With the entire region of Southern California facing drought conditions, the city will begin requiring residents and some businesses to change the way they use water effective June 1. The new water regulations come as the city prepares for less water coming from the

La Jolla Country Day (LJCD) School’s 2009 senior class will gather Friday, May 29, from 2 to 4 p.m. at the school’s amphitheater for its commencement ceremony. About 89 seniors will begin the tradition around 1 p.m. Friday, receiving their caps and gowns, said Francine Phillips, the school’s Country Day senior Junnarkar Samir senior communications officer. “The ceremony starts at 2 and will address his fellow grads during the then they have a class photo,” May 29 commencement ceremony.

LJCD holds a tradition in which Torreys seniors ring an old school bell to commemorate the 1926 LJCD, when it was located at La Jolla’s Wisteria Cottage and called the Balmer School. Friends would ask how we could run while talking so much. Conversation has never been a problem for us. In 1980 we headed north, me by plane and the other two with spouses in a VW bus, to the Avenue of the Giants Marathon, a beautiful out and back course through the redwoods. Joanne was “angel of the Avenue” as she ran me through this one at a particularly low point of my life. We were proud of the fact that the next night we were able to walk the hills of San Francisco, a place we stopped at overnight on the long ride back to San Diego. One year Joanne and her husband Tom and two young teens ran the Boston Marathon. When they were finished and resting in their hotel room, someone would say, “If anybody is going to the bathroom, would you please bring back the aspirin and a glass of water.” Linn was a competitive swimmer as a kid and would have made a tenacious triathalete if only she liked biking. Being a bit of a showoff, one year I ran the San Francisco Bay to Breakers dressed as a cow. My udders attracted a lot of folks, and the heat from the costume kept me humble. We three runners have raced and hobbled through rain, wind, hail, snow and heat as well as death, divorce and depression. A

marathon, of course, is a metaphor for life. You are terribly excited about the journey but you know it is going to hurt sometimes, how much and when remain undetermined, and the finish line may see you laughing or limping or both. Our lives have tightly intertwined like the laces on running shoes. It’s been 30 pounds since I ran a full marathon. However, I know there is still one in me if only I can pass by Baskin Robbins. Joanne has taken on tennis

with a vengeance. She and her husband, a semi-retired veterinarian, are a skilled mixed doubles team. Linn’s knees keep barking like an angry Doberman, so she has chosen to keep her aerobics going on a home treadmill, although she’s a gifted endurance athlete. I’m the only one who dreams of one more marathon. I recall entering the 2000 Rock ’n’ Roll. On the uphill leg of the run on Route 163, at mile 7 or 8, a guy on the sideline yelled, “The Kenyans are already finished.” I didn’t know if I should laugh or cry. At the half I quit, worked my way back to the start in Hillcrest where my car was and decided to take up golf. The Rainbow Runners, celebrating 30 years of friendship through running, encourage the Rock ’n’ Roll Marathoners to pace themselves. It’s always two races: 20 and six. Runners and joggers develop more than good lungs from their sport. They bond with their running partners and realize what a gift running is. To quote Ellen Hart again, “This gift, like any other, is subject to abuse, to the ravages of compulsiveness, insensitivity, overindulgence and self-importance.” Hopefully, the first-time marathoners will have some fun along the way on Sunday. With bands playing at every mile, the music should just wash over you as you pound the pavement. Hopefully you’ve been blessed with friends to run with. A special blessing to the back of the pack even though “the Kenyans have already finished.” I

Hoffman ruled the TRO was not relevant, according to the attorneys. “If the federal TRO is lifted, then I’ll file an emergency motion for a stay with the 9th Circuit,” Pease said. In addition to Pease’s federal restraining order — which protected the seal colony during pupping season, December through May 15 — state Sen. Christine Kehoe is shepherding legislation through Sacramento to change the area’s tidelands grant, which would save the city money dispersing seals. But Hoffman said the tidelands grant legislation — which would activate around January of 2010 — wasn’t relevant, according to the attorneys. “It’s unconstitutional… I disagreed and the judge did, too,” Kennerson said. “I said these arguments are financial and political. The city’s remedy is to have an audio box of barking dogs, but that’s just to generate public sympathy.” Kennerson said barking dog sound effects playing around the clock would disturb nursing home residents across the street from the Children’s Pool. “We’ll return to court with a revised plan June 15,” Kennerson said. “I’ve got access to some [seal] experts; I have some people in mind.” Kennerson said he plans to create a seal dispersal plan. “One of the world’s leading experts says, for instance, the best way is to have a lap dog at the

