Santa Monica cops arrest serial arson suspect BY DAILY PRESS STAFF PUBLIC SAFETY FACILITY Santa Monica Police have arrested a man they suspect lit 10 arson fires around the city, it was announced on Sunday. Police officials say that Balbinder Singh is responsible for a number of fires, some of which damaged three

apartment complexes. The fires spanned a 10-day period, starting on Dec. 30. At one of the complexes, the fire had burned into a ground-level garage and was threatening to burn further up into the living area of the complex. Another arson fire caused major damage to a car parked at a car dealership.

Monica’s oldest (and largest) residents are about to be firewood. City Hall has determined that at least 11 eucalyptus trees on Seventh Street need to be removed. Decay, disease, and age have caused limbs to fall, posing a threat to safety, said Public Works Director Martin Pastucha. Matthew Wells, a city urban forester, estimates that the trees are “at least 70 or 80 years old and maybe older.” It’s hard to estimate the age, he said, because eucalyptus trees grow at different rates depending on the conditions over the years. They are relatively large trees, he said, and the density of the area means they’re a greater threat. “It’s a busy sidewalk,” Wells said. “If we had eucalyptus trees of that size in a quieter area, the intensity of what we’re doing maybe wouldn’t be as great.” But a bunch of limbs have already fallen on Seventh Street and both the consulting arborist and public works officials agreed it was time for them to go. “If a limb does fall off there’s a good chance that there might be someone there,” Wells said. “There might be a car there. There might be a property there. So we have to manage them in a very careful manner.”

been arrested in connection with a stabbing incident at the Santa Monica Pier on Saturday. The incident, which occurred at approximately 1:20 a.m., involved five suspects and a pair of fisherman at the west-end of the popular tourist attraction. An argument escalated to the point where the group of five attacked the other two. During the altercation, both victims were stabbed multiple times in the torso and arms. The suspects left the pier fishing deck and walked east. The victims reported the incident to pier and Harbor Service Officers who immediately began to administer first aid until Santa Monica Fire Department paramedics arrived. SMPD officers, who were working on the pier at the time, were notified and responded. The officers saw a group of individuals walking east on the pier who matched the description of the assailants and subsequently detained them. Identifications were later made of the group, implicating them in the crime. The victims were transported to a local trauma center where the more serious of the two was immediately sent to surgery. Both victims are in stable condition and expected to survive.

Legislative deadline nears for hundreds of state bills DON THOMPSON Associated Press

SACRAMENTO, Calif. Hundreds of bills that failed to pass the Legislature last year face an end-of-the-month deadline to gain initial support, including measures affecting gun owners, the oil industry and farm laborers. It’s the first significant bill deadline of 2014, the second half of the Legislature’s two-year session. The bills are dead if they don’t pass the house where they originated by Jan. 31, and dozens of the holdover bills already have died in committees. Some of the bills left over from last year have been stripped of their original language and entirely rewritten, a practice known as a gut-and-amend. One such bill, SB477 by Senate President Pro Tem Darrell Steinberg, D-Sacramento, began life last year as a measure to require grassroots financial support for ballot initiatives. But it was gutted and amended to require contractors who recruit farm laborers in other nations to register with California’s labor commissioner and meet certain standards. The reincarnation came after Gov. Jerry Brown vetoed Steinberg’s original farm labor bill last year. If the revised legislation clears the Senate, it will head to the Assembly. Sen. Noreen Evans’ SB241 would impose a tax on companies that extract oil in California, a concept that is supported by Steinberg but has not been embraced by the governor. Evans’ bill is stalled in committee, but the Democrat from Santa Rosa plans to propose new legislation that would put the oil tax before voters on the 2016 ballot, an avenue that does not require Brown’s approval. Evans also is teaming with Sen. Kevin de Leon, D-Los Angeles, to pass SB199 out of the Senate by month’s end. The Imitation Firearm Safety Act would require that toy guns, BB guns, pellet guns, airsoft guns and the like be made to look clearly different from guns that fire bullets. The legislation follows the fatal shooting in October of 13year-old Andy Lopez in Santa Rosa, when a sheriff ’s deputy mistook the boy’s airsoft rifle for a real AK-47. “Toys should not get a child killed,” Evans said in introducing the bill. De Leon also faces a month-end deadline to advance his SB808, which would require anyone who assembles a homemade firearm to undergo a background check and register the weapon. LOS ANGELES “Ride Along” arrived in first place at the weekend box office. The Universal buddy cop comedy featuring Kevin Hart and Ice Cube debuted with $41.2 million, according to studio estimates Sunday. The strong opening for “Ride Along” marks the biggest debut for a film released during Martin Luther King Jr. Day weekend and puts it on track to top the $40.1 million record set by the 2008 monster movie “Cloverfield” for the biggest opening of January. “It certainly appears with business at this level and with a CinemaScore of A and our exit polls supporting that, it’s safe to say we’ll break a few records,” said Nikki Rocco, head of distribution for Universal. “Ride Along” is the first starring role for Hart, whose box-office status has been on the rise since the success of his 2013 standup film “Kevin Hart: Let Me Explain” and memorable stints in such movies as “Think Like a Man,” “This Is the End” and “Grudge Match.” “He’s everywhere it seems,” said Paul

