UCLA Six years ago, a Santa Monica library teen publication featured a poem called “Manhood” by

Nikan Namiri. “Tomorrow is the day I graduate, the day I will come alive,” the young author wrote. And that tomorrow has arrived. Namiri recently graduated from Santa Monica High School, and he’s looking forward to starting his college career at UCLA. Namiri, who was honored as salutatorian in the high school’s Class of 2015, is one of 678 graduates this year and one of 97 heading to University of California campuses, according to Santa MonicaMalibu school district data. “It sounds cliche, but it’s going to be a new experience,” he said. “The way I’m going to be able to apply myself, I’ll have much more opportunities at UCLA than in high school. I’m really going to get to figure out what I enjoy doing and explore different areas and hone in on what I want to do the rest of my life.” Namiri said he also considered attending Johns Hopkins University in Baltimore but ultimately decided on UCLA, where several relatives have gone and where he’ll be able to pursue studies in bioengineering while remaining in Southern California. “It seemed like the right choice,” he said. Merely having the option to

attend UCLA is an accomplishment in and of itself. The highly regarded public university received 92,681 freshman applications for the upcoming fall term, more than any other four-year college in the country. It offered admission to Namiri and 16,026 other outgoing high school seniors, which amounts to a 17.3 percent acceptance rate. “Our applicant pool and admitted students are just amazing,” Youlonda Copeland-Morgan, UCLA’s associate vice chancellor for enrollment management, said in a press release. “They are not only incredible scholars with great academic achievements, strong test scores and excellent grades, but they are wonderfully talented individuals with strong leadership skills and a commitment to community service.” Namiri, who went to Franklin Elementary and Lincoln Middle schools before attending Samohi, fits those descriptions. In addition to earning exemplary marks in the classroom, he was involved in a variety of extracurricular activities throughout high school. He was a co-founder and executive of CareDrop, a nonprofit group that has sent water purifiers to communities in Madagascar. He played soccer for four years

and was a team captain at Samohi, and he said he hopes to stay involved in the sport through intramural competition. Namiri also volunteered for three years at UCLA Medical Center in Santa Monica, boosting his exposure to medicine and research. He said he eventually wants to pursue a doctorate in engineering. “I always liked the health field, but engineering and the possibility for innovation was the thing that really interests me,” he said. “In the future I want to invent cool things for health care, and bioengineering seemed like the perfect thing.” Namiri has given himself a head start. He’s spending time this summer working in a UCLA bioengineering lab, learning about how ultrasound testing of human tissue can help surgeons detect cancer. Namiri said he feels ready for the challenges of college after a productive journey through Samohi. “I had a really good time there,” Namiri said. “I think I was challenged enough, and I had a good time. Everyone was really supportive ... It was a good four years overall.” JEFF@smdp.com

The Council will hear the second reading of an ordinance to allow fire dispatchers to receive the same training as police dispatchers. In addition, there will be a second reading of rules to extend an interim ordinance governing development standards in the Downtown area. Boston gangster’s bid for new trial heads to appeals court DENISE LAVOIE AP Legal Affairs Writer

BOSTON - During his 2013 racketeering trial, former Boston crime boss James “Whitey” Bulger called the proceeding a “sham” after he was barred from presenting the centerpiece of his defense: his claim that a federal prosecutor gave him immunity to commit crimes. Two years later, Bulger is hoping a federal appeals court will overturn his convictions based on what his lawyers call a “constitutional error” that denied Bulger his right to a fair trial. A three-judge panel of the 1st U.S. Circuit Court of Appeals in Boston is scheduled to hear oral arguments on Monday. Bulger won’t be present for the proceedings. Bulger was convicted of participating in 11 murders while leading a violent South Boston gang from the 1970s into the

New business includes amendments to the city code to facilitate transportation options. The transportation rules help define a bike share system, regulate the use of bike station equipment, amend car share rules to allow for off-street car share spaces and refine rules regarding parking in front of commercial driveways. The City has already authorized a bike share program in Santa Monica, but staff said at the time of authorization that addi-

