Long before Santa Monica native Kesha Ram started campaigning to be second in command in the state of Vermont, she ran for student council president at Roosevelt Elementary School. It was a race against three boys, she remembered, and she won. “It was a do-or-die moment,” she said. “I took it quite seriously.” Ram took the position seriously too. She recalled writing speeches on index cards, speaking in front of the local Board of Education and launching the Teddy Tribune student newspaper on campus. It was the first elected office in a political career that has blossomed since her primary education days. Ram, 29, is a candidate to be Vermont’s next lieutenant governor. Local supporters Paul Song and Lisa Ling are hosting a fundraiser for Ram in Santa Monica on March 19, less than six months

Ram, who has served in the Vermont Legislature for nearly eight years, said her experiences as a preschool teacher, social worker and government official have motivated her to try to help others. “Whether it’s for Vermonters or other Americans, it’s hard to find a pathway into the middle class,” she said. “Families struggle to afford child care and health care. We’re struggling to retain and attract our next generation. ... I find myself looking at my peer group and colleagues and seeing the struggle to be able to give their children access to quality early education, the struggle to pay off student debt or pay off a loan. That’s what I intend to focus on.” Growing up, Ram said, her mother gave

City-planned festivities for Expo a waste of money APPARENTLY, CITY HALL STAFF IS WORRIED

that many will not be aware of Metro’s Expo light rail service when it begins operation to Santa Monica, May 20. That’s as if you won’t be aware of a 270 foot long, 100 ton train when it passes down Colorado Avenue 24 times an hour during peak periods creating traffic gridlock. You can bet that staff ’s motivations aren’t just to build awareness of Expo but to also hype us on abandoning our personal cars and riding the commuter rails, instead. Staff proposed hiring a public relations/marketing firm (or “consultant” as the bureaucrats call it) for a maximum of $750,000 over two years to accomplish this task. Having never seen a buck it wouldn’t spend, City Council approved a contract for PR services a few weeks ago. The deal is to “execute a professional service agreement with GOOD Worldwide Inc., in an amount not to exceed $500,000 for one year, with one-additional one-year renewal option in the amount of $250,000… for a total amount not to exceed $750,000 over a two-year period...” Future year funding is contingent on council budget approval. Some of you are ahead of me, here. “Well, Mr. Bauer, why is the City hiring yet another marketing consultant when City Manager Rick Cole just established a whole new City Hall Department of Communications. Do we really need another consultant to set marketing and promotional goals for the City and work closely with Downtown stakeholders and business interests to insure constant, positive and consistent messaging?” Yes, Virginia, we do. There are over 1,926 fulltime and 490 part time highly paid city employees, on the municipal payroll according to Cita-Data.com. Each full time employee serves about 48 residents - one of the highest employee-to-resident ratios of any municipality in the country. And, that doesn’t include a whole raft of outside consultants and advisors also under contract to the city. The annual cost to taxpayers is close to $200 million smackers - not counting pensions, insurance and other benefits. I was hoping that when Cole was hired he’d put our bloated City government on a diet. Instead, he established a new communications division with a half dozen more employees and a million dollar annual budget. Staff ’s report to council does note that, “the Office of Communications, with the assistance of a (newly-retained) marketing consultant, is developing marketing, outreach, and educational strategies for an overarching campaign focusing on the issue of mobility in Santa Monica…” Promotional support would specifically address commuters and riders, arrival and departure circulation, first and last mile connections, maintenance, public safety and launch and opening events. Launch and opening events? Funny that should come up. David Martin, director of Planning and Community Development, Karen Ginsberg,