Dergarabedian, senior media analyst for box-office tracker Rentrak. “I know he was co-starring with Ice Cube in ‘Ride Along,’ but this really was marketed as a Kevin Hart movie. There’s no question he’s a movie star now who doesn’t require any qualifications before his name.” In second place, Universal’s Navy SEAL drama “Lone Survivor” starring Mark Wahlberg, Taylor Kitsch, Emile Hirsch and Ben Foster earned $23.2 million in its second weekend in wide release, bringing its domestic total to $74 million. Open Road Films’ animated film “The Nut Job” featuring the voices of Will Arnett and Brendan Fraser opened in third place with $20.6 million. The weekend’s other major new releases, Paramount’s spy series reboot “Jack Ryan: Shadow Recruit” and the Fox horror flick “Devil’s Due,” respectively opened in fourth and seventh place. “Jack Ryan,” which stars Chris Pine in the titular role, debuted with a disappointing $17.2 million. The film directed by and also featuring Kenneth Branagh performed better overseas, where it nabbed $22.2 million in 29 international markets.

“Devil’s Due” featuring Zach Gilford and Allison Miller as parents expecting their first child amid spooky occurrences birthed $8.5 million in its opening weekend. Several films nominated for Academy Awards last week received a bump at the North American box office following their nods on Thursday, including “American Hustle” in sixth place with $10.6 million, “August: Osage County” in eighth place with $7.6 million and “The Wolf of Wall Street” in ninth place with $7.5 million. “The Wolf of Wall Street” also scored $27 million in 19 international territories. The best picture contenders “Gravity,” “Captain Phillips,” “12 Years a Slave” and “Dallas Buyers Club” were all rereleased in theaters this weekend following their Oscar nominations. “Gravity” is up with “American Hustle” for the most trophies with 10 nominations each at the 86th annual ceremony set for March 2. “The Oscars definitely have an impact on studios’ decision-making process,” said Dergarabedian. “These are movies that would normally be played out, finished, pretty much done in terms of box office, and now they’re getting a completely new lease on life.”

New California law squeezes recyclable collectors THE ASSOCIATED PRESS LOS ANGELES A new California law that tightens the state’s recycling redemption rules is squeezing people who cash in bottles and plastic to make ends meet. The Los Angeles Times reports that, as of Nov. 1, recycling centers started paying

much less for containers including wine bottles and milk jugs that do not have a specific redemption value. An empty beer or soda bottle can still be turned in for a nickel or a dime. But under the new law, recycling centers receive the much-lower, scrap value for containers with no specific redemption value.

That means the centers pay people who scour cities to collect recyclables much less as well. A load of containers that used to fetch a few hundred dollars might now only be worth one-quarter of its prior value. That is the situation facing Francisco Morataya, an office janitor who each week

recycles a vanload of bottles and cans in Los Angeles. Morataya told the newspaper that he used the $200 he received to pay his daughter’s cellphone bill. Now he takes home about $50 for the same load. SEE LAW PAGE 10

Mr. [Dave] Simpson’s short article “Parking revenues way up, Jan. 12” leaves out one important contributing factor in this great boon to Santa Monitary’s coffers and that is the fraudulent practice of selling the same time slot to more than one buyer made possible by the new computerized meters. If I buy an hour’s worth of time, but leave in 30 minutes, the meter can sell the remaining half hour again to someone else, and maybe again after that. How is this not theft and double or triple dipping? Those same meters that take our credit card information to charge us can also credit us with our unused time to be applied next time we use that account to purchase parking. Why can’t this petty “Leech by the Beach” empire do as some other cities do and treat the people who bring business to their town with a little common decency?