Now 85, Bulger was one of the FBI’s 10 Most Wanted fugitives for more than 16 years until he was captured in Santa Monica, California, in 2011. He is now serving a life sentence. Bulger claimed that former Assistant U.S. Attorney Jeremiah O’Sullivan, now deceased, had given Bulger immunity during the 1980s in return for protecting his life from the mobsters he prosecuted. But Judge Denise Casper ruled that Bulger could not raise his immunity claim during his trial because he offered no hard evidence to support it. The judge also found that O’Sullivan, who died in 2009, did not have the authority to grant such immunity. Bulger cited the judge’s ruling when he decided not to testify in his own defense. He told the judge he felt he’d been “choked off

from having an opportunity to give an adequate defense.” “And my thing is, as far as I’m concerned, I didn’t get a fair trial, and this is a sham,” Bulger said. In his appeal, Bulger’s lawyers argue that if he had been allowed to testify about his immunity claim in his own words, the jury would have had the chance to weight his credibility against the credibility of prosecution witnesses. “The court’s denial of his right to raise this defense deprived Mr. Bulger of this fundamental right,” Bulger’s lawyers argue in a brief filed with the appeals court. “His testimony alone could have made a difference in the verdict.” Bulger’s lawyers say his testimony also could have challenged the government’s theory that Bulger was an informant on the rival New England Mafia. “Mr. Bulger had a Fifth and Sixth Amendment right to testify that the govern-

ment’s witnesses were lying about his alleged role as an informant and rebut by explaining his immunity agreement with the DOJ,” his attorneys, Henry Brennan and James Budreau, wrote in their brief. The defense said during the trial that former FBI agent John Connolly falsely portrayed Bulger as a valuable FBI informant, but Connolly was actually taking bribes from Bulger and leaking information to him about investigations. Prosecutors have argued that Bulger did not have a right to make his immunity claim to the jury because immunity is something a judge decides on before trial. Bulger’s right to testify in his own defense did “not entitle him to offer testimony that is irrelevant or otherwise barred,” Assistant U.S. Attorney Randall Kromm wrote in a brief filed with the appeals court. Prosecutors say the evidence of Bulger’s guilt was overwhelming and he should not get a new trial.

According to the July 28 staff report, the proposed code amendments are needed for operations and enforcement when the bike share begins later this year, including a prohibition on private bikes using the bike share racks. According to staff, the cost of the bike share ordinance will be paid for through impound release fees while the remaining rules carry no financial impacts. The city has previously authorized the implementation of a car share program to allow residents use of shared vehicles. The program stalled in 2014 when the proposed vendor, Hertz, ceased participation. The original program allowed for on street parking to be dedicated to the car share program. The new rules allow for the use of public offstreet parking. The third update clarifies rules related to parking in front of a driveway. Commercial property owners are allowed to obtain per-

mits to park in front of their private driveways. Those allowances did not specify the direction of the parked car, allowing property owners to park in the same direction as traffic on the street, including at an angle where appropriate. An update to the municipal code specified cars blocking driveways must be parked parallel to the street, unintentionally banning the angled parking. The proposed rules re-allows angled parking that blocks a driveway where appropriate. Council will also be asked to approve rules that ease the permitting process for small residential solar systems. According to the staff report, state rules require local jurisdictions to establish an expedited and streamlined process for solar installation. That process includes a checklist of objective requirements and a process for electronic submittal of applications. The report says Santa Monica’s existing rules likely comply with the state requirements already, and the

proposed action is to specifically to reference compliance with the California Government Code as opposed to making substantive changes. “Most of the procedures currently in place, such as electronic submittal of plans, complies with the requirements of the Assembly Bill and staff assures the successful implementation of an expedited, streamlined process will be available to permit applicants by September 30, 2015,” said the report. Consent calendar items include a proposed legislative agenda outlining the City’s, “historic and emerging legislative priorities and associated advocacy strategies,” approval of a contract to begin design, cost estimates and feasibility analysis for work at the City Yards and acceptance of Homeland Security grants that will be used by the Fire Department to pay for communications equipment upgrades.

