New rules could limit Bird scooter operations

Following a pair of robberies on Montana Ave. this month, store owners and residents of the area are questioning how to secure their homes and businesses in the face of a troubling series of crimes. Two jewelry stores have been robbed on the same block this year and the area has experienced residential burglaries including a violent home invasion last year. SMPD has identified the suspect in the recent robbery as Robert Art Abalov, a 32 year- old Los Angeles resident who was still at large at press time. The incidents have prompted calls for more security, both private and public. “The reality is we’re really concerned as merchants because as this happens more and more, fewer and fewer people are going to come shop because they don’t feel safe,” said Ryan Olehass, President of the Montana Ave. Merchants Association. Olehass said some merchants have asked for private security patrols along the business district but the price to provide even an unarmed guard is more than the organization can currently afford. However, they are considering ways to levy additional assessments

City staff is recommending an emergency ordinance to migrate Bird Scooters off sidewalks in Santa Monica and onto private property. The Council will debate an ordinance Tuesday that will prohibit offering or displaying a

“shared mobility device” from the public right-of-way or public property without City authorization. Under the proposed law any vehicles, including Bird scooters, left on the sidewalk would be subject to immediate impounding. “Urgent regulatory actions are necessary to protect public health and safety,” said a recent report by

A GoFundMe campaign to help a local woman who was attacked and stabbed in her Santa Monica apartment quickly surpassed its goals and raised $15,000 in just one day. The fundraiser for Leigh Collins

Soundwaves Welcomes Aron Kallay On Wednesday March 21, at 7:30 p.m., the Soundwaves new music series at the Santa Monica Public Library welcomes keyboardist Aron Kallay to the Martin Luther King Jr. Auditorium at the Main Library, 601 Santa Monica Blvd. Kallay will perform selections from his Beyond 12 project, which commissions new music for retuned and remapped keyboards. While the black and white piano keys represent a linear order of fixed pitches, software now allows Kallay and his collaborators to assign any pitch to any key, to use notes beyond standard 12-note equal temperment, and to even retune and reorder the keyboard during a piece. Three Beyond 12 albums have been recorded, with contributions from dozens of composers, including Kyle Gann, John Schneider, Bill Alves, Isaac Schankler, Nick Norton, and many others. A busy concert pianist, arts administrator, and educator, Kallay is also a Grammy nominee and holds a doctorate from USC. He appeared on the first Soundwaves concert, in January 2016, playing a piano composition by Daniel Lentz, and the Library is happy to have him back. This performance is a co-production with Microfest, Southern California's annual festival of music in alternate tuning systems, now in its 21st year. In 2011, Greene organized the orchestra’s chorus, Legal Voices, and later that year, the chorus debuted with the LA Lawyers Phil at Walt Disney Concert Hall. Consisting of more than 100 voices, Legal Voices gave a triumphant performance of the finale of Beethoven’s 9th Symphony, the Ode to Joy. Since then, the chorus has performed major works annually at Disney Hall including Carl Orff’s Carmina Burana, Beethoven’s Choral Fantasy, Bernstein’s Chichester Psalms and countless Broadway and motion picture scores. In the fall of 2012, Greene appointed Jim Raycroft, a 30-year member of the Los Angeles Master Chorale, to serve as Legal Voices’ third Choral Director. In 2012, Greene formed the award-winning Gary Greene, Esq. and His Big Band of Barristers. In the same year, the band participated in the American Bar Association’s “Battle of the Lawyer Bands” and was invited to perform in Chicago where they took first place and have since been dubbed, “America’s #1 Legal Band.” These musical organizations are where lawyers, judges, law students and legal staff meet in harmony. The members include conservatory graduates, professional musicians as well as some serious amateurs. The concert will support the LA Lawyers Philharmonic, a 501(c)(3) nonprofit organization. The money collected from ticket sales makes it possible for the orchestra, chorus and big band to perform concerts and raise funds for those who cannot afford legal services and other charitable causes. Caring About Climate Without the Federal Government Dear EarthTalk: How did the Global Climate Action Summit coming up later this year in San Francisco come about and what do organizers hope to accomplish?

