How will El Niño impact the homeless count? Inclement weather could affect Santa Monica data BY JEFFREY I. GOODMAN Daily Press Staff Writer

With El Niño bringing a series of rainstorms through Santa Monica, local social service providers have seen more homeless people coming through their doors for shelter and warmth. “Especially in the morning, if they've been out in the rain at night, they want to come in and get dry,” OPCC executive direc-

tor John Maceri said. But exactly where those people will be on Jan. 27 is anybody's guess. That's the day of Santa Monica's annual homeless count, when hundreds of volunteers attempt to capture a snapshot of homelessness in the area. Count participants will tally people living in local shelters, but their decidedly bigger challenge is sweeping the city's underpasses, overhangs, alcoves and vehicles to get an idea of how many people are living on the streets.

Last year's count found that 402 of the city's 738 identified homeless people were living on the street. But Maceri, whose nonprofit organization operates several shelters while offering case management, counseling and a variety of other services, said inclement weather could impact the numbers this year. He noted the possible effect of the Los Angeles Homeless Services Authority's winter program, which launched in 1994 to provide temporary shelters during the colder

months of the year. The shelters are located across the county from November through March, but none of them are in Santa Monica. (The closest one is at 1300 Federal Ave., east of city limits.) As part of the winter program, a shuttle picks up homeless people near the intersection of Ocean Front Walk and Market Street in Venice and takes them to temporary shelters. SEE HOMELESS PAGE 8

For Josh Paget, Santa Monica seemed like an ideal place for hosting screenings of short movies about urban planning.

The city recently launched Breeze, a bikeshare program that officials hope will reduce traffic congestion. The Expo Line extension, which is scheduled to open this spring, will allow residents to travel to Culver City and Downtown Los Angeles while welcoming visitors and tourists from around the region.

And ongoing construction has sparked contentious debates over the future of the beachside city. “Santa Monica is a hotbed for new urbanism projects,” Paget said, “especially with the Expo Line coming in and a lot of stuff going on in Downtown Santa Monica

Its a major reason we have a well-funded local government and great public services in Santa Monica - in large part from the tax dollars generated by our tourism and visitor-oriented service industries. But it's also about the karma of what we do with this blessed opportunity. We in Santa Monica have long prioritized keeping our public spaces open, clean, safe and accessible; ensuring that at least some local dining, arts, culture, entertainment and recreation is affordable; and providing top level public transit to get here. We've also made environmental stewardship a key priority, evidenced by our internationally renowned Sustainable City Plan. THE WORKERS

Along with those who invest in businesses and property in Santa Monica, part of our local wealth is created by those who work here. We don't want our public services to be funded on the backs of underpaid workers, so there's a broad local movement that recog-

nizes and supports workers rights and fair wages for all. Which brings us to Tuesday night's Council vote on establishing a citywide minimum wage of $15 an hour for all non-hotel businesses (plus certain other benefits) by 2020 and $15.37 for hotels by 2017. Santa Monica isn't the first city to pass a local minimum wage law - many others across the county have already done so (http://www.nelp.org/content/uploads/CityM i n i m u m - Wa g e - L aw s Recent-Trends-EconomicEvidence.pdf). In 2015 both the City of Los Angeles and Los Angeles County (for unincorporated areas) enacted laws to establish their own $15/hour minimum wages. But Santa Monica is among the first poised to enact a truly comprehensive ordinance that looks at all working conditions and benefits together, not just an hourly wage. That's where interesting public policy choices come in. PAID SICK LEAVE

This can lead to health problems for workers and their families, job loss if illness prevents workers from attending their jobs, and broader public health implications if it encourages workers to put off treatment until their condition becomes serious. California state law requires employers to provide at least three days of sick leave per year. The City Staff recommendation supported by many in the local business community and by worker advocacy groups - goes beyond this to require at least five days for businesses with 25 or fewer employees, and nine days for businesses with 26 or more. So far so good. But strong retaliation protection is also needed for employees taking paid leave. Exercising our rights under the law can't lead to harassment and intimidation. We have such anti-harassment protections in place for tenants asserting their rights in their apartments. We need the same for workers in the workplace.

