Tenant harassment claims rising BY DAVID MARK SIMPSON Daily Press Staff Writer

CITYWIDE As rents rise in the city by the sea so have claims by tenants who say their landlords are harassing them. This fiscal year, Santa Monica City Hall is on pace to receive 43 official harassment complaints from renters. Last fiscal year they heard 38 and the year before it was 34. There

have been 34 so far this year with more than two months remaining. Deputy City Attorney Gary Rhoades briefed the Rent Control Board Thursday on the current state of tormented tenants. City Hall’s ordinance on the subject, which was passed almost exactly 20 years ago, prohibits landlords from doing things like using lies and intimidation to get renters to move out, refusing repairs required by

law, or intentionally disturbing the peace and quiet. There are numerous reasons a landlord would be motivated to coerce a tenant to leave including rent control, which keeps units at stable rental rates so long as the renter doesn’t move out. “Generally, we’re in a leveling off period,”

With $41.4M, ‘Captain America’ holds off ‘Rio 2’ JAKE COYLE AP Film Writer

NEW YORK “Captain America” continued to flex its Marvel muscle at the global box office, as “The Winter Soldier” took in $41.4 million domestically and $60.6 million overseas. The strong second-week performance for the Walt Disney release in North America was enough to narrowly edge 20th Century Fox’s “Rio 2” in a springtime battle of sequels. The animated Amazon jungle tale “Rio 2” debuted with $39 million, according to studio estimates Sunday, almost exactly the opening weekend total of the 2011 Oscar-nominated original. But “Captain America” has grown considerably in stature since its 2011 original, “The First Avenger.” With a global cumulative total of nearly $477 million, “The Winter

Soldier” has (in two weeks domestically, three weeks internationally) easily surpassed the $370 million total of “The First Avenger.” For a superhero whose costume is draped with the U.S. flag, Captain America (played by Chris Evans) has proven particularly popular abroad. The international appeal of such a traditionally patriot figure was once doubted. “The traditional rules just don’t apply anymore. It’s really about that Marvel brand,” said Paul Dergarabedian, senior media analyst for box-office tracker Rentrak. “’Captain America’ can play in Peoria just as well as Hong Kong.” “Rio 2,” with a voice cast including Anna Kendrick and Jessie Eisenberg, also played well internationally. In its second week of release overseas, it made $62.5 million. Two other new releases opened in a distant third and fourth place. The low-budget supernatural horror film

“Oculus” took in $12 million for Relativity Media. The football drama “Draft Day,” starring Kevin Costner and directed by Ivan Reitman, debuted weakly with $9.8 million. Made with the cooperation of the National Football League, the Lionsgate release is the second movie this year, along with the thriller “3 Days to Kill,” to attempt to restore the 59year-old Costner to leading man status. The overall box office for the year is up more than 7 percent over 2013’s record boxoffice haul. The month of April has been propelled especially by the summer-style release of “The Winter Soldier” and a number of less likely successes. With $39.5 million domestically, the Wes Anderson caper “The Grand Budapest Hotel” has performed exceptionally in a gradual release by Fox Searchlight. The independently released Christian film “God’s

Not Dead,” from Freestyle Releasing, has made a whopping $40.7 million in four weeks. Just holding in the top five was Lionsgate’s teen sci-fi franchise-starter “Divergent,” which added $7.5 million in its fourth week to bring its cumulative total to $124.9 million. Lionsgate announced Friday that the third installment in the series (a sequel for 2015 is already in the works) will be split into two releases. The final book in Veronica Roth’s young-adult trilogy, “Allegiant,” will be made into two installments, one to open in March 2016, the other in March 2017. Estimated ticket sales for Friday through Sunday at U.S. and Canadian theaters, according to Rentrak. Where available, latest international numbers are also included. Final domestic figures will be released on Monday.

