Two time cancer survivor climbs to the top

New suit calls NMS a ‘criminal enterprise’

Lila Javan is a cinematographer, Venice resident, two-time cancer survivor, mountain climber and a documentary film maker working to utilize her experience as a way to change lives. Javan was first diagnosed in 2010 with Acute Myeloid Leukemia (AML), which is the second most common type of leukemia diagnosed in both adults and children, according to Conquer Cancer Foundation.

Her film about her journey to climbing Mount Kilimanjaro in Tanzania will help raise funds for cancer research. “I was 39 at the time, and was a marathon runner in my early thirty’s, I had always been active,” said Javan. “I was working a lot and now when I look back at it, I remember I could feel my blood running through my body in an unusual kind of way.” Javan was told that sixty percent of her blood was cancerous and she SEE SURVIVOR PAGE 6

In a new case filed against Santa Monica’s biggest developer, NMS Properties, a hedge fund accuses the major Los Angeles developer of acting like a “criminal enterprise” that operates through forgeries, lies, threats and sham lawsuits. The latest lawsuit filed by AEW alleges NMS’s CEO Neil Shekhter’s misdeeds go far beyond submitting forged documents to the court. The lawsuit claims he has sent fake contracts to banks and lenders to confuse the terms of a joint venture agreement (JVA) between the two companies worth more than half a billion dollars. “In order to inflict maximum pressure on Plaintiffs, Defendants also initiated a series of copycat lawsuits involving the same false and misleading allegations regarding the authenticity and validity of the JVA,” reads the complaint filed Jan. 25th in federal court, adding the lawsuits amount to extortion intending to “sue AEW until it breaks.” Back in December, a federal judge found

Shekhter forged contracts, lied and destroyed evidence in a lawsuit to buy out AEW’s interest in nine properties, six of which are in Santa Monica. The judge gave AEW full control of the properties and the hedge fund quickly sold them to a San Francisco developer for about $430 million, much less than market value. Shekhter’s attorneys have appealed the ruling and filed a counter-suit, accusing AEW of its own shady dealings to sell the buildings. In the meantime, NMS had continued to manage the properties and collect rent from tenants. That all changed last week, when a separate judge stepped in and put a third party, Lincoln Property Company in charge of the buildings. Shekhter’s attorney, Skip Miller of Miller Barondess, LLP, says tenants will not notice the change in management. Websites for the specific properties involved now redirect to NMS’s general website. A notice on the door of at least one building alerts tenants to the management shake-up.

To some, preserving a neighborhood might mean buildings. To others, it’s the trees. To Ayde Gonzalez, the new Neighborhood Preservation Coordinator for the City of Santa Monica, it’s the people. “The goal of the role is really to keep Santa Monicans housed,” Gonzalez said in an interview at City Hall, “and right now I’m focusing on tenant protection programs that are in place.” It’s a broad job with the possibility of big impact: about 70 percent of the City’s population rents. Right now, the City has no idea how many tenants are considering leaving their buildings – rent controlled or otherwise – because of issues with their landlord. After just three weeks on the job, Gonzalez is still sifting through a complicated web of rules, tenant protections and regulations that spans at least five departments in the City. As she tries to understand what exactly she can do to help renters who feel like they’re being forced from their

