What Are Elder Law and Special Needs Planning? Elder law and special needs planning involve preparing for expected and unexpected life circumstances, including the possibility of becoming incapacitated as well as protecting and providing for future needs of loved ones with disabilities.
At its core, Elder Law focuses on the unique needs of older persons and practice areas that address issues of concern for aging adults, adults with disabilities/incapacity, their families and caregivers. Unlike traditional estate planning, Elder Law begins by assisting you with issues associated with a long and healthy life, rather than simply planning for death. It mixes legal and practical issues such as being able to continue residing in your home if you have a chronic condition, having someone help in managing your finances, and not becoming a victim of financial abuse in the process. Elder law endeavors to help you solve the problem of not knowing what you don’t know. Special Needs Law focuses on solving legal problems for individuals with special needs and their caregivers. Although there is no uniform definition of “special needs,” the phrase describes individuals with a wide variety of physical or mental conditions who require assistance with personal care needs, activities of daily living, paying bills, managing finances, etc. These individuals
may be vulnerable to and need protection from exploitation or abuse, as well as access to public benefits or any number of other types of assistance. Frequently, parents and grandparents are concerned about how their children and grandchildren will be cared for upon the death of parents or grandparents and want to plan in advance to protect their special needs loved one. Elder Law and Special Needs Planning encompass many different fields of law, including, for example: isability planning, durable powers D of attorney, living trusts, advance directives, other tools to delegate management and decision-making to another in case of incompetency or incapacity n Estate planning, including the management of finances and assets during life and disposition on death using trusts, wills, and other instruments n Special/Supplemental Needs Trusts n Conservatorships and guardianships n Long-term care planning and placements n Trust and probate/estate administration n Elder abuse and financial exploitation n Medicaid planning n Retirement and Social Security planning n

ALZHEIMER’S/DEMENTIA CARE – Non-skilled care provided for clients with memory issues includes but not limited to establishing a routine, reminders for activities for daily living, rerouting if necessary and assistance with sleep issues or ‘sun downing’. By using creativity and caregiving skills, you can adapt routines and activities as needs change. BONDED – Being bonded means that a bonding company has secured money that is available to the consumer in the event they file a claim against the company. COMPANION/HOMEMAKER SERVICES – Refers to services provided by a companion to be with your family member for a specified amount of time each day up to and
including 24-hour supervision. The companions may provide assistance with routine household activities – cooking, cleaning, laundry, errands and shopping. Many agencies provide transportation and supervision to physician’s offices, grocery and clothing shopping as well as recreational activities. Companions are able to perform a wide variety of other non medical tasks and activities that are designed to assist the elderly to remain at home as long as possible. By law homemakers and companions cannot provide hands on personal care such as assistance with bathing, dressing, toileting, ambulating nor dispense medications for their clients.

Hospice Care Definitions continued more intensive nursing services are required. If an individual is at a care facility, room and board are covered by hospice during this period. CC-CONTINUOUS CARE – Provided to prevent the individual from going to the hospital when a crisis occurs. It also is given when more help is needed to assist the individual and family in coping with the crisis. This level of care is usually provided at the individual’s residence no matter where that may be. The criteria for continuous care may include: Severe pain or symptoms which are out of control, psychotic episodes, breakdown of caregiver, imminent death and family unable to cope. Continuous care is typically reserved for end of life or other crises that requires a constant presence by a nurse or care team. 24/7 ADMISSIONS – If a patient qualifies for hospice care, they should be admitted as early as the family requests. Many agencies admit patients to hospice, 24/7, evenings weekends, and holidays. GRIEF SUPPORT GROUPS – Grief is the normal and universal reaction

humans have to the loss of those they love. When your loved one passes, you may go through a period of bereavement and experience grief. Many provide Grief Groups that meet and address issues of grief in a supportive group setting. IN-PATIENT CARE – These hospices offer full hospice services in their on-campus unit or building. The patient moves into the inpatient care facility to receive their hospice services rather than in the patients’ home setting. PAIN PUMPS AVAILABLE – Many patients have their symptoms controlled through oral medications. Some situations require a pain pump where medications are administered through an IV pump. If this is the situation, inquire with the hospice RN case manager to see if pain pumps are available through their agency. PALLIATIVE CARE – Specialized medical care for people with serious illness. It is focused on providing patients with relief from the symptoms, pain and stress of a serious

Senior Housing Definitions AGE RESTRICTIONS – Some communities have a restriction on the youngest age they are allowed to accept. These restrictions vary by community. ALZHEIMER’S / DEMENTIA ASSISTED LIVING COMMUNITY – Licensed assisted living facility or skilled nursing facility that specialize in delivering care to victims of Alzheimer’s and dementia. Communities are typically bedroom-style rental units with common areas for dining and activities. Many are locked for residents’ safety.
ASSISTED LIVING COMMUNITY – Typically apartment-style with kitchenettes and private baths. Some offer companion accommodations. Personal assistance with Activities of Daily Living (ADLs) bathing, grooming, dressing, toileting, eating and ambulation. DAY CARE – Any provider can elect to provide day/night services on a short or long term basis. Rates typically include a place to rest, one or two meals and snacks and activities for the day.
