to properties built before the spring of 1995 • Prohibits Rent Control on single family homes and condominiums • Allows landlords to raise rents to “Market Levels” when a tenant moves out (Vacancy Decontrol) If it wasn’t for these three keys rules, NO NEW HOUSING would have been built in these cities after 1995. Owners would have gone bankrupt because the rent caps were not keeping up with the costs of doing business, and properties would have fallen into a dire state.

Tenant groups have now qualified Proposition 10 for the November 6, 2018 election, which will repeal these rules and add the ability for Private Attorney General lawsuits. This will rapidly expand rent control in the 15 cities in California that currently have rent control and will encourage other cities to follow along. It will decrease property values, discourage new development, and leave owners at risk of not being able to pay their mortgagees. We must vote NO on Prop 10 and defeat their efforts!

National City Rent Control Ballot Measure Advocacy groups in National City have qualified one of the strictest forms of rent control ever for the November election.

Should this measure pass: • It will cap rent increases to the Consumer Price Index (CPI) but no more than 5% and rolls rents back to Spring 2018 rates, even if you are below market or raised rents in the interim.

• It will establish a Rent Control Board of at least three tenants, which will be paid for by a NEW $120 per unit per year rental fee to start.

• It creates Cause Eviction, making it difficult to evict bad, troublesome tenants.

• All evictions must go through the Rent Control Board before you can proceed to an unlawful detainer. The Rent Control Board can refuse your eviction, even for non-payment of rent, and you have no recourse.

• The Rent Control Board can mandate inspections of every unit at a cost to you as many times as they like.

• The measure will also prevent passing through utilities. Ratio Utility Billing systems (RUBs) will not be permitted.

• If you want to move into your property or remove it from the rental market you can be required to pay $7k - $10k in relocation costs.

Make no mistake: defeating this measure is going to be difficult and expensive. There are approximately 45,000 voters in National City and approximately 2/3 of the residents are renters. The measure promises more affordable housing and improved housing conditions, when in fact it does the opposite. Rent control will make the housing crises worse not better. Rent Control does not deliver one affordable rental unit. If it is approved by voters in November, rent control will spread throughout the region.

What can you do to help with these issues?

We cannot be more serious about these issues.

1. Contribute today to the campaign against rent control in National City. We suggest owners contribute at least $120 per unit, the initial fee you will be assessed by the new Rent Control board should it pass. www.protectourhousing.com 2. B

usiness development is a concept common to most companies across all industries. Typically, business development refers to generating ‘external’ business leads, establishing inroads with new clients, and solidifying relationships with existing customers. But what about ‘internal’ business development?

How does a company grow strategically and evolve internally?

One of the challenges of ‘internal’ business development is a lack of resources. The key to success in any industry is access to mentors.

However, it is unlikely that competitors and industry partners are willing to share best practices due to a conflict of interest.

While companies within the same industry may want to see each other succeed, the possibility of losing business is not worth the risk of helping another company improve.

So, the question remains, how

By Scott Ledesma, Generation Contracting & Emergency Services can a company gain an objective perspective and industry insight in a non-threatening, collaborative atmosphere? A business consulting network can provide access to those missing resources.

The burden is on business owners to seek the guidance of peers and mentors within their industry. Numerous national associations were created for this very purpose, to encourage collaboration without creating a conflict of interest. By leveraging an industry on a national level, business owners unite from across the country to openly share their experiences in a non-competitive environment.

These industry networks meet on a regular basis, each time visiting a different host company, in a different part of the country. The ultimate goal of the rotating site visit is to conduct an in-depth audit and provide candid feedback for the host company. However, there is value for all business

owners participating in the process.

The initial meeting typically highlights current industry trends and new business concepts being implemented in other networks.

Industry challenges are also often discussed, and the group shares personal experiences of how they have overcome obstacles since the last meeting.

Participating in a peer network must be a fully transparent process to be effective. The true indicator of any company’s success is reflected in their financials.

Numbers don’t lie. At each meeting, every business owner shares their most recent financial reports, and the group collectively dissects the numbers and offers advice. This objective, oversight process allows companies to receive honest, bare-bones feedback on how their company can improve.

During the host company audit, every employee is interviewed September 2018 RentalOwner | 5

in groups and/or individually by management teams from the visiting companies. Everyone from the field crews all the way to the owners of the company must provide honest input about the company and its processes.

