Council considers new major bike route BY DAVID MARK SIMPSON Daily Press Staff Writer

MICHIGAN AVE Cyclists are on the verge of scoring some major upgrades. City Council will take a look at the plans for a major bike route in Santa Monica from

the incoming Expo Light Rail’s Bergamot Station to the Santa Monica Pier. Council will only consider funding of one part of the route Tuesday night, a section around Santa Monica High School. The rest of the route will be funded over the next eight years and beyond.

City planners studied the Michigan Avenue Neighborhood Greenway (MANGO) with a grant from Caltrans. One aspect of that plan, which would include traffic diverters at 11th Street on Michigan Avenue, has stirred some controversy in the Pico Neighborhood — where a

During the recession, Los Angeles County lost tens of thousands of residents to the eastern counties of the Inland Empire despite the area’s staggering unemployment rate, new Census Bureau estimates reveals. The migration marked the nation’s biggest net county-to-county movement from 2007 to 2011, the Los Angeles Times reported Sunday. According to the Census data roughly 35,000 more people moved to the Inland Empire from Los Angeles County than the opposite direction. The migration occurred as

Riverside and San Bernardino counties lost 144,000 jobs. The gulf in housing costs continued to be a powerful force drawing the Pacific coast city’s residents eastward, where the median price for a home is almost $200,000 less than the $449,000 average in Los Angeles County, said John Husing, chief economist of the Inland Empire Econimic Partnership. The better-than-expected result made the Warner Bros. collaboration with the Danish toy company easily the biggest hit of the year so far. A sequel is already in development for the 3-D animated film, digitally drawn to mimic a world composed entirely of Lego bricks. The film has drawn raves from critics. Co-directors and co-writers Phil Lord and Chris Miller (“21 Jump Street,” “Cloudy With a Chance of Meatballs”) gave the film a playful tone to capture the whimsy of a child playing in a box of Legos. Characters are largely voiced by comic actors like Will Ferrell and Chris Pratt. The film marks the biggest animation hit for Warner Bros., a studio that despite popular live-action franchises has struggled to develop animated hits on par with other studios. “I can’t imagine this not turning into a long-term franchise,” said Paul Dergarabedian, senior media analyst for box-office tracker Rentrak. “This is such a runaway success that Warner Bros is now a major player in the animated genre.” Dan Fellman, head of distribution for Warner Bros., said the film, made with a production budget of $60 million, resounded because of the popularity of the Lego brand. This is the first feature film for the toy company. Fellow toy-maker Hasbro has seen mixed results since the launch of the “Transformers” franchise, which was followed by “G.I. Joe: Rise of the Cobra” and the notorious flop “Battleship.” George Clooney’s World War II caper “The Monuments Men” opened in second place with $22.7 million. Reviews have been weak for the based-on-a-true-story tale about the mission to retrieve artwork stolen by the Nazis. The Sony Pictures film was postponed from a Dec. 25 release because, Clooney then said, more time was needed to finish the visual effects. Clooney served as director, cowriter, producer and star on the film. “The Monuments Men,” based on the nonfiction book by Robert Edsel and Brett

Yet it all seemed to slip away for the Vikings in the opening minutes of a 58-45 loss to the Normans. An ongoing story at Planning Commission meetings in the second half of 2013 was information secured by commissioners that discloses weaknesses in the city's efforts to mitigate the effects of additional traffic generated by new developments. Most recently, Commissioner Jim Ries appears to have succeeded in persuading fellow commissioners to raise to $150,000 the sum recommended to be required of one developer for efforts to mitigate traffic congestion associated with a new project (the Planning Department had recommended a payment of $15,000). It is obvious that a more robust program of traffic mitigation will be required if city streets are to absorb the new traffic associated with current development proposals. In a front page article of Friday, Jan. 24, (“City Hall says all but one development in compliance”), the SMDP reports that the city is meeting its targets for traffic mitigation associated with new development agreements in the city. Only one party, the new Agensys campus on Stewart Street, was found to have failed to meet its target of reducing vehicle traffic among employees by 50 percent. Instead, Agensys' reduction was found to be closer to 30 percent. Doubtless, this helps. One reason for the good news is the fact that prior development agreements do not require parties actually to achieve the targets for reductions set by the city. By definition, then, projects that fail to meet these targets such as Saint John's Health Center and the Colorado Center are not in violation of code since there is no requirement in place. Experience to date indicates that the most promising way to reduce new commuter traffic is to levy a fee for each day that a particular vehicle travels into and out of the city during morning and late-day rush hours. The city is slowly moving in this direction although the fees currently proposed for the new Hines project between 26th and 28th Streets at Olympic Boulevard are likely to prove an insufficient deterrent.

