Union pressures DoubleTree through Board of Ed BY DAVID MARK SIMPSON Daily Press Staff Writer

SMMUSD HDQRTRS What started as complaints from hotel workers about labor conditions at the DoubleTree Suites has led to an investigation into the hotel’s finances by the Santa Monica-Malibu Unified School District Board of Education. The district owns the land on which the DoubleTree sits and, while they have no proof of financial wrongdoing, the board has requested clarification on how certain lease payment calculations were made. The board’s scrutiny is the result of questions raised by Unite Here Local 11, a hospitality union. Unite Here led a protest at the DoubleTree earlier this year with 50 hotel employees who claim that they aren’t getting the two 10-minute breaks they’re entitled to during every shift. A hotel general manager told the Daily Press at the time that they were unaware that

this was occurring. It’s up to the workers to take their breaks, the general manager said. DoubleTree Suites is not a union hotel but Unite Here helped workers file official complaints with state and federal labor agencies. Investigations are ongoing. Union officials then turned to the district, which owns the land. The district is owed a monthly base rent that rises with inflation. The Procaccianti Group, which bought the hotel a few years ago, has always paid on time. The district is also entitled to 5 percent of the hotel’s net cash flow, which has a complex definition. From this provision, the district has never seen a penny. The net cash flow takes into account the hotel’s development and operating cost which, according to the hotel owners, has always exceeded revenues by tens of millions of dollars. Since the contract was signed in 1987, the hotel owners (there have been three) always reported this cash contribution to the district with little explanation as to how it’s been reached.

At the request of the board, district officials sent a letter to the hotel owners, asking for more information on the calculation. Many of the board members were dubious about this reported deficit given Santa Monica’s booming tourism industry ($1.63 billion generated last year). Dean Pappas, the district’s real estate attorney, explained that the lease could have been “better drafted.” It does not explicitly require the lessee to explain how it reached its final calculation, nor does it give the district the right to audit the lease. Pappas was not responsible for drafting the lease. Boardmember Ben Allen noted that the lessee should have to cooperate in explaining its calculation, even if the contract doesn’t specifically require it. The contract is up for an adjustment in 2021. Hotel workers, Santa Monica High School students, leaders from two school employee unions, clergy members, residents, and the incoming Parent Teacher

Association president spoke during the public comment portion of the item, asking the board to take action. Boardmember Laurie Leiberman recused herself from the discussion because her husband, an attorney, previously represented the hotel owners. Boardmembers Maria LeonVazquez, Ralph Mechur, Oscar de la Torre, and Ben Allen were direct in their opinion that the labor violation allegations, if true, are unacceptable for a district lessee. If the state or federal agencies do find that the hotel is violating labor laws, the hotel will have an opportunity to appeal. If they lose an appeal, they have 30 days to remedy the violations. Mechur suggested that future district contracts should require lessees to pay employees a living wage. On the issue of net cash flow, board members agreed to wait until their next meeting to consider taking action, allowing the hotel owners time to respond. dave@smdp.com

18th STREET There’s a new face at one of Santa Monica’s oldest churches. Pastor Scott Savage has formally taken the reins at the Church of the Nazarene, located at 18th and Washington, following the retirement of former pastor Clarence Crites. Crites served the community for 35 years and Savage said he also hoped for a long tenure. “I expect to be here for a while,” he said. “My approach as a pastor is to put down some roots.” The church is one of the oldest religious institutions in Santa Monica and a 1908 history text, “Ingersoll’s Century History Santa Monica Bay Cities,” lists the church as opening in 1906. The congregation has a history of working with the community including Crites’ significant work for the Santa Monica Police Department’s chaplaincy program. bers decide how they will practice their faith and develop wider connections to the neighborhood. “You can’t help your friends if you don’t know what’s going on,” he said. “I want to nurture the local area and I want us to be connected.” He said his hope is that the church will find its community service work radiating out but that he expects the initial focus to be in the immediate area. “I want us to be pretty mobile but you have to begin somewhere and I want us to begin at 18th and Washington,” he said. He said he hopes to bring in a diverse audience to the church that will spark interesting and meaningful discussion around important questions. “One thing that excites me about the church is I’m interested in people who want to have a different conversation about who God is,” he said. Schools launching special ed satisfaction survey

