Court Will Televise Gay Marriage Hearing in California
A
n upcoming appeals court hearing on the constitutionality of California’s same-sex marriage ban will be televised. The 9th U.S. Circuit Court of Appeal announced Wednesday that it had granted C-Span permission to carry the Dec. 6 proceedings in San Francisco live. Supporters of the voter-approved ban are appealing a federal trial judge’s August decision that struck down Proposition 8 as a violation of gay and lesbian Californians’ civil rights. The January trial that resulted in that decision had been slated for broadcast on
YouTube and other federal courthouses. But the ban’s backers objected and the U.S. Supreme Court blocked the plan.

ADAP Waiting List Becomes ADAP ‘Drop List’ Agencies Make Their Presence Known
T
he AIDS Health Care Foundation sponsored a forum on the AIDS Drug Assistance Program in Florida last Wednesday, and the turnout was very strong, with activists asserting their concern about the diminishing availability of meds in the federal drug treatment program. “350 People will be removed from the program on February 1st,” said Joey Wynn, a well known AIDS advocate. “That’s the earliest it could happen so if you’ve heard that it would happen this week, that’s not true.” Wynn was speaking to about 75 people who came to Wilton Manors for the HIV/ ADAP town hall discussion. Participants were mostly from the Wilton Manors area, but a few travelled from Miami and other cities to gather information.
Wynn has been doing work and advocacy for people with HIV/AIDS for more than a decade but tonight he’s just trying to motivate people to be proactive in the face of frightening cutbacks to the AIDS Drug Assistance Program in South Florida. “So I just want everybody to know there are programs here to help […] and there are people out there who are fighting for this cause. It’s not hopeless.” There was no panic, chaos or yelling at this meeting as there had been at other public discussions earlier in the year. Still, attendees listened attentively and asked plenty of questions. New Rules Grant Greater Medical Rights For Same-Sex Partners
T
he Centers for Medicaid and Medicare has issued new rules which require all hospitals that participate in Medicaid and Medicare to allow patients to designate who shall be allowed to visit them and make medical decisions on their behalf. The order allows for same-sex partners to have the same rights as other immediate family members. The new rules were published in the Federal Register on November 19. “We are thankful that the administration has acknowledged that everyone should have the right to be with their loved ones in their times of need,” said James Esseks, Director of the ACLU Lesbian, Gay, Bisexual and Transgender Project. “Nobody should have to suffer the indignity of having to justify who should be at their hospital bedside.” The rules follow a directive issued by President Obama to the Department of Health and Human Services (HHS) in April
in which he noted that LGBT people are “uniquely affected” by being “unable to be there for the person they love, and unable to act as a legal surrogate if their partner is incapacitated.” Upon announcing the rules yesterday, HHS Secretary Kathleen Sebelius said, “Basic human rights - such as your ability to choose your own support system in a time of need - must not be checked at the door of America’s hospitals.” “Same-sex couples deserve the same respect during life’s most difficult moments as anyone else,” said Robin Bodiford, a local attorney who has fought for human rights in South Florida for thirty years. The rules require hospitals to have written policies and procedures to explain to patients that they have the right to choose who can visit them. When a participant from Red Hispana (another HIV-related advocacy group) asked about contacting legislators, multiple participants answered that they could provide this information. Methods of imploring Florida and Federal legislators to help middle and lower-income HIV positive persons seemed to be a major theme throughout questions and answers. “We just want to make sure our federal legislators go up to Washington and do what’s best for our state, not their party,” said Wynn to much applause. Congressman Alcee Hastings sent a representative to the town hall meeting to take notes and make sure that participants knew that he was aware of the issue of funding and working on it. If any other government officials were present, they did not make themselves known. Some participants were agitated at suggestions that things would be ok in the long run. One young man told the audience that he was cut off of ADAP while he was hospitalized and struggled to get back on the program, only to be removed again one week later. Other ADAP recipients shared that they were taken on and off of computerized records, and had trouble collecting their medication, although most are still unclear whether or not they had been removed from the actual program. Meanwhile, AHF announced it is planning a new rally at the Federal Building downtown on the Tuesday after Thanksgiving. Stated Ron Weston, an AHF representative, “The reason we’re going to the Federal Building is because, like Joey said, it’s the
Federal Government that gets the money and gets the access that the state governments lack.” AHF has had rallies at the Federal Building in downtown Ft. Lauderdale before, as well as some eyecatching demonstrations outside the offices of House Speaker Nancy Pelosi’s office in California. “We are just advocating that Congress allocate more funding to our state,” said Jason King, a patient advocate with AHF, “because we have, in fact, the highest number of people on our waiting list in the country. We are disproportionately affected by this disease.” King is correct. While Florida had not had a waiting list for 13 year, it already has more than 1700 patients waiting for needed meds. 11 other states had waiting lists earlier this year but at least two have begun to enroll patients again after a recent funding increase. Both Democrats and Republicans have bills languishing in committees to increase emergency funding for ADAP but with slight differences. The Republicans want to see ADAP money drawn from the stimulus package. Democrats see that as a partisan move and point out that some states need to contribute to their own healthcare needs with more vigor. Confusion and anger in the political realm have kept the people who are most concerned about ADAP funding from seeing the raw facts. The state of Florida is also expected to contribute to their own ADAP program as ADAPs are meant to be a “partnership.” Currently Florida contributes 10% of the funds going into its ADAP. The national average for states contributing to their ADAP is 20% of the program. Some states like California contribute a far greater share to their own healthcare needs in general. “The ability for Florida to make an increase to ADAP is limited,” said Jason King, “as you know, we’re a southern state with no state income tax and limited revenue even for things like infrastructure.” Overall, since 2005, ADAP funding has gone up about $13.3 million dollars per year, while national AIDS funding has gone from $6.3 billion in 2005 to $7.6 billion for the 2011 fiscal year. There were small increases in the Bush years, and a little bit larger ones during Obama’s term.

