City Hall: Nativity scene regulation getting easier BY DAVID MARK SIMPSON Daily Press Staff Writer

PALISADES PARK Once again the holidays survived a season without nativity scenes in the parks.

Complaints and hours spent dealing with the regulation of unattended displays in Palisades Park have reduced dramatically since City Council’s ordinance went into effect three years ago, city officials said in a recent report to council.

For years, local church groups set up nativity scenes in the park, but in 2012 council banned unattended displays. The decision came following a holiday season in which atheists stuffed the ballot box, winning all but a handful of the slots allocated

for the displays. During the first year of the ban, city officials spent about 80 hours answering questions and providing information regarding SEE DISPLAY PAGE 8

Council preview: Water rates and labor rules BY DAVID MARK SIMPSON Daily Press Staff Writer

CITY HALL Water, workers and parks will be the big three topics at Tuesday’s City Council meeting. Aside from stricter regulations on outdoor fitness trainers — an issue the Daily Press wrote about last week — council will consider implementing penalties for waterwasters and review City Hall’s policy for employing contract workers. City officials have been discussing penalties for high water users since July and, in their most recent report to council, note that the penalties won’t hit until August. All water users would be expected to consume 80 percent of what they did during the same timeframe in 2013. All residents would be given a threshold allowance. In a Stage 2 water shortage (that’s where we’re at right now), all single-family customers will get a threshold of at least 22 hundred-cubic-feet (HCF) of water every two months. One HCF equals 748 gallons. Multi-family homes will be allowed at least a 11 HCF per unit every two months in a Stage 2 water shortage. They too will be asked to reduce by 20 percent over their 2013 baseline, if they exceed the threshold. These thresholds are meant to keep things fair for residents who already did much to reduce their water usage in 2013. Commercial water users must adhere to the 80 percent cut without any threshold. Hard working people Editor:

My wife Susan and I walk to the Santa Monica Pier from our apartment in Ocean Park on a regular basis. We have for years. And for years we have seen the beach bathroom crew driving city vehicles, cleaning the bathrooms, and locking up the facilities. We’ve often stopped to thank them for their hard work on behalf of the public. So it came as a shock when we learned that they are not permanent employees of the city, but merely “asneeded” trainees — although most of them have been there for five years or more. These workers do not have employee protections or receive holidays, sick leave, or vacations. On Tuesday night the City Council has the opportunity to review and redress this situation. Staff recommends putting these people through the hoops of Civil Service, then requiring them to compete for their jobs with a pool of applicants. But the city codes provide for another, simpler alternative — turning these jobs into permanent positions and directing appropriate staff to take a recommendation to the city’s Personnel Board for immediate action — instating the current workers as the employees for the newly permanent positions. We think that these people have already proved they can do the job. Furthermore, they carry serious responsibilities like handling dangerous materials, driving city vehicles, and securing public property. They have done it for years. I hope you will join me in urging the City Council to do the right thing for these hard working people.