The Hines project at Bergamot is consistent with our city's strategy of directing growth to this station area, helps us meet our sustainability goals and prepares us for the future. Transit oriented communities like this proposal are a key solution to our gridlock, allowing increasing numbers of people to live car-free and car-light lifestyles. Pam O'Connor has been a tireless leader in promoting this same vision in her work on our City Council as well as on Metro. That the Hines project is consistent with these values indicates to me that our city's leaders have been effective in promoting this vision to those who want to build here. In this light, I find Councilmember O'Connor's acceptance of legal donations from Hines no more troubling than any candidate's acceptance of funding from people who share their views.

City Hall drives us crazy LAST TUESDAY NIGHT, CITY COUNCIL

approved a development agreement (DA) allowing Texas developer Hines to build nearly 767,000 square feet of creative office, commercial and residential space along Olympic Boulevard. Most residents strongly opposed the Bergamot Transit Village (BTV) DA because of the traffic congestion that will result. Despite letter writing campaigns and massive rallies on City Hall’s lawn that urged council members to “just say ‘no’,” they just said “yes.” For the record, Mayor Pam O’Connor, Mayor Pro-Tem Terry O’Day and council members Bob Holbrook and Gleam Davis supported the DA while Kevin McKeown, Tony Vazquez and Ted Winterer didn’t What’s next? The project will be officially approved by council at a second reading tomorrow night, then we’ll find out if enough Santa Monicans are angry enough to stop it. A new organization called Residocracy.org will launch an official referendum petition to overrule council’s decision on the Bergamot development and “Take Our Town Back.” A “Referendum Launch Event” will be held on Wed., Feb. 12 at 7 p.m. at the SGI Auditorium at Sixth Street and Wilshire Boulevard. Printed petitions will be available at the event and on Residocracy’s website to download, print, and circulate for registered voter signatures. There’s also talk of litigation and the Santa Monica Coalition for a Livable City (SMCLC) will announce their plans later this week. I’m hearing that O’Day and O’Connor who voted “yes’ on this (and virtually every new development that’s come before them) think that most Santa Monicans support all these projects and that opposition only involves a couple hundred hysterical nogrowthers. They’re in for a big surprise. O’Connor’s vote along with her acceptance of many campaign contributions from developers such as Hines will pretty much kill any chance for her re-election effort this fall. Plus, O’Connor specifically has been targeted for “retirement.” Holbrook, whose term is up this fall, isn’t likely to run again which is just as well. His consistent pro-development votes have made him a target, too. O’Day and Davis will feel the wrath of voters in 2016. As bad as the traffic and congestion from the BTV promises to be, MANgo or the Michigan Avenue Greenway project from Stewart Street to Santa Monica High School — and eventually on to the beach is worse. It’s also on council’s agenda for review, tomorrow. Thirty members of planning staff including three paid consultants came up with this latest experiment in traffic calming to force us to walk more and ride bicycles. It’ll turn Michigan Avenue into the city’s longest recreational park. MANgo is being promoted as “a safe and comfortable place for neighbors of all ages to walk, bike, relax and interact with one

