SACRAMENTO, Calif. The California Legislature is generally regarded as a fairly progressive institution, with a sizable gay and lesbian caucus and lawmakers representing an array of racial and ethnic groups. But one group has been dropping steadily in representation for nearly a decade — women. The number of women in the 120member Legislature has fallen from a peak of 37 in 2006 to 32 this year, and groups that promote women running for public office are concerned the trend will continue this election year. They also worry about how the dropoff will affect policy decisions in future years. “We have been losing a woman every election cycle,” said Bettina Duval, president of CALIFORNIALIST, which has raised more than $1 million to support female candidates since she founded the group 12 years ago. There is a general perception that California is doing well because women who are in office hold such powerful positions, she said. Both the state’s U.S. senators are women, it is home to House Minority Leader Nancy Pelosi, Assemblywoman Toni Atkins, D-San Diego, is poised to become the next speaker of the state Assembly, and California’s attorney general and secretary of state are women. Yet Duval fears women could lose three to five legislative seats this year, accelerating what has been a gradual decline. Moreover, newly expanded

showcase. And if that’s not enough, a documentary is in the works about the Samohi choir and its director, Jeffe Huls. Director and producer Varda Hardy, with the help of others, raised nearly $45,000 through a Kickstarter campaign in 2011 to fund the first stages of “Big Voice,” a film that explores public school art programs and the intensity and unity of the choir. “What really motivated me was I wanted to find out how Mr. Huls was able to make such extraordinary art at a public school,” she said. “I wanted to know his secret.”

are suing the state over its laws on teacher tenure, seniority and other protections that the plaintiffs say keep bad educators in classrooms. The case that goes to trial today in Los Angeles Superior Court is the latest battle in a growing nationwide challenge to union-backed protections for teachers in an effort to hold them more accountable for their work. The nonjury trial is expected to wrap up in March. “The system is dysfunctional and arbitrary due to these outdated laws that handcuff school administrators,” said Theodore J. Boutrous, the lead attorney on the case sponsored by an educational reform group. States across the nation have weakened teaching job protections, including generations-old tenure, to give administrators more flexibility to fire bad teachers. Tenure was created in the early 20th century to prevent arbitrary or discriminatory firings based on factors such as gender, nationality or political beliefs. It spelled out strict rules under which teachers could be dismissed after a probationary period, though opponents claim they make it virtually impossible to fire teachers who aren’t making the grade. The changes are occurring as states replace virtually automatic “satisfactory” teacher evaluations with those linked to teacher performance and base teacher layoffs on performance instead

Drought has ranchers selling cattle JASON DEAREN Associated Press

AROMAS, Calif. In January, business at the 101 Livestock Market’s cattle auction on California’s Central Coast is usually slow. The busy season is normally in June or July, when ranchers have had time to fatten their animals for weeks on spring grasses. This year, however, business is bustling, with packed pens of moaning cattle and cowboys standing on tip-toe to get a glance at their potential prizes. Because of historically dry conditions, California’s soil moisture — a key ingredient for the forage that cattle graze on — is low throughout the state. With feed costs high and weeks of dry weather in the forecast, ranchers are already selling off parts of their herds as normally green grazing pastures have turned brown. “We’re in the drought now, so a lot of these are going back to Texas,” said rancher and auction house co-owner Monty Avery, gesturing to a pen packed full of cows. “We usually sell about 100-150 animals per week. Now we’re seeing 800-1,000 per week, so the volume’s jumped up.” Gov. Jerry Brown has formally proclaimed a drought in California, a move that codified what farmers and ranchers in the state had known for weeks. The U.S. Drought Monitor has said there are “extreme drought” conditions in central and northern California, where much of the state’s ranching is located. California is now in its third dry year, with little snowfall so far this winter and forecasts suggesting only more sunshine. Precipitation in most of the state is less than 20 percent of normal and reservoirs are dwindling — one town on California’s far northern coast says it has fewer than 100 days of drinking water in storage. The state is the nation’s leader in dairy cows, and fourth overall in the U.S. for total number of cattle, trailing Texas, Nebraska and Kansas, according to the National Cattlemen’s Beef Association. With little free food available for cattle, some ranchers have already started controlling costs. Romaldo Martin, a cattle rancher who runs M&M Farms in Hollister, has sold more than 160 cows and calves at 101 Livestock Market over the past two weeks and plans to sell at least 100 more. He said it’s too expensive to buy hay to feed his herd, and the water on his land is drying up. “If the weather doesn’t change, I might need to get rid of all of them,” said Martin, who is in his 70s and used to run about 600 heads of cattle. “I’ve never seen anything like this in my life ... It’s a disaster.” The U.S. Department of Agriculture on Jan. 16 declared a drought disaster in some California counties, which allows farmers to apply for low-interest loans to help them cope. Ranchers are not included in the program. To help them navigate the historic dry weather, the University of California’s Division of Agriculture and Natural Resources is holding workshops. “From previous droughts we’ve learned that feeding the whole herd through the drought may spell the end of business,” said SEE DROUGHT PAGE 11

