In one corner of Jeffrey Condon’s office rests a large Garfield stuffed animal. A “Kung Fu Panda” movie poster adorns one wall. An image of Snoopy hangs on another. It’s not necessarily what you’d think of as the prototypical working space of an estate planning attorney, but Condon doesn’t see himself as the prototypical estate planning attorney. The longtime Santa Monica resident knows the material he covers with clients can be dense, dull and highly technical, so he tries to infuse it with humor. He tries to bring it to life with anecdotes, cautionary tales and other droplets of wisdom. It’s the approach he takes to his latest book, “The Living Trust Advisor: Everything You (and Your Financial Planner) Need to Know About Your Living Trust,” the hardcover edition of which was recently released. Condon, who has practiced law

in the fields of trusts and estates for about 30 years, will share his insights during a book signing and seminar March 12 at Barnes & Nobles bookstore on Third Street Promenade in Santa Monica. “If this subject is not written about in an entertaining, funny, eccentric way, then even I would fall asleep,” he said. “Humor is the way to go. ... It’s written for and accessible to the layperson, the person who knows nothing.” For Condon, the upcoming talk builds on a law career that is rooted in Santa Monica. The son of Gerald Condon, who graduated from Santa Monica High School in 1949, he attended Franklin Elementary and Lincoln Middle schools before graduating from Samohi in 1979. Condon then attended Santa Monica College to swim under legendary coach John Joseph before studying English at UCLA and going to Whittier Law School. When Condon joined the family law practice, his father gave him a box of notes and dictation that the two eventually synthesized into

“Beyond The Grave,” a book about leaving money for loved ones that was published in 1996 and revised in 2001. Condon has held hundreds of talks for financial institutions, insurance companies, charities, civic groups and other organizations. Condon and his father were in business near the corner of 7th Street and Arizona Avenue until his father died in 2006. Condon now has an office near the eastern edge of the city on Ocean Park Boulevard. In his latest book, Condon takes readers on a tour of the living trust process: from the time someone thinks about arranging a trust, picking a lawyer and understanding its parameters to the passing of one spouse and then the second spouse. “What good is saving money for your clients ... if after they’ve died, you’ve left the family in conflict and chaos because the estate plan was messed up?” he said. “I look at is as helping families stay together, as being needed at a time when the clients most need that help,” he said. “When both parents are gone, kids come into the office and maybe they

haven’t seen each other in years. Now they’re here with me for advice on what happens next. That never ceases to impress on me how important I can be in their lives.” JEFF@smdp.com

Santa Monica College hosts Japanese National Debate team “Should the US Implement Significant New Gun Control?” will be the topic of a debate at Santa Monica College between the Japanese National Debate Team and the SMC Debate Team. The debate will be held March 10 at 11:15 a.m. in Art 214 on the SMC main campus, located at 1900 Pico Blvd., Santa Monica. The event is free and open to the public. Seating is strictly on a first-arrival basis. “It is a great honor to host the Japanese Debate team here at Santa Monica College,” said SMC Communication Professor Nate Brown. “This is our second debate against an international team, and we are excited about the new challenge.” Japanese National Debate Team members Masaya Sasaki and Naruhiko Nakano

will argue against SMC Debate Team members Stephanie Mendez and Alfredo Gama in the parliamentary-style debate, which pits opponents two against two. Each speaker has a specific amount of time to speak, but can be interrupted by the opposing team. Audience members will be able to indicate their preferences throughout the debate - as well as vote for a team - using their own electronic devices. Sasaki is a second-year debater on the University of Tokyo Debating Society’s parliamentary-style debate team. Although he had no debating experience before entering the university, he has won many prizes in national and international debate tournaments. Most recently, he was a semifinalist in both the 2015 ESUJ National Tournament and the 2015 Asian Debate Institute Tournament. Nakano is a third-year debater on the policy debate team at Mie University E.S.S. During his junior year, he and his team won

