Blue Martini Accused of Transgender Discrimination

M

ichael O’Brien, a 40-yearold esthetician student, and fourth generation Fort Lauderdale native went out with his partner to meet friends at Blue Martini in their Galleria Mall location this past week. Michael, describes himself as carrying a mixture of masculine and feminine attributes. This also extends to fashion choices, which he does not follow according to what is deemed gender normative. “I was wearing men’s clothes,” said O’Brien. “Yet, I was carrying my purse and wearing my sandals. The security guards looked at me funny, and rolled their eyes.” The sandals were men’s, which revealed a pedicure of clean, neat, red toenails.

O’Brien was told no shorts, and no sandals after 8 p.m. or else no entry. However, O’Brien watched as women wearing sandals or open-toed shoes were allowed entry into the venue. “Clearly,” said O’Brien. “They have a basis of gender discrimination in terms of dress code. Both the doorman and the manager came out to talk to me. They brought up lawyers first,” in an attempt to intimidate him. “To which I countered, the LGBT community has plenty of lawyers!” Eventually, O’Brien was admitted access to the club. However, they admitted him without an apology and made him feel as if they were, “doing me a favor by letting me in that night,” said O’Brien from his home in Northeast Fort Lauderdale. Once he entered he expected to see the men all neatly dressed with proper shoes and slacks. However, he found many men in sandals and casual attire. Their position is that the happy hour crowd is often more casual, and while they cannot kick out those that came in earlier they can deny entry to people in the evening when the cress code is – supposedly – more strictly enforced. Nikki Hatch, a 57-year-old postoperative trans woman typically goes to the Blue Martini’s Boca Raton location to sip a glass of wine and listen to the band.

“I typically go to the Blue Martini in Boca and they are always very nice and welcoming to me,” said Hatch. “Yet, a couple of years ago I was actually asked to leave by one of the waiters. I was sitting by myself when some idiot came up and whispered to me to leave. I asked ‘Why?’ and never got a reply other than ‘You just need to leave.’ I told him that I would leave when I was good and ready.This, of course, was before Broward County passed Gender Protections Ordinance.” Hatch had another experience with a rude bartender and she complained to the manager, who was very apologetic about the situation. “Honestly,” said Hatch. “That was really the only two times out of several times going there that I had any problems.” The LGBT community knows when to fight their battles, and Hatch is honest in admitting the second incident might have just been a case of rude – not gender-specific discrimination. “I heard of a couple of others,” who present as women in public, “who were asked for their ID and were told their presentation did not match their photo ID, pretty slick,” said Hatch. “Not sure if they are still pulling that stunt.” Blue Martini Fort Lauderdale directed me to their corporate office. After defending the official position of Blue Martini in terms of dress code as it related to O’Brien’s case – namely that women are allowed to wear sandals, not a person who expresses themselves across gender lines – and apologizing for any possible blatant discrimination in Hatch’s case, the representatives sharply refused to give me their names. They then quickly said I was not given permission to quote, which is odd considering they were so eager to defend Blue Martini. Furthermore, they stated that Blue Martini “does not wish to appear in your paper” and that Blue Martini has “no comment.”

Florida:

Won’t Enforce Adoption Ban

lorida Governor Charlie Crist (I) and George Sheldon, head of the state’s Department of Children and Families (DCF), said on September 22 that they would no longer enforce the state ban on adoption by gay men and lesbians. The announcements came Wednesday after a state appeals court upheld a trial court decision that found the ban unconstitutional. The appeals court said that Frank Martin Gill, a gay man, has the right to adopt the two boys he and his partner have raised for almost six years. But it remains an open question whether the state will appeal the case. Gill issued a statement Thursday through the ACLU of Florida, which is representing him, saying, “I understand that the Governor would like to hear my views in considering whether to appeal the decision . . . . After considerable thought and consultation with my attorneys at the ACLU, it is my hope that the State will not appeal and the case will stop here.” Leslie Cooper, senior attorney with the national ACLU’s LGBT Project, said that if the state decides not to appeal, the state appeals court decision will be binding on trial courts statewide and “will allow lesbians and gay