Patient Information ISENTRESS ® (eye sen tris) (raltegravir) Tablets Read the patient information that comes with ISENTRESS1 before you start taking it and each time you get a refill. There may be new information. This leaflet is a summary of the information for patients. Your doctor or pharmacist can give you additional information. This leaflet does not take the place of talking with your doctor about your medical condition or your treatment. What is ISENTRESS? • ISENTRESS is an anti-HIV (antiretroviral) medicine used for the treatment of HIV. The term HIV stands for Human Immunodeficiency Virus. It is the virus that causes AIDS (Acquired Immune Deficiency Syndrome). ISENTRESS is used along with other anti-HIV medicines. ISENTRESS will NOT cure HIV infection. • People taking ISENTRESS may still develop infections, including opportunistic infections or other conditions that happen with HIV infection. • Stay under the care of your doctor during treatment with ISENTRESS. • The safety and effectiveness of ISENTRESS in children has not been studied. ISENTRESS must be used with other anti-HIV medicines. How does ISENTRESS work? • ISENTRESS blocks an enzyme which the virus (HIV) needs in order to make more virus. The enzyme that ISENTRESS blocks is called HIV integrase. • When used with other anti-HIV medicines, ISENTRESS may do two things: 1. Reduce the amount of HIV in your blood. This is called your “viral load”. 2. Increase the number of white blood cells called CD4 (T) cells. • ISENTRESS may not have these effects in all patients. Does ISENTRESS lower the chance of passing HIV to other people? No. ISENTRESS does not reduce the chance of passing HIV to others through sexual contact, sharing needles, or being exposed to your blood. • Continue to practice safer sex. • Use latex or polyurethane condoms or other barrier methods to lower the chance of sexual contact with any body fluids. This includes semen from a man, vaginal secretions from a woman, or blood. • Never re-use or share needles. Ask your doctor if you have any questions about safer sex or how to prevent passing HIV to other people. What should I tell my doctor before and during treatment with ISENTRESS? Tell your doctor about all of your medical conditions. Include any of the following that applies to you: • You have any allergies. • You are pregnant or plan to become pregnant. - ISENTRESS is not recommended for use during pregnancy. ISENTRESS has not been studied in pregnant women. If you take ISENTRESS while you are pregnant, talk to your doctor about how you can be included in the Antiretroviral Pregnancy Registry. • You are breast-feeding or plan to breast-feed. - It is recommended that HIV-infected women should not breast-feed their infants. This is because their babies could be infected with HIV through their breast milk. - Talk with your doctor about the best way to feed your baby. Tell your doctor about all the medicines you take. Include the following: • prescription medicines, including rifampin (a medicine used to treat some infections such as tuberculosis) • non-prescription medicines • vitamins • herbal supplements Know the medicines you take. • Keep a list of your medicines. Show the list to your doctor and pharmacist when you get a new medicine. How should I take ISENTRESS? Take ISENTRESS exactly as your doctor has prescribed. The recommended dose is as follows: • Take only one 400-mg tablet at a time. • Take it twice a day. • Take it by mouth. • Take it with or without food. Do not change your dose or stop taking ISENTRESS or your other anti-HIV medicines without first talking with your doctor.
If you fail to take ISENTRESS the way you should, here’s what to do: • If you miss a dose, take it as soon as you remember. If you do not remember until it is time for your next dose, skip the missed dose and go back to your regular schedule. Do NOT take two tablets of ISENTRESS at the same time. In other words, do NOT take a double dose. • If you take too much ISENTRESS, call your doctor or local Poison Control Center. Be sure to keep a supply of your anti-HIV medicines. • When your ISENTRESS supply starts to run low, get more from your doctor or pharmacy. • Do not wait until your medicine runs out to get more. What are the possible side effects of ISENTRESS? When ISENTRESS has been given with other anti-HIV drugs, side effects included: • nausea • headache • tiredness • weakness • trouble sleeping • stomach pain • dizziness • depression • suicidal thoughts and actions Other side effects include rash, severe skin reactions, feeling anxious, paranoia, low blood platelet count. n Wednesday, December 1, nearly 1,000 people are expected to will descend on Wilton Drive to remember those who have passed away from HIV/AIDS. The event intends to give hope to those currently living with the disease. Beginning three years ago, “Our Memories Burn Bright” candlelight vigil and rally has
steadily increased in size each year with last year having over 950 participants. agency “will use its programs and initiatives to ensure a focus on LGBT youth.” Specific SAMHSA efforts for helping LGBT youth, Hyde wrote, include the SAMHSA-funded Suicide Prevention Resource Center, which “includes LGBT youth as one of its priority populations.” The agency has also “produced publications and trainings geared toward improving awareness and capacity for suicide prevention for LGBT youth.” SAMHSA’s National Suicide Prevention Lifeline, Hyde noted, “routinely refers youth to The Trevor Project.” The agency also directs funds to state, tribal, and campus suicide prevention programs through its Garrett Lee Smith grants, Hyde wrote, noting that currently nearly half of the 32 state grantees and nearly a third of the 68 campus grantees reported activities focused on LGBT youth. Hyde said materials from the Human Rights Campaign’s Welcoming Schools program—designed to address family diversity, gender stereotyping, and bullying in elementary education—are included in resources given to grantees of SAMHSA’s Child, Adolescent, and Family Branch. SAMHSA’s Annual Children’s Mental Health Conference this coming March will hold a workshop using the Welcoming Schools materials as well as anti-bullying resources developed by the Gay, Lesbian, and Straight Education Network (GLSEN). And a toolkit being developed by SAMHSA to help schools create suicide prevention programs will include materials from Trevor. Additionally, Trevor will be invited to participate in SAMHSA’s National Workgroup
on the behavioral health of LGBT youth and their families. The YES Institute, a Miamibased organization that trains providers, families, and others about suicide-related behavior in LGBT youth, is already taking part. The Workgroup, according to its Web site, will “help identify specific strategies and interventions” for caregivers and communities. SAMHSA has also disseminated to staff and grantees recommendations from the Family Acceptance Project, a major academic study showing the connections between family rejection of LGBT youth and mental health problems, including depression and suicidal behavior. Answering the representatives’ question about SAMHSA’s immediate next steps, Hyde wrote that she and leaders of the agency’s Sexual Gender Minority Interest Group recently met representatives of the National Coalition for LGBT Health, including Trevor, to plan ways of working together and including Trevor in some federal anti-bullying efforts. To the representatives’ question about whether SAMHSA might need additional resources or legal authority to help with its efforts around LGBT youth, Hyde said no. She noted, however, that the attention on LGBT youth suicides has “mobilized SAMHSA staff and leadership across multiple Federal agencies to renew their commitment to these youth.” Rep. Nadler, in a statement about Hyde’s reply, thanked SAMHSA for its “comprehensive response.” He called the agency’s “recommitment” and “increased focus” on suicide prevention among LGBT youth “encouraging.” He said he looked forward to seeing the “concrete steps” SAMHSA will take, and to working together with SAMHSA and other partners in the Obama Administration to ensure that they “achieve results.”

