My Last Will and Testament Will Shield My Estate From Probate, Right? Perhaps…
A common misconception is that having a Last Will and Testament ensures assets avoid probate entirely. However, this isn’t entirely accurate. A Will serves as instructions for how your assets should be distributed after your death and designates a Personal Representative to oversee this distribution. Depending on the nature of your assets, not all will be governed by your Will, and some will still need to go through probate to be transferred to your beneficiaries. For instance, assets like bank accounts with joint owners or designated beneficiaries will automatically pass to those individuals, and not to those named in your Will. Similarly, real estate may require probate in order to transfer ownership as directed in the Will. Another circumstance that could impact distribution involves joint owners or specific legal factors such as marriage or minor children, which might disrupt your intended distribution plan. 45 Years of AAASWFL: Supporting SWFL Seniors
The Area Agency on Aging for Southwest Florida (AAASWFL) has served as the designated Aging and Disability Resource Center (ADRC) in SWFL for 45-years, serving: Charlotte, Collier, DeSoto, Hendry, Glades, Lee, and Sarasota Counties. AAASWFL’s Helpline, 866-413-5337, connects older adults, adults with disabilities, and caregivers with local resources for living safely and independently in their homes.
AAASWFL engages volunteers in Health & Wellness and SHINE (Serving Health Insurance Needs of Elders) initiatives. Trained volunteers lead free classes including low-impact exercise, Tai Chi, caregiver training and support, and
chronic disease self-management. Our SHINE program provides free, unbiased Medicare counseling and education, screening and application assistance for cost saving programs, and instruction in the prevention, detection, and reporting of Medicare fraud.
AAASWFL also administers state and federal funds for direct-care, long-term supportive services and screens clients for state and federally funded long-term care services to include case management and in-home services such as personal care assistance, chore assistance, respite, supplies, and home-delivered meals. Procrastination Can Lead to Tragic Results in Estate Planning
If you are like most of my clients, you’ve been thinking about putting together an estate plan but, keep putting it off.
My fortunate clients come and see me before a tragic event happens. However, all too often I get a call after a severe medical event happens or even a death of a spouse, and the right documents were not put in place before that tragic event. Keep in mind, without a Florida compliant power of attorney, you cannot handle your spouse’s affairs or sell jointly owned property. You then must go through the extensive time and expense of a guardianship which causes delays and added stress in an
already stressful situation.
Another tragic situation can occur in a second marriage where both parties have kids from a prior marriage and no Will or Trust is in place. Under Florida intestacy laws, children from a prior marriage get 50% of your assets when you pass with the other 50% going to your spouse. If your spouse needs those funds to survive, and your kids don’t like your spouse, I’ve seen devastatingly heartbreaking results.

How to Know When It’s Time to Move Your Parents to Senior Living
Unfortunately, in our society people often don’t want to address the challenges of aging until they absolutely have to. At Oasis Senior Advisors, we strongly advise you to be proactive, not reactive.
So how do you know when it’s time to act? Aging seniors tend to wear their pride on their sleeve, and they’ll do whatever they can to hide their frailties with you. Pay close attention when you talk to them or visit. Here are some signs that it’s time to consider bringing in home health care or looking at senior living communities:
• Isolation causing loneliness and possibly depression. Studies have shown that socialization and mental stimulation are key components to healthy aging. Moving to a senior living community is usually the best solution so they can make friends, socialize during meals, participate in activities with little effort, and become part of a community.
• Loss of driver’s license. This is such a difficult subject to broach, even when we know our loved one is not only endangering herself, but also the other drivers on the road. It becomes much easier to ask them to stop driving if you can offer a viable solution such as having a caregiver who drives or moving to a senior living community that provides transportation.
• Frequent falls. When an older adult falls, it can often mark the beginning of a great decline in physical condition and health status. Please do everything in your power to obtain assistance in the home or move them to a senior living community before a life changing fall happens!
• Drastic weight loss. Malnutrition in older adults often happens when he or she can no longer shop and/or prepare meals adequately.
• Increased forgetfulness or confusion. This is when it becomes critical to have a caregiver looking out for your loved one, either in the home or at a senior living community.
• You are spending an inordinate amount of time caring for your loved one. You might be going to their home to help them bathe, get dressed, or even use the toilet. It’s very stressful to have to give up so much of your own time, and it puts your loved ones in a situation that is often uncomfortable since your parent/child roles are now being reversed. It’s healthier to have a hired caregiver–either in the home or at a senior living community–performing these duties. This allows you to resume your role as the child or other caring relative. Remember you don’t have to go it alone. There are plenty of local resources including a network of Certified Senor Advisors® (CSAs ) such as myself who are here to help.

Original Medicare is a government health insurance program primarily for people age 65 and older. It has four main parts: A, B, C & D. The chart below is an example of how Parts A & B work together with a traditional Medicare supplement also known as a “Medigap Plan.”