2018 Global Climate Action Summit— scheduled to take place September 12-14, 2018 in San Francisco, California—is to showcase the actions that state and local leaders, businesses, investors, scientists, students, non-profits and other so-called “subnational actors” have taken to reduce their emissions already. Organizers hope to secure bold commitments from them to do even more, thus showing that decarbonization and economic growth go hand-in-hand and galvanizing a global movement for climate action that leaves no one behind. This new international meeting is the brainchild of California’s 79-year-old outgoing governor Jerry Brown, one of the country’s great crusaders for cutting carbon emissions despite lack of federal interest in solving the climate crisis. According to Brown, subnational actors are a critical part of the climate solution and can help push the world’s leaders to go further, faster. These leaders will join citizens from around the world to showcase examples of major climate action initiatives already taking place without the aid of the federal government. They hope to inspire deeper commitments from each other and from national governments in support of the Paris Agreement. Brown has tapped three leaders as summit co-chairs: Patricia Espinosa, executive secretary of the United Nations Framework Convention on Climate Change; Anand Mahindra, chairman of the Mahindra

Group, an Indian conglomerate that recently committed to meet its Paris climate agreement commitments; and Michael Bloomberg, the former mayor of New York City and founder/CEO of Bloomberg LP who is a vigorous campaigner for and generous donor to environmental causes. These three are primarily responsible for shaping the event’s purpose, format and overall curation and leveraging their voices and network for the cause. Why now? According to Brown, 2018 is a turning point: Countries and all of us must step up the commitments that were made in Paris and do more. “The momentum we generate this year must lead to a climate turning point by 2020 in order to prevent the worst effects of climate change,” says Brown. “It must be the beginning of a new phase of action and ambition on climate change.” Participants are expected to go beyond just sharing what they have achieved to date and announce stepped-up commitments to usher in what organizers are hoping will be “a new era of decarbonization and prosperity.” The culmination of the meeting will be a call to action to nations to step up their ambition under the Paris Agreement and cut emissions on a sciencebased trajectory that limits warming to well below two degrees Celsius. “The Summit seeks to change the climate conversation, broaden and depoliticize the issue, and activate everyone to call for change to preserve our future,” Brown concludes. The governor’s actions in steering California to be one of the world’s most fuel efficient large economies is even more inspiring than his words. Given that Brown won’t be able to run again for governor due to term limits, the Summit may represent the last hurrah of his storied political career. ON FEBRUARY 20, AT ABOUT 6:30 P.M. Officers responded to a radio call for service at the 3rd Street and Broadway regarding suspicious circumstances. The reporting party indicated she was victim of a theft and located a subject that was in possession of her property. Officers arrived and detained the subject for an investigation. Offices learned the reporting party/victim was at the Apple Store and noticed a subject walk into the store carrying what she believed was her property. The victim confronted the subject and found other items – sunglasses, laptop case, make-up bag and charger – that belonged to her. She told security and was able to retrieve her property. The victim reported the items stolen earlier that day. The suspect was taken into custody. Ronald Cecil Reynolds, 34, homeless was arrested for receiving stolen property and a parole violation. He was denied bail.

It's time for the Westside Writers Mingle annual Picture Book Peer Critique Night, in which organizers break into groups of 5-6 people to offer kind and constructive feedback on each other's PB manuscripts. To participate, bring 6 copies of your picture book manuscript (double spaced, please). After multiple drafts, it becomes almost impossible to read your own manuscript with fresh eyes. This Mingle provides a great opportunity to get that fresh perspective. Find out what is working in your manuscript and what could use a little polishing. In small groups each author will have an allotted amount of time to read and receive feedback. Please note: Picture book manuscripts are often 500 words or less. If yours is lengthy, you may want to read only part of it so you don't miss out on valuable critique time. Do you write novels and not picture books? has already been collecting scooters from the sidewalk. “Although staff has recently impounded devices, such as scooters operated by Bird Ride’s, Inc, no impound fee currently exists making these efforts ineffective,” the report said. The ordinance is worded to limit criminal liability on the part of users. Instead, companies that display or offer the scooters for rent would have to pay up for misdemeanor penalties. In order to keep their business in the city, Bird would instead need to partner with local businesses and parking lots where users would park their scooters at the end of a ride. The company currently operates on an ad-hoc basis where users can simply leave the electric scooters on street corners and sidewalks. While this ordinance focuses on the company, riders can still get tickets from the police department for not wearing a helmet, riding on the sidewalk or without a license. The California Vehicle Code prohibits riding motorized scooters on sidewalks or the beach bike path. While the emergency ordinance is in effect, the city would establish a pilot program to assist with the development of a regulatory framework for dockless rental companies like Bird. City staff wants to contract with a third party to help enforce the law by removing scooters from the street. Just two weeks ago Bird took a plea deal with the city attorney’s office to accept responsibility for violating local law and pay more than $306,000 in fines and investigative costs. The city said a significant portion of the fines would go to a broad public safe-

