The morning after the Nov. 3 General Election, San Diego had the “blues,” with a Democrat elected mayor and five new faces on the nine-member City Council, which could possibly turn out to be all Democrats except for Chris Cate in District 6. Early returns had voter turnout of 1,254,604 ballots cast, of which 1,088,251 were mail-in ballots from among 1,949,073 registered voters. And unlike much of the rest of the nation, where it may take days to tally mail-in ballots in razor-thin

was elated the day after the election. “We’re thrilled with the early results and we’re waiting anxiously to receive the final tally,” Kenton said. “We’ve made history with a bi-partisan measure that will add housing that San Diego so desperately needs, create a sports and entertainment venue that San Diego can be proud of, and most importantly transform our community. “You can see through the slats, and animals can still go in and out from it,” Dominguez said adding, “It’s rather less costly than other fencing we’ve looked at.” The City’s habitat protection plan for Dog Beach was previously approved by OB Planning Board whose vice chair, Kevin Hastings, commented: “It’s adding wood slats to prevent people and dogs from crossing the existing rope barriers into areas that are already off-limits. People and dogs can still access the entire sandy beach, including from paths crossing over the dunes."

Port Master Plan Update preserves La Playa piers, sportfishing on Shelter Island, and hotels on Harbor Island By DAVE SCHWAB | The Beacon
A revised draft for the Port Master Plan Update has concentrated future hotel rooms on Harbor Island while preserving both La Playa piers and the Marlin Club sportfishing on Shelter Island. The Port’s objective for the PMPU is to create a thoughtful and balanced approach to future water and land uses on and around San Diego Bay for future generations. Its latest PMPU draft considers and reflects extensive community input received since its discussion draft was released in April 2019. The Port Master Plan serves a number of functions. It determines where port activities take place and where public access is allowed. It also guides where recreational amenities and view corridors are to be located, and where commercial uses like hotels, restaurants, and visitor-serving retail may be built. It also helps to protect and restore the natural environment. Port spokesperson Brianne Page said public testimony on the master plan update taken at Board of Port Commissioners’ meetings was reflected in direction by commissioners to staff. Those directions call for: Moving proposed Shelter Island hotel rooms
to Harbor Island; maintaining the 30-foot building height limit; keeping La Playa piers open to the public with docks remaining private; no reconfiguration of Scott Street; keeping the La Playa trail natural and clarifying master plan update language. Port planning director Lesley Nishihira said the master plan, certified by the California Coastal Commission in 1981, has been amended 40 times since then. She said the Port decided the master plan needed an overhaul, adding a decision was made to “update the entire plan” instead of amending it piecemeal “to allow special projects.” “This is really the first complete update that we’ve done,” Nishihira said. “The plan had really become outdated and we said, 'Let’s step back and take a holistic view of our master plan to come up with a vision and some guiding principles.’” Nishihira said more than 3,000 individual comments have been received from the public in the PMPU, the majority coming from Peninsula and Coronado residents. “We got a lot of feedback about development intensity on Shelter Island and visitor-type uses there,” she said. “We had originally planned on hotel rooms in Shelter Island, but those have been removed. The revised draft now

proposes hotel development on Harbor Island only, which doesn’t have the same view-blockage issues.” Regarding La Playa piers, Nishihira noted: “Those piers were initially constructed as part of private residences, but then the state tidelands became owned and managed by the Port. For many years, those piers have been leased to the adjacent homeowners for private use. But the Coastal Commission previously ruled that the piers had to become 100% public or be demolished. Our board has directed us to allow the piers to remain as they are today. We will see how the Coastal Commission responds to this.” Like the piers, Marlin Club sport fishing is proposed to be left untouched in the PMPU. The revised PMPU is now out for public review. After that, Nishihira said Port staff will sift through all the public comments received. “Our hope is to wrap the draft

