Rustic Canyon, Mélisse add employee benefit surcharge BY DAVID MARK SIMPSON Daily Press Staff Writer

WILSHIRE BLVD Santa Monica restaurant groups are supplementing healthcare costs for their workers by adding a 3 percent surcharge to every bill. Josh Loeb and Zoe Nathan, part owners of Rustic Canyon, Milo and Olive, Huckleberry Cafe, and Sweet Rose Creamery, along with Josiah Citrin, chef and co-owner of Mélisse, started adding the surcharge to diner’s bills on Sept. 1. They started enrolling employees - those who work 30 or more hours per week - in the benefit program on Thursday. Healthcare coverage kicks in on Oct. 1. The Hungry Cat, which has a location in Santa Monica Canyon, will be including the surcharge. Several other nonSanta Monica restaurateurs in the region implemented the program as well. Loeb said that they recently learned that under the

Affordable Care Act they won’t be required to offer healthcare coverage at some of their restaurants until 2016 and that others would be exempt altogether. “It looked like we weren’t going to have to do it but we looked at each other and said, this is something we want to do,” he said. “We want to be able to grow up as a restaurant. The well-being of our staff is an incredibly important thing for us.” In San Francisco, many restaurants are already offering health insurance. Republique, in Los Angeles, enacted a 3 percent surcharge when it opened last year. Republique’s model drew some ire from restaurant-goers who felt they were unfairly being asked to pick up the owners’ healthcare tab. Some restaurants seeking to add healthcare for employees have opted to instead raise the rates of their dishes. SEE HEALTH PAGE 7

Erik Huberman, CEO of Hawke Media, talks to Aaron about DogVacay, how he became an entrepreneur and Santa Monica. Erik Huberman: Tell me a little bit about yourself and DogVacay? Aaron Hirschorn: DogVacay came out of an experience my wife and I had four years ago (in 2011). We left our two dogs, Rocky and Rambo, in a kennel when we visited our family on the East Coast. CITYWIDE Fall is Back to School season and in Santa Monica, the educational opportunities aren’t limited to the traditional classroom. Several organizations are gearing up for fall classes for adults or offering extracurricular activities for youth. The City of Santa Monica Fall Community classes begin the week of September 8. Recreation classes take place at the local parks and facilities and organizers said there is something for everyone in the family. Class types include sports, dance, art, preschool preparedness, cooking, dog training, language, several new options. Sandra Catena will offer classes through the City on Belly Dancing and Italian Cooking. She said the unusual combination reflects her unusual life that brings a sense of adventure to her classes. Catena said her two classes are connected through a passion for healthy living. Her cooking class features clean, healthy food based on family recipes from Italy. “Everyone should eat well and we live in a land of abundance,” she said. “I teach my students how to cook and how to have fun while cooking. I educate them as to the vitamins

Today, I received in the mail a nice little invitation from the people pushing Measure D to one of their information sessions. At the bottom of this slick mailer were the words “Major Funding by Aircraft Owners and Pilots Association and National Business Aviation Association.” I’m glad this group is being open and honest about who’s cutting the checks to pay for their mailers. It looks like the AOPA’s recent donation of $60,000 (on top of the $127,000 they’ve already ponied up, along with the NBAA’s $125,000 investment in maintaining their gravy train) is indeed creating jobs in the community. Of course, those jobs are for graphic designers and printers for their campaign mailers, but what the hell.

I was watching a Hercule Poirot mystery on TV just after I read your fascinating article about the great “Airport Ballot Language Mystery”, and I realized the little Belgian detective has some wise words which help sort out the differences between Santa Monica’s own Measure LC and the aviation lobbyists’ Measure D. Poirot always asks “What is the motive?” and the lobbyists are quite clear about theirs: they want to keep the airport open. So it’s not hard to deduce that their Measure D isn’t really about giving local voters choice - it’s about making sure the private jets can keep flying in. Which is why they’ve put in the language that will demand an impossible majority before anything can be done about the noise, pollution and danger. Measure LC, on the other hand, straightforwardly puts the power in the hands of the voters and specifically forbids development at the airport. The motive: to keep a $2bn asset that belongs to the people of Santa Monica in local hands so it doesn’t become the private playground of the privileged few. I think that’s what Poirot’s “little gray cells” would be telling him, anyway. And probably what Santa Monica voters will be figuring out for themselves before November.