The Santa Monica-Malibu Unified School District is asking parents to participate in a Special Education Satisfaction Survey launching today, Monday, May 19. District leadership is seeking to measure stakeholder satisfaction with special education programs and services. Designed and administered by independent technology and communications firm K12 Insight, the survey focuses on topics such as parent involvement and relationships, communication, and processes and procedures, among others. “Our goal is to provide our students with a high-quality education that empowers them to be successful in college and/or career,” said Sandra Lyon, superintendent of SMMUSD. “This survey allows us to assess our special education programs and services to ensure that we are effectively meeting student needs.” Parents who have provided the district with their email addresses will receive invitations to participate. The survey will also be accessible to parents via the district website at www.smmusd.org. In the interest of privacy, candor and widespread participation, all survey responses are confidential and anonymous to district staff. Results will only be delivered collectively, with no individual data or identifying information in any report. Once the survey has closed on Friday, May 30, the district will share results with the community, along with an explanation of how it will use the data to make any necessary improvements to the special education program. “As we work to foster a culture of transparency, trust and collaboration, listening and responding to our stakeholders is crucial,” Lyon said. “Together, we will provide our special needs learners with the social, emotional and physical support they need to live rich and fulfilling lives.” — MATTHEW HALL

‘Godzilla’ opens with smashing $93.2 million JESSICA HERNDON AP Film Writer

LOS ANGELES “Godzilla” has smashed its way to the top of the box office. The 3-D monster movie from Warner Bros. and Legendary Pictures had the second-largest debut of the year this weekend with $93.2 million, according to studio estimates Sunday. “Godzilla” trails Disney-Marvel’s “Captain America: The Winter Soldier,” which opened with $95 million in April, and sits just above “The Amazing Spider-Man 2,” which debuted with $91.6 million this month. Paying homage to the 60-year-old franchise in tone and spectacle, the latest iteration continues the legend of 1954 Japanese original — Ishiro Honda’s “Gojira.” Reviews of the film were positive — it earned a “fresh” rating from review aggregator RottenTomatoes.com, with 72 percent of film critics responding positively. Legendary Pictures President Jon Jashni said the film did better than expected partly because it was “starting to get sampled even by those who didn’t think it would necessarily be for them. They didn’t have nostalgic feelings for it.” He said friends or family members likely recommended the movie to those viewers. Jashni added that the success of “Godzilla” is “validating” after last year’s “Pacific Rim” and “Jack the Giant Slayer” performed below expectations for the Warner-Legendary team. The film, directed by Gareth Edwards, also helped eliminate the bad memory of another of the franchise’s remakes, Roland Emmerich’s “Godzilla,” released in 1998 and starring Matthew Broderick. Backed by Sony, the film opened with

$44 million. Two other reboots — “Godzilla 1985” and “Godzilla 2000” — also flopped. May is prime real estate for studios looking to launch or advance franchises. The top two opening weekends of all time in North America occurred in May — “The Avengers” opened with $207.4 million in 2012 and “Iron Man 3” debuted with $174.1 million in 2013. “Godzilla,” starring Bryan Cranston, Aaron TaylorJohnson and Elizabeth Olsen, marks the largest May opening ever for Warner. It’s also the year’s biggest opening for Imax globally. It generated $103 million and 14.35 million admissions from 16,946 screens in 64 markets outside the U.S. and Canada. “Godzilla” knocked last weekend’s No. 1 hit, Universal Pictures “Neighbors,” down to No. 2 in its second weekend. The raunchy Seth Rogen and Zac Efron-led comedy earned $26 million, bringing its domestic total to $91.5 million. Rounding out the top three was “The Amazing SpiderMan 2,” with $17 million. So far it’s earned a total of $172 million domestically. Also opening this weekend was Disney’s feel-good sports drama “Million Dollar Arm,” starring Jon Hamm, which landed at No. 4 with $11 million. “The summer is about having a diverse lineup, and this film will have legs,” said Paul Dergarabedian, senior media analyst for box-office tracker Rentrak. “If superheroes and monsters aren’t your pleasure, you can go see a more character-driven sports movie.” In its fourth weekend, Fox’s femme-fueled comedy “The Other Woman,” starring Cameron Diaz, Leslie Mann and Kate Upton, gained $6.3 million, bringing its domestic total to $72 million.

Thanks to the first responders Editor:

As a resident of 850 Second St. in Santa Monica, I wanted to express my deep appreciation for the first responders, especially the Santa Monica Fire Department and police for the quick and decisive actions beginning on the evening of May 15 in response to the transformer explosion and subsequent fire at that location. The fire that could have easily engulfed our building was heroically and I might add so professionally extinguished. Our fire fighters were ably aided by units from Los Angeles and I am told from Beverly Hills. Sadly to say, a few of my neighbors did not fare so well as I and their units were severely damaged. Fortunately, it appears that no one was injured badly enough to warrant hospitalization and the emergency medical professionals were on hand for them. Throughout the events of that night, the evacuation and the fighting of the fire, these brave professionals acted with sensitivity and caring as regards to the needs and desires of us as the residents. I especially want to commend the person, responder or neighbor, who went door to door literally thumping a warning to us all of the danger and the need to get out when the normal alarm system failed. Over the years in this area, I have experienced several of these transformer explosions and perhaps I, personally, have become complacent and would have dismissed this as just another power failure except for the thumping on my door. Please accept my heartfelt thanks and commendation.