One of our long-term community goals has been to have affordable entertainment, recreation and dining on the Pier and beach. Yet the largest employers on our Pier and the operators of all of our beach bike path restaurant/bike rentals has stated if the $15/hour minimum wage were to apply to them, they would not be able to employ the same number of extra peak demand workers they need during summer and holidays, without substantially raising their prices. At the same time, youth employment today is very different than what may have been the case in the “Leave It To Beaver” days of the 1960s. Today, increasing numbers of youth workers have a wider and deeper range of financial and other responsibilities, and often struggle with making ends meet. This is a case where competing public policy goals conflict. How to square the circle? No city in the state has an exemption for seasonal workers. Yet state law provides for a “learner” exemption, defined as someone working for the first time in an activity in which they have no previous or similar experience. City Staff recommends a learner exemption that would require employers to pay 85-percent of the minimum wage for 480 hours or six months, whichever is sooner - main-

taining an incentive to hire first time seasonal workers and helping Santa Monica employers cope with seasonal employment cycles. WAGE THEFT, TIP PROTECTION AND “SERVICE” CHARGES

Wage theft - often associated with Third World sweatshops, is widespread in C a l i f o r n i a (http://www.labor.ucla.edu/ wage-theft/). Some employers pay less than minimum wage, don't pay overtime, refuse to allow meal and rest breaks, deny paid sick leave, and steal workers' tips. Despite strong labor laws, these practices persist because of insufficient enforcement. When workers report violations, the process can take years. The businesses that are responsible can shut down or change names. The result is that many workers who hold a court-ordered claim to receive their unpaid wages never see a dime. So any new law will need to ensure that benefits are truly realized by those they are intended for. City Staff recommends a rigorous education and enforcement program, contracting with the Los Angeles County Wage Enforcement Program to implement it. Again so far, so good. But under current state law, there's a loophole by which an employer can add a “service charge.” All of that can go to the employer, even if it appears on the bill where

customers normally pay a tip. City Staff recommends requiring that service charge proceeds go to workers who participate directly or indirectly in the chain of service; including back of house workers (i.e. in the kitchen) in the restaurant industry. At the same time, City Staff proposes that employers can continue their practice of adding other surcharges, such as for health care. There is a bait and switch/lack of truth in the advertising aspect to these surcharges when they are not presented up front. There is also something inappropriate about insinuating that health care costs are an “extra,” somehow separate from other operating costs. Despite concerns about sticker shock from local businesses, it is the consumer's right to be informed of all costs up front before deciding upon a purchase, and to be clear where the money is going. For this reason, I would accept this political compromise for today, but vote to phase it out over a period of years and require rigorous reporting to employees and consumers in the interim. But since I'm not on the City Council, even if they don't make this improvement, I would still support the ordinance for the greater good. SUPERSESSION AND PROTECT-

night. More socialism-based policies and the ongoing screwing of Santa Monica residents and taxpayers are on the agenda. Item 7-C continues City Hall's decadeslong agenda of setting minimum wages for anybody and everyone who works within city borders. When low-educated, under qualified, or entry level workers can earn $15 an hour by 2020 ($15.37 for hotel union workers by 2017), then wages for everyone else will also have to be adjusted upward. A few years ago, a local restaurateur said that if he had to pay a dishwasher $15 per hour, he'd have to raise pay for all his employees. It amounted to hundreds of dollars in increased weekly payroll costs across the board. This meant raising prices and risking losing customers or the business, itself. People on fixed incomes, such as social security or fixed pensions, see their buying power diminish and are forced further down the economic scale. We trade one group young, entry level workers (who can probably find a job, but maybe at a lower wage than they'd like) being forced deeper into poverty for another demographic like seniors and the disabled who have no way to reverse their increasingly dire economic circumstances. Why adopt regulations favoring just one elite class of workers? I'm talking about Here Unite, Local 11 hotel workers. This initiative has nothing to do with poverty and everything to do with political payoffs. The Santa Monicans for Renters' Rights political organization that controls City Council depends on the hotel union for campaign workers and other support at election time. SMRR even recently appointed two key Local 11 organizers to its Steering Committee. The union wields clout and SMRR will obviously pander to its demands. Meantime, voters and residents pay through poor governance, higher taxes and fees and less citizen-serving services. Speaking of higher taxes and fees, another item on tomorrow's council agenda is Item 8-A. It asks council to provide direction on a report prepared by the city's Housing Commission regarding potential sources of funding for affordable housing and to review potential financing opportunities for creating it. With the cessation of Redevelopment Agency funding a couple of years ago, City Hall allowed developers with low income apartments in their projects, or that set aside money for a low income housing fund, to build much taller and denser projects than would be normally allowed under code. Developers factor the costs of the lowincome units rents for their market rate units to maximize return. A well-intentioned but failed policy that's driving middle class tenants out of the local rental market and producing a two-tier housing system - one for the wealthy and the other for folks near the bottom of the economic scale.