Communicating Residents “HOW CAN RESIDENTS BETTER TALK TO EACH

other on issues of public policy?” That question stayed with me when I left the City Council in 2004. When people speak at the meetings of their local elected officials, they are clearly addressing the ultimate decision makers. But they are also addressing other community members listening in person, on television, or in the case of the City Council, on KCRW radio. Especially because our City Council, School Board and Rent Control Board (but not the College Board!) meetings are broadcast on CityTV, and rebroadcast many times, we have an enormously powerful tool to communicate with each other. But despite this, I left office feeling something was missing. It’s one thing for a member of the public to speak at a City Council meeting. But speakers there are limited to two minutes per item (three when I was on the Council). Depending upon an issue’s depth and complexity, that rule can be extremely limiting. In 2008, when the Council voted to cut back public input from three minutes to two minutes per person per item, part of the rationale was that people can also communicate with the Council via email, snail mail and voice mail outside of meetings. While that is true with the Council members, that “outside-of-meeting” communication doesn’t get shared with the rest of the community. Why is this so important? When we hear each other, sometimes we learn that others hold similar positions to our own, when we thought we were alone. We also understand why others feel differently than we do, learning from our diversity. And, by virtue of communicating for free with thousands via local cable TV, we are able to use our public testimony as a grassroots organizing tool, strengthening our local democracy, and making the spreading of ideas more merit-based, than who can afford to buy election mailers. But even when we had three minutes per item, there was a limited ability for residents to respond to each other, and for the Council to benefit from hearing that interchange. That is the gap I left office wanting to close. PUBLIC ELECTRONIC NETWORK (PEN)

Santa Monica once had a tool to close that gap called the Public Electronic Network (PEN). Our nation’s first municipally sponsored interactive electronic BBS (Bulletin Board System), PEN was launched in February, 1989. Among its initial objectives was to enhance communication, increase a sense of community and provide an equitable distribution of communication resources to all residents (http://archive.wired.com/wired/archive/2.01/pen.h tml). For some time PEN did exactly that, allowing a large number of residents to talk to each other about upcoming issues, and for their elected officials to

observe, and sometimes participate in, that dialogue. At its apex, approximately 5,000 residents had PEN accounts. But eventually PEN was shut down when users (including elected officials) fled in the face of abusive and bullying language on the part of some participants, a problem endemic to this kind of medium. ELECTRONIC PUBLIC COMMENT ON AGENDA ITEMS

What I wanted to create after I left office was a web site where the individual agenda items for our local governmental agency meetings are posted one-by-one, with a blog comment option following each item so community members could comment directly about upcoming proposals, in advance of the meeting at which they would be decided. In this way, community members could speak to each other about specific agenda items in advance of the public hearing, and decision makers could observe that dialogue. By keeping the focus on each separate agenda item, moderation to keep people on topic would also be easier. In early 2005, I went to a few local friends with IT experience to see if they could design such a web site, but it never happened. Making things more complicated was that unlike agendas for the City Council (http://www.smgov.net/departments/clerk/agendas.as px) and Rent Control Board (http://www.smgov.net/Current_Board_Meetings.asp x), which have individual links on the City website for each agenda item, the agendas for the School District (http://www.smmusd.org/board/meeting_archives.ht ml) and College (https://www.smc.edu/ACG/Pages/Trustees-MeetingInformation.aspx) were (and still are) single PDF documents for all items, so that its not possible to electronically post individual agenda items for those agencies. SANTA MONICA GOVERNMENT FACEBOOK GROUP