One of the reasons, I am supporting former Santa Monica Mayor Bobby Shriver for LA County Supervisor is regarding a quote he made over the 2010 sales tax … The debate on the dais became somewhat heated when Shriver referred to Santa Monica as a ‘rich’ City, and not one that is financially troubled. “It might get there if it persists in doing business the same way it has done in the past,” he said. That said, I feel very much the same about the Santa Monica Ballot Measure H to provide “affordable housing” by taxing sales on homes/condos etc. over $1M. It is just another Initiative that is posing as an “Affordable Housing Measure” to provide funding for ongoing development. There are better tools to use than to tax our already overtaxed citizens.

hackles. In “In house or out house?” (SMDP, Sept. 1, Pg. 5.) I criticized City Council for being the pro-union shill it’s become, in part for its general opposition to three contracts that involved outside contractors doing work for the City of Santa Monica. The contracts with private companies, most of which had been doing work for the city, involved maintenance and janitorial services for a number of city-owned/operated facilities including the Santa Monica Pier, beach restrooms, Public Safety Facility and maintenance for the Big Blue Bus. I usually take City Hall staff reports with a grain of salt, but when they reported that using private contractors will save the city $1.2-million over five years or about a quarter million dollars a year as opposed to using or hiring direct employees for beach and Pier services, it got my attention. Money saved could reduce the city’s operating budget or be used elsewhere on the beach. Of course, everything here is subject to a social engineering agenda so whether to outsource or hire/retain city employees has become a philosophical debate. Council candidate Sue Himmelrich emailed me last week claiming her research on outsourcing seemed to show that that “…we in fact spent more money per year than we had previously and certainly did not save the $500,000 promised by the 2010 staff reports. In my view, this (outsourcing) is not social engineering but simply sound policy,” she wrote. There’s only one-way to resolve this: conduct an audit of the real costs of outsourcing as opposed to hiring and maintaining an in house workforce for all departments. Everyone knows that organized labor has an enormous influence on local political policy. Members of labor unions, especially the UNITE HERE hospitality workers union, work hard to convince voters to vote for candidates they support for City Council, School Board and other offices. They work closely with Santa Monicans for Renters’ Rights (SMRR) and persons they endorse are elected, consistently. While many activists complain about the unfair influence of developer money that goes to their favored candidates, the same folks overlook the fact that that most of our elected officials are in office courtesy of labor unions. Union bargaining organizations, such as The Coalition of Santa Monica City Employees Political Action Committee, also endorse candidates and contribute money to pay for campaign ads and flyers. The Police and Firefighters bargaining units do the same. The goal of these municipal workers unions is to protect jobs, advocate for a safe working environment and insure proper wage and benefits packages for their members. And, before someone distorts my view there’s nothing wrong with labor organizations supporting candidates any more than there’s anything wrong with business interests and developers putting their money where their mouths are. Voters should always be aware of how

