Childminders, nurseries and schools can be liable for finger injuries OFSTED has sadly failed to act by not including acceptable researched and safe door safety into a childminders safety criteria. Childminders should be aware that there is statutory legislation and a duty of care required of them in addition to OFSTED’s remit. A childminder can be liable if they have not eliminated the possibility of door injury risk with a suitable solution. A child (via the parent or personally before the 18th birthday) could sue you for allowing their injury. These child victims have a probably 94% chance of winning their case and receiving compensation. Even childminder insurance providers get it wrong. Premium discounts have been offered based upon inferior and worryingly unsafe and untested door shielding devices. These do not eliminate finger injury and can increase risk of fatalities because these devices can compromise doors against building regulations.
