TheJusticeforRentersActisbeing spearheadedbyMichaelWeinstein, whomyouprobablyrememberfrom hispreviouslyunsuccessfulattackson theCosta-HawkinsAct.Weinstein emphasizedtheurgencyofaddressing

Unfortunately,tenantsoftenregarda housingservicethatcannotbesevered withoutjustcause.(Asapracticalmatter, thebalanceofrightsandobligationsbetweenlandlordandtenanttendtoratchet inonlyonedirection.)

Thatsaid,youdidonlygivepermission gratuitously,inthecontextofapandemic andnotinexchangeforadditionalconsideration.Additionally,thetenanthas nowviolatedthespiritofthisgiftbyneglectingitandcreatinganuisance,which wouldpotentiallygiveyoujustcauseto “sever”thehousingserviceintheeventof adispute.

ThehouseisagreatexampleofVictomanyyears,itstoodastheonlyremainingVictorianonFranklinStreet.Records tellusMaxandhiswife,Theresa,owned thehouseuntil1930.Then,theFirst BaptistChurchofSanFranciscoretained ownershipuntil1991.

From1991onward,thehousechanged handsmanytimes,andunfortunately, noneoftheownerswereabletobringthe housebacktolife.Justafewyearsago,it satvacantanddilapidated.

You’reprobablymostfamiliarwiththe EnglanderHousefromrecentnews,when itssix-blockmovefromitsoriginaladlocationof635FultonStreetwasfollowed bylocalsandthemedia.

ThehistoricEnglanderHousewasliterallymoved.Sixwholeblocks,tobeexact. Thehome’smostrecentowner,whois alocalrealestatebrokeranddeveloper, paidcloseto$800,000inmovingcosts andfeestorelocatethehousein2021.