director of Community and Cultural Services and Beth Rolandson AICP of Principal Transportation Planner are “planning a series of community-oriented events to help welcome Expo to the City.” There you go, folks. Three, top staff members are really in the party-planning business. No wonder traffic is so screwed up. Their “Welcome to Expo” event memo advises City Council that, “In addition to supporting Metro’s ribbon cutting ceremony by hosting activities at each of the new Santa Monica stations on opening day, (May 20) the City of Santa Monica is also planning a series of community-oriented events to help welcome Expo to the City.” The City will also introduce a collection of commemorative Transit Access Pass (TAP) cards featuring local artists and host its own open streets celebration to mark Expo’s arrival. Of course, vehicular traffic will be restricted on sections of Wilshire Boulevard, Ocean Avenue, Colorado Avenue and Main Street “for walking and cycling” on Saturday, June 4 for an “Open Streets event” because they just can’t help inconveniencing most of us. Say “goodbye” to this year’s Santa Monica Festival. Its resources and funding could be diverted to Expo-related activities. “The event will focus on sustainable mobility, celebrate the arrival of Expo, capitalize on the completion of the Colorado Esplanade, while weaving art, culture and environmental learning opportunities throughout, similar to the Santa Monica Festival.” It just all sounds so “Santa Monica-like,” doesn’t it? “The Open Streets event will serve as the City’s signature event this year with an even larger footprint than the traditional Santa Monica Festival… Members of the entire community with opportunities to experience the streets in a different and exciting way,” promises their memo. We’ll see. Metro’s Open Streets Grant Program provided a $200,000 grant - a $50,000 in-lieu local match was previously approved by council - for the “one-day open streets event that will allow pedestrian and bicycle access to streets free of automobiles with activity hubs along the route.” Staff from nearly all City departments will participate. The Ocean Park Association, Downtown Neighborhood Association, Downtown Santa Monica Inc., the Main Street Merchants Association, Santa Monica Travel and Tourism, the Chamber of Commerce, the Santa Monica Pier and Santa Monica Place will work together to ensure favorable and mutually beneficial outcomes from the event. Final plans and a request for yet another outside supplier - a production contract for the open streets event - will be made at the March 22, council meeting. Ohhh! I’m so excited! United States, whether or not it is easy and economical to go solar depends more on state politics than prevailing weather trends. In those states with ample sunshine and the legislative initiative to get solar panels on residential roofs, there has never been a better-or cheaper-time to put photovoltaic panels to use. According to Solar Power Rocks, a website that helps homeowners understand the rules, incentives and investment returns on local solar panel installations, the top three states where switching over to solar power makes the most economic sense are in the Northeast (New York, Massachusetts and Connecticut). Maryland, Connecticut, Oregon, Minnesota, New Mexico, Vermont and Colorado round out the top ten. What makes these states particularly prime for rooftop solar is their willingness to allow homeowners to lease photovoltaic equipment from third-party owners (like Sun Edison, Solar City, SunRun, etc.) and legislature-backed incentives to help keep costs down overall. Going solar in one of these states might end up being cheaper than remaining on the grid. Surprisingly, a few states in the South (Florida, North Carolina, Oklahoma and Kentucky), where solar panels would seem like a no-brainer, continue to resist this change for the better, in large part due to entrenched utility lobbies intent on maintaining their fossil-fuel-based lock on the status quo. According to a recent Rolling Stone article by Tim Dickinson, the recent ascent of solar power in the U.S. poses a

grave threat to the business interests of big fossil fuel industry investors. Dickinson details how these entrenched interests are “mounting a fierce, rear-guard resistance at the state level-pushing rate hikes and punishing fees for homeowners who turn to solar power.” He adds that their efforts have “darkened green-energy prospects in couldbe solar superpowers” like Arizona and Nevada. “But nowhere has the solar industry been more eclipsed than in Florida, where the utilities’ powers of obstruction are unrivaled.” “The solar industry in Florida has been boxed out by investor-owned utilities (IOUs) that reap massive profits from natural gas and coal,” reports Dickinson. “These IOUs wield outsize political power in the state capital of Tallahassee, and flex it to protect their absolute monopoly on electricity sales.” While Florida might be a laggard on rooftop solar for now, that could all change if some residents are successful in their drive for an amendment to the state constitution to allow for third-party solar ownership (which would enable solar leasing). Of course, the state’s utilities have challenged the amendment by creating their own, designed to confuse voters into keeping solar panels off their rooftops. A discussion is scheduled for the meeting to identify policy issues that have arisen since adoption of the Zoning Code. Housing Commission is the first of Thursday’s meetings. the City of Santa Monica and the Federal Aviation Administration made opening arguments before a three-judge panel in a dispute over control of the property. The City, which is attempting to establish its right to the land, is appealing a recent U.S. District Court dismissal of its case against the FAA. Deanne Maynard, an attorney representing the City, asserted that Santa Monica’s claim under the Quiet Title Act is valid and that the federal government does not have the authority to take over the property if the City ceases airport operations there. “The U.S. wants to have its cake and eat it too,” said Maynard, a partner with the firm Morrison & Foerster LLP, who was previously an assistant to the U.S. Solicitor General at the Department of Justice. “The City wants the power to decide what to do, in the best interests of its citizens, with its land.” Maynard added that the title to the property cannot revert to the federal government because the federal government never owned the land in the first place. “You can only get back what you started with,” she said. Arguing on behalf of the FAA, Alisa Klein said the district court was correct in its dismissal of the City’s case. She argued that there are restrictions on the City’s claim to the property and that the statute of limitations has passed. She added that the City should have known about the federal government’s interest in the land well before its 2008 assertion. “There is a cloud on this title,” she said. Judge Harry Pregerson pressed Klein on the applicability of the so-called reverter clause as it relates to a 1948 agreement in which the U.S. surrendered its airport land interests to the City. “Whoever wrote it didn’t know what they were saying,” he said. “They were stupid.” Pregerson, 92, even made an airplane-