California drought spawns well drilling boom SCOTT SMITH Associated Press

CHOWCHILLA, Calif. The scarcity of irrigation water in drought-stricken California has created such a demand for well drilling services that Central Valley farmer Bob Smittcamp is taking matters into his own hands. He’s buying a drilling rig for $1 million to make certain he has enough water this summer for thousands of acres of fruit and vegetable crops. “It’s like an insurance policy,” said Smittcamp, who knows two other farmers doing the same thing. “You have to do something to protect your investment.” With California in a third dry year, well drilling is booming across the nation’s most productive agricultural region, and some drilling companies are booked for months or a year. In some counties, requests for permits to dig new wells have soared, more than dou-

The truth on drones Editor:

RE: John Fairweather letter about drones (“Drones the way to go,” Letter to the Editor, April 5) To suggest the use of drones for delivering blood, hearts and other organs for justification to close [Santa Monica Airport] is unbelievably ignorant of their lack of development, lack of range, lack of useable load (weight), lack of security, air regulations and communications, and multiple other safety and delivery issues. Mr. Fairweather, as I understand it, is a realtor, and bought, in recent years, a home under the primary departure path, and no doubt for less than other areas of Santa Monica. He is aligned with at least two antiairport groups, has managed to become an airport commissioner, and has acted with the single goal of attempting to force closure of the airport. His mandate as a commissioner is: “The Airport Commission shall have power and be required to: Consider and recommend City Council rules and regulations for the management and operation of the Municipal Airport. (Amended at General Municipal Election, Nov. 7, 2006; certified by Res. No. 10187CCS)”. He clearly has no interest, or perhaps skill, to guide the management and operation of the airport. He needs to go, and it is not he alone that lacks any aviation related experience. There is not one member of the commission that has aviation related experience, and four of them live under or adjacent to the primary departure path, which perhaps colors their decision making. Once off the commission they are free to pursue closure without violating their mandate. As the city has seen recently, with a resident’s referendum about the Hines development project at the Paper Mate site, there is a sense that some of those in decision making positions are not heeding the desires of the residents. While there is a small vocal group that live under the flight path that would benefit from closure, e.g. a realtor, and many of whom supported the referendum that will offer residents a citywide vote on the Hines project, they seem not to find it in their interest to have a similar citywide initiative regarding the future of the airport, and so state on their anti-airport websites. This commission needs to be replaced with members that understand the importance of our national transportation system, the importance of competently trained pilots, the importance of recurrent training, and the fact that each time one of us steps on a commercial flight at LAX, or anywhere else, we are trusting that those up front are capable of getting us safely to our destination. That requires training at an airport, with flight instructors, and maintenance, and fuel, and flying. SMO fulfills those requirements, just as it has for at least 90 years. Which of you, in the future, will be the first on the plane that is really a drone, with no pilot up front, because they had nowhere to learn to fly?

Dust-up at the Samohi corral AN INCIDENT AT SANTA MONICA HIGH

School recently has made national news. It was the wrestling match between Samohi science teacher/wrestling coach Mark Black and an 18-year-old student. Coach Black won the match with a two-point takedown. The scuffle took place in Black's classroom according to news reports after the teacher approached the student who was allegedly selling marijuana. The student either threw a punch at Black, stabbed him with a pencil and/or pushed him according to various eyewitness accounts. Black grabbed the student, wrestled him to the floor and held him down. Portions of the incident were recorded on student cell phones. Santa Monica Police were called and Blair Roderick Moore from Los Angeles and a 16-year-old, male student from Santa Monica were arrested. Santa Monica-Malibu Unified School District (SMMUSD) Superintendent Sandra Lyon was informed about the cell phone video which was already posted on You Tube and being broadcast on local TV newscasts. Lyon e-mailed parents and staff that same Friday that an unnamed teacher was involved in “a deeply disturbing” and “utterly alarming” incident that resulted in the police being called to campus. Lyon wrote that the teacher used an “unacceptable” kind of physical restraint in a confrontation with a student. She placed Black on paid leave shortly after the incident. According to the Santa Monica Police Department, Moore was charged with “two counts of threatening a public school official” and “one count of possession of less than 28.5 grams of marijuana on school grounds,”“one count of possession of a box cutter on school grounds,” and “one count of force or violence against a school employee in retaliation for an act performed in the course of his or her duties.” All misdemeanors. Mark Black is a well-liked teacher and coach. His students, friends and supporters put up a Facebook page and started a Change.org online petition to show support for the popular educator. The "We Support Coach Black" has garnered nearly 20,000 Facebook “likes" while the online petition had 7,000 signatures as of Thursday. By Saturday, the groundswell of support for Black had caught the superintendent's attention and she issued another statement. She wrote that some had interpreted her initial statement as prejudging the teacher's conduct and it didn't take into account the conduct of students involved. “I apologize that my comments focused solely on the message that teachers should not physically engage when disciplining or intervening without underscoring that we need to obtain all the details leading up to this situation before we reach conclusions,” she stated. Lyons has promised “a thorough and independent” investigation of the incident before the end of spring break which is next Monday. Moore pleaded "not guilty" to his charges