another.” Yep. The fact that it essentially semi-privatizes the street by limiting public access in front of the home of a vocal Santa Monica cycling advocate may or may not be relevant. But, to the unicorn chasers in City Hall, it’s too good of an opportunity to pass up. Planners promise that MANgo “will make it easier to get around the Pico Neighborhood,” however traffic diverters at key intersections, turn restrictions, shrinking traffic lanes, mid-street islands and roundabouts, wide sidewalks, mini-parks, curb extensions that interfere with turns and bulb-outs that make cars maneuver around extended planted areas built into current parking spaces contradict that promise. Michigan Avenue intersections with Seventh Street, Lincoln Boulevard; 11th, 14th, 17th and 20th streets will all have street impediments to slow and discourage traffic. Staff ’s Pollyanna vision is a shared space/street with gamboling children, strolling pedestrians, carefree bicyclists and contented motorists in the same space at the same time. I’m wondering how fire and delivery trucks or emergency vehicles will handle the obstacle course? Pico neighbors are upset because, at the last moment, someone slipped “a maximum target of 2,000 vehicle trips per day along the greenway” into the concept plan. “It’s nothing more than a thinly veiled strategy aimed at imposing traffic diverters on a community that has overwhelmingly rejected the concept of diverters,” one angry Pico resident told me. City Council will also review concepts for the “Safe Routes to School” scheme for Michigan, Seventh Street and Pico Boulevard near Santa Monica High School. This is where pedestrians, dual-direction bicycle lanes and a single, one-way vehicular traffic lane will all collide next to Samohi. I question the safety benefits of this mess. Plans include reducing vehicle lanes to 10 feet wide on Pico between Sixth and Seventh streets to accommodate a 12-foot wide, bidirectional track for bicyclists riding to/from Ocean Park. Plus, there’s a whole host of other traffic jamming elements proposed for the entire area. City Council will love it. You’ll hate it. An item calling for the same kind of road alterations for Berkeley Street between Wilshire Boulevard and Montana Avenue is also on council’s agenda. Alterations proposed include realignment of Berkeley’s intersection with Stanford Street; two median islands (between Stanford and Lipton Avenue), a traffic calming circle at Lipton along with two curb extensions; and channelizers at the Wilshire intersection. It’s a recipe for more gridlock. Council will be ecstatic. Until there’s a turnover in political thinking in City Hall and staff is forced to respond to real citizen needs — like solving traffic problems instead of pursuing pipe dreams — we’re going to have lot’s more ludicrous traffic proposals guaranteed to make congestion worse. protections for gray wolves across most of the U.S. suffered a significant setback Friday as an independent review panel said the government is relying on unsettled science to make its case. Federal wildlife officials want to remove the animals from the endangered species list across the Lower 48 states, except for a small population in the Southwest. The five-member U.S. Fish and Wildlife Service peer-review panel was tasked with reviewing the government’s claim that the Northeast and Midwest were home to a separate species, the eastern wolf. If the government were right, that would make gray wolf recovery unnecessary in those areas. But the peer reviewers concluded unanimously that the scientific research cited by the government was insufficient. That could make it difficult for federal officials to stick with their proposal as it now stands, further protracting the emotionally charged debate over what parts of the U.S. are suitable for the predators. “The process was clean and the results were unequivocal,” said panel member Steven Courtney, a scientist at the National Center for Ecological Analysis and Synthesis at the University of California in Santa Barbara. “The science used by the Fish and wildlife service concerning genetics and taxonomy of wolves was preliminary and currently not the best available science.” Wolves were added to the endangered species list in 1975 after being exterminated last century across most of the Lower 48 states under government-sponsored trapping and poisoning programs. Hunting for wolves already is allowed for roughly 5,000 wolves in the Northern Rockies and Great Lakes, where protections were lifted in 2011. More than 900 of the animals have been shot or caught by trappers in the two regions during this winter’s hunting season. A struggling population of several dozen Mexican gray wolves in the desert Southwest would remain on the endangered list under the government’s plan. The Southeast is home to a separate species, the red wolf, which remains highly endangered. The release of the peer review findings opens another round of public input on a proposal that has received more one million comments.

