A tenant’s trepidation Will a longtime resident of a rent-controlled unit be able to stay? BY JEFFREY I. GOODMAN Daily Press Staff Writer

The 3-bedroom apartment in the 1400 block of Harvard Street is more than a collection of rooms and walls to Connie Hill. It’s where she created a life with her late husband, who passed away a couple years ago. It’s where she raised her children, who are now grown and living elsewhere. For more than 35 years, it’s been her slice of Santa Monica. Her current unit is rent-controlled. She owes about $1,100 each month, well below the market rate. Hill struggles to imagine living elsewhere, let alone paying for another place. It’s why she and her family are worried about the changes taking place at her build-

ing. “It’s the new face of Santa Monica,” Hill’s daughter, Kim Cecere, said. The debate over rent control rages on in the beachside city, which adopted the housing regulations in 1979. Proponents believe the policies promote stable neighborhoods and help to keep Santa Monica affordable for middle- and low-income residents. Critics argue that the laws reduce the availability of vacant units and discourage landlords from paying for repairs and upgrades. Senior forward Mikhail Brown earned first-team all-1A and firstteam all-league recognition, junior forward Daniel Schreier made the all-section 1A second team and the all-conference first team, and sophomore wing Rip Economou was a second-team honoree in 1A and the Ocean League. On March 26, at approximately 12:47 p.m., Santa Monica Fire Department Paramedics, were called to the Santa Monica Beach, north of the pier, for a possible drowning. On scene, Santa Monica Firefighters worked with Los Angeles County Fire Department Life Guards to rescue one juvenile, who was transported to Santa Monica UCLA Medical Center in critical condition. Ultimately, numerous Life Guard Swimmers, one Life Guard boat, one County Fire Department Helicopter, Santa Monica Police, and Santa Monica Firefighters worked together to locate the victim and get medical attention. Santa Monica Beaches and the Pier received an influx of visitors due to warm temperatures, and the Easter holiday weekend. would like to thank the Santa Monica community for helping to make our secondannual Lions Eyes Across California event on March 19 at Virginia Avenue Park so successful. People started lining up at 7 a.m. for an event that didn’t start until 9 a.m. The Santa Monica Lions partnered with the Venice Marina LAX Lions, Miracle Mile Lions and the new West Los Angeles Lions to increase the number of people we were able to serve this year. Using our mobile screening unit, we were able to provide eye screenings to 85 adults, a 12-percent increase from last year, and give away 200 eyeglasses, a 60-percent increase. If the eye screening indicated a potential for eye disease, such as age-related macular degeneration, glaucoma or diabetic retinopathy, we were able to provide free referrals for 15 people to our eye clinic downtown. We also collected 75 used eyeglasses. We were fortunate to partner with two incredible local nonprofits, The Center for the Partially Sighted (CPS) and Vision To Learn (VTL), so we could offer a wider variety of vision services to people in Santa Monica. For many older adults that are having agerelated vision problems, CPS was able to provide information and assistance on reducing the impact that vision loss has on their everyday lives. The tips and suggestions they offered were greatly appreciated, with five people scheduling appointments to receive personalized help in assessing their needs.

VTL provides eye screenings, exams and free prescription eyeglasses for youth through age 18 to help them see better, improve their reading skills and succeed at school. On Saturday they provided eye screenings for 57 children, gave 26 children full eye exams and will be providing 21 children with custom eyeglasses. In the spirit of VLT’s mission to help children read, the Santa Monica Lions gave them 150 children’s books to hand out to children after their eye screenings. Books not used will be given out when they do screenings at other events. Another organization, the Westside Center for Independent Living, provided volunteers to help us at the event. In addition to helping with eyeglass distribution, they shared information about their services, which not only help people with vision problems, but also people that are hearing-impaired or have other issues that could threaten their independent living. We are looking forward to learning more about them when they come to speak at a Lions lunch meeting in May. Bloom’s ‘sugar tax’ leaves a sour taste