On November 5, 2012, the day before our local municipal elections that year, I woke up unsatisfied with the campaign season’s high ratio of simplistic slogans and expensive direct mailers versus in-depth and informed community debate. Working with the social media tools available to me, I created the Santa Monica Government Facebook group, short for “Santa Monica Government, Politics, Policies and People”, which is how you can find it on Facebook. Critical to me was that, unlike other sites, this would not be organizationally sponsored, nor based upon any particular point of view, other than I wanted to finally “bridge that gap” of communication among us. The group’s explicit Charter/Purpose (https://www.facebook.com/groups/44919849514 3013/permalink/800329143363278) is, “to discuss the policies and politics of the Santa Monica City Government, Santa Monica-Malibu Unified School District, Santa Monica College and Santa Monica Rent Control Board, and the policies and

politics of county, state and federal agencies as they directly apply to Santa Monica,” and, “to promote greater community dialogue and understanding, to be inclusive and a safe place for a range of viewpoints, and to fill a very specific gap in our community, to provide an on-line place for community members to talk about the affairs of our governmental agencies.” Eligibility is “primarily for current Santa Monica residents, but also open to other community members who may not live in the city, but who work in, or own a business or property in Santa Monica; attend school/college in Santa Monica; serve on a local government advisory board, commission or task force; or are county, state and federal elected officials who represent Santa Monica, and their staff.” How has it worked? The group boasts more than 750 members (without any widespread outreach), and I’ve only had to unsubscribe five people who weren’t willing to follow the posting guidelines. But most importantly, it features respectful participation from a wide cross-section of Santa Monicans and includes many of our local elected officials.” To make the group a safe place for diverse views, I’ve strongly moderated it according to its charter/purpose and posting guidelines (https://www.facebook.com/groups/44919849514 3013/permalink/800329143363278), which are meant to promote civility and inclusivity, but also dialogue that doesn’t unnecessarily bifurcate the same topic over multiple discussion threads, nor monopolize screen space by a few individuals. Given the format/layout of Facebook, such moderation is often more art than science. If you fit the eligibility criteria, please feel free to visit the group and ask to be subscribed. If it’s clear from your Facebook page (and/or a web search) that you fit the eligibility guidelines, and/or I have you in my Santa Monica voter registration database, I will add you. TIME FOR PEN 2.0?

Since the end of PEN, the City of Santa Monica has increasingly used electronic means to gather public input on a variety of topics. But there still is no pre-meeting, public comment option for actual agenda items. On the Santa Monica Government Facebook group, I often post links to an upcoming City Council or Planning Commission agenda item. But that’s only a small approximation of a website designed specifically to receive such input on all agenda items. Given the high level of civic participation we strive for locally, its time for the City to visit the idea of an electronic forum for public comment on each individual agenda item. The more tools we give our community to learn from each other, the stronger we can be.

rible traffic in Sunset Park and how it was most likely the number one contributor to air pollution in that neighborhood, Santa Monica Airport notwithstanding. Traffic congestion is probably the number one complaint here in Santa Monica. The number two complaint is development/overdevelopment, however the major reason people are complaining about more development is the traffic that it will generate. I recently read an article in the London Daily Mail (Feb. 16, 2015) about how drivers and pedestrians are being exposed to very high levels of air pollutants at traffic lights. The research was conducted at the University of Surry in the UK. Most people focus on stopping and going, rude drivers and reckless driving moves, pedestrians who walk in front of moving cars, bicyclists who don’t obey traffic laws, the frustration of being late for appointments and the costs associated with wasting fuel and the wear and tear on our personal vehicles when stuck in traffic. In addition to the stress, there is another downside of traffic congestion: air quality, especially for people who live close to major streets and intersections. We all know that gasoline and diesel powered vehicles spew polluting nanoparticles which contribute to respiratory and heart diseases. The University of Surry research showed that “pollution is 29 times higher at traffic lights where cars rev engines.” Professor Prashant Kumar said his research team, “found traffic intersections were high pollution hot-spots due to the frequent changes in driving conditions.” It turns out that stopping at traffic signals could be killing all of us because of the toxic pollution generated when cars stop and go. “With drivers decelerating and stopping at lights, then revving up to move quickly when lights go green, peak particle concentration was found to be 29 times higher than that during free-flowing traffic conditions ... Though drivers spend just 2 percent of their journey time passing through intersections managed by traffic lights, this short duration contributes to about 25 percent of total exposure to these harmful particles,” he added. Kumar suggested some remedies for avoiding the intake of particulates and other pollutants. Keep car windows rolled up. Don’t stop immediately behind the car in front of you, as pollutants are concentrated the closer you are to its tailpipe. Pedestrians could avoid pollution hotspots by crossing streets or finding other paths less dependent on traffic light crossings. The only problem is that pedestrians are putting themselves more at risk at un-signalized intersection of being hit by inattentive drivers. Professor Kumar also suggested that,“local transport agencies could also help by synchronizing traffic signals to reduce waiting time…” Holy Synchronized traffic signals!!! I’ll bet that’s a tool in the traffic engineer’s bag of tricks that our planners never thought of.

