Revenue and spending take center stage at the June 28 Council meeting but development and zoning are still part of the agenda. Council will approve several contracts in the consent calendar, hear proposals for potential bonds or tax increases, modify purchasing rules, tweak zoning regulations and direct staff to come back for a future discussion on a ballot measure that could compete with the Land Use Voter Empowerment initiative.

The consent calendar contains multiple items that are considered routine, have already been discussed once or are otherwise lacking in controversy. Items of interest this week on the 15 item calendar include a $119,172 contract for restoring the Chain Reaction statue outside the Santa Monica Civic Auditorium, a $400,000 five year contract for Business License Tax audit/compliance services and a $175,000 modification to an existing contract with RAND Corporation for the production of the second Local

Wellbeing Index. The first ordinance for discussion Tuesday continues a recent trend of tweaking zoning rules. Following the large-scale revisions to zoning rules last year, staff have complied a list of errors that need fixing. A majority of the fixes were relatively easy and had no real impact on the rules. Interstate Hotels & Resorts has named Todd Cahill as the general manager and Karen Filson as director of sales of Hampton Inn & Suites by Hilton Los Angeles/Santa Monica. The under-construction hotel is scheduled to open in October 2016 and is owned by Palmetto Hospitality of Santa Monica, LLC and managed by Interstate Hotels & Resorts. potential to alter the way the rules are enforced. Staff are returning this week with four issue that require Council direction including: applicability of Active Commercial Design and Active Commercial Use requirements in mixed-use and commercial districts, requirements for enclosed garages in the R-1 zone, requirements for front setbacks in the OP3 zone, requirements for Maximum First Story Street Wall Height in the OF zone. Staff are recommending that the Active Design/Use rules be clarified to prevent retail uses from becoming non-active uses (such as office), require off street parking for single family homes be in an enclosed garage, preserve required setbacks at 20 feet with some allowable setbacks at 15 feet and provide clarity on how to apply the upper-story setback requirement. Planning Commission has already heard and approved the proposals. The second ordinance revises the city’s purchasing rules. According to staff, Santa Monica’s commitments to sustainable and cutting edge practices put its purchasing needs are ahead of the general market resulting in only one or two companies bidding for city servic-

The Grapes of Wrath at Santa Monica Public Library As part of its ongoing Adult Summer Reading series, Santa Monica Public Library is pleased to present a live reading of The Grapes of Wrath by the Santa Monica Rep. A 1988 stage adaptation by Frank Galati of John Steinbeck’s Pulitzer Prize-winning novel, the play will be performed on Saturday, July 9, at 2 p.m. in the Main Library’s Martin Luther King, Jr.

A series of revisions are proposed to widen the potential bidder pool including moving to an all digital system, repealing prohibitions on doing business with Arizona based companies, shortening the protest procedures, centralizing purchasing authority and pursuing better coordination among agencies. Two administrative items will be before the council regarding funding. Council will consider support for a voter-approved bond floated by Santa Monica College. Staff are recommending the city support the bond and work with SMC to define terms and assess future agreements between the two agencies. Council will also discuss a City sponsored ballot measure that would fund affordable housing. Options for discussion include general obligation bonds, Transient Occupancy Tax, Sales Tax, Real Property Transfer Tax, Parking Tax, Utility User Tax or A Parcel Tax. “Staff seeks Council direction on which options, if any, merit further research and evaluation,” said the report. Council will hold a second hearing on modifying its anti-corruption laws. The City previously discussed revisions to the rules and some of those proposals will require voter approval. The proposed modifying language will be up for discussion and public feedback. “If approved by the voters, they would: expand the scope of the Oaks Initiative’s pro-

hibition to include those receiving public benefits; clarify the initiative’s application by defining the term “public official”; exempt persons providing uncompensated, volunteer services to some nonprofits; state that the initiative’s prohibition applies outside the City limits; specify enforcement procedures; and clarify that remedies are cumulative. At least for now, staff continues to recommend against modifying the Oaks Initiative to reach back in time for the reasons discussed at the last Council meeting,” said the staff report. The meeting will conclude with a request by Mayor Vazquez and Councilmember Himmelrich that staff return at a future meeting to discuss a potential ballot measure that would provide “voter-approval as a requirement before large-scale development.” A discussion of the potential measure’s language will not happen Tuesday as the agendized request is to have a formal discussion at a future meeting. Council recently asked for a study of the Land Use Voter Empowerment initiative that would require voter approval for developments above 32 feet, all development agreements and major revisions to the zoning rules. LUVE will be on the November ballot and the language of the Vazquez/Himmelrich request suggests an interest in a City sponsored alternative.

