After the finger-slamming episode, Whitter suffered a nervous breakdown and was admitted to a Jackson Health System mental health treatment center, the suit states. When she was released three days later, Whitter received a message to call Publix and was told she was fired. The lawsuit states that Whitter suffers severe emotional distress over the discriminatory treatment, has suicidal thoughts and has been diagnosed with severe depression. The suit follows a landmark 6-3 decision in June by the United States Supreme Court that Title VII of the Civil Rights Act of 1964, which prohibits employment discrimination

based on race, religion, national origin and sex, also protects gay and transgender workers. Before the June 2020 decision, it was legal in more than half of the states, including Florida, to fire workers for being gay, bisexual or transgender. Whitter filed the suit after filing a discrimination charge with the Equal Employment Opportunity Commission and the Florida Commission on Human Relations in June 2019, and within 90 days of receiving a “Notice of Right to Sue” from the EEOC. The lawsuit alleges that Publix violated protections against disability discrimination, hostile work environment and retaliation guaranteed by Title VII of the federal Civil Rights Act and Florida’s Civil Rights Act.

US CHRISTIAN GROUPS SPEND MILLIONS IN AFRICA TO STOP LGBT PROGRESS

LGBT EMPLOYEES IN JAPAN STAY IN THE CLOSET

The results of a new investigation by openDemocracy published at the end of October show over 20 Christian groups based in the U.S. have spent more than $50 million in Africa since 2007. These Christain groups have a reputation for working against LGBT rights, reproductive rights, sexual education and contraception, according to openDemocracy. Between 2007 and 2018, the biggest spender against LGBT rights on the continent has been the Billy Graham Evangelistic Association, with a total of $7,554,764. Other groups working against LGBT rights include Human Life International and Focus on the Family. They’ve spent $4,133,502 and $1,936,130, respectively, in Africa between 2007 and 2018,

according to openDemocracy. “These groups explicitly state their opposition to LGBT rights [including same-sex marriage, prohibitions on employment discrimination based on gender identity or sexual orientation, and prohibitions on so-called ‘conversion therapy’ or ‘reparative therapy’ that seeks to ‘correct’ queer people],” acording to the openDemocracy website.

Less than 1 in 5 of the Japanese LGBT people are out at work, according to a recent study. The study conducted by Au Jibun Bank in Japan took a look at the working environment for the LGBT community, and revealed that less than 1 in 5 of the Japanese LGBT people surveyed were out. The study gathered data from 1,000 people: 500 LGBT and 500 non-LGBT, according to a press release. Of the 500 members of Japan’s LGBT community surveyed, just 17.6% were out. The survey also analyzed the support systems available in corporate Japan. Of the 1,000 surveyed, 22.7% said that the company they work for has a cooperative system or initiative for LGBT

Common support systems named by those surveyed include congratulatory money and bereavement leave for samesex partners, training to learn about the LGBT community, participation or sponsorship of LGBT events and clear discrimination prohibition, according to the release.

UK SUPREME COURT RULES AGAINST TRANS DAD

PLAYBOY MÉXICO TO FEATURE FIRST TRANS WOMAN ON COVER

In the UK, 34-year-old transgender man Freddy McConnell lost a legal battle to be registered as his child’s father on Monday, after a UK supreme court decision, the Guardian reported. McConnell, a freelance reporter who works for the Guardian, began to transition through testosterone therapy in 2013 and 2014, and received a double mastectomy. He gave birth in 2018 after suspending hormone treatment, according to the article. The high court ruled in September of 2019 that McConnell could not appear as the “father” on the birth certificate. An appeal court came to the same ruling in April of 2020. The appeal court ruled in favor of the right of a child of a transgender parent to know the biological reality of the

Playboy México will feature the first transgender woman on the cover of its November / December issue, according to the Playboy website. Victoria Volkóva, 27, was born in Querétaro in central Mexico, NBC News reported. She spoke about her journey as a transgender woman in an instagram post. “I long hated my body and hated being a trans woman, as I thought that was what made me a less valuable person, less worthy of love, less ‘normal,’” Volkóva wrote in the post. “But then I learned that the one that had to be accepted was myself before demanding that others accept me, because when you accept you first you stop mind what others think of you.” Volkóva has over 900,000 Instagram