NEW YORK The Kevin Hart comedy “Ride Along” continued to speed through a typically quiet box-office frame, while the monster thriller “I, Frankenstein” couldn’t be roused from the dead. Universal’s buddy cop comedy “Ride Along,” co-starring Ice Cube, cruised to the top of the box office again, taking in $21.2 million in its second weekend, according to studio estimates Sunday. The film last week set a January debut record, with $48.6 million over the three-day holiday weekend. For the second weekend in a row, Universal claimed No. 1 and No. 2 at the box office, with the Afghanistan war film “Lone Survivor” earning $12.6 million in its fifth week. With a cumulative total of $93.6 million, the relatively inexpensive “Lone Survivor,” starring Mark Wahlberg, will soon cross the $100 million mark. “I, Frankenstein” had a sizable budget,

estimated at $65 million, yet opened with just $8.3 million. Starring a beefed-up Aaron Eckhart as Mary Shelley’s famous monster in a modern-day setting, the 3-D film wasn’t screened for critics and came into the weekend with little buzz. Lakeshore Entertainment financed the film, which was distributed by Lionsgate. With $13 million in overseas box office, “I, Frankenstein” could scare up better business internationally. Two family films trailed “Ride Along” and “Lone Survivor.” The animated squirrel comedy “The Nut Job” made $12.3 million in its second week for Open Road Films. Disney’s juggernaut “Frozen” added $9 million for a 10-week domestic total of $347.8 million. Several Oscar candidates sought to capitalize on their recent best-picture nominations. Expanding by a few hundred theaters were “Dallas Buyers Club” ($2 million, $20.4 million total), “12 Years a Slave” ($2 million, $45.5 million total), “Gravity” ($2 million, $261.2 million total), “Philomena” ($1 million, $25.8 million total) and

“Nebraska” ($1.4 million, $11.6 million total). Also adding theaters was “August: Osage County,” which earned $5 million, bringing its cumulative haul to $26.5 million. Some of the biggest Oscar bounces were abroad, where several nominees still have countries to open in. Paramount’s Oscarnominated “The Wolf of Wall Street” led international business, with a robust $31 million. Fox Searchlight’s “12 Years a Slave” has also proved unusually strong overseas for such an American story. It took in $8.3 million internationally over the weekend. Hollywood will largely cede next weekend to the Super Bowl, except for new releases “Labor Day,” starring Kate Winslet and Josh Brolin, and “That Awkward Moment, with Zac Efron and Michael B. Jordan. Estimated ticket sales for Friday through Sunday at U.S. and Canadian theaters, according to Rentrak. Where available, latest international numbers are also included. Final domestic figures will be released Monday.

