ELMHURST – The Zoning and Planning Commission plans to deliberate Oct. 23 on two applications by the same developer to build a six-story, mixed-use development in downtown Elmhurst. One application requests a conditional use permit for height and several variances from the city’s zoning code. The other application proposes a text amendment to the city’s zoning ordinance for planned unit developments in the C4 (downtown) district. Under the proposed amendment, planned unit developments in the C4 district could be granted exceptions to the zoning code, rather than variances, which require that a trio of standards are proven. Conditional uses, such as buildings between 45 and 90 feet, would still need to meet specific standards for permits. The development, called Wilder Crossing, would consist of 31 condominiums – including two penthouses – two retail spaces on the first floor, a mezzanine and 48 residential parking spaces on a double lot with addresses 195 and 197 N. The first hearing Sept. 11 was cut short before public comment due to a three-hour time restriction. The commission started the Sept. 25 hearing with public comment on the first application, which requests variances from the existing zoning code. Newly appointed commissioner Kurt Warnke recused himself at the beginning of the meeting because he previously was chairman of the Economic Development Commission, which submitted a letter of endorsement for the Wilder Crossing project. “I’d like to recuse myself from any further deliberation [regarding Wilder Crossing] to alleviate and hopefully remove any future appearance of a conflict of interest per-

taining to my work with the Elmhurst Economic Development Commission,” Warnke said. Several members of the Elmhurst business community spoke in favor of the development, including an Elmhurst real estate broker, Maria Gracik, who submitted a petition signed by 69 Elmhurst residents in favor of the project. A few residents submitted letters against the project, mentioning concerns like added traffic in the area and questioning if the city’s existing sewer system could support the project. Elmhurst resident, Tamara Brenner, opposed the project because she believed it does not follow the vision for the city outlined in the comprehensive or downtown plans. “I’m not necessarily opposed to taller buildings, but [the downtown plan] does say

that the two to four stories should dominate and there should be select locations that get higher buildings,” Brenner said. The applicant then entered much of the same testimony during the public hearing for the text amendment application. “This is the type of development the comprehensive plan recommends and that would be good for the city of Elmhurst,” said Scott Day, the developer’s attorney. Day went as far as to say the comprehensive plan’s definition of “high-density” as up to 20 dwelling units per acre may be a typo. Andrea Alvarez of the Citizen Advocacy Center pointed out the developer’s application would result in an overall policy change, and urged the commission to recommend it be denied. Brenner also called for the commission to recommend against the application, saying if commissioners were going to review the zoning code, they should do so as a separate process with community input, not in the context of one application. “I don’t disagree that there are issues in the zoning code that need to be updated, but it should be done in a more global setting,” Brenner said.

Elmhurst to save hospital’s ‘historical’ cupola structure By MARI GRIGALIUNAS mgrigaliunas@shawmedia.com ELMHURST – The Elmhurst Memorial Healthcare’s newest campus has been recognized as one of the most beautiful hospitals in America, but some Elmhurst residents are more concerned with preserving a design element from the former hospital building. “[The Elmhurst Hospital cupola] is kind of a landmark here in the city of Elmhurst.” said Lee Daniels, an Elmhurst resident and former speaker of the Illinois House of Representatives. Daniels, who is now Elmhurst College’s special assistant to the president for government and community relations, began inquiring about the future of the cupola as demolition began on the hospital’s former Berteau Avenue campus. “Most of my kids have been born there,” said Daniels, who also served on the hospital’s board of directors until it merged with Edward Hospital & Health Services in July 2013. Nitti Development plans to build a 56-home subdivision on the former hospital land. When Daniels discovered

there was no existing plan for the cupola, he contacted Mayor Steve Morley and Kevin York, an alderman in the Fourth Ward, where the former hospital site is located. “It’s a historical part of Elmhurst,” Morley said of the white architectural design element atop the hospital building. Morley explained he’s called Nitti Development and the developer has agreed to help preserve the cupola. Morley said the first step is devising a way to remove it from the building without damaging it. “It’s a very unique piece,” Morley said. He added that given the age of the cupola, it will need some rehabilitation, but the first priority is to get it down and safely into storage. Joe Nitti, president of Nitti Development, said his company plans to take the cupola down in one piece within the next few weeks. Nitti said he realizes many people in the community were born at the former hospital building and has heard from many in Elmhurst about how much the cupola means to them. “For us to take it down and

give it to the city is our pleasure,” Nitti said. Since word has spread that city officials are interested in saving the cupola, Morley said City Hall has received many calls and offers to help. Discussions have involved possibly having York High School students restore the cupola and a variety of locations where it could be housed permanently, but Morley said there is no final plan as of yet. “It’s become a community effort,” Daniels said. Although Elmhurst Memorial no longer owns the building that is being demolished on Berteau Avenue, the hospital has been involved in discussions on the cupola. “We’ve talked to the mayor and will continue to have a dialogue on this,” said a statement issued by the hospital. Daniels describes the cupola as a beacon in Elmhurst that holds many memories for those who were born or had family members born in the former hospital building. To him it’s more than a piece of architecture. “It represents all that is good about Elmhurst,” Daniels said.