and was released on his own recognizance after his arraignment last Tuesday. The 16year-old (name withheld) was arrested on “suspicion of battery against a school employee” and is awaiting arraignment. Lyon was wrong in airing an opinion before the facts were out — something that has resulted in calls for her termination. I don't think her "rush to judgment" is reason to fire her nor do I think that putting Black on administrative leave pending a full investigation was uncalled for. Putting a teacher or staff member on leave in a situation like this is standard operating procedure in most school systems and I'm betting Black will be welcomed back as a hero next Monday. Other issues have been raised which I consider to be much more troublesome. Moore was a resident of Los Angeles and attending Samohi, apparently as a permit student although the district has not responded to questions about his student status. I have no issue with permits being issued to children of school district, City Hall or Santa Monica College employees. It's well known that hundreds of students here are imported from outside districts for a number of reasons including income from the daily, student remuneration the state of California pays school districts. Although Moore is considered innocent until proven guilty, it would behoove the school board to set up a screening and evaluation process to make sure that students coming into the school district from Los Angeles or elsewhere on permits are striving to improve their education and not potential trouble-makers. The SMMUSD has no public relations or public information officer. So when it comes to the press, it's more a matter of who reporters can find in a timely manner to interview. Normally, this would be the public information officer, superintendent (who in this case issued e-mails) or the president of the Board of Education. However, the present board president, Maria Leon Vazquez, is on record as "not speaking to the press." How unfortunate. This would have been a great opportunity for board member Ben Allen, who is running for State Senate, to step to the plate but that didn't happen, either. Board member Oscar de la Torre seems to be the “go-to guy” on a lot of community issues as he was on this one. He handled himself well with the media. But, since when did de la Torre become the SMMUSD's official spokesperson? Inquiring minds want to know if the next talking head on the six-o-clock news is speaking officially or stating personal opinions on school issues. The school board desperately needs to come up with an official spokesperson — whether it be an administrator or one of their own.

BERLIN The cost of keeping global warming in check is “relatively modest,” but only if the world acts quickly to reverse the buildup of heat-trapping gases in the atmosphere, the head of the U.N.’s expert panel on climate change said Sunday. Such gases, mainly CO2 from the burning of fossil fuels, rose on average by 2.2 percent a year in 2000-2010, driven by the use of coal in the power sector, officials said as they launched the Intergovernmental Panel of Climate Change’s report on measures to fight global warming. Without additional measures to contain emissions, global temperatures will rise about 3 degrees to 4 degrees Celsius (5 degrees to 7 degrees Fahrenheit) by 2100 compared to current levels, the panel said. “The longer we delay the higher would be the cost,” IPCC chairman Rajendra Pachauri told The Associated Press after the panel’s weeklong session in Berlin. “But despite that, the point I’m making is that even now, the cost is not something that’s going to bring about a major disruption of economic systems. It’s well within our reach.” The IPCC, an international body assessing climate science, projected that shifting the energy system from fossil fuels to zeroor low-carbon sources including wind and solar power would reduce consumption growth by about 0.06 percentage points per year, adding that that didn’t take into account the economic benefits of reduced climate change. “The loss in consumption is relatively modest,” Pachauri said. The IPCC said the shift would entail a near-quadrupling of low-carbon energy — which in the panel’s projections included renewable sources as well as nuclear power and fossil fuel-fired plants equipped with technologies to capture some of the emissions. U.S. Secretary of State John Kerry called it a global economic opportunity. “So many of the technologies that will help us fight climate change are far cheaper, more readily available, and better performing than they were when the last IPCC assessment was released less than a decade ago,” Kerry said. The IPCC said large changes in investments would be required. Fossil fuel investments in the power sector would drop by about $30 billion annually while investments in low-carbon sources would grow by $147 billion. Meanwhile, annual investments