First Prize as the strongest team at the regional NDAJ X FIDL Tournament in western Japan. He placed 8th as individual debater and his team placed 8th in the National Debate Tournament of the National Association for Forensics and Argumentation (NAFA), the largest debate organization in Japan. He currently supports small debate teams as a member of NAFA. Mendez has only been in competitive debate for one semester, but took First Place at the Fall Championship tournament in December 2015. She majors in political science at SMC, and plans to transfer to UCLA in political science and pre-law. Gama was on his high school’s debate team, where he was a finalist in the 2013 Brushke Invitational, and the policy debate captain his senior year. He also was undefeated at the first 2013 Western Bay Forensics League tournament in policy debate. Alfredo studies public policy and business administration at SMC, and plans

commissioned by the California Community Foundation, the exhibit is meant to be a gift to Los Angeles County residents in celebration of the foundation’s 100 years of service to the region. “We want this exhibit to turn inspiration into action,” said Antonia Hernández, president and CEO of the California Community Foundation in a press release. “The Unsung Heroes teach us that acts of kindness, compassion, generosity and courage have a ripple effect that will multiply over countless lives.” One of the ways that “hero” Quill is responsible for bringing social change to the community is through L.A. Waterkeeper’s Marine Protected Areas Boat Based Survey, a program that provides the opportunity for at-risk youth to reconnect to the planet and themselves. “This is an opportunity for those underserved, an opportunity for them to come out with us and learn citizen science and spend time on the water,” Quill said. “And as they do that I saw that something would shift. I don’t try to tell anybody what to do. I just try to help us to reconnect with the planet and reconnect with each other.” “Everything we do inland affects our waters,” Quill said. “We have to change core behaviors; change consciousness. Those changes can’t be imposed by governments; change has to come from within our community. Heights of downtown development SANTA MONICA’S MOST RECENT MULTI-

year debate over maximum allowable heights in our downtown has gone on since 2004, when the Macerich Company first proposed twin 22-story condominium towers, as part of its proposed tear down and rebuild of Santa Monica Place. Then came proposals (by others) for three different hotel/luxury condominium projects along Ocean Ave., for as high as 325, 260 and 195 feet at their highest points, respectively. All of these proposals have come at the same time that the City’s official maximum allowable building height has been 84 feet (i.e. six to seven stories), a limit in place since 1984, when the City ‘down-zoned’ as part of that year’s Land Use Element update of the City’s General Plan. Then in 2010, the Land Use (and Circulation) Element was updated for the first time since 1984. But the question of maximum allowable heights was deferred to a separate ‘specific plan’ for the downtown area, called the Downtown Community Plan (DCP). Last week the Planning Commission reviewed the draft DCP now circulating in the community. Normally City Planning Department Staff would present such a draft to the Commission. But reflective of the highly-charge nature of the City’s overall debate on development and heights, the draft DCP was presented by City Manager Rick Cole - an extremely rare occurrence in Santa Monica, for a City Manager to being making such a presentation.

Since Cole has come to Santa Monica as City Manager in Spring 2015, he has sought to bring what he hopes will be more transparency, certainty and clarity to the planning process - and his presentation included how he hoped that would occur as a result of the proposed DCP. That spurred a fascinating and extended Socratic interchange between Cole and Planning Commission Chair Richard McKinnon, over a) how the DCP would reduce the number of negotiated “development agreements” (in which existing maximum heights and other development standards could be negotiated away by the City Council in exchange for additional community benefits) and b) whether there should be separate, higher allowable maximum heights (up to 130 feet) for three distinct large and irregularly-sized parcels in the downtown. Normally during a public hearing, the staff presents and then the public speaks, and members of the public often lament they wish they could ask various questions directly of City Staff. But in this case, McKinnon’s line of questioning served that purpose, as McKinnon’s history as a slowgrowth (and sustainability) advocate on the Commission (and as a City Council candidate), meant that his questions were reflective of the sentiments of many in the community. Fortuitously, the thoughtful, principled and sometimes forceful back and forth between Cole and McKinnon served to raise

issues and solicit responses that many would have sought directly from the City Manager, had they had the opportunity. Normally, development standards (including maximum height limits) are crafted to guide development on regularly sized parcels, with the regular size of such parcels making such predictable development standards reasonable and generally applicable. Cole and the DCP proposed to take on the highly charged question of whether 84 feet should be a maximum everywhere in the city, or whether there should be a limited number of exceptions in distinct cases where large and irregularly sized parcels might present specific opportunities for exceptional design and outstanding community benefits. HOW TALL IS THE RIGHT HEIGHT?