Anybody have a shoehorn? WHEN IT COMES TO DEVELOPMENT IN

Santa Monica, it doesn’t have to be a new high-rise hotel, mixed-use plaza or sevenfloor apartment building to generate heated controversy. This time, it’s a relatively small, 10-unit apartment building overlooking Lincoln Boulevard on the edge of Sunset Park. The project is listed as “2919 Lincoln Boulevard/802 Ashland Avenue.” It was administratively approved because it meets the code requirements for R2 (low-scale) multifamily neighborhoods. The project doesn’t require either Planning Commission or City Council review. Public review for administratively approved projects is usually by the Architectural Review Board (ARB). But, here’s the rub: the ARB has no power to substantially alter the project such as reducing its size or density. It can only deal with general appearance or cosmetics such as building color, trim, exterior materials, landscaping and signage (if any). Nevertheless, this project has been before the ARB a halfdozen times because of problems. The project would merge two properties by a deed restriction. The first is a 20-footwide, 100-foot-deep vacant lot at 802 Ashland between a single-family home upslope and two foreign car repair shops downslope on Lincoln just east of Lincoln Boulevard. It leads to a larger, irregularly shaped, undeveloped, “landlocked” parcel with no street frontage. This parcel is like a hole in a doughnut and although it shows an address of 2919 Lincoln on city documents, it’s literally an island surrounded by privately owned properties. Access to the parcel is only via the narrow 802 Ashland strip. The combined hillside parcels are 15,257 square feet and have a grade differential of approximately 32 feet, according to ARB documents. They are enclosed on three sides by houses and small apartment buildings on Ashland Avenue, 10th Street and Wilson Place and on the fourth side by Lincoln Boulevard commercial operations including two foreign car repair shops and the former Lincoln Pipe. This 100-foot-long parcel, described as a “front-yard setback,” provides the 10-footwide driveway and walkway for four twostory, contemporary residential structures over a 20-vehicle subterranean garage. The development will feature two studio units (which appear to be on garage level), four two-bedroom units and four three-bedroom units. One major issue is the size of the project. Because it is considered a “preferred permitted project,” it’s allowed a higher unit density of one unit per 1,500 sq. ft. This is higher than is permitted for projects in the R2 District, which is zoned for one unit per 2,000 square feet (with a maximum of four units plus state density bonus). The ARB staff report states, “As a result, the project is larger than typical R2 projects, but meets all development standards for the R2 District. “Preferred permitted projects were established in the Santa Monica Municipal Code to encourage the construction of two and three-bedroom rental units with environmentally forward design through the provi-

sion of increased density.” The proposed 10-unit project would have one three-bedroom unit set aside for lowincome (50 percent of median) occupancy, which also qualifies it for density bonuses but strangely, that’s omitted from the project’s documentation. The ARB report continues, “Furthermore, the scope of the project with the exception of design review is ministerial and exempt from the requirements of the California Environmental Quality Act (CEQA).” Neighbors are frustrated with the lack of a proper CEQA review. They claim the development doesn’t meet the conditions for exemption. Some folks are concerned about traffic and parking impacts as Ashland is a very narrow, 29-foot-wide, steep hillside street and the new driveway will mean the loss of two scarce on-street parking spots. The architects for this project are from Koning-Eizenberg Architecture, a major player on the Santa Monica development stage. Principal Hank Koning is a former Planning Commissioner. K-E replaced David Forbes Hibbert, another prolific Santa Monica architect. Hibbert’s designs had run into approval problems at ARB. He had proposed a single “motel-like” structure as opposed to four separate modules. The developer isn’t named in the various ARB documents and a phone call last week to ARB Liaison Grace Page for further information and clarification of what appear to be contradictions in ARB reports was not returned. According to the report, “The applicant’s (K-E’s) description states that, ‘the program of ten rental units is broken down into four separate buildings in order to create homes with backyards and/or private balconies and views’…” Yet, the gap between the two east structures is only four feet or an arm’s length! Kind of like the Millennium East Village on the site of the Village Trailer Park? Last Monday, the ARB finally approved “2919 Lincoln/802 Ashland.” Neighbors have vowed to file an appeal, which means this development will go before the Planning Commission for further review. There, more substantial changes could be made. But, aside from insisting on additional “lowincome units,” don’t expect this commission to reduce its size or negative impacts. Shoehorn, anybody? City officials are recommending that City Council consider bringing the equivalent of more than 31 full-time jobs in-house after reviewing City Hall’s policy on contract labor. “Council requested that city staff perform a comprehensive study of (City Hall’s) contractual services, including an evaluation of the number of contracted employees and as-needed staff currently performing services for (City Hall), and options to convert these jobs into permanent full time city positions,” city officials said in a report to council. A report by city officials indicated that they continue to limit the use of contracted staff to services meeting criteria established by city policy. “The Report recommends converting

I still love e-commerce, but I missed connecting with people. “I was doing a lot of local sales, and every time I was out at a party or sale supporting one of the schools, I realized that was why I wanted to do this. And I’ve always wanted a shop, so it was a natural progression.” The resulting boutique, which is just east of Bob’s Market on a lively block between 17th and 18th streets that has several other shops and eateries, features women’s clothing, home decor and gifts in a bright, laidback atmosphere. Rodd, who has lived in Mar Vista for about five years, said the location and vibe of the area enticed her to open the shop in Santa Monica. “This neighborhood, I’ve watched it grow and kept my eye on it,” she said. “This is a real community. People know each other, they walk around. And there’s no real shopping area for this part of town — Sunset Park, Ocean Park, Mar Vista — but this street has major potential.” A mother of two and Ironman triathlete who spent her formative years on Long Island, Rodd said her beach-influenced style isn’t coast-specific. Although she didn’t study fashion design, she broke into the industry as a freelance photographer who started assisting with styling her subjects. “I realized I cared more about what the girls were wearing in my photos than the technical aspects of photography,” she said. “I’m like, ‘Hmm.’” That revelation led to the creation of