It now appears that there is no revenue-gathering scheme too vulgar or ugly for our increasingly tonedeaf, incredibly greedy council members. I am not a fan of billboards, but can usually manage to avoid looking at them when they are on privately owned property, or even on L.A. city buses. But the chutzpah of the council members has shocked even me. They have installed ugly in-your-face large movie billboards in Parking Structure 2. You can’t avoid seeing them. They are on the walls you drive toward and they are exceedingly offensive. Is there no law against using public property for private purposes? Can no one stop the onslaught against our common decency? Help! Let me know where I can sign and distribute petitions for a recall election.

Memorial Park plan a blueprint for lots more development THE CITY PLANNING STAFF HAS BEEN

busy developing schemes that may benefit a few select individuals, but will make life much less pleasant for the rest of us. The Memorial Park Neighborhood Plan (MPNP) is a master plan for identifying neighborhood uses, open space elements, parking, circulation and infrastructure improvements and integration with the coming Expo Light Rail Line in and around Memorial Park. You’re thinking, “Bill, this is about improving one of Santa Monica’s most heavily used parks. It’s a good thing, right?” Not entirely. This is really about development that will be permitted and encouraged in the Mid-City area along Colorado Avenue from Lincoln Boulevard to 20th Street. There’s a potential for a lot of redevelopment including multi-story housing blocks with retail space on Olympic Boulevard, Broadway and numerous neighborhood cross streets. The Santa Monica-Malibu Unified School District is planning to move out of their current headquarters on 16th Street which will open up this large parcel to extensive redevelopment. We’re talking about cookie-cutter, mixeduse, four- and five-floor buildings with apartments including the usual brace of lowincome units. Santa Monica’s more prolific developers are actively searching for and acquiring properties in the area. Plans are to make the new main entrance to Memorial Park near the Expo Light Rail stop on Colorado near 16th Street. Parents are concerned that transients and other undesirables riding Expo from Downtown Los Angeles will disembark at the stop and drift into the park where they could present a danger to children. Other concerns center on traffic and a lack of parking for both park recreational users and light rail riders. A bicycle advocacy group wants a full-service bicycle service center either within the expanded park or on the park’s already inadequate parking lot. A final plan will be coming to the Planning Commission and City Council in the months ahead. Stay tuned.

Talk about major screw-ups. How about the “Safe Routes to School” program? It’s described on the Planning Department’s website as “about health, safety and transportation improvements to get more students biking and walking.” The Santa Monica High School project proposes to construct improvements that eliminate barriers to biking and walking to school.” In other words, traffic disasters ahead. The planning and transportation management staff are now championing physical activity for teens? Forget about traffic, congestion and parking problems. They’re more concerned about creating opportunities for high-schoolers to exercise. It’s social engineering at its worst. Many of Samohi’s entry/exit points, including the former main entrance on Pico Boulevard, have been closed — I assume for security reasons. Now, Samohi’s key access point is the intersection of Michigan Avenue and Seventh Street for all modes (foot traffic, cars and bikes) including drop-off/pickup of an estimated 600 or more students who are driven to and from school. Here is the nightmare the space cadets in City Hall have dreamed up: • A new traffic signal at Seventh and Pico Boulevard including a crosswalk to improve access to Pico bus stops — some of which are now half a block away. • Vehicle traffic on Seventh Street will be one-way, southbound. Cars will be able to turn left or right on Pico. This necessitates removing a portion of the existing Pico median. But, it gets worse. • New, protected, bi-directional, green, bike lanes will be added on Michigan between Lincoln Boulevard and Seventh, along Seventh Street between Michigan and Pico and on one block of Pico between Sixth and Seventh streets. Oy vey! With expected increases in school pedestrian and bicycle flow from Michigan east of Lincoln, increased congestion on Lincoln already jammed with 40,000 plus cars daily is inevitable. Add dreaded curb extensions, enhanced crosswalks and “protected” turns for cars at Lincoln/Michigan and the Seventh/Pico intersections and it’s the perfect storm. There’s no mention about how thousands of students on foot will mesh into this disaster. And, nothing about on-campus student parking. Even though City Hall is allowing parents to use the Civic Center parking lot as a drop-off/pick-up point, there’s apparently no plan to “officially” move it from congested Michigan/Seventh. I’m hearing Samohi students don’t like crossing Fourth Street at Pico and walking up the hill to classes. Hummm. They won’t walk a block to school and City Hall’s rainbow chasers are going to get them to ride bicycles? Am I missing something? Who’s going to use all those new on-campus bike racks? Traffic studies are due just two weeks before City Council votes on this — well after the public input period has closed. Look for this on the agenda in the coming weeks. You’ve been warned.

