Get Equity QUESTION:

We have a home with a lot of equity and want to sell. Because we expect to downsize, we really don’t need all the cash from a sale to buy a new house. Does it make sense to sell and take back financing from a buyer? Would we get a better price?

ANSWER:

Before the mortgage meltdown, owner take-backs were sometimes used to attract buyers. The seller would offer to take back some or all of the financing in exchange for a reasonable price, a solid interest rate, or both. Buyers often liked seller take-backs because they didn’t have to qualify with a commercial lender and maybe could get financing with nothing down. Today, however, a seller take-back is more complicated than in the past. It’s likely unnecessary and something most sellers should avoid. The complicated part starts with federal rules included under Dodd-Frank. You cannot finance consumer residential real estate unless you’re a licensed loan originator in most cases.

However, there are exceptions for owner-sellers. For instance, an owner/seller can take-back one loan every 12 months. You cannot be a contractor. The loan cannot allow negative amortization. There are other standards and rules—lots of them. For details, speak with an attorney who works with real estate transactions before considering a seller take-back. With a seller take-back, you might be able to get a better interest rate than from other fixed-rate investments. You may be able to sell your home for a premium price. But – and you knew this was coming – there are also concerns. The big ones look like this: First, you want to make sure the buyer makes a hefty deposit, not a deal which depends on “other people’s money” – your money in this case. Second, with a seller take-back, you remain tied to the property. What if the buyer stops making payments? You can foreclose, but how long will that take? What are the costs? Meanwhile, do you have enough income to live comfortably without the incoming mortgage payments? Third, are you confident the buyer is qualified to purchase the property? Have you seen buyer paperwork, tax returns, bank

statements, etc.? Do you know if the buyer has had financial troubles? What about credit history? Fourth, by any chance, is the buyer willing to provide a sale agreement and mortgage? Do you think such paperwork might favor the purchaser? Sign nothing without first getting advice from an attorney. The alternative is this: Let the buyer get lender financing. Then, it’s up to the lender to assure that the purchaser can repay the loan. It’s the lender’s problem if payments are late or the property must be foreclosed. The lender must conform to mortgage regulations. We now live in a period where mortgage rates are low by historical standards. Very low. If a borrower cannot qualify at today’s rates to buy your property, then why would you want to make a loan to that individual? If a lender handles the financing, you’ll get a check at closing for the money due from your sale. You won’t be in the mortgage business. You’ll walk away from the closing table without worries about future payments from the buyer. Or the lack of future payments. It’s a great feeling. Governor Inslee issued a statewide “Stay Home, Stay Healthy Order” (the “Order”) that became effective on midnight on Wednesday, March 25th to limit the spread of COVID-19 (Coronavirus). The order will initially last for two weeks (and may be extended) and requires the closure of all “non-essential critical infrastructure” businesses. Workers that are considered non-essential, must work only from their home. On Saturday, March 28th, Governor Inslee issued certain modifications to the Order for the residential real estate industry that acknowledge the importance of providing housing to the public. The Governor’s directive balances housing needs with the over-riding importance of protecting public health through staying home and social distancing. The real estate brokerage industry shares the Governor’s priorities. The industry’s paramount concerns are safety of the public and the prevention of the spread of the COVID-19 virus. Accordingly, real estate brokers will limit personal interactions to the greatest extent possible and will engage in-person only when necessary, and by following these strict protocols: • In-person activities must be by appointment only; • No more than two people, including the broker, may be at the property at any one time; and • Those two persons must strictly follow social distancing guidelines established by the Centers for Disease Control and Prevention (“CDC”) by remaining at least six feet apart at all times. Real estate brokers, who strictly follow the above protocols are permitted to engage in the following inperson activities related to the purchase and sale of homes: • Conduct listing presentations, take property photos, and create virtual tours for new listings; • Facilitate signing of contract documents; • Preview and show listings by appointment only; and • Facilitate inspections, appraisals, buyer “walk-throughs,” and key delivery. All other real estate brokerage services will be limited to services that the broker can provide from the broker’s home. There are risks associated with leaving the safety of your home and viewing homes for sale, as well as having prospective buyers enter your home. Buyers and sellers must be attentive to and abide by the mandates and guidelines from public health officials and work with their real estate broker to make informed decisions about listing, selling, and purchasing real property. Brokers will exercise their best judgment under the circumstances to provide advice regarding all aspects of the current real estate market. “For a down payment, the bank usually wants to see and verify that the funds are your own – not borrowed money,” says Brailofsky. While it’s possible to take out a cash advance, Kevin Chen, a credit card expert with Finder.com in New York City, strongly recommends avoiding this practice. “First, you’ll incur a high cash advance fee right away. Furthermore, your transaction will start accruing interest immediately – and at a steep annual percentage rate – unlike with normal purchases on the card,” Chen adds. “Plus, the costs you’ll pay to take out a cash advance will largely erase any rewards you earn,

and you could easily end up in the red.” Also, many credit cards award no miles or points for cash advances or balance transfers, “so the benefits are highly unlikely,” says Brailofsky. Here’s another reason why banks, attorneys, title companies, and other vendors don’t accept credit cards: They have to pay a 2 percent to 3 percent fee to accept that plastic, Brailofsky notes. If they allow credit card payments, chances are they’re going to tack that 3 percent fee onto your bill. “Mortgage lenders, in particular, see no reason to provide this convenience, as they don’t want to take this loss,” says Brailofsky. Scott says a mortgage lender may allow you to use a credit card to pay for the monthly mortgage. “But be aware that the lender may charge you 3 percent to process the payment with a card,” Scott continues. “And if you want to use balance transfer checks provided by your credit card company, those transfer checks may also incur a 3 percent to 4 percent fee on behalf of the credit card company.” The moral of the story? Avoid using credit cards to help pay for a home if you can. “If you need extra money, look into getting gift funds from a relative to help defray some of your costs, explore down payment assistance programs offered near you, and look into low-or nodown-payment loans, you may be eligible for,” advises Scott. And instead of using plastic toward the home’s purchase or monthly mortgage, “consider using it for home improvements and utility payments you’ll need to make after you move in,” Chen suggests. If you have a connection with the U.S. military, you’ve probably guessed it: Your buyer might be paying with a VA-backed mortgage loan. Ten percent of all home purchases in 2019 were with VA financing, and that should grow this year, say experts. Sellers in areas with military bases or a strong presence of April 3, 2020

veterans are especially likely to attract a buyer using this financing. With the down payment, the biggest obstacle facing would-be buyers, sellers benefit from the broader pool of purchasers who can tap a no down VA mortgage. Still, sellers should be aware of the special impacts of a VA buyer, notes Cindy Hawks White, president of the Hampton Roads Realtors Association: Greater Appraisal Scrutiny Purchasers using any mortgage will need an independent appraisal

of the home’s value, which is based on what similar properties in the vicinity recently sold for. But, “A VA appraisal tends to be a little more thorough, particularly with respect to the personal inspection of the property,” says Stephen Wagner, immediate past president of The Appraisal Institute. “Appraisers view the crawl space and attics, for example,” Wagner explains. The appraiser looks for close comparisons, making careful note of how, say, a home with a finished basement

compares with a nearby house with a similar basement. High Price Hitch When they select a listing agent, sellers typically interview at least a couple of agents who offer opinions on pricing. If the seller lists at the top of the range, and the VA buyer contracts at or new that price, there’s a greater potential that the appraised value falls short of the purchase contract price.