California to fund research in stem-cell genomics THE ASSOCIATED PRESS SACRAMENTO, Calif. The state of California is preparing to invest up to $40 million in a new scientific field that backers say could revolutionize medicine and lead to personalized medical treatments. The directors of the California Institute for Regenerative Medicine are meeting in Berkeley this Wednesday to create one or two research centers for stem-cell genomics, the Sacramento Bee reported Sunday. Scientists and biotech companies in the San Francisco Bay Area, San Diego and

elsewhere are competing for the research money. Researchers believe that genomics, the study of genes and their relationships, can lead to more effective therapies that are tailored to a patient’s genetic makeup. The new research centers for stem-cell genomics could help make California a leader in the fast-moving field. “Right now, in a lot of ways, doctors are making educated guesses as to how to treat us patients more generally,” said UC Davis stem cell researcher Paul Knoepfler. “By knowing our genomic information ... they could be making far more educated choices

about treatments.” The move into genomics comes as the California Institute for Regenerative Medicine struggles to fulfill the promises of the 2004 ballot initiative campaign that created the $3 billion stem-cell agency. So far, no new therapies have emerged from the state institute, which will run out of cash for new awards in less than three years and needs some high-profile success to raise more money. Think about traffic near Samohi Editor:

Like Paula Goldman, (”Breathe, Bill,” Letter to the Editor, Jan. 21) I am a parent of a Santa Monica High School student who is very concerned about the safety of the students getting to and from Samohi. My issue is that the federal grant she refers to that is being used for the “Safe Routes to School” plan at Samohi can only be used to fund bicycle and walking safety additions. Therefore, the currently proposed project has only focused on adding bike lines and changing lights and turns to increase the safety of bikers and walkers and has not adequately evaluated the traffic impact of the project. In order to add bike lanes to Michigan Avenue and Seventh Street at the high school they have to change these streets to single-lane, one-way streets from the existing two-way streets. In October 2013 after this plan was in place the city planners said that the next step was to complete a traffic study and that they would have that for review well before the presentation at the February 2014 City Council meeting. I am one of many Samohi parents who are concerned about what the traffic impact will be at this extremely congested intersection at drop-off and pickup times by essentially reducing the traffic throughout by half. At the Dec. 10 PTSA meeting, the group voted to support the plan pending the traffic study which was supposed to be completed and disseminated by then but wasn’t completed yet. I have been in contact with the transportation planner and she said that the traffic report would be completed by the next PTSA meeting and that she would send me the report as soon as possible before that meeting. At 4:53 p.m., before the 6 p.m. PTSA meeting on Jan. 21, I received an e-mail from the transportation planner saying that she misinformed me and that she couldn’t release the traffic study to me or anyone as it would be a part of the staff report for the City Council meeting on Feb. 11. It would be made public as a part of the City Council meeting agenda on Feb. 5 or 6. At the PTSA meeting on Jan. 21, she reported that the results of the traffic study were that there would not be any significant impact on the traffic. How is there no significant traffic impact by reducing heavily congested two-way streets to single-lane, one-way streets? That just doesn’t make sense. I agree with Paula‘s statement that “there are very few options for protecting students from distracted, rushing drivers.” More traffic gridlock will increase the number of distracted and rushing drivers and make it less safe for our children. I am all for improving the safety of our kids getting to and from school but just adding bike lanes without doing adequate and transparent traffic analysis is not the right way to move forward. The Safe Routes to School program should not only address bikers and walkers but should also include improving traffic flow and increasing bus ridership to school. I have been paying adult fare for my son to take the bus to and from Samohi as there is no real student Big Blue Bus fare. Despite following up with the Big Blue Bus I have not gotten a response as to why the daily student fare that was in existence was dropped from the prices approved in May of 2010.

