The City of Santa Monica has negotiated the authority to close the Santa Monica Airport on Dec. 31, 2028. At a special meeting on Jan. 28, the council announced a deal with the Federal Aviation Administration and the United States government that dissolves all pending legal disputes between the agencies and sets a date for closing the facility. Under the terms of the agreement, the airport can close on Dec. 31, 2028, the runway will be immediately reduced to 3,500 feet (from 4,973 feet) and both sides agree to adhere to the terms without interfering with each other’s rights.
City Hall will regain control over the reclaimed runway land with six months according to City Manager Rick Cole. That land can be used as the city desires with an exception for an airport right of way that would prohibit uses of the former runway land that would interfere with airport traffic. “This agreement ensures local control. As part of that, as part of the future planning, many things are on the table,” said Interim City Attorney Joseph Lawrence. Staff said shortening the runway will reduce current jet traffic by about 40 percent and the shorter runway will eliminate the possibility of charter flights into or out of the airport. The agreement also allows the city to pursue its munic-

ipal takeover of airport services and allows for Santa Monica Airport to develop a pilot program for the sale of unleaded fuel. City Hall had previously voted to pursue closure of the airport by 2018, however its efforts resulted in multiple legal disputes with the FAA and airport users. A prior court ruling had said the airport could close no earlier than 2023 and multiple complaints have been filed with the FAA over the city’s actions at the airport. Lawrence said compromise between the FAA and the city resulted in the city agreeing to extend the closure date to 2028 and the FAA agreeing to the immediate reduction in runway length. The City Council agreed to settle a lawsuit involving an LAX employee who was hit by a Big Blue Bus employee driving a utility vehicle $2,875,000 after a closed session meeting Tuesday night. Lisa Fuqua was in a marked crosswalk at Avion Dr. and 98th Street near the Sheraton Gateway Hotel in Westchester when a truck hit her on Sept. 24, 2013. The BBB employee behind the wheel, Ramon Barba, was on his way to repair a bus near LAX when he hit Fuqua, according to court documents. The former management analyst for the City of Los Angeles will likely deal with her injuries from the crash for the rest of her life, according to her attorney David A. Azran. “She was actually attending a course that was being put on by the City of Los Angeles for her advancement,” Azran said over the phone from his office in Encino. “She was in management and was attending a course and actually on her way to obtain some materials from her car to go back to the
course when she was struck.” The crosswalk was marked by a stop sign. The impact of the truck sent Fuqua flying several feet before hitting the pavement. Because she was working for Los Angeles at the time, part of Fuqua’s settlement will go toward reimbursing her worker’s compensation benefits. Fuqua could not be reached to comment on her settlement, but Azran says she was relieved to avoid the stress of a jury trial that could have lasted up to three weeks. “This would have been an expert driven trial,” Azran said. Forensic accountants, medical experts, accident reconstruction and biomechanical engineers, as well as life care planning experts would have likely been called at trial. Acting City Attorney Joseph Lawrence declined to comment on the settlement to the Daily Press. Insurance will cover most of the multi-million dollar pay out, with $1 million in City funds going toward defense costs and the plaintiff. Seismic retrofit list released The City of Santa Monica released its list of buildings that may require a seismic retrofit to ensure their safety in the event of an earthquake. This comes in advance of the Feb. 14 Santa Monica City Council meeting on the Seismic Retrofit Ordinance. The buildings on the list were identified through building permit records and/or visual identification. These buildings display characteristics such as age, appearance, construction material, method of design and construction, and structural records that may indicate a potential need for strengthening. Inclusion of a building on this list is not confirmation that the building is structurally deficient, hazardous or unsafe. Buildings on this list will receive notice from the City on Santa Monica to complete a structural analysis. Buildings found by the structural analysis to be non-compliant with established standards for earthquake resistance will be required to undergo a seismic retrofit. the agreement is unprecedented in its ability to close a currently functioning airport. “No other community in the United States has been able to achieve the closure of a fully operational airport,” he said. “The City of Santa Monica and its community has achieved that through this agreement.” The new deal dissolves two federal lawsuits and a pending notice of investigation with the FAA. Private complaints against the city filed with the FAA, known as Part 16 complaints, are still pending but the individual filers will have the opportunity to withdraw those complaints in the coming days. If they are not withdrawn, officials said there is a mechanism in place to resolve those concerns quickly. While both sides agree to various provisions, Lawrence said future disputes could well arise. In those cases, the agreement puts those disputes in the jurisdiction of the district court, not the FAA. According to the FAA, the city is required to provide leases to private aeronautical service providers until the runway is shortened and the city decides to implement its own airport services. “Mutual cooperation between the FAA and the city enabled us to reach this innovative solution, which resolves longstanding legal and regulatory disputes,” said FAA Administrator Michael Huerta. “This is a fair resolution for all concerned because it strikes an appropriate balance between the public’s interest in making local decisions about land use practices and its interests in safe and efficient aviation services.” Council voted to approve the settlement on a 4-3 vote. McKeown said the city missed an opportunity to press its advantage. “With this settlement, we snatch defeat from the jaws of victory. This, at a time when the FAA’s willingness to negotiate revealed that the FAA itself suspected they would lose their court battles with Santa Monica — even while they continue to hold our land hostage,” he said. Vazquez said he felt the city had the upper hand in negotiations and could have pressed for an earlier closing date. He said that while a court case has no guarantees, he thought the city had a worst-case scenario of closing the airport by 2023. He also said a lot can change in 12 years. “I’d hate to see a future council cut a deal with the FAA to continue to operate this airport any longer than 12 years,” he said. Himmelrich said the agreement lacked certainty and was too generous in allowing continued jet operations. “I further believe that having the burden of even a reduced number of jets over our neighborhoods and effecting our residents is something, and frankly West LA residents, is something that is unacceptable to me,” she said.