Mexico Backs Benefits for Couples The Mexican House of Representatives voted Tuesday to amend rules governing social security benefits for gay and lesbian couples, the Associated Press reports. The op-ed generated more than 90 comments, many positive, but some quite negative. “Benilde-St. Margaret’s principal Sue Skinner called Simonson’s parents a day after the piece ran, and also talked to Simonson,” reported MPR. “School administrators declined to be interviewed for this story, but Simonson said the principal wanted the newspaper to stop taking comments on the piece. Simonson disagreed.” Instead, the newspaper staff and their faculty adviser decided to remove the op-eds and comments entirely from the website and to post an explanation from the principal. The explanation said in part, “While lively debate and discussion clearly has its place in a Catholic school, this particular discussion is not appropriate because the level of intensity has created an unsafe environment for students. As importantly, the articles and ensuing online postings have created confusion about Church teaching.” Vigil and Simonson expressed concern that the deletion suggests the critics have won, but they saw hope in a vibrant conversation now moving to Facebook, reported MPR.

Retail Sales Rise but Holiday Outlook Bleak South Florida Residents Plan to Spend Less By Joey Amato

espite a greater than expected rise in retail sales in October, many local South Florida residents are still hesitant to spend more this holiday season. Sales rose more than expected in October to post their largest gain in seven months, further evidence the economy is regaining strength. The overall report offered hope for the holiday but many people were quick to note they would spend the same, if not less, compared to last year. According to CNBC, Total retail sales increased 1.2 percent, boosted by purchases of motor vehicles and building materials, after advancing by 0.7 percent in September. The rise last month was almost double market expectations for a 0.7 percent gain. In a separate report, the New York Federal
Reserve’s “Empire State” general business conditions index fell to 11.1 in November from 15.7 in October. Economists had expected a tick down to 14 this month. Analysts were quick to note the survey was not a bellwether for the rest of the U.S economy. Recently, the Federal Reserve debuted a controversial $600 billion round of bond buying, known as quantitative easing, to provide additional stimulus. This round of stimulus became known as QE2. economy grows more quickly than expected, that could prompt the Fed to tilt toward a smaller QE package over the next year.” Although the unemployment rate is hovering around 9.6 percent, October’s retail sales report showed gains across most categories. Gasoline station receipts rose 0.8 percent after increasing 1.2 percent in September. Clothing and clothing accessories sales gained 0.7 percent, while receipts at sporting goods, hobby and book stores rose 1.0 percent, the largest increase since March. Core retail sales, which exclude: autos, gasoline and building materials, rose 0.2 percent after a 0.4 percent increase in September. This report is a more accurate indicator of consumer spending, which accounts for 70 percent of U.S. economic activity. One dark spot in the report shows purchases at electronics and appliance stores fell 0.7 percent in October. Furniture sales also fell 0.7 percent last month. “It shows the likelihood is that the hol-
iday period is going to be a good one for retail sales,” said Tim Ghriskey, chief investment officer at Solaris Asset Management in Bedford Hills, N.Y. Here in South Florida, pessimism is high. Local businessman, Kimber White of United American Mortgage is planning on spending the same, if not, less than last year. “I plan on being more frugal than last year,” he states. “I will spend more wisely, even though I have the capability to spend more.” Another local resident, Gerri Vidal-Rosa agreed with White. “No way will I spend more this year. In fact I may go back to making gifts out of construction paper and glitter,” she says jokingly. With the increase in personal dept, Susan Caplan of Pompano Beach is also keeping a tight hold on her wallet. “I am more broke than I was last year,” states Caplan. “Everything seems to be piling up, medical bills, car repairs, etc. The raise I received this year is barely worth talking about.” Notwithstanding the local outlook, we will need to wait until after Black Friday figures are released to get a true gauge of how this year’s holiday spending will compare to years past.