City Attorney Jan Goldsmith has weighed in with a recommendation that all parties delay action until the change in the terms of the beach’s state trust is passed by the State Assembly. “While we respect the Court and will obey its orders, we believe the costs and disruption of attempting to remove the seals at this point is unnecessary,” according to a statement from Goldsmith’s office. District 1 San Diego City Councilwoman Sherri Lightner will hold a community forum today, May 28 at 6 p.m. at La Jolla Recreation Center, 615 Prospect St., to discuss seal dispersal plans. FEDERAL COURT TIMELINE: • Dec. 11, 2007, Pease filed a federal lawsuit on behalf of APRL — in U.S. district court — against the city and state, asking for the rope’s issuance. Pease lost. But he said he focused on the Marine Mammal Protection Act (MMPA), not the rope. • Dec. 18, 2007, Pease and APRL moved for a temporary restraining order regarding the barrier

rope, but the district court denied the request in a Feb. 4, 2008 ruling. • Feb. 27, 2008, the district court issued an order “abstaining from exercising subject matter,” court documents stated. Furthermore, the federal court said, the (federal) MMPA “does not preempt the state law at issue in this action,” the court stated. So Pease immediately filed an appeal in the U.S. Court of Appeals for the 9th Circuit. • March 10, 2008, the court of appeals granted an “emergency motion for injunctive relief pending disposition of the appeal staying ‘application of state law or any state court order to prevent placement of a guideline rope in the La Jolla Children’s Pool Beach.’” And then the court of appeals for the 9th Circuit dismissed APRL’s lawsuit June 17, 2008, saying the court lacked federal jurisdiction, documents stated.

• Pease said he filed another federal lawsuit for the 2008-09 pupping season with official letters NOAA officials sent to the city, requesting the rope. Pease focused on the city council’s previous motions allowing a pupping season rope barrier. • Pease said he requested a barrier rope and a restraining order in an October 2008 APRL lawsuit against the city of San Diego, and agents of the National Oceanic and Atmospheric Administration (NOAA) and the National Marine Fisheries Service (NMFS). Regarding the city complying with its resolutions, at this stage, the record supports that federal interest is substantial enough to support the question of federal jurisdiction, federal Judge William Q. Hayes of the Southern District Court said. At this point the MMPA “does not provide for citizens to enforce the statute but expressly

preempts state laws which conflict with the provisions of the act,” Hayes wrote. All issues regarding marine mammals revert to federal law, Hayes said. “Consistent with his conclusion… filed on August 26, 2005 by Superior Court Judge William C. Pate which the city is obligated to follow specifically states that ‘nothing contained in this order shall be construed as requiring the city to violate any law, rule or regulation of any federal, state or county government,’” Hayes wrote. “At this stage in the proceedings, the state law claim for writ of mandate… involves a dispute or controversy respecting the validity, construction, or effect of federal law.” Hayes granted Pease’s application for a temporary restraining order in the Dec. 18 electronic ruling, “…requiring the city of San Diego to follow two resolutions of its City Council by placing a guideline pupping season rope at the Children’s Pool beach in La Jolla, California.” For more information, visit www.childrenspool.org or w w w. f r i e n d s o f t h e seals.com, www.aprl.org www.aprl.org/seals.html. While impending regulations, including only watering lawns between 6 p.m. and 10 a.m., may take some water users by surprise, others are already in the habit of conserving, which has helped the city save water, city officials said. “[Watering between 6 p.m. and 10 a.m.] is just a smart practice anyway, to prevent waste,” said Luke Sandri, manager of Green Garden Nursery, 4910 Cass St. “Everybody seems to be aware of it.” Businesses like Green Garden Nursery and Coastal Sage Gardening in Ocean Beach have been tweaking their business practices to deal with drought conditions for a while. The city won’t hinder their consumption. The new regulations won’t affect them as much as residential and other users who will only be allowed to irrigate on specific days, for 10 minutes at a time per watering station. Each sprinkler head on an irrigation system can water for 10 minutes. “As long as sprinklers don’t overlap [areas] because we don’t want people over-watering,” Har-