“Obviously we do take the comments from peer reviewers very seriously and we need to take those into account,” Fish and Wildlife Service spokesman Chris Tollefson said. The Fish and Wildlife Service already faced fervent opposition to its plan from some scientists, wildlife advocates and members of Congress. They’ve argued that protections should remain in place given that vast areas of potentially suitable wolf habitat remain unoccupied in the southern Rocky Mountains, along the West Coast and in the Northeast. Carlos Carroll, a wolf researcher at the Klamath Center for Conservation Research in Orleans, Calif., said the problems highlighted by the peer-review panel had been raised previously by others. He said he hoped they would now get more attention from wildlife officials. “This gives them a chance to re-evaluate their strategy and say it’s time to listen to the science,” Carroll said. The ranking Democrat on the U.S. House Natural Resources Committee, Oregon Rep. Peter DeFazio, on Friday called on the Fish and Wildlife Service to rescind its proposal in light of the peer review. But feelings run strong on both sides of the issue. Many Republican lawmakers, agricultural interests and hunting groups have pushed equally hard for jurisdiction over wolves to be passed to states so they could manage the population through annual harvests. Those efforts have been motivated in large part by wolf attacks on livestock and big game herds in areas where the predators have recovered. David Allen, with the Rocky Mountain Elk Foundation, said that after several years of hunting, it’s clear the harvests are not driving down the wolf population too aggressively. An earlier peer-review panel charged with reviewing the delisting proposal was dissolved last summer, after criticisms arose when three scientists who had been critical of the government’s wolf plan were told they couldn’t serve. One of the three — Robert Wayne at the University of California Los Angeles — was later named to the panel that came up with Friday’s report. Officials had aimed for a final decision on the matter this summer. That’s now uncertain after delays in the peer review and time lost to the federal government shutdown in the fall.

I thought Japan’s 2011 Fukushima nuclear plant meltdown would have sealed nuclear power’s fate, but I keep hearing otherwise. Can you enlighten?

aster did cause many nations to reconsider their nuclear committments, though many European countries — Switzerland, Belgium, Austria, Germany, Italy, Spain and Sweden — had already begun phasing out nuclear power decades earlier. After Fukushima, Germany, Belgium and Switzerland all moved to decommission their nuclear facilities altogether by 2022, 2025 and 2034 respectively. Japan’s nuclear program, which provided 30 percent of the country’s electricity needs before the March 2011 disaster, is now essentially non-operational due to public safety concerns. Furthermore, Japan announced in November 2013 that, due to the shuttering of Fukushima and other nuclear facilities, it was backpedaling its on prior commitments to cut greenhouse gas emissions 25 percent from 1990 levels. Here in the U.S., Fukushima has not had any major effect on our nuclear industry. No nuclear plants have been closed, license extensions for existing facilities continue to proceed, and the federal Nuclear Regulatory Commission (NRC) has even greenlighted construction of two new reactors at a nuclear power plant in Georgia. But public concerns over the safety of nuclear power and what to do with spent fuel indicate that nukes will likely become a smaller and smaller slice of the U.S. energy pie moving forward. Elsewhere, however, many countries are looking to nuclear power as a way to increase energy production without adding to greenhouse gas emissions. Casey Research reports that developing countries are increasingly

relying on it to supplement coal and other fossil fuels. The International Energy Agency predicts global electricity demand will grow 70 percent by 2035, with the majority of the increase coming from developing countriesChina and India combined will account for half of the projected growth. “Serious pollution problems mean that those developing countries cannot produce all that electricity by burning coal,” says Amir Adnani, CEO of Uranium Energy Corporation, a uranium mining company. “The plans to develop nuclear power in China and other countries are very much driven by a set of realities that is very different and very acute. People are dying every year in China, literally choking to death, because of all the toxins that are being put into the environment by burning coal.” China now has 17 nuclear plants in operation and another 29 underway. India has 20 plants running and seven more being built. And the Russian Federation operates 33 and has another 11 in the works. So while it might be premature to call it a “nuclear renaissance,” much of the world doesn’t seem too worried about what happened at Fukushima. Indeed, nuclear power looks like it could be around for a long time. Medical marijuana gains traction in the Deep South CHRISTINA A. CASSIDY Associated Press