‘Thank God I’m Gay’ By Rabbi Greg Kanter
C
omedian Bob Smith said that when he came out over Thanksgiving dinner he said, “Mom, could you please pass the mashed potatoes to a homosexual?” “So,” he adds, “She passed the potatoes to my Dad.” I don’t recommend coming out over Thanksgiving dinner; not unless you want to be subject to years of, “You ruined Thanksgiving for me forever!” But I do recommend coming out. And this Thanksgiving, while we might not make an announcement over dinner, we all have plenty of reasons to give thanks that we are gay. “Thanks for being gay?” you ask. Yes, indeed! And I’m not talking about the stereotypical tongue-in-cheek responses – all the great clothes, fabulous sense of style, hot guys, etc. I’m talking about real bona fide reasons we can thank God we were created just as we are. Thank God for letting me know who I really am. Because I know I am gay and don’t hide it (anymore) either consciously or subconsciously, I have a better grasp of the person I really am. Consider all the people who wander through life not really understanding deep parts of their own psyche, people who live lives that are so repressed that they have no concept of themselves. Because God helped us to understand ourselves just as we were created, we have a huge advantage over all those poor souls. No doubt there is still much for us to learn about who we are, but we already have a tremendous headstart when we understand that we are gay. When we accept ourselves totally, we are even further ahead in the game. Thank God for the self-awareness that comes with knowing I am gay. Thank God I can understand and appreciate what it means to be on the margin of society. But why would one want to understand those unfortunate individuals who
live on society’s margins? What good can come from that? As I see it, we are better human beings when we have a better grasp of what the world is all about. Sure, we could go through life in a shiny little bubble never knowing what it means for people to suffer. But when we understand our own suffering, we can better relate to the suffering of others and we are more inspired to do something about it. You can live in an ivory tower if you’d like. I prefer to see life as it is, warts and all. Because God made me this way, I see the world differently, better. I thank God I have inspiration to fight for the rights of the oppressed. Thank God for my GLBT friends. When I wandered through life in the closet, I had few if any gay friends. Subconsciously I must have been keeping our community at arm’s-length; not in a hateful way, but in a way that reflected a tremendous fear of guilt by association. Now, that the fear and the closet are behind me, my world is opened up to a world of beautiful people I never would have known; people who love and support me for the person I am, not the monster they fear or imagine. Thank God for beautiful GLBT friends who make life more rich and meaningful. Thank God for passion, love and sexuality. In the Jewish tradition, even for the most Orthodox Jews, sex is not something we are supposed to be ashamed of. Rather, sex is a gift from God given to us so that we might enjoy life even more. Too many people associate sex with shame. They live afraid of the feelings God gave us. They punish themselves and others for daring to have sexual thoughts, to speak about sex, to express themselves at all in a sexual way. Now, God doesn’t want us to use sex as a weapon anymore than God wants others to use the Bible as a weapon. Both are gifts
meant to make life more meaningful. Unfortunately, not everyone sees it that way. Fortunately, we in the GLBT community can learn to love ourselves just as God made us – feelings, emotions, attractions and all. Thank God for letting me know what it means to be attracted to another man. Thank God I can change the world. Because we are different from the mainstream, we can stretch the edges of the envelope. We can create new definitions of marriage, of family, of values. Many people fear change and anything unlike themselves. By virtue of our being different from the start we can change the world to think about life in new and better ways. We can be parents. We can be mentors. We can be husbands and wives – even if it’s not in the way most people think about the world. By doing so we expand peoples’ minds about the possibilities this world offers us. Because God made me gay, I can show other people that the world does not exist in black in white; that there is a rich rainbow of colors on the palette from which to choose. Thank God for giving me the gifts with which I can change the world for the better. This year on Thanksgiving, let us count our blessings. We may want to wait a few days before telling Mom what she always suspected anyway. But let us not forget that life is so rich and rewarding if we open our eyes to the possibilities. They refer to the heroes and villains of old western novels, comic strips and countless movies that, in one way or another, told us the stories of the epic struggle between whites and Indians in the immense prairies of the West. There have been two polarized ways of presenting the story of the people who came to conquer from Europe and the na-

Historians, writers and moviemakers told and retold it, in a variety of ways, arousing, each time, feelings and opinions often different and conflicting with each other. Before the world became “politically correct,” before we had 150 TV channels of crap to choose from, before HBO, before Clint Eastwood and Dances with Wolves, the “cowboy and Indian” films solidified the Western myth for Americans. The cowboys were the champions of civilization, the Indians the ferocious savages intent upon killing whites and civilization itself. Little attempt was made to portray the Indian view that they had the right to protect themselves, their lands and way of life from the encroaching wagon trains.

Transgender Day: A Journey for Social Change he Transgender Day of Remembrance was started by activist Gwen Smith to mark the death of Rita Hester, a transgendered woman murdered in Boston in November 1998. This year, the 12th annual TDOR is observed in hundreds of cities and towns around the country and around the world, from Poughkeepsie to Perugia, from Salt Lake City to Sydney, from Tacoma to Tel Aviv. In November 2009, I was honored to give the keynote speech in observance of the first TDOR in the state of Iowa, standing with members of the Iowa transgender community in front of the state capitol in Des Moines. I spoke about the work of the New York Association for Gender Rights Advocacy, an organization that I lead and that I co-founded in 1998. NYAGRA is best known for its legislative work, some of the most important work that we do is the transgender sensitivity training