INDIVIDUALS MUST BE A PART OF THE CHANGE The panelists discussed the importance of donations and activism within the LGBT community in order for there to be sustainable change. They suggested using the media to spread the word. Media can be used to amplify messages members of the panel noted. They stressed the importance of individual responsibility to take action for a common goal. They suggested donating, volunteering, and mentoring as some of the ways people could help. Each panelist then took an opportunity to discuss what their own organizations would be doing for the community in the aforementioned areas. BIG BUSINESS AND LGBT RIGHTS Suffredini spoke about how big businesses have been immensely helpful over the years for the LGBT community. Having large companies’ support adds credibility to the cause being presented to the government. He touched on how having business leaders’

support can lead to more support for the movement at a local level as well. Suffredini explained the idea that people are more compelled to show support for a cause when big businesses also back it. He said that he hopes the business support will continue and increase as the years go on. ‘PEOPLE NOT POLITICS’ A difficult question was presented to the panelists when a young student’s video was shown asking about what the panelists could do to make transgender students more comfortable in their transition in the public school system. Parker tackled the question by asking another question: “What can YOU do?” She explained that individuals have to work together to make changes in schools. Organizations can only do so much if the students within the institutions aren’t banding together. Parker suggested that allies and LGBT students make an effort to include everyone. The forum ended on a reflection of the discussion. Smith described the forum as having a dose of reality within it and that the issues were not looked at with rose-colored glasses. Suffredini said, “At the end of the day, we get movement when we make issues about people, not politics.”

SCHOOL FOR TRANSGENDER STUDENTS OPENS IN BANGLADESH Bangladesh has opened its first school exclusively for transgender people in Dhaka. The school will focus on teaching Islamic values to its students. It is privately funded and free of charge to students. The school is not limited to age either. As long as the student is transgender, they can attend the institution regardless of their age. The school is mirrored after traditional all-girls schools or allboys schools. In 2018, Bangladesh created a new amendment identifying transgender as a third gender. According to a new student at the school, most of the trans community were illiterate. The new school gives trans people an opportunity to become educated and advance in society with more ease.

NEWS NATIONAL

SUPREME SCARE WILL HIGH COURT RE-WRITE RULES ON ADOPTION, DISCRIMINATION?

With the confirmation of Amy Coney Barrett, Conservatives now have a clear majority on the Supreme Court Lisa Keen

Keen News Service

A

n important oral argument at the U.S. Supreme Court this month went largely overlooked because of the nation’s nearly complete fixation on the outcome of the 2020 presidential election. But statements and questions by some conservative justices during that argument — coupled with the new solid majority conservatives have on the court — have left LGBT legal activists feeling a bit unnerved. Among other things, two justices claimed that the court’s 2015 ruling striking down state bans on same-sex marriage made “promises” that future Supreme Court decisions would show “respect for religious beliefs” hostile to same-sex marriages. The two-hour hearing Nov. 4 in Fulton v. Philadelphia is the latest in a long line of lawsuits that have attempted to secure an exemption for some people and businesses to laws prohibiting discrimination based on sexual orientation and gender identity. Those arguing for the exemptions claim that requiring they obey the non-discrimination laws violates their First Amendment freedom to exercise of their religious beliefs that they should discriminate against LGBT people. Opponents of such arguments say people and businesses have a First Amendment right to believe what they want, but if they voluntarily operate in the public arena, they must abide by laws governing the public, including laws prohibiting discrimination based on sexual orientation and gender identity. In Fulton, the city of Philadelphia discovered that one of its contractors performing foster care placement services had a policy of denying consideration of

same-sex couples to serve as foster parents. That contractor, Catholic Social Services (CSS), acknowledged it had such a policy but said no same-sex couple had ever approached it so it couldn’t be accused of discrimination. When its contract with the city came up for renewal, the city declined to renew it, saying CSS was in violation with the contract’s stipulation that contractees comply with laws prohibiting discrimination on the basis of numerous factors, including sexual orientation. The Becket Fund for Religious Liberty filed a lawsuit for CSS and two parents who had served as CSS foster parents, including Sharonell Fulton. They lost in the district court and in the Third Circuit U.S. Court of Appeals. The three-judge panel at the Third Circuit, which included a Reagan appointee, said the “city’s non-discrimination policyis a neutral, generally applicable law, and the religiousviews of CSS do not entitleit to an exception fromthatpolicy.” CSS then appealed to the U.S. Supreme Court.

ROBERTS AND GORSUCH HAVE, SO FAR, ESTABLISHED MODERATE RECORDS ON LGBTQ ISSUES BEFORE THE COURT.