ATLANTA Medical marijuana has been a nonstarter in recent years in the Deep South, where many Republican lawmakers feared it could lead to widespread drug use and social ills. That now appears to be changing, with proposals to allow a form of medical marijuana gaining momentum in a handful of Southern states. Twenty states and the District of Columbia have legalized medical marijuana, and this year powerful GOP lawmakers in Georgia and Alabama are putting their weight behind bills that would allow for the limited use of cannabis oil by those with specific medical conditions. Other Southern states are also weighing the issue with varying levels of support. The key to swaying the hearts of conservative lawmakers has been the stories of children suffering up to 100 seizures a day whose parents say they could benefit from access to cannabidiol, which would be administered orally in a liquid form. And proponents argue the cannabis oil is low in tetrahydrocannabinol, or THC, the psychoactive compound in marijuana that makes users feel high. “I’m an unlikely champion for this cause,” said Georgia Rep. Allen Peake, a businessman from Macon who attended the evangelical Dallas Theological Seminary. “Once people realize it’s not a 6-year-old smoking a joint, most folks realize this is the compassionate thing to do.” Peake’s bill has already earned the backing of more than 80 state lawmakers, including several members of the House Republican leadership, who signed on as cosponsors and the state’s largest professional association of doctors. The bill would revive a long-dormant research program allowing academic institutions to distribute the medical cannabis and would be “limited in scope, tightly restricted, well regulated and managed by doctors,” Peake said. Alabama Rep. Mike Ball, a retired hostage negotiator for the State Patrol, is behind a bill that would allow people to possess the cannabis oil if they have certain medical conditions. It passed a key committee vote on Wednesday. “The public is starting to understand what this is,” said Ball, who chairs a powerful House committee and is a prominent voice on law enforcement issues. “The political fear is shifting from what will happen if we pass it, to might what happen if we don’t,” Ball said. The bills in Georgia and Alabama still have more vetting, and their ultimate prospects are not certain. But what is happening offers a strong signal of what’s to come in other states. In Louisiana, although a bill has yet to be introduced, a recent committee hearing at the Capitol on legalizing medical marijuana drew a standing-room-only crowd, and Gov. Bobby Jindal made comments last month indicating he was willing to consider it. “When it comes to medical marijuana ... if there is a legitimate medical need, I’d certainly be open to making it available under very strict supervision for patients that would benefit from that,” Jindal said, according to a report in The Advocate. Technically, both Georgia and Louisiana have laws on the books from the 1980s and 1990s that allow for the use of medical marijuana, but those programs essentially ended before they could start. Georgia’s law established the academic research program for those diagnosed with glaucoma and cancer

patients undergoing chemotherapy and radiation, but the program stalled when the federal government stopped delivery of legal cannabis. Louisiana’s law allowed for glaucoma and cancer patients and those suffering from spastic quadriplegia to receive marijuana for therapeutic use but regulations to govern the program were never developed. In Mississippi, Republican state Sen. Josh Harkins of Brandon is sponsoring a cannabis oil bill similar to the ones in Alabama and Georgia. Harkins said one of his constituents has a 20-month-old daughter with Dravet syndrome, a form of pediatric epilepsy, and the oil can help reduce the number of seizures. Elsewhere, both Kentucky and Tennessee have medical marijuana bills under consideration although they have yet to gain traction. Kentucky Senate President Rover Stivers, R-Manchester, has said he’s not convinced marijuana has legitimate medical purposes and called it an area ripe for abuse. In Florida, it’s likely to become a campaign issue in the fall given that Gov. Rick Scott is up for re-election and a proposed constitutional amendment will be on the ballot that would allow for the medical use of marijuana as determined by a licensed physician. Former Republican Gov. Charlie Crist, now a Democrat seeking to challenge Scott, has called it “an issue of compassion, trusting doctors and trusting the people of Florida.” Meanwhile, Alabama Gov. Robert Bentley has signaled a willingness to discuss medicine that might be derived from marijuana with appropriate federal regulation. “If someone wants to use the medicine that is in marijuana, go through the same testing that you have to go through when you do that through the (U.S. Food and Drug Administration), you go through all of that, do the testing, the drug testing, that’s fine,” Bentley said last month. “I have no problem with that. I am not just for prescribing marijuana.” Georgia Gov. Nathan Deal has declined to take a position, but noted the “strong case being presented by some of the families with very serious situations involving their children.” Dustin Chandler, a police officer in Pelham, Ala., has been a major part of the effort there. His daughter, 2-year-old Carly, has three to five seizures each day from a severe neurological condition she has had since infancy. Chandler believes cannabidiol could help control his daughter’s seizures and improve her cognitive functioning based on anecdotal evidence seen elsewhere. Overall, public opinion in support of legalization has shifted in less than a decade, according to William Galston and E.J. Dionne, who co-wrote a paper last year on the topic for The Brookings Institution. The authors noted proponents were shrewd in focusing the earliest campaigns on efforts to allow the use of marijuana for medical purposes, citing a 2013 Pew Research Center survey that three-quarters of Americans, including 72 percent of Republicans, believe marijuana has legitimate medical uses. Among critics’ biggest concerns is that allowing medical marijuana even under a narrow list of circumstance would eventually open the door to widespread use. Peake, the Georgia lawmaker, has been adamant that will not be the case. “I am concerned as anyone that we would get to a slippery slope of a broader scope of marijuana use in the state,” Peake said. “I promise you I will fight that with every bit of energy in me.