There is certainly a reasonable urban planning debate over whether building ‘higher and thinner’ with the same amount of building mass, can lead to more interesting structures than the same amount of mass in a shorter and wider building. In response, the DCP proposed considering maximum heights of up to 130 feet for three such parcels - for redevelopment of the Miramar Hotel at Ocean/Wilshire, for a proposed hotel/condominium project at Ocean/Santa Monica Bl., and for the Citysponsored project at the City-owned site at 4th/5th/Arizona. Cole said the reason City Staff choose to recommend considering up to 130 feet was in part to bring a reality check to developers who had seized upon the “taller and thinner is better” argument to propose even greater heights, far exceeding the comfort level of even those who saw a place for modestly greater heights, let alone those in the community who feel no building should be higher than 84 feet. Among the Planning Commissioners, three did not support going higher than 84 feet in any circumstance, one supported considering up to 130 feet on all three parcels, another on only two of the three, while two other commissioners wanted more information on the potential public benefits in exchange for extra height. Hence, there were not four votes to take an official Commission position on maximum heights in the DCP at this point. McKinnon queried Cole on the City’s role as both developer and regulator of heights for the proposed project at 4th/5th/Arizona, which Cole admitted was an “awkward straddle,” but one that existed before the DCP proposed the 130-foot limit. At the same time, Cole stressed how critical it was that rather than considering exceptions to the 84-foot limit on a projectby-project basis, it was important for the community to have that debate up-front in the DCP and then stick to it. height limit within the DCP, developers are still free under state law to propose future exceptions to such limits, through what is called a “text amendment” to the General Plan - a lengthy, costly and complicated option to be sure, but one that exists nonetheless. PLANNING, POLITICS AND YOU

So where does that leave us? In Santa Monica, planning and politics cannot be divorced from each other, as our long history of initiative and referenda on development suggests, let alone how debates over development can shape City Council elections and Planning Commission appointments. From a pure planning perspective, keeping the option open for some flexibility on heights in response to unique circumstances is not unreasonable - and having “consideration of up to 130 feet” (or some other level) in the DCP as part of the City’s discretionary approval process is not the same as automatically allowing it “by right.” Yet given how many questions at last week’s hearing came from Planning Commissioners about exactly what such

“consideration” would mean in the DCP, it’s inclusion as a option in the DCP could be interpreted as its de facto affirmation, by many community members who do not have the luxury of being able to follow City process on the micro-level that Planning Commissioners and City Councilmembers do. And at the same time, signature gathering has just started on a proposed ballot measure that would mandate public votes on a range of developments in the City. How residents see what height limits are included in the DCP could affect that signature gathering. All of this means that in the attempt to bring more transparency, certainty and clarity to the City’s planning process, nothing yet is certain nor clear about maximum allowable heights in our downtown. Big game hunting Dear EarthTalk: How is it that big game hunting can actually be good for wildlife?

Palmer killed Cecil, a much-loved wild 13year-old black-maned lion, with his bow and arrow in July 2015 outside a protected section of Zimbabwe’s Hwange National Park, animal advocates were outraged. The University of Oxford’s Wildlife Conservation Research Unit team had been studying Cecil and his family-protected as long as they stayed within the invisible borders of the park-at the time. In response to the extensive media coverage and public fury following the incident, Delta, American and United airlines announced in August that they would no longer allow hunters to transport big game trophies, including buffalo, elephant, leopard, lion or rhino, on their flights. Cecil’s death also helped draw attention to big game hunting and its effects on wildlife populations and their ecosystems. Globe-trotting big game hunters imported more than 1.26 million “trophies”-the part of the animal they keep for display-to the U.S. between 2005 and 2014, according to a new report by Humane Society International (HSI). That’s an average of 126,000 trophy imports a year, or 345 a day. But hunting proponents found the sudden backlash over Cecil’s death unsubstantiated. Dr. Alan Maki, conservation chair at the prominent hunting group, Safari Club International (SCI), argued that, considering that Africa’s human population is projected to double to two billion in the next 25 years, more and more land will be needed to support this growth, resulting in lots of lost wildlife habitat. Safari hunting, a $200 million annual industry, provides substantial value to wildlife, he said, by paying for antipoaching patrols, national park operations and conservation programs that support local communities.

“We’re too busy showing everyone what great hunters we are, and we’re not doing enough to show what kind of conservationists we are,” says Ivan Carter, an African hunting guide and host of Carter’s W.A.R. on the Outdoor Channel. “We have to change the perception that we are just trophy killers and we’ve got to focus on the fact that we’re conservationists, and we do that by having and sharing the right information and research, and taking the time to post properly on social media.” Of course, not everyone agrees that trophy hunting is benign, let alone beneficial. HSI maintains that widespread corruption in some of Africa’s most sought after big game destinations means that money raised from trophy hunting in places like Tanzania and Zimbabwe is more likely used to line officials’ pockets than to help ailing wildlife populations. (This unavoidable corruption was part of the reason Kenya banned trophy hunting altogether within its borders some four decades ago.) HSI also points out that trophy hunting may be more about egostroking than conservation, with wealthy American hunters willing to pay top dollar to compete in contests to kill the most wildlife for awards (such as the “Africa Big Five” that includes lions, elephants, rhinos, leopards and Cape buffalo). HSI, which has published several reports detailing the negative effects of trophy hunting on wildlife populations, is working to get additional airlines to refuse passage to hunting trophies, and has helped introduce legislation to Congress calling for a ban on the importation of large animal trophies altogether. While it appears that the debate is not going to be settled anytime soon, animal advocates maintain that upholding laws protecting species does much more to protect animals than killing them ever can.