OCEAN AVE. MEDIAN ISOLATES RESIDENTS

City Hall will soon start construction on a 10-foot wide, landscaped median on Ocean Avenue adjacent to the Santa Monica Village at the Civic Center between Olympic Drive and Vicente Terrace. The median will severely curtail vehicle access to homes and apartments in Seaview Terrace just west of Ocean Avenue. Turns in and out of the beachside neighborhood will be affected. One Seaview Terrace resident called and said that she’ll be unable to make left-hand turns from northbound Ocean Avenue into the only vehicle alley available (Vicente Place North) — forcing her to drive many extra blocks. I wonder if planners gave any thought about the inconvenience to folks living west of Ocean Avenue or whether they even care. Chalk up one more example of poor transportation management from planners who never saw a traffic jam they didn’t like.

SPARKS, Nev. Most locals reacted like Rick Dinoso when he first heard that all the fish in the Sparks Marina were dead — an estimated 100,000 trout, bass and catfish. “All the fish don’t just die,” said Dinoso, 37, an assistant manager at a nearby tavern who grew up in Sparks. “That’s a lot of fish,” Wayne Weaver said Friday as he walked the 2-mile loop trail around the 77-acre, man-made lake with wife, Dee. “That’s a lot of recreation lost.” Scientists say the massive fish kill was caused by a dramatic drop in the water’s oxygen content, which they say is not all that uncommon. They believe it was triggered by a weeklong cold spurt in December when lows hovered near zero at the former gravel pit converted into a marina 15 years ago along Interstate 80 just east of Reno. Though testing is incomplete, state wildlife and environmental officials are convinced there’s no danger to humans or animals. There’s been no sign of any contamination like the pollutants that leaked into the pit in the 1980s from a petroleum tank farm across the highway, they say. Despite those assurances, city officials have been forced to respond to concerned citizens. Most worry whether it’s safe to let their dogs in the water. “It’s not good for the fish obviously, but the water quality itself is great and there’s no health or safety issue,” city spokesman Adam Mayberry said. “Other than fishing, there’s no indication you can’t do anything else out there that you have always been doing.” Sudeep Chandra, a limnologist at the University of Nevada, Reno known for his research at Lake Tahoe, agrees. “I really don’t think it is other contaminants, it’s just the low oxygen,” he said. He said it likely occurred when the oxygen-rich warmer waters on the lake’s surface quickly cooled, sinking to the bottom of the lake and causing a violent “turnover” of the waters. A hot, dry summer may have contributed by spurring growth of oxygen-sucking algae, he said. Wildlife officials estimate replacing the fishery will cost tens of thousands of dollars. City officials believe the economic impact is limited to the 1,800 anglers who fish there. The past five years, they’ve accounted for roughly 1-of-30 overall visitor user days, which totaled about 340,000 last year. Of bigger concern is the national media

coverage of the massive fish kill — not the sort of thing the neighbors of “The Biggest Little City in the World” had in mind when they recently adopted a new city slogan, “It’s Happening Here.” “Negative publicity is always a concern,” Mayberry said. “Dead fish and fish floating to the bottom of the lake — those aren’t very good images.” Founded along the Union Pacific Railroad in 1905, Sparks touts the marina on its web site as a “Brownfield Success Story.” A family ranch dating to the 1860s operated on the property until it was sold in 1967 to Helms Construction Co., which dug aggregate from the pit for 25 years. Contaminants discovered in 1988 quickly were linked to the tank farm, the target since of a state-led cleanup project. The early effort included pumping out polluted groundwater that had collected in the pit. Because groundwater constantly flows into the marina, city officials pump more than 2 million gallons a day into the neighboring Truckee River. That water has never exceeded environmental standards, including in the most recent testing in December, regulators said. “There is no data to indicate that the (tank farm) is involved, connected or related to the dead fish,” Nevada Division of Environmental Protection spokeswoman JoAnn Kittrell said. That hasn’t stopped Kristine Rowland from wondering what killed the fish. She remembers the quarry was used as a dump when she was growing up 30 years ago. “In the old days you would just back up the truck and dump it all out,” said Rowland, a Reno businesswoman. “It was like family day, and you could ride home in the back of the truck.” Wildlife officials typically restock the marina by March 1. They had planned to add 26,000 trout and 4,000 catfish this year, but won’t unless the oxygen recovers. The loss of Nevada’s biggest “urban fishery” would be more significant than usual during this drought year, when low water is expected to preclude fishing at many popular reservoirs and rivers, Department of Wildlife spokesman Chris Healy said. It also would force cancellation of a youth fishing day, which annually attracts 3,000-4,000 in June. Gary Yuill said the unfortunate collapse of the fishery won’t curtail his daily dog walks. “I don’t think there’s anything wrong with the water, but I understand people questioning it,” he said. “It doesn’t make sense.”