Residents a power to be reckoned with THE RESIDENTS OF SANTA MONICA

achieved a major victory last Tuesday when City Council repealed their previously approved development agreement for a proposed 765,000-square-foot mixed-use project called the Bergamot Transit Village. The Olympic Boulevard development, in the pipeline for over seven years, has been universally disliked by residents who hated its size and appearance, density, height and inevitable contribution to already congested traffic from the get-go. Houston, Texas mega-developer Hines had made some changes over time — reducing the original project’s size, mix of housing and office uses — but it wasn’t nearly enough. When council gave its approval to the project in February, citizens rallied around Armen Melkonians and his Residocracy.org group and were circulating petitions to recall the project just hours after council’s controversial vote. Nineteen days later, petitioners had gathered well over the 6,500 valid voter signatures needed to force council to either rescind its vote on the development agreement of put it on the ballot for voters to decide on upholding or repealing the project. Tuesday evening, council voted to rescind their support for the project. Voting for repeal were Kevin McKeown, Tony Vazquez and Ted Winterer, who were the minority council members who also voted against approving the development agreement in February. Now, here’s where it gets interesting: Gleam Davis who has been consistently pro-development and voted to approve the project in February, voted Tuesday to rescind the development agreement she previously supported. Bob Holbrook and Mayor Pam O’Connor, who are also consistent prodevelopment votes on council, abstained on the Hines development agreement. Terry O’Day, also a pro-development supporter, voted against rescinding the vote, preferring instead to put it on the November ballot. It should be noted that O’Day, O’Connor, Holbrook and Davis have been recipients of developer campaign money in past elections. In 2008, developers and real estate interests raised $800,000 to defeat Measure T (also known as RIFT) which would have capped commercial development in Santa Monica for 13 years. Terry O’Day and Santa Monicans for Renters’ Rights (SMRR) honcho, Judy Abdo co-chaired the anti-T committee that was the recipient of major developer largess. T was narrowly defeated in that year’s election. If the Hines agreement were put on the November ballot, it would have been interesting to see how much money — and how many lies — Hines and other developers would have expended on trying to convince voters to oppose rescinding the agreement. Today, voters, especially with Residocracy.org, are much more aware of development issues than voters in 2008. I doubt that this year even a million dollar

plus campaign to save the Hines development would be successful if it were placed on the ballot. Bob Holbrook was upset at the “nasty” and vitriolic communications he had received from those supporting the Hines repeal. While there’s no excuse for rudeness, I’m finding that councilperson’s complaints about uncivil e-mails is a little boring, especially when they make decisions they know will be clearly unpopular with a stirred-up public. We, the people, have been discounted over the years when it comes to development, traffic and other issues. It took a public uprising and 13,500 signatures to overrule City Hall politicians who have chosen to pursue their own unpopular agenda. The people are angry and I’m angry. We’re tired of being ignored, excused and fluffed off. If that’s not acceptable to someone on council — or a council-appointed commission — they can step down or be removed from office. Speaking of City Hall’s response to the citizens, it’s pretty obvious that developers, their land-use attorneys and especially their lobbyists seem to have a louder voice and greater influence on city policy and decisions than any and all groups of residents combined. I had written in this space about City Hall’s most high profile lobbyist Kim Karie of the Kim Karie Group (“Skullduggery at City Hall”, May 5, page 4). I mentioned that the influential Karie with her access to developer checkbooks was a regular fixture in City Hall and at various community meetings were developments were presented and discussed. Wasn’t I surprised when I found out that the Karie Group, whose offices are on Neilson Way in Ocean Park, did not have a Santa Monica business license. I investigated and found out that the Karie firm was last licensed in 2006 but has not registered or paid any business taxes since then. The good folks in the city’s business licensing department tell me she recently applied to renew her business license and the application (as of a few days ago) was pending. It is likely that Karie will be granted a renewal and probably have to pay back business taxes as well as penalties that could equal an additional 100 percent of business tax owed for the seven years (2007 through 2013). I and others will be following up to see if Karie uses her political clout or calls in favors to negotiate a special tax break involving reducing the amount of money and penalties she owes to City Hall. Karie’s clients are a virtual roster of every developer who had, or has, a pending project in Santa Monica as well as a couple local businesses and non-profits such as Bubba-Gump Shrimp Company and Saint John’s Health Center, the latter of which was embroiled in a parking garage controversy a couple of years ago that Karie helped to diffuse for the center’s financial benefit. of the synthetic compound Bisphenol A (BPA) in our bloodstreams, so it’s no wonder that public health advocates are concerned about its potential effects. Developed in the 1950s to strengthen plastics and epoxy resins, BPA is today used in a wide range of products, including many plastic food and drink containers, the lining of most cans, some paper products, and dental sealants. But with widespread use of BPA has come increased scrutiny regarding its potential impact on human health. When ingested, BPA mimics naturally occurring human hormones and thus can potentially interfere with the body’s endocrine and reproductive workings. According to the nonprofit Breast Cancer Fund, previous research has linked BPA exposure to with increased risk for cardiovascular disease, miscarriages, decreased birth weight at term, breast and prostate cancer, reproductive and sexual dysfunctions, altered immune system activity, metabolic problems and diabetes in adults, and cognitive and behavioral development in young children. These concerns have led the European Union, Canada-and more recently the U.S.-to ban the use of BPA in baby bottles and other items geared toward babies and children. Meanwhile, the U.S. Food & Drug Administration (FDA) maintains that typical low-level BPA exposure does not pose any health risk. A February 2014 study by FDA researchers found that low doses of the compound did not affect the health of rats over a 90-day study period. While study rats exposed to higher doses of BPA had lower body weights, abnormal female reproductive