High noon for proposed Bergamot Transit Village IS THERE ANYBODY IN TOWN WHO

likes the Bergamot Transit Village (BTV)? Maybe a few folks and they work for Houston, Texas-based mega-developer Hines who has big — very big — plans for redeveloping an industrial property on Olympic Boulevard between 26th and Stewart streets. Hines purchased the 7.16-acre Paper Mate manufacturing site in 2007 for a reported $75 million. A few years later, the developer announced plans for a 969,000square-foot complex of offices, creative studio space, apartments and retail stores. In March of 2011, Hines presented their proposed project to City Council. The development by Gensler architects was universally panned and ridiculed. Hines was told to reduce the project’s size and go back to the drawing board if they expected to receive a coveted development agreement. Five months later, Hines returned to council with a revised plan that was 20 percent smaller. It was still too big, too much of a traffic generator and out of scale with the adjacent low-rise neighborhood. Buildings were still over 80 feet high. Fast forward. A more residential-friendly Bergamot Transit Village is before City Council Tuesday night. It’s obvious the Hines team has been ignoring residents and City Hall staff because the BTV is still a five-building, 765,095-square-foot development, but now with 473 apartments (93 affordable/workforce units) and 25 artist live/work spaces in three buildings. The 374,434 square feet of office space in two new buildings and 29,451 square feet of retail/restaurant space is still there. Subterranean parking capacity totals 1,927 vehicle spaces with facilities for 1,284 bicycles. At 85.6 feet, the tallest buildings will be higher than the adjacent Water Garden office complex. Green spaces and open plazas are scattered throughout the development which will be built in phases and likely sold off as portions are completed. Architecturally, the Hines development is a disaster. Each building tries to outdo its neighbor for clumsiness, unattractiveness and sheer banality. Between the BTV’s 1970s Orange County Business Park layout and faux European-industrial facades, the project is an embarrassment for all involved. Traffic-wise, the nightmare continues, unabated. As noted in my Dec. 2, 2013, My Write (“Bergamot Transit Village development is a monstrosity,” Pg. 4), Hines still underestimates the parking needs. Architect Ron Goldman has crunched the numbers and tells me that 2,363 parking spaces are needed for office employees alone. Add 747 spaces earmarked for residential parking plus another 100 spaces for restaurant/retail use and even with shared parking, the BTV garage should contain 3,400 spaces instead of 1,927 to prevent the possibility of overflow into nearby residential neighborhoods. Similar underestimates apply to traffic the BTV will generate. Hines maintains its development will only produce 6,900 additional daily car trips because of car pooling, a tough transportation demand manage-

ment program, Expo rail and bicycle-friendly initiatives. Even with these mitigations, the real projected trip count is probably closer to 15,000. Using the lower trip figures Hines supplies, the development will generate major congestion at 34 intersections and on numerous streets throughout Santa Monica and West Los Angeles. In addition, the new roads within the development and two new traffic lights on Olympic will pile on even more problems. Just think of the mess a small brush fire on PCH created two weeks ago times 250 working days a year. Hines takes credit for approximately two acres of ground space occupied by new streets and sidewalks in its Floor Area Ratio (FAR) calculations. Including streets and sidewalks in FARs? This allows Hines to deceptively present their project as less dense than it really is. This development is universally despised. Neighborhood groups, activists and everyday citizens are united in opposition to this project. Even the Santa Monicans for Renters’ Rights (SMRR) Steering Committee voted to oppose the project — a highly unusual move for the politically powerful organization. It’s interesting to note that one of SMRR’s key leaders, Judy Abdo, didn’t vote on the motion which is why co-chair Patricia Hoffman noted in her letter to the media last week that the vote was unanimous “among those present and voting.” Abdo and Councilman Terry O’Day cochaired Save Our City — the developer-supported group that opposed 2008’s failed ballot measure “T” (RIFT) that would have temporarily capped commercial developments like the BTV in Santa Monica. While six out of seven council members were endorsed by SMRR, there’s still a chance that enough of them will vote to move this development forward and commit political suicide by doing so. Council must shoot this down, pronto. They should tell Hines that building height can’t exceed 45 feet which is the current code. Insistence on the lower maximum height alone would mean a project half the size of the development that’s now proposed. And, one that may be more palatable to residents. City Council should also instruct Hines to consider adaptive re-use of the old Paper Mate manufacturing plant. Preservation and renovation of just part of the plant along with a couple new residential structures would make for a much more exciting and imaginative development. Like similar adaptive reuse-driven developments around the world, with the right use mix, the BTV could become a living community center that would also be a home for arts, unique shopping opportunities, entertainment and dining — with less traffic impacts. We’re all watching to see which City Council members will vote for us or for more density, traffic and campaign contributions. The latter choice is guaranteed to torpedo re-election bids in 2014 and 2016.