The city is also asking nurseries and other heavy water users, such as golf courses, to use efficient irrigation systems. Because it’s part of their business, the city is not mandating nurseries and golf courses to cut back on their water use. Sandri said that in addition to self-adjusting irrigation systems that can detect moisture conditions, customers are also switching to more drought-resistant plants. There is also a trend toward growing vegetables at home. John Noble, owner of Coastal Sage Gardening, 3685 Voltaire St., said the new drought regulations change the nature of the gardening and landscaping industry. “I think most nurseries are going to be focusing more on the drought-tolerant plants this year,” Noble said. Water-storing succulents, shrubs and other native plants are one part of the trend in this new water era where scarcity is the norm. Because of the expected cuts to water supplies, Harris said that moving to a level 2 drought alert compels residents to change their water usage instead of mandating water allocations. The city will formulate a plan for water allocations should one be needed, he said. Harris said these regulations shouldn’t come as a surprise to anyone. “Mayor [Jerry Sanders] has been asking everyone to fundamentally change the way they think about and use water for more than two years now,” Harris said. “He’s been telling people, ‘You gotta get ready. You gotta be prepared. You have to know it’s coming.’” To help curb water usage, every drop counts and it’s the small activities that make a difference. For example, Sanders no longer shaves in the shower to save water, according to Harris. To help spread the word about the new water regulations, the city’s Water Department has been hosting public meetings throughout the city. I

Aside from a possible gang-related shooting at the Belmont Park parking lot Sunday, police officials reported a Memorial Day weekend without significant incident. No one was injured in the May 24 shooting and police are continuing to investigate, said Lt. Jorge Duran, a San Diego Police Department gang unit investigator. Police are searching for witnesses, Duran said. “We are hoping somebody in the community may have seen or heard something,” Duran said. “Tying to find folks to cooperate with the gang unit is a challenge.” Beach-area patrols arrested 13 suspected drunken drivers during a DUI checkpoint along Garnet Avenue on Friday, May 22. Police handed out about 122 misdemeanor alcohol citations in Mission, Ocean and Pacific beaches, according to Northern Division Capt. Shelley Zimmerman. The second Memorial Day weekend since the start of a beach alcohol ban — a temporary ban last summer and now a permanent ban approved by voters last year — lured 750,000 sandal-clad tourists and families over three days.

“Did the alcohol ban play a role? ...Yes, without question that the atmosphere is very relaxing, very welcoming, even though we had 500,000 more people compared to last year,” Zimmerman said. Officer Mark McCullough said Friday’s DUI checkpoint resulted in several arrests for driving without a license and other offenses. Police did not set up checkpoints after Friday. An increase in arrests, however, means police are doing their job, McCullough said. “It’s not that there’s more drunk drivers, we just have more enforcement… If we’re not seeing an increase in alcohol-related vehicle collisions, then we know that we’re holding the line,” McCullough said. He said no major collisions were reported. Lifeguards also had their hands full over the holiday weekend. San Diego Lifeguard Services Lt. Andy Lerum said strong currents and throngs of people made for quite a bit of rescue activity. Middle-schoolers recant attack story Three Correia Middle School students in Loma Portal lied to both police and school administrators recently, fabricating a story about a man assaulting them, according to officials. They trio made up the story as a cover for leaving school grounds without permission, according to documentation sent to parents of the school’s students in late March. The girls falsely claimed a 6-foottall black male assaulted them and tried to kidnap them as they walked to the school along Valeta Street, according to a letter emailed to parents by Correia Principal Patricia Ladd. The letter, dated Tuesday, April 14, states the incident did not occur. San Diego Police Department spokeswoman Mònica Muñoz said parents should remind their children that knowingly filing a false police report is illegal. “It’s important for anybody to understand that if you’re the victim of a crime, we need to hear about it,” Muñoz said. “But you have to be completely honest. Midway goes all out for Childhelp