Brooke Rodd Designs, and her items are now for sale in an Ocean Park store that is accented with soft sky blue flooring, framed posters of beach scenery and hanging translucent light bulbs that remind the owner of jellyfish tentacles. Colorful clothing hangs on the side walls, and a center table displays a variety of accessories. It was closed the first time she saw it, so she was glad to browse the selection. “It’s great,” said Seaman, who made several purchases. “It’s open, it’s bright and beachy, and it’s simple but there’s lots to find. It’s exciting as a customer to see something new.” Rodd said it’s been challenging to get Jellyfish up and running on her own, but she hopes to hire part-time help eventually. And she’s been encouraged by the foot traffic and feedback. “It’s been very rewarding,” she said. “People like to shop and touch things. When people saw my clothes in person and had the opportunity to try them on, they bought them more. You can’t take away the experience of coming into a place that feels good and the instant gratification of buying things in a store. That’s never gonna go away. So I think there’s been a big turn back towards brick-and-mortar.”

Where the typical black-tie gala promises drinks, dinner and entertainment, the art charity’s eighth annual Heaven gala aimed to provide an artistic experience curated by performance artist Marina Abramovic. “It’s Marina’s vision that you are part of the art,” guests were told upon entering the party Saturday, held in an airplane hangar in Santa Monica, California. It began with a “silent cocktail hour.” Celebrants such as Zach Braff, Usher, Joaquin Phoenix and Johnny Depp, who lounged on a couch behind velvet ropes, were instructed not to speak during the cocktail reception and encouraged to wear silencing headphones provided by atten-

dants. Drinks were to be ordered by pointing at a menu. Depp and fiancee Amber Heard, the night’s guest of honor, did not wear the headsets. When chatter erupted after about 30 minutes, Abramovic playfully admonished partygoers for not following the rules. Instead of a ballroom of numbered tables, guests entered a gymnasium full of beds topped with tray tables. Everyone was given a gray robe to wear over their fancy clothes. (Depp and Heard did not wear the robes.) A small stage rotated in the center room and four giant video screens glowed overhead. Entertainment included a performance piece on love and loss, a 3-D film and a musical set by Moby. The event was projected to raise $1 million for the nonprofit group that brings art to sick children and others in need.

2 Tuskegee Airmen die in Los Angeles at 91 on the same day LOS ANGELES — Two members of the Tuskegee Airmen — the famed all-black squadron that flew in World War II — died on the same day. The men, lifelong friends who enlisted together, were 91. Clarence E. Huntley Jr. and Joseph Shambrey died on Jan. 5 in their Los Angeles homes, relatives said Sunday. Huntley and Shambrey enlisted in 1942. They were shipped overseas to Italy in 1944 with the 100th Fighter Squadron of the Army Air Force’s 332nd Fighter Group. As mechanics, they kept the combat planes flying. Huntley serviced P-39, P-47 and P-51 aircraft, and as crew chief was responsible for the plane of the squadron commander, Capt. Andrew D. Turner, said Huntley’s nephew, Craig Huntly of Inglewood. “The life of his pilot was in his hands, and he took that very seriously,” his nephew said. His concern led Turner to nickname him “Mother,” Huntley said. In addition to facing danger, the Tuskegee Airmen faced racism. Shambrey’s son, Tim Shambrey of Altadena, said his father recalled getting off a train in Alabama where a hospitality station was welcoming returning white troops with handshakes and free coffee. “When he and his buddies came off, dressed in their uniforms, of course they didn’t get any congratulations” and were asked to pay for their coffee, Shambrey said. They did so. “The thing about those men is that they were very proud” and decided not to make a fuss, Shambrey said. “They were already used to so much discrimination.” In later life, Shambrey didn’t talk much about his war service but he held barbecues that sometimes drew 150 people, including a lot of his old Army buddies, his son said. Huntley also didn’t talk much with his family about the war, said his daughter, Shelia McGee of Los Angeles. He told them: “I was doing what I was supposed to do, and that was to serve my country,” she said. Shambrey was a National Guard combat engineer during the Korean War and later spent his career with the Los Angeles County Department of Parks and Recreation, his son said. Huntley was a skycap for more than 60 years at airports in Burbank and Los Angeles, his daughter said. -