men who are interested in adopting—no matter where they live in the State—to apply and be evaluated under the same criteria applied to everyone else.” “This is precisely what our litigation has sought to achieve,” said Cooper. If the state does appeals, Cooper said, “we’re confident that the Florida Supreme Court will reach the same result as the Third District Court of Appeal.” The state Department of Children and Families (DCF) opposed Gill in the case but is now giving the decision “a thorough review,” said Communications Director Joe Follick. “The primary consideration on whether to appeal,” said Follick, “is finding the balance between the value of a final ruling from the Florida Supreme Court versus the impact on the Gill family.” Follick noted that DCF plans to make a decision before its 30-day deadline. Florida Attorney General Bill McCollum issued a statement through his communications director, saying the attorney general’s office would be “discussing” with DCF whether or not to appeal today's ruling. But DCF Secretary Sheldon said on September 20 that the state would not remove the two boys from Gill’s home even if the state Supreme Court decided to uphold the ban. And Governor Crist, who is now running for the U.S. Senate, told reporters at a news conference Wednesday that he wanted to meet with Gill before deciding whether to appeal. As governor, he could order the DCF to do so. Crist’s position on LGBT issues has shifted recently. On September 12, he announced his support for a range of civil rights for LGBT people, including adoption. Even if there is no appeal, a hypothetical conflicting decision in another appellate court could limit the Third District’s ruling to just the Third District, not the whole state. continued on page 25

Pride Center Hosts First ‘In The Know’ Expo

T

his Saturday, the Pride Center at Equality Park was host to the first “In the Know” Expo, what we hope will be part of a series of such gatherings. Representatives from IAPAC, the Broward Heath Department, Tibotec Pharmaceuticals, Walgreens Drug Stores, Holy Cross Hospital, AHF Pharmacies and many others came together to bridge the gap between LGBT persons and healthcare knowledge. Speakers at the expo included Paula Thaqi, Director of the Broward County Health Department; Joan Holloway, Vice President, Global Health Initiatives; Cynthia Peterson, Executive Vice President, Broward County Medical Association and Donn Rubin, Broad Member, Pride Center at Equality Park. At this expo, you could speak to doctors and healthcare providers, you could be screened for diabetes, HIV, Hepatitis A/B, pregnancy or you could just drop by for the plethora of male and female condoms, vaccines or take part in the needle exchange. The Association of Nurses in Aids Care was available to discuss membership with healthcare professionals and provide a look at their comprehensive journal. The Pride Center provided information about their many community programs, and Covenant House, Broward House and Shadowood II Inc. were on hand to discuss housing issues with those in need as well. SFGN spoke with representatives from the Florida Department of Health and IAPAC, the International Association of Physicians in Aids Care. According to Joan Holloway and Christopher Gibbs of IAPAC, the expo was the beginning of a larger outreach to minority and at-risk persons nationwide urged on by the Federal Government after the release of the National AIDS Strategy. The mission is to connect people with the knowledge and

services that they need for better health. The Expo was successful at achieving its mission because there was a wealth of information available at people’s fingertips (everything from depression to anal pap smears) but attendance was sparse at 9:30 AM. There was a lot of hope for future endeavors of this sort expressed along with the need to actively engage the community and get broader attendance. All of the information, services and products were given away free of charge and could substantially put the gay community on the right path toward better health.

Gay Rally Dispersed in Moscow Associated Press – Police dispersed a gay rally Tuesday and detained at least a doz-

en protesters in the Russian capital. The two dozen demonstrators had been protesting the policies of Moscow Mayor Yuri Luzhkov, who has called homosexuals "satanic" and thwarted attempts to hold a gay pride rally in the city. Police detained most, if not all, of those participating in Tuesday's rally, which was held without a required permit near city hall. CELEBRATING GAY HISTORY MONTH LBGT Heroes

I

n 2006 the Equality Forum (EF) held the first GLBT History Month, to celebrate and honor the many gay men and women in our community who have enriched the world. Historical names such as Michelangelo, Whitman, Christopher Isherwood, Gertrude Stein, and Bayard Rustin are included on this list of Icons. The list also highlights newer, contemporary individuals such as Rachel Maddow, Rufus Wainwright, Suze Ormon, and Jóhanna Sigurðardóttir. EF is committed to educating the gay community, and its supporters, friends and allies, about gay heroes by offering complementary videos, biographies, downloadable images and other resources to the community on their website beginning on October 1. By the end of the month all 155 Icons that have been documented since 2006 will be available on the website. “GLBT History Month teaches us how proud we should be of our community and our moment. History months are an important step for civil rights movements. We are proud to coordinate this national and international project. Each one of these people is a remarkable story in and of itself,” said Malcolm Lazin, Founder and Executive Director of the EF. “Thirty-years-ago if you thought there was going to be something called women’s studies, black studies, you would have thought I was crazy. Now these are standard, as are queer studies classes.” To celebrate GLBT History Month, the SFGN staff compiled a list of our own personal heroes!

