CITY HALL Two member of City Council would like an ordinance created that would require lobbyists to register with City Hall. The ordinance would “require lobbyists representing clients who seek benefits or contracts from the City to register with the City and provide other information that will help promote transparency.” Mayor Pro Tempore Tony Vazquez and Councilmember Sue Himmelrich put the idea forward to be discussed at Tuesday’s meeting. If a majority of the council members support the idea, the city attorney will come back with a specific ordinance to be considered next year. In the city of Los Angeles, lobbyists are already required to register. “Any individual,” reads L.A.’s website, “who directly communicates with a City official for the purpose of influencing ‘municipal legislation’ (as defined in the ordinance) and who is compensated to spend 30 or more hours in any consecutive three-month period engaged in lobbying activities must register as a lobbyist with the City Ethics Commission.” Himmelrich had said during her campaign — she took office this month — that this was one of the first moves she’d make once on council “Different people have different interpretations of what a lobbyist is,” she said. “I think we want to capture as many people who are trying to get benefits from the city as we possibly can. In conjunction with that, I think we should be registering everybody seeking something for a client, including nonprofits, including — to the extent they aren’t practicing law — lawyers.” Himmelrich is concerned that residents aren’t aware who is being paid by whom. “This is not about anything other than transparency for the people who live here so they know who’s in and out of City Hall and how much they’re being paid to do it,” she said.

SEEDY BAY CITY In Raymond Chandler’s murder-filled mysteries, often the strangest and coldest crimes were carried out in Bay City, the writer’s stand-in for Santa Monica. One hundred years ago this month, about a year after Chandler first moved to Los Angeles, the Santa Monica police were busy. “HEAD OF AN UNKNOWN MAN IS BURIED AFTER YEAR,” reads one Los Angeles Times headline from December 1914. The man was found dead, hanging from the rafter under the burned-out Dragon’s Gorge at Ocean Park, the report says. Dragon’s Gorge was an impressive
multi-block structure, built right on the water, that included, among other things, “The House of Mystery” and a roller coaster called the “Scenic Railroad.” It burned down with the rest of Fraser’s Million Dollar Pier in 1912. The hanging man was identified as the husband of Minta Jordan, who collected a $5,000 insurance policy on his life — valued at more than $100,000 today. The body of the supposed Mr. Jordan was buried at the Woodlawn Cemetery until a few months later when the real Mr. Jordan mailed in his insurance premium. The body was exhumed and the head, which didn’t look much like Mr. Jordan, removed.
A fraud case was brought against Mrs. Jordan but later dismissed after she returned the money. The head was nicely preserved in hopes that family of the man would come forward and identify it but, after a year of no takers, the District Attorney decided it needed to be reburied. SMC maintains prized transfer status Santa Monica College maintains its hold as California’s No. 1 community college in transferring students to the prestigious University of California system, for the 24th year in a row. This finding came from recent 2013-14 transfer data released by the California Community College Chancellor’s Office. SMC came second in transfers to the UC and the California State University systems combined. Another category in which SMC showed up as No. 1 was in the number of AfricanAmerican and Latino students transferred to UC. The college sent significantly more African-American students - 51 - a large leap compared to 31 from the previous year. Dan Nannini, SMC Transfer Center Faculty Leader attributed this record growth to SMC’s Black Collegians program, which provides counseling and support services to students of African descent. “The Black Collegians program in the African-American Collegiate Center supports their students with excellent counseling, tutoring and a variety of academic and social programs to help students meet their goals, one of which is attending the University of California,” said Nannini. In 2013-14, SMC transferred a total of 1,061 students to UC, maintaining its hold as the number one transfer institution — by far outranking the No. 2 and No. 3 UC feeder schools, which transferred 756 and 741 students, respectively. Other statistics for 2013-14 illustrate why Santa Monica College is considered California’s premier transfer institution: Santa Monica College maintained its hold on first place in transfers to the University of Southern California, from 160 students in fall 2013 to 191 in fall 2014 (USC reports transfers only for the fall). SMC transferred over 70 percent more

SMC Latino student transfers to UC campuses increased to 150 from 141 in 2012-13. SMC came in a close second for transfers to the UC and CSU systems combined, with 2,083 students as compared to the top feeder, which transferred 2,152 students. “Santa Monica College continues to demonstrate through the years our commitment to transfer — but we are working continuously to provide even more pathways for students into four year universities,” said SMC President Dr. Chui L. Tsang. “We strive to do this in a way that will close the achievement gap for many of our students.” “SMC’s commitment to counseling and student services is second to none,” says Nannini. “We offer the courses student need to be successful, and our faculty keeps the bar high so that students succeed after transfer.” Among other reasons for SMC’s strong transfer reputation, Nannini cited the recruiting of good students and keeping SMC’s transfer reputation in the spotlight. Nannini also pointed out that SMC’s Transfer Center hosts the largest college fair in the state. This fall, representatives from 160 colleges and universities worldwide came to the SMC Transfer Fair to recruit students. SMC’s Transfer Center also conducts workshops, holds weekly visits from fouryear institutions, and has a close working relationship with UC and CSU to make sure SMC students get credit for their classes. UCLA continues to be by far the most popular destination for SMC students, with nearly 42 percent of the UC transfers — 444 — going to the Westwood campus. San Diego came in second with 156 transfers,

