‘Bump’ Clause? Question:
We’re in a hot market and our real estate broker says we should insist on a “bump clause” for any offer we accept. What is a it?
Answer:
Most real estate contracts are contingent arrangements where one or more hurdles need to be overcome before the transaction can be finalized. In some cases, there can be a contingency that says the purchaser will buy the replacement property only when they have sold and settled on their current property. In other words, the buyers do not want to be in the position of owning two houses – and having two mortgages.
A seller in this situation might say “yes” to a buyer sale contingency because it’s better to have a purchaser in hand than to lose a possible buyer. At the same time, the seller wants to move on with the transaction. The seller – not unreasonably – might worry that the buyer’s house might take a long time to close. Meanwhile, the seller is unable to sell the property to other buyers, including buyers who might be willing to offer more money. What to do? The seller might agree to a sale contingent on the sale of the buyer’s current home but with a kick-out clause. The agreement might give the buyer time to sell but if the seller gets an acceptable offer from another purchaser, then the first buyer has a given amount of time – say 72 hours – to get rid of all contingencies except for financing and go forward with the sale. If the buyer can’t meet the deadline, the deal will be terminated and the buyer’s deposit returned in full. In effect, the buyer will be bumped out of line. In addition, there’s likely a second time limit.

This one says if the buyer’s property is not sold by a certain date the owner – but not the buyer – can elect to end the transaction. With a termination, the buyer will again get back the full deposit. Transactions contingent on the sale of the purchaser’s home require a properly-written addendum. An attorney should write or review such clauses for buyers and sellers, they are not for do-it-yourself contract writers. Because you live in a strong market you may benefit from a kick-out clause but as a seller be aware that such clauses are not risk free. Getting rid of buyer #1 might sound great if a better offer comes along, but if the replacement purchaser cannot settle, you’re back to square one.

Devastatingly effective wire fraud scams are becoming more and more common in real estate transactions. Sophisticated hackers are monitoring client and/or broker email accounts and waiting for a window to steal monies from clients. The scammers convincingly impersonate the broker or escrow agent, and then send messages urging the clients to wire funds to fake accounts set up by the scammers. The clients are left with no recourse to recover the stolen funds.

The Truth About PMI
MI coverage is typically required on a mortgage loan when your down payment is less than 20 percent. It serves as a safety measure for the bank/lender in the event you can’t pay for your mortgage, says Mike Mirshahzadeh, chief revenue officer for The Money Source, Melville, New York. “Lenders require PMI on loans because it reduces the risk of loss in the event the loan ends up defaulting,” Mirshahzadeh says. “In the event of a foreclosure on your home, the mortgage insurance company would pay the lender part of their losses.” With a conventional loan, your lender will set up PMI with a private company, which you will pay monthly premiums to, with little to no initial payment needed at closing; with an FHA loan, you’ll pay mortgage insurance premiums directly to the Federal Housing Administration both as an upfront cost at closing and as a monthly premium included in your monthly mortgage payment. PMI fees/premiums are usually calculated based on the amount of coverage the lender requires, which is
determined by risk factors associated with the mortgage – including your credit history, down payment amount, mortgage loan type (fixed-rate or adjustable-rate), and type of loan documentation. David Hosterman, branch manager with Castle & Cooke Mortgage LLC in Greenwood Village, Colorado, says PMI costs on conventional loans range from 0.21 percent to 1.48 percent of the loan amount. “You may be able to opt for a singlepremium mortgage insurance to avoid having monthly PMI. This is typically an upfront charge by the borrower which allows you to buy out of the mortgage insurance for the life of the loan,” Hosterman says. To cancel PMI, you have to earn a minimum of 20 percent equity in your home. You can request that your lender discontinue PMI after you’ve decreased your mortgage balance to 80 percent of your property’s original appraised value. You may be able to eliminate PMI sooner if you refinance, prepay your mortgage (make accelerated payments