up with a nice bow before the end of 2021,” she said. “A draft environmental impact report for the PMPU we’re targeting for summer 2021. It’s (PMUP) a 30-year plan expiring in 2050.” The San Diego Unified Port District was created in 1962 to manage 34 miles of San Diego Bay waterfront along Chula Vista, Coronado, Imperial Beach, National City, and San Diego including Shelter Island. The lands
are to be used to benefit the statewide public in enhancing commerce, navigation, fisheries, and recreation. ReWild Mission Bay’s ‘Wildest’ proposal takes positive step forward after Water Quality Control Board vote In a unanimous vote following two hours of public testimony, the state Regional Water Quality Control Board for the San Diego region voted 6-0 in support of a Supplemental Environmental Project that will enable the ReWild Mission Bay “Wildest" plan for wetland restoration in northeast Mission Bay to be considered at the same level as the city's own plan. Backed by an impressive coalition of community planning groups, businesses, labor unions, environmental outlets, and faith-based organizations, the adoption of the Supplemental Environmental Project earmarks funds for the City of San Diego to develop a new, wetland-rich planning alternative in the ReWild area of concern that will benefit the ecological health of Kendall-Frost Marsh Reserve, Rose Creek, and De Anza Cove.
Andrew Meyer, conservation director at the San Diego Audubon Society and campaign director for ReWild Mission Bay, said the control board’s vote is important, but there's more work to do. "This is a big win for ReWild Mission Bay project and the 46 members of the ReWild Coalition," he said. "However, while this enables the city to create a new alternative with more wetland in the ongoing De Anza planning process, it doesn't guarantee the city will choose it. That's where our focus has to go now." ReWild campaign coordinator Tommy Hough echoed the need for a renewed effort at City Hall, but also noted what he described as the "unimpeachable basics" of the campaign. "This is about taking steps to ensure resiliency to climate change and rising sea levels,
improve water quality, restore access to our shared public places, ensure greater habitat for vulnerable and threatened species, facilitate carbon sequestration, and add environmental justice components to the Mission Bay Park experience relative to the area's lengthy history of Indigenous use," Hough said. ReWild Mission Bay is a project of the San Diego Audubon Society and the ReWild Coalition partners to enhance and restore wetlands in the northeast corner of Mission Bay, thereby creating new opportunities for wildlife to thrive, and for San Diegans to enjoy nature in their collective backyard. Planning Commission to address revised short-term rental proposal By DAVE SCHWAB | The Beacon
District 2 Councilmember Dr. Jen Campbell’s compromise proposal on short-term rentals was vetted on Oct. 8 by the City Planning Commission, which voted 4-3 to send it back to staff for further review and to return later with more details. Reacting, Campbell’s chief of staff Venus Molina, who presented the proposal said, “I felt a sense of relief knowing that all of the planning commissioners felt there was
something that needed to be done. I didn’t hear one of them say, ‘We don’t need an ordinance. We don’t need to do this.’ I felt they were very on board with the idea of moving forward and having regulations. That’s a huge win.” If Campbell’s proposal passes muster with both the Planning Commission and the City Council, it is not proposed to take effect until Jan. 1, 2022. What’s going to happen between now and Dec. 3 when a more detailed proposal is due back to the
Planning Commission? Answered Molina: “The City Attorney’s office will definitely be asking the legal questions. Which is, can we do this? Should we do this? What happens if we don’t? I think that legal piece of it will set the tone from the very beginning.” Added Molina, “The piece we have to bring back is the framework on the administrative regulations.” Molina said their office is convinced implementing any new ordinance would necessitate creating
a new office of short-term vacation rentals to implement the program. “This is so big, and it encompasses so many different departments, that we need to have this centralized in one standalone office or one division,” she said. “Because it’s so complex, you need time to hire people and get the team going. In our proposed ordinance, we gave staff a year to get this up and running.” Added Molina, “On the policy side of things, you need to determine how many code enforcement
officers would be needed, and how much it should cost.” If Campbell’s more fleshed-out, short-term rental proposal gets passed by the commission on Dec. 3, Molina said the earliest it could be brought before the City Council would be in January 2021. And, following the Nov. 3 election, there will be five new council members, and a new mayor, weighing-in on any short-term rental proposal that would come before the next year.