in energy efficiency in transport, buildings and industry sectors would grow by $336 billion. The message contrasted with oil and gas company Exxon Mobil’s projection two weeks ago that the world’s climate policies are “highly unlikely” to stop it from selling fossil fuels far into the future, saying they are critical to global development and economic growth. Coal emissions have declined in the U.S. as some power plants have switched to lower-priced natural gas but they are fueling economic growth in China and India. The IPCC avoided singling out any countries or recommending how to share the costs of climate action in the report, the third of a four-part assessment on climate change. Though it is a scientific body, its summaries outlining the main findings of the underlying reports need to be approved by governments. This brings a political dimension to the process. In Berlin, a dispute erupted over whether to include charts that showed emissions from large developing countries are rising the fastest as they expand their economies. Developing countries said linking emissions to income growth would divert attention from the fact that historically, most emissions have come from the developed nations, which industrialized earlier. “This is the first step for developed countries of avoiding responsibilities and saying all countries have to assume the responsibility for climate change,” said Diego Pacheco, the head of Bolivia’s delegation in Berlin. In the end the charts were taken out of the summary, but would remain in the underlying report, which was to be published later in the week, officials said. Counting all emissions since the industrial revolution in the 18th century, the U.S. is the top carbon polluter. China’s current emissions are greater than those of the U.S. and rising quickly. China’s historical emissions are expected to overtake those of the U.S. in the next decade. The IPCC summary also refrained from detailed discussions on what level of financial transfers are needed to help developing countries shift to cleaner energy and adapt to climate change. Another IPCC report, released last month, warned that flooding, droughts and other climate impacts could have devastating effects on economies, agriculture and human health, particularly in developing countries.

What’s behind the rise in public transit in the U.S. in the last few years, and how does our transit use compare with that of other developed countries?

highest level in the U.S. in 57 years. According to data collected by the American Public Transportation Association (APTA), Americans took 10.7 billion trips on public transportation in 2013-the highest number since the 1950s when many fewer of us owned our own cars. And this increase “isn’t just a one-year blip,” says APTA. Since 1995-when Congress passed the landmark ISTEA legislation and other surface transportation bills that greatly increased funding for public transit-U.S. ridership has risen 37.2 percent, topping both population growth (up 20.3 percent) and vehicle miles traveled (up 22.7 percent). “There’s a fundamental shift going on,” says APTA’s president Michael Melaniphy. “More and more people are deciding that public transportation is a good option.” A number of factors are contributing to Americans’ embrace of transit in recent years. For one, the flow of federal dollars to transportation alternatives since 1995 has meant more options than ever are available to those leaving their cars behind: Melaniphy reports that in the last two years, upwards of 70 percent of transit tax initiatives have passed, providing lots more funding for beefing up transit projects coast-tocoast. Another factor is the economic recovery. “When more people are employed, public transportation ridership increases, since nearly 60 percent of the trips taken on public transportation are for work commutes,” says Melaniphy. “People in record numbers are demanding more public transit services and communities are benefiting with strong economic growth.”

Despite these gains, the U.S. still lags way behind other developed nations. In a recent issue of The Atlantic, Ralph Buehler cites 2010 statistics showing that, while Americans drive for 85 percent of their daily trips, Europeans opt for cars only 50-65 percent of the time. “Longer trip distances only partially explain the difference,” reports Buehler, adding that 30 percent of daily trips are shorter than a mile on both continents. “But of those under-one-mile trips, Americans drove almost 70 percent of the time, while Europeans made 70 percent of their short trips by bicycle, foot or public transportation.” The U.S. ranked last in the National Geographic Society’s Greendex survey of transit use across 17 developed nations. Only five percent of Americans surveyed reported using public transit on a daily basis and only seven percent reported using it at least once a week. Internationally, 25 percent of respondents reported daily public transportation use, with 41 percent using it at least once a week. According to Greendex, Canadians are more than twice as likely to report weekly or more transit usage than Americans, while Germans are almost five times more likely to use transit at least weekly. Russia topped the list with 52 percent of respondents using public transit daily and 23 percent using it at least once a week. Given America’s suburban sprawl-and the car-based infrastructure that has built up to support it-it’s hard to believe the U.S. will ever catch up with other developed countries in transit usage. But that won’t stop millions of forward-thinking Americans from trying. A witness video posted on TMZ.com shows Smith exchanging words with an officer as he was being handcuffed and escorted out of the gate area. With the arrest, Smith is involved in three pending criminal cases. “We are disappointed to learn of the incident today involving Aldon Smith,” 49ers general manager Trent Baalke said in a statement. “As this is a pending legal matter and we are still gathering the pertinent facts, we will have no further comment.” A fearsome pass-rushing specialist, Smith took a five-game leave of absence from the 49ers last season to undergo treatment for substance abuse. He rejoined the team Nov. 5. Smith played in a 27-7 home loss to the Indianapolis Colts on Sept. 22, two days after he was arrested and jailed on suspicion of DUI and marijuana possession. After the game, he publicly apologized for his behavior and later announced he would leave for treatment. Leading up to the playoffs in early January, Smith said during an interview with The Associated Press he was encouraged by the strides he had made to better himself off the football field that put life — and his work — in perspective. He said at the time he hadn’t had any alcohol since before his Sept. 20 DUI arrest, and that he wasn’t craving it. When he rejoined the team Nov. 5, he insisted he was on the path to lifelong sobriety stuck by that statement. His teammates rallied around him in support of his rehab and, later, his return to the team. Smith emerged as one of the NFL’s mostfeared pass rushers in 2012. He had a franchise-record 19.5 sacks that year, but failed to record a sack in his final six games including the team’s postseason Super Bowl run. Smith finished with 8? sacks and 34 tackles in 11 games last season, making eight starts. In November, Smith pleaded not guilty to three felony counts of illegal possession of an assault weapon, stemming from a June 2012 party at his home. Investigators say several shots were fired, two partygoers were injured and Smith was stabbed. In the subsequent investigation, prosecutors say detectives found five unregistered weapons in Smith’s house, including two Bushmaster rifles and an Armalite AR-10T. They say those are assault weapons illegal to possess