mgrigaliunas@shawmedia.com ELMHURST – An automobile dealership could owe Elmhurst more than $100,000 if it’s found the dealership defaulted on a sales tax incentive agreement. Lucky Motors, which sells pre-owned luxury cars, and Elmhurst entered into an agreement with the city in July 2010. According to the agreement, Lucky Motors was to have 50 percent of the sales tax it generated each year returned by the city annually for 10 years. The agreement caps annual payments at $50,000 and sets a total limit for the incentive at $500,000 during the 10 years. When the Internet automobile dealership considered opening in Elmhurst, the site it chose had been vacant for three years. Four years after the agreement was signed, the 27,000 square-foot Lucky Motors facility at 817 N. Church Road in Elmhurst appears closed. A Google search for the Elmhurst store lists the location as closed, and the Elmhurst Lucky Motors phone number is answered at the Villa Park location. “We’re operating out of our Villa Park store,” said Lucky Motors owner Chris Wright when asked about the Elmhurst location. He added that Lucky Motors still owns the Elmhurst building. Elmhurst City Attorney Don Storino said Thursday the

city is still evaluating whether or not Lucky Motors is still in compliance with the agreement. Marilyn Gaston, Elmhurst director of finance and administration, said the city has paid Lucky Motors $144,635.16 to date. According to the agreement, if the dealership relocates its operations outside of Elmhurst within five years, it owes the city all of the money it’s been rebated. The provision is called a clawback. Storino said that in the past five years he has been in Elmhurst, none of the city’s sales tax incentive agreements that include a clawback have been defaulted on that he can remember. When asked if Lucky Motors had broken the Elmhurst sales tax incentive agreement, Wright said that was between him and the city. The Villa Park Lucky Motors, located at 225 West Roosevelt Road, entered into another sales tax incentive agreement with Villa Park in November 2013. Per the Villa Park agreement, the village rebates Lucky Motors 50 percent of the sales tax it generates each year for seven years, similar to the Elmhurst agreement. However, the Villa Park agreement does not establish a maximum payout per year or overall. For the three years following the 50 percent rebate, Villa Park will rebate 25 percent of the sales tax generated back to Lucky Motors.

To the Electors of the State of Illinois: The purpose of a state constitution is to establish a structure for government and laws. There are three ways to initiate change to the Illinois Constitution: (1) a constitutional convention may propose changes to any part; (2) the General Assembly may propose changes to any part; or (3) a petition initiative may propose amendments limited to structural and procedural subjects contained in the Legislative Article. The people of Illinois must approve any changes to the Constitution before they become effective.

PROPOSED AMENDMENT TO SECTION 8.1 OF ARTICLE I OF THE ILLINOIS CONSTITUTION ARTICLE I – BILL OF RIGHTS SECTION 8.1. CRIME VICTIMS’ VICTIM’S RIGHTS. (a) Crime victims, as defined by law, shall have the following rights as provided by law: (1) The right to be treated with fairness and respect for their dignity and privacy and to be free from harassment, intimidation, and abuse throughout the criminal justice process. (2) The right to notice and to a hearing before a court ruling on a request for access to any of the victim’s records, information, or communications which are privileged or confidential by law. (3) (2) The right to timely notification of all court proceedings. (4) (3) The right to communicate with the prosecution. (5) (4) The right to be heard at any post-arraignment court proceeding in which a right of the victim is at issue and any court proceeding involving a post-arraignment release decision, plea, or sentencing. make a statement to the court at sentencing. (b) The victim has standing to assert the rights enumerated in subsection (a) in any court exercising jurisdiction over the case. The court shall promptly rule on a victim’s request. The victim does not have party status. The accused does not have standing to assert the rights of a victim. The court shall not appoint an attorney for the victim under this Section. Nothing in this Section shall be construed to alter the powers, duties, and responsibilities of the prosecuting attorney The General Assembly may provide by law for the enforcement of this Section. (c) The General Assembly may provide for an assessment against convicted defendants to pay for crime victims’ rights. (d) Nothing in this Section or any law enacted under this Section creates a cause of action in equity or at law for compensation, attorney’s fees, or damages against the State, a political subdivision of the State, an officer, employee, or agent of the State or of any political subdivision of the State, or an officer or employee of the court. or in any law enacted under (e) Nothing in this Section or any law enacted under this Section shall be construed as creating (1) a basis for vacating a conviction or (2) a ground for any relief requested by the defendant appellate relief in any criminal case.