I was shocked by the front-page article on salaries for Santa Monica employees (“Overtime looms large,” June 23). I am quite sure that most Santa Monicans shared my outrage at this use of our taxes. One example alone will suffice to tell this appalling story: the salary and benefits of Police Chief Jacqueline Seabrooks. The article reported that Chief Seabooks’ salary and benefits totaled $478,120 for 2015. You might be interested to know that Police Chief Charlie Beck of the Los Angeles Police Department (LAPD) earned $364,537.52 in salary and benefits for 2015 (this information is also from Transparent California). The LAPD has more than 9,800 sworn officers and 3,000 civilian employees and has a budget of over $1 billion. Let us compare city sizes: Los Angeles covers 472 square miles and has an estimated 2016 population of 4 million people. Santa Monica, on the other hand, covers 8.5 square miles and has a population of something over 90,000 people. Perhaps if Beck were to have been offered a 25-percent increase as an inducement, he would have been tempted to come to Santa Monica as our police chief and leave behind the troubles of Los Angeles. But even at a 25percent increase in salary and benefits, he would still not make what Chief Seabrooks makes right now. When Bill Bratton (once Police Chief of Los Angeles) was appointed Police Commissioner for the City of New York in 2014, his pay was reported to be $205,180. Perhaps we could have enticed Mr. Bratton to come to Santa Monica? I am not in any way suggesting that Chief Seabrooks and her highly paid staff are not doing a good job. Nor am I suggesting that our highly paid firemen are not doing a valuable and demanding job. What I am doing is simply suggesting that these salaries are out of line with reality. Something is rotten here in Santa Monica, and the smell leads back directly to the Santa Monica City Council, which approved these salaries.

Study reveals schools in crisis on every level A NUMBER OF SERIOUS, ONGOING ISSUES

have plagued the Santa Monica-Malibu Unified School District for decades. One of those has been the “achievement gap” -— a term stating that demographically white (Caucasian) and Asian students do better academically than students of color. The “gap” also exists along socioeconomic lines and parallels the racial disparities. There has been an extraordinary amount of lip service regarding fixing the gap and achieving equality in educational access for all students. However, talk is cheap and coming up with a comprehensive plan to define and address the elements contributing to the inequality problem has so far proven impossible for the SMMUSD Board of Education. One solution to creating an equal playing field was to implement centralized fundraising. The board would determine the programs to be funded and allocate spending, thus eliminating donations to specific schools, activities, programs and projects and leveling the playing field. The centralized fundraising model was controversial, and many donors and fundraising groups such as PTAs either cut back or stopped raising funds. In order to provide a better, equal and more effective education to its 11,000-plus students, SMMUSD hired noted educator Pedro Noguera last summer to analyze the district from top to bottom and fix the problems. The school board and Noguera are now in the process of reviewing the issues, outlining goals and determining how to best measure progress. According to Noguera, frequent changes in administrative leadership has resulted in a degradation of the educational experience in the SMMUSD. Case in point: Current Superintendent Sandra Lyon, who was tapped as the district’s new leader in 2011, recently announced that she is leaving the district. According to the Santa Monica Daily Press (“Cautious optimism for SMMUD equity plan,” June 21), Noguera claimed that the district’s history of racial tension has fostered feelings of distrust and marginalization among parents, students and staff. He also mentioned inconsistent training, ineffective buy-in on the part of site leaders and staff and less-than-ideal patterns of communication. “Those factors,” Noguera said, “have contributed to the failure of previous initiatives to close achievement gaps.” Noguera criticized working relationships. “There are way too many cases of teachers working in isolation,” he said. “Some of your best teachers are not a resource for the others.” Noguera’s statement supports the ongoing disconnect between district and site leadership and a need for improved professional development. Distractions have kept the district from addressing inequity. The possible separation of Malibu and Santa Monica into two autonomous districts is a “significant distraction from a clear focus on student needs.” The Board of Education has seriously dropped the ball. I became aware of the mis-