themed joke about Klein’s diminutive stature as she approached the podium to outline the FAA’s arguments. “You’re flying low to the ground,” he said. When asked by Judge Richard Paez about the FAA’s interests in the airport, Klein said SMO serves as a reliever airport for congestion at nearby Los Angeles International Airport. Judge Jacqueline Nguyen asked Klein why the federal government believes it has authority over what Santa Monica does with the property if it doesn’t own the land. “If the parties are fighting over the terms of the merits,” the judge said, “then the court needs to figure out what the merits are.” In October 2013, the City of Santa Monica sued the FAA regarding the title to the airport property, disputing the claim that it must operate the airport in perpetuity. In early 2014, when the FAA filed a motion to dismiss the case, the City argued against the idea that the U.S. could claim the title to the land if Santa Monica stopped operating the airport. The FAA’s motion to dismiss was granted by the U.S. District Court’s Central District of California, which concluded that “the City knew, or should have known, that the United States claimed an interest in the Airport Property as early as 1948.” The City appealed the ruling in October 2014, saying that its claim under the Quiet Title Act remained justified. The FAA contended that the statute of limitations had passed. The 1984 settlement agreement between Santa Monica and the U.S. expired July 1. An appeals court hearing was announced in late December, a month after the City hired Nelson Hernandez as an airport affairs advisor to City Manager Rick Cole. “The future of Santa Monica Airport is at critical juncture and securing local control is one of the City’s top priorities,” Cole has said. Californians are entitled to view a wide variety of emails, memos and other records created by their state and local governments. Ask to see who your state lawmaker is emailing, however, and they’ll get a two-page canned response that says, in essence, “no way.” Access to public records is considered paramount to maintaining trust in government holding politicians accountable. But California lawmakers wrote themselves out of the 1968 Public Records Act that requires other government officials to release their records when the public asks. Lawmakers instead apply their own, less transparent law. The issue has come into focus repeatedly since the Legislative Open Records Act was signed in 1975, but little has changed. Government transparency laws like those allowing public access to records allow citizens to keep an eye on their government, ensuring politicians are keeping their promises, and deter corruption, said Jessica Levinson, a professor at Loyola Law School who serves as president of the Los Angeles Ethics Commission. “When people know that they’re going to have to tell the public what they’re doing, or how they’re getting and spending money, or how they’re spending their time, then they may think twice before engaging in questionable behavior,” Levinson said. Legislators have long defended their carve-outs as necessary protections for constituents and for maintaining a forum for frank debate in the Legislature. The Associated Press requested a week’s worth of calendar entries and emails for the four top lawmakers in every state and most governors. In California, officials in Gov. Jerry Brown’s office said they release the governor’s calendar monthly and declined to provide earlier access to a week of appoint-