LA Kings F Tanner Pearson out with broken left leg Los Angeles Kings rookie forward Tanner Pearson is out indefinitely with a broken left leg. The Kings confirmed Pearson’s injury on their website Sunday. Pearson was hurt when he crashed feet-first into the boards while skating with Winnipeg’s Jay Harrison during the second period of the Kings’ 5-4 shootout loss to the Jets on Saturday. Pearson is the Kings’ second-leading goal-scorer with 12 in 42 games this season. Pearson was one of six rookies selected for the skills competition at the NHL All-Star weekend next month. He is still technically a rookie despite playing a significant role last summer during the Kings’ run to their second Stanley Cup title in three seasons. The Kings also faced the Jets without forward Tyler Toffoli, who is out indefinitely with mononucleosis. — AP

Last year, city officials only dealt with issues related to the ordinance for about eight hours. “As in previous years, when contacted, staff worked very closely with the various organizations to ensure that applicable laws were followed, rules and regulations were explained, and city authorization was provided when required,” city officials said in the report.“This year, staff received one anonymous concern from a member of the public requesting (City Hall) bring back the nativity displays in Palisades Park. Over the past several years, the administrative burden of overseeing this program has been greatly reduced.” In lieu of the unattended displays on public property, holiday displays were unveiled (while attended) in several public locations. Unattended religious displays were also erected on private land. As was the case last year, proponents of the nativity scenes held an event in Palisades Park early December celebrating the Christmas story. They unfurled a 24-footlong scriptural banner. In 2012, the nativity groups relocated to a commercial property on the 2700 block of Ocean Park Boulevard. For the last two years they’ve been on display at Mt. Olive Lutheran Church at 14th and Maple streets. In 2012, an attorney representing 13 local churches filed suit against City Hall, claiming that the council erred because the ban

was approved specifically to avoid controversy, effectively revoking the churches’ rights to free speech. Later that year, a Los Angeles federal judge dismissed the lawsuit, claiming that City Hall was within its constitutional right to ban the unattended displays because the decision impacted all groups, religious or otherwise, and provided groups with other ways to display their scenes. The churches’ attorney filed for an appeal of the dismissal. Two years later they got word that the appeal will be heard by a three-judge panel within the U.S. Ninth Circuit Court of Appeals on Feb. 6 in Pasadena, according Hunter Jameson, a spokesperson for the churches. If the churches win the appeal, the case would go to trial or City Hall could change the ordinance. Menorahs were also on display throughout December on both public and private land. There were Hanukkah events on the Third Street Promenade, with the exception of one day, every day from Dec. 16 through Dec. 23. “As required under these event permits, the organizer attended the display throughout the entire event and removed all displays at the conclusion of each day of the event,” city officials said in their report. Menorahs were also on display on private property at at least six locations throughout the city, according to the report from city officials. DAVE@smdp.com

Both the suspect and the vehicle had been identified by investigators as having been involved in a burglary in Santa Monica in November. In the early morning hours of Dec. 30, the officers were alerted when the vehicle entered the Santa Monica city limits. The vehicle was quickly located in the area of 3rd Street and Hill Street and stopped. The lone occupant of the vehicle, identified as Sergio Diaz, gave officers permission to search his vehicle. Diaz was found to be in possession of multiple items of property used to commit burglaries, including dark clothing, bolt cutters, a cordless drill, a tool bag, a flashlight, gloves, and several screwdrivers. Officers arrested Diaz for the November burglary as well as possession of burglary tools. He was transported for the Santa Monica Jail for booking. Sergio Arturo Diaz, 43, of Inglewood, had bail set at $50,000.
