On Tuesday, the City Council will debate adding a controversial requirement for restaurants and other food vendors who lease Cityowned property to enter into a labor peace agreement (LPA) with a local union. The requirement could impact everyone who sells food on The Santa Monica Pier from the Churroman cart vendor to Bubba Gump Shrimp Co. The idea faces strong opposition from the Santa Monica Chamber of Commerce, arguing it threatens the livelihood
of small business owners who cannot afford to go head to head with unions such as Unite Here Local 11 to secure a lease. Tuesday’s discussion is agendized as a “study session” meaning the Council will hear from staff and the public and then give direction. The proposed language, similar to a provision that regulates restaurants and other venders at LAX, would require business owners or managers to negotiate and then submit a LPA with a worker’s union as a condition of operating on the Pier, Downtown or the SEE COUNCIL PAGE 6

The General Fund ended the fiscal year with an extra $10.9 million more than budgeted, thanks to both extra revenue ($4.5 million) and lower expenses ($6.4 million) than initially expected, according to a new report from the City’s director of finance. “The context for this good news is crucial,” Gigi Decavalles-Hughes wrote in the report. “Despite concerns about a slowing in the growth of key economic drivers (particular-
ly retail and tourism), the prior fiscal year continued to reflect the underlying strength of Santa Monica’s diversified economic base.” Some of the extra funds will go toward the homeless crisis, new technology at City Hall like Total Workplace and $200,000 will go toward developing a long-term strategy for economic sustainability. Decavalles-Hughes says $3.7 million will be set aside toward the construction of the Civic Center Multi-Use Sports Field. About $1 million of the
increased revenue came from hotel and parking facility taxes, although some gains were offset by lower than anticipated parking revenue and sales tax. The remaining $3.5 million of the unexpected increase came from development-related fees, property sales, and a return of unspent contributions from EXPO. Montana Avenue Traffic Signal Replacement For the week of October 23, work will continue along the Montana Avenue corridor at 4th and 14th Streets. The entire intersection hardware will be replaced, including poles, signal and pedestrian heads, controllers and underground conduit. Work includes underground utilities, curb ramp construction, traffic signal installation, and all activities necessary to implement the traffic signal improvements. Work areas will be contained; crews will make practical efforts to minimize sound, dust, and disturbance to the neighboring community. One lane of traffic in each direction will be maintained. Work is scheduled to take place between the hours of 8am - 3pm, Monday – Friday, until November 2017. Storm Drain Catch Basin Pipe Screens Project
The LA County Public Defender has won the Silver Eagle Award for its Public Defender Jail Liaison Program — the second-highest award in the Top 10 category — during the 31st Annual Productivity and Quality Awards Ceremony on Oct. 18, 2017 at the Dorothy Chandler Pavilion. “You have demonstrated what effective collaboration among departments looks like,” Los Angeles Board of Supervisors Chair Mark Ridley-Thomas told winners during the ceremony. “You’ve set an example of what a public sector should strive to achieve.” The new LA County Public Defender program assists incarcerated, mentally ill and developmentally disabled clients. The award honors LA County departmental improvement efforts deserving recognition by the Board of Supervisors, Chief Executive Office, Quality and Productivity Commission and the public. Called the Jail Mental Health Liaison Program, the effort for the first time allows Public Defender licensed clinical social workers direct access to detained mentally ill and developmentally disabled inmates. These efforts help ensure the inmate receive the correct medication, proper interventions, more humane treatment and alternatives to remaining in custody. The approach also improves their legal outcomes in court. The Public Defender program was developed in collaboration with the Department of Mental Health (Health Services) and the enthusiastic support of the Sheriff and the District Attorney. Since its inception in January 2016, more than 400 mentally ill and developmentally disabled inmates have benefited from this crucial service, significantly reducing the need for these vulnerable clients to endure forced, often-violent physical extraction from cells. To date, the program has prevented 62 jail extractions. Often, mentally ill clients in custody are incapable of meaningful communication with their attorneys either in person, or through video conferencing and telephone calls. Many are not taking proper medication, suffer from depression or become suicidal. They may refuse to exit their cell to appear in court. This may result in disciplinary issues. The attorney-client relationship may suffer. The social worker liaison streamlines each client’s case and improves the way the Public Defender functions in general. Before the program, if a mentally ill client had an issue in jail — not taking their medication, refusing to go to court or eat, becoming despondent — sheriff’s deputies would contact the client’s attorney, who would try to schedule a meeting usually at a later date. Now, deputies email the liaison team and within 24 hours, typically much sooner, a Public Defender social worker at the Twin Towers Correctional Facility where most mentally ill inmates are housed, meets with the client face-to-face. With the inmates’ mental health issues analyzed, assessed and resolved by the liaison, Public Defender attorneys can focus their attention on the legal aspects of the case. These coordinated efforts expedite case processing, and result in better case outcomes and quicker mental health services for the client. Often, after the social worker speaks with a client refusing to leave his cell, the issue is resolved, eliminating the need for forced removal. Addressing the client’s underlying psychological and medical needs reduces court delays and ultimately helps the client move out of the criminal justice system. — SUBMITTED BY KERJON LEE