LUVE (Land Use Voter Empowerment) ballot initiative before Santa Monica voters in November kicked off yesterday at a rally at the Robert Berman Gallery in the Bergamot Station Arts Center. The initiative empowers residents to take control of major land use decisions in Santa Monica by imposing more conservative height and density limits citywide as well as have a direct say on the shape and scope of new developments within City borders. Neighborhood leaders, resident advocates and slow-growth activists say their voices have not been heard and that City Hall is ignoring their concerns about future development in Santa Monica. The grass roots group Residocracy which was formed a couple of years ago to stop the Bergamot Transit Village mega-development in the Mid-city is behind the ballot measure. LUVE seeks to amend the 2010 Land Use and Circulation Element (LUCE) of the City’s General Plan and its zoning codes “to establish a majority vote requirement for approval of major developments and significant modifications to the City’s land use planning documents.” Last year, the City’s zoning ordinances were updated and revised to more closely align with land use objectives defined by the LUCE. Residents objected to many of the code changes because they encouraged more, larger and denser developments citywide and benefitted business and developer interests far more than resident interests. According to Residocracy’s “Notice of intent to circulate petition”, “The LUCE states that its aim is to ‘maintain our City’s character’ and ‘protect our neighborhoods.’ Instead, it has opened the flood gates to developers by allowing larger development projects with a three-tiered system. Above the Tier 1 base height of 32 feet, increased height and density are permitted in exchange for so-called ‘community benefits’.” The notice says the result is traffic jams, scarce parking and open skies and ocean breezes being lost to ever taller and larger buildings. Infrastructure and residents are over-stressed while long-term residents and small businesses are being displaced. Santa becoming an increasingly unattractive and unpleasant community as a direct result of City Hall’s planning and development policies. The LUVE initiative “will require “Major Development Review Permits” for most projects that exceed the Tier 1 base height. After going through the City approval process, these Major Development Review Permit projects will then be required to be placed on the ballot for voter approval.” Santa Monica voters will decide if “community benefits” such as more “affordable” housing, landscaping and bicycle infrastructure improvements will outweigh the impacts that major developments with their increased height and density will have on our quality of life.

LUVE will also require voter approval for major changes in land use policy. The electorate - not politicians and bureaucrats in the pocket of developers - will determine how much growth is right for Santa Monica. 6,500 plus valid Santa Monica registered voter signatures are required to qualify it for the ballot. If the measure is approved by the majority of voters in the November election it becomes law and the people not the special interests will control Santa Monica’s future. LUVE ballot petitions are in circulation. Over the next few weeks, if someone asks you to endorse the LUVE initiative, ask “Where do I sign?” Once LUVE qualifies for the ballot, you can bet the family Buick that developers and special interests will be amassing a war chest to defeat this measure which is similar to 2008’s RIFT - Residents Initiative to Fight Traffic - (Measure T) created by the Santa Monica Coalition for a Livable City (SMCLC) to fight the ever worsening traffic by limiting commercial development. Developers, their land use attorneys, lobbyists, public relations flacks and their cronies raised over $800,000 to lead the charge against the underfunded measure - a record amount of money for/or against a ballot measure at the time. After a dishonest and misleading campaign mounted by T’s opposition Save Our City, the measure was defeated at the polls with 56.5 of the voters opposing it. Save Our City was co-chaired by current City Councilman Terry O’Day (whose term on the dais expires at the end of this year) and Judy Abdo who was recently dropped from the Santa Monicans for Renters’ Rights powerful Steering Committee for campaigning for a non-SMRR endorsed City Council candidate (Pam O’Connor) in the 2014 election. No word on whether O’Day is planning to run for re-election.