Economists Benjamin Powell and Edward Stringham conducted a recent study for the Reason Public Policy Institute and determined that housing starts in eight California cities dropped off significantly after inclusionary zoning went into effect. In the seven years before the law was implemented, over 28,000 new homes were built. In the seven years after, only 11,000 were constructed. Of those, only 770 were “affordable.” 17,000 homes were never built, exacerbating the housing shortage at all price levels while driving prices out of the reach of even more buyers. Nevertheless, council is reviewing the following options for raising funds to build more “public” housing as opposed to things like renovating our water infrastructure or giving property owners (and renters) a break on the cost of city services such as water, trash and sewage fees. Council could cut current services paid for through the General Fund to save money that could be used for new low-income housing. Three options would require majority voter approval. Attempt to pass a documentary transfer tax, currently $3 per $1,000 of real estate sale value to generate $2.4 Million for each $1.50 increase. Institute a tax that would equal 5percent of calculated value of all commercial and for-profit multifamily construction with a companion measure requesting that funds be spent on affordable housing. Which could raise up to $7.5 million annually. Increase in the 9.5-percent sales tax on retail goods. A quarter percent increase would raise $7.5 million annually. Keep in mind that there will also likely be a measure on the November ballot asking voters to approve another increase of the County's portion of the sales tax to pay for additional Metro transit projects, and to issue a $100 million general obligation bond, paying for it by imposing a $220/year per property tax for a 30 year period. That requires 2/3 voter approval as would a new parcel tax of $334/year per property to raise $8 million annually. Other options under consideration but not likely to win approval for various reasons (insufficient income, etc.) include increasing the hotel transit occupancy tax, currently at 14-percent, to bring in $3 million for each one percent increase, raising the utility user tax on gas, electric, phone, cable TV, etc. from its current 10-percent. Each one percent increase in the UUT would bring in $3 million for low income housing. Lastly, increase the current 10-percent tax on parking fees, but each percent jump would only raise $1 million, annually. This is another one of these cases where the public be damned. I doubt that the majority of residents will cough up increased taxes/fees to build more large and unattractive developments for out-of-towners who want to but can't afford to live here. Many Santa Monicans have recently received mailers from a new group called the One Fair Wage Coalition, claiming to support a minimum-wage law in concept, but implying Santa Monica's would be unfair to workers. Upon what basis? - the law's union supersession clause, something already part of Santa Monica's 2005 Living Wage ordinance for City Contractors (https://www.smgov.net/uploadedFiles/Dep artments/Finance/Ordinance.pdf) and several City development agreements. Union supersession clauses are common in many city and county living wage ordinances around the country (https://ilsr.org/rule/living-wage/2092-2/). They provide that some or all of the conditions of a minimum or living-wage ordinance may be “superseded” by a collective bargaining agreement. Such supersession clauses could allow unions to negotiate a more dynamic package of wages and benefits that better fit a particular industry or workplace, where total compensation and the quality of working conditions negotiated might be higher than the minimum wage. But the main reason for

them is to insulate wage increases from legal challenge - local collective bargaining agreements formed while new wage floors were in place would be protected (http://inthesetimes.com/working/entry/18083/labor_uni on_exemption_minimum_wage_la ). If there is a referendum campaign against Santa Monica's minimum wage law by this new group - which has not revealed its members nor its funding, but is represented by an opponent of Los Angeles' minimumwage law - expect this to be the element they seek to misrepresent, rather than taking on the minimum-wage increase itself.

Many people have been curious about the barrage of confusing messages about our minimum wage law. Thanks for asking. You're right to be puzzled by what's really going on here. The LA Times ad and the multiple mailers are being paid for with national anti-union money. The local “leader” of their movement is a political operative who's been active in fighting the City of LA's minimum wage law, and that's what he's really doing here. Your City Council, along with our staff, community members, and local businesses, have been working for over a year on the most progressive minimum wage ordinance in the country. Early on, we committed to the same regional $15 wage as LA City and County. That wage level is not in question. Further, we are guaranteeing workers sick days, and making sure that service workers don't have their tips skimmed by employers or eliminated by mysterious “service charges” controlled by the employer. We have written a law that is fair and enforceable. So why are anti-union dollars being lavishly spent to make it look as if the Council isn't going to support workers? We are adamant that workers should fully retain the right to organize in the workplace, form bargaining units, and negotiate their own contracts with employers. Because wages are a key issue in such negotiations, we feel the workers must have the choice whether a certain dollar figure is more important to them and their families than unionnegotiated benefits like health care, predictable work schedules so they can be home with their children, etc. Therefore our Santa Monica minimum wage law will allow willingly negotiated union contracts, in which the workers participate and decide their own terms. Corporate employers don't want this. They realize that the $15 dollar wage is fair and broadly supported in the community, and are trying to pervert that support into an attack on unions. They know that our law will pass. They're not trying to get Councilmembers to vote for it. They're trying to get us to gut it by removing the workers' right to organize. We're not going to do the bidding of corporate interests, of course, and can only hope that when community members hear the real story Tuesday night many of the 6,000 who were misled into sending supportive postcards for the anti-union “petition” will openly rescind their support and come down on the side of the workers, where we all should be united. Corporations don't need another tool to fight unions.