After employee interviews are complete, the audit team reports their findings and begins creating goals for the host company based on the input they received. Again, transparency is key to this process being successful. The more honest and upfront the host company employees can be, the more accurate and precise the proposed company goals will become.

Assigned goals will vary from one company to another based on the challenges they are facing and the opportunities for growth that are discovered. The benefit of this external audit process is that the goals are specific and

measurable. Another invaluable aspect of networks like these is accountability. Each company goal is assigned a timeline to ensure the host company is proactive to enact change within their company, or they could face a financial penalty from the network.

Change is hard and often uncomfortable, however, if a company wants to continue to evolve over time change is inevitable. As steps are taken toward achieving each new company goal, the host company can leverage the network by

reaching out via online platforms for guidance and feedback along the way.

Regardless of the industry or size of a company, it is important for business owners and employees to have access to industry partners who can serve as a mentor, a sounding board, and a trusted advisor. Retaining a competitive edge is vital for all businesses, however, having access to the necessary resources is often the missing link between failure and success.

SD City Council adopts of “Source of Income” ordinance

On July 31, the San Diego City Council approved a proposed code amendment that prohibits landlords from discriminating against tenant applicants who use Section 8 vouchers as a source of income. The ordinance is aimed to provide Section 8 voucher holders more housing options in the city, but it could require some landlords to participate in the Section 8 Program. However, the tenant will still be required to meet other requirements for tenancy.

Under the ordinance, landlords would be: • Prohibited from including in rental advertising that Section 8 will not be accepted.

• Prohibited from refusing a rental application from prospective tenants with a Section 8 voucher.

• Prohibited from charging tenants using a Section 8 housing voucher higher deposits, adding more conditions to their tenancy, or treating the tenant differently from other tenants.

• Prohibited from restricting or denying a tenant using a Section 8 voucher access to services and facilities on the rental property and interrupting or terminating their tenancy.

• Required to include the tenant applicant’s (or

applicants) Section 8 voucher with other sources of income when determining if the individual(s) meets the minimum income requirements.

On June 27, the SDCAA testified in opposition to the ordinance at the Smart Growth and Land Use Committee, but because the vote was 2-2, the ordinance moved forward without a recommendation to the full city council for a hearing on July 31. In the weeks preceding the July 31 hearing, the SDCAA met with City Councilmembers to share concerns and suggested amendments to the ordinance, some of which were included in the proposed ordinance. Two of the items of concern for SDCAA were addressed: • A one-year grace period was added to provide plenty of time for education and outreach to the rental housing industry. To file a source of income complaint, the alleged violation must occur on or after August 1, 2019. SDCAA was very concerned that owners or managers would not have time to get up to speed on the law and would receive complaints, or worse, have lawsuits filed against them right away.

• The San Diego Housing Commission will form September 2018 RentalOwner | 9

a Stakeholder Advisory Committee for owners and managers to provide feedback on program improvements. SDCAA believes the open line of communication can lead to program improvements that will ultimately benefit owners and managers, as well as residents and the Housing Commission.

Still on SDCAA’s ask list before the hearing was a shift in the use of the proposed contingency fund to provide some sort of upfront payment to offset what are often delays of weeks, and in some cases months, for initial rent payments. Several councilmembers expressed concerns on the impact on “mom & pop” property owners. Councilmember Kersey asked Councilmember Georgette Gomez to exempt some small property owners (one and two units). However, she refused to take the amendment. The Housing Commission, via the stakeholder meetings, will consider other ways to use the funds. SDCAA also suggested an annual report on activity related to the ordinance, and to the extent that they can, track the reasons why property owners enter the program (voluntarily versus the mandate).

At the hearing, the Mayor’s Office suggested a set of amendments that were accepted by Councilmember Gomez. The ordinance as presented by staff was approved along with direction for the Housing Commission to report back to the Smart Growth & Land Use Committee in nine months on the status of implementation, including: • Summary of the education and outreach efforts.

• Number of education and outreach meetings held.

• The stakeholders engaged.

• Number of complaints brought to the hotline to be managed by a third party.

• Summary of additional process improvements made to the Section 8 program as a result of this policy and outreach efforts.

• Update to the payments standard qualification page (voucher size and payment form).

• Requirement for civil mediation and landlord education to be the first line of enforcement; Return to Smart Growth & Land Use Committee by May 2019 with a legal analysis on the ability for the City to require such mediation, and possible Municipal Code amendment for adoption and implementation by

• Ensure the “lost rent” allowance in the Contingency Fund covers up to one month of lost rent due to any Housing Commission processing or inspection delays.