THE SIGNS OF MODERATION At the very top of oral arguments (which can be heard or read at the Supreme Court’s website), Chief Justice John Roberts Jr. struck

a note that many LGBT people would probably take as a good sign. He referred to the Supreme Court’s 5 to 4 decision in Obergefell v. Hodges, striking down state bans on marriage for same-sex couples. The Fulton case, he said, “is a case involving free exercise rights, but …they’re in tension with another set of rights, those recognized in our decision inObergefell. And whatever you think or however you think that tension should be resolved as a matter of government regulation, shouldn’t the city get to strike the balance as it wishes when it comes to setting conditions for participating in … its foster program?” Justice Neil Gorsuch also challenged CSS attorney Lori Windham, noting “the city seems to be representing to us … that the [non-discrimination ordinance] is binding of its own force and that the department can’t offer any exemptions.” Later, to the Trump administration’s Deputy Assistant Attorney General Hashim Mooppan, he asked, “What do we do with the Fair Practices Ordinance and the argument by the city — and we normally

take their representations about their law with — with some respect — that the Fair Practices Ordinance applies by its own force and that there are no exemptions here?” Roberts and Gorsuch have, so far, established moderate records on LGBT issues before the court. THE CONSERVATIVE ATTACK But the established conservatives on the bench seemed eager to score points as such. Justice Samuel Alito was blunt about where he stands, saying, “If we are honest about what’s really going on here, it’s not about ensuring that same-sex couples in Philadelphia have the opportunity to be foster parents. “It’s the fact that the city can’t stand the message that Catholic Social Services and the Archdiocese are sending by continuing to adhere to the old-fashioned view about marriage,” said Alito, who is Catholic. “Isn’t that the case?” “Absolutely not,” said Neal Katyal, the attorney representing Philadelphia. He

for our community and other marginalized groups.” As an example, Minter noted that Barrett asked Katyal a question about the nature of the relationship between Philadelphia and the CSS — whether it was a government giving a contract or a government regulating a service through granting license. A government awarding contracts could, presumably, have great leeway in deciding the criteria it seeks in potential contractees who would be doing specified work on the city’s behalf. Regulating a field of service, through awarding of a license, would enable the government to set certain standards but would dictate the operation of the licensee. Barrett asked Katyal, “Is it possible for any entity to participate in the recruitment and certification of foster families without a contract from the city?” Katyal said no, not when it comes to selecting “who cares for the kids in city custody.” “The whole point of the modern foster care system,” he said, “is to bring responsibility for those kids inside the government and not leave it into private hands. These are wards of the state, and the city has the highest interest in screening parents.” “When someone is licensed — like to practice law or run a barber shop,” said Katyal, “they are not carrying out the government’s work. They’re performing their own work, a private profession, with the permission of the government.” The relationship between Philadelphia and CSS, said Katyal, was not

like licensing a business but about performing work for the city to care for children who are wards of the state. But what if the city took over all hospitals, asked Barrett, and granted contracts to operate them. And what if the city gave a contract to a Catholic entity to run one a hospital that had previously been a “Catholic hospital.” And what if the city said every hospital “has to perform abortions,” she asked. “Do we still say this is a licensing question or, given that the Catholic hospital can’t even enter the business without this contract, do you still say this was the provision of a contractual service?” asked Barrett. Katyal was not given time to answer Barrett’s hypothetical fully, but he pointed out a couple of key differences between Barrett’s hypothetical and CSS. He noted, for instance, that CSS still receives $26 million a year from Philadelphia to run homes for children, so it can’t be said that the city is putting CSS out of the business of foster care. What troubled NCLR’s Minter was Barrett’s “apparent endorsement of the idea that the city of Philadelphia is not contracting with Catholic Charities to perform governmental services but rather ‘licensing’ them,” which limits the government’s power to enforce its nondiscrimination protections. “If the court were to adopt that view,” said Minter, “it would work a radical change in the law governing governmental services and open the door to unprecedented governmentfunded discrimination.”

LIFESTYLE TWO GUYS AND A DOG

THE PEOPLE WE LOVE TO HATE Brian McNaught

Photo via PxHere.