Residents in residential neighbors often push for stop signs to slow traffic. The thinking is that cars won’t or can’t accelerate to high speeds if they have to stop every block or two. Using stop signs to control bad driving habits doesn’t work. It leads to accidents, creates noise and excessive amounts of pollution and detrimentally affects the health of nearby residents. Yet, on 14th Street north of Montana Avenue, there are stop signs at almost every block to San Vicente Boulevard. Because there is little cross traffic, these signs are there for one reason only: to reduce speeding. But they don’t. Plus, drivers on 14th run them continuously. The same with Broadway east of 26th Street. More bad traffic planning based on folk tales and social agenda-driven traffic engineering. Typical of the misguided nonsense proffered by Santa Monica’s director of Strategic and Transportation Planning, David Martin, is this item before City Council tomorrow evening. Martin asks that City Hall accept a total of $1,250,000 in Open Street grants for pedestrian and bicycle enhancements between the Expo rail terminus, Downtown and the Civic Center. The grants also include $200,000 to stage an Open Street event to promote walking and bicycling. Really? This program is funded through the Congestion Mitigation Air Quality Improvement Program. But, we all know the result of these efforts will end up further restricting traffic flow, exacerbating congestion and contributing to even poorer air quality; as have all the other City Hall traffic initiatives over the years. Kumar suggested finding more appropriate placement of traffic signals. “Use of them in built up residential areas, near schools or hospitals may serve to manage traffic flow, but at the cost of trapping higher concentrations of harmful pollutants in exactly the areas where residents and vulnerable members of society will most regularly commute or walk.” Bad traffic management planning is a mantra here. I can’t wait to see the mess that the Safe Routes to School alterations to Michigan Avenue, Pico Boulevard and 7th Street bring to the table when school starts. This ill-conceived plan mixes bicycle riders, pedestrians and auto traffic from folks dropping off and picking up their kids next to Santa Monica High School. In addition to the safety concerns resulting from the ungainly mix of transit uses concentrated in one, already heavily congested area, we can add dramatically increased air pollution next to a public school. Insane. In a city that prides itself on being sustainable and environmentally friendly, the way city planners handle traffic is laughable. In conclusion, it’s only through understanding where pollution hotspots are that enables us to take more direct action and push, “for real greener, cleaner planning.”

Michelle Obama opens Special Olympics in Los Angeles JOHN ROGERS Associated Press

LOS ANGELES Michelle Obama welcomed thousands of athletes with intellectual disabilities to the Special Olympic World Games on Saturday during a festive opening ceremony filled with cheers, songs and praise for their courage and determination. “My husband and I, we are so proud of you, so incredibly proud of you, and we love you all from the bottom of our hearts,” the first lady said. She said the athletes were an example to the millions of people watching the event on television. She was introduced by Special Olympian Tim Harris, who owns a restaurant in New Mexico that he said serves “breakfast, lunch and hugs!” Mrs. Obama “knows the power of a hug,” he said, and shared one with the first lady. Earlier, President Barack Obama welcomed the athletes by video. About 6,500 athletes from 165 countries streamed into the Los Angeles Memorial Coliseum to cheers and roars. The athletes will participate in 25 sports over nine days, ranging from weightlifting to the triathlon. L.A. also hosted the Special Olympics in 1972. Applause greeted the athletes, from some 400 in the United States contingent to a handful each from smaller countries. It was the largest gathering of athletes in Los Angeles since the 1984 Summer Olympics. The groups wore distinctive colors but carried no national flags. However, Special Olympics athletes and Olympic gold medalists including swimmer Michael Phelps, diver Greg Louganis and skater Michelle Kwan together carried in the Special Olympics flag.