development and altered hormone levels, there were no such effects in rats exposed to lower doses more akin to what humans experience. But critics point out some flaws in that study which call its conclusions into question. For one, a control group of rats that was supposed to remain unexposed to BPA somehow had levels of the compound in their blood equivalent to the lowest-dose study population. FDA researchers maintain that this contamination of the control group did not affect their results because neither group of rats showed any effects given their low-dose exposure. Another issue is that the researchers did not look at neurological effects such as changes in learning, memory and behavior. “What needs to follow is whether these exposures are causing neurobehavioral changes,” Harvard epidemiologist Joe Braun told Environmental Health News, adding that previous research has shown that estrogen receptors in the brains of rats were triggered by low doses of BPA. “Hopefully [the FDA] will address that down the road.” More research is underway still. The February 2014 FDA study is part of an ongoing two-year assessment of the toxicity of BPA. Dozens of university studies are also in progress to shed more light on just how risky our use of BPA may be. Consumers should continue to take precautions to limit their intake of BPA by avoiding polycarbonate plastic food and drink containers and metal cans, and by refraining from putting plastic items in the microwave-a process that can expedite the leaching of BPA into food.

Obama eyeing San Antonio mayor for housing chief JULIE PACE EMILY SCHMALL Associated Press

WASHINGTON President Barack Obama is considering nominating San Antonio Mayor Julian Castro, a rising star in the Democratic Party, to head the Department of Housing and Urban Development, according to people familiar with the selection process. Tapping the 39-year-old Castro for the Cabinet post would raise the national profile of the three-term mayor who has been discussed as a possible vice presidential pick in 2016, particularly if Hillary Rodham Clinton runs. If Castro is nominated and then confirmed by the Senate, he would become one of the highest-ranking Hispanic officials in the Obama administration. Castro’s stock in Democratic circles has been on the rise since he delivered the keynote address at the 2012 Democratic National Convention. He and his twin brother, Rep. Joaquin Castro, D-Texas, have become highly sought speakers on the fundraising circuit. Castro would succeed Shaun Donovan, a

member of Obama’s original Cabinet who is well-liked by the White House. It’s unclear whether Donovan will remain in the administration. An aide to Joaquin Castro said Julian Castro has expressed interest in the housing job and does plan to take the position if it is offered. The aide cited the mayor’s work on San Antonio’s “Promise Zone” as part of his qualification for the post. HUD plays a lead role in overseeing the “Promise Zone” initiative, which aims to revitalize high-poverty communities by increasing economic activity, improving educational opportunities and leveraging private capital. San Antonio was among the first cities that received a grant for the program from the administration. The aide spoke on anonymity because they were not authorized to discuss the situation ahead of an official announcement from the White House. Others familiar with the selection process also insisted on anonymity because they were not authorized to discuss it by name. The White House and Castro’s office would not confirm that the mayor was under consideration.