that older, still functioning thermostat with a new whiz-bang “smart” variety might seem like a waste of money, but it can be one of the best small investments a homeowner can make, given the potential for energy and cost savings down the line. The coolest of the bunch of new smart thermostats, the Nest, was created by former Apple employees who had been instrumental in designing the original iPod and iPhone years earlier. This simple looking round thermostat is reminiscent of oldschool thermostats that one would manually adjust by turning the temperature dial. But the auto-awake feature that turns on the bright blue digital display when someone walks nearby gives the Nest away as an ultra-modern piece of high tech gadgetry. The Nest’s software “learns” the habits in a given space by logging when inhabitants tend to be home and awake and noting when they tend to turn up or down the heat-and then sets a heating/cooling schedule accordingly. Owners can also program the Nest, which connects to the Internet via Wi-Fi, to heat up or cool down the house at a set schedule or go into “away” mode from any web browser or smart phone. While the Nest is likely the best known smart thermostat available-especially since Google acquired the company behind it in early 2014-several other manufacturers (including Honeywell, ecobee, Hunter, Radio Thermostat, Trane and Lux) have WiFi-enabled smart thermostats available now as well. While only some of them have the autosensing and “learning” capabilities of the Nest, those without that feature also cost less. And merely programming in a weekly schedule to any smart thermostat will be the main source of cost and energy savings.

People who were diligent about turning their old thermostats up and down throughout the day might not see any substantial savings with a smart thermostat, but most of us aren’t so diligent-especially when it comes to turning the heat down at night when we are sleeping. Many smart thermostat owners report savings of between $10 and $30 per month on their heating/cooling bills-and research has shown that such an upgrade can save upwards of 10 percent of the total energy consumed by a given household. Smart thermostats range in price from $50 to $250, so upgrading could pay for itself within a year or two at most, with longterm savings racking up month-by-month after that. Many utilities now offer free or discounted smart thermostats to customers. Getting in on such a program is a great way to reduce energy costs without the up-front expense of installing a smart thermostat independently. According to the Database of State Incentives for Renewables and Efficiency (DSIRE), incentives to install smart thermostats are available through utilities in 45 states. New York’s Con Edison, California’s PG&E and Texas’ CPS Energy are just a few of the larger utilities offering such incentives. Those that do upgrade certainly won’t be alone. Feds seek option for dredge sand along NC beaches MARTHA WAGGONER Associated Press

RALEIGH, N.C. Beach communities and environmentalists are pushing back against a proposal to give the National Park Service the option of using dredging material to fight erosion on North Carolina’s pristine Shackleford Banks, where wild horses roam and no humans live. The proposal, part what’s called a 20-year Dredge Material Management Plan, has created an odd coalition of towns that want the material from Beaufort Inlet to go to their beaches, not the Shackleford Banks, and environmentalists, including the well-known Orrin Pilkey, who want to protect Shackleford Banks from more human interference. The park service manages Shackleford Banks, the southern-most barrier island in Cape Lookout National Seashore, as a wilderness area, although it doesn’t have the designation from Congress. The erosion at Shackleford Banks is both a part of the natural expansion and contraction of inlets and a natural reaction to sea level rise, said Pilkey, a geology professor emeritus at Duke University. And in the past, the park service has stuck to its guns about letting nature take its course, he said. “I oppose it because I’m so strongly in favor of the park service’s ‘let nature rip’ policy,” he said. “And what I fear, and what others like myself fear, is that the park service is starting to waffle a little bit on this. I understand why. They’re always under pressure to do something (about erosion).” It’s natural for inlets to expand and contract over time, he said, and Beaufort Inlet is expanding right now. “Shackleford Banks is doing what nature intended it to do,” he said. More than 100 horses roam Shackleford Banks, but humans haven’t lived there since the turn of the 20th century, plenty of time for evidence of their presence to disappear. Visitors can walk its nine miles of deserted beach seeing maritime forests but no roads or homes. It’s that sort of pristine environment that people such as Pilkey fear will be lost if the Corps is allowed to pipe in sand. The sand that some view as an unwanted interloper on Shackleford is a valuable commodity for places such as Atlantic Beach, where the mayor says it protects about $2 billion in oceanfront investment from storms. But the plan only gives the park service the option of using the dredge material at Shackleford Banks; it doesn’t require it to do so, said Pat Kenney, superintendent of the Cape Lookout National Seashore. “If we say no to sand now, in the next 20 years, we would not be considered for sand,” Kenney said. “One of the critical things the park service is trying to do is protect the option to accept sand.” That’s a new stance for the park service,