administration has propelled me into getting politically involved. I was advised to start by sitting in on City Council meetings and decided to attend Tuesday, January 24, which happened to have a hot button issue – the new building behind city hall – that I was able to view from the interesting perspective of a neophyte. I listened as everyone stated their case. It was an exciting first look into how our democracy works at the local level and I’m lucky to have been a part of it. When the council ultimately ruled to deny the appeal, languished sighs and “boo!” were heard from the crowd. I watched as the appellant, David Garden, looked smugly toward Council as the public gave their support in his defense. Why project such an air of superiority to your constituents? Nothing even close to “concerned” jumped out at me about his appeal – more like control. But I gave him the benefit of the doubt to focus on the greater issue at hand – proper use of tax payer money. For years, solar and other zero-waste technology hopefuls have been overwhelmingly used by the mid-to-upper middle class for one reason: they can afford the upfront costs. As time goes on, the Elon Musks of the world will continue to develop cheaper renewables, but this is still cost prohibitive for many despite the Federal and State grants of additional money to incentivize lower income households to purchase them. These are the people who can afford to pay for something in cash, while the rest of us put it on a credit card to spread out payments over 12 months. City Hall’s new building is a testament to this fact: that renewables still come at a higher short term cost which we can’t reap the benefits for immediately, but will overwhelmingly in the long run. My one complaint is that the report was
not as data driven as it could have been to assuage the crowd. Any real cost – savings or otherwise – data was cut out from a slide in favor of verbally disclosing amongst a group that had already made up their minds. When in doubt, show the numbers. Research the companies that formed the Living Building Challenge (an aspirational benchmark, not a trophy grab): if they all show a commitment to sustainability, i.e. through operating as Benefit Corporations or giving grants to grassroots climate change activism, tell us! If there is zero conflict of interest and a separate set of materials and contractors will be used, tell us that too! Acknowledge that this has been carefully considered and not a gotcha! cost. It also doesn’t hurt to show a graph of cost savings over a 10-20-30 year period, and mentioning from the get-go that this is earmarked specifically to projects such as these, and cannot go toward any other type of social services initiative. At a time when rents are skyrocketing (an 18% lease increase for current buildings is not what us rent-controlled residents have to deal with, despite one commenter mentioning, that we’re all renters here – why doesn’t the city want to rent too?) and our current administration believes climate change is a Chinese hoax, it is more important than ever that we continue to set an example of progress while the rest of the country is moving backward. I attended the annual meeting of the Pacific Palisades Democratic Club recently. Among the speakers were L.A. Mayor Eric Garcetti, Ben Allen, Richard Bloom, and Congressman Ted Lieu. I was particularly moved by the very inspirational talk given by the Congressman. He spoke about what he will be doing (and what we can do) to protect liberal values. Our job is to stay vocal about the causes we believe in; let our elected officials know they have our support; and get involved with organizations that are lobbying for the those causes. I was particularly pleased to hear that Congressman Lieu plans to co-author legislation for a revenue neutral carbon tax. This is in keeping with the resolutions of our state legislature and the Santa Monica City Council.