Hulu has begun transforming Santa Monicans relationship with the road by giving residents, workers, and visitors a new option for moving around the city in 2016. Every week hundreds of new users are choosing bike share for short trips around town because the system is convenient, flexible, and easy-to-use. Breeze offers 500 bikes and 70 stations throughout Santa Monica-with more on the way, including stations in nearby Venice. Since launching last November over 5,200 people have joined the bike share program, taking 19,887 trips and traveling 44,260 miles on the City of Santa Monica owned system. This equates to an estimated 2,003,868 calories burned and 44,176 lbs. of carbon kept from the atmosphere. Bike share is an important component in the City's overall strategy to offer sustainable transportation options that reduce congestion and greenhouse gas emissions, and improve mobility, community health, and the overall quality of life in Santa Monica. Bike share's arrival has helped raise awareness about bicycling as an attractive form of transportation. City officials expect membership to continue to grow with other mobility improvements in 2016--like the spring arrival of the Expo Light Rail and expansion of the bike network throughout the city. Through the first year of operation the City and system operator will be fine-tuning the bike share system to maximize operational efficiency, customer usefulness, and safety. Such adjustments could include station relocations or expansions, website and mobile app changes, new membership programs or offers, and events or unique opportunities to ride. As more and more people take to the streets on Breeze bikes, here is a list of things you need to know to Breeze like a pro in 2016: 1. Choose the best plan for you: Breeze offers numerous membership plans to help minimize the cost to users, including “payas-you-go” (pro-rated 10/min), monthly (30 or 60 daily ride time), or annual (30 or 60 daily ride time) memberships. When choosing consider how often you plan to ride, how long your trips will be, and how often you would like to pay for your membership. 2. Know the system area: The Breeze system area extends north to San Vicente, south to Venice Blvd, and east to I-405. The smart bike technology allows you to ride beyond those boundaries, however an additional $20 convenience fee will be charged if the bike is locked outside of the system area. Bikes can be put on hold outside the system area without incurring the convenience fee. 3. Secure your ride. Use the hold feature:

NEW IN TOWN: The Breeze bikeshare program is a new option for getting around the city.

Placing the bike on "hold" temporarily suspends the bike for an hour so users can visit local businesses. The timer remains ticking, and the user is charged as if they are riding the bike (pro-rated 10/min). This option is convenient if there is no hub nearby or if there are no bikes at a close by hub. Using the "hold" option allows users to assure that they will have a bike when they are ready to continue their ride. The hold feature is especially useful if you are outside of the system area. 4. Don't forget the lock or “u-bar”: After the lock u-bar is removed from the bike, place the u-bar in its holster. The holster is located on the left side of the bike if you are standing behind the bike facing the back wheel. It is mounted to the rear controller panel of the bicycle. To properly holster the u-bar, slide the u-bar into the slots with the prongs facing the ground. 5. Out-of-hub fees are in effect: Smart bike technology allows users to lock Breeze Bikes to any public bike rack in the system area (not only Breeze hubs) when there is no hub nearby. However, to encourage use of Breeze hubs and to reduce operational costs, a $2 convenience fee is charged for using this feature. To avoid out of hub fees, return bikes to hubs or use the hold feature during short stops. 6. Collect bike bounties: Bikes that are locked outside of a Breeze hub can be returned by any user to a hub for a $1 credit to your account, which can be used toward ride time overages or out of hub lock-ups. 7. Help us maintain the fleet. Report broken bikes: You can report a broken bike by using the bike's back panel controller upon lock-up, or on your mobile app by selecting the repair icon (red triangle with an exclamation point) and typing a brief description of the problem before submitting. Why do green groups oppose the TPP? Dear EarthTalk: Why do many green groups oppose the Trans-Pacific Partnership (TPP) governing trade in the Pacific?