Gay Marriage advocates should also pause to consider the moral fortitude of a man who lived with the same life partner until his death in 1987.

I

have read all of E. M. Forster’s novels. He was born in 1879, and after his mother was widowed raised by what one “about the author” section described as an “army of aunts.” He wrote elegantly, with an economy of words, surely a reaction to a new century in which the florid pens of Victorian authors were no longer fashionable. His themes are class structure and society, often highlighting the hypocrisy of the upper echelons in their relationships with the poor. Homosexuality was also one of Forster’s themes. The character of Tibby Schlegel in Howard’s End seems to be that of a closeted, effeminate young man, content in the shadow of his sisters. In Maurice, which was published posthumously but written before WWI, we see a man who gives up class and country to flee to South America with his male lover. Forster was so dedicated to writing the truth in his work that he virtually gave up his career as a novelist when he could no longer deny his sexuality, and not being able to publish themes about gay life.

What is KALETRA? KALETRA is a prescription anti-HIV medicine that contains two medicines: lopinavir and ritonavir. KALETRA is called a protease inhibitor that is used with other anti-HIV-1 medicines to treat people with human immunodeficiency virus (HIV-1) infection. HIV-1 is the virus that causes AIDS (Acquired Immune Deficiency Syndrome). It is not known if KALETRA is safe and effective in children under 14 days old.

• When your KALETRA supply starts to run low, get more from your doctor or pharmacy. It is important not to run out of KALETRA. The amount of HIV-1 virus in your blood may increase if the medicine is stopped for even a short time. The virus may become resistant to KALETRA and become harder to treat. • KALETRA can be taken with acid reducing agents used for heartburn or reflux such as omeprazole (Prilosec®) and ranitidine (Zantac®) with no dose adjustment. • KALETRA should not be administered once daily in combination with carbamazepine (Tegretol® and Epitol®), phenobarbital (Luminal®), or phenytoin (Dilantin®). Avoid doing things that can spread HIV infection. KALETRA does not stop you from passing HIV infection to others. Do not share needles, other injection equipment or personal items that can have blood or body fluids on them, like toothbrushes and razor blades. Always practice safer sex by using a latex or polyurethane condom to lower the chance of sexual contact with semen, vaginal secretions, or blood.

he number of Floridians on food stamps has dipped slightly over the past year, but Department of Children and Families workers are still seeing a load of about 57,000 cases per month. In September 2009, the caseload stood at 58,646. The number is now at 57,742. Exactly how many people are represented by that caseload wasn't clear, but in August 2010, there were more than 2.8 million people receiving benefits. “While some economic indicators are improving, thus far it has been a ‘jobless recovery’ and the unemployment data is not yet showing a decline,” said Jennifer Large, the director of Access Florida, a division of DCF that financial assistance to Florida families. “Once the employment outlook improves, we can expect to see fewer people receiving food assistance benefits.” Florida's unemployment rate was 11.7 percent in Florida, with some counties even higher. Hendry County in south-central Florida had an August unemployment rate of 20.6 percent, followed by Flagler County at 16.4 percent and Indian River at 16.2 percent. The state numbers for food stamps have fluctuated slightly over the last 12 months, with the high of 61,096 cases in December 2009 and a low of 56,358 cases in May. National figures aren't available for the increase over the last year, but the number jumped significantly last year and is expected to again. According to the U.S. Department

of Agriculture, the total number of people on food stamps nationwide in September 2008 was about 31.6 million. A year later, the number had jumped to 37.1 million. Currently, the maximum allotment for a four-person family in the 48 states and Washington D.C. is $688, but that number could change with legislation under consideration in Congress. In August, the U.S. Senate approved a child nutrition measure that divided members because it is also likely to cut into the money used to fund the food stamp program. According to the Food Research and Action Center, a nonprofit advocacy group that lobbies on hunger and nutrition issues, the measure could result in a $2 billion reduction to the program. Several groups are lobbying House members to amend the bill so that it does not impact the food stamp program. For a family of four, that could translate to a cut of about $59 per month, the center said. The food stamp caseloads also are not expected to largely change over the next few years. State economists estimated that by Fiscal Year 2014, the caseload could decrease to 54,817. Large said it is possible that even when some families do go back to work, they may remain on food stamps. “Though some who would never have sought help before the recession, may have been eligible previously without knowing it,” she said. “They may return to work and continue to receive benefits, albeit at a lower level, because they are now familiar with the program and the help it can provide.”