endorsements are awarded and the strings tied to them. In the case of UNITE HERE, it’s obvious new hotels and hotel worker wages are top priority both with City Hall and SMRR. Most union leaders and their members don’t care about budgets, deficits or whether we’re going to pay more for government services through higher fees or tax increases. How much do you think hotel workers care about the traffic and congestion that comes with new hotels? Try “zero.” City Hall politicians, department heads and pro-labor liberals must stop treating members of labor unions as if they’re “special” and deserving of privileges that the rest of us aren’t entitled to. Shifting gears … There are nearly 2,200 municipal employees in this eight square mile city of 91,000 plus residents. That’s a little over one city employee for every forty residents. It’s way above the average ratio of workers to employees for most cities. Yeah, I know. There’s at least 100,000 daily visitors and workers who come to Santa Monica to work or play. The employee to resident/visitor ratio is still excessive. Comparing a few California Cites at random (www.city-data.com). Most employee numbers are dated “2007”, but they generally should hold for the current year, in most cases. Despite having a large and very well paid city staff, it seems that the Planning and Community Development and Housing and Economic Development departments especially can’t get anything done without hiring an overpriced consultant or two. Speeders on Berkeley Street? Hire a consultant to develop a remedy. I got your remedy: speed bumps. There, it didn’t cost City Hall a cent. Spruce up Reed Park? Hire a consultant. Need an urban plan for the Bergamot area? Hire a consultant. At a hundred thou here, and a couple hundred thou there, who cares? It’s only money. If you think that maybe Santa Monica has too many employees, check the pay levels and benefits for the various department heads and supervisors. School spirit THERE’S A MURAL ON THE SIDE OF

Olympic High School. It’s of Muir Woods and to be honest, it’s seen better days. Everyone involved agrees on that point and acknowledges that something needs to be done. The school wants a new mural, designed and painted by students. A very small group of very vocal protesters disagree. They want the old one restored by a now out-of-town artist. The protesters are wrong and the school is doing exactly what it should in commissioning a new piece. The Woodites opposition to the new mural is based on the work having some historical value, and it does, but their campaign has been both deceptive and selfish so far. Time after time, the Woodites have talked about saving the mural from being “painted over.” They talk about the benefits of public art and the importance of art in community spaces. Those are fine arguments, but they’ve been constructed in a way that that insinuates the school wants to remove all art from that space. That’s a lie. The mural will be replaced with another mural. Any arguments being made about the value of public art will apply to the new work just as much as to the old. The issue isn’t art or no art, it’s trees or something else. The trees were painted when the school was still John Muir Elementary and at the time, the work made sense. That’s no longer the case. The school is now Olympic High School so the context isn’t correct anymore. The protesters say the work is historically significant and sure, it’s older than some other works in the City, but just because something is old, doesn’t mean it’s valuable. The value of the trees to the small number of people who care about them is less than the value of a new work would be to the students and much as the Woodites like to ignore this fact, the school’s primary responsibility is to the students, not the protesters. Olympic is a continuation school meaning it’s a place for those students deemed at risk. For many of them, this is the last chance to emerge from the education system as a functional member of society and to be blunt, they’ve been dealing with benign or active neglect for years. They have a left-over

campus, with left-over equipment and are often forgotten about in the larger educational debate. Showing these students that they can take ownership of their community, that their thoughts, opinions and actions matter, that they are valued members of the community is a critical function of Olympic. Telling them they can’t paint their own walls because people they’ve never met, worked with or talked to don’t like the students’ choices does exactly the opposite. The students deserve better and they have every right to want to put their stamp on their school because it’s their school. That’s an important point and one that the activists don’t seem to understand. A school isn’t a community center, it’s not a public park, it’s not a monument to the past. There are certainly times and places for schools to provide benefits to non-students but when there is conflict, the school should do what is best for the students. The conflict here is fundamentally about money. Work needs to be done and work costs money. In a fantasyland of infinite resources, there’d be enough money to restore this and paint something new. But there isn’t so there’s one shot at this project and the school is using the necessity of repainting as a chance to provide students with a sense of ownership, a sense of pride and a sense of identity. It would be nice if the Woodites would put the needs of the next generation ahead of their own and it would be great if political candidates sided with students instead of pandering to potential voters. Neither is likely so it falls to school administrators. They have the ultimate say in this and they’ve already shown a willingness to work with the community on the project, but that’s not good enough for the vocal minority. The discussion of the project will continue and hopefully, the community at large will rally around the students because this is a chance for Santa Monica to think longterm and invest in the next generation. It would be a shame if we couldn’t see the forest for the trees. — MATTHEW HALL