S

ome people, and some groups, seem to beg you to hate them. And, it’s easy to do. Saying we hate a person, or a group, allows us to dismiss them, like Glinda did to the Wicked Witch of the West. “Be gone, you have no power here.” Out of sight, out of mind. Once dismissed, we don’t have to give the people we hate another thought. If they’re in a group, they’re all the same. They’re the enemy, such as Trump, Nazis, the KKK, gay Republicans, Born Again Christians, child molesters, Trump voters, axe murderers, The Salvation Army, Scientologists, the Taliban, straight white men, the NRA, Mitch McConnell, etc. Don’t let the door hit you on your way out of my heart, mind, and soul. And yet, and yet, many of us are inspired by the teachings of a man who told us to forgive people as so much as 70 times seven, which means always. “Forgive them? They haven’t asked for forgiveness. The hell with that,” we say. “They’re all evil, I hope they die, and I want nothing more to do with them.” Hate is easy peasy. Except, when it’s not. Take for example, a residential drug and alcohol facility for, among others, furloughed convicts, many with psychiatric problems. Their everyday dialogue is described by one staff person as “rude, crude, and lewd,” filled with homophobia and racism. Recently, a bisexual staff counselor came out to her small group session, telling the men that she wouldn’t tolerate any more of their anti-gay or anti-Black talk. Word got back to the facility’s executive director, who immediately wrote to compliment and thank the counselor for speaking up. The boss was thrilled the issue was being dealt with so openly and firmly. Likewise, another staff person wrote to the counselor, saying, “I want to express to you my sincere gratitude and appreciation for addressing the problem of gay slurs and homophobia with the men in the Friday morning group session. I heard about it from a client who was very appreciative of your actions … Addressing the problem of gay slurs and homophobia … may run some risk of criticism and attack, especially from some of our more ‘macho’ minded clients. The benefit, however, is helping our GLBTQ clients to feel safer, accepted, valued, and respected as they seek to work through whatever substance abuse or mental health issues they may be facing in life.” The bisexual counselor replied, “I appreciate your kind words. I did get some pushback in group, but I just know what is right, and what is wrong, and all of the ‘jokes’ felt so wrong. I asked the guys in group on two separate occasions to think about how their jokes would make someone who identified as GLBTQ feel. It shut the slurs and joking down temporarily. Finally, I banned it completely from my groups because it kept

IT’S EASIER THAT WAY, AT LEAST FOR US, BECAUSE WE DON’T HAVE TO GIVE IT MUCH THOUGHT.

coming up, and I was just tired of it. It was too much for me to hear because I found zero humor in the talks whatsoever. “I have also asked that they do not use the N-word in my group or in my presence. We have an African American group member, and I couldn’t believe I heard the N-word being thrown around like it was nothing. That word is no longer used in my groups either.” She added, “I identify as bisexual, and every time these derogatory, hurtful-to-the-core sayings are used in group, my heart starts to beat faster and louder. I feel tension rising within, but I never want to be the type of group facilitator that pushes my personal agenda onto the class. “The feelings I had reminded me of high school where I saw several popular boys picking on a gay male classmate. Of course, at that time, I didn’t feel I had a voice, as a freshman, to stop the hate that I saw. Today, I am a grown woman, and I can stop it during the groups that I facilitate. Although, I ‘came out’ to the group that day, I knew that it was wrong what they were doing from the first ‘joke.’ I asked the guys if in jail they talked in the manner that they were talking in my group about this topic. They stated that the men who were gay or bisexual … enjoyed the ‘banter’ and the ‘jokes’ because

they laughed along with them. I took this time to share that although others may laugh with them, it ultimately is not coming from funny laughter, but from uncomfortable laughter most likely. I further shared that what they were doing was not only hurtful, but in other systems would be considered cause for serious concern.” What does this great example of the power of standing up for yourself, and for others, at work, and in life, have to do with the topic of “hate,” other than we hate straight male prisoners who bully LGBT and queer people? But what about our hate of The Salvation Army? We still hate The Salvation Army, right? They’re homophobic, or maybe not. This incident happened at a Salvation Army alcohol and drug rehabilitation facility. The executive director, who recently recommended the promotion of an openly gay employee, and who wrote to compliment and thank the bisexual counselor, reports directly to The Salvation Army. The staff person who thanked the counselor, and who emailed to tell me what happened, is an officer in The Salvation Army. OK, so maybe we don’t hate those members and employees of The Salvation Army, but we hate everyone else in the group. It’s easier that way, at least for us, because we don’t have to give it much thought. They’re all the same. Or, are they?