homes because of construction or poor management, she’s realizing the complicated picture they face. “Part of my role is to help people by connecting the dots ahead of time so that they’re not spending their time and getting frustrated trying to figure out who to talk to,” Ayde said. A Santa Monica native, Gonzalez has worked with tenants to stay here for the past 20 years. For the last ten, she worked as director of resident services at Community Corp, a non-profit affordable housing provider. When Gonzalez applied for this job, she tried to look for examples from other cities to find out what they’re doing to maintain diversity in their neighborhoods despite escalating rents and a hot real estate market. She realized that the job doesn’t really exist anywhere else. Santa Monica Conservancy Achieves LEED Gold The Santa Monica Conservancy has earned LEED Gold certification, demonstrating that even a small, 100-year-old house can be rehabilitated and adapted for sustainable, contemporary use. Awarded by the U.S. Green Building Council, Leadership in Energy and Environmental Design is a globally recognized symbol of excellence in green building. The Conservancy sought LEED certification for the Shotgun House, the site of its Preservation Resource Center, to emphasize that historic rehabilitation and sustainable, green building design and construction can be mutually beneficial.? “We are extremely pleased with the LEED Gold certification,” notes Conservancy president Carol Lemlein. “We made sure that the rehabilitation was done not only in a historically sensitive way but also sustainably under the leadership of Conservancy board vice president John Zinner, principal of Zinner Consultants, and his partner Glen Boldt.” LEED™ has both prerequisites and credits, which earn points in categories such as water and energy efficiency, resources and materials, and indoor environmental quality. The Shotgun House earned points for all categories, most notably in its reuse of 95% of the original site as well as recycling 95% of its construction waste. Additionally, the Shotgun house features a drought-resistant, water-efficient garden. “As a leader in implementing Green Building techniques, Santa Monica can proudly point to more than 50 structures in the City that have been recognized with LEED™ certification,” says Santa Monica Mayor Ted Winterer. “We are delighted the Santa Monica Conservancy has added yet another to our growing list and applaud its accomplishment in meeting the challenge of achieving the Gold standard for an historic property.” A display describing the LEED rating is now part of the educational program at the Preservation Resource Center. The Conservancy thanks Engineering Economics, Inc (EEI), Brummitt Energy Associates, Carbon Solutions Group, Recology and the team at Zinner Consultants. Founded in 2002, the Santa Monica Conservancy is a nonprofit organization dedicated to promoting understanding of the cultural, social, economic and environmental benefits of preserving the historic resources of Santa Monica’s unique urban landscape. ON JANUARY 24, AT ABOUT 10:57 P.M. Officers were patrolling the area of 1500 Palisades Park made contact with a subject walking along the park. The subject admitted to having just urinated in the park but did not have any identification on him. Officers asked the subject if he had any weapons on him. The subject stated he did have a knife concealed in a sheath on his waistband. An approximate 9” fixed blade knife was recovered. The suspect was taken into custody without incident and was on felony probation. Valdez Gonzalez, 54, homeless was arrested for carrying a concealed knife and a probation violation. He was denied bail.

