Plaintiffs sanctioned in PCB lawsuit Court’s ruling follows ‘unauthorized’ caulk testing at Malibu schools BY JEFFREY I. GOODMAN Daily Press Staff Writer

Sanctions have been imposed on Malibu activists in their lawsuit over the Santa Monica-Malibu school district’s handling of chemical testing and cleanup at Malibu schools. The penalties, handed down by U.S. District Court Judge Percy Anderson in a Dec. 21 hearing, added to the ongoing legal battle between the plaintiffs and the district that stems from the discovery of polychlorinated biphenyls on Malibu campuses about two years ago. The sanctions follow unauthorized independent chemical sampling of caulk by Jennifer deNicola, the leader of America Unites for Kids, according to the court document. The plaintiffs, America Unites and Public Employees for Environmental Responsibility, will not be allowed to use chemical samples they obtained as evidence in the lawsuit, according to the court. process,” reads the court’s analysis. America Unites has also been ordered to pay the district for repairs related to physical damage caused by deNicola’s unauthorized testing. The plaintiffs and the district must file a joint report by Jan. 11 with proposals for the compensation amount. The court also ordered the plaintiffs to pay for SMMUSD legal fees related to the district’s motion for sanctions. The district has until Jan. 11 to outline those fees, although the plaintiffs can challenge the figures by Jan. 19. The case was not dismissed altogether, but the plaintiffs and their supporters were ordered not to conduct any additional testing at Malibu schools without court approval. After failing to secure $100,000 through a regional grant program, leaders hoping to improve wellness in Santa Monica are looking for other ways to fund a holistic health center at Santa Monica High School. Although Santa Monica-Malibu Unified School District officials, City of Santa Monica staffers and other members of the Cradle to Career consortium were disappointed that they didn’t win an LA2050 grant for a so-called Thrive Center at Samohi, they remain committed to providing students with mental health counseling and other support services. “We’re actively pursuing other funding,” said Natasha Kingscote, an administrator in the city’s Community and Cultural Services Department. “We’re looking at a variety of places where we might be able to get funding. ... The $100,000 would’ve been great, but we still would’ve needed to pursue a lot of

You Are What You Paint I FIRST MET FELLOW OCEAN PARK RESIDENT,

Bruno Marcotulli, at the Ocean View tennis courts twenty years ago. I worked for the city checking in players. I remember it because I’m somewhat short at 5’ 8 1/2” (on a good day) and Bruno is somewhat tall at 6’4”. I also remember our meeting because Bruno’s playing partner and girlfriend was highly attractive. Two decades later, Bruno’s current girlfriend, Kelly, is also highly attractive and they’re getting married in June. At 57, this will be Bruno’s 1st marriage. “I’m glad I waited until Kelly arrived,” Bruno says proudly. (And smartly.) Among Bruno’s and my common interests, other than tennis and Sanskrit (joking) was basketball. Bruno played on his Hollywood High varsity team for all three years and ultimately got a scholarship to play Division I at Loyola Marymount University. As an actor, Bruno has been in many commercials, including a United Airlines spot in which he played Bigfoot. In a Dimetapp Cold Medicine commercial he played a guy carrying a giant suitcase and suffering from a giant cold. (“Nobody does “a cold” better than I do,” says Bruno, sounding like Dustin Hoffman in “Tootsie”.) Bruno’s TV credits include his role in the controversial documentary series on FX, “Black.White.” Bruno was brilliantly made up to look black so he could experience how his interactions might change now appearing to the world as an African-American. On HBO, Bruno was in the comedy series “Encyclopedia Brown” about a 10year-old genius who helps fight crime in his small town. With deft comic skill, Bruno played the bumbling but sweet Police Chief Brown who frequently took a pratfall. (And who apparently didn’t have a first name.) Bruno’s also appeared in numerous movies including: “Spy Hard,” “Moon in Scorpio” and “One Tough Bastard” as well as other TV shows such as “Bay Watch,” “MacGyver,” “Murder She Wrote,” “Dragnet,” “Jag,” “Dallas” and “V.I.P.” in which he played Paul the nudist. (Which he insists was not typecasting.) Locally, Bruno has been in numerous Shakespeare productions , at the Miles Memorial Playhouse in Reed Park, including “A Mid Summer Night’s Dream” and “Macbeth.” In April he’ll be performing in “As You Like It.” For many years, Bruno was a beloved grade school substitute teacher on the Westside. But, back in 2007, Bruno began, “An adventure with paint which took [him] on a journey of self-discovery [he] had no way of anticipating.”. Bruno’s written a book about this journey, “You Are What You Paint: Fearless Creativity.” (Since I’m such a procrastinator, maybe I should do a book, “You Are What You Write at the Last Minute.”)