Mayor Eric Garcetti and the Los Angeles Department of Transportation (LADOT) have announced the release of the city’s first Vision Zero Action Plan. The plan outlines the city’s blueprint to reduce fatalities by 20 percent by the end of 2017 with the ultimate goal of eliminating traffic deaths by 2025. We can work together to keep people walking, biking and driving out of harm’s way — and the Vision Zero Action Plan is a blueprint for making our streets safer for everyone, no matter how they get around the city,” said Mayor Eric Garcetti. “The strategies in our plan can save lives. We’re committed to seeing them through, as quickly as possible, to reach our goal of completely eliminating traffic-related fatalities in Los Angeles by 2025.” The Action Plan identifies the highest concentrations of fatal and severe injury collisions on the City’s High-Injury Network. Additional priority was given to fatal or severe injury collisions that have involved older adults and children, as well as collisions that occur in communities with negative health outcomes. This combination of severity, vulnerability, and social equity developed a prioritization methodology that identified 40 priority corridors called out in the Action Plan. Focusing Vision Zero efforts in 2017 on these priority corridors will help achieve the goal of a 20% reduction in traffic deaths by the end of the year. “Car crashes are one of the leading causes of death for our children, teens and young adults here in LA. It is imperative we address this public health crisis and spare more families the misery of lives cut too short. We need better traffic enforcement combined with street designs that discourage speeding. By prioritizing Vision Zero and regularly reporting on implementation progress, we are holding leadership accountable and making a commitment to save lives,” said Los Angeles Councilmember Mike Bonin. The Action Plan also highlights a series of projects that work. For example, since the installation of a scramble crosswalk at the intersection of Hollywood and Highland in November 2015, there have been zero deaths and serious injuries because of a collision. Leading pedestrian intervals installed at 22 locations, or “pedestrian head starts,” have been shown to result in a 60% reduction in vehicle collisions with people walking. These are just a snap shot of the many projects, both infrastructure and non-infrastructure, that will continue to be implemented to eliminate traffic fatalities. “Traffic crashes are the leading cause of death for children in LA County, and Los Angeles experienced a 40 percent increase in traffic deaths in 2016. Each and every one is preventable - not a natural outcome of our transportation system. This action plan is a roadmap that requires our full participation and partnership with every Angeleno to keep us all safe,” says LADOT General Manager Seleta Reynolds. The Action Plan is organized around the following key outcomes, to emphasize the importance of working together to achieve Vision Zero goals: Create Safe Streets for All, Develop a Culture of Safety, Adopt New Policies and Legislation to Strengthen Safety and Respond to Relevant Data. Each outcome has a series of strategies and actions, with benchmarks to be measured in 2017, 2020, and 2025. For example, the Department of Transportation is the lead on investing $2 million on an education campaign in 2017, including creative development, on-the-ground community-based outreach, as well as a paid media campaign. The Los Angeles Police Department has also partnered with LADOT to increase a focus on speed enforcement on the Vision Zero High-Injury Network. “Traffic safety is a core function of the Los Angeles Police Department, and our traffic divisions are dedicated to focus on tactics and missions that help achieve our goals of reducing deaths and serious injuries,” said LAPD Chief Charlie Beck. “By partnering closely with LADOT, we are making important progress on joining efforts so that engineering, education, and enforcement complement each other to effectively save lives.” The Department of Transportation has also published a technical companion, called the Vision Zero Safety Study. The study expands on the data that was used to develop the High-Injury Network. Each traffic fatality has a story and the Safety Study helps to provide the additional information needed to come up with an effective solution. ON JANUARY 21, AT ABOUT 8:36 P.M. Officers responded to a radio call for service at Bloomingdales regarding a theft suspect in custody. Officers determined the suspect entered the store and selected clothing. The suspect attempted to purchase the merchandise using a $100 bill. The sales clerk believed the bill was fake and called Loss Prevention for assistance. The Loss Prevention Agent checked the bill and determined the bill was counterfeit. The suspect was detained until police arrival. An additional counterfeit bill was recovered from the suspect. The suspect was taken into custody without incident. Enrolling next year’s kindergarteners in SMMUSD Elementary schools throughout the Santa Monica-Malibu Unified School District will be welcoming resident parents of incoming Kindergarteners to tour the schools and find out more about enrolling their children for the 2017-18 school year. thinking about potential budget cuts and to receive projections. The overall budget process can take months and a final budget will not be approved until June. For the 2016-17 school year, SMMUSD has a total revenue is $100,299,367 with expenditures of $111,881,738, leaving the district with a $11,582,371 deficit. SMMUSD listed $87,132,301 in ongoing funding and $2,693,336 in one-time income. The one-time payments come from the state and are a result of past changes to school funding. Those payments are due to expire soon and the loss of that income combined with the ever-increasing cost of employee benefits is forcing the district to
anticipate budget cuts. Maez said SMMUSD should aim for a $4 million reduction, but not all at one time. “The size in reduction in any one year would be very dramatic and have a longterm consequence, and we want to do it more gradually,” she said. The district is considering cutting $2 million for the upcoming year, then another $1 million each of the following two years. While officials discussed the tiered cut approach, they were also aware that uncertainty at the state and federal level can rapidly change the local budget picture. “Today is an awareness of the challenges we will face. In between now and three or four months we will be working hard with the budget committee, to come up with some ideas to benefit the school district,” said Superintendent Ben Drati.

The presentation included seven different functions where reductions can be made. These areas included instruction, other instructional staff such as staff training, site administration, instructional media, pupil services, instruction supervision, maintenance and operations and district administration. During the workshop Maez asked the board to choose the top four functions to address, in other words reduce. Maez wants the staff and the budget committee to focus on the areas for reduction, ultimately asking the board to provide guidance. Discussion over the specific cuts will be ongoing over the next several months but the board stressed the need to make cuts in a way that will create a sustainable funding model. “We do need to reduce but for me, I want
us to spend money that enhances the learning, and defines who we are,” said new boardmember Jon Kean. Boardmember Craig Foster said fresh eyes on the problem might identify new efficiencies. “I think judgment is going to most important thing here. If Dr. Drati can build a culture where our leaders are goal oriented and focused on excellence through equity then a person can look at a department and see what needs work,” he said. No action was taken at the workshop but staff will continue to work with the budget committee and establish recommendation for the Board to consider in early March.