NEWPORT, R.I. A proposal to build a visitors center on the grounds of The Breakers, the Gilded Age Vanderbilt family mansion and national historic landmark, is dividing Newport’s preservationists, neighbors, and even some family members in a seaside city where tourism is its lifeblood. The Preservation Society of Newport County, the nonprofit group that owns the 70-room mansion, says the center is badly needed to serve The Breakers’ 400,000 annual visitors. Many opponents agree something is needed, but they want it across the street in the parking lot or elsewhere, not on the 13-acre grounds of the property, which they say would be irreparably damaged. During the months since the $4.2 million plan was released, then rejected by the city’s Historic District Commission, the disagreement has devolved into a bitter fight, with opponents who once considered themselves allies of the Preservation Society now accusing it of steamrolling or cutting people out when they disagree. The Preservation Society says it has explored the alternatives, and its plan is the only feasible one to protect the magnificent home built by railroad magnate Cornelius Vanderbilt II. “We have hired the best people, the brightest people. They’re very sensitive to the issues. There is no steamroller. We believe we’re doing the right thing,” said Don Ross, chairman of the group’s board. Both sides say they’re fighting for the future. Opponents set up a “Save the Breakers” Facebook page in August. The Preservation Society set up a competing page the next day, also called “Save the Breakers.” On Friday, the National Park Service weighed in, siding with critics and asking the Preservation Society to reconsider a plan it said could damage the national historic landmark. The Preservation Society will go before the city’s zoning board on Monday to appeal, and says if it’s again turned down, it will go to court. In the meantime, the plan has drawn some high-profile detractors, including designer Gloria Vanderbilt, who in a letter to the editor of Newport This Week last summer decried the possibility that visitors to the “magical kingdom” her grandfather built would be greeted by “plastic, shrink-wrapped sandwiches.” The Preservation Society acknowledges some Vanderbilts are angry, but says others privately support the idea once they hear more about it. The Breakers, named for the breaking

Atlantic waves it overlooks, is one of the most popular historic house museums in the United States. The estate opened in in 1895, during a time when Newport functioned as the nation’s summer social capital, and became the crown jewel in a city populated by mansions. By the middle of the 20th century, though, many of the once-splendid homes had fallen into disrepair. Some were razed. The Preservation Society was formed to save some of those buildings. It purchased The Breakers from Vanderbilt’s descendants in the 1970s and today owns 11 properties that collectively receive more than 900,000 visitors annually. Those who visit The Breakers today must either pay admission at a small ticket booth or at a tent erected on the grounds during warmer months. Restrooms are in the basement or in portable toilets outside. Snacks are available from vending machines situated in an outdoor shed. The Preservation Society’s plan calls for a 3,700-square-foot building reminiscent of a conservatory to be built inside a grove of trees, where it says it would not be visible from the house or street. It would include ticketing for The Breakers and other of its houses, as well accessible restrooms. It would offer a place to get out of the weather as well as a place to buy sandwiches and sit. Opponents ask why it can’t simply be built across the street, where it would be close by while not disrupting the original plan of the estate’s designers, including architect Richard Morris Hunt, forester James Bowditch and his brother, landscape engineer Ernest Bowditch, who was a student of Central Park designer Frederick Law Olmsted. The Preservation Society says the building would take up too many parking spaces, forcing more traffic into the neighborhood, which includes several other large residences, Salve Regina University, and an entrance to the Cliff Walk, itself an attraction that draws hundreds of thousands of visitors annually. It also says building it in the lot would be too far from the house and could be seen from the street. “That’s nonsense,” said Don Christ, chairman of the board of the Alletta Morris McBean Charitable Trust, which has given more than $10 million to the Preservation Society over the years and is among its largest donors. He calls the current plan inappropriate and says he doesn’t understand why a group that stands for preservation is pushing it. He also objects that the group plans to spend so much on the project when there are other preservation projects at The Breakers that could use the money.

