Was nixing of SMMUSD board election unfair? BY JEFFREY I. GOODMAN Daily Press Staff Writer

As he considered running for a seat on the Santa Monica-Malibu school board, Jason Feldman knew he would probably need more than the required 100 citizen signatures.

The local parent figured several names would be disqualified by county officials for a variety of reasons, but he thought 121 would be enough. Forty were nullified. Those rulings led to the disqualification of Feldman as a candidate, which led to the cancellation of the SMMUSD board election, which has led to concern among

some community members about the entire process. “Ultimately the responsibility is mine, but I do feel my being disqualified was unfair and a disservice to voters,” Feldman said. “I was told I would have time to obtain supplemental signatures if necessary. As the deadline approached, I inquired about

obtaining additional signatures, but was denied that opportunity. “The City took their time sending the signatures to the County and the County took their time in validating the signatures, leaving me no opportunity to cure any problems SEE SMMUSD PAGE 6

Alive and Kickin’ Cancer Local foundation’s 5k supports preventive care

Almost every weekend, Lynne Cohen wanted to spend time at the beach in Santa Monica. From her Brentwood home, she would call what was then the Sand & Sea Club beach house and ask if the overcast skies had burned off. “That’s where we spent every weekend,” recalled her daughter, Amy Cohen Epstein, a current Santa Monica resident. “Even on cloudy days. She was this really unbelievable person. ... She was one of those ladies. People knew her, or they knew about her. She was so spectacular.” Nearly two decades after the death of her mother, Cohen Epstein’s nonprofit organization is still honoring her memory by helping other women fight against ovarian and breast cancers. The locally based Lynne Cohen Foundation’s 15thannual Kickin’ Cancer 5k fundraiser is scheduled for Oct. 2 on San Vicente Boulevard in Brentwood. Money raised through the event will support operations at the foundation’s four preventive care clinics, where women receive screening and care for breast and ovarian cancers. There are two clinics in New York and one in Alabama as well as one in Los Angeles. In one visit clinic patients can meet with medical specialists, nutritionists,

The Los Angeles County Board of Supervisors has thrown its support behind the City of Los Angeles’ $1.2-billion bond measure to build housing for the homeless. If approved by voters on November 8, Proposition HHH would finance the construction of 8,000 to 10,000 permanent supportive housing units for the chronically homeless over the next decade. It would also fund affordable housing, temporary shelters and other amenities needed by the homeless and those at risk of becoming homeless. “Let’s get on with the business of making a significant dent in homelessness,” Supervisor Mark Ridley-Thomas said. “We cannot afford to allow the status quo to persist – our fellow Angelenos are depending on us.” Testifying before the Board, Mayor Eric Garcetti explained that Proposition HHH stands for homelessness, housing and hope. He added it goes hand in hand with the County’s own efforts to address the crisis of homelessness. “A year ago, we didn’t have a strategy. A year ago, we weren’t working together. Today, it’s a very different picture,” the mayor said. “We’re now aligned in a comprehensive homelessness strategy to make sure that we can address the immediate needs of unsheltered residents.” Councilman Marqueece Harris-Dawson said Proposition HHH would house women, children, veterans, seniors, foster youth and the disabled, among others. “Without this bond, we would be stuck at about 3,000 units of permanent supportive housing,” he said. “With Proposition HHH, we can more than triple that number.” City Administrative Officer Miguel Santana said, “The plan addresses not just the immediate needs of the homeless, but the long-term needs.” He added a civilian oversight committee would be among those ensuring the funds would be spent appropriately. Ruben Gonzales with the LA Area Chamber of Commerce and United Way’s Christine Margiotta also testified in support of the motion. Additional Job Skills And Supportive Housing Program Approved For Foster Youth