which the plan says requested the Corps to include dumping of dredged material on Shackleford Banks in 2010 after refusing the sand in the past because it wasn’t considered consistent with NPS management policies. The National Park Service has never used dredge sand on a wilderness area or one that’s proposed for a wilderness designation, such as Shackleford, an NPS spokesman said. It has no proposals to use dredge sand in any such areas other than Shackleford, the spokesman said. The Corps has dumped sand at other national parks, while working with other federal or state entities. That includes placing sand on the sound side shore of the Cape Lookout Lighthouse in 2006 to protect historic structures and in 2003, at the Cape Hatteras National Seashore, to fill a breach caused by Hurricane Isabel. It intends to have a final plan for Beaufort Inlet sand by spring of 2015. Under the plan proposed by the Corps, the sand would be split 57 percent for Bogue Banks, where the town of Atlantic Beach is located. The National Park Service has asked for 43 percent of the sand for Shackleford, the same percentages as the erosion, the plan says. Atlantic Beach Mayor Trace Cooper wants the sand to continue to be dumped on the shoreline of his town and at Fort Macon State Park, as it is now, especially since the plan is the result of a lawsuit that Carteret County filed several years ago. In addition to protecting oceanfront investment, the sand also protects the park and provides wide beaches for visitors, Cooper said. If Bogue Banks got just 57 percent of the dredged sand, it would have to find money and sand from other sources. “This whole Dredge Material Management Plan is the result of the lawsuit against the Corps in which the Corps has admitted that their dredging affects the beaches of Atlantic Beach,” he said. “And their renourishment efforts along Atlantic Beach are there to mitigate the harm they have caused. We just want them to do what they said they were going to do.” The county brought legal action in 2007, said Gregory “Rudi” Rudolph, shore protection manager for Carteret County. The two sides reached an out-of-court settlement in 2008, Rudolph said, that required the Corps to codify its intention to dump dredged material at Fort Macon State Park and Atlantic Beach. That happened in 20102011, when the Bogue Banks got about 1 million cubic yards of sand as part of interim plan, Cooper and Rudolph said. Now, however, the Park Service wants to claim some of that sand as its own. “I don’t want to say the process has been hijacked, but it’s pretty darn close,” Rudolph said.

City officials are looking at the roots and the canopies to determine how many more will need to come down. City officials gave a thorough presentation to the Urban Forest Task Force, said Chair Grace Phillips. “While the news made us very sad, we also understood their decision in terms of public safety,” she wrote in an e-mail. “Some of the limbs dropped over the public rightof-way were alarmingly large.” Another member of the task force, Gloria Garvin, said that City Hall should bring in a eucalyptus specialist that she knows of from Central California. “Eucalyptus can grow to be well over 100 years old,” she wrote in an e-mail. City Hall plans to officially list the tree removals this week and take them out with-

in a month, Pastucha said. Because Seventh Street has a 20-foot offset from the curb there are rows of eucalyptus trees on either side of the sidewalk, said city Landscape Manager Darrell Baker. “Anything that’s in the parkway we will replant,” Baker said. “Anything that’s on the back side of the parkway, we probably won’t or we’ll have to look at that more carefully.” Last year, City Hall took out 230 trees, mostly due to a backlog of dead ones, Baker said. This falls within City Hall’s usual range, he said. Santa Monica has 33,000 trees and many are aging. While the old eucalyptus trees are significant and stately, Wells said, diversity of age and species is important for the city’s tree population. “I think the key is to remove the trees that are required to be removed while not spending a lot of money trying to retain trees that can’t be retained easily,” he said. “We’re replacing them with new healthy, young trees that are going to establish into a valuable public asset.” dave@smdp.com

Kern retired from professional bowling and assumed management of the pier alleys where he shared his love and knowledge of the game. In 1926 he passed away and interest in the pier’s alleys waned. By 1930 the alleys closed for good.