A flaming torch carried from Greece was used to light the Coliseum’s Olympic beacon. The three-hour ceremony, broadcast on ESPN, included Special Olympians at every level. Global ambassadors partnered with celebrities onstage and TV commentators. There were fireworks and musical performances by Avril Lavigne, Stevie Wonder, Colombian reggaeton artist J Balvin and others. “You are the special people of the world,” Wonder told them. “You are the ones that will make a difference every single day. Your courage, your desire to make the world better by showing your love ... (and) in the way that you carry yourself.” At the beginning of the show, late-night television talk show host Jimmy Kimmel thanked the competitors and the international crowd of spectators for coming and joked about California’s long drought, saying he hoped they brought water. “That Olympic flame they’re going to light will truly burn forever because we don’t have the water to put it out,” Kimmel said. Kimmel also praised the athletes. “You remind me of how deeply lazy a man I am,” he said. The games were the brainchild of President John Kennedy’s sister Eunice Kennedy Shriver, who held informal backyard competitions at her home before deciding to take the competition international in 1968. She said she believed everybody should have a chance to feel special. On Saturday night her daughter, Maria Shriver, addressed the throng. “She was so proud of you and wanted more than anything for you to be respected, valued, appreciated for who you are,” Shriver said. “Brave, good, kind, solid, and yes, smart human beings.”

er “Pixels” to claim the top spot at the box office this weekend by an ant-sized margin. The Disney and Marvel superhero pic brought in $24.8 million over the weekend, bringing its domestic total to $106.1 million according to Rentrak estimates Sunday. “Pixels,” meanwhile, just barely missed first place with a $24 million debut. While studios always hope for the bragging rights of a No. 1 debut, the real issue here is whether or not the Adam Sandler end of the world comedy will make up its $88 million production budget. “It’s been a little competitive in the marketplace when you consider the extent of the performance of ‘Jurassic’ and ‘Inside Out,’” said Sony’s President of Worldwide Distribution Rory Bruer. “To get to where we opened to was quite good.” Critics were not fond of “Pixels,” which shows 1980s video arcade game characters attacking Earth, but younger audiences still turned out to theaters — an estimated 62 percent were under the age of 25. Paul Dergarabedian, Rentrak’s senior media analyst, said Sandler can still attract an audience, but the expensive film has a lot of ground to make up. “They’re really going to have to count on the international component. That’s going to be key,” he said. Overall, the box office is down 3 percent from the same weekend last year, when “Lucy” opened particularly strong. Dergarabedian said that though some are attempting to link last week’s theater shootings to any dip in the box office this weekend, “the numbers just don’t bear it out.” Holdovers “Minions” and “Trainwreck” took the third and fourth spots with $22.1 million and $17.3 million, respectively. Meanwhile, the R-rated boxing drama “Southpaw” surpassed expectations and landed a place in the top five with its $16.5 million opening. Dergarabedian said that its performance is likely due to star Jake Gyllenhaal’s enthusiastic promotion of the film and also the fact that it provides an alternative to the standard summer blockbuster fare. “‘Southpaw’ felt like a really good fall movie,” he said.

