BOARD REPORT DECEMBER 14, 2017 SPECIAL REPORT TO THE PUBLIC Trustee Mary Graham recommended the San Diego State University course on YouTube titled “Black Minds Matter,” which discusses biases in higher education. Trustee Rich Grosch reported that he met with representatives from Climate Action Campaign and discussed various topics, including renewable energy, climate-focused policies, and sustainability. He requested, and the Board agreed, that the Board would consider a resolution in support of the organization. Chancellor Constance Carroll indicated that a resolution would be prepared for the Board’s consideration at the January meeting. Trustee Bernie Rhinerson, along with Trustees Graham, Grosch, Senour, and Zschiesche, wished everyone a happy holiday season. Trustee Peter Zschiesche reported that he attended a Project New Village event held at Continuing Education’s (CE) Educational Cultural Complex and a human rights rally in downtown San Diego. Trustee Maria Nieto Senour reported that she attended the holiday receptions hosted by the campuses and the District Office and a Trustee Advisory Council (TAC) meeting where CE President Carlos Cortez presented on CE’s noncredit to credit transition programs and support services. Chancellor Constance Carroll informed the Board of four major proposals that Congress is considering regarding the DACA program: 1) The Development, Relief, and Education for Alien Minors (DREAM) Act, a pending bill that would extend the current program, including a pathway to citizenship after 5 years; 2) Recognizing America’s Children (RAC) Act, which would extend the current program and provide a pathway to citizenship after 10 years; 3) Bar Removal of Individuals who Dream and Grow our Economy (BRIDGE) Act, a visa-only program that provides no pathway to citizenship; and 4) Solution for Undocumented Children through Careers, Education, Defending our nation (SUCCEED) Act, a pathway to citizenship after 5, 10, or 15 years depending upon residency and other considerations. In order for applicants to remain in the country legally, a bill would need to be passed before the March 5, 2018, deadline. The District is continuing to monitor this situation, with emphasis on the DREAM Act.

The governing board of the San Diego Community College District is composed of 5 elected members and 1 student trustee position. The student trustee position is filled on a rotating basis. Dr. Carroll indicated that student enrollment continues to build. Registration for the forthcoming intersession 2018 is running significantly ahead of registration for intersession 2017 at a comparable time. Enrollment is currently 45.2% ahead in on-campus classes and 61.8% ahead in online classes. Student Trustee Alana Mahal Bermodes reported on various student activities, including that the Miramar College Associated Student Government (ASG) hosted food and clothing drives, and held an end-of-the-semester potluck for students. At City College, the ASG attended the Student Senate for California Community Colleges (SSCCC) and National Student Leadership Diversity Convention (NSLDC) conferences, while at Mesa College, the ASG voted to rename the group Associated Students and hosted a Thanksgiving feast for students.

At its meeting of December 14, 2017, the Board of Trustees: •

Announced the following action from Closed Session: the Board denied the appeal of the Administrative Determination of a Title 5 Investigation regarding a matter at Mesa College; and approved the disciplinary actions of expelling a Continuing Education student and a Miramar College student from all colleges, campuses, programs, sites, and activities of the San Diego Community College District, pursuant to California Education Code section 72122 and 20 U.S.C. section 1232g.

Heard public comments from Mesa College Professor Edward Alexander regarding a Title 5 complaint appeal; from Mesa College Academic Senate President Kim Perigo, who congratulated the Mesa Olympians Football team for winning the recent southern California Bowl, and recognized the Mesa Associated Student Government, Classified staff, and Vice President of Administrative Services for work they had each done throughout the year to support students; from Continuing Education Academic Senate President Richard Weinroth, who discussed resolutions passed at the statewide Academic Senate plenary, particularly those concerning noncredit education; and from Supervisory & Professional Administrators Association President Daniel Gutowski and member Charlotta Robertson, who addressed the Board regarding economic justice for supervisors who make close to or less than the employees they supervise.

Approved and adopted revised Chapter 2 – Board of Trustees Board Policies (first reading 11/9/17) and Chapter 7 – Human Resources Board Policies (first reading 11/9/17). These revisions are part of a comprehensive six-year review to ensure currency

Conducted the Board’s Annual Organizational Meeting:

Electing Trustee Maria Nieto Senour as President of the Board;

Electing Trustee Bernie Rhinerson as Executive Vice President of the Board;

3.

Designating Trustee Mary Graham as Vice President for Institutional Effectiveness;

4.

Designating Trustee Peter Zschiesche as Vice President for Community Development;

5.

Designating Trustee Rich Grosch as Vice President for Educational Collaboration;

6.

Appointing Chancellor Constance Carroll as Secretary to the Board

7.

D iscussing matters of policy or function as determined by the Board; and referring to the Chancellor regarding Board members’ interests in serving on the two subcommittees: Budget Study and Audit, and Accreditation and Student Success. It was suggested to keep the existing subcommittees.

Reviewed the results of and approved the Board of Trustees’ self-evaluation for 2016-17 and set goals for 2017-18. The Board members thanked all who participated in providing feedback regarding the Board’s performance and accomplishments. It was noted that the Board received a 98.6% approval rating in the survey results, the highest rating the Board has ever received. They also thanked the Chancellor and District staff, who worked to implement the goals they set forth. Approved new or revised courses and programs following a presentation by Vice Chancellor of Instructional Services Stephanie Bulger; authorized travel of City College students and faculty to conduct Spanish courses in Madrid, Spain, and travel of Mesa College students and faculty to participate in a concert tour to Czech Republic and Poland. Accepted the District’s 2016-2017 Independent Auditor’s Reports, which were conducted by the accounting firm Christy White Associates. Audit reports for the five major funds in the District were provided: General Fund, Proposition S Fund, Proposition N Fund, the SDCC Auxiliary Organization, and the Social Security Alternative Plan. The Board’s Budget Study and Audit Committee (Trustees Bernie Rhinerson and Peter Zschiesche) had reviewed the audits in depth with Executive Vice Chancellor Bonnie Ann Dowd and Chancellor Constance Carroll prior to the meeting. Christy White, President of Christy White Associates, addressed the Board and noted that all audits received the highest ratings possible, an unmodified opinion (meaning that all information was accurate and complete, with adequate internal controls and full federal and state compliance), no negative findings, and no recommendations. In response to Board members’ positive comments, Dr. Dowd stated that all members of the District, especially the District Controller and the campus Vice Presidents of Administrative Services were to be commended for their excellent work. All Board members certified that the accreditation self-evaluation reports had been reviewed.

Accepted a grant from the U.S. Department of Education for the Developing Hispanic-Serving Institutions Program – Title III STEM, which is designed to expand and improve Latino/a success at Mesa College; entered into a one-year contract with the U.S. Navy to provide instructional services to military personnel at the Naval Technical Training Center at Cory Station, Pensacola, Florida; approved purchase orders prepared during the months of October and November 2017; and approved various personnel actions including the certification of short-term personnel service effective on or after December 15, 2017.

Authorized the use of George L. Stevens Senior Center as an off-campus facility by Continuing Education; a contract with Grace Brethren Church to use its vacant lot for Mesa College parking; a Master Retail Natural Gas Service Supply agreement with Constellation New Energy-Gas Division LLC. to provide natural gas to Miramar College; and the increase in funding of an existing consultant agreement with JE Moore Consulting Inc. to provide project managing services districtwide.