The ordinance requires a second hearing (mostly a formality) which is slated to occur on September 11. The ordinance goes in to effect 30 days after adoption.

The SDCAA has long promoted voluntary participation by landlords in the Section 8 Program but remains opposed to any effort requiring landlords to participate in the program and contract with a third party/the government.

SDCAA will closely monitor the City of San Diego and the San Diego Housing Commission activities. The SDCAA will provide a white paper, conduct seminars, announce when the Stakeholder Advisory Committee will hold meetings, and other updates.

San Marcos to hold the first phase of District elections in November

San Marcos City residents for the first time will get to vote to elect District Councilmembers beginning this November – The city’s Districts 1 and 2 be the first to hold elections this November.

District 1 covers the neighborhoods immediately north and south of State Route 78, extending east of Poinsettia Avenue and west of Woodland Parkway,

South of Borden Road, and the Richmar area. District 2 is the southern portion of San Marcos including the neighborhoods of Discovery Hills, Old Creek Ranch, San Elijo Hills, and Rancho Dorado.

San Marcos Districts 3 and 4 will hold elections in November 2020. District 3 includes the areas in the Creek District, Civic Center, west of Rancho Santa Fe Road, east of Nordahl Marketplace and Cal State San Marcos. District 4 is the northern area of the city which includes Santa Fe Hills and the neighborhoods around Palomar Community College.

All councilmembers will have four-year terms and can serve a maximum of three consecutive terms.

The City’s Mayor is a four-year term and remains as an at-large position. Currently, all councilmembers are eligible to run for re-election.

In September 2016, the San Marcos City Council voted to change the city’s election from at-large to district elections. San Marcos, along with dozens of cities throughout the state, received a demand letter from a Malibu-based attorney stating that the city was violating the state’s Voting Rights Act of 2001 by holding at-large elections. Rather than facing legal action, San Marcos decided to change their election to a district-based system.

Helix Water District approves rate increase

The Helix Water District Board of Directors adopted rate increases for all water customers in August.

The rates will take effect in November but will not be reflected in water bills until after January 2019. The board also adopted a new budget and rate increase for FY 2018-19 - The new budget is 5.7 percent higher than last year’s budget.

The larger budget and rate increase reflect the water district’s rising costs. District officials say the larger budget is due to higher costs for purchasing water, rising costs in labor and pension and complying with state regulations,

and rate of inflation. However, water district officials point out the new rate increase is the smallest in the last decade.

Rates will increase by 3.4 percent, about $2.59 more per month, for single-family residential customers.

Commercial and multifamily customers each will see their rate increase by 3.5 percent. Commercial users will see their rate rise by $2.76/month and multifamily rise by $2.73 per month.

Notices regarding rate increase were mailed to customers beginning in August. The Helix Water District serves approximately 270,000 customers providing water service to the cities of La Mesa, El Cajon and Lemon Grove, and Spring Valley. The district also serves areas within the cities of Santee, Lakeside, and parts of San Diego County.

Helix District customers receive their billing statements every two months. The new rates will be applied billing statement beginning in November, and customers will receive their billing statements with the new rates after January 1, 2019. Visit hwd. com for more information.

Encinitas will vote on Housing Element in November

On August 8, the Encinitas City Council again approved another version of its first Housing

Element. The Housing Element will go before Encinitas City voters on November 6 for final approval. Encinitas Proposition T approved by city voters in 2013 requires voter approval if there are major changes to be made to the city’s General Plan.

The City Council insisted that the Housing Element had to be adopted before August 10 so it could be placed on the November 6 Ballot.

The Encinitas City Council last June narrowly adopted a housing element after an eight-hour city hearing, but the city council decided to modify the element again over concerns that its housing numbers were too low to meet state requirements.

The Housing Element calls the construction of 1,504 new housing units on 15 new sites in the city. The densities of some projects will be increased from 25 to 30 units per acre, and the new housing number exceeds the state’s numbers. Housing projects under the new element will be capped at three stories.

Mayor Catherine Blakespear along with Councilmembers Joe Mosca, Tony Kranz, and Mark Muir voted for the element because they had to approve the housing element before August 10 deadline so that the element can be placed on the November ballot. Also, councilmembers voted for the element to show progress on approving a housing element when the city goes before a San Diego Superior Court Judge on August 17.