• Health care services offered in the home may include:

HOMEMAKER/COMPANION SERVICES
Services provided by homemakers and companions include housekeeping, meals, shopping, and trips outside the home. These services can also be offered by a home health agency, nurse registry, or hospice.
HOME HEALTH AGENCIES
Home health agencies provide nursing care; physical, speech, occupational, respiratory and IV therapy; home health aide and homemaker/companion services; home medical equipment; nutritional guidance; and medical social services in the patient’s home or place of residence. These agencies are required to carry liability and
workers compensation insurance on all employees.
These employees are supervised and working under the direction of a licensed practitioner. These services can be paid for by Medicare, Medicaid, Long Term Care Insurance and private pay.

HOME MEDICAL EQUIPMENT PROVIDERS
Home medical equipment providers sell or rent home medical equipment and services for use in a patient’s home or place of residence. Equipment includes, though is not limited to, oxygen, respiratory equipment and customized wheelchairs. Services include delivery, set up, instruction and maintenance of equipment. A home health agency or hospice can also provide this service.
MEDICARE HOME HEALTH AGENCY:
If you have Medicare, you can use your home health benefits if you meet all the following conditions: You must be under the care of a doctor and you must be getting services under a plan of care established and reviewed regularly by a doctor. You must need, and
a doctor must certify that you need, one or more of the following: Intermittent skilled nursing care, physical therapy, speech-language, pathology services, continued occupational therapy. The home health agency caring for you must be approved by Medicare (Medicare-certified). You must be homebound, and a doctor must certify that you’re homebound. A person may leave home for medical treatment or short, infrequent absences for non-medical reasons, such as attending religious services. You can still get home health care if you attend adult day care, but you would get the home care services in your home. Eligibility is also based on the amount of services you need. If you meet the conditions above, Medicare pays for your covered home health services for as long as you’re eligible and your doctor certifies you need them.
HOME HEALTH AIDES/ASSISTANCE
ADL’S: Refers to persons specifically trained to help individuals with their personal care needs and activities of daily living (ADL’s). Activities of Daily Living are activities that reflect the client’s ability to perform tasks that are essential for self-care such as bathing, feeding oneself, dressing, toileting, transferring from a bed to a chair, etc. Other tasks may be assigned to aides per individual agency and family negotiations/contract. Home Health Aides are available for just a few hours per week up to 24-hour care on a temporary or long term basis.
PHYSICAL THERAPY (PT): Refers to assessing and treating large motor function, utilizing rehabilitative techniques of exercise, gait training, prosthetics, and heat to restore the client to his/ her highest functional level of strength, range of motion and mobility.
OCCUPATIONAL THERAPY (OT):
Assesses and treats small motor function. Utilizes rehabilitative techniques of exercise, splinting and assistive devices to increase the client’s ability to carry out normal daily activity such as feeding, dressing, grooming, and performing household tasks. Guides client through specialized regimes and encourages sensory and muscle return. Exercises and activities are used to increase upper body extremity function.
SPEECH THERAPY (ST): Assesses and treats speech and swallowing disorders. Provides individually designed treatment programs to maximize communicative effectiveness for the client, such as stroke, head injury, laryngectomy, voice disorders, as well as cognitive deficits.
SOCIAL WORKER: A clinical social worker whose purpose in health care is to enhance, promote, maintain, and restore the best possible social abilities of the patient or family. Services provided may be preventative, developmental, or remedial in nature.