under California law. Smith and former teammate Delanie Walker were named in a lawsuit last September filed in Santa Clara County Superior Court by a Northern California man who said he was shot at a party at Smith’s house on June 29, 2012. The players charged a $10 admission and $5 per drink, the lawsuit said. Smith and now-Tennessee Titans tight end Walker were allegedly intoxicated on Smith’s balcony when they fired gunshots in the air while trying to end the party, the lawsuit said. Smith, selected seventh overall in the 2011 draft out of Missouri, had previously been arrested on suspicion of DUI in January 2012 in Miami shortly after the 49ers lost in the NFC championship game. This is the latest in a long list of legal issues for 49ers players the past two years — and recently, too. The Niners, who lost to the rival and eventual champion Seattle Seahawks in the NFC championship game, have made nearly as much news away from the field as they have in free agency this offseason. On Thursday, 49ers quarterback Colin Kaepernick was one of three NFL players named in a Miami police report involving a woman who passed out in a hotel and later woke up in a hospital not knowing how she got there, though no one has been charged with a crime. Kaepernick, 49ers wide receiver Quinton Patton and Seahawks wide receiver Ricardo Lockette — a former 49er — were with the woman at a Miami hotel where Lockette lives, according to the Miami Police Department report. The police say it’s too early to determine whether a crime was committed. Late last month in San Jose, 49ers cornerback Chris Culliver was arrested on suspicion of felony hit and run and reckless driving after he drove a car into a bicyclist and fled. He is the player who underwent sensitivity training after his anti-gay remarks leading up to the Super Bowl after the 2012 season. He has done outreach to the lesbian, gay, bisexual and transgender community. Last summer, another starting linebacker, Ahmad Brooks, was investigated by the Santa Clara County District Attorney’s office on allegations that Brooks repeatedly hit a teammate on the head with a beer bottle. No assault charges were filed because of insufficient evidence. According to police, Brooks hit thenteammate Lamar Divens with the bottle three times and then punched him in the face during an early morning argument June 8. Divens sustained a 3-inch cut on his forehead.