Councilmember Tasha BoernerHorvath voted against the housing element because one property was removed.

On August 17, Superior Court Judge Ronald Frazier will determine if the two separate lawsuits filed against Encinatas will move forward now that the housing element will be on the November ballot.

City voters may vote to disapprove the housing element, and it could still be subject to scrutiny by the state’s Department of Housing Community Development.

Property Management Company Licensing in California Branch Office Licensing

If your employees conduct business at any location other than your primary office (including any apartment complex where resident managers live and work), do you have a branch office license for those locations? If not, to avoid possible disciplinary action, obtain branch office licenses.

Generally, California property management companies, and their employees engaged in property management activities, are required to have a real estate license. See Property Management Company Licensing in California.

Each management company has a primary office location.

Additionally, a branch office license is required for any additional locations from

which a broker conducts business, including any office, apartment building, complex or court where unlicensed people are employed by the broker, including complexes with resident managers.

Supervision of branch offices can be delegated to a licensee if certain requirements and procedures have been met.

Failure to comply with applicable law and regulations (including failure to maintain a branch office license), even inadvertently, could result in disciplinary action by the Real Estate Commissioner against the broker corporation, designated broker officer, and/or individual salespersons or associate brokers involved.

to-day operations, supervise the licensed activities of licensees, and supervise clerical staff employed in the branch office or division. (b) Notwithstanding subdivision (a), nothing in this section shall be construed to limit the responsibilities of an employing broker or a corporate designated broker officer pursuant to subdivision (h) of Section 10177.

A licensee accepting appointment as a manager shall be subject to disciplinary action pursuant to Section 10165 for failure to properly supervise licensed activity pursuant to subdivision (a). (c) Appointment of a manager shall only be made by means of a written contract in which the manager accepts the delegated responsibility. The appointing employing broker or corporate designated broker officer shall retain a copy of the contract and send a notice to the department, in a form approved by the commissioner, identifying the appointed manager and the branch office or division the manager is appointed to supervise. (d) A licensee shall not be appointed as a manager if any of the following apply: (1) The licensee holds a restricted license.

(2) The licensee is or has been subject to an order of debarment.

(3) The licensee is a salesperson with less than two years of fulltime real estate experience within five years preceding the appointment. (e) Whenever an appointment of a branch manager is terminated or changed, the employing broker or corporate designated broker

officer shall immediately notify the commissioner thereof in writing. (f) This section shall become operative on July 1, 2012.”

• CA Business & Professions Code §10165 reads, “For a violation of any of the provisions of Section 10160, 10161.8, 10162, 10163, or subdivision (b) of Section 10164, the commissioner may temporarily suspend or permanently revoke the license of the real estate licensee in accordance with the provisions of this part relating to hearings.”

• CA Business & Professions Code §10131.01 reads, “(a) Subdivision (b) of Section 10131 [defining real estate brokers engaged in property management] does not apply to (1) the manager of a hotel, motel, auto and trailer park, to the resident manager of an apartment building, apartment complex, or court, or to the employees of that manager, or (2) any person or entity, including a person employed by a real estate broker, who, on behalf of another or others, solicits or arranges, or accepts reservations or money, or both, for transient occupancies described in paragraphs (1) and (2) of subdivision (b) of Section 1940 of the Civil Code, in a dwelling unit in a common interest development, as defined in Section 1351 of the Civil Code, in a dwelling unit in an apartment building or complex, or in a singlefamily home, or (3) any person other than the resident manager or employees of that manager, performing the following functions who is the employee of the property management firm retained to manage a residential

RENTAL HOUSING COALITION LOCAL LEGISLATIVE UPDATE Palm Springs asking residents to submit ideas for District Election Maps

The City of Palm Springs is asking residents to submit proposed district maps for consideration by the city council in December. Palm Springs began holding workshops to educate residents about the process for creating and submitting their suggested district maps to the city. The city held several workshops in late August.

On April 19, the Palm Springs City Council initiated the process of changing the city council elections from at-large to district-based elections. Like many other cities in California, Palm Springs decided to switch to council district elections to avoid violating the state’s Voting Rights Act and possible litigation.

Palm Springs decided to use a process utilizing the public’s input.

The city has instructions available in English and Spanish on how residents can create their district maps and send them to the city. Residents can submit 1) a paper-only map, 2) a paper map with an Excel

spreadsheet and interactive view map, or 3) create their district map using a map-drawing tool online provided by the city. Palm Springs also has various demographic materials available on their website to help guide residents with their maps. Residents can also submit comments online to the city on the website.