“Paper Towns,” an adaptation of John Green’s coming-of-age novel, opened in sixth place with $12.5 million. The Fox film only cost $12 million to produce, but considering Green’s fan base and last year’s massive $48 million debut of “The Fault in Our Stars,” which Green also wrote, it’s a bit disappointing. A straight comparison isn’t entirely fair, though. “The Fault in Our Stars” had a much bigger following and transcended age and gender groups with its story of two teens dying of cancer and falling in love. “Paper Towns” is a more narrow and lighthearted high school tale. According to exit polls, 71 percent of the “Paper Towns” audience was female and 78 percent were under age 25. Also, Shailene Woodley was a much bigger name when “The Fault in Our Stars” came out, whereas Cara Delevingne and Nat Wolff are somewhat lesser known. Woodley’s “Divergent” association took the modest film “to another level,” Dergarabedian said. “I think we have a job ahead of us in the coming weeks to find more of our potential audience who we weren’t able to reach this weekend. But I think we can do that,” said Chris Aronson, Fox’s domestic distribution president. Estimated ticket sales for Friday through Sunday at U.S. and Canadian theaters, according to Rentrak. Where available, the latest international numbers for Friday through Sunday are also included. ON JULY 16 AT APPROXIMATELY 4:15 P.M. Officers responded to Jack in the Box located on the 2000 block of Lincoln Boulevard in response to a fight in progress. Upon officers arriving, they were told that the victim was sitting inside of the restaurant when he noticed a male walking away with the bicycle he left unsecured on the side of the entrance. The victim confronted the subject, later identified as Alberto Martinez, 25 years of age, when a verbal argument ensued. A physical confrontation followed the verbal confrontation and the victim was able to retrieve his bicycle as Martinez began to walk away. Information about the suspect’s identity was broadcast and an officer patrolling the immediate area detained a man matching the description. Martinez was ordered to lie on the ground multiple times by officers, after about the fifth time he finally complied. The victim positively identified Martinez, yet he was hesitant of pursuing anything further, as he stated he was afraid of retaliation. Martinez was booked for robbery and resisting arrest. The Expo Light Rail Line extension from Culver City to Santa Monica is scheduled to start train-testing activities in Santa Monica next week and will continue for several months. Initially the trains will be pulled along the rail corridor, and then operated on their own power. Testing will be ongoing along the entire alignment in Los Angeles and Santa Monica. The testing activity will test train clearances, the Overhead Catenary System which powers the trains, the crossing gates and traffic signals, and all related systems before the project is turned over to Metro for pre-revenue operations.

plummeting profits after the release of the 2013 documentary, “Blackfish,” which tells the story of Tilikum, a performing killer whale that killed several people while in captivity. Although wild capture was outlawed in the U.S. in 1972, killer whales continued to be seized in foreign waters: Tilikum was caught, at age two, off Iceland in 1983. Today, SeaWorld asserts that its population of killer whales has been successfully producing healthy offspring since 1985, and the success of this program has made it possible for them to care for and display killer whales to the public without collecting a killer whale from the wild in 35 years. For its part, SeaWorld disputes the negative accusations. Earlier this summer, SeaWorld San Diego released a study contrasting current published data for survival and reproductive activity of knownage Pacific Northwest killer whales since 1975 with the life history of killer whales in SeaWorld’s care. “Although emotion will always be a part of the debate as to whether killer whales, or any other species, should be maintained in human care, it is absolutely necessary to have validated facts when an argument for or against is being made on scientific grounds,” said study author Kevin Willis, Vice President for Biological Programs for the Minnesota Zoo. “Based on the available data, it is now clear that it cannot be truthfully argued that killer whales should not be maintained in captivity because they have a shortened life expectancy relative to their wild counterparts,” Willis added. Animal rights groups have been quick to criticize SeaWorld’s study. People for the Ethical Treatment of Animals (PETA) points out that another study published in April 2015 in the journal Marine Mammal Science found that the median life expectancy of 83 killer whales kept in captivity from 19612014 in the U.S. was only 12 years. The study also determined that 118 killer whales kept in facilities outside the U.S. during those same years were found to have a median lifespan of just four years. “Contrary to what the authors of this study, three of whom are SeaWorld employees, while the fourth works for a zoo, would have people believe, the average age of the orcas who have died at SeaWorld is 13 years, and only one orca at SeaWorld, Corky, who was captured in the wild, has actually reached SeaWorld’s claimed ‘average life expectancy’ of 41.6 years,” PETA’s director of animal law, Jared Goodman, reported. “Every single orca who has perished at SeaWorld died far short of how long they are expected to live, though it is in fact hard to call it ‘living’ when their ‘life’ consists of being forced to perform circus-style tricks in a tiny concrete tank.
