PROPOSEDAMENDMENT TO ADD SECTION 25 TO ARTICLEI OF THEILLINOIS CONSTITUTION ARTICLEI— BILL OF RIGHTS

TheIllinois Constitution establishesa structure of government and laws for the State of Illinois. There are three ways to initiate change to theIllinois Constitution:(1)a constitutional convention may propose changes to any part;(2) the General Assembly may propose changes to any part; or (3)a petition initiative may propose amendments limited to structural and procedural subjectscontainedin the Legislative Article. The people of Illinois must approve any changes to theIllinois Constitution before they becomeeffective. The purpose of this document is to inform you ofproposed changes to theIllinois Constitution and to provide you with a briefexplanation anda summary of the argumentsinfavor of and in opposition to the proposed amendment.

The proposed amendment, which takeseffect upon approval by the voters,adds Section25 to the Bill of Rights Article of theIllinois Constitution The new section willguarantee workers the fundamentalright to organize and to bargaincollectively and tonegotiate safety conditions,wages, hours, workingconditions, and economic welfare. The amendment prohibits the passage of any new law within the State that restricts orprohibits workers from engaging incollective bargaining withtheiremployer overwages, hours, and other terms andconditions of employment,like safety protocols or training.

Arguments In Favor of the Proposed Amendment

This amendment will protect workers’ and others’ safety That includesguaranteeing nurses’ right to put patient care ahead ofprofit and making sure construction workers can speak up when there’sa safety issue. It will protect workers from beingsilenced when they call attention to food safetythreats, shoddy construction, and other problems that could harm Illinoisans This amendment protects firefighters andEMTs who put theirlives on theline to protectIllinoisans It means they get the training and safety equipment they need to do their jobs, and can speak out when theyseea problem without fear ofretaliation This amendment will help our economy by putting more mon ey in workers’ pockets who join together and getraises. That will mean more money goinginto ourcommunities andsmall businesses as people join themiddle class with good-paying jobs.

Arguments Againstthe Proposed Amendment

A fundamental right provided to all citizensunder theFirst Amendment of the United States Constitution is the right to free speech and freedom of association This amend ment prohibits any law orordinance that allowsunion workers tochoosewhether they wish to be a member of theunion or not. Under the2018 United States Supreme Court decision Janus v. IllinoisAFSCME, non-union government workers cannot be required to payunion dues as acondition of workingin the public sector Approval of this constitutional amendment will deny that protection to private sector workers. The amendment also states that lawmakerscould never “interfere with, negate, or diminish” certain rights. These terms are broad andundefined andleave lawmakers without the ability toclarify through legislation. OurIllinois Constitution provides such protection to publicemployees. The result of that protection has been to squashefforts by state lawmakers and votersto addressIllinois’ pension fund deficits.