What’s up with the pines? Dear EarthTalk: How is it that climate change is responsible for killing whitebark pine trees and thus impacting mountain ecosystems?

WHITEBARK PINE TREES ARE A “KEYstone” species in high-altitude ecosystems across the American West, meaning they play an important role in maintaining the natural structure of many of our most iconic mountain regions. Wildlife from grizzly bears to songbirds are dependent on whitebark pine seeds for nourishment, while forest stands of the trees stabilize and shade the snowpack in winter, which helps reducing avalanches and helps extend snowmelt flows into the dry summer months. “This slow melting process not only keeps rivers cool for trout and other aquatic wildlife but also helps maintain sufficient water resources for the people living in the arid American West,” reports the non-profit Natural Resources Defense Council (NRDC), a leading U.S. environmental group. Given how important the iconic tree is to Western mountain ecosystems, it’s no wonder that NRDC and other green groups are distressed by its recent decline due to changing environmental conditions. “White pine blister rust, a lethal disease accidentally brought to the continent on imported seedlings, has wiped out roughly 50 percent of the whitebark pine in the Rocky Mountains since its arrival in the early 20th century,” reports NRDC. “In some areas such as Glacier National Park, it has killed 85 to 95 percent of the whitebark pine. Infected trees can take a long time to die, but the disease can also cause their cone production to drop significantly, affecting grizzlies and other wildlife.” And now a newer threat, expanding populations of mountain pine beetles, is exacerbating the effects of blister rust. These small insects bore into mature pine trees, killing them by eating critical tissue under the bark. “Cool year-round temperatures and freezing

winters once kept this beetle confined to low-elevation forests, where native lodgepole pines evolved natural defenses against beetles,” reports NRDC. “Global warming, however, has allowed the mountain pine beetle to expand its range into high-elevation forests, where the whitebark pine is virtually defenseless against this newcomer and its explosive attacks.” NRDC fears that this one-two punchbeetles attacking mature whitebark pines and blister rust killing smaller ones-could have a devastating impact on high-altitude forests across the American West. In late 2008 the group petitioned the U.S. Fish & Wildlife Service to protect the tree under the Endangered Species Act. A year and a half later the agency indicated that the tree might be worthy of endangered species status, although the case is still under review. “Endangered Species Act protections could help federal agencies focus their whitebark efforts and could bring increased resources for research, conservation, and restoration efforts,” adds NRDC. Everyday people who live in or near whitebark pine territory can help the cause by taking photographs and writing down observations about the changing health of high-altitude forests and the prevalence of Clark’s nutcrackers, red squirrels and grizzly bears, each of which depends on the trees for sustenance. The Whitebark Pine Citizen Scientists Network, a project sponsored by NRDC and TreeFight.org, coordinates this research and synthesizes the findings to give researchers and policymakers more information so they can make sensible land management and species protection decisions. WOMEN FROM PAGE 1 term limits (to 12 years in each chamber) mean incumbents could lock out female challengers for more than a decade. California ranked sixth in the nation in the percentage of women serving in the Legislature in 2004, according to the Center for American Women and Politics at Rutgers University. It has slipped steadily as women left their seats in California, and other states added female lawmakers. California now ranks 19th among states. Vermont and Colorado rank highest, with women accounting for 41 percent of state lawmakers. Nearly 27 percent of California’s Senate and Assembly seats are held by women, slightly higher than the nationwide average of 24 percent. But it’s far below the 50.2 percent of the state’s population who are women. “I always say the Legislature should be a microcosm of California,” said Assembly Minority Leader Connie Conway, R-Tulare, who is one of eight women leaving the Legislature this year because of term limits or retirement. A ninth will leave in midterm if she is elected to Congress. Conway serves on two of the many organizations that try to recruit, train and fund female candidates: Right Women Right Now, a national initiative of the Republican State Leadership Committee; and California Women Lead, a nonpartisan effort to boost the number of women in elected and appointed office at the state and local levels. “It is really about reaching out to women and helping them understand what’s out there,” Conway said. Women bring a valuable perspective to lawmaking, said Sen. Hannah-Beth Jackson, D-Santa Barbara, vice chairwoman of the Legislative Women’s Caucus. She said women have promoted legislation related to education, paid family leave, child care, employment discrimination, domestic violence and sexual harassment, among many topics. Legislative leaders of both political parties said they actively recruit female candidates. Yet the successes that women have had elsewhere in society have made it more difficult to entice them to run for political office, advocates and lawmakers said. That applies not only at the state level but also to local offices such as school board or city council. “It seems that we don’t have enough qualified folks in the pipeline who want to come to Sacramento, and we need to work harder at that,” said Assemblywoman Bonnie Lowenthal, D-Long Beach.