Resident have until September 15, 2018, to submit their maps to the city. The city’s consultant will post all maps received from the public on the city’s website. The city’s California Voting Rights Act (CVRA) Working Group will review each map and determine which maps will advance to the next phase. The city council has scheduled two meetings for September 27 and October 4 to review the maps selected by the CVRA and to determine when and how the elections for each district will take place.

In the third and final phase, the city council will hold five public hearings to decide which maps will receive final consideration. The hearings will take place on October 16, November 15, November 29, and December 5. The council hopes to select and September 2018 RentalOwner | 17

approve the final district maps in its final meeting on December 19.

Murrieta holding first ever District Elections in November

The City of Murrieta will be holding its first set of district elections this November. Like many other California cities, Murrieta changed its elections from at-large to a district-based system beginning in March 2017.

On November 6, residents living in Districts 1, 2, and 5 will vote for their district representative.

Residents living in Districts 3 and 4 will vote for their representatives in November 2020. Councilmembers can serve up to two consecutive four-year terms.

The city’s Mayor and Mayor Pro-Tem positions will remain on a rotating basis as determined in city council rules. Each term is one year. All councilmembers will be able run in their districts iin the next cycle.

District 1 area is the northwest region of the city. The district includes neighborhoods along

Clinton Keith Road west of I-215 to Copper Craft Drive, neighborhoods along Murrieta Oaks area, neighborhoods north and east of Hancock Avenue, and neighborhoods east and north California Oaks Road.

District 2 is the northeastern area of the city. The northernmost part of the district begins at Scott Road going south along Antelope Road. The western boundary of the district starts east side of I-215 going east along Keller Road until Menifee Road.

The eastern border includes Winchester Road and a portion of Via Princessa and the district’s southern boundaries include Las Alamos, Whitewood, and Hunter Roads, and a section of Murrieta Hot Springs Road.

District 5 is geographically the smallest among districts covering east and southeast areas of the city. The northern borders of the horseshoe-shaped district include Hunter Road, Murrieta Hot Springs Road, and Whitewood Roads. The eastern boundary is Winchester Road while the western border runs along Via Princessa Road, Alta Murrieta Drive, and East of I-215.

District 4 covers the central and south parts of Murrieta along I-15 beginning at Cherry Street in the south up to Clinton Keith in the north. District 3 covers the west part of the city including Old Town Murrieta, neighborhoods along Washington Avenue, and the northern part of Jefferson Road.

As a broker it’s nice to come across an investor who follows through on everything they say they will do. That has been my experience working with Dan Feder. Dan has vision, drive, and is dependable, which is why he’s been able to grow his portfolio to over four hundred units in a short period of time. Born in Denmark to a Danish mother and an Israeli Special Forces father, Dan has a diverse background. He also inherited an entrepreneurial spirit from his parents, who owned a small brass bed factory in Denmark. Though he was raised in Orange County, he has lived in many world-class cities around the world such as Tel Aviv, Miami, Los Angeles,

and Copenhagen. We sat down at his North Park office recently to discuss his amazing growth.

Doug: You've had quite a trajectory, what’s your background?

Dan: I was in the entrepreneur program at USC. I started an

equipment leasing business helping small-business owners get money to grow their companies.

We became — in our little niche — the largest in the country. It wasn't fun, so I figured, sell it and get into the real estate business.

I like real estate. It's one of the oldest businesses; it's not going anywhere. You can put your own stamp on it and do something creative. The market will either reward you or tell you they don't like it. Then you have to adjust.

Doug: What prompted you to get into apartment buildings?

Dan: I was looking at buying thirty Burger Kings. I thought, September 2018 RentalOwner | 19

"Do I really want to have 1,000 employees again?" The answer was "no." I looked at the San Diego market; industrial buildings, retail, and office. None made sense to me. I went to Alan Nevin, a good friend and mentor. At breakfast I asked, "Who in the community is most generous in terms of charity on a consistent basis, what asset category are they in?" He said, "It's easy — apartments."

I said, "Okay. I'm getting in the apartment business." I figured if you can afford to be generous on a consistent basis, you must have a good business. And I've fallen in love with it.

Doug: That's interesting; I would have asked about the numbers, not "Who is the most generous?"