Supervisor Michael D. Antonovich announced the unanimous approval by the Board of Supervisors for a contract with the YWCA of Greater Los Angeles to provide essential job training skills for foster youth ages 18-21, along with onsite housing. “Upon emancipating from the system, many foster youth find themselves unemployed, on public assistance, homeless, or incarcerated,” said Supervisor Antonovich. “This proposed program through the YWCA is an innovative workforce development partnership for foster youth who can learn job skills while living in a supportive housing environment with other youth.” The board action will further improve integrated service delivery to serve non-minor dependent foster youth. Money talks, but in Santa Monica, developers’ money howls! On one of the last undeveloped beach lots, 1920 Ocean Front Walk, 83 residential units are being proposed, along with subterranean parking. Its 47 foot height will block the view of existent dwellings and make a mockery of traffic flow, especially in the beach season. Recent tsunami warnings by the city go unheeded for these beach dwellers and their underground garages. We need to consider the welfare of the greater community when developing public spaces. I propose an arts center, We have an extensive colony of artists whose contributions do not get the attention they deserve. Bergamot Station received funding from the Endowment for the Arts. Santa Monica/ Malibu schools will get $600K for art education, and Santa Monica Community College has a first rate arts program. Let’s give these artists an opportunity to display their works to a large appreciative audience. Many local families, especially with children, are overwhelmed by their numerous responsibilities. They do not have the opportunity to visit LACMA or Bergamot Station. But when going to the beach, visiting an art center is doable. Let’s not forget the sizable number of international travelers who would be wowed by our local art scene.

Follow the Money – Local Ballot Measures FIVE BALLOT MEASURES QUALIFIED FOR

inclusion in the November 8, 2016 Santa Monica election. Money and political endorsements now gravitate to both sides of each measure as local elected officials, prominent residents, members of advocacy groups, political organizations and specifically targeted political action committees (PACs) which have no limits on financial contributions – all battle to sway public opinion and garner votes. In this article and a follow-on next week, here is the field of play: The Land Use Voter Empowerment Initiative (LUVE), Measure LV, is the only grassroots initiative measure, submitted with over 10,000 resident signatures. The initiative would amend the City’s General Plan to require a new permit process for major development projects exceeding base size heights of 32-36 feet. Measure LV requires voter approval of major development projects and development agreements (excluding affordable housing, moderate income and senior housing projects, among others) as well as voter approval of changes to City land use and planning policy documents. In favor of LV are Residocracy founder and civil engineer, Armen Melkonians; Residocracy Board members Kate Bransfield, Ellen Hannan, Zina Josephs; and, Richard Hilton, Vice-chair/former chair Santa Monica City Housing Commission and Executive Director, West LA Council for Seniors. As of the June 30, 2016 Campaign Disclosure Statement, Residocracy has raised $26,654 to support LUVE with $12,701 spent for web services. Opposing LV is a coalition of civic heavyweights including councilmember and former Mayor Kevin McKeown; Barbara Inatasugu, President of Santa Monica League of Women Voters; Linda Sullivan, SMRR Steering Committee member; Nathaniel Trives, former Mayor of Santa Monica; and Harry Keily, teacher and former President of SMMUSD Classroom Teachers Association. Two PACs are raising and spending money to defeat LV: Housing Opportunity for a Modern Economy (HOME), sponsored and funded by housing developers NMS Properties ($225,000), Mass Equities, Inc., Century West Partners ($25,000) and Cypress Equity Investments (a partner of Century West). As of June 30, 2016, HOME had raised $125,000 and spent $46,151 on