to beat dead horses. Once again, he’s floating another proposal for a “sugar tax.” Never mind that two previous efforts of mandating a statewide tax on sugar-sweetened sodas failed, spectacularly. A 1-cent per ounce statewide soda tax proposal in the legislature was killed in 2014. Another similar bill stalled in Bloom’s committee last year. This year, AB2782 by Bloom and co-author Jim Wood of Healdsburg, would impose a surcharge of 2-cents per ounce on sugar-sweetened sodas and other drinks sold in the state. If it becomes law, your favorite 12-ounce Coke or Pepsi will cost 24-cents more. Revenues from the tax plan would go to counties, cities, community based organizations and licensed clinics to implement and maintain anti-obesity and diabetes prevention initiatives as well as dental care and safe drinking initiatives. The tax is expected to raise $2 billion each year and benefit black and Latino neighborhoods that have traditionally high rates of diabetes and obesity. Bloom noted that policy makers have the opportunity to reverse the growing obesity trend with programs that counteract marketing campaigns pushing sugar-reinforced products toward children. However without some education about health risks directed to consumers about sugar consumption, this is just another tax and state-mandated funding opportunity for some lawmaker’s favorite charity. AB2782 is flawed legislation and like previous sugar tax proposals, omits surcharging obvious sources of sugar-reinforced foods, such as chocolate and candies, fruit juices and salty, greasy snacks. Worst of all, creates a nanny government. The California League of Food Processors claims its “unfair and “inaccurate” to blame sugar-sweetened beverages as the “main culprit” for diabetes and says the legislature has no business regulating our personal decision to purchase and consume sugary beverages. CalBev (the state beverage industry trade association) executive director Bob Achermann issued the following statement in response to the introduction of AB 2782. “Time and again, misguided tax proposals on sugar-sweetened beverages have been defeated in cities across the state, as witnessed last year in the California Legislature with Assembly Bill 1357 - legislation that received wide-spread opposition from business organizations, unions, vendors, grocers, retailers and restaurant owners throughout California. It’s time to move on and find real solutions to obesity and diabetes that will have a meaningful impact. Taxes are not a solution to our public health challenges. Instead, they hurt small businesses and increase the costs of common grocery items… The last thing that hard-working Californians need is another tax, which will only make it even more difficult to make ends meet in one of the most expensive states in the nation.” Right on, Bob!

And while City Hall is planning to spend a million bucks to welcome the Expo Light Rail in June, it hasn’t given up nickel and diming residents. As usual, it involves parking fees. Stacy Dalgish, Mid-Cities Neighbors board member forwarded a comment from one of the organization’s members. It said,“Last night I parked on 7th Street between Arizona and Santa Monica Boulevard and had to pay $2 for an hour and 15 minutes of parking at a meter that went to 9 p.m. Four blocks from 3rd Street and you have to pay until 9 p.m.? “Okay but why $0.25 for three minutes at certain meters? What can you possibly do in three minutes? That seems like a blatant money grab to me. And on outlying streets, meters go to 9 p.m. when they used to go to 6 p.m. Why not roll them back to 6 p.m.?” That’s exactly what it is. A blatant money grab. JUST WHAT WE NEED: VEGAN CITY EMPLOYEES

If you think that city politicians and policy makers inject too much of their social engineering into the lives of residents, you may be surprised to know that the proselytization doesn’t end with us.City employees have been subject to a “go vegan” campaign as promulgated by the Office of Sustainability and Environment. Currently, City Hall is wrapping up a “Meatless in March” promotion for City employees with tips and recipes about how they can be more sustainable by going meatless. Programs on not wasting food and how to properly store fruits and vegetables have also been distributed by email and over the intra-city network. It all made one city employee, who called the City’s political correctness efforts to my attention, to comment that the social engineering of employees is an ongoing effort. Of course, it costs money. And, we’re paying for it. But, it keeps people busy and employed. PORTRAIT OF A WHISTLE BLOWER