encompass the entire human experience of HIV/AIDS. “HIV/AIDS is a complicated and multifaceted focus of attention with a rich tapestry and history,” explained Schneier. “I am extraordinarily honored and humbled to be a vehicle for this ongoing story. My hope is that guests find the paintings as moving and relevant as I did when painting them.” “The Colors of AIDS” will remain on display through Dec. 21. In addition to reopening, WAM will kick off World AIDS Day with “Rock the Ribbon” on Tuesday, Dec. 1 at 8:30 a.m. Hosted by The Galleria at Fort Lauderdale, the new event will feature original Styx rock band member Chuck Panozzo and “The Voice” contestant Laura Vivas. The Fort Lauderdale Gay Men’s Chorus will also perform in the socially distanced, outdoor event. WAM Executive Director Requel Lopes said, “World AIDS Day remains as relevant today as it’s always been, reminding people and governments that HIV has not gone away. There is still a critical need for increased funding for the AIDS response, to increase awareness of the impact of HIV on people’s lives, to end stigma and discrimination and to improve the quality of life of people living with HIV.”

HOLIDAY MOVIES GO GAY FOR 2020 J.W. Arnold

I

f you tune in to Lifetime or the Hallmark Channel during their annual holiday movie marathons leading up to Christmas, then you’ve probably already figured out the formula (swapping out the variables): Burned out (marketing exec/writer/photographer) is stranded in a (small mountain village/ charming inn/family homestead) where she meets a (handsome single father/brooding handyman/prince of obscure European nation) and rediscovers the spirit of Christmas. They’re all pretty campy, usually filmed in Canada (and when they aren’t, snow is sprayed on the green leafy trees and lawns of Southern California) and feature rotating casts of unknown D-list actors, with the exception former child star Candace Cameron Bure (“Full House”) whose career has since been resurrected. Only recently, with the entry of Netflix and other network competitors, have Lifetime and Hallmark embraced diversity. Minority and interracial couples gradually were added to the snow-white mix and — finally in 2020 — the wholesome, family-friendly genre will feature LGBT lead characters. Hallmark Channel is first with “The Christmas House,” premiering on Nov. 22, and featuring “Mean Girls” star Jonathan Bennett, along with Robert Buckley (“One Tree Hill”), Ana Ayora (“In the Dark”), Treat Williams, Sharon Lawrence and Brad Harder. According to Hallmark’s synopsis: “Working through some difficult decisions, Mitchell family matriarch Phylis (Lawrence) and patriarch Bill (Williams), have summoned their two grown sons — Mike (Buckley) and Brandon (Bennett) — home for the holidays. It is their hope that bringing the family together to recreate the Christmas house will help them find resolution and make a memorable holiday

for the entire family and community. As Brandon and his husband, Jake (Harder), make the trip home, they are anxiously awaiting a call about the adoption of their first child. Meanwhile, Mike reconnects with Andi (Ayora), his high school sweetheart.” Lifetime’s entry, “The Christmas Setup,” debuting on Dec. 12, features real-life husbands Blake Lee (“Parks and Recreation”) and Ben Lewis (“Arrow,” “The Handmaid’s Tale”) and gay icon Fran Drescher (“The Nanny”). Hugo (Lewis), a New York City lawyer, goes to Milwaukee with his best friend, Madelyn (Ellen Wong) to spend Christmas with his mom, Kate (Drescher), a meddling matchmaker who also organizes the local holiday festivities. Kate arranges for him to run into his old crush Patrick (Lee), who’s home from his high-powered job in Silicon Valley. As the romance appears to be taking off, a wrench is thrown into the works when Hugo is offered a job in London. MTV Studios/Paramount TV will simulcast their inaugural gay Christmas rom-com, “Dashing in December,” on Logo, Pop and TV Land on Dec. 13. This one is full of “Brokeback Mountain” vibes (with a happier ending): “Wyatt (Peter Porte), a New York City financier, connects with his roots and a handsome ranch hand on his mom’s ranch/ Winter Wonderland attraction when he returns home for the holidays to try to convince her to sell the place. While visiting his mother, Deb (Andie MacDowell), Wyatt meets Heath (Juan Pablo Di Pace) and the attraction is palpable.” If the stories still seem familiar, they should, because the studios stuck to the tried-and-true holiday formula that has appealed to gays and straights alike for more than a decade. These movies are just a little more heartwarming as LGBT representation finally gets stuffed in the Christmas stocking.