management issues close to two decades ago, when the board initiated a parcel tax ballot measure to pay for staff and faculty raises they had approved but couldn’t fund. Then there were the gag orders, athletic coach stumbles and a whole litany of misfires. Noguera’s report was equally damning. Again, it confirms that the “persistence and pervasive” nature of the socioeconomic fracture suggests schools in SMMUSD are unclear about how to meet the educational needs of minority and socioeconomically disadvantaged students.” A similar study of the district’s 16 schools was conducted by UCLA nine years ago, and little progress had been made since then, Noguera said. None of this is new. In July 2001 a report by Michael D. Rich, RAND vice president and chairman of the district’s Financial Oversight Committee, came up with a set of fiscal recommendations that included improving financial planning and management, conducting a “best practices” audit, budgeting labor related costs, strengthening revenue flows and assessing future facility needs among other suggestions. Rich said at the time that the school board members had serious shortcomings in their ability to handle money. The problems have only deepened. “Teachers are working a lot in isolation, they’re not collaborating a whole lot and frankly, we saw a lot of students who were not thoroughly engaged,” Noguera said. Administrative appointments, including those of board-approved superintendents, seem to be based more on a candidate’s social engineering philosophy, political leanings or cronyism rather than being able to effectively manage a $100-million academic, nonprofit learning institution. With three board seats up for grabs, Santa Monica and Malibu voters have a great opportunity to clean house and put some competent and invigorated overseers in place. Dr. Jose Escarce has announced he’s retiring. Escarce is a huge advocate of bringing in non-resident permit students whose cost to educate was not fully covered by the California education subsidies — it’s the reason we pay high school parcel and sales taxes. To make up the difference. Ralph Mechur says he’s running again. He was voted off the board a couple of years ago, but when an opening turned up after Ben Allen resigned to take a State Senate seat, Mechur was appointed to the board by his Renter’s Rights cronies to serve out Allen’s term. The problem is that Mechur lacks leadership, as does Maria LeonVazquez, another longtime board member whose claim every election cycle that “helped close the achievement gap” isn’t supported by the facts. Our schools are run incompetently and inefficiently by a bunch of glad-handers and social cliques out to maintain power, control their own turf, toot their own horns and reward cronies. non-profit Ocean Mammal Institute would like the UN to endorse a “precautionary approach” limiting all sources of intense underwater anthropogenic sound and requiring individual nations to follow suit accordingly. “The precautionary principle should be applied publicly and transparently to noise generated for military, commercial and scientific purposes,” reports OMI. “In many cases, there are alternatives and realistic mitigation scenarios for reducing and eliminating very loud human-generated noise from the marine environment, including employing improved passive sonar devices, using reduced noise energy, mechanical and operational designs that minimize noise, alternative energy sources, etc.” Given the Convention on the Law of the Sea’s lack of “teeth” on monitoring and enforcement on the issue, the United States has started taking matters into its own hands to address underwater noise pollution in its own territorial waters and beyond. The Obama administration recently called for more scientific research to fully understand the ecological impact of underwater noise, and directed the National Oceanic and Atmospheric Administration (NOAA) to step up efforts to track and monitor volume levels below the surface. NOAA is also working on tools that the public, corporations and military can use to assess and help mitigate noise-making activities, and has initiated a campaign to raise public awareness on the issue. While ocean wildlife activists say much more needs to be done to start solving this insidious problem, at least the U.S. is taking steps in the right direction even if the rest of the world continues to ignore the noisy threats lurking below the depths.

For us land-dwellers, underwater noise rarely reaches our ears. However, marine organisms can be very sensitive to undersea sounds, particularly unnatural noise. Human activity-from explosives to underwater construction to ship traffic to oceanographic research-creates intense noise that threatens the health of ocean wildlife. Direct effects include hearing loss, habitat displacement, and even brain hemorrhages. The noise impedes the senses that enable many marine species to coordinate their movements and find food, and can also interfere with breeding cycles and migration patterns. This cacophony of underwater noise pollution puts additional stresses on marine ecosystems already on the ropes due to overfishing, pollution and myriad other human threats. Of particular concern lately to environmentalists is underwater noise pollution from seismic testing, where resource extraction industries use air guns to map the seafloor to look for potential oil and gas reservoirs. “From the water’s surface, the gun generates a blast of sound that penetrates the ocean floor then bounces back up to a receiver, relaying data about the layers of sediment, rocks, and potential fuel deposits below,” reports the Pew Charitable Trusts. “There is concern that the intensity of seismic sounds and their large spatial coverage may lead to injury, disturbance or displacement of marine animals or a masking of their communication.” While the United Nations (UN) Convention on the Law of the Sea forbids pollution that can damage marine wildlife, a lack of enforcement abilities means corporations and the military can continue to carry out many noisy undersea operations. Report: It’s harder to know who’s paying for political ads GEOFF MULVIHILL Associated Press