The BG Gallery at Bergamot (2525 Michigan Ave, Gallery G8) has a multi-artist show currently on display. One of the pieces is a kinetic sculpture by local artist Dave Quick. The whimsical piece depicts a pencil lying on a flat bed, railroad train carriage. A little man sits on top of the pencil. Its title is “Whistle blower: Portrait of Bill Bauer.” It’s an interactive work so viewers can crank the handle on the top-right side of the sculpture, which in turn spins gears that drive a rotating sign that spells out the word: “Monstrosity.” Quick got a kick out of my columns where I described many local developments as “monstrosities” and he used the word as a theme for the portrait. Quick’s works - unlikely collisions of found objects, photography, political satire, and “machine era” mechanical motion - have appeared in scores of local and national exhibitions over the decades. Peanut allergies among children in the United States has more than tripled, from 0.4 percent in 1997 to 1.4 percent in 2010, according to a study by food allergists at Mount Sinai Hospital in New York City. Of the eight foods that cause 90 percent of food allergies (milk, soy, eggs, wheat, peanuts, tree nuts, fish and shellfish), peanuts are the deadliest. They result in an estimated 15,000 emergency room visits (half of the 30,000 due to food allergies) in the U.S. Heather Fraser, author of The Peanut Allergy Epidemic: What’s Causing It and How to Stop It, says that despite the continuing intense attention given to the growing epidemic of peanut allergies in children, an answer to its cause(s) has not been found. Fraser adds that it is difficult to accept the startling increase in peanut allergies in just the last 20 years as a coincidence or to chalk it up to a genetic fluke. Robyn O’Brien, author of The Unhealthy Truth: How Our Food is Making Us Sick and What We Can Do About It, states that the sudden surge in American peanut allergies may be attributed to the fact that peanuts are grown in the same soil as Roundup Ready, or glyphosate tolerant, cotton. Unlike almonds, walnuts and cashews, peanuts do not grow on trees-they re actually a legume with a soft shell that grows in the ground. “Put anything in that soil and you can imagine how it gets absorbed into the peanut,” O’Brien wrote on her website, adding: “Put genetically engineered seeds in that soil and you get soil that is saturated with a controversial chemical, glyphosate,” a chemical that the U.S. Environmental Protection Agency (EPA) has linked to gradually increasing, cellular-damaging inflammation. But according to Fraser, the consumption

of genetically modified foods does not correlate with the epidemiological facts of the peanut allergy epidemic. Fraser proposes that the use of refined peanut oil as a vaccine adjuvant, or enhancer, is behind the epidemic. According to Fraser, the use of refined peanut oil in vaccines resulted in the slow growth of the allergy primarily in children until the late 1980s when its prevalence exploded due to the extensive and sudden changes to childhood vaccination. There has been a 414 percent increase in vaccines given to U.S. children, says VacTruth.com. In 1950, an American child would have received seven vaccines by the age of six. Today, if an American family follows the Centers for Disease Control and Prevention, American Academy of Pediatrics and American Academy of Family Physicians endorsed annual childhood vaccine schedule, their child will receive over 36 vaccines by the time they are six years of age. With the direct cause(s) of the peanut allergy epidemic still open-ended, many pregnant women have taken to avoiding peanuts altogether to prevent their unborn child from developing the allergy. But a recent study found that children whose nonallergic mothers had the highest consumption of peanuts or tree nuts, or both, during pregnancy had the lowest risk of developing a nut allergy. The risk was most reduced among the children of mothers who ate nuts five or more times a month. “Some studies actually showed that avoiding peanuts during pregnancy increased the risk of a child developing peanut sensitization,” said Dr. Ruchi Gupta, an associate professor of pediatrics at Northwestern University. Dr. Gupta emphasized that further research is needed to determine “why more and more children are developing food allergy and how we can prevent it.”