What a golden evening it was for the 50th anniversary celebration of Childhelp’s Southern California Auxiliary, when all the stars were aligned for an unforgettable event aboard the USS Midway. Scheduled to appear were the likes of Connie Stevens, Joyce Bulifant, Roger Perry, Norm Crosby and Della Reese, whose aides wheeled her aboard but ducked a photographer who wanted to catch her smiling face. Oh well, them’s the breaks, but no one else avoided the lens as can be seen by the photos on this page. As for the founders, Sara O’Meara and Yvonne Fedderson, former starlets who were so appalled by the Japanese American orphans spurned by their countrymen back in 1959 that they formed International Orphans in order to help them. How proud they must be of what they have wrought over the years, including Operation Babylift (Vietnam), starting a tollfree hotline, Children’s Villages around the country to house abused children and much, much more. Airport planners will outline the next steps for Lindbergh Field’s short-term developments during a community town hall meeting on Wednesday, June 3 in the Corky McMillin Cos. Live music gives runners smiles for marathon miles BY ANTHONY GENTILE | VILLAGE NEWS

Runners and musicians alike will take over the streets of San Diego this Sunday — 20,000 runners, to be precise — when the Rock ’n’ Roll Marathon comes to town. The 12th annual marathon set to rock music concludes three days of health and fitness events. “It’s essentially a 26.2-mile block party,” event manager Kari Logan said. A new element of this year’s race is the Rock ’N’ Roll Relay. In the relay, 400 teams of four will complete the course for awards in five different award categories. “We wanted to add a little spark to the event. It’s a good opportunity to give the nonmarathon runner a chance to participate in the event,” Logan said. “It will hopefully open the

door to making them want to run a marathon one day.” But the Rock ’n’ Roll Marathon is not all about the running. A total of 42 bands will set up at stages along each mile of the course for runners and spectators to enjoy. Forty high school cheer squads will also urge on the runners, competing with each other in the “Spirit of the Course” contest. “Pacific Beach and Mission Bay are the best spectator spots because the neighborhood has taken ownership over the past few years,” Logan said. “The residents come out and have their own block party.” Traffic will also snarl across town, and participants should plan an extra one to two hours for travel and expect delays simSEE MILES, Page 10

I said, ‘Wow, is this what Trevor experienced?’ “I told them if you want me to go out there in the eighth inning, I’m ready. Let [pitcher Cla] Meredith or somebody else be the closer. I know the money is in being a closer, but I don’t care about that,” he added, alluding to the $6 million annual salary Hoffman commands with the Brewers. “On the road, I can go out and pitch two innings… I have no problem with that. Anything to help the team win. Winning solves everything.” As it did that night. Bell gave Greg Maddux, a future Hall of Famer and exPadre, credit in advising him how to take bad outings. “‘Don’t hold it in… let it out,’ he told me. ‘Don’t hurt yourself, but toss some towels, kick a trashcan or something. If you made a mistake, you made a mistake. Get your frustration out. Next day, you’ll be out there.’” Bell was asked about any main battles with batters at the plate. He recalled pitching against Cincinnati’s Ken Griffey Jr. “He fouled off nine or 10 pitches in the ninth inning of one game, but a base runner was thrown out to end the inning,” he said. “So I faced him again in the 10th. I threw 10 more pitches before he hit a home run to win the game. I haven’t really had a battle like that since.” He remembered facing Dodger powerhitter Manny Ramirez, who shattered his bat on one of his fastballs before striking out. So happens a childhood friend works for the company that furnishes Ramirez’s bats. “My friend was upset with me, but San Diego was happy,” he added. Bell brought laughter when he discussed a new training method: a video game console. He credits a Nintendo Wii game for helping him lose 25 pounds (he tips the scales at 240). He wasn’t a highly touted prospect, being selected by the Tampa Bay Rays in the 69th round of the 1997 amateur draft. He didn’t sign, but he caught on with the Mets as an undrafted free agent the following year. When he was traded to the Padres in 2006, he was considered a respectable middle reliever with a plus fastball, a decent change-up and a solid curve-slider combo. In 2007, he posted a 6–4 record in 81 appearances, 93.2 innings pitched, a 2.02 ERA, two saves and 102 strikeouts. He said the bullpen is always aware of what’s going on in the game even though he’s watching from a distance, like the fans in the outfield seats. “When they call us, we know the situation,” he said. “I keep mentally strong by pitching before the game in the bullpen.” He calls Chris Young the leader in the bullpen. “CY’s smarter than the rest of us,” he said of the Princeton graduate. And at 6–10, he’s much bigger. I