Women are increasingly busy with their own careers and might be reluctant to leave their jobs and families to travel to the capital for much of the year, advocates and lawmakers said. They also might be more reluctant to ask donors to contribute to their campaigns or to engage in the blunt-edged, highly partisan discourse that increasingly surfaces in political campaigns. “Women are not stepping forward in the numbers that correspond to our place in the population,” said Sen. Lois Wolk, D-Davis. “Until we break that 50 percent ceiling, we won’t be as effective as we’d like.” Most of the old prejudices and stereotypes against women seem to have disappeared, advocates and lawmakers said, yet they said there are differences that can make recruiting women more difficult. “There’s sort of a ‘good old boys club,’ and men tend to mentor each other. Men tend to get into politics when they want to and because they want to,” Jackson said. “Women tend to feel that they have to be ready and have to ask permission, or be encouraged to do so.” That encouragement can start at a younger age, she and others said, and include groups such as military veterans, retirees, women whose children have grown up and those who have been successful in a career and want a new challenge. Currently, 20 of the 80 Assembly members are women. That includes seven of 25 Republicans and 13 of the 55 Democrats. Twelve of the 39 sitting lawmakers in the Senate are women. With one seat vacant, that includes 10 of the 28 Democrats and two of the 11 Republicans. Democratic women are all but certain to lose seats in this year’s elections, yet the loss could be made up if Republican women gain ground, said California Target Book publisher Allan Hoffenblum. In the Senate, two Democratic women are likely to be replaced by male candidates, but Republican women have opportunities to replace men in three districts. The Assembly is likely to have two Republican and four Democratic women replaced by men, said Hoffenblum, whose publication analyzes legislative and congressional campaigns. But women have a chance to replace men in five other districts. Advocates and party leaders are scrambling to recruit more candidates as the deadline for running in this year’s elections approaches. Declarations of candidacy and nomination papers must be filed between Feb. 10 and March 7. “Our plate isn’t full yet,” said Conway, the Assembly GOP leader. “We’re still talking to people who are considering running.”

They also say the evaluations are too dependent on standardized tests and that eliminating such protections erases a vital support system for a profession already losing talented people to higher paid private sector positions. The California Teachers Association and the California Federation of Teachers intervened and asked the court to throw out the lawsuit filed against the state, including the Department of Education, Gov. Jerry Brown and Superintendent of Public Education Tom Torlakson. “It is deceptive and dishonest to pretend that teacher due process rights are unfair to students,” said California Federation of Teachers President Josh Pechthalt, the parent of a ninth-grade student in the Los Angeles Unified School District. “Students need a stable, experienced teaching workforce. They won’t have one if this lawsuit succeeds in gutting basic teacher rights.”