migratory birds “overwinter” in the Canadian Boreal forest, a vast tract of mostly uninhabited coniferous woodlands and wetlands stretching from Newfoundland to the Yukon. The area makes up some 60 percent of Canada’s total land mass, and serves as the winter home for more than half of America’s avian population. But environmentalists are worried about the impact of increasing “tar sands” oil development there and the impact it might have on wildlife populations continent-wide. Tar sands are a mixture of sand, clay, water and a dense and viscous tar-like form of petroleum called bitumen. The bitumen is extracted from the tar sands mixture and eventually refined into transportation fuel like gasoline. The extraction process is especially “carbon-intensive” and generates some of the dirtiest fuel around, but its abundance makes it affordable as long as industry keeps turning up new sources. A recently released report by the National Wildlife Federation (NWF) and the Natural Resources Council of Maine (NRCM) concluded that almost half of the 292 different migratory bird species that overwinter in Canada’s Boreal forest-as many as 75 million birds-are threatened by future tar sands development. Further, they say, bird losses in the hundreds of thousands have already taken place as a result of overzealous and under-regulated oil development there to date. “The direct and indirect impacts to birds from tar sands development are immense,” states the report. “Waterfowl and shorebirds land in tailings ponds that they mistake for natural water bodies and become oiled with waste bitumen and toxic elements.” The

result can be birds drowning, dying from hypothermia or otherwise suffering from the ingestion of toxins. “Toxins from the tailings ponds and other pollutants from tar sands operations leak millions of gallons of toxic liquid waste into wetlands and forests each day, further contaminating habitat,” the groups add. Tar sands development also contributes disproportionately to climate change. U.S. State Department analysis shows that tar sands oil is 20 percent more carbon pollution intensive than conventional oil on a “well-towheel” basis. The effects of global warming on Canada’s Boreal forest are likely to include shifting food supplies, increasing numbers of damaging wildfires in forests, more droughts in wetlands and potentially dramatic changes in vegetation and the relationships between predators and prey. Environmentalists would like to see U.S. lawmakers deny permits for the transport of Canadian Boreal tar sands oil-most of which is extracted in land-locked regions-through the U.S. in hopes of making future tar sands projects there too expensive to be worthwhile. “Saying no to tar sands is a critical pillar in an effective strategy to protect wildlife from carbon pollution,” says NWF. Furthermore, given Americans’ growing desire to get away from costly and polluting foreign oil, it makes sense to pass on adding dirty tar sands oil to the mix. But it remains to be seen if the Obama administration will allow construction of the controversial Keystone XL pipeline to transport the oil from Canada through the U.S. The welfare of millions of birds-and, indeed, our energy future-is at stake. Most of the owners who are in on the surcharge have worked as chefs at one point or another, Loeb said, so they’re familiar with the disparity. “It gives the customer a chance to adjust their contribution if they want to,” Loeb said. “If a guest were normally going to leave 18 percent and they know there’s a 3 percent surcharge, they can leave 15 percent.”

Loeb sent out an e-mail about the surcharge to all their newsletter subscribers. They’ve posted information about it on the menu and around the cash registers in the restaurants. Servers are making a point to mention it to guests. “We had a very small response, in general, either way,” he said. “Most of the response is very positive. We get a lot supportive emails back from our newsletter. A lot of regulars at our restaurants think it’s great. Some people are going to complain about anything.” Some people have said they don’t want to see the surcharge - that they’d rather it be included in the menu price. Between the drought and the cost of gasoline, which in turn impact the cost of ingredients, Loeb said, restaurants are already battling to keep the menu prices down. “I’m finding more people than not appreciate the transparency,” Loeb said. “People want to see an open kitchen when they come to a restaurant. People want to watch restaurant shows where they see what’s going on. We’re saying, let us show you.”