political consultants, slate mailers and campaign literature. The second anti-LUVE PAC, Santa Monica Forward Issues Committee, is lead by Judy Abdo, a former mayor. Ms. Abdo, along with council member Terry O’Day, lead a similar PAC, Save Our City, in opposition to Prop T, a 2008 Initiative to limit commercial growth that subsequently was defeated. Santa Monica Forward’s PAC raised $10,255, with the biggest donations of $1,000 each coming from Theodore Kahan, a real estate investor, and Jeff Klocke, manager of Pacific Park. Santa Monica Forward has spent less than $600 on a fundraiser to date. The City Council voted to place two measures on the ballot. GSH and its companion advisory measure add a half-cent increase in the Transaction and Use Tax to city coffers, the funds to be allocated for preservation and building affordable housing and schools. Measures GSH are promoted by prominent civic group leaders including Sarah Braff, President of the SMMUSD Classroom Teachers Association; Michael Soloff, Chair of the Housing Commission; Jennifer Smith, President of the PTA; Patricia Hoffman, Co-chair of SMRR; and, Barry Seid, AARP District Co-coordinator. Opposing the GSH measures are Roberto Rodrigues, renter; Clara Benrey, retired School Teacher; Donald Gray, former Chair of the Pico Neighborhood Association; Scott Kelso, Union Member; and Robert Kronovet, former Rent Control Board commissioner. As of June 30, 2016 no money had been raised either for or against the two GSH measures. Two further measures, V, the Santa Monica College $345 million bond measure, and SM, which stipulates changes to Santa Monica’s anti-corruption Oaks law, will be addressed in a separate article next week. extinction, cloning seems like a viable solution to rebuild populations. Using DNA from already deceased animals, cloning can even increase the diversity of a gene pool. There are only seven white rhinos confirmed to be alive today, for example, so adding only a few more through cloning could mean the difference between extinction and survival of the entire species. Why, then, do many environmentalists oppose the artificial cloning of endangered species? Cloning is often thought of as unnatural and inhumane, but it was, in fact, the first method of reproduction and is still very common in nature today. Asexual reproduction, the oldest form of cloning, is used by aspens, stick insects and Kentucky Bluegrass. Artificial cloning began in 1928, when Hilde Mangold took a first step: injecting DNA into an egg. By 1952, the first animal was successfully cloned. It was a tadpole. Perhaps the most notable clone in recent history, Dolly the Sheep, was the first mammal to be cloned from an adult cell. The first endangered animal to be cloned was the Gaur in 2001. But along with these successes were many failed and forgotten clones. Even the cloning of common, well-understood animals is difficult. Dolly the Sheep was the result of the 434th cloning attempt and only lived to just over half the average lifespan of

a sheep. When the animals are endangered and their reproductive physiology is not well understood, cloning gets even more difficult. Cloning of endangered species has a wildly low success rate; usually under one percent. Even successful clones are often not able to themselves reproduce and usually live shorter than average lives. Because of the potential for reducing the already low numbers of existing population of endangered species, scientists often use close relatives for eggs and as mothers to gestate the cloned embryos. This often results in the mother rejecting the egg or if the clone is born, reproductive complications. Due to such inefficiencies, most environmental leaders are not bullish on cloning endangered species. “The potential of cloning is intriguing, but it’s been very little tested in terms of its practical application,” says Oliver Ryder, an endangered species expert at the San Diego Zoo. “The way to preserve endangered species is to preserve them in their habitat.” Despite not being a viable current method for saving endangered animals, cloning could very well be effective in the future. “Frozen zoos” in San Diego and Brazil hold the genetic material of extinct and endangered animals and could be used if need be and if the technology improves. In the meantime, and as Ryder points out, efforts to stop poaching and the destruction of habitats—rather than high-tech fixes like cloning—could go much further to preserve species.

ON SEPTEMBER 1, AT ABOUT 12:24 A.M. Officers responded to a radio call for service regarding a subject creating a disturbance, yelling and throwing items at a building, in the 600 block of Ocean Avenue. Officers arrived and made contact with a subject in the 100 block of Idaho Avenue. The subject identified himself to officers and indicated he was on probation for theft. A search of the suspect revealed an identification card and credit card belonging to another person. The suspect was placed under arrest and transported to SMPD Jail. Joaquin Alvarez Jr., 22, of Montebello was issued a citation for appropriation of lost property.

The Santa Monica Community College District is requesting qualified persons, firms, partnerships, corporations, associations, or professional organizations to perform the program and construction management services for the District’s Bond Construction Program. The initial contract will be for three (3) years but is subject to renewal with satisfactory performance. Over the last several years, Santa Monica College has been upgrading and refurbishing facilities funded in large part with bonds authorized by Measures U, S and AA. There is a new bond initiative, Measure V, for $345 million on the November 2016 ballot. Final award of this contract may be subject to passage of the Measure V.

as the deadline had already passed by the time the determination was made.” Feldman was planning to be a challenger in a Board of Education election that was scheduled for November. The election was canceled, however, because the number of qualified candidates (three) now equals the number of available seats. Incumbent board members Maria Leon-Vazquez and Ralph Mechur will remain on the seven-member governing body, and Jon Kean will replace retiring board member Jose Escarce. Mechur, Leon-Vazquez and Kean will be officially named to the board at the entity’s meeting Dec. 15, when it will select a new president and vice president for the year, according to SMMUSD spokeswoman Gail Pinsker.