Surprise—Delicious Winter Squash in the Summer Heat! KEEPING UP WITH THE SEASONS IN THE
Santa Monica Community Gardens means growing year-round and being open to the surprises that abound. In our local Mediterranean climate, active gardening can be lively every day of the year. Yet, even with endless possibilities, planting a winter squash in spring for summer dining appeared crazy. Such is life in a community garden, particularly when we are willing to take a chance and receive gifts from the community that are available. After all, sharing underlies the relationships that help create a productive culture based on good practices and traditions. In fact, Santa Monica’s newest community garden is the Ishihara Learning Garden modeled on communal plantings and harvests. It was not unusual then, following an Ishihara celebration, that Teague, the City’s gardening specialist, offered leftover Waltham Butternut squash (Cucurbita moschata) seedlings to residents and gardeners. It was time to experiment and learn to appreciate a new opportunity. I had doubts. Randy, my partner-in-life and gardening, and I had never planted butternuts. Butternut planting definitely appeared off-season, and summer squash, typically the prolific zucchini, is my favorite seasonal ingredient to a scrumptious ratatouille. Randy questioned whether butternut’s sprawling growth would overtake our plot. We would need to cultivate with attention to restrain the crop. He believed the effort to be worthwhile so I grudgingly agreed to the attempt. Randy transplanted two Waltham Butternuts. We watered and tended and watched. It was hot. They rooted and grew. Emerald leaves opened. Butterscotch-colored squash flowers blossomed. Local wild bees and honeybees pollinated, and the
“vine” snaked across the beds, with small mint-green dumbbell-shaped protrusions emerging and, after weeks, bulging into beige then amber hard-shell gourds. The butternuts grew. And grew. And grew. At first five, then ten, fruit came forth. By the end of July, we stopped watering. Ten gourds became twenty and more and more gourds that soon would lay upon the soil. Fellow gardeners and visitors marveled. Many remarked that butternuts are their favorite. Seeing the plentiful harvest, we promised to share what I am used to thinking is a Thanksgiving food. By late August, a few were ready to test for dinner. Randy sliced the gourd in half, spooned out the seeds and soft mesh, filled the hollow with a mixture of balsamic vinegar, olive oil and light seasoning and roasted the gourd at high heat for 60 – 90 minutes. The Waltham Butternut tasted like dessert. No wonder that the name is said to have come from the “smooth as butter, sweet as nut” flavor. Today, six months later, a half-dozen remain, and little ones keeping popping forth. We have given away many. We have dined on a delicious winter squash in the summer heat. What is seasonal, after all, might only be a human determination as much as Nature’s favor. The best community gardeners observe carefully what is going on within the soil interacting with air, water and light, amidst the plants, pollinators, bugs and insects—to be wise in attending to nurture productive dynamic relationships among and within natural and human communities. Santa Monica Airport. The new LPA would go a step further than current lease requirements, which say tenants will not impede workers’ efforts to organize. The new language was introduced by nowMayor Ted Winterer and Councilmember Tony Vazquez and unanimously supported by the City Council during a meeting in Aug. 2016. At the time, Mayor Winterer said an LPA would prevent a work stoppage caused by a strike or other labor action that could hurt City revenues. Every year the City makes about $4.5 million from leases to restaurants and other food vendors. During the brief discussion, Councilmember Pam O’Conner directed staff to analyze the LPA’s potential effect on “mom and pop” businesses. More than a year later, the City report found the new language would impact 27 out of 101 properties managed by the City. The vast majority of those tenants are small businesses with fewer than 25 employees (19 versus 8). The Chamber sent a letter to the Council in advance of the discussion saying those small businesses would be under threat if the LPA was to be instituted. “One of our primary concerns with the proposal is the competitive disadvantage that it would place on businesses on city property, relative to those on private land