ACTIVE ADULT RETIREMENT
COMMUNITY: Active adult communities offer independent, relatively maintenance-free living to residents aged 55 and over. In “age restricted” active adult communities, 80% of homeowners must be 55 and over, while “age-targeted” communities simply market to the 55+ crowd.
INDEPENDENT LIVING (IL):
Communities designed specifically for the aging adult to enhance quality of life and remain independent as long as possible. A community may offer annual rentals or month-to-month. Independent Communities provide residents with convenient access to dining & meal plans, entertainment and social activities, transportation, housekeeping & laundry, maintenance, wellness clinics, and access to third party medical services. Apartment styles vary and can include studios, one bedrooms, or two bedrooms. Communities offer amenities such as full kitchens, on-site pool, fitness center, walking paths, and more. These communities are NOT licensed to provide personal/nursing care.
SUPERVISED INDEPENDENT LIVING:
If you or your loved one may not need all the benefits of assisted living, then supervised independent living may be the right option for you. It’s the perfect bridge between being completely independent and not necessarily needing all of the care assisted living residents may need. Traditional independent options plus the option of adding ala carte personal care services as needed.
CCRC/LIFECARE: Continuing Care
Retirement Community otherwise known as Life Care, offers a campusstyle environment that may include villas, apartments or condos, assisted living, and skilled nursing services. A large endowment fee is usually required that entitles residents to use assisted or skilled services when needed throughout their lifetime. WHAT ARE ASSISTED LIVING COMMUNITIES?
Assisted living provides a combination of housing, personal care services, and health care designed to respond to individuals who need assistance with normal daily activities in a way that promotes maximum independence. Services include, but are not limited to:
• Nutritional meals and special diets
• Supervision and assistance with personal care (bathing, dressing, grooming, toileting, transfers, and eating)
• Health monitoring
• Assistance with self-administration of medications
• Arrange for health care and mental health services
• Provide or arrange for transportation to medical appointments
• Housekeeping and Laundry services
• Daily social and leisure activities
• Supervise residents with dementia and/or cognitive impairments
• Provide or arrange for rehabilitative services
• Provide escort services to medical appointments
• Educational programs to promote health and prevent illness
TYPES OF ASSISTED LIVING COMMUNITY LICENSES:
There are four types of assisted living licenses. A community must have a standard assisted living community license in order to operate in the state of Florida. The other four licenses can be added in order for the community to provide services designated outside the spectrum of a standard assisted living community license.
STANDARD LICENSE: A residential community that provides direct physical assistance with or the supervision of activities of daily living, assistance with medication(s) and other similar services.
LIMITED NURSING SERVICES
(LNS) LICENSE: An assisted living community with a LNS license provides the same services as a Standard License Community as well as nursing services provided by licensed nurses within the scope of their nursing practice. The resident would still need to meet admission and continued residency criteria. LNS services include but are not limited to:
• Nursing assessments
• Administration of medications
• Measurement and recording of vital signs and weight
• Dietary management, including special diets, monitoring nutrition, food, and fluid intake
• Diabetes management, oxygen administration, and wound care
EXTENDED CONGREGATE CARE
(ECC) LICENSE: An assisted living community with an ECC license allows a resident to age in place. In addition to LNS services, ECC communitites provide:
• Total help with bathing, dressing, grooming and toileting
• Assistance with (non-nasogastric) tube feeding
LIMITED MENTAL HEALTH LICENSE:
An assisted living community that serves three or more mental health residents. The basic services of assisted living are provided to the resident. In addition to these services, LMH license provides mental heatlh services to support the individual.
MEMORY CARE: These are licensed assisted living communities that specialize in delivering care to residents suffering from a cognitive impairment. These include but are not limited to: mild cognitive impairment, dementia and Alzheimer’s. Communities are secure for residents’ safety and provide 24-hour supervised care. The same license rules apply as assisted living. Staff members are trained for the special needs of this population.
SHORT TERM/RESPITE CARE:
Circumstances require a caregiver to seek temporary senior housing for
your loved one. Knowing they can move seamlessly into an emergency care environment that supports the wellness needs of seniors allows peace of mind when you are called away for business or vacation, or if you just need a short break from caregiving.
ACTIVITIES OF DAILY LIVING (ADLs):
Define the personal care services available in assisted living and include bathing, dressing, grooming, bathroom assistance, eating and ambulation. Medication Administration and transferring are not ADLs but are factors in determining a person’s level of functioning.
ADULT DAY STAY PROGRAMS:
There are two general types of adult day care programs. One is based on a medical model and the other on a social model. The medical model provides comprehensive medical, therapeutic, and rehabilitation day treatment. The social model offers supervised activities, peer support, companionship, and recreation. Both models assist older adults and those with chronic conditions to remain as independent as possible, for as long as possible.
ASSISTED LIVING MEDICAID WAIVER
The waiver is available to people who are 60 or older who qualify for Medicaid and are eligible under SSI, MEDS-AD, or ICP. The waiver program does not cover the entire bill in a assisted living community.

SKILLED NURSING DEFINITIONS
SKILLED NURSING COMMUNITY
(SNF): This level of care is typically found in a nursing center or a transitional care unit in a hospital. Daily rates typically include a furnished bedroom & a private or shared bath, meals, activities, transportation, phone service, cable television and all personal/nursing care. Payor sources usually accepted are Medicare, Medicaid, VA, some insurance plans & private sources.
METHODS OF PAYMENT: Not all nursing homes accept all forms of payments. Furthermore, some nursing homes are limited in the number of beds available for a particular payment form.
MEDICARE: Medicare is a Federal program that serves people 65 and older and those with certain disabilities, regardless of income. Qualified individuals are automatically enrolled in Medicare Part A, but must apply to become eligible for Part B coverage. Medicare generally pays for the first twenty days in a nursing home following a hospital stay of at least three days. Medicare generally pays a portion of the nursing home bill (after the first 20 days) for up to 100 days per year.
MEDICAID: Medicaid is a stateadministered medical assistance program that serves low-income families, those 65 and older, people
who are blind, and people who are disabled. You must apply and qualify for Medicaid before you are eligible for Medicaid coverage. Schedule an appointment with your local Department of Children and Family Services’ Medicaid Eligibility office to determine if you are financially eligible for Medicaid. Applicants must demonstrate that assets and income are below a maximum level, as well as other criteria in order to be eligible. Medicaid applicants must also meet medical eligibility for nursing home placement.

The surgeon inserts a tube into the opening to bypass an obstruction, allow air to get to the lungs, or remove secretions.