Dan: It actually is numbers because it's not just the most generous, but the most generous

consistently. If somebody can afford to give $1 million a year or $2 million or $5 million a year, they have a very good business.

Apartments are one of the few businesses that allow you to do something meaningful for the community long-term.

Doug: Where was your first office?

Dan: Solana Beach. Great location, great view. But I believe to be successful in this business you have to be in the market. So we bought an office in Sherman Heights. We outgrew that, which got us into North Park. From here we can synthesize the environment, start to understand what's important to residents, what works, what doesn't, what's a better street, what's a better block.

The reality is that if you want to be successful, you have to do everything you can to understand

who your customer is and what they want.

Doug: Do you manage your properties?

Dan: We manage our own stuff.

We don't use third parties. If you own the assets, it's worth it. The team I have is a great team. Very good team. And I’m always looking to add great people.

Doug: What do you look for in an investment?

Dan: We'll buy anywhere in San Diego. I look for reasonable sellers, reasonable terms, and someone who'll close. Most of the stuff we do is existing and renovation, value-add, long-term holds.

Doug: What’s your vision when you buy the property?

Dan: We try to brand the property. Your property is free advertising. The minimum we invest is $20,000 per unit. We’ve invested as high as $115,000 per unit. I would say right now it's very reasonable that we'll be at $35,000 to $50,000 per unit. It usually takes us about two years to turn a property around.

Doug: What is the biggest problem you see in the business today?

Dan: Rent control is a major threat, not just from the property owner's standpoint, but also for the state of California. Nothing works unless there are incentives.

What they should be doing is figuring out how more can get built. The San Diego Business Journal had an article about the toughest places to build. Number two is New York. San Diego was

number one. Think about that.

We should be embarrassed.

Doug: What is F&F doing to approach the problem?

Dan: Generally speaking, we're not doing a lot of ground-up because it doesn't make sense. I built a 12-unit townhome project in North Park. It took me over three years. It's like getting hit in the head with a sledgehammer daily. The Empire State Building, built 70-plus years ago, took thirteen-and-a-half months. It's just not worth it.

Doug: What's next for F&F?

I try really hard to create amenities and provide value where it didn’t exist.

Our other resident is concerned about the camera facing her window. I thought it was illegal to do this, please let me know so I can address this issue.

A. The answer depends upon whether the resident, who is being recorded, has a reasonable expectation of privacy. A camera recording a resident’s activity inside the apartment is a violation of a resident’s expectation of privacy. That is, what we do inside our living space is not for others to see or let alone record.

The landlord should contact the recording resident asking them to remove the camera or point the camera in a different direction.

The recording resident may claim the camera cannot record that far, or is not recording in that direction. This may involve the landlord inspecting the camera and its setup. If the resident refuses, then the quickest action, have the resident who is being recorded call the police. The resident who is being recorded can advise she is being stalked. The police tend to take these matters seriously. Finally, if the police cannot resolve the issue, the landlord could serve the resident

Q. We have acquired a new property in San Diego. I was advised by the regional team that this property is under contract with a company who provides cable service to the property. I included a special provision on the Satellite Dish Addendum that states the following: “This community provides pre-wired access to a cable service. Installation of a satellite dish is NOT permitted at the community.”

A. Your rule not allowing any satellite dishes but requiring residents to use the contracted cable vendor violates the intent of the FCC rules for Over the Air Reception Devices “OTARD.” The FCC rules for OTARD – protect a property owner or tenant’s right to install, maintain or use an antenna to receive video programming from direct broadcast satellites, broadband radio services and television broadcast stations. OTARD rules also apply to rental property where the renter has exclusive use of an area, and to customer-

end antennas that receive and transmit fixed wireless signals. Under the OTARD rules, an owner or a tenant has the right to install an antenna on property that he owns or over which he has exclusive use or control. This includes single family homes, condominiums, cooperatives, townhomes and manufactured homes. In the case of condominiums, cooperatives and rental properties, the rules

apply to “exclusive use” areas, like terraces, balconies or patios.

“Exclusive use” refers to an area of the property that only renters and their guests may enter and use.

If the area is shared with others or accessible without the renter’s permission, it is not considered to be an exclusive use area.

Restrictions that prevent or delay installation, maintenance or use of antennas covered by the rule are prohibited. For example,

see if this is acceptable. By law, the FCC requires that we allow residents to have a satellite dish, but we can place reasonable restrictions on installation. Given this community does not allow it may be prudent to make sure we’re in compliance.