not subject to the new rule,” says the letter from Chamber president and CEO Laurel Rosen. “Requiring an LPA would lead to longer periods of vacancy and a greater likelihood of corporate/chain occupants on important city locations that are not only significant to city revenue, but also to the fundamental character of Santa Monica.” Business owners have also expressed concern labor organizations would have unilateral leverage in negotiating the LPA if it were required, and would burden the owners with the cost of hiring specialized legal assistance. The new regulation could also impact hundreds of hosts, waiters, waitresses and cooks who work on the Pier and downtown. The City has not experienced any work stoppages at City-owned properties and the impact of a required LPA on rental income and small businesses is “unknown and unpredictable,” according to a staff report by the City’s director of housing and economic development. “As a group, the City Tenants employ a range of full- and part-time positions totaling approximately 600 employees annually,” the report by Andy Agle states. The Airline Service Providers Association took the City of Los Angeles to court over the LPA requirements at LAX. This past summer, the Ninth Circuit Court of Appeals upheld the City’s right as landlord to set requirements for tenants on City-owned space. kate@smdp.com

ON OCTOBER 14, AT ABOUT 10:37 P.M. Officers responded to Nordstroms – 220 Broadway regarding a theft suspect in custody. Officers arrived and spoke with Loss Prevention Staff. Officers determined the subject entered the store and selected various items from the sales floor. The subject proceeded to the register and purchased approximately $2,000 worth of merchandise using a Nordstrom card belonging to another person. The clerk notified Loss Prevention Staff. The subject was detained. The store was desirous of prosecution and there was no loss. The subject was placed under arrest and transported to SMPD Jail for booking. Terrence Darnell Matthews, 22, from Detroit, was arrested for larceny. Bail was set at $20,000.

The City’s reserves will be bolstered by nongeneral funds, which ended the year $54.6 million over budget, according to the report. “These funds will be used to build reserves, fund ongoing operations, and support future capital projects,” the report said. As part of the effort to address economic changes and homelessness, the City is expected contribute about $200,000 to Santa Monica Travel and Tourism for a “destination and perception study.” The study will survey residents, business owners and visitors on homelessness, quality of life and tourism. The city hopes to establish benchmark data to monitor ongoing sentiment and perception of life in Santa Monica.
On Tuesday, the City Council will weigh in on how to best use $1.4 million set-aside to address homelessness, whether by pursuing regional partnerships, street outreach teams or expanding or refocusing existing resources. “Historically, the City has made investments of land, capital funding, operational support, and significant political will to address homelessness,” the report says. “One-time City and County funds are being used to pilot new intensive street-based services to high users of local emergency services and develop mobile technology to transform the way that City first responders and front-line staff interact with people experiencing homelessness.” Staff also recommends appropriating $700,000 to renovate the dinosaur fountains at the Third Street Promenade and to replace equipment for Breeze Bikeshare. After City staff reviews the end of the year budget performance, they will present their findings to the Council in January 2018.