She will also provide some entertainment, and promises an inspirational song for those in attendance. In addition to “Stories to Share,” the library will also offer a wellness fair. “Our Susan G. Komen for the Cure Wellness Fair provides valuable information from health organizations in the Broward area,” said Barbara Miller, Programming Manager of the Broward County Library. “We also have an outstanding collection

of books about breast cancer at the Main Library and our other 36 branch locations. Our goal is to provide information to all our customers and to answer their questions to the best of our ability about where to obtain additional information about breast cancer.” Another breast cancer survivor that met with Buzzi was Dr. Nan Van Den Bergh, a professor of social work at Florida International University. She has been an activist since she finished her treatment in 2004. “I have been working specifically with health disparities for lesbian women and how to provide quality healthcare and work change these disparities,” she told SFGN. “In my story for “Stories to Share,” I focused on making lemonade out of lemons. We have no cure for breast cancer. As a social worker I am interested in eliminating disparities in society,” said Van Den Bergh. “I discovered lesbian women were potentially at a greater risk for breast cancer and researched why this is the case.” Her findings are simple and direct. Women, who do not bear children are exposed to more estrogen, and as most lesbian women do not give birth this is a key factor. Breast cancer is fed through estrogen. Lesbian women are also less likely to self-exam, get clinical exams and ultimately mammograms. “That somewhat evens out with older populations of straight and lesbian women,” added Van Den Bergh. “Yet, the younger women, aged 20 to 50, are not engaging in exams as much as they should, nor getting baseline exams at 40. This has been gauged through nationwide surveys.” Also national studies show that women continued on page 24

Lesbian women also tend to drink and smoke in higher quantities than heterosexual. As part of her activism and commitment to what she described as “our cause” she worked to establish Area Resource and Referral Organization for Women: Targeting LBT Women’s Health, also known as ARROW. The group started last October. “Our whole focus has been outreach to the community, we are at all the pride festivals, we work with Care Resource, and we received another grant from Susan G. Komen to expand our training to all the major providers of low or no cost breast health programs in Broward & Dade,” said Van Den Bergh. “We train health care providers in terms of how to be culturally sensitive when working with lesbian patients.” Being culturally sensitive is key in treating women who identify as lesbian, to discuss risks like smoking, alcohol consumption and body fat index, which not only facilitates breast cancer but cardiovascular disease, and cervical cancer which can go undetected in the lesbian population as they are less likely to be have a Pap Smear test and an HPV screening. But a spokesperson for the ACLU of Florida, Brandon Hensler, said he knew of no such cases pending and, “with the weight of the evidence we have on our side, we’re confident that if there were ever two competing appellate decisions, a Supreme Court decision would find the same as the Third District.” Florida is the only state whose law specifically bans adoptions by all gay men or lesbians. Mississippi bans same-sex couples from adopting, and Arkansas, Michigan, and Utah ban unmarried couples (which, by definition, includes all same-sex couples in the state). Although the ban will no longer be enforced, there is still another hurdle for same-sex couples in Florida: the question of joint adoptions by a couple or secondparent adoptions by one partner of the other partner’s legal child. Gill, in fact, has a partner (who remained unnamed in court documents). The men felt, however, that they would stand no chance in their case if they sued for a joint adoption. case really involved five people: Gill, the two children, Gill’s partner, and the partner’s biological son. “The bonds of attachment that have formed over the past six years are not limited to those between the two adopted children and the petitioner;” wrote Salter. “[T]he children have also established strong bonds with Tom Roe (a pseudonym) and his son (and they with the children). . . . The continued use of the legal system to attempt to unwind these relationships is simply inexplicable.” In his statement, Gill said the state’s ban “has kept me from adopting the two boys who have known me as Papi for the past six years.” “This deprives them of the emotional security of knowing they are part of a forever family,” said Gill. “The law is also an obstacle to adoption for countless other Florida children who have no family of their own. “I am eager to adopt my two children and to remove this barrier to adoption for other children as soon as possible. Ending this case now would be the quickest way for that to happen.”