Downtown open space and 5th/Broadway WHEN WE THINK ABOUT GREAT CITIES

we’ve visited around the world, the ones that we love walking around for hours, what are the things that make them great? It’s often a mix of parks and plazas, cultural and civic destinations, and cool buildings, public art and great architecture; as well as fun places to shop, eat and people watch. In Santa Monica’s downtown, we are undergoing a major transformation - from a downtown in the 1980s with the Third Street Promenade as its locus; to expanding activity to 2nd and 4th streets in the 1996 Bayside Specific Plan (https://www.smgov.net/ Departments/PCD/Plans/Bayside-DistrictSpecific-Plan/); to today’s draft Downtown Community Plan (DCP), stretching from Ocean Ave. to Lincoln Bl., and from Wilshire Bl. to Colorado Ave. (http://www.downtownsmplan.org/”http://www.downtownsmplan.org). FOCUSING DEVELOPMENT DOWNTOWN

Since the early 1980s, its has been the de facto policy in Santa Monica to focus future residential growth in our downtown - to minimize redevelopment pressure upon our existing residential neighborhoods and resultant displacement of existing residents and to positively concentrate future residential density near public transit and jobs. Can we do that and still make our downtown livable? One key measure will be the number and character of our downtown open spaces. Some of them will be green, some will be hardscape. By the end of the DCP planning period in 2030, there should be a matrix of public open spaces that populate the downtown, and connect its edges to Wilshire Bl., the Mid-Cities neighborhood along Lincoln Bl. and the Gateway area next to Colorado Ave. capping over the I-10 freeway. OPPORTUNITY SITES AND OPEN SPACE

When community meetings were first convened for the draft Downtown Specific Plan (DSP) in late 2011 (the precursor to the DCP), the term and concept “opportunity sites” was introduced. The idea was that the exceptional size, shape and location of eight public and/or privately-owned parcels might merit special planning attention, creativity and flexibility for their potential to achieve a range of public policy goals, including great urban design and open space

As part of that concept, some exception to Santa Monica’s 84-foot height limit could be on the table on a case-by-case basis in exchange for additional public benefits. But even at 84-feet and below, the exceptional dimensions of a limited number of downtown parcels merit special planning consideration and creativity through the negotiated Development Agreement process. At the same time, there were three private hotel/luxury condominium projects proposed for Ocean Ave., at heights absurdly beyond what most Santa Monicans would support - 195, 260 and 325 feet respectively. These ill-conceived, radical proposals recklessly colored the public perception of the public DSP process, and of the urban design debate overall, and generated much unnecessary blowback that continues today. The current 84-foot height limit has served Santa Monica well, since it was established in 1984 as part of the City’s Land Use Element of its General Plan. Our downtown has thrived and grown since then. Any future exceptions made to the 84-foot limit - if ever - need to come out of a very considered public process. But that doesn’t mean we shouldn’t be having the debate, especially since by law, developers - both public and private - can always propose their own height exceptions in limited cases. Presumably, we also want the debate to be community-driven through the DCP, and not solely on a project-byproject basis. OPEN SPACE WITHIN EXISTING HEIGHT LIMIT AT 500 BROADWAY

One of the eight opportunity sites identified in the DSP was the Fred Segal parcel at the southeast corner of 5th and Broadway 500 Broadway - a parcel of 67,500 square feet, 150 feet wide x 450 feet long, extending in length along the east side of 5th Street. In this case, the developer chose not to also ask for an exception to the 84-foot height limit. At the same time, the project attempts to address a number of public policy objectives, including significant residential housing (affordable and market rate), a community food market, public parking, sustainability and meaningful public open space. Can we get all of this and still have an

attractive project? What kind of open space will come out of this process? FUTURE ROLE OF 5TH AND BROADWAY