ments. Brown did not use his official email account during the week requested by the AP, spokesman Evan Westrup said. The Assembly and Senate Rules committees declined requests for emails and calendars for the top legislative leaders, citing a number of exemptions including privacy and legislative privilege. California’s legislative branch is bound by a less transparent public records law than the Public Records Act, which applies to other government agencies, including the executive branch and local governments. The Legislative Open Records Act, signed in 1975, exempts from public disclosure all “correspondence of and to individual members of the Legislature and their staff ” as well as any communications between private citizens and the Legislature. In denying the AP’s requests, the Rules committees also cited a 1991 California Supreme Court decision that said Gov. George Deukmejian was not required to disclose his calendar. Yet, Brown and his predecessor, as well as other statewide elected officials, regularly release their schedules upon request. In 2011, three lawmakers told the AP and San Jose Mercury News they would be willing to release their personal meeting calendars, but were prohibited from doing so by the rules committees that control legislative documents. The rule appeared to be extremely rare among state legislatures. That same year, then-Assembly Speaker John Perez said he’d create a task force to study open-records issues following an uproar over the Assembly’s refusal to release lawmakers’ office spending records during a feud with another Democratic lawmaker. The task force does not appear to have ever met, and Perez referred questions about it to the Assembly Rules Committee. Chief Administrator Debra Gravert said she was hired three years later but would research the issue. “We already did more disclosure than was required by law, and more disclosure than the Senate did,” Perez said.

California gets fourth day of rain, snow ASSOCIATED PRESS A storm brought strong winds, periods of heavy rain, snow and high surf to California on Sunday, the fourth day of wet weather that has prompted road and school closures and left an officer injured. Dry conditions and warmer weather are forecast for Monday. A California Highway Patrol officer was in serious but stable condition Sunday after being struck by an out-of-control vehicle as he provided traffic control in snowy conditions on a mountain pass, the CHP Truckee office said. The accident Saturday led authorities to temporarily close a portion of Interstate 80 near Donner Summit, a treacherous road in the Sierra Nevada in the northeastern part of the state that has been battered by a series of winter storms. The weather was bad enough that the officer had to be taken to the hospital by ambulance instead of by helicopter, CHP Lt. Sven Miller told the Sacramento Bee. More than 1 foot of snow fell in the area overnight and up to 3 feet were expected in the higher elevations of the Sierra Nevada through Monday, the National Weather Service reported. In counties north of San Francisco, rivers swelled and the flood risk was high. About 8 _ inches of rain fell during a 72-hour period in the unincorporated town of Venado in Sonoma County. Water from the rain-swollen Sacramento River was spilling Sunday over a 33.5-foothigh concrete wall and into a bypass built to divert flood water. The overflow is expected to reach a depth of 3 feet Tuesday then start receding, said Robert Hartman, a hydrologist with the National Oceanic and Atmospheric Administration. It’s the first time water that has spilled

over the so-called Fremont Weir crest and into the Yolo bypass since 2012. The nearly 2-mile-long concrete wall is located about 8 miles northeast of Woodland. The bypass is an expanse of farmland and natural habitat that stretches from Sacramento to Davis and was created a century ago. A portion of California Highway 1 in Mendocino County was closed where slides nearly toppled a California Department of Transportation dump truck with an employee inside. The truck hit a guardrail - stopping its fall - and landed at a 45-degree angle. No one was injured. In the East Bay, a landslide near the Moraga Country Club prompted at least two homeowners to evacuate from their hillside homes. Tim Alford told the Contra Costa Times he noticed cracks at the foot of his home on Tuesday, and two days later his decks had collapsed. He and another neighbor, Darlene Martel, hired a geologist. “He came and told me: ‘I would not sleep here,’” Martel said. Powerful rains also slammed the central part of the state, flooding streets in Fresno and briefly shutting down the airport there. The storm dumping rain in much of Northern California is expected to weaken as it moves south, though the southern part of the state could see scattered showers or drizzle, and beachgoers were warned of powerful surf along the Central and Southern California coast. Waves up to 8 feet could pound beaches for most of the day Sunday, the National Weather Service said. A high surf advisory is in effect in Santa Barbara, Ventura and Los Angeles counties. Meanwhile a wind advisory has been issued for some coastal areas and in the mountains and high deserts.

ON MARCH 2 AT APPROXIMATELY 11:30AM A Santa Monica police officer assigned to the HLP Team was patrolling the embankment at the 1000 block of the I-10 freeway and saw two homeless men in a makeshift camp site. The officer issued a citation to one of the men, but the other one said he had no identification. The man also gave the officer a false name and birthdate. When the officer was able to finally get the man’s true identity, a search of his criminal record showed he had a “No Bail” warrant for his arrest. The man was then taken into custody and booked at the Santa Monica jail. The suspect was identified as Jefferey Roddenberry, 57, homeless, and was charged with false identification and flash incarceration. No bail was set.