The school district has the right to cancel a board election if the number of candidates does not exceed the number of seats to be filled, according to Santa Monica City Clerk Denise Anderson-Warren. Her office contracts with the county clerk’s office to review and verify signatures. Following Feldman’s disqualification, SMMUSD officials consulted with the county Office of Education and the City of Santa Monica, which handles elections for the school district, before deciding to cancel the election, Pinsker said. The district, which had budgeted $200,000 for the election, is now only on the hook for small costs associated with paperwork processing. Feldman, a Santa Monica-based lawyer who has lived in the district for nearly 10 years and who has two young daughters in the school system, said he was surprised to hear that the election was being canceled considering he was told a day earlier that he could run as a write-in candidate despite his disqualification.

“I was also disappointed for Santa Monica and Malibu voters,” he said. “I think it is better for voters to decide instead of by appointment by current school board members.” Feldman said he didn’t have time to challenge his disqualification because county officials returned their review of his collected signatures after the appropriate deadline. Feldman entered the race with the goal of helping the district improve outcomes for all students, particularly those with special needs, and trying to close longstanding academic achievement gaps. “I also hoped to help Santa Monica and Malibu stay united and cure the annual budget shortfall to set the district on a course of success for the future,” he said. “I look forward to serving the community in another way.” jeff@smdp.com

The in-person cooperation, foundation spokeswoman Ginna Anderson said, yields more effective care. “It’s really about collaboration and multidisciplinary, human-centered care that’s really personalized,” she said. It’s the kind of care that foundation officials believe is crucial in the fight against breast cancer. It was the most common cancer among women between 1976 and 2012 in Los Angeles County, according to a recent report by the Los Angeles Cancer Surveillance Program, which is a project of the USC Norris Comprehensive Cancer Center and the university’s Keck School of Medicine. Breast cancer rates are now declining or steady in most ethnic groups here, according to the report, but risk factors remain. “Breast cancer risk is higher among women with a family history of the disease, suggesting that genetic factors are important for some women,” the report reads.“Regular physical activity, which may delay puberty and regular periods and reduce obesity, reduces breast cancer risk.” Physical activity is exactly what participants will get at the Kickin’ Cancer 5k, which over the years has grown from a small gathering of friends and families into a major fundraiser with thousands of runners, walkers and supporters. The 5k has raised more than $3 million since its inception. “The best part about this event is I don’t know that many people anymore,” said Cohen Epstein, who is the executive director of the foundation. “It’s all these people who are really there for the cause.” It’s a personal cause for Cohen Epstein, who left Duke University and started taking classes at UCLA so she could be closer to her family after her mother died in 1998. She has since lived in New York, Washington D.C., and Abu Dhabi, but she and her husband moved to their current home on 10th Street in Santa Monica a few years ago and hope to stay for a long time. Cohen Epstein’s wants to keep expanding the Kickin’ Cancer fundraiser because she feels her mother’s legacy is at stake. “Of all the events we do, it’s the one that is most like my mom,” she said. “Kickin’ Cancer is a day full of family and health and wellness and sunshine and life and exercise. It’s really what signifies her.” The Kickin’ Cancer event hub will be located at 11620 San Vicente Blvd., in Brentwood. Troubled Waters ■ The lead-tainted water supply woes of Flint, Michigan aren’t unique. It’s a serious concern across the country -- and not just about lead. According to the Environmental Protection Agency, at least 6 million Americans are being exposed to higher-than-recommended levels of industrial chemicals in public drinking water. ■ The finding, based on 36,000 EPA-collected water samples, covers a widely used class of chemicals known as PFASs, which have historically been used in products like fire extinguishers and food packaging. They’ve been tied to cancer and other diseases. ■ The EPA estimate may be on the low side because regulators don’t have data on PFAS levels for one-third of the nation’s public water supply.