Bird has recently reduced the top speed of the scooters from 22 to 15 miles per hour, instituted a free helmet service and improved their app security to ensure only those with a valid license can register to ride. The discussion on an emergency ordinance to control Bird’s operations comes just a week after the City Council voiced strong support for policies to get more commuters out of cars. “I think we have a tendency to react.. somewhat negatively to disruption, sort of the conversation we had around Uber and Lyft a year ago was actually quite negative,” said Mayor Pro-Tempore Gleam Davis during last Tuesday’s mobility discussion. “That’s not going to stop these disruptors so we darn well better adjust our attitude and say…’we’re going to work with you.’” Davis supports more car-free lanes in the City for bikes and electric scooters. She encouraged staff to be both bold and nimble. Recent data suggests traffic has worsened throughout Southern California over the last fifteen years, with the percentage of households without cars falling thirty percent, according to the Southern California Association of Governments. The increased congestion has lengthened commute times. “We welcome disruption,” Davis said. “We want to be disrupted but you have to work with us.” The City Council will hear from the public and discuss the emergency ordinance Tuesday, March 6, at 5:30 p.m. inside City Hall Council Chambers 1685 Main Street. her apartment early Friday morning near Santa Monica High School when a man broke in, held her at knifepoint and demanded money. “I gave him money and he attempted to rape me and I was able to fight him off,” Collins said. “I’m doing fine. I’m healing. I’m at the hospital, obviously.” The man ran off after Collins fought back. He was injured during the scuffle and left a trail of blood outside the apartment on the 1700 block of 5th Street. SMDP officers were waiting when Harris met with his probation officer in Van Nuys Tuesday in the San Fernando Valley and arrested him there. Collins was cut twice in the forehead and had a black eye after the attack but is expected to make a full recovery.

and Montana Ave. should have the same kind of protection. “Obviously the criminals agree with us because they’re targeting Montana for a reason,” he said. “They don’t target areas that have a heavy police presence, you don’t hear about this happening on Rodeo drive, there’s a visible presence.” Lieutenant Saul Rodriguez said the department is already changing its patrol priorities based on citywide crime trends. “We try our best to cover the entire city to be as effective as we possibly can,” he said. He said the department has heard from businesses and residents about pre-emptive police activity and additional patrols in the area are possible. “We’re already adapting to burglaries in the residential area,” he said. “Including visible patrols, bike patrols, undercover operations, those are discussions we’re having now as to how we can best combat that. We understand (the concern) and we know that and we do our best to handle whatever issues we are facing. We’re trying to do our best to do what we can with the resources we have available.” The North of Montana Association neighborhood organization (NOMA) held its monthly meeting just days after the most recent commercial robbery and residents had concerns over the way SMPD communicates during emergencies.

“I know everyone is really scared and I wanted to call each of you individually and make sure you know that everything is going to be alright,” Collins said. “I wish I could be with all of you.” kate@smdp.com

During the most recent robbery, officers established a perimeter to search for the suspect and residents who were out of the house at the time were unable to return home. NOMA president Nancy Coleman said it was hard for those residents to find overnight accommodation on short notice, especially if they were unaware of the situation until they reached a road closure. She said residents were also frustrated by a lack of in-person information during the event. “When police officers are asked about what’s going on, the residents are told ‘we’re in the middle of an operation, we can’t talk about it.’ Is that appropriate or not appropriate? That is a question that folks felt fairly strongly about.” The NOMA neighborhood has had private security patrols since 1981. The guards are paid for by a coalition of homeowners and while residential burglaries have been fairly common in the neighborhood for years, a pair of more violent home invasion incidents prompted the private association to increase patrols. On an individual level, everyone agreed there are steps that can be taken. For businesses, installing security measures such as visible cameras and alarms can deter criminals. Residents can also install alarms and lock doors/windows even when they are home. In both cases, Rodriguez said all suspicious activity should be reported to police. “If you see something, call us, we’ll come out,” he said. editor@smdp.com