Dig deep for Barber Tract’s rich history BY LINDA MARRONE

The Barber Tract is a neighborhood rich in La Jolla history as well as a trove of early architecturally designed homes. In this picturesque neighborhood, nestled between Windansea beach and the Village, you find proud Spanish Colonials gracing the streets alongside quaint storybook English Tudors and French Normandystyle homes. Along the charming streets, vine-covered walls and garden gates hide secret gardens filled with mature landscaping, beautiful flowers and meandering pathways. Many of the European revival-style homes were built from 1920 to 1940 and were designed by some of San Diego’s noteworthy early architects. Edgar V. Ullrich, Tom Shepherd, Herbert Palmer, Requa & Jackson, Lilian

Rice, George Washington Smith and Florence Palmer have left their eclectic architectural imprints on this seaside terrain. Close to the turn of the century, the neighborhood was originally named “Neptunia” but has been affectionately known as the Barber Tract since the early 1920s after its major landowner and developer, Phillip Barber. Barber was an heir to the Barber & Company steamship firm in New York. The 16th of 18 children, Barber was a visionary and dreamer with an artistic sense, who in many ways was a man ahead of his time. While on a trip to San Diego around 1920, he purchased the slowly developing seaside tract of Neptunia. The acreage of the tract spread from La Jolla Boulevard to the sea and from Westbourne to the south and Sea

Lane to the north. The rugged sand dunes that ran throughout the area reminded Barber of a favorite vacation spot he frequented on Long Island, N.Y.; it was love at first sight. Barber’s daughter, Barbara Barber Stockton, who passed away in March 2009, recalls her very excited father telephoned her mother Mary, in Tenafly, N.J., and said, “Pack up the family, I’ve just purchased property in La Jolla, California.” The family arrived in La Jolla in 1921, and under Barber’s ownership, development of the Barber Tract began to take off as he sold small parcels of land with select, architect-designed homes on them. Many of the homes reflected the European revival styles that were gaining popularity throughout the country during this era. In 1923, Barber finished construction and moved his wife and four children (a fifth child, daughter Tootie, was born later) into a sprawling oceanfront Spanish Colonial home. The Depression in the 1930s slowed development of the area for a number of years and many of the homes were left vacant. Even Barber had to relinquish his beloved home and properties to creditors during this difficult time. Barber remained in La Jolla until 1946 and then moved to the Julian area. He passed away in 1963, followed in 1965 by his wife Mary. The home Barber built on Dunemere Drive remains today. The barren sand dunes that once surrounded the home have given way to a landscape filled with towering

trees, lush plantings and expansive lawns that gently roll down to the sandy beach below. The house itself has changed very little over the years and belonged to Academy Award-winning actor Cliff Robertson for more than 40 years. The home was historically designated as “Casa de la Paz — Historic Site #520” in 2002. Recently, new owners have purchased the one-of-a-kind historic estate. There is a true sense of an oldfashioned neighborhood in the Barber Tract. The Neighborhood Association sponsors events during most holidays. There is a Fourth of July parade, pancake breakfast at the beach around Memorial Day and a wonderful Christmas party at the French Normandy-style home that originally belonged to architect Ullrich. All of my neighbors seem to agree that the Barber Tract is a little piece of paradise by the sea.

Perhaps Benjamin Franklin said it best: “You don’t stop playing because you grow old… you grow old because you stop playing.” A perfect example of that philosophy was literally played out on the La Jolla Beach and Tennis Club’s courts from May 15 to 21 by a select group of amazingly agile women whose chronological age was from 90 to 100 years young, in both singles and doubles tournaments. This was the third year for these matches sanctified by the USTA, but only a year after the same category for men that was first sponsored in Palm Springs in May of 2003, at that time called the Super Seniors. As a matter of fact, Pat Yeomans, winner of the doubles team, and a computer whiz, compiled a list of two dozen women — mostly on the West Coast with its pleasant weather conditions but from as far away as Florida, Texas, Utah and Wisconsin — who might participate. She personally invited each one to join her and the six who did play in the local tournament. Several of these players also had recently entered the clay court tournaments in the Los Angeles area.