THE TRANS-PACIFIC PARTNERSHIP (TPP)

is an international agreement that seeks to unite the economic interests of 12 countries that border the Pacific Ocean by lowering trade tariffs and establishing an international trade court to settle disputes. TPP emerged as a West Coast equivalent to the proposed Trans-Atlantic Trade and Investment Partnership, designed to ease trade restrictions between the U.S. and Europe. But TPP has progressed much faster thanks to the willingness of Pacific nations to “play ball.” International negotiators released a draft of the TPP agreement in October 2015 and are awaiting approvals from participating governments. However, despite the theoretical advantages of more fluid international

trade, the current draft has several complications that could lead to a variety of problems for participating nations and others, meaning its implementation is far from a sure thing at this point. Green leaders criticize the Obama administration and negotiators from other countries for keeping early talks on the formation of the TPP closed to observers and media. Many individuals and public interest groups requested access to the discussions, fearing that the agreement would unfairly favor large corporations. However, those appeals were ignored and the drafted document revealed what many feel was a prioritization of corporate interests over health and environmental concerns. Without any enforceable guarantees for environmental protection, the TPP could actually significantly contribute to global warming through increased exportation of U.S. fossil fuel supplies. Additionally, differences in national policies regulating chemical use, artificial fertilizers and seeds from genetically mod-

ified organisms (GMOs) have yielded an agreement that encourages minimal protection. The non-profit Public Citizen points out that existing U.S. regulation of pesticide and GMO labeling on packaging could be challenged in the international court as “trade barriers.” Another point of contention is the distinct advantage given to foreign corporations under the current TPP model. Overseas firms would be able to sue the U.S. government over new policies that disrupt the company's “expectations.” Perhaps more troubling is what's not included in the document, which fails to mention how it will protect from over-harvesting of limited natural resources. Green groups point out that, while the TPP accounts for nearly a third of global fish harvest, there are no provisions to protect against overfishing. The draft also barely mentions enforceable safeguards of endangered species products, such as elephant ivory. Yet another issue critics say is woefully

Clearly, the current draft of the TPP agreement needs a lot of work before Congress should even consider it. The winning short films from the 2015 festival are scheduled to be shown Feb. 24 at Laemmle Theatres' Monica Film Center in Santa Monica. The screenings were originally scheduled for Jan. 13, but the theater is currently being renovated. Paget said he's hoping that Rick Cole, Santa Monica's city manager, will be able to attend the film festival's upcoming screening. During his time as a deputy Los Angeles mayor, Cole served as a keynote speaker for a NUFF event in Los Angeles. Focusing on mixed-used development, transit-oriented design and walkable cities, the festival's movies are meant to foster discussions about public policy. Paget hopes those conversations lead to decisions that help citizens navigate their cities more efficiently. “We want to encourage people to think about how the built environment affects every aspect of our lives,” he said. Paget isn't exactly an urban planning expert. He's a Los Angeles-based stand-up comedian who studied creative writing at Seattle Pacific University and screenwriting at the Los Angeles Film Studies Center. But

Elderly people who live in walkable areas are more likely to be able to stay in their homes as they age, Paget said. Another festival film, “The Edge of Memphis,” documents the work of an incubator program for start-up businesses in a section of that Tennessee city. The goal, Paget said, is to find out what works and what doesn't. For example, are parking-protected bike lanes in New York City affecting cycling traffic? Are they having an impact on local businesses? “People can make more informed decisions,” he said. “You can see projects occurring in other cities and around the world and how they turned out, how it developed, how it was followed through on and what effect it had. ■ (1) A tractor-trailer driver with a load of bottled water tried to make it over a historic bridge in Paoli, Indiana, on Christmas Day, with the obvious outcome when 35 tons of water starts across a limit-6-tons span. The driver told police she saw the 6-ton sign but did not know how that "translated" to pounds. (2) Among the activists denouncing a proposed solar-panel farm at a December Woodland (North Carolina) Town Council meeting were a husband and wife certain that vegetation near the panels would die because the panels would (the husband said) "suck up all the energy from the sun." His wife (described as a "retired science teacher") explained that the solar panels prevent "photosynthesis" (and also, of course, cause cancer). The council voted a moratorium on the panels.

■ Paul Stenstrom of Tarpon Springs, Florida, is among the most recent Americans to have discovered the brightest side of federal bankruptcy law, having lived in his mortgaged home basically free of charge from 2002 until 2013 by using the law to stave off foreclosure. Even though none of his 15 petitions was ever approved, he followed each one immediately with another petition, and it was not until 2013 that one judge finally declared Stenstrom a "serially abusive filer," barring further petitions for two years -- at which point his bank was able to conclude the foreclosure. Upon expiration of the two-year period in September 2015, Stenstrom quickly filed another bankruptcy petition -- to keep from being evicted from the townhouse on whose rent he is four months behind.