In October Midway-Pacific Highway Community Planning Group heard from State Assembly member and mayoral candidate Todd Gloria about recent developments with COVID and the proposed central mobility hub at NAVWAR/Old Town. The planning group was also briefed by the San Diego Association of Governments on the agency’s Comprehensive Multimodal Corridor Plans. Concerning COVID Gloria said, “The good news is we were the only county in Southern California that stayed in Tier 2 of the four-tier (color-coded) system that the government has established. That should
serve as a reminder to encourage folks to wear face coverings in public and stay at home when sick and observe all best practices. Unfortunately, our (virus) numbers continue to creep up scraping just below Tier 1 (most restrictive) status. We want to avoid another business closure. We need to stop the spread of this virus. We’re not there yet.” Gloria warned of tough economic times lying ahead due to COVID. “The next couple years are going to be very difficult for the City financially,” he concluded. Speaking before MPHCPG for the last time as their state legislator, Gloria also discussed a bill he co-authored, AB 2731, which was recently signed into law
AVOIDING FUTURE TRUST OR WILL CONTESTS By: Dick McEntyre and Chris von der Lieth, Attorneys at Law Although most trusts and wills contain a “no contest clause,” disgruntled persons, especially one’s children, who feel they were improperly left out of a decedent’s disposition of property, may still vigorously challenge the provisions of the decedent’s document(s) in question following the deceased person’s death. The grounds for such a challenge can be: (1) alleged fraud or undue influence exacted by the taker under the trust or will; (2) purported lack of mental capacity of the trustor or testator resulting in the estate going to the “wrong beneficiary”; or (3) especially in the instance of children, when a child believes he or she was inadvertently left out (“forgotten”) of the trust or will. Such challenges can slow up the administration of the trust or estate, cause anxiety, and be very costly to all parties involved. To help avoid such a future challenge, when a trustor of a trust or the testator of a will believes there may be future discontent among his or her children, he or she should strongly
consider having a before-the-fact meeting with the children and advise them of his or her intentions regarding the future disposition of the trust and/or estate. While such a meeting may be uncomfortable, in the long run it could be beneficial, since it may well allow the trustor or testator to die in peace, knowing that there should be no challenge to his or her estate planning disposition, with its attendant delays, costs, and anxieties. Further, such a meeting may provide for a reconciliation of those presently estranged children. Another idea which may be helpful is making a videotape of the trustor’s or testator’s signing of the trust or will along with such trustor or testator making a statement of why he or she is making the disposition in question.

and is intended to help clear the way for the proposed long-term, large-scale redevelopment of the NAVWAR/Old Town site. The plan is to transform NAVWAR/ Old Town into a central transportation mobility hub with an airport connection. Gloria discussed AB 2731 which he co-authored with Senate president pro Tempore Toni G. Atkins. He noted that bill directly impacts the Midway community. Known as the California Environmental Quality Act: City of San Diego: Old Town Center redevelopment, AB 2731 lays the groundwork for potential redevelopment of Naval Information Warfare Systems Command in the Midway District. The bill empowers CEQUA as the lead government agency to prepare and certify completion of an environmental impact report on creation of a NAVWAR/ Old Town central mobility hub, a project that may have a significant environmental impact. The new legislation follows efforts by SANDAG and the U.S. Navy to collaborate on a potential major redevelopment of the
NAVWAR site straddling Old Town Transit Center. They have been exploring the possibility of creating a central mobility hub connecting transit to the San Diego International Airport, along with creating a newly modernized cybersecurity facility for the Navy plus new regional housing. “I’m excited about the opportunities this bill presents in supporting a new chapter in the Midway neighborhood,” Gloria said. “Your support for Measure E (removing 30-foot height limit in Midway) signals your willingness to go beyond the status quo. Hopefully, this bill will help shepherd the NAVWAR redevelopment and allow you a seat at the table with great transparency and public participation in what’s going on at that site. It also has the potential for creating a transportation hub, as well as rental housing. It’s a one-in-100-year opportunity to redevelop that site.” MPHCPG chair Cathy Kenton asked Gloria, if he gets elected mayor, how he foresees the process moving forward for both creating a central mobility hub at NAVWAR/
Old Town and sports arena redevelopment, should Measure E pass. “I’ve been outspokenly in support of Measure E which people in this community also support,” Gloria answered. “Hopefully, this will help the neighborhood, residents and business owners. That message resonates. I have confidence in Brookfield (sports arena redeveloper).” SANDAG senior transportation planner Rachel Kennedy told Midway planners about CMCPs, a comprehensive program being studied by the regional transportation planning agency to concentrate numerous transportation modes including mass transit into distinct travel corridors. She said there are five such corridors – Purple Line/I -805/ Blue Line/I -5 South, State Route 52 in Santee, San Vicente along State Route 67, North County and the Central Mobility Hub and Connections at Old Town/NAVWAR – currently being studied. In September, SANDAG’s board approved $40 million for advanced planning on CMCPs over the next five years.