And so when we commemorate the Transgender Day of Remembrance, we must join together in re-committing ourselves to the task of transforming society’s understanding of gender in order to make our world a safe one for all people regardless of gender identity or expression. Senate to Vote Again on Military Gay Ban By ANNE FLAHERTY Associated Press
WASHINGTON (AP) – The U.S. Senate’s top Democrat said Wednesday that he will call for a vote later this month on legislation that would allow gays to serve openly in the military. Senate Majority Leader Harry Reid’s announcement makes good on his pre-election promise to resurrect legislation that would repeal the 1993 law known as “don’t ask, don’t tell.’’ But it remains far from certain whether the legislation would have enough votes to pass. Several leading Republicans, including Sen. John McCain, have said they oppose lifting the ban. “We need to repeal this discriminatory policy so that any American who wants to defend our country can do so,’’ Reid said in a statement. The legislation would, for the first time,
allow gay troops to acknowledge publicly their sexual orientation. However, the repeal of the current law would take effect after the president and his top military advisers certify that doing so would not hurt the military’s ability to fight. The bill emerged from a deal struck earlier this year between more liberal Democrats eager to change the law and the White House, under pressure by the Pentagon to give it more time to determine how to repeal the law without causing any backlash. The provision is tucked into a broader defense policy bill that includes such popular programs as a pay raise for the troops, which gay rights groups hoped would help its chances of passing. But when the bill reached the Senate floor in September – just weeks before the
midterm Congressional elections – Republicans united in objecting to its debate on procedural grounds. Reid insisted that few amendments be considered in the interest of time; Republicans said restricting debate on such a wide-ranging policy bill was unfair. Jim Manley, a spokesman for Reid, said Wednesday that it had not been decided yet how many or which amendments might be
considered for debate. A wild card in the upcoming debate will be a Pentagon study on gays in the military that is likely to be released just days before the Senate vote. Last February, Defense Secretary Robert Gates said he supports an eventual repeal of the law but wanted time to figure out how it should be done. He ordered a 10-month study due Dec. 1. A draft of the 370-page assessment has found that the ban could be lifted with little harm and that most troops don’t object to the change in personnel policy, according to officials familiar with its findings. But it also found that some troops had serious concerns with repealing the law. Military officials have warned that even scattered resistance to the change could pose logistical and discipline problems for field commanders. Gay rights groups see the lame-duck session of Congress, before newly elected Republicans are sworn in, as their best chance at repealing the law. The House has already passed the bill. But come January when the new Congress is seated, Republicans will take control the House and the Democratic majority in the Senate will be narrowed by six seats.

Governments Remove Sexual Orientation from UN Resolution By A. Sebastian Fortino

n November 16 the Third Committee of the United Nations General Assembly – the Social, and Humanitarian Cultural Affairs Committee of the UN – voted to remove a reference to sexual orientation from a resolution on extrajudicial, summary or arbitrary executions. For the past ten years the resolution included sexual orientation in the list of what
qualified as discrimination. The removed reference was originally contained in a nonexhaustive list in the resolution highlighting the many groups of people that are targets of discrimination and killings. In addition to sexual orientation persons belonging to national, ethnic, religious, or linguistic minorities were included under the auspices of the resolution. The amendment removing the sexual orientation reference was sponsored by Benin on behalf of the African Group within the United Nations General Assembly. A startling 79 votes were in favor of removing the clause protecting sexual orientation. Sara Perle, a spokesperson for the International Gay and Lesbian Human Rights Commission (IGLHRC) based in Manhattan kindly clarified what this action means. Needless to say the IGLHRC is deeply disappointed in the actions of the Third Committee. “The amendment removed the words ‘sexual orientation’ from a paragraph in the resolution that listed particularly vulnerable groups of persons who are targeted by killings, including all groups targeted for discriminatory reasons. The resolution is voted on every two years and in the past has included this language noting the vulnerability of people targeted because of their sexual orientation, language which reflects the understandings of the Special Rapporteur on extrajudicial, summary and arbitrary executions, an independent human rights expert,” Perle explained. The IGLHRC noted that all people have a right to life free from extrajudicial, summary and arbitrary executions. However, it is disturbing that States of this amendment do not see the frequent killing of individuals because of their actual, or perceived, sexual orientation. “The resolution is important in international efforts to end violations on the most important human right – the right to life,” said Perle. “It’s tragic that the lives of LGBT people have been used to garner support around this human rights instrument, but in trying to get more governments to support this and in trying to make it seem less controversial, we cannot accept the sacrifice of the human rights of LGBT people.” Fortunately, this resolution is brought before the UN for a vote every two years. Unfortunately, there are countries whose LGBT citizens might not be able to wait for the amendment to be overturned in favor of

Texas Teen Burned, Bludgeoned in Hate Crime
T
he LGBT newspaper of record in Texas, the Dallas Voice is now reporting that a young teenager was bludgeoned and burned to death in a possible hate crime. Joshua Wilkerson, 18, was missing for 24 hours from his school in Pearland, Texas, when a man who was helping with the hunt told authorities he beat the victim to death and burned his body after the victim made sexual advances toward him. Authorities now say that Joshua Wilkerson, 18, was beaten with a large wooden rod and that his body was burned. Hermilio Moralez, 19, is charged with murder in Wilkerson’s death. That is what Channel 13 in Houston reported Thursday. According to court documents, Wilkerson gave Moralez a ride home from school Tuesday and Moralez stated that Wilkerson began to make sexual advances towards him. Moralez said they got out of the truck and began to fight when Wilkerson grabbed a large wooden rod and tried
to hit him. Moralez said he took the piece of wood from Wilkerson and began to hit him with it. He said Wilkerson was not moving afterwards. The court documents state that Moralez told police he drove Wilkerson to a field along FM 521 near 518 and burned the body. Morales said he then drove Wilkerson’s pickup truck to the parking lot of a nearby strip center and threw Wilkerson’s shoes and backpack into a dumpster there.