Several bills are expected to die that would have altered what is now an $11.1 billion bond scheduled to go before voters in November. But other bills have been introduced that could be used to lower the cost or postpone voters’ consideration of the measure, which already has been delayed twice. Lawmakers say they prefer a vote on an amended measure this year, given the drought. Competing Senate bills aimed at permitting Internet gambling also will miss the end-of-month deadline. Yet aides say Sen. Lou Correa, D-Anaheim, and Sen. Roderick Wright, D-Inglewood, plan to keep trying to authorize an industry that could bring the state budget hundreds of millions of dollars a year in revenue. A bipartisan bill would preserve Southern California’s tradition of allowing beach bonfires and prevent the regional air quality agency from enforcing restrictions. Assemblyman Travis Allen, R-Huntington Beach, and Assemblywoman Sharon QuirkSilva, D-Fullerton, teamed up to support AB1102 after Newport Beach proposed removing 60 fire pits from city beaches. The state would further restrict the activities of paparazzi under AB1356, by Assemblyman Richard Bloom, D-Santa Monica. The bill would amend the civil prohibition on stalking to prohibit surveillance techniques, including staying outside a person’s home, school or workplace with no legitimate purpose. Brown last year signed a bill supported by actresses Halle Berry and Jennifer Garner that increases penalties for photographers and others who harass the children of public figures. A bill by Assemblyman Ian Calderon, DWhittier, would attack the state’s childhood obesity problem by prohibiting public schools, along with state-owned buildings, from serving chicken or turkey that has been “plumped” by injecting saltwater, chicken stock, seaweed extract or other substances. AB682 notes that “plumping” can increase the sodium content of fowl by 500 percent.

TRENTON, N.J. The Democratic mayor of a town severely flooded by Superstorm Sandy said Sunday that she was told an ultimatum tying recovery funds to her support for a prime real estate project came directly from Republican Gov. Chris Christie, a claim a Christie spokesman called “categorically false.” Hoboken Mayor Dawn Zimmer told CNN’s “State of the Union with Candy Crowley” that the message pushing a

Rockefeller Group commercial development was delivered by Christie’s lieutenant governor, Kim Guadagno, when the two were at an event in Hoboken in May to celebrate the opening of a new supermarket. “The lieutenant governor pulled me aside and said, essentially, ‘You’ve got to move forward with the Rockefeller project. This project is really important to the governor.’ And she said that she had been with him on Friday night and that this was a direct message from the governor,” Zimmer recalled Guadagno saying. Christie spokesman Colin Reed issued a

statement Sunday saying, “Mayor Zimmer’s categorization about her conversation in Hoboken is categorically false.” On Saturday, Zimmer said Guadagno and a top community development official separately told her that recovery funds would flow to her city if she expedited the project. Hoboken, a low-lying city of 50,000 across from Manhattan, was nearly swallowed by the Hudson River during Sandy, with three of its electrical substations and most of its firehouses flooded, businesses and homes submerged, the train station inundated with water, and people trapped in

high-rises because elevators didn’t work and lobbies were underwater. Zimmer has proposed a comprehensive flood mitigation plan and has applied for $100 million in grants to help make it happen. Zimmer said she didn’t reveal the conversation with Guadagno until now because she feared no one would believe her. But, with Hoboken having received just $342,000 out of $1.8 billion in Sandy recovery aid from the state in the first funding round, she said, she is speaking out in hopes her city won’t be shut out in a second funding wave, when the state is due to disperse $1.4 billion. Hoboken has also received millions in federal aid. Christie, meanwhile, is embroiled in another scandal that threatens to undercut his second term and future presidential ambitions. The U.S. attorney’s office and a state legislative panel are investigating allegations that Christie aides engineered traffic jams in Fort Lee by closing lanes to the George Washington Bridge, possibly as payback against the town’s Democratic mayor, who didn’t endorse Christie for re-election. Democratic Assemblyman John Wisniewski, the legislator leading the state investigation, told NBC’s “Meet the Press” on Sunday that his committee would look into Zimmer’s political payback allegation as well. “I think we have to give the allegations serious thought,” he said, “because this is a pattern we’ve heard time and time again throughout New Jersey.” Former New York Mayor Rudy Giuliani, a Republican, told “Meet the Press” that Wisniewski is part of a “partisan witch hunt” and should step down. Wisniewski countered that his committee of eight Democrats and four Republicans is bipartisan and would continue its investigation. The committee issued 20 new subpoenas Friday as the traffic jam plot reached deep into Christie’s administration; the Port Authority of New York and New Jersey, which runs the bridge; and Christie’s re-election campaign. Zimmer said another member of Christie’s administration, Community Affairs Commissioner Richard Constable, approached her later in May to reiterate what the lieutenant governor had said. According to Zimmer, he told her Sandy aid “would start flowing” to Hoboken if she backed the development project. Lisa Ryan, a spokesman for Constable, said Zimmer’s claim was false and questioned why she waited eight months to come forward. Ryan also asked why Zimmer didn’t take her concern to authorities “if she was so distraught.” David Samson, whom Christie picked to chair the Port Authority, is among those subpoenaed. He is a founding partner of the law firm representing the Rockefeller Group, the New York City developer seeking to build commercial space in Hoboken. A lobbyist for the group, Lori Grifa, was a member of Christie’s administration before leaving to work for a law firm. Calls to the firm went unreturned over the weekend. Wisniewski said he has no plans to subpoena the governor, and there is no evidence Christie knew about any lane closing scheme in advance. Christie is fundraising in Florida this weekend, but the events are closed to the press.