Speaking at Gage Elementary School on Oct. 27, San Diego Unified leaders said safety measures put in place over the summer have so far prevented any documented cases of COVID-19 transmission on its campuses that have reopened. The next phases would continue to be rolled out gradually, with secondary and pre-K students next to receive appointments for in-person education following further collaboration with educators and other employees. District leaders said they hope to begin bringing large numbers of students on campus in January for in-person learning, although they expressed concern over the worsening COVID-19 conditions in San Diego County. “Safety has been our strategy from the start,” Superintendent Cindy Marten said. While stressing the fact the first phase of reopening has only just begun, she said preliminary signs are encouraging. “The safety precautions put in place at schools like Gage and elsewhere appear to be working."

Mariner’s Cove upgrade would add more ‘workforce housing’ in OB By DAVE SCHWAB | The Beacon
A large-scale apartment redevelopment that could redraw the landscape on West Point Loma Boulevard will be presented to Ocean Beach Planning Board in December. Proposed is a multi-family redo of Mariner’s Cove Apartments at 4392 W. Point Loma Blvd. The project will add 272 more units to the existing 31-acre, 500-unit, two-story apartment complex. “The Mariner’s Cove project will be appearing on the Dec. 2 agenda,” said Andrea Schlageter, OBPB chair. “I am getting a lot of community interest in the project and I expect a robust discussion around Mariner’s Cove. I want to make sure it gets the time and attention it deserves.” The Mariner’s Cove expansion project was presented to the Midway-Pacific Highway Community Planning Group about six months ago. Patti Shwayder, senior vice president for the apartment project’s developer, Apartment Investment and Management Co., said project planning is advancing but has changed little from its original concept. Noting Aimco has owned the 31-acre property since 2002, Shwayder spoke of the need for updating the apartment complex. “We love the location but it’s

’80s construction,” she pointed out. “We looked at what we could do with the property. It has been well maintained, but it needs some work. At first, we looked at just rehabbing it. But the infrastructure was old and it required a huge amount of investment. So we thought we would think broader. It is 31 acres, so thinking what we could do, led us to do a whole new master plan.” Shwayder said Aimco has a
ground lease for the property with the San Diego Housing Commission. “We were looking to extend the ground lease,” she said. “So we started looking seven years ago at the conditions for extending the ground lease. But the housing commission required us to put millions of dollars into the property, which did not make it the new modern community that we desired. Being such a large