LOS ANGELES “Guardians of the Galaxy” continues to rule the box office universe. The cosmic Marvel adventure arrived in first place at the box office for a fourth weekend with $10.2 million, according to studio estimates Sunday. The domestic haul for “Guardians,” which features Chris Pratt and Zoe Saldana as intergalactic do-gooders, now stands at $294.6 million after six weeks of release. “Guardians” furthered cemented itself as the top grossing film of the year in North America, eclipsing the $259.8 million earned by fellow Marvel movie “Captain America: The Winter Soldier.” The sci-fi romp earned an additional $11.5 million internationally, bringing its worldwide total to $586.2 million. Despite the continued success of “Guardians,” the weekend box office marked the slowest of the year with the total for all films released projected at $65 million, down 23 percent from a year ago, according to Paul Dergarabedian, senior media analyst for box-office tracker Rentrak. Paramount’s “Teenage Mutant Ninja Turtles” sliced off second place in its fifth weekend with $6.5 million, bringing the domestic total of the live-action superhero reboot starring Megan Fox and Will Arnett to $174.6 million. The Warner Bros. young-adult novel adaptation “If I Stay,” starring Chloe Grace Moretz, took third place in its third weekend

In the pet services industry, which includes boarding, it’s a $11 billion current spend and no one has any market share. People hate the kennels and they don’t like calling in favors to leave dogs with friends and family. That’s where we enter, my wife and I started watching dogs in our own home. In 2011, we hosted over 100 dogs, learned a ton about what it meant to provide great customer service and care for dogs, and then at the end of 2011, started working on the DogVacay concept. We launched in March of 2012. Now we have over 15,000 dog watching host families across the US and Canada. We have 75 employees here in Santa Monica, about half the company is in Customer Care, which is really what our company is about. It has been an awesome, awesome ride. E: What made you want to be an entrepreneur? A: To be honest, I did not have an “I want

to be an entrepreneur” itch for many, many years; it came out of this particular experience. After watching dogs ourselves and realizing it was a solution people liked, and thinking about how we could share that concept, it was a really natural evolution. As opposed to something really conscious, over many years, it was born out of this particular experience, and we got deeper and deeper to the point where we were actually running a business. We started working on a basic concept, started talking to a couple of investors and it started moving really fast. I would say, honestly, I’m not a hardcore entrepreneur by nature, but overtime, that’s what I’ve become. E: Why did you choose to be in Santa Monica? A: I absolutely love Santa Monica. First, I think it’s absolutely a great lifestyle; in terms of attracting the top talent that we have, it makes a big difference. People enjoy spending time here, and it’s just a great place to be in terms of dining and the beach and everything else. It also has become a real hub of innovation and of community. I think it’s really unusual that you can walk outside and see people that you know that are in the

same industry and same community, and it happens all the time. I’m constantly seeing people from local venture capital firms, local entrepreneurs, other startups. That builds on itself; a lot of the great talent is here and that becomes a really great draw. E: How is DogVacay changing the world? A: There are 83 million dogs in the US, tens of millions of dog owners who travel every month and this is a really tough problem for them because they view leaving their dog in a cage, or calling in favors as difficult. This is changing the world in three different ways. It’s giving pet parents an opportunity to have a much better experience for their dogs and peace of mind when they travel. On the other hand, we are earning millions of dollars for our hosts. So regular people from retirees; stay at home moms; people who work from home; college students are now earning income doing something that they love. The third way is that we’re making a great experience for dogs, and the well-being of the dogs is ultimately what we’re about. I think all that together is a really rewarding experience for our employees; it’s really motivating for them and for me and I guess to use your