EXPLANATION The Constitution sets forth substantial rights for crime victims. The proposed amendment expands certain current rights: 1) Victims are currently entitled to fairness and respect throughout the criminal justice process. The amendment would also provide that they shall be protected from harassment, intimidation and abuse. 2) Victims currently can make a statement to the court when a criminal defendant is sentenced to punishment. The amendment would allow a victim to be heard at any proceeding that involves the victim’s rights, and any proceeding involving a plea agreement, release of the defendant or convicted individual, or sentencing. 3) Victims may obtain information about conviction, sentencing, imprisonment or release. The amendment would require prosecutors and the court to notify victims of those events before they happen. The amendment would also grant additional rights to crime victims: 1) A victim would have a right to formal notice and a hearing before the court rules on any request for access to the victim’s information which is privileged or confidential information. 2) A victim would have the right to have the judge consider the victim’s safety and the safety of his or her family before deciding whether to release a criminal defendant, setting the amount of bail to be paid before release, or setting conditions of release after arrest or conviction. 3) The victim would have the right to assert his or her rights in any court with jurisdiction over the criminal case, but would not have the same rights as the prosecutor or the criminal defendant and the court could not appoint an attorney for the victim at taxpayer expense. The proposed amendment would not alter the powers, duties or responsibilities of the prosecutor. Further, a criminal defendant would not be able to challenge his or her conviction on the basis of a failure to follow these provisions.

Elmhurst Partners’ Small Business Institute will offer a two course series starting this fall – Business Series: Starting and Growing Your Business and Communication Series: Using Interpersonal Skills to Get Results. Each series features multiple courses, with fees ranging from $125 per course to $400 for the entire series, according to a city news release.

Give it an annual checkup before cold weather arrives to help add comfort, save energy and cut home maintenance in the long-run. When inspecting your home’s windows and doors, here’s what to check: Inspect interior and exterior finishes: Over time, paint and stain can weather away. Flaking or peeling may mean that it’s time to refinish or replace the unit. When replacing windows or doors, consider factory prefinished wood or fiberglass options from Pella, or vinyl options that don’t need painting or staining, to save time and money. Look for damaged exterior surfaces or signs of leaks: Check your sprinkler system to make sure it’s watering your lawn and landscape, not soaking your windows or doors. Cracked or deteriorated wood may be a sign of water penetration. Leaks can linger and affect interior walls, floors or ceilings, so look closely for discoloration or other moisture signs. If you spot a problem, track its trail. For example, discolored trim around a window might actually be caused by moisture entering a ways away. With a leaky roof, water may run down inside the wall and appear at the window. Contact a professional for help in making home repairs. Clear windowsills and tracks of dirt and debris: Sand, leaves, insects or pine needles stuck in weather-stripping can affect the performance of your windows and doors. Open the windows and clean the opening with a soft brush, like a dry paint brush or vacuum attachment. Do the same for sliding patio doors. Try opening and closing: Open your windows and doors to make sure moving parts work, and units close properly. Replace worn or broken parts.