At the first DSP community meeting in 2011, 500 Broadway was identified as a potential site to gain new public open space. Naturally as an instinctive nature lover, I immediately envisioned an open-to-the-sky green corner park. What has been proposed is much different - a more urban Corner Plaza. It works. Designed with the nearby Expo light rail line station in mind, it strategically fits what 5th/Broadway can/should become - a crossroads for people coming to and from the nearby Expo light rail station at 4th/Colorado - not just downtown residents, but others walking across Lincoln from MidCities, or from the north across Wilshire. This proposal’s open space facilitates just that, and creates a dynamic urban environment in the process. The project provides publicly accessible ground floor open space equivalent to 20 percent of the parcel. To facilitate pedestrian flow, the ground floor retail and outdoor dining along 5th Street and Broadway is set back at least 12 feet from the sidewalk and often much more, and there will be flexible/moveable free public seating areas throughout. Then, set back further from the corner on the 5th Street side, will be an open-to-the-sky courtyard with more chairs and tables, leading to a residential lobby (and onwards to bike parking adjacent to the alley) (http://500broadwayvision.com/#gallery). The outdoor seating/eating/walking/people-watching continues along 5th Street, with an outdoor Market Court and South Patio. This will also fill a need expressed by those living in the seniors building across the street, to have a safe and accessible outdoor place to eat and drink, especially in the earlier and later hours. WHAT KIND OF OPEN SPACE?

The public policy question with this Corner Plaza (and a fraction of the Market Court and South Patio) is that on the ground level it is open to the air, but with six stories of housing above. Should it count as part of the project’s required open space, if it isn’t open to the sky? In this case the answer is yes. The Corner Plaza creates quality public space, it facilitates a critical crossroads function - and

because its on the sunny side of the street, the overhang provides shade from direct sun, but still allows daylight and temperate air to fill the space. If we didn’t allow the housing over the Corner Plaza, then the rest of the project would have to be much denser and less appealing, and/or the community benefits fewer. Right now there are four residential buildings proposed above the ground floor level (housing 249 market rate apartments), and 27-30 foot wide openings between each. None of this is claimed for the open space requirements for the project. But the openness is great for our future neighbors (and their visitors), and it makes the buildings feel better scaled and more open to light and air from the street. Designing a project in this way also enables a hefty and wide-ranging community benefits package, that includes an additional $1.7 million that the city can use toward new parks land acquisition and keeps the project within the 84-foot height limit. Instead of asking for an exception to the City’s height limit - in order to build multiple stories of multi-million dollar luxury condominiums to finance their project by privatizing our skyline, as have the aforementioned developers along Ocean Ave. - the developers of 500 Broadway purchased a nearby property along Lincoln Bl. (and contributed gap financing), where 64 deed-restricted desperately needed affordable housing units would be constructed. Having been approved 6-1 by the Planning Commission, the 500 Broadway project is now headed for final approval to the City Council. FUTURE OPEN-TO-THE-SKY DOWNTOWN PUBLIC SPACES

Looking ahead, major open-to-the-sky open space opportunities in the DCP planning area include the City project at 4th/5th/Arizona, the massive Vons site along Lincoln Bl. (when it eventually redevelops) and the publicly-owned land immediately south of the Expo station at 4th/Colorado as well as immediately adjacent between Ocean Ave. and 5th St., when we cap over the top of the I-10 freeway with parks and plazas. On its way to capturing its first section championship in school history, the Samohi girls water polo team gave up just 11 goals combined in four playoff games. The Vikings’ stout defense was due in part to the efforts of junior goalkeeper Amalie Luneng-Solli, who was named coplayer of the year in Division 6 alongside Pasadena-Westridge star Georgia Bogle. Four of the 14 players recognized in the division represent Samohi. Luneng-Solli was joined on the list by senior Olivia Allen, junior Shanna Stevenson and freshman Lauren Gaudry, the only ninth-grade honoree. Molly Tomlin’s 25-point outing against Lawndale-Leuzinger in early December was perhaps a sign of a remarkable season ahead. St. Monica Catholic girls basketball coach Don Burke had called the senior a “great leader,” praising her for her basketball knowledge and defensive intensity. And Tomlin, who ended up leading the Mariners to the Division 4AA quarterfinals, was honored with a spot on this year’s allsection team. Santa Fe Springs-St. Paul junior Na’lon Smith was named the 4AA player of the year and St. Paul’s Robert Miller was chosen as coach of the year. Tomlin guided St. Monica to second place in the Camino Real League. She then helped the team defeat Walnut-Southlands Christian and Sherman Oaks-Notre Dame by a combined 89 points in the first two rounds of the playoffs to set up the quarterfinal meeting with Smith and St. Paul.