St. Matthew’s music guild – musical time travel, Music at St. Matthew’s continues its 32st season of concerts in Pacific Palisades with an opportunity to travel through 500 years of music from Venice, Paris and New York. The concert features twelve of the finest choral voices in Los Angeles, the critically acclaimed Chamber Orchestra at St. Matthew’s and the Jennifer Leitham Jazz Trio. The concert begins with music from Venice where, in the early 1600s, Giovanni Gabrieli and Claudio Monteverdi revolutionized the musical world by placing antiphonal groups of singers, brass and strings in balconies around the Basilica of St. Mark’s. Their experiments – in many ways the first music to be heard in quadrophonic sound – introduced new textures and dynamics that became the basis of Baroque style. Their music will be heard again in an opulent acoustic, this time in the visually stunning St. Matthew’s Church in Pacific Palisades, with the choir and soloists accompanied by two organs and harpsichord plus an ensemble of trumpets, trombones, woodwinds and strings. Fast forward to the Paris of Monet, Toulouse-Lautrec, and Gaugin. Evocative French poetry provides the canvas for two sets of choral songs by the most famous impressionist composers, Debussy and Ravel. Claude Debussy’s Trois Chanson was composed in 1908 and based on texts of Charles d’ Orléans, a prince and poet who was imprisoned in England after the Battle of Agincourt in 1415. The Trois Chanson of Maurice Ravel, composed in 1914-15 represent one of Ravel’s few efforts in the field of choral music. They are full of humor but also reference the experience of going off to war, which Ravel did around the time of writing the songs. Moving ahead to 20th century, we find ourselves in New York City around the end of World War II. The city’s jazz clubs are hopping and music is in the air. The singers are joined by the Jennifer Leitham Jazz Trio for a set of Manhattan-Transfer style settings of jazz standards made famous by the likes of Ella Fitzgerald, George Shearing, Mel Tormé and Nat King Cole. Jennifer Leitham is a career jazz musician and has collaborated with Mel Tormé, George Shearing, Woody Herman, Beny Carter and many others. Her trio is internationally known and she has appeared on over 125 albums, including 10 of her own. All concerts in the Music Guild’s series take place on Fridays at 8 p.m., in St. Matthew’s Church, 1031 Bienveneda Ave., Pacific Palisades. Admission is $35. This week’s show is Feb. 10. Santa Monica PONY Baseball strengthens ties with Santa Monica high school baseball team Santa Monica PONY Baseball has announced enhancements to its long-time ties with the Santa Monica High School Viking Baseball Program. Many of their players continue their education at the High School, and some of them are fortunate enough to play baseball and other sports for the Vikings. First-year Viking Baseball Coach Adam Klein and his staff have continued the Viking tradition of making community involvement a priority for its players and coaches, and Santa Monica PONY Baseball is one of the many local organizations to benefit. This season will see Klein, his staff, and their players providing periodic Skills Clinics for PONY players and teacher training for their managers and coaches. They will also help out and provide a positive presence for young players during their Opening Ceremonies and Carnival on March 4 and at their Fun Day/Photo Day/Home Run Derby on April 23. The Vikings will also honor the League by hosting a Santa Monica PONY Baseball Day at one of the Santa Monica Vikings home games to be announced. And, for the first time in Santa Monica PONY Baseball’s history, each team in the Pony Division (ages 13-14) will be managed by a coach from Adam’s Viking coaching staff, supported by two parent coaches. All the High School coaches have played college and/or professional baseball. They were selected for the Viking baseball staff based on that experience as well as their coaching ability and their belief in developing the whole person in working with our community’s young people. PONY staff have met several times with the school staff, and they will be instrumental in furthering the League’s long-time commitment to delivering a youth baseball experience to all players that is simultaneously Rec-Ball/Neighborhood League/Developmental/ Competitive. It’s not clear what will happen to NMS’s employees who work in those buildings, although some may move to other properties managed by NMS that are not involved in the litigation. “Lincoln is a very professional company,” Miller said. “As long as the money is safely in an account that’s what we care about. We plan to win this litigation.” But to lawyer James Fogelman with Gibson Dunn, the litigation is part of Shekhter’s scheme to defraud and extort AEW. To date, Shekhter has filed eight lawsuits against AEW. Fogelman and his team now want Shekhter to pay for the damage he’s done to AEW’s reputation and their ability to make money off the joint venture. If a judge rules in AEW’s favor, the payout could add up to millions of dollars. The two sides are arguing over when Shekhter could buy out AEW’s stake in the nine properties. The market was in a rut when the two sides formed the contract to develop the properties in 2010. Three years later, real estate values rebounded and the market stabilized. The complaints say Shekhter suddenly had a huge incentive to cut AEW out of the pictures and keep future profits to himself. He hit a wall when he realized the joint agreement lasted until 2015, according to court documents. That’s when the complaint alleges “Shekhter and his co-conspirators set about to defraud and/or extort AEW into selling its interest to Shekhter.” A federal judge found Shekhter created a fake contract that included a three-year buy/sell agreement and presented it to the court. But the new lawsuit alleges he didn’t stop there. Shekhter, his wife, his children and other employees at NMS created more fake documents and sent them to at least five lending houses. When AEW tried to sell the properties, interested parties received copies of forged documents. Last October, the alleged forged contracts finally had their day in court. was sent to UCLA Westwood to start treatment right away. There she received a bone marrow transplant and went into remission. Four and a half years later she planned to climb Mt. Kilimanjaro, but the trip was postponed. She was and was diagnosed again with AML in 2014. She was back at UCLA and in the hospital hung a picture of Kilimanjaro to keep her motivated and determined. “I love to travel and do things that challenge my physically. I also learned through this experience that everything I want to do in life, I should do it now,” said Javan. After another bone marrow transplant she achieved remission and reached out to The Leukemia & Lymphoma Society (LLS) to see how she could turn her dream of climbing Kilimanjaro into a fundraising event. “It was not easy getting back to life, but I got lucky with all the support I had from family, friends, and strangers,” said Javan. The idea of climbing a mountain lead to the slogan, Climb to Cure, and is now a fundraising event for the LLS organization. The LLS is the worlds largest voluntary health agency dedicated to blood cancer. The