Farmers expect to get only a fraction — if any — of the water they need from vast government-controlled systems of canals and reservoirs interlacing the state. In an effort to make up the difference, they are drilling hundreds of feet deep to tap underground water supplies. Smittcamp said a licensed driller he often hires approached him, saying the demand for drillers is so high that Smittcamp needs his own full-scale drilling rig. Smittcamp, whose Wawona Packing Co. farms thousands of acres, said he has written a $150,000 check as a deposit and the rest is due upon delivery of the $1 million rig, which he expects to happen soon. He estimates that he spends $4,000 an acre tending his peach and grape crops before the harvest. If a well were to run dry mid-season with nobody to call, Smittcamp said he could lose that investment — and perhaps entire orchards or vineyards. When the rig isn’t being used on Smittcamp’s land, he said the driller will put it to work on neighboring farms to recoup the investment. The boom driving farmers to such lengths is a result of drought and a steadily improving economy, said John Hofer, an underground water consultant and executive director of the California Groundwater Association. Hofer said his consulting firm started receiving more calls last year, and that’s when he predicted the rising demand for drillers would follow. “I kept telling my friends and associates to look out, that it was going to get crazy, and it has,” he said. “Drilling is up big-time.” The figures prove it. In Fresno County, which leads the nation in agricultural production, officials issued 256 permits to dig new wells in the first three months of 2014, more than twice the number compared to the same time last year. That includes all types of water wells used for agriculture and homes. In Tulare County, the number of permits issued to dig farm wells alone has tripled to 245. In Kern County, farmers took out 63 new well permits in the first quarter of the year, more than quadrupling last year’s number. The price to dig a well depends on the depth and ground composition, drillers say, costing a farmer anywhere from $50,000 to $500,000 before installing the pumps. Tapping groundwater has other costs. The water that was deposited underground

naturally over thousands of years isn’t being replaced as rapidly as it’s being drawn, causing the ground in the Central Valley to sink in a process called subsidence. In California, there is little if any regulation of groundwater pumping by the state. In most years, Central Valley farmers draw one-third of their water from wells, while the remaining two-thirds comes from California’s State Water Project and the federal Central Valley Project. Most farmers expect to receive no water from either this summer, and that ratio is dramatically shifting to underground water supplies, which could eventually run dry. Matt Rottman, president of Rottman Drilling Co. based in Lancaster, said his midsized firm of three rigs is backlogged 15 months. For a recent job near Bakersfield, his crew dug a 1,840-foot well. Three wells coming up later this year in the Central Valley will hit depths of 2,000 feet. Farmers calling Rottman tell him they’re in a pinch. They don’t expect any water from the state and federal water projects this summer, and Rottman said the market price of buying irrigation water elsewhere has shot up three or four times. “They’re shut off,” he said. “They’ll be looking at crop damage if they don’t get wells in.” Mike Maggiora, owner of Gillroy-based Maggiora Bros. Drilling Inc. and president of the California Groundwater Association, said he suspects that some drillers are backlogged because farmers are calling several firms to see who responds first. He’s booked for the next three months. His eight crews work 24 hours a day for weeks drilling each well, which Maggiora said is a nice change from two years ago when the economy was bad and work was hard to find. Now, Maggiora said he has trouble finding workers willing to put in the grueling hours. He also fears today’s boom will cause a run on supplies, such as the steel casings used to keep the walls from caving in. So he’s ordering them by the truckload. Smittcamp said he worries that so much drilling could cause underground water supplies to run dry in little more than a decade. He blames politicians for failing to give farmers any other options, leaving them to fend for themselves. This summer, Smittcamp said he has to come up with two-thirds of his water that would normally come from the state and federal water deliveries. “This year, we get none out of the projects,” he said. “So we’ve got to pump the whole enchilada.”

CLAIMS FROM PAGE 1 Rhoades said. “(Another attorney) tells me that back in the ‘90s when the harassment law was first passed we had triple or quadruple the numbers we have now because we had a group of landlords that didn’t understand the law, didn’t know the law, didn’t know how we would enforces the law.” During the last fiscal year, 22 of the 38 cases were “misunderstandings,” Rhoades said — instances in which the law was misinterpreted by the tenant or, after a phone call or letter, investigators were satisfied that harassment wasn’t occurring. The remaining 16 cases were solved through “a series of phone calls, meetings, conferences in City Hall, discussions with the landlords and their attorneys, and with written settlement agreements,” Rhoades said. The current law is sufficient, Rhoades said, and the Consumer Protection Unit, of which he is a part, is well staffed. But some feel there is a disconnect somewhere in the process. Several tenants got up and spoke about aggressive unfounded evictions or landlords who refused to fix glaring problems with their apartments. Denise McGranahan, senior attorney at the Legal Aid Foundation of Los Angeles, said that the tenants genuinely feel there is a