Four local players earned all-section recognition in boys soccer this winter. Although Samohi didn’t make the playoffs, sophomore defender Diego Villagran and freshman midfielder Oscar Benavidez each earned spots on the CIF-SS Division 3 boys soccer team. Benavidez was one of two freshmen on the elite roster, joining Santa Maria forward Gabino Mantano. Redlands East Valley’s Jonathan Garcia and Ted Small were named player of the year and coach of the year, respectively. Crossroads also had two all-CIF selections, with senior goalkeeper Jackson Schierbeek and freshman midfielder Dante Perez-Mendoza making the Division 5 team. Perez-Mendoza and Granite Hills forward Gabby Hernandez were the only first-year honorees. Garden Grove’s Derek Ayala and Matt Grenert were selected as player of the year and coach of the year, respectively. The Roadrunners went 17-3-3 this season, reaching the section semifinals before falling to Garden Grove-Santiago. GIRLS SOCCER

Chloe Kleinman has been here before. A year after receiving all-section recognition, the senior Samohi forward was again honored for her contributions in Division 4 this season. Kleinman led the Vikings to a third consecutive Ocean League title and guided them in the playoffs, where they defeated Thousand Oaks-La Reina and PhelanSerrano in the first two rounds before falling 2-1 to eventual champion La Mirada in the quarterfinals. There were 153 units affected by Ellis Act evictions in 2015, according to the Rent Control Board’s recently released Consolidated Annual Report, an 80-percent increase over the 85 units impacted a year earlier. The units can return at market rate if they’re kept off the market for five years. “Clearly this increase is tied to economic opportunities,” Dan Costello, an information analyst for the city, said earlier this month. “There are high property values here and the opportunity to develop condominiums on properties that may have had rentcontrolled rental housing exist. And even if owners didn’t demolish the buildings and waited five years, they could command much higher rents than perhaps the properties are generating now.” Hill lives in one of Santa Monica’s 27,000plus rent-controlled units, and she gets an extraordinary bargain relative to other local residents. Her monthly rent is less than onethird of $3,595, the median monthly cost of a 3-bedroom apartment in the city last year, according to the annual report. Hill moved to Santa Monica after visiting her sister in town decades ago, landing a place near the original Hot Dog on a Stick. She soon met her eventual husband, Donald, who lived in the former Muscle House on Ocean Front Walk. The two got a house nearby before settling in an apartment on Harvard Street in 1979. It’s where Hill, 70, still lives today. Her complex between Broadway and Santa Monica Boulevard was recently sold to

a new owner, Denali Alpha LLC. Los Angeles Property Management was hired to handle day-to-day duties there. Vanessa Pineda, who runs the property management company, said she inspected her new client’s units earlier this month and informed Hill in a letter of several violations that had to be addressed. There were issues with excessive storage. An air-conditioning unit had been installed in a window. More smoke detectors were needed. Her pet bird was against the rules. The letter made Hill uneasy. “They’re trying to find anything to get her to leave,” said Cecere, Hill’s daughter. Pineda, an experienced property manager on the Westside, said roughly 80-percent of the units she oversees are rent-controlled. She said her tenants are given plenty of time to follow orders and added that it’s her job to notify them of landlords’ expectations. The owner doesn’t want to force Hill out, Pineda said. “It’s exciting to get a client who wants to make the property nice,” she said. “Usually when landlords deal with tenants with low rent, they don’t want to put money into the property. It’s been a pleasure for me. ... It’s nice to find someone who fits the market, who wants to improve the property.” Cecere said Hill, who still has the original lease paperwork, is trying to comply with Pineda’s instructions so she doesn’t get kicked out. Pineda, meanwhile, recently learned that Hill has a deep emotional attachment to her bird because it reminds the widow of her time with her late husband.