If there is a conflict about a restriction’s validity, the association, landlord or local government trying to enforce the restriction must prove it is valid. This means that no matter who questions the validity of the restriction, the person or entity trying to enforce the restriction must prove that the rule is legitimate.

Q. All residents have satellite access through our contracted vendor. The residents don’t have the option to install their own satellite of choice. Are we still in compliance with the FCC regulations?

A. The answer depends if the antenna/dish is a central one, whereby the tenants can pick their own service. The property cannot have limit to one

service provider. The tenant is allowed to pick their own service provider. An individual who wants video programming or fixed wireless services other than what is available through the central antenna should not be unreasonably delayed in obtaining the desired programming or services either through modifications to the central antenna, installation of an additional central antenna, or by using an individual antenna.

in most cases, requirements to get approval before installing an antenna are prohibited.

Restrictions necessary to prevent damage to leased property are permissible, as long as the restrictions are reasonable. For example, a lease restriction that forbids tenants from damaging the balcony floor when installing an antenna is likely to be permissible.

An association, landlord or local government may impose certain restrictions when safety is a concern or where a historic site is involved. An example of a permissible safety restriction would be requiring that an antenna is securely fastened down so that it will not be blown loose. Safety restrictions must be narrowly written so that they are no more burdensome than necessary to address a legitimate safety purpose.

San Diego & Section 8 Lynn Dover, Esq. , Kimball, Tirey & St. John LLP

On July 30, 2018, the San Diego City Council passed an ordinance that will require landlords to participate in the Section 8 Housing Voucher Choice Program and other rental assistance programs. Enforcement of the ordinance will begin on August 1, 2019.

The ordinance prohibits discrimination on the basis of source of income. While source of income discrimination is already prohibited under California law, this ordinance broadens the definition of source of income to include “rental assistance from any federal, state, local, or nonprofit-administered benefit or subsidy program, or any financial aid from any rental assistance program, homeless assistance program, security deposit assistance program, or housing subsidy program, whether paid directly to the

program participant, landlord or representative of either.”

Under the ordinance, it is unlawful for landlords with properties in the City of San Diego to take the following actions based on a person’s source of income: (1) To refuse to enter into or renew an agreement for tenancy; (2) To interrupt or terminate any tenancy; (3) To falsely represent that a rental-unit is not available for tenancy; (4) To require inclusion in the terms of an agreement for tenancy any clause, condition, or restriction1 ; or (5) To restrict a tenant’s access to facilities or services on real property associated with the tenancy, or refuse repairs or improvements to real property associated with the tenancy.

The ordinance also makes it unlawful to “make, print, publish, advertise, or disseminate in any way, or cause to be made, printed, published, advertised, or disseminated in any way, any notice, statement, or advertisement with respect to a rental-unit, or with respect to financing related to a rental-unit, which indicates discrimination based on a person’s source of income.” This means that it will be unlawful to advertise in any way that a property does not participate in the Section 8 (or any other housing assistance) program.

Finally, the ordinance makes it unlawful to use a financial standard (such as a rent-to-income ratio) that does not take into account an applicant or resident’s entire source of income or to use a financial standard that fails to aggregate income for the entire

household (and any proposed co-signers) on the same basis as the aggregate source of income of married persons. This means that a landlord must consider any money that will be paid by Section 8 (or any other housing assistance program) in determining whether an applicant meets the rent-toincome ratio or other financial standard. If a landlord combines the income of married persons (and any proposed co-signers) to determine whether the household meets the property’s rent-toincome ratio or other financial standard, the landlord must also combine income for non-married individuals and any proposed cosigners.

The ordinance provides that a lawsuit may be filed for any violation that occurs on or after August 1, 2019. Any lawsuit must be brought within one year from the discovery of the violation

and may seek monetary damages as well as an injunction against the landlord. If court determines the landlord has violated the ordinance, it must award damages equal to three-times the monthly rent that the landlord advertised the rental unit for at the time of the violation. It also has the power to award punitive damages and attorney’s fees and costs.

Although the rental housing industry fought for exemption for smaller properties and singlefamily units, the City Council exempted only owner-occupied units from the ordinance.

Accordingly, a homeowner who lives in his or her house, condominium or other singlefamily unit and rents out a room within that unit is exempt from the ordinance.