Of course, this win stood out from the others in a stellar campaign that has included just two losses. Star senior Jonah Mathews bounced across the court, overcome with joy. Teammates danced in a celebratory mob. Moments later, school principal Eva Mayoral swung the championship plaque over her head and shook it towards supporters in the stands, who responded with a loud chant: “Samo! Samo!” It took a special team to make it happen, Hecht said. “The chemistry, the love, the care, in my 22 years at Santa Monica, is second to none,” he said. “These guys have fun together, they enjoy being around each other, they push each other, they challenge each other. When they step off the court, there’s a brotherhood there. It’s unbelievable. That was the key ingredient to our success this year.” After cruising to an Ocean League title with an undefeated record in conference play, Samohi stormed through the postseason. The Vikings topped Long BeachCabrillo in the opening round and edged Moreno Valley-Valley View two days later to reach the quarterfinals, where they clobbered Palmdale-Highland. They punched their ticket to the title game with a 68-45 rout of Burbank-Burroughs in the semifinals Feb. 26. In a championship game that featured seven ties and 12 lead changes, Samohi made up for poor shooting and sloppy execution with clutch plays down the stretch at both ends of the floor. Mathews, who finished with a game-high 33 points despite a subpar performance from the field, drained a 3-pointer with 1 minute 36 seconds left in the fourth quarter to give his team a 57-55 lead. And he had plenty of help from his friends. On the ensuing possession, senior

forward Mikhail Brown took a charge. Mathews flexed and let out a yell. Sophomore wing Rip Economou extended the Vikings’ edge to four on a putback with 1:11 left. And after sophomore guard Isaiah Johnson forced Temecula Valley into a turnover with defensive pressure in the backcourt, Mathews threw punches into Johnson’s chest. “The game wasn’t over yet, but I was so excited,” Mathews said. “That was one of the biggest moments of the game right there.” The Vikings extended their cushion to 63-57 on two free throws by junior guard Antonio Holley III with 45 seconds left. “Jonah gets a lot of attention,” Hecht said. “He’s the heart and soul of our team. But these guys have proven that he’s got a great supporting cast.” After shooting just 24.2 percent from the field in the first half, Samohi outscored the Golden Bears 42-25 after halftime. Hecht’s squad outrebounded a much taller opponent 46-36 and forced 20 turnovers. The Vikings were lucky to be in striking distance after a disastrous first half, Mathews struggling to find the range and Temecula Valley breaking through full-court pressure for several easy baskets. But junior guard Roderick Henley II scored all nine of his points in the first quarter to keep his team close. “There are not many instances where Jonah’s off,” Henley said. “But when he’s off, other people have got to step up. We just had to help him out a little bit.” Economou added seven points for Samohi, Johnson and Holley each finished with six, Brown had three and senior guard Chailen August chipped in two. DeWayne Holmes scored 15 points to lead the Golden Bears, who received 12 points apiece from Hollingsworth and Riley Schaefer. Two days before the title game, Mathews took to Twitter to explain his anxiety. “The only thing I care about right now is Saturday,” he wrote. HOMELESS LEVELS REMAIN FLAT

The results are in. The City of Santa Monica Homeless Count of January 27, 2016 showed the number of “homeless” in Santa Monica as holding steady. The 2016 count found 728 total homeless individuals, down from 738 in 2015 or a one percent decline at the time of the count. Those on the street climbed three percent to 416 individuals this year as opposed to 402 last year. 312 people were also counted in shelters, jails and hospitals and -- down seven percent from 2015. 56 percent receive services from one or more local agencies 30 percent said they had been here less than a year and 25 percent disclosed they had been here “less than one month.” The annual count is a valuable tool for updating the City’s “Action Plan to address homelessness” which seeks solutions for ending homelessness in the City through a wide range of programs and policies. Crime Watch is culled from reports provided by the Santa Monica Police Department. These are arrests only. All parties are innocent until proven guilty in a court of law.

ON FEBRUARY 25 AT APPROXIMATELY 11:30 P.M. Officers were dispatched to the corner of 5th and Arizona Avenue to a call of a possible rape that just occurred. When officers arrived, they spoke to the victim and she told them that she was lying down on a concrete bench when she was approached by two males. According to her, one of the males became rude and started to curse at her. Not thinking much of this interaction, she decided to try and go back to sleep. The subject, later identified as Jonathan Simpson, 35 of Los Angeles, suddenly got on top of her, twisted her arm behind her and pulled her pants down. The victim began to yell and scream for Simpson to get off of her, yet he continued to grope her. Simpson went on to digitally penetrate the victim while he held her head against the wall. The victim stated that that the assault lasted for a couple of minutes until another man passed by, saw what was happening and told Simpson to stop. Simpson stood up and walked away. The victim provided a description and officers on patrol detained two subjects, one of whom was Simpson. Simpson was positively identified by the victim and was arrested. He was arrested for intent to commit rape and digital penetration. Bail was set at $100,000.