Inspect weather-stripping: Re-attach loose weather-stripping around windows or doors, and replace material that’s ripped or torn. Replace or repair broken locks: If locks feel loose or don’t work smoothly, replace them. Keep windows and doors locked when not in use. Locks help hold doors and windows tightly, to lock out rain, wind, snow and insects. Inspect weep and breather holes: Weep holes in the exterior of windows, allow excess moisture to escape, while breather holes allow air exchange within certain components. Clear blocked holes of dirt or debris with a wire or toothpick. Check exterior sealants and caulk on and around windows and doors. Pay attention to areas susceptible to rain, water and extreme sunlight. Remove damaged material and reapply sealant. In coastal locations, rinse exterior metal like exterior aluminum trim or cladding: Rinsing exterior metal parts three or four times a year can help extend the life of your windows and doors by minimizing corrosion from salt spray or fog. Feel for signs of air leakage around the window or door: Improperly installed windows or doors can be drafty, decrease energy efficiency, and allow unwanted moisture into your home. To help save on utility bills and keep your home more comfortable year-round, replace drafty old, leaky windows with new, ENERGY STAR-qualified Pella windows installed properly. Weber Grill elevates backyard barbecue LOMBARD – As the season turns and separation anxieties mount at the thought of backyard grills decommissioned until spring, one restaurant always provides a comforting phalanx of professional Weber grills and charcoal at the ready. This year marks the silver anniversary of the Weber Grill restaurant, which originated in Wheeling and today has locations in Lombard, Schaumburg, Chicago and Indianapolis. The restaurants are owned by the Illinois-based grill manufacturer. We visited the Lombard location, a handsome space with a playful motif that pays homage to the early days of the dome-lidded Weber barbecue grill invented in 1952. There are vintage photos in the dining room, a chronological display of actual grills above the bar in the Smokey Joe’s lounge where myriad TV screens are tuned to sports, and a life-size sculpture in the foyer of the grill’s creator, George Stephen, cooking on his Weber in front of the open kitchen. Outside the restaurant is a towering giant of a kettle grill, its sheer size lending an amusing exclamation point. The dining room has an inviting clubby feel, with an exposed-beam ceiling, wagon wheel-style chandeliers above the tables, expansive leather banquettes and ultra-comfortable, upholstered booths. A stone fireplace and rich wood accent the space. We opted for a booth, and our helpful server soon delivered warm pretzel rolls with a tangy cheddar butter. Steaks, barbecue, burgers, grill-fired pizza and seafood dominate the menu, but I didn’t need to ponder all the choices. I had to try the signature pork ribs with hickory barbecue sauce, and they did not disappoint. The tender, fall-off-the-bone meat was flavorful, and the sauce hit just the right notes of zesty, smoky

Served with our dishes was a thick slab of cornbread bursting with the just-picked flavor of high-summer sweetcorn with a hint of added sugar. My dinner date had chosen the two-item combo, picking the signature ribs along with the hardwood-slow-smoked pulled pork, which he praised

We were getting full, but couldn’t resist the seasonal creme brulee, whose flavor of the day was peach. We happily crunched through the crackling caramelized sugar atop the creamy custard. Splitting dessert does wonders to assuage the guilt of picking a rich confection. We paired dessert with a tasty cup of cappuccino prepared with Lavazza espresso coffee from Italy.

Productive pair By DAN SANTAROMITA dsantaromita@shawmedia.com ELMHURST – With the offense York is running this season, it’s hard for defenses to know which runner is going to hurt them, but there’s a good chance it’s going to be an Alexander. Dukes running backs Morgan Alexander, a senior, and Lucas Alexander, a junior, have both had big games this season. The two brothers are two of the bevy of rushers that are featured for York. A rare bright spot in the 49-8 loss at Oak Park-River Forest on Sept. 26 came when Lucas ran in for a touchdown and Morgan followed by running in the ensuing two-point conversion. The Dukes have yet to play a game where one of the Alexanders, if not both, are not making a big impact. Both players scored touchdowns in York’s first two games. In Week 3 at Hinsdale Central, Morgan had a break-

out game with 131 yards and a touchdown against a tough Red Devils’ defense. The next week against W i l l o w b r o o k , Lucas L u c a s b u s t - Alexander ed out for five touchdowns and 190 yards. The idea behind the running offense that firstyear coach Matt Monken has in- Morgan stalled this sea- Alexander son is that multiple runners can be productive. The Alexanders have both taken advantage of that. “I think the strongest point is that it can hit you from a bunch of different spots,” Morgan said. “It’s not a very predictable offense.” The brothers claim there is no sibling rivalry or competition over stats, simply a desire to win. thing because in this offense it’s not very predictable which runner will get more opportunities. “In this offense some games the fullback is going to get the ball a lot and some games the wings are going to get the ball a lot,” Lucas said. “It depends on the defense we’re playing and what they do.”

This is the first year the Alexanders have played organized football on the same team. Morgan started playing in fourth grade and the next year, when Lucas entered fourth grade, he started playing as well. While playing for the Elmhurst Eagles youth program the two moved to various po-

sitions on both sides of the ball. Lucas even played quarterback as recently as freshman year. However, it’s clear now that the two found a good home at running back. “I think it suits me the best,” Lucas said of his current position. “I definitely like it the best.” Morgan is listed as 5-foot7, 175 pounds while Lucas is a skinnier 5-foot-8, 155 pounds, but both play the game the same. “I think we’re pretty similar,” Morgan said of their running styles. “There’s not much difference.” No matter which back has the hot hand, York is hoping to make the playoffs. Three wins in the final four games would clinch a spot while two wins could be enough if the Dukes can get into the postseason on playoff points. “I think we’re satisfied with [our 3-2 start],” Morgan said. “I think we expect more down the road, though.”