ou won’t find jazz saxophonist Dave Koz at a Jews for Jesus rally, but he really loves Christmas music and, on Monday, Nov. 29, Koz will return to Fort Lauderdale’s Broward Center on his Smooth Jazz Christmas tour. “I grew up in a household that celebrated Chanukah, but you can’t escape Christmas music during the holidays,” Koz explains. “I think as a saxophonist, I gravitate to those melodies that I can really sink my chops into. They never go out of style, because they’re great.” Ironically, Koz’s favorite Christmas song is “White Christmas,” made popular by Bing Crosby and written by Irving Berlin, a Jewish composer. “That’s definitely one audiences will hear. I just fell in love with it years ago. It’s so ‘Christmasy’ and all the emotions of the holiday are tied up in those notes,” the multiple Grammy-nominee says. “It’s such a great irony that a lot of the most famous songs of the holiday season were written by Jewish people.” He also emphasizes that his musical celebration is about the “feelings of the season” and not so much a religious experience: “We remember who we are

Koz says audience will also get a taste of his latest album, “Hello Tomorrow,” which was just released in October and holds a commanding position on the Billboard charts. The album, his first in seven years since coming out and nearly 20 years from his debut, stretched Koz creatively and became an expressive outlet after the loss of his mother. But, he says, make no mistakes, the album channels new sounds and energy. Following his South Florida performance, Koz takes the tour around the country and then he resumes a demanding international performance schedule. Ultimately, Koz is reminded of some advice he received years ago. He concludes, “It gets a little crazy, but I love it, I thrive on it. The people who come to see us are what keep us going. Somebody said to me a long time ago, the show you do for free, but you’re paid for the other 23 hours of the day. The shows make it all worthwhile.”

The animals, however, are not forced into this kind of behavior. “Dolphins are so big we can’t make them do what they don’t want to do. They truly want to interact and play with the humans,” Graff said, and human guests seem to get very attached to the dolphins and their very distinct personalities. “Everyone says their dolphin is the best,” laughed Graff. Dolphin Odyssey, offers guests a one and a half-hour magical experience with one of the 12 Atlantic Bottlenose Dolphins that call the Seaquarium home. If you do not

1 tablespoon fresh herbs of your choice: sage, thyme, or rosemary 2 teaspoons smoked paprika 1 stick of cinnamon 1pint heavy cream 2 cups of sparkling wine or champagne Melt butter in heavy-bottomed stockpot then add chopped leeks. Sautee until creamy. Add grated potatoes, then salt and pepper to taste. Stir until well combined with leek and butter mixture over medium-high heat. Then add the six cups of broth, smoked paprika, 2 tablespoons of fresh chopped herbs and small cinnamon stick. Simmer the soup for 30-40 minutes stirring occasionally. The potatoes and leeks should have broken down into a thick, creamy mixture. If you wish to puree take pot off of heat and let stand uncovered for ten minutes. Remove cinnamon, then puree in a blender or food processor.
My trick of grating the potatoes however should only require you to puree half of the soup, leaving a nice balance of creamy and rustic textures. I advise chilling the soup for 24 hours, as it allows the flavors to mature. Gently whisk in the heavy cream, and 2 cups of sparkling wine before guests arrive. Serve in oversized wine goblets as a first course with the same sparkling wine or champagne you finished off the soup with, garnished with a few leaves of the herb you chose to use. he young man who used to work the coffee counter at the Manor in real life but worked as a ‘pizza delivery boy’ in porn films now has a lot of pepperonis to deliver. A judgment has been filed in Orlando federal court against Justin Krueger, also known as performer Jake Lyons, in the amount of $54,160 dollars, and it is good for 20 years. As reported in SFGN last June, online
gay porn studio Corbin Fisher had sued Lyons for allowing copyrighted photographs it owns on the popular male escort site “men4rentnow.” Claiming copyright and trademark infringement, Corbin Fisher initially sought over one million dollars for the use of seven photos. Lyons, who has done porn films lately in various locales, left Wilton Manors and never answered the lawsuit. A default wound up being entered against him, in an amount determined by the court sufficient to meet the breach of the plaintiff’s rights. Movie Review: Tangled By Steve Fritz
F
or many years, the Magic Kingdom has opened its doors to the gay world.They even offer an annual Gay Week at both Disneyland and Disneyworld. For their efforts, they receive more than their share of outcries of eternal perdition from the extreme Right. At the same time, the business must be good enough to withstand the threats of banishment and damnation. Still, there’s one place the Mouseworks rarely goes, if ever. That’s the place where Uncle Walt started his entertainment empire; the animated feature film. It looks like that’s changing with their latest holiday season animated feature film, Tangled. No kids, the hero the appropriately named Flynn Ryder (voiced by Dexter’s Zack Levi) will ride into sunset with the latest—seriously female--Disney Princess, Rapunzel (Mandy Moore). Disney the Brand is way too smart to mess with THAT part
of the formula.Yet, pay attention, there are some interesting hints. The first hint is evil stepmother Goethl (Donna Murphy). She’s pulled right out of the pages of Mommie Dearest. This is the most wonderfully diabolical character since Susan Sarandon’s deliciously evil mom turn in Enchanted, and Murphy has a much better singing voice. The next clue is Tangled is on one heck of a Broadway production. It’s only a matter of time before it goes on to the Great White Way. Part of this is due to the team they’ve put together. If you examine the credits of this film you’d discover some familiar names. The producers include Don Hahn and Al Menken. Tangled’s animation director is Glen Keane. The last time these three worked together was Disney’s one feature film to earn a Best Feature Film nomination, Beauty & The Beast. The teaming of these three creative forces make Tangled an incredible achievement in its own right. Yes, the story is a Disney-fied reinterpretation of the old Grimm’s Fairy Tale. In Tangled, Rapunzel has the magical ability to heal just about anything and restore eternal youth…as long as you don’t cut her hair. Goethl kidnaps the young lass and locks her up in the infamous tower. Goethl’s scheme for eternal youth and virtual immortality probably would have worked. Except that’s when the suave uber thief Flynn didn’t give Rapunzel motivation to get out of Dodge. Now this soon-to-be classic Disney villainess has to really show how backstabbing and conniving she can be to win Rapunzel back. Until this point, the film is a mish mash of sterling moments, such as Goethl’s knock out number “Mother Knows Best,” or Rapunzel going through mood swings that should have the young thing be locked up in real life. Then it kicks into high gear when Flynn he’s had enough of the young diva with the lethal frying pan. So he takes her to the most dangerous place he knows, a low down
dive called the Snuggly Duckling. Yes, you read that right. It’s led by some of the ugliest looking ne’er-do-wells since Captain Hook’s crew. The only thing is they, like Rapunzel it turns out, have their share of dreams. The biggest, meanest looking one of them likes to
collect his own glass menagerie, especially miniature unicorns. Another wants to be a mime. A third dreams of being an interior designer. The leader, Hook Hand (Brad Garrett), dreams of being the next Liberace. Under lesser hands, this could have been incredibly insulting. Still, Keane manages to create some incredibly funny and just
plain incredible performances out of these covertly queer characters. They easily outperform Robert DeNiro’s Captain Shakespeare in Stardust. Further, with the aid of this crew of malfeasants Tangled kicks into overdrive, turning into a truly turbo-charged screwball comedy that matches some of the best work of Howard Hawks and Frank Capra. Yes, like all true Mouseworks productions, the film will move towards its inevitably happy ending. Goethl will meet an extremely satisfying death. Rapunzel and Flynn with have the big kissing scene. The thugs will all stand around them with tears in their eyes. At the same time, one could also call it an incredibly satisfying conclusion. More important, this is the most out I’ve ever seen in any Disney feature film ever. As said before, this movie’s prince charming won’t ride into the sunset with the boy of his dreams. The Magic Kingdom gets enough flack from the hell spawn of Anita Bryant as it stands. Then again, Disney World has already announced its next Gay Week for 2011. While always espousing family values, they seem to be slowly but surely moving towards a more well-rounded world view. It looks like they’ve managed to make their cake and eat it, too. Luckily, Tangled is a tasty little sucker and we all get to have a bite.