The financial test comes as Minnesota and other states contend with meager sign-ups and questions about the potential for financial bailouts unless participation begins to surge. The exchanges being operated by 14 states and the District of Columbia are supposed to be self-sustaining by next year, according to the Affordable Care Act. A monthly surcharge on insurance policies is intended as the main money-maker for Covered California. In its short life, Covered California has grown to oversee a $400 million budget, more than 860 employees and offices throughout the state. The agency is in the process of hiring 350 additional call-center employees, mostly in Fresno. If the agency fails to generate enough income to pay for its operations, it’s not clear whether California taxpayers would be on the hook. The state law that created the California exchange requires it to operate with a bal-

We have you covered anced budget and a cash reserve. Additionally, it’s prevented from drawing dollars from state government’s main checkbook, the general fund, which is supported by taxpayers. That is, unless there is a separate action by the Legislature, now dominated by Democratic lawmakers who generally support the ACA’s goals. The law contemplates the potential for a cash crisis and a “contingency plan should it be impossible to operate the exchange without the use of general fund moneys.” Covered California considers the potential for a taxpayer bailout remote. “So far, our enrollment numbers are outpacing our projections, so we don’t anticipate any shortfalls in our budget that might create a need for this,” exchange spokeswoman Anne F. Gonzales said in a statement. The pace of enrollment so far suggests the agency will be able to support its operations in 2015 and into future years, provided signups continue to increase through 2016 and then at least remain stable, said Dylan H. Roby at the University of California, Los Angeles’ Fielding School of Public Health. Roby said in an email that the agency’s goal is to maintain a reserve that could cover its expenses for a minimum of three months, even if its income stalls, and that monthly fees paid on policies could be raised if neces-

sary to generate more money. Agency documents show Covered California plans to put aside $184 million of the more than $1 billion in federal grant money it has received to date as a hedge against anticipated budget shortfalls. The records show the exchange will need $78 million in reserves to plug a budget hole after July 2015, when expenses will outrun income, and another $34 million to cover a deficit the following year. While agency officials say Covered California is on track to meet enrollment targets — nearly 2 million individuals by June 2016 — planning documents and government reports sketch out the danger if those numbers ebb. The state auditor raised the possibility of a troubling cycle in which enrollment falls and fees are raised to fill the gap. The threat is that higher policy premiums would then push sign-ups even lower. In one scenario, the auditor said that if enrollment dips sharply below projections, individual fees in the year that begins July 2015 could surpass $20 a month, up from $13.95, to keep the agency solvent while retaining a reserve. Sluggish enrollment also could force cuts to service-center staffing and other expenses to keep the budget in line. “Covered California’s financial sustain-

ability is wholly dependent on enrollment,” the auditor concluded. Enrollments were averaging about 100,000 a week in December, but they fell to an average of 58,000 in the first two weeks of January, according to agency figures. Agency officials hope enrollment will be robust so fees paid by individuals and small businesses can be lowered. Since insurance policies purchased under the ACA took effect Jan. 1, the agency has faced criticism for lackluster sign-ups among Hispanics and younger people, as well as confusion over billing and paperwork problems that have left an unknown number of consumers in limbo. There also are complaints about long wait times at the exchange’s three telephone call centers and problems with the online enrollment site — issues that could discourage enrollment. A state lawmaker last week called for a probe of the agency’s balance sheet and advertising spending, which is on track to top $300 million for TV ads, billboards, door-to-door visits and other sales pitches intended to encourage sign-ups. “I’m not sure the way it’s structured it’s actually going to contain costs, and I’m not sure what the costs are going to be,” said state Sen. Ted Gaines, a Republican who submitted the request to the Joint Legislative Audit Committee.