It’s getting harder to know who is funding political advertising at the state level as more money becomes anonymous or is filtered from one political action committee to another, a new study finds. In 2014, the last year in which statewide elections were widespread across the country, only 29 cents of every $1 of independent political spending could be tracked easily to its original individual donor, according to the Brennan Center for Justice at the New York University School of Law. The center found that dark money and what it calls “gray” money are rising even faster in state elections than in federal races. In places where the costs of elections can be cheaper because word is distributed by direct mail rather than television ads, the spending can have a larger impact. “Dark money can outspend all,” said Larry Norden, deputy director of the Brennan Center’s program on democracy. Dark money comes from nonprofit advocacy groups that spend on political purposes but are not subject to campaign finance disclosures. Its rise is one of the effects of the U.S. Supreme Court’s 2010 Citizens United ruling, which removed caps on how much corporations, unions and interest groups can spend on advocacy communications that do not specifically call for the election or defeat of candidates. That category of spending grew from less than $600,000 in 2006 to nearly $22 million in 2014 in the states the study evaluated. Despite that rise, the majority of state political spending overall remains from traditional channels where most large contributions must be disclosed: candidates’ official committees and party organizations. One election with heavy dark money spending was the 2014 Arizona race for two seats on the Public Utilities Commission, which was in the throes of a debate over solar power policy. More than $3 million in dark money poured into that race through social welfare nonprofit groups that in turn donated to PACs that made independent expenditures. That was up from just $3,000 in total outside spending in a similar race in 2008 - and all the money at that time was linked to specific donors. Some of the 2014 money came from the Arizona Public Service Company, the state’s biggest utility, but the company has not dis-

closed how much. There has been litigation since then over whether the public has a right to know how much the company funded. A utility spokeswoman did not return a call. That election is a prime reason Arizona fast became a hub of dark money. In 2006, there was just $35,000 involved in state races. In 2014, it was over $10 million. The Brennan study was limited to California, the most populous state, along with Arizona and four others: Alaska, Colorado, Maine and Massachusetts. They were among only nine that had statewide elections in the study years of 2006, 2010 and 2014 and collected enough data on political spending by outside groups to do the analysis. The authors said they did not have enough time to delve into all nine states, so they chose the first six alphabetically. James Bopp Jr., a conservative Indiana lawyer who has pushed for political contributions to be equated with speech, says the Brennan analysis is misleading. Many states require advocacy groups to report individual donors who specify that their contributions be used for political purposes. Donors who make general gifts, he said, don’t determine whether it will be used in political ads. “It would be unfair to attribute that spending to any of your donors,” Bopp said. The Brennan authors said they were surprised not by the growth of dark money but rather by what they called gray money. It happens when a super PAC, which is supposed to be independent of a candidate’s campaign organization, takes contributions from other PACs. While all the committees are required to report the source of their funding, it takes digging through multiple reports to find out where the money originates. That category of spending was far larger than the fully dark money in the six states. It was $42 million in 2006 and tripled to $129 million in 2014. In California, the report found, strict state reporting requirements and tough enforcement meant there was not a surge in dark or gray money like there was elsewhere. Amounts of both were lower there in 2014 than four years earlier. But the report said voters still did not know who was behind political ads before Election Day in some cases. The Brennan Center is calling for more disclosure requirements, including mandating that donors be made public before elections.

voters in the November elections, but the school board authorized Superintendent Sandra Lyon to write a letter to City Manager Rick Cole stating the board’s backing of such a measure. The potential tax would support affordable housing and education, city Housing and Economic Development director Andy Agle said. No official ballot language had been developed yet, but City Council is expected to provide input on the affordable housing component and district officials will offer recommendations for the schools wording. The impetus for the possible transaction and use tax, Agle said, was the combination of market conditions and Ellis Act evictions that have had dramatic effects on Santa Monica’s housing supply. “We’ve been struggling to do what we can,” he said. Agle said polling has indicated support for such a tax, which could raise upwards of $16 million annually for the City and the school district. Polling results will be presented to City Council on Tuesday, he said. After Lyon learned that City officials were considering asking voters for a tax increase, she organized a committee to explore how local schools could benefit. Lyon said fluctuating state revenues make education funding difficult and added that a local tax would provide some stability, whether it supports maintenance, technological upgrades, preschool or other programs.