site, we thought it was primed for additional apartments. And given we have buy-right (to increase) density, we decided to add an additional 272 apartments.” The Aimco vice president noted the new units proposed to be added to Mariner’s Cove will not be converted to condominiums, as their company handles apartments only. Aimco owns some 40 San Diego apartment communities.
Shwayder said a significant portion of Mariner’s Cove will be set aside for affordable housing, but added the majority of the housing project will target “workforce housing.” “It’s not going to be highend,” she said of the housing market being targeted. “We have 100 existing affordable units, and 200 affordable units in the new development, which is geared toward workforce housing, the missing middle.” Shwayder described workforce housing as applying to occupations such as “teachers, firefighters, police, those folks who make a good income, but don’t qualify for affordable units,” she said. “They are also priced out of more expensive areas in San Diego. The idea is to have a very robust mix of housing. In the main, it’s workforce missing-middle housing.” If all goes well with planning for Mariner’s Cove expansion, Shwayder said, “We will probably begin construction in summer of 2022, anticipating completion in mid-2025, though that might be a little aggressive.” Aimco has said the Mariner’s Cove apartment redo is being accompl i shed w it h pr ivat e investor funds, not taxpayer support. Stranded couple sends rescue crews racing to Sunset Cliffs during the night By SCOTT HOPKINS | The Beacon
A couple's relaxing evening on a Sunset Cliffs beach took a frightening turn when they found themselves in total darkness and unable to climb up the steep incline. The rescue call went out at 7:19 p.m. on Oct. 29 and sent lifeguards and San Diego Fire-Rescue crews from several stations to the cliffs at the intersection of Monaco Street. The first engine on the scene, observing the darkness at the site,
put in a call for Copter 2, a department resource, to provide lighting for personnel. Fire captains and a battalion chief quickly assessed the situation and devised a plan. Crews used the fully extended aerial ladder from Truck 20 to reach out over the cliffs. A system of ropes was used to lower rescuers to the beach where the uninjured man and woman were trapped. From there, each was raised separately with a firefighter, beginning with the
woman, to safe ground above. A crowd of about 100 watched the complex operation, attracted by the helicopter and flashing lights of the half dozen fire vehicles and police blocking access to the scene. Once brought to safety, each offered identification to police officers. When finished, the couple sauntered off towards Ocean Beach as rescuers began the half-hour task of retrieving hundreds of feet of rope and retracting the huge aerial ladder.

One truly authentic Mexican eatery has replaced another at the corner of Bacon Street and Niagara Avenue in Ocean Beach, as La Doña has debuted in the space where Nati’s Mexican Restaurant was for nearly 60 years. Nati’s closed in June 2018. La Doña co-owners Brendan Huffman and Hoffman Leung are with the Social Syndicate, a San Diego-based restaurant development group founded in 2014. The group is known for revitalizing and creating popular and profitable restaurant concepts. The business duo has teamed with chef and Tijuana native Gabby Lopez to bring
homespun Mexican cuisine to 1852 Bacon St. “We’d been doing research on t h i s proje ct for s evera l years as we had a cantina concept in our back pocket,” noted Huffman, pointing out chef Lopez, who has been cooking since age 8, is the star of La Doña’s show. “She’s unbelievable, she’s the leader of the ba nd,” he sa id. “Her fa m i ly recipes date back generations. A nd ou r beverage d i rector, Jah mal Bento, has been doing an incredible job mixing beautiful, creative cocktails that really blend well with chef Gabby’s food menu.” La Doña is Social Syndicate’s fourth OB restaurant joining Blue Water Seafood Market,
Wonderland Ocean Pub and Ob Surf Lodge. “We’re pretty OB-focused,” admitted Huffman adding, “We continue to try and elevate food and beverage in the surrounding area. Given the ongoing pandemic, Ocean Beach’s Restaurant Walk 2020 event will feature a new twist this year: A take-out edition. The fundraising event sponsored by the Ocean Beach Town Council with the assistance of Ocean Beach MainStreet Association will take place Monday through Thursday, Nov. 9-12. “OBTC and OBMA invite you to participate in this year’s OB Restaurant Walk Take-Out Edition,” said the two groups in a statement. “In ever-changing times, we too will change, to bring the community a taste of OB’s restaurants and breweries in a way never experienced before; spread over four nights with each evening featuring select restaurants/ breweries.” Added the fundraiser’s promo, “This year's Restaurant Walk will follow safety guidelines provided by the State, County, and City to bring the community a unique curated experience highlighting OB establishments.”

Point Loma High School cinema instructor Anthony Palmiotto knew he had a special film student after Ace Davis graduated and turned in a project that actually improved upon an unreleased 1994 “Fantastic Four” feature film titled, "Doomed: The Untold Story of Roger Corman's the Fantastic Four (2015).” Corman is a 94-year-old American independent film director, producer, and actor who has been called “The Pope of Pop Cinema." C or ma n mentore d such high-profile film directors as Francis Ford Coppola, Ron Howard, Martin Scorsese, Jonathan Demme, John Sayles, and James Cameron. He also helped launch the acting careers of Peter Fonda, Jack Nicholson, Dennis Hopper, Bruce Dern, Sylvester Stallone, Diane Ladd, and William Shatner. An aspiring filmmaker, Davis has been making his own movies since he was a preteen. He is the creator of an independent film production company, Smiling Devil Productions, where he has crafted a plethora of short films. Palmiotto and Davis spoke about the origin of Davis’ successful re-mastering film project. “I assigned the students in my cinematic arts class to watch a documentary of their choosing,” said Palmiotto. “[Davis] chose one