Judge Rolf Treu, who will decide the case, rejected a motion to dismiss the case. The lawsuit wants the court to deem unconstitutional five statutes within the state education code. Besides the one on tenure, three others lay out the steps to dismiss a teacher, and the fifth mandates the last-hired, first-fired rule, which the lawsuit’s attorneys say hurts teachers who are young but may be talented. “Every student in California should be taught by a teacher with the background and skills they need to help their students succeed,” the California Department of Education said in a statement issued Sunday. “There is nothing in the law that prevents districts from making sure unqualified or unsuitable teachers don’t become permanent, just as there is nothing that prevents them from removing teachers from the classroom when necessary.” The plaintiffs are students primarily from the Los Angeles and Bay areas. They are supported by a nonprofit organization called Students Matter that says it fights for education equality. Los Angeles Unified School District Superintendent John Deasy, who oversees the nation’s second-largest school district, will be

called to testify by the plaintiffs, Boutrous said. Plaintiff attorneys say teachers too often get tenure by just showing up for work — after about 18 months in California. Afterward, bad teachers are almost impossible or too expensive to fire, Boutrous said. “The school system knowingly puts kids in classrooms with teachers who are grossly substandard,” Boutrous said, adding that it was crucial to turn to the courts because “the political system can’t fix this.” Many districts send substandard teachers to disadvantaged schools instead of dismissing them because those schools are seen as less desirable places to work by experienced teachers, who can have priority where they are assigned, Boutrous said. The California teacher unions say they support improving teacher evaluations and streamlining the dismissal process. But those changes should be made by the Legislature not the courts. Laura Lacar, a high school teacher in the ABC School District, fears the law could expand beyond what happens in the classroom. “It would be very scary to me, if this lawsuit succeeds, to think that I might not have a job next year, not for anything I’d done in the classroom, but because my principal didn’t like

me, or my clothing, or something I’d said.” Declaring the laws unconstitutional will allow the Legislature to craft legislation that does work, the lawsuit’s attorneys say. Karen Martinez, who lives in San Jose, said her daughter, Daniella, who is a plaintiff, reached the third grade unable to read before a teacher helped her. “I’m hoping with all my heart that we win this case, so California can change a system that is clearly failing so many children,” Karen Martinez said. “To me, it’s common sense: appreciate and reward the teachers who are doing great, and hold accountable the teachers who are failing our kids.” Terry Moe, a senior fellow at Stanford University’s Hoover Institution who has researched teacher unions and their impact on public education, said there’s a long way to go even in states that have adopted new laws. “Unions can make life difficult for administrators in coming years,” he said. “The political pressure on the ground is strong. It’s going to be really difficult to follow through on these new laws and put a dent in teacher tenure and really do away with the role of seniority.”

As they sift through the footage and develop a story, Hardy said, one of the driving forces is Huls’ personality. “He’s a big-hearted person, and his intentions are good, but he also has an edge,” she said. In one early clip, posted to the Hardy’s Kickstarter page, Huls flexes his jaw, waiting for the class to quiet down before making subtle alterations to a piece that was performed minutes earlier and, to an untrained ear, sounded perfect.

It’s clear, however, that the students latch on to his intensity. “He really engages everyone and he really makes you learn the theory, the technical part of the music,” said Gsell, one of the YoungArts finalists. “I know how to sightsing and rhythmic sight-sing. I know a lot of people who are the same age as me but go to different high schools and know nothing about that. The learning process is faster and it’s just more fun.” For Hardy, the underlying theme is about

unity, which she sees as a larger societal issue. “What struck me at the time, thematically, was that there was an ongoing dialogue about the importance of the individual and about the importance of the group,” she said. “The discussions happened between the students and with Mr. Huls. And when they sing together the voices blend and you’re literally becoming one voice.”

The bowling alleys enjoyed early success, attracting retired three-time U.S. Professional Bowling Champion Martin “Pop” Kern. Years earlier Pop Kern gained notoriety for bowling two of the most sensational consecutive games ever recorded – a 300 in one game followed by 297 in the next! Kern retired from professional bowling and assumed management of the pier alleys where he shared his love and knowledge of the game. In 1926 he passed away and interest in the pier’s alleys waned. By 1930 the alleys closed for good.