The City Council indicated that they, along with the San Diego

Housing Commission (which administers the Section 8 program within the City of San Diego), will be putting together an education and outreach program over the next year to educate landlords about the ordinance and the Section 8 program.

The ordinance does not apply to properties outside the City of San Diego, such as those located in other cities or unincorporated areas of the County.

September is all about getting back to school and routine after the summer break. Being a property owner isn’t easy and sometimes we need a refresher.

Often, we think we know it all, but the only thing I know for sure is that nothing in property management stays the same! Here is a Top 20 Back-to-Basics list to consider when managing your property!

1. Offer different ways of collecting rent. Especially online options!

Consider Venmo or PayPal. 2. Know the laws- or hire someone who does.

Regularly attend classes, webinars or pay attention to SDCAA updates.

3. Create a policy and stick to it.

Use your head not your heart.

4. Invest in your property.

Consider cost-effective upgrades like USB outlets or refinishing the countertops.

5. Have office hours, unless it is an emergency.

You need a life too!

6. Hire a supplier that is licensed, bonded, and insured.

Most find this too risky. The resident could leave at a bad time of year, unless you are prepared and willing to accommodate that.

19. Consider allowing pets.

12. Document, document, document—no verbal agreements.

Always write it down, memorialize any conversation, and take extra photos!

20. Know when to hire a professional.

Whether it is a lawyer or property manager, knowing when to get out is the hardest but smartest decision you can make.

13. Save for a rainy day or leaky roof.

Be prepared for the bad times.

When Pacific Beach officially became a city back in 1888, the main attractions were a “college of letters” and racetrack. While neither attraction survives today, the “young and hip” mentality remain untouched. While there are many older residents, the streets are dominated by an amiable, younger crowd.

Pacific Beach, or “PB,” is a small beach community cozily nestled between the famous town of La Jolla and the quaint municipality of Mission Beach. Once you get off of the 5 freeway, you are immediately engulfed in the everlasting atmosphere of a permanent vacation that drowns out any worries or thoughts about the “real world.”

towards the pier, the pace and ambiance begin to pick up a little bit. This is where the heart of the bar scene is. It is unique in the sense that every walk of life is accepted, you will see high heels, buttoned-down shirts, and swim trunks on any given night.

What could be the most amazing part of Pacific Beach is the sense of community. While it definitely can be considered “localized” for outsiders, almost everyone is a transplant of some sort. Once you are a resident, you are “one of us,” and people look after each other. Despite its status as a haven for young people and social gatherings, crime rates are astoundingly low. It truly is a perfect size: big enough to be a community, but small enough to be a family.

Another aspect of Pacific Beach worth mentioning is the beach itself. Crystal Pier is a beautiful spot where people can fish or simply walk out to enjoy the ocean breeze. On either side are beaches where you can find both quiet, secluded spots, and bustling social environments. Running parallel to the beach is the boardwalk, where you will see all walks of life from 65-year-old rollerbladers to 12-year-old groms running around with boogie boards. The best attraction for sustenance on the boardwalk would have to be the famous Kono’s coffee, which serves up world-class coffee and is one of the businesses that Pacific Beach residents take pride in supporting.

Overall, Pacific Beach is also a very healthy town filled with gyms.

There is a 24-Hour Fitness, many Crossfit gyms (one of which is rumored to host the legendary John Cena), and Pacific Beach Recreation center to name a few.

At the rec center, one can always go to lift weights, work out, or play basketball. There are also many recreational sports leagues that hold games there, including softball, dodgeball, and ultimate frisbee.

Between the scenic beaches, vibrant nightlife, and worldclass eateries, Pacific Beach is undoubtedly one of the standout spots in the greater San Diego area. With its fantastic weather, friendly neighbors, and abundance of restaurants, recreational sports, and nightlife, it shouldn’t be too hard to market your Pacific Beach property.

As the fall season approaches, it is time to take care of recommended maintenance practices for your properties. Use this easy checklist to maintain your properties on a regular basis.

• Check for leaks and loose gutters.

Skim Community Pools – Monthly • Regularly remove leaves and debris that can clog filters.

Dryer Connections and Vents – Biannually • Make sure dryers vents and coils are deep cleaned and free of lint and fragments.

• A qualified technician should evaluate gas dryers twice per year.

Test Smoke & Carbon Monoxide Detectors, and Fire Extinguishers - Biannually • Make sure detectors are plugged in or that the batteries operational Clear Overgrown & functioning properly twice per Vegetation - Monthly year.