DUI Checkpoint The Santa Monica Police Department’s Traffic Unit will be conducting a DUI/Driver’s License Checkpoint on Dec. 19, at an undisclosed location within city limits. The operation will take place between the hours of 7 p.m. and 3a.m. The deterrent effect of DUI checkpoints is a proven factor in reducing the number of persons killed and injured in alcohol and/or drug related collisions. Research shows that accidents involving impaired drivers can be reduced by up to 20 percent when well-publicized, enforcement checkpoints and proactive DUI patrols are conducted routinely. Traffic Officers will be looking for objective signs of alcohol and/or drug impairment and verify that motorists are in possession of a valid driver’s license. In California, drunk driving led to the deaths of 802 persons in 2012. Nationally, the latest data shows nearly 10,000 people were killed by impaired drivers. Recent statistics reveal that 30 percent of drivers in fatal collisions had traces of one or more drugs in their systems. The study showed that more drivers tested positive for drug impairment (14 percent) than did for alcohol (7.3 percent). According to the National Highway Traffic Safety Administration (NHTSA), checkpoints have provided the most effective, documented results of any of the DUI enforcement strategies, while also yielding considerable cost savings of $6 for every $1 spent. Nearly 90 percent of California Drivers approve of DUI checkpoints. Funding for this checkpoint is provided

Schools to solicit funding feedback online The Santa Monica-Malibu Unified School District will be hosting a series of LCAP (Local Control Accountability Plan) Webinars to solicit input from parents, students, staff and community members. In 2013, the state of California adopted a new formula for funding public education called the Local Control Funding Formula (LCFF). When fully implemented, the LCFF will allocate funds based on specific student needs and will allow maximum flexibility at a local level. As part of the LCFF, school districts must develop, adopt, and annually update a three-year plan called The Local Control Accountability Plan (LCAP). The LCAP is to be written and developed with feedback and input from community stakeholder groups. Staff, parents and students will be asked to provide input on eight different components of the LCAP. The next webinar is scheduled for Dec. 17 at 6 p.m. Stakeholders are invited to provide input into the LCAP revision by completing a post-webinar survey. I’m writing to state my enthusiastic support for Jake Wachtel to fill the open position on the SMMUSD Board of Education. I’ve known Jake ever since my son started kindergarten a Grant Elementary two and a half years ago. At the time, Jake was our PTA president, as well as an active, involved and enthusiastic parent in the classroom. From the time we met, I was impressed by Jake’s warm, friendly nature, intelligence and passion for creating the best possible learning environment for all of the students at Grant. Jake has always been supportive of parents in their attempt to affect positive change in the school district, while at the same time well informed about how the school district operates and how to work effectively within that system. As I’ve gotten to know Jake better over the years, I continue to marvel at his overall positive attitude and steadfast determination to make SMMUSD live up to its huge potential to create a safe, supportive and comprehensive educational environment for all of the students in our district. I would be thrilled to see him sitting on the board, and wanted to share my thoughts.

A seat at the table BY NEXT JUNE, HUNDREDS OF MUNICIPAL
zoning codes will have to be revised and approved. They must adhere to the update of the Land Use and Circulation Element (LUCE) — a key component of Santa Monica’s General Plan which establishes the City’s land use, urban design, and transportation vision. The new codes will govern all aspects of new construction and development in the city for the next twenty years. Residents want zoning ordinances that will keep a lid on development and traffic, restrict heights and density, protect housing and structures of merit, insure adequate parking and contribute to a more attractive and livable community Developers primarily want to develop projects that are marketable and profitable, with few limitations on height, mass and density. Generous building codes are their ticket to projects that make more money. I’ve written previously about a number of last minute changes requested by land-use attorneys, developers and the Santa Monica Chamber of Commerce favoring businesses and developers — and opposed by most residents — that were incorporated into the LUCE in the immediate weeks before its approval five years ago For four plus years the Planning and Community Development Department has been working on code updates and revisions to implement LUCE goals. Residents and business interests alike have been engaging in a tug of war on the wording of final codes and standards that will balance resident “quality of life” issues with the business community’s fiscal health. Suspicions arose a year ago when neighborhood leaders were scrutinizing zoning maps in the LUCE and noticed that over 100 “A” lots citywide (residentially zoned lots mostly adjacent to commercial properties and used for parking) had been mysteriously changed to “commercial” designations. Planners were caught by surprise. Everyone played dumb when asked how the conversion of residential to commercial designation had come about and who made the changes. After weeks of stonewalling and buck-passing, Planning Director David Martin disclosed that the map designating the “A” lots as commercial properties was part of the LUCE presentation approved by City Council in July, 2010. Apparently, nobody noticed the map changes, including those on the Council dais who approved the LUCE, until they were spotted by Tricia Crane and Amy Aukstikalnis of the Northeast Neighbors neighborhood group. After much wrangling, Martin indicated that the changes were “in error” and the map would be corrected. Still unanswered are the questions as to how and why the changes were made, who actually made the changes and who approved them as part of the LUCE presentation. The “A” lot changes clearly benefit developers with commercial projects because it enables them to combine street fronting commercial properties with adjoining “former” residentially-zoned lots and