The Knights picked up their biggest win of the season by beating previously undefeated Aurora Central Catholic 30-23 Sept. 26 on the road. Now, a 2-3 IC team takes on another Metro Suburban West team in Riverside Brookfield. The Bulldogs, which have the biggest enrollment in the conference, travel to Elmhurst for a Saturday showdown. Krefft mentioned RB running back Matt Chapp as a player to watch, but Chapp wasn’t the only player Krefft knows his team needs to watch. “Riverside Brookfield is very athletic,” Krefft said. “There’s a good running back, there’s a couple good linemen on that team that we’re really concerned about. They have numbers, so there’s some things we have to take into

consideration with depth. I think they’re a fast team.” As for the Knights themselves, sophomore running back Jordan Rowell continued his big season with four touchdowns against the Chargers, including the game-winning touchdown in the final minute. Rowell’s big year so far has been thanks in large part because of the play of IC’s veteran offensive line. The plan will be to rely on them against the Bulldogs. “Up front on both sides of the ball we’re starting to play like we’re supposed to,” Krefft said. “We’re going to put it on their shoulders. That’s where the seniors are.”

It’s all about the same in NFL It seems like for the past decade, or even two, we’ve been debating the quality of NFL teams. Has pro football become truly mediocre, with no more than two, three or four teams really worth getting excited about? Or is everybody just that good? Many of us spent the better part of May, June and July bemoaning the difficulty of the Bears early schedule this year, with six of the first nine games on the road and five of those against 2013 playoff teams. Nobody wanted to listen when I warned everyone to relax, and tried to remind Bears fans that the way things change overnight in today’s NFL, that schedule might look a lot different by the time the Bears actually get to play it. Here we are just four weeks into the 2014 season, and not one of those teams the Bears face over their first nine games is over .500. The San Francisco and

Carolina teams that were the second and fifth seeds in the NFC playoffs last year, and ranked third and second respectively in scoring defense, are both 2-2 and now rank 13th and 17th in points allowed. We feared the Jets and Falcons could be extremely difficult road trips and yet, through four weeks, New York is 1-3 and resides in the Bears win column, as do the 49ers, and the Falcons are 2-2, but currently ranked 31st in the NFL in total defense and 29th in points allowed. Miami was a popular AFC preseason wild card pick. The Dolphins started out on fire this year, upsetting the Patriots. But then they were embarrassingly bad, getting stoned in Buffalo and spanked at home by a Chiefs team that was 0-2 at the time. The Dolphins whacked the Raiders in London to get back

Buffalo was viewed as a rare winnable game for the Bears in their opener at Soldier Field, yet they found a way to lose. Buffalo went on to beat the Dolphins in Week 2, but then fell apart against San Diego and Houston to drop them to 2-2. The Patriots still lurk at home for the Bears in Week 8. We suspect they’ll be pretty good by then, but all we know at the moment is they struggled to get by the Raiders in Week 3, and Oakland is almost certainly the worst team in the league. Finally, there are the Pack-

ers, who’d been atrocious on defense and struggled to run the ball before coming to Soldier Field and letting the Bears run up 496 yards of total offense on them. Yet, they still found a way to beat the Bears, and by three touchdowns. Is there a lesson in any of this? Only that the Bears are about six or seven plays over four games away from being 4-0, or 0-4. As of this writing, they were seemingly like everyone else – of course, 2-2. And one more thing. Through four games, we still really have no idea who the Bears are, or who their main competition is going to be as they fight for a spot in the playoffs. It appeared after four weeks that the Bears offense was capable of playing with the best in the NFL. Or are they? For all the plays the Bears seem to have made and all their trips up and down the field, they were just 19th in the league in total offense and 16th in points per game through four weeks. Can that get a team to the playoffs, particularly when it’s

22nd in defense and 22nd in points allowed per game? In today’s NFL it can, as long as the team makes a few big plays along the way, and as long as the bulk of its competition is as mediocre as the Bears are. The Bears should continue to get better on offense. Defense is the big question. As the Bears learned from the Packers in Week 4, shootouts are awfully hard to win and even harder to control. But if you can score points, it only takes a few plays a game on defense in this league to steal wins. The good news for the Bears through the first quarter of the season is that other than perhaps Seattle, there’s no one in the NFC who’s going to run away and hide from them. The final question is, can they be just a little bit better than the rest, because there’s still plenty of time left, and it doesn’t take much in the NFL today.