Playing has been paramount for most of these women forever, most beginning to compete in tournaments well over 75 years ago. Like the Energizer Bunny, they never seem to stop! Most of the oldest age group were within driving distance of this competition. Doubles winners were Tennis Hall of Famer Dodo Cheney, playing at age 93, our local star tennis player, partnering with Jean Harris, only 92, from Carmel. Their opponents were Yeomans also 92, an L.A. resident, who joined up with the young’un of the group, Mary Hill, traveling from Claremont. At 89, she needed to turn 90 this year, September to be exact. These four, although competing against each other, are best friends and stay each year at Cheney’s home, which just happens to be near the courts. Two other participants were Bea Greene, at age 94 the oldest participant, from San Jose, and Marge Broce, age 91, who lives in San Marcos. She was the oldest player against the youngest, Hill, with a score of 6-1, 6-3. Dressed in a pink-pleated lace skirt, Cheney spoke to TV and radio commentators before, during and after playing. The Bishop’s School boys lacrosse team finished regular season play with a 15-2 record, capturing the Coastal League crown with a perfect 10-0 record. “We have an outstanding senior class this year, and their leadership has largely been the reason for our success,” Bishop’s head coach Steve Sepata commented. Senior members are Jack Kelly, Nick Eggemeyer, Max Greenspan, Willy Chen, Mike D Jensen, Mike P Jensen, Alex Thiele, Zach Ostrup, Danny Organ and Trevor Gudim.

LeBron to host King’s Academy Camp at UCSD

The La Jolla High varsity baseball team wrapped up the regular season by dropping a couple of tough Western League matches against Mission Bay last week. The Vikings wasted a brilliant pitching performance by Patrick Christensen as they fell 2-1 in 10 innings. Christensen tossed nine innings, allowing only one run on four hits while striking out nine. Stephen Foster put La Jolla up 10 in the fifth inning on a basesloaded single. Mission Bay answered with one run in the sixth and won the game in the 10th inning. Sam Salom took the loss for

La Jolla. La Jolla rallied from a 5-0 deficit to tie the Buccaneers at 5-5 before succumbing 7-5 in the other contest. Jake Linsky pitched well in relief but suffered a tough-luck loss. Linsky also drove in the first two runs with a single up the middle in the fourth inning. Kyle Zimmer and Robbie Beathard each had two hits in the loss. Despite the two losses, the Vikings still qualified for the Division III playoffs. They opened on the road at Valley Center Tuesday, May 26, winning 8-3. “We are very excited to be returning to the postseason again

this year,” La Jolla High head coach Gary Frank remarked. “We hope to make the most of our opportunity. We’ve got the talent to go a long way in the playoffs; now it’s up to us to get the job done.” In other recent action, La Jolla Country Day (LJCD) School beat San Diego Jewish Academy 6-0 on a great pitching performance by senior Ben Cohn. Cohn scattered five hits over five scoreless innings, while Anthony Torres (sophomore) threw two scoreless innings of his own. Senior Ben Sweeney had two hits, and junior Derek Hatfield added his second home run of the season.

LJCD also lost a 7-6 decision in 10 innings to Canyon Crest. With the score knotted at 6-6, LJCD’s Ruben Pena (sophomore) pitched the Torreys out of a jam in the bottom of the seventh to keep the score tied and went on to pitch two more scoreless innings. Canyon Crest won the game with two outs in the bottom of the 10th. Jason Gilberg (junior) pitched six strong innings for LJCD, yielding only one earned run. Connor Gerhart (junior) and Sweeney each had three hits. Pena, Gilberg, Frankie Brown (sophomore) and Roman Valenzuela (freshman) each had two. Tritons team continues to surf swimmingly According to the powers that be, the University of California, San Diego (UCSD) has again risen to the top after a global website that specializes in surf reports named it the top surfing campus in the U.S. “The surfing community ranks the top ‘surfing school’ based upon the waves that are near the school, the local community, the school and the party life of the school,” said Marty Weinstein, captain of the surf team. “UCSD is number one because we have one of the best surf beach breaks around, aka Black’s Beach, which gets so damn good in the winter it’s hard to surf anywhere else.” Surfline.com did the ranking, which also included UC Santa Cruz, UC Santa Barbara and the University of Hawaii.