Bruno’s book includes 24 original brightly colored, clown-themed paintings which reflect his personality and views on life. As Henry Ward Beecher (brother of Harriet) put it, “Every artist dips his brush in his own soul, and paints his own nature into his pictures.” Each painting includes humorous commentary in which Bruno dispels the notion that only those who have studied art can enjoy creating it. “If you create art, you’re an artist. I believe we all have something to say and the ability to express it.” Bruno’s journey coincided with a burgeoning movement of would-be artists exploring and expressing their own talents. Of late, I’ve even noticed commercials on TV for “adult coloring books,” which seem to have become the rage. The Paint Lab, a walk-in art studio on 14th Street is a perfect example of this growing trend of amateur artists with their inspiring logo “Experience, Express, Explore.” They offer kids, teens, adults and senior classes and provide all the art supplies necessary. In his book, Bruno names each of his paintings. The titles include “Egg Head,” the “Power of Flowers” and “Love Flows,” a humorous salute to Vincent Van Gogh. The last painting in Bruno’s book is titled “God,” an homage to what Bruno describes as “the creative power of the universe,” which he believes flows through us all. It’s also an encouragement to others, as he puts it, “To feel free to express themselves artistically, without the fear of making mistakes. There are no mistakes in art.” There’s actually nothing more that Bruno would like than to encourage others to tap into their artistic selves. We need a system of guaranteed healthcare where we replace premiums with taxes and everyone has insurance and there’s never any possibility of bankruptcy due to healthcare needs. Under such a system out-of-pocket costs will be non-existent, we won’t have out-ofnetwork costs because there will be a single network, and we will have the ability to control costs without shifting the cost to the individual. We can’t do that under the current system. But we will be able to can do that under improved Medicare-for-All.

other funding opportunities. Unfortunately, that doesn’t go real far.” Kingscote said officials have been collaborating with the L.A. Trust for Children’s Health, a nonprofit that promotes student wellbeing, about possible avenues for bringing a wellness center to Santa Monica’s flagship school. But although the concept for a wellness center at Samohi is moving forward, it remains unclear exactly how it will manifest on campus. Some of the services that would be offered through the Thrive Center are already available to students, while others would require additional funding. The scope of the project hinges in part on the availability of space on the Samohi campus, an ongoing dilemma as school and district officials develop a long-term master development plan. “There are services available, but nowhere near at the level we’d like it to be at,” Kingscote said. “There’s no special designated space. That’s a school district issue if they want to indeed dedicate a building or room to these services. It’s really a long process to plan out and figure out how to fund.” According to SMMUSD spokeswoman Gail Pinsker, district managers, Samohi administrators, facilities managers, nursing staff and a recently hired mental health counselor, as well as representatives from Venice Family Clinic, have been touring other schools with wellness centers to get ideas for the local project. “We are early in a very long process that will include discussions regarding future funding sources and grants,” she said.

A wellness center fits into the Cradle to Career goals of improving mental health, expanding support services and preparing students for college and beyond. As officials secure more funding, Kingscote said, more services can be phased into existing spaces. Additional money, for example, could support a healthcare provider for more hours, she said. She added that she hopes to have a clearer update on the Thrive Center’s progress by the end of the school year. Public voting for the LA2050 grants, which are funded by the Goldhirsh Foundation, wrapped up Nov. 3. The winners in several different categories were announced last month. The top vote-getter in the Thrive Center’s category was Heal the Bay, a Santa Monicabased environmental advocacy group. The organization is partnering with Pacoima Beautiful and the Pacific American Volunteer Association to launch a multilingual conservation project to improve Southern California residents’ understanding of water challenges. In the same category, an LA2050 panel awarded a grant to Iraq and Afghanistan Veterans of America. The group will use the money to support veterans and their families as they transition to civilian life. Although the Thrive Center wasn’t one of the LA2050 winners, Kingscote said it gained exposure through the grant program. “The voting component of LA2050 really helped us put the word out to the community that this is something that Cradle to Career has been working on, and it’s a priority based on the data that we’ve seen,” she said. “These wellness centers are a great model throughout the state and country, and we don’t want to lag behind any further.” jeff@smdp.com

We want to capture as many people’s attention as possible.” However, Lowenthal said that even if you post something at a bus stop that is in a different color than anything else that has been posted there, people still may not notice it. “So we’ve tried to communicate through prints, through social media, with the above head messages that you’ll see on the bus. We have the onboard announcements that have been playing. We think with all of these points of contact, one of them will grab someone’s attention.” While the fare rates may not have changed over the past five years, BBB has implemented other changes, such as NextBus, TAP card system and 3-position bike racks. Regular priced day-passes that allow unlimited rides in a calendar day will remain at $4 and will require an upgrade fee of $1.25 on the Rapid 10. Patrol officers assigned to the downtown area were stopped along the curb on Ocean Avenue facing the intersection with Colorado Avenue, monitoring traffic at that location. At about 7:59 p.m., the officers were alerted by the Automated License Plate reader in their vehicle that a stolen Hyundai Accent had just driven past them northbound on Ocean Avenue. The officers located the vehicle and followed it for several minutes while they verified it had been reported stolen, and also to wait for additional officers to arrive. The officers stopped the car in the 2500 block of Neilson Way and detained the driver (suspect Jurnell Davis), front passenger (suspect Constance Harris), and additional adult passenger, and two small children. During the investigation, Davis provided a false name to the officers. Harris rented the vehicle on Dec. 6 and was supposed to return it by the 21st. The vehicle was reported stolen three days later when Harris failed to bring the car back to the rental agency. Davis was arrested for providing a false name to the officers and Harris for vehicle theft. Both were transported to the station for booking. Harris, 28, of Los Angeles, had bail set at $35,000. Davis, 25, of Los Angeles, had bail set at $5,000.