ay, lesbian, bi, trans, straight – it doesn’t matter. If you’re an American and you watch big-time sports, you can’t avoid seeing religion too. A football player scores a key touchdown, and then points his finger to God in the sky. A winning pitcher thanks the Lord for the win. Basketball teams sponsor special “Faith Nights” for their fans. What in God’s name is going on? Tom Krattenmaker – a Portland, Ore. journalist and member of USA Today’s board of contributors who writes frequently on religion in public life – figured he’d find out. The result: Onward Christian Athletes: Turning Ballparks into Pulpits and Players into Preachers. The book – published earlier this year – is an incisive, example-filled look at the often-overlooked, seldom-examined ways
in which sports and faith converge. Krattenmaker believes that “spontaneous” displays of faith are actually part of a well-organized effort – orchestrated by “a network of evangelical chaplains and sports ministry organizations” – to unite the powerful institutions of religion and athletics. Of course, wherever religion pokes its nose, it smells homosexuality. Inevitably, athletics and Christianity converge to create a tangled homo hornet’s nest. “Anti-gay sentiment is where sports, culture and politics intersect,” Krattenmaker says. “The opposition to gay rights is part of the Christian right rhetoric. And sports as a whole can be homophobic too.” Though Krattenmaker devotes only a few of his 210 pages to specifically anti-gay examples, the ones he chooses are chilling. My mother was a stern woman and I guess the way I run this place makes me a lot like her. I’m strict about our rules. Mandatory 11PM curfew. No drugs or alcohol or sex on the premises. Random and regular testing. Group meetings. But my mother always put in an extra half acre of garden just to grow food to give away. She made us work that garden and taught us the value of helping those who need it.” James, who grew up in Sunrise, lost a brother to addiction and has himself been through recovery twice. He met Jarod through mutual friends and would not take no for an answer when Jarod repeatedly refused to date him. He soon brought him home to meet the folks. Sanctuary House is at a critical juncture. James is its constant operations manager and Jared who works an additional job as a package courier is close to exhaustion and not without health problems. They receive no government funds but are in line for a HOPWA (Housing Opportunities For Persons With AIDS) grant if they can make some required improvements to the prop-
erty. Their small board of directors includes police office James Nash who has been generous with his time, sometimes substituting for them as manager. (James and Jared have taken only one vacation, an overnight to a campground.) Attorney George Castrataro is providing pro bono help with the paperwork needed for 501(c)(3) certification. Every piece of furniture, all the cabinetry, tiling and plantings are donations. ore than a year after a controversial inspection at the Rainbow Lounge sent protesters to the streets and vaulted the city into the national spotlight, city officials have dropped charges against four of the gay bar’s patrons. The dismissals came 2 ∏ weeks before Chad Gibson, who suffered a head injury in the June 2009 incident, and George Armstrong had been set to go to trial on public intoxication charges. Both had pleaded not guilty, and Gibson also pleaded not guilty to assaulting a Texas Alcoholic Beverage Commission agent. In a prepared statement released Friday, city spokesman Jason Lamers confirmed that the Class C misdemeanor charges against Gibson and Armstrong were dropped