expert testified the documents were forgeries “so blatant … that you would do a presentation on it or write about it in a text book.” Another expert in electronic forensics said Shekhter and NMS were “almost like a case study in anti-forensic measures.” The experts were able to track down the exact time the documents were created in Adobe Reader, transferred on thumb drives, and printed. The experts found the documents were created in 2013, three years into the agreement. They also discovered a day before they were supposed to hand over their computers as evidence, Shekhter’s son Alan searched Google for: “secure wipe hard drive,” “backdated secure wipe,” and “los angeles anti-computer forensics.” Before turning over his computer as evidence, the court found Shekhter and his son replaced the hard drive and tried to cover their tracks by backdating the computer’s clock and flooding the hard drive with more than 75,000 backdated files and folders. When caught in the act, Shekhter told the court he replaced the hard drive to delete “private personal pictures of my wife.” To Fogelman, the alleged lies, forgeries and lawsuits add up to racketeering. The lawsuit alleges Shekhter participated in the operation and management of a criminal enterprise to rip-off AEW. As a result, both sides ended up losing money on the venture. Shekhter’s attorneys have not yet responded to the new allegations. While Lincoln Properties manages the buildings, profits from rent will go into an escrow account. As the cases make their way through the court, the money will continue to grow until a judge makes a final decision whom it belongs to. The properties include seven buildings in Santa Monica: the Lido at 1440 5th Street, Quonset at 829 Broadway, Lincoln Walk at 1447 Lincoln Blvd, San Marco at 1420 5th Street, Rapallo at 1430 5th Street, Luxe Broadway at 1502 Broadway and 1511 15th Street. One other property is in Los Angeles: 9901 Washington Blvd, and another is in West Hollywood: Luxe La Cienega at 375 N. La Cienega Boulevard kate@smdp.com

Together they climbed the 19,341 foot mountain from Jan. 4 - 14. The team also became the first official Climb to Cure team, and she inspired other adventure seekers to join in on the movement and hike Kilimanjaro this year. The new groups are bing trained by national climbing coach, Mike Phipps. Javan has been cancer free for a year and a half and is already looking forward to another adventure. “I really think that everyone can make an impact on someone. and Safety, the Rent Control Board, Housing and Human Services and the City Attorney’s Office. “We, as a City, want to be focused on creating efficiencies,” Farrell said of the City Manager’s decision to create the new position. It’s not just inefficiencies that plague tenants navigating Santa Monica’s bureaucracy. It is also difficult for the City to grasp the full scale of construction work going on at any given property because a landlord or owner planning a massive remodeling project files permits through several different agencies unit by unit. “We don’t get the full picture of what’s happening in the entire building,” Gonzalez said, “so that’s something we’re looking at as well. We might have multiple means and methods plans in the entire building.” To tenants like Gert Basson at the Tenth Street Promenade, remodeling is a major source of disruption. While his rent-controlled apartment remains mostly untouched, his 1950’s era building is a constant construction zone. Of twenty apartments at 1238 and 1242 10th Street, only five are still occupied as tenants take buy-outs and flee the noise. As tenants leave, construction moves into those newly empty units and workers rip out ceilings, tear up floors and break down walls. Basson knows if he leaves to escape the noise and dust, he will no longer be able to afford to live in his city of twenty years. “I will not be surprised if soon enough I will be the only person living there,” Basson said. Right now he’s hopping from place to place while his landlord pays him relocation fees because of asbestos dust found in his unit after a flurry of construction. Asbestos dust is

a known carcinogen and construction projects that involve old buildings must follow strict federal rules to avoid contamination. In a few weeks, Basson has a rent reduction hearing with the Rent Control Board, another milestone in a process to get help that has taken nearly a year at this point. Basson hopes Gonzalez will also focus on developing repercussions for bad actors who displace tenants. He says the bureaucracy has a tendency to deflect issues as ‘someone else’s job.’ “That’s one way of getting rid of the problem. You’ll go through a round with several different departments and end up right where you started.” What makes Basson’s case more frustrating is that the City Council has promised greater scrutiny of the man who owns the Tenth Street Promenade. The deed to the property is signed by Neil Shekhter and lists his NMS office as a return address. Back in December, the City Council directed staff to scrutinize Shekhter’s contracts in the City after a judge found he committed perjury and submitted fraudulent business contracts in federal court. Shekhter’s attorneys have appealed the judge’s ruling. Gonzalez is sympathetic to Basson’s plight and hopes she’ll be able to avoid similar issues in the future. With the City’s new efforts to get all buildings up to current earthquake standards, she knows there is about to be a massive wave of construction on apartment buildings. She hopes with a little effort, renters will have more stability. “The market is so strong here. There’s a lot of pressure on tenants,” Gonzales said. “Once they move out we do lose some of our diversity here and I would hate to see that happen.” kate@smdp.com