TORONTO Nick Young says the Los Angeles Lakers have woken up since airing some grievances at a team meeting last week. Young returned from suspension to score 29 points, Pau Gasol had 22 and the Lakers beat the Toronto Raptors 112-106 on Sunday, just their third win in 15 games. “Nick’s been doing it all year and he just keeps going,” Lakers coach Mike D’Antoni said. Young was suspended for Friday’s victory at Boston after he was ejected for throwing a punch at Phoenix’s Goran Dragic in a loss last Wednesday. Rested and refreshed, Young scored 15 points in the fourth quarter as the Lakers overcame a 19-point first-half deficit. They won back-to-back games for the first time since beating Memphis on Dec. 17 and Minnesota on Dec. 20. Los Angeles held a team meeting before Friday’s game to address Young’s ejection, and suggestions that his teammates had not done enough to stand up for him after a hard foul by Suns center Alex Len. Young called the meeting “a turning point” in what’s been a dismal season so far. “We had an altercation that woke us all up and we’re out there battling with each other now,” Young said. “Now we’re just laying it out there.” Ryan Kelly scored 17 in his first career start and Kendall Marshall had 10 points and 11 assists. Kelly said Friday’s meeting underscored a “lack of urgency” in both the team’s response to Len’s foul on Young, and the Lakers’ play in general. “That was carrying over into the game, a lack of urgency to get back on defense, a lack of urgency to rebound and things like that,” Kelly said. “When we saw that on tape, that’s the one thing it did for us is to make us realize that on every play, every possession, we have to have that sense of urgency.” The Lakers reached the midway point of the season with a record of 16-25. “It’s really gratifying to win back-to-back games on the road, especially with the way we’ve been struggling,” Gasol said. “I’m just really proud of the guys. They’re stepping up, they’re bringing the effort, bringing the intensity, bringing the focus and not wanting to give up.” Long-term injuries to Steve Nash and Kobe Bryant have made life rough on the Lakers, but they haven’t given up on a playoff push. “If we keep plugging along, maybe we’ll get some luck here and get some guys back,” D’Antoni said.

With Bryant sidelined by a sore left knee, Kelly said Young has become the player the Lakers turn to when the shot clock is winding down. “If we’ve got seven seconds on the clock, you give Nick the ball and he finds a way to get a shot or get to the line,” Kelly said. “Right now, we need that. It was great to have him back on the court.” Young went 10 for 11 at the free throw line Sunday and made five 3-pointers. D’Antoni said Kelly will start again when the Lakers visit the Bulls on Monday night. “The guy knows how to play,” D’Antoni said. “There’s no substitute for smarts and he’s got smarts.” DeMar DeRozan scored 23 points, Kyle Lowry had 21 and Patrick Patterson 17 as Toronto’s six-game home winning streak came to an end. “We didn’t get our defensive focus into the game all afternoon,” Toronto coach Dwane Casey said. The Raptors, who won 106-94 at Los Angeles on Dec. 8, failed to record the first season sweep over the Lakers in franchise history. “It definitely tough,” DeRozan said. “We have to understand that no matter how big the lead is, no team is going to lay down.” Amir Johnson had 13, Greivis Vasquez 11 and Terrence Ross 10 for the Raptors, who have never won consecutive home games against the Lakers.