Study Rates LGBT Life on Campus By A. Sebastian Fortino

C

ampus Pride and the Q Research Institute for Higher Education conducted a research study to find out just how accepting college campuses are these days. Students, faculty and staff from approximately 40 colleges around the nation rated their experience as “out individuals.” Responses were collected from all 50 states, with close to 3,000 people participating in the survey. This is good news, considering only data from 10 states was collected for a similar survey in 2003. What is not such good news is that only 160 campuses nationwide have LGBT affirming organizations. When you learn that many students do not participate in campus life, or are not invited to by their peers because of their gender identity, one can understand why this percentage should increase. Such surveys are important, as a pleasant campus environment is crucial to the education of the student, and the ability for LGBT faculty and staff to work for an accepting entity. As the survey is 250 pages long, Campus Pride kindly let SFGN sit in on a Webinar they broadcast last week. Here are some notes from the webinar and report. • Transfeminine and transmasculine students reported the most harassment as opposed to students whom identify as either male or female. • While there was no substantial difference between LGBT-identifying white people and people of color in terms of harassment people of color claimed racial identity as basis for harassment, while white people claimed sexuality or gender.

• 34% of students know of other LGBT students who have experienced sexual harassment, while 3% were victims of sexual assault. • Only 14% of colleges have non-discrimination policies for faculty and staff, and even less offer protection for LGBT students. • Intimidation in the name of religion often harries the life of LGBT students. A story of a student with a pride rainbow on their backpack among a crowd calling for the execution of gays via burning at the stake was especially chilling. • 53% of respondents stated they have witnessed the harassment of other students, one can take this to mean calling a student a derogatory term because of their actual or perceived sexuality. • One-third of LGBT students, faculty and staff have seriously considered leaving their institution because of what they experienced on campus. Many who stay do so in order to “make a difference.” One transfeminine graduate student felt the most accepted by those in her program, while she did not feel comfortable with the campus at large. • Transfeminine individuals reported the highest rate of harassment, and discrimination on campus. Transmasculine people experienced less harassment if they did not reveal their birth gender. However, as with anything as personal as sexuality, and gender many people may not participate in a survey which might possibly “out them” to their community, classmates, and peers. We can only hope that the increase of LGBT groups on campus in the past 10 years means further inclusion and acceptance for future generations of Freshman. GOP ‘Pledge’ Honors Only ‘Traditional Marriage’ By Lisa Keen

epublicans in the U.S. House of Representatives revealed their “Pledge to America” Thursday, September 23, and it includes a pledge to “to honor families, traditional marriage, life, and the private and faith-based organizations that form the core of our American values.” That reference to traditional marriage was too much for most LGBT leaders and too little for right-wing conservatives. The document, unveiled by House Minority Leader John Boehner, is essentially a campaign tool – part of the GOP’s effort to win a majority of seats in the House, where polls show they currently have the better likelihood, compared to the Senate. It is inspired by its predecessor, “Contract with America,” that was issued to help Republicans take back the House in the 1994 elections.

The difference in this year’s document is the promise to “honor…traditional marriage.” The 1994 Contract had no similar statement. That statement, said Fred Sainz, a spokesman for the Human Rights Campaign, the preeminent LGBT lobby group on Capitol Hill, signals that Republicans “clearly are not going to be supportive of any form of relationship recognition –civil unions, domestic partnerships, or marriage.” “On the whole,” he said, the Pledge is “very bad for LGBT people.” “It is the same tired conservative agenda that drove our nation backward, not forward,” said Sainz. National Stonewall Democrats leader Michael Mitchell agreed. “For anyone who believed a few weeks ago that the GOP was thawing when it comes to LGBT rights,

especially marriage rights, this document is a great object lesson in the lengths the Republicans will go in order to exclude millions of LGBT Americans from their stated vision of ‘greater liberty and wider opportunity’.” “This Pledge to America is nothing but recycled talking points about policies that have failed again and again and that fail to recognize the greatness of fair-minded Americans,” said Mitchell. But R. Clarke Cooper, executive director of Log Cabin Republicans, said the Pledge includes "important pro-equality language.” “It states, 'We pledge to advance policies that promote greater liberty, wider opportunity, a robust defense, and national economic prosperity’,” noted Cooper. But, he noted, “the Republican party, like the Democratic party, remains on a journey toward completely embracing marriage equality." “If there is any silver lining in it,” said HRC’s Sainz, “it’s that there’s no mention of a federal marriage amendment.