words, changing the world. E: Do you have one piece of advice you want to pass along to entrepreneurs? A: The main advice is that you have to just move forward. Very often I see entrepreneurs who are constantly talking about their idea, talking about “if only they had this next investment” or this person, or this thing. They’re talking and they’re going to events and conferences, and the reality is that none of that actually makes a difference. You really have to just start building, and if you’re building then everything else really starts to come into place. When you’re having conversations, people see that you have momentum and they get more excited about it. So however possible, you have to figure out how to move forward with your idea, and that’s the hardest part for people, I think. E: Is there anything you want to share with local people in Santa Monica? EAST RUTHERFORD, N.J. Rex Ryan wanted more from his New York Jets. More points. More discipline. More execution. That’s why the coach was far from thrilled after a 19-14 season-opening victory over the Oakland Raiders on Sunday. “This game should’ve been a rat kill,” Ryan said. “It wasn’t.” Chris Ivory had a 71-yard touchdown run midway through the fourth quarter, and the Jets’ swarming defense mostly clamped down on Oakland rookie quarterback Derek Carr as New York held the Raiders to 158 total yards and overcame a sloppy, penaltyfilled performance to win. “Our fans were better than our team today,” Ryan said, bemoaning the Jets’ 11 penalties for 105 yards. “We never had any takeaways and had two turnovers, so that’s obviously a work in progress. It has to get better for us to do what we want to do.” With the game still in the balance, Ivory rushed up the middle and appeared stopped. He slipped a few would-be tacklers and took off into the end zone. A pass on a 2-point conversion failed. Carr, the Raiders’ second-round draft pick, made it close with a 30-yard touchdown toss to James Jones, who made a leaping grab over Darrin Walls with 1:21 left. The Raiders tried an onside kick, but Greg Salas recovered to seal it for the Jets. “We’ll take it,” Ryan said. “I’m not very happy with it, but it’s a victory.” Geno Smith was shaky early with an interception and lost fumble. But he threw a 5-yard touchdown pass to Chris Johnson as the Jets sent the Raiders to their 14th straight loss in the Eastern time zone. Smith finished 23 of 28 for 221 yards. “We’ve got high expectations,” Smith said. “We can’t shoot ourselves in the foot and we can’t make excuses for it.” Ivory finished with 102 yards on 10 carries, while Johnson had 68 yards rushing in his Jets debut and caught five passes for 23 yards. The Jets were fired up by comments made

by former right tackle Austin Howard, saying the Raiders would push around his exteammates. “They certainly did that, to the tune of 25 yards rushing,” Ryan said sarcastically. “And they gave up (212) rushing.” Carr, who got the nod over Matt Schaub, held his own in the first half, but the Jets pressured him throughout the final two quarters. He finished 20 of 32 for 151 yards, with touchdowns to Jones and Rod Streater. “I don’t think the game was too big for him,” Raiders coach Dennis Allen said. “Overall, I saw some positive signs, some things that he did well. Obviously, I saw some mistakes.” With the Jets leading 10-7, the defense came out roaring to start the second half, holding the Raiders to minus-3 yards in the third quarter. “I need to do a better job of putting us in better situations,” Carr said. “Now I have to do a better job of making the correct calls. You can put it all on me.” Carr had a short field to work with after Charles Woodson intercepted Smith. He got his first NFL touchdown on a screen to Streater, who scored from 12 yards to give the Raiders a 7-3 lead. Smith turned it over again on the next possession, killing a long drive, when he fumbled - with Michael Vick lined up at wide receiver - while trying to get into the end zone. Sio Moore plowed into Smith, knocking the ball loose, and TJ Carrie recovered. Johnson, signed by the Jets as a free agent in April, took a shovel pass and stretched into the end zone for a 5-yard score that put New York up 10-7 just 30 seconds before halftime. The Jets nearly got a touchdown on some trickery on the previous play when Vick lined up as a wide receiver, sprinted into the backfield and took a flip from Smith. Vick zipped a pass just wide of an open Eric Decker as the ball went off his fingertips in the end zone. It ended a sloppy first half for the Jets, who were called for eight penalties, including one that was declined. The Raiders had no first-half penalties, and finished with four.