esterday, Knights Out, a military and veterans advocacy group comprised of West Point graduates who are gay and their supporters, delivered an explanation of their controversial support of a proposal to go ahead with approving the Defense Authorization Bill even if it doesn’t include language for the repeal of DADT. Almost immediately after it was revealed that the Palm Center at the University of California had given the ok to drop DADT repeal from the Defense Authorization package, gay rights advocates began blogging about how the Palm Center, Knights Out, OutServe and President Obama were all conspiring to just give up on the whole issue of ending DADT. John Aravosis on AmericaBlogGay wrote of his conspiracy theory this way: “It’s pretty clear to both Joe and me that the Palm Center is doing this on behalf of some other unnamed groups (with three-lettered-names), who are working on behalf of an unnamed elected official who has a record of being rather un-fierce. You can do the math.” In their own defense, Knights Out said, “We signed on to a statement that made it
clear that we support repealing “Don’t Ask, Don’t Tell” during the lame-duck session and at the same time, the military mission is a priority. Funding the Defense Authorization Bill to support our troops is critical, and while some Senators are willing to play politics with the DADT issue at the expense of our troops, we are not.” “This is being misinterpreted as “surrender” on DADT, which it is not. Please understand that this is a statement of principle, and it does not let anyone “off the hook” regarding repeal of DADT. Repeal can happen in several different ways: in the original NDAA, in the amendment process for the NDAA, in a stand-alone bill - but it must happen in 2010. We are unwavering in that regard.” Knights Out’s intent, evidently, had been two-fold; one part ethics and one part strategy. Ethically speaking, Knights Out wanted to make it clear that they did not approve of tying repeal language to a spending bill which ended up depriving the military of what Knights Out believes to be essential funds. and recyclers, nothing was wasted, everything had its place, use and purpose. American Indian society did not view the universe as plain absolutes of black and white, good and evil, male and female. Everything was always in fluid and constant transition. A sort of Yin and Yang, where contrary forces are interconnected and interdependent in the natural world. After they were placed in godforsaken reservations they were handed broken treaties and broken promises, forgotten and left to die. Then in the 1980’s there was a revival. Books and movies begun to rewrite the old struggle, this time from the Native-American point of view, as if there was a need and
a desire to cleanse the atrocities of the past. One thing that has not surfaced and has not been talked about, in this renewed appreciation of all things “Indian,” is how they viewed homosexuality. It is not surprising that even in this area they were light years ahead of modern society. According to Native American scholars, individuals who showed masculine and feminine traits were referred to as “Two-Spirit.” They were considered a third gender with a unique spiritual quality. The belief was that they walked with a foot in two different worlds and for this they had a special place within the tribe and acted as healers, counselors and storytellers. They were highly
regarded as having artistic and intellectual qualities. They were often inducted into the “Berdache” status marked by special clothing, privileges and obligations. Some tribes believed that homosexuality was something one was born with or that it came to a person in a dream. The dream often told them to act as a person of the opposite sex. Indian elders also believed that a human being is what nature or his dreams make him and he/she has to be accepted for what he/she wants to be. The obvious acceptance, display and prevalence of homosexuality within many tribes reinforced the belief among the invaders, that, with God on their side, they had the divine duty to de-
stroy Native-Americans and their way of life. After the settlers imprisoned them in the reservations the missionaries exposed them to the Christian views of homosexuality, teaching them homophobia and introducing new sets of taboos and sins until then unknown. In the end we can say that the white man stole “the Home of the Brave” and raped its soul. In 1805 Chief Red Jacket spoke these words to the Evangelical Missionary Society of Massachusetts, “We do not wish to destroy your religion, or to take it from you. We only want to enjoy our own.” There is profound wisdom in these words. They have much to teach, and if we are willing to listen, they may teach us, because as a nation, we still have much to learn.

Rubbers Get Papal Blessing VATICAN CITY (AP) – The Vatican on Sunday cautioned that there is nothing “revolutionary” in Pope Benedict XVI’s startling assertion that condom use in exceptional circumstances can be a responsible act in the fight against the spread of HIV. The Holy See’s chief spokesman, the Rev. Federico Lombardi, issued a statement stressing that the pope’s comment in a book being published Tuesday neither “reforms or changes” church teaching, which forbids use of condoms and other contraceptives. Neither was Benedict “morally justifying” the unbridled exercise of sexuality, Lombardi added. The pope maintains that condom use to
lessen the danger of infection is a “first assumption of responsibility,” the statement said, quoting from the book. “The reasoning of the pope cannot certainly be defined as a revolutionary turn,” the spokesman said. The pope spoke in an interview given to a German journalist. Vatican newspaper L’Osservatore Romano on Saturday published excerpts from the book, “Light of the World,” three days ahead of publication. In the interview, Benedict says that in certain cases, such as for a male prostitute, condom use could be a first step in assuming moral responsibility for stemming the spread of the virus that causes AIDS.
Lombardi noted that the pope emphasized the church’s main advice in the fight against AIDS – sexual abstinence and fidelity among married couples. He cited Benedict’s words that the church “of course does not regard it (condom use) as a real or moral solution.” “With this, the pope isn’t reforming or changing the teaching of the church, but reaffirming it, putting it in the context of the value and the dignity of human sexuality as expression of love and responsibility,” the spokesman said.