about this unreleased film. That documentary led him to find the trailer online, and also a low-quality version of the film on YouTube. He then took it upon himself to re-master the trailer with an iMac. So if the whole point about last school year going online was the pursuit of mastery – this student proved it.” “I was still at PLHS in Mr. P’s class,” said Davis, adding he was inspired to redo the Corman
‘Fantastic Four’ film trailer after viewing it because “the original 1994 film is not the best. So I worked on it and showed [Palmiotto] what I had and he said, ‘This looks great. Let’s keep working on it.’ Then we did some of the comic book stuff, the panels, and I recut the trailer so it looks way different. I used the original trailer as a skeleton, a framework, and worked off that. I used effects very similar to CGI action.”

Palmiotto was impressed. “I am blown away by this young man,” the film instructor said. “He probably spent at least 200-plus hours on his own, re-editing the trailer, sound designing it, creating new titles, adding comic book panels, color correcting the film, etc. He basically just finished this working on it every now and then four months after he graduated high school.” “For me, it was a fun thing to
do,” said Davis of remastering the Corman trailer, which he characterized as a “portfolio piece.” He added his ambition is to attend film school. “The plan is to obviously go to college and network there meeting some new people,” Davis said. “And I’m going to keep making films and submitting them to local film festivals, like the San Diego International Film Festival.” A perfectionist, Davis got interested in filmmaking early-on. “I’ve been making movies with a Sony Camcorder since I was a little kid, 6 years old,” he said. “I used to pull out Legos and make stop-action movies.” Of the film directors he’s been inspired by, Davis cited Sam Rami, who did the original “Spiderman” movie, as well as Martin Scorsese and Steven Spielberg. He hasn’t settled on a film genre yet though he noted, “I’ve tried to dabble in horror and psychological thrillers, action, and drama.” Thankful to Palmiotto for his coaching, Davis concluded of his fledgling film making career, “It’s all a work in progress. New Point Loma High School principal Kelly Lowry and a select committee are near an announcement of the school's new head football coach and Lowry, a former assistant football coach at Mission Bay, knows full well how important the choice is. When former head coach Mike Hastings stepped down after 26 years on the football staff, 22 as head coach, Lowry was taken by surprise. Hastings was only the third head coach the school has had since 1946, so Lowry didn't foresee the selection of Hastings' successor as one of his first tasks. "I hope that we can find another individual who can carry on that tradition, and mentor young student-athletes as they become productive citizens," Lowry told the Peninsula Beacon just hours after

learning of Hastings' decision. The open position apparently drew high interest from applicants
throughout the region. Interviews were held Oct. 26 and 27, but Lowry said the selection committee had so many well-qualified applicants that interviews were to continue with the selected name revealed Nov. 5 or 6 (after press time). There are numerous off-season workouts to be held along with developing young players hoping to earn a varsity spot. Checks must be made on players' progress in classes along with any off-campus issues and home issues while teaching five periods a day. Hastings and Pointer fans have felt for years that the school's placement in the Western League with private school powers Cathedral Catholic and St. Augustine was an issue. The private schools are able to bring in selected players and waive or reduce tuition fees if needed. An off-season effort to move the Pointers to a different league was unsuccessful.
In fact, Hastings guided four of his teams to the CIF championship games at Qualcomm Stadium. The Pointers were defeated by St. Augustine in 2005 and 2006, and in 2007 and 2009 by Cathedral Catholic, both schools playing in Div. II determined by enrollment despite their clear advantage in obtaining players. Hastings celebrated 148 wins with his assistants over 22 years ranking him 17th all-time in San Diego history. Low r y cited Hast i ngs' strengths, besides guiding his athletes to success, as teaching important life skills including personal integrity, self-discipline, teamwork, dedication, goal setting, and completion. Hastings noted he will remain as a PE teacher and mentor to students for five or six more years before fully retiring.