Hopefully this can pass.” Shari Davis, a school funding advocate who has served as co-chair of Community for Excellent Public Schools and worked on the city’s Measure Y and Measure YY campaigns in 2010, noted the impact those dollars have made on schools. She said she believes another local tax can have similar benefits, lamenting that the state does not adequately fund education. “I see this as an opportunity for resources that will contribute to the high quality of our education in the community,” said Davis, who is also involved in the effort to pass a $295-million bond measure for expansion and improvement projects at Santa Monica College. “We’ve created a unique environment of collaboration between the district, the city and SMC that’s been nurtured and cultivated over the years. This would further that.” Iao Katagiri, a community relations director for RAND Corporation and a member of the city’s child care and early education task force, discussed the potential for future initiatives in local schools. Mudd College in Claremont, was honored as the top student in the graduating Class of 2016 during commencement ceremonies earlier this month. “It wasn’t explicitly a goal and I wasn’t expecting it, but it’s nice to be recognized for the work I’ve put into academics,” he said. “I was more proud that there were 23 other candidates who were just as deserving. It shows how strong Samohi is as a whole.” The school’s cohort of 24 valedictorian candidates, all of whom had perfect 4.0 grade-point averages, also included Ferrarin’s twin sister, Gianna. And Ferrarin’s designation deepened another family tradition of scholastic prominence, as his father was valedictorian of Crawford High School in San Diego in 1973. Accepted at several larger research institutions like Northwestern and Johns Hopkins, Ferrarin sees Harvey Mudd as a place where it’ll be easier to develop relationships with professors. He also felt encouraged to explore STEM subjects and liberal arts disciplines simultaneously. “At Harvey Mudd there was this community of collaboration,” he said, “and I prefer that to some more competitive schools.” Harvey Mudd is still plenty prestigious, though, as evidenced by the fact that valedictorians and salutatorians made up 27 percent of its freshman class last year. The college has roughly 800 total undergraduate students. Ferrarin plans to study electrical engi-

neering, a field that combines his interests in math and science. Its connections to neuroscience pique his curiosity. “The brain is pretty similar to a computer, and I think if you analyze it in that context you can discover some new innovations about it,” he said. “Computers are getting more and more powerful.” Ferrarin, who attended Roosevelt Elementary and Lincoln Middle schools before starting at Samohi, credited Advanced Placement physics teacher Rebecca Yaghoubian with nurturing his love of science and its real-world applications. But Ferrarin made sure to branch out. He took 12 different AP classes during high school while climbing the ranks to principal violist in the symphony and chamber orchestras. “It was a lot of time, long rehearsals and a lot of gigs on weekends and after school,” said Ferrarin, who was also a member of the Delians honor society and treasurer of the campus Habitat for Humanity club while making time for karate lessons after school.“But it gave me a sense of community and belonging.” College will probably be odd at first for Ferrarin and his twin sister, who is heading to the University of Pennsylvania to study cognitive science. She played saxophone in the Samohi band and overlapped with Ferrarin throughout high school. “It was unique having someone who’s your age taking some of the same classes and living in the same home,” Ferrarin said. “We’re going to be separated for the first time.”

ON JUNE 11 AT ABOUT 7:12 A.M. Officers responded to radio call regarding a battery at Café Bellago, 1400 3rd St., where a suspect attempted to enter the kitchen area of the establishment. The victim, an employee, told the suspect he could not enter. The suspect became upset and struck the victim in the face with a closed fist. The suspect fled the location. At 8:03 a.m., SMPD personnel observed the suspect on the Santa Monica Pier ramp. Officers attempted to detain the suspect, who ran from officers. Officers were able to detain the suspect at Appian Way and Pacific Terrace without incident. The victim was desirous of prosecution. Uari Profeta, 21, homeless, was arrested and booked on charges of battery and resisting arrest. Bail was set at $20,000.