lot of unaddressed harassment going on, particularly through what she called frivolous eviction cases. “Maybe people aren’t really spending enough time with them,” she said. “I’m not quite sure what it is. But it seems like there is harassment that is going on that is not being addressed.” Rent Control Board Chairman Todd Flora, and other board members, grilled Rhoades on specific policies. “I want you to know that one of the reasons we’re asking a lot of questions is because we’re really hearing a lot that’s going on out here and a lot of people would tell you that they don’t get the feeling there are a lot of resources,” Flora told Rhoades. “I’m hearing from people who feel they are being dissuaded from continuing to pursue matter.” “If it’s a new and growing problem that is surprising to me,” Rhoades responded. “I know there’s going to be a few folks not happy with our decision not to prosecute the landlord either in criminal court or civil court but the way you put it makes it sound like a new and growing and serious problem.” Rhoades promised to take everything he’d heard back to his colleagues. NTSB: No evidence of pre-impact fire in bus crash FENIT NIRAPPIL Associated Press

RED BLUFF, Calif. Federal investigators said Sunday that they haven’t found physical evidence confirming a witness’ claim that a FedEx truck was on fire before it slammed into a bus carrying high school students, killing 10 people in Northern California. National Transportation Safety Board member Mark Rosekind said investigators are not ruling out a pre-impact fire, but a fire expert did not find evidence of flames as the truck crossed a median, sideswiped a Nissan Altima and crashed into the bus. “This is all preliminary and factual information,” Rosekind said at a news conference. “We are not ruling anything out.” The bus was carrying 44 Southern California high school students to a free campus tour of Humboldt State University. Many were hoping to become the first in their families to attend college. Five students, three adult chaperones and both drivers died and dozens were injured in Thursday’s collision in Orland, a small city about 100 miles north of Sacramento. Bonnie Duran, who drove the Altima and survived with minor injuries, told investigators and reporters Saturday that she had seen flames emerging from the lower rear of the truck’s cab as it approached her car. The bus was gutted and the truck was a mangled mess after an explosion sent flames towering and black smoke billowing, making it difficult for investigators to track the source of the fire. Rosekind said a blood test of the FedEx truck driver could indicate whether he inhaled smoke before his death. A family member told the Sacramento Bee that the truck driver was Tim Evans, 32, of Elk Grove, Calif. On the day of the crash, the Sacramentobased driver delivered freight to Weed, Calif., and returned with an empty semi-trailer and a partially loaded semi-trailer, although investigators do not know the contents. The biggest questions for investigators include why the truck had left its lane and did not leave behind tire marks, suggesting the driver did not brake. The investigation will review maintenance records and the driver’s medical history, experience and potential impairment. The bus’ black box-style electronic control module was recovered and will be analyzed. The truck’s device was destroyed, but investigators will take other steps to analyze

its speed and maneuvering. Beyond the cause of the crash, the NTSB will examine if any of its safety recommendations could have reduced the death and injury toll. In this case, the transportation authorities are focusing on seatbelts, escape routes and fire safety, though it has no authority to enforce measures it recommends. This not only includes examining defects and mistakes, but also looking for what voluntary features and measures the companies involved used that can serve as lessons for future crashes. The bus was a brand-new 2014 model in operation for a month, and its owner, Silverado Stages, has a strong safety record. The victims included passengers who were thrown from the bus despite being voluntarily equipped with seatbelts. Under a rule long sought by Rosekind’s agency, all new motor coaches and some other large buses must include three-point lap-shoulder belts beginning November 2016. Regulators did not require existing buses add seatbelts because it would have been too expensive. Rosekind said it’s difficult to issue guidelines to enforce seatbelt use while they aren’t mandated. “In the absence of a flight attendant, the likelihood of anyone on a bus buckling is slim,” said Larry Hanley, president of Amalgamated Transit Union representing bus drivers and advocating for policies reducing driver fatigue. Bodies recovered from the bus were charred beyond recognition. The transportation board has also called for measures to detect and suppress fires and make buses less vulnerable to blazes after a 2005 bus fire killed 23 nursing-home evacuees escaping Hurricane Rita in Texas. Rosekind said investigators will examine the materials and design of the bus to withstand fires. Fire-suppression systems, now under study by the federal government, are designed with blazes that start in engines and wheels in mind. The systems, akin to a hand-held extinguisher automatically dousing the first embers and sparks, aren’t suited for massive blazes following collisions, said Joey Peoples, a vehicle fire safety expert for SP Fire Research. “Once you have a fire, it’s now simply a matter of how do we buy enough time to evacuate all the passengers,” Peoples said. Almost every window on the bus involved with Thursday’s crash was available as an emergency exit.