build a much larger and profitable commercial project such as an apartment/mixed use development or car dealership. Similarly, a few weeks ago, troubling new language suddenly popped up in the redline draft of the Zoning Ordinance Update’s “Purpose” section. It called for regulations to “enhance the City’s fiscal health.” Nobody would fess up to where it came from and why it too appeared without any public discussion. Kinda makes you wonder who is in charge, doesn’t it? At the December 3, Planning Commission meeting, Sue Himmelrich (now on City Council) challenged the “fiscal health” language that had been added to the redline update. Himmelrich proposed “fiscal health” be removed because she could foresee the day when land use lawyers would use it to advance “crappy projects” that “give the city a little money.” Deputy City Attorney Barry Rosenbaum who advises the Commission, argued vehemently to persuade commissioners to keep the language in. Then, Commissioner Jennifer Kennedy revealed the source of “fiscal health” was land use/developer attorney Chris Harding. Kennedy said, “I know you are saying you don’t know where it (the added language) came from but in that same letter I referenced earlier — a year-old, Dec. 10, 2013 letter the Harding law firm to Planning Commissioners and staff — (it) says, to please include a section with respect to resident serving facilities and services and please add a statement about the city’s “fiscal health.” I’m not faulting Harding for doing whatever he can to curry favor with his many developer clients, however I lay blame on planning staff and its legal advisors for the “screw the residents” shenanigans. It seems they are more interested in catering to landuse attorneys like Harding and developer interests than extending equal consideration to the voting taxpayers who live here and who pay their generous salaries. As the last few zoning update meetings unfold between now and the end of January, the question remains: Will the Planning Commission vote to recommend to council that large “activity centers” and five floor and higher buildings on major boulevards be scuttled as requested by residents? Or, will they keep them in to satisfy the desires of developers and their attorneys for bigger, denser and more profitable developments? And, what will happen to the “A” lots? For far too long, special insiders, lobbyists land use/developer attorneys and powerful influence peddlers have infused their presence in all aspects of city government and occupied most seats at the table. While powerful business entities co-host city events, attend meetings and have the ear of department heads and key staff, the rest of us are not invited to the party and casually dismissed in the debate on Santa Monica’s future. During the initial visit, applicants will be required to prove their identity and residency, and take a driver knowledge and vision exams. A behind-thewheel test will be given at another time. A: Anyone planning on visiting a DMV field office to apply for a first time driver license is required to schedule an appointment. However, the DMV has set up four temporary Driver License Processing Centers in Granada Hills, San Jose, Stanton, and Lompoc, where anyone can drop in without making an appointment. Biochar is a naturally occurring, finegrained, highly porous form of charcoal derived from the process of baking biomass — and it’s been associated with fertile soils for some two thousand years. “Biochar is found in soils around the world as a result of vegetation fires and historic soil management practices,” reports the International Biochar Initiative (IBI), a trade group representing the world’s burgeoning biochar industry. “Intensive study of biochar-rich dark earths in the Amazon has led to a wider appreciation of biochar’s unique properties as a soil enhancer.” Indeed, researchers have been hard at work perfecting their own methods for manufacturing biochar by baking biomass in giant oxygen-free kilns. The resulting biochar can then be used as a soil amendment to help restore tired, compromised farmland, not to mention contaminated industrial sites, all the while taking carbon dioxide out of the atmosphere. A liquid byproduct of the biochar production process can also be converted into a carbon-neutral “biofuel” that can displace other carbon intensive fuels. Farmers can layer biochar into their fields where it becomes part of the soil matrix and helps retain water and essential agricultural nutrients like nitrogen, phosphorous and potassium. “You can basically think of it as a soil reef upon which abiotic and biotic phenomena happen,” says David Shearer, CEO of Full Circle Biochar, one of a handful of U.S. based biochar start-ups working to commercialize the age-old “technology.” Farmers like the fact that
using biochar can lower their water and fertilizer bills as well as yield more and better quality agricultural products — leading to better market performance overall. “This is really a hedge for farmers,” reports Shearer. “It really helps them manage their financial risk and it helps them manage risk into the future around production.” Beyond agriculture, biochar can also be used to clean up polluted land. “For example, if you have a mine that has contaminated soil adjacent to it, biochar ... will allow you to remediate soils,” said Shearer. He adds that biochar also makes for an excellent filtration medium: “We know that activated charcoal has been used for millennia as a filter mechanism, and so there is discussion in the biochar community that maybe the first step is we’ll use it as a filtration media, and then we’ll move to agriculture as the cost of production of biochar comes down.” As far as environmentalists are concerned, the greater the demand for biochar the better, given the fact that it is a potent storage mechanism for carbon dioxide that would otherwise head into the atmosphere and contribute to climate change. “The carbon in biochar resists degradation and can hold carbon in soils for hundreds to thousands of years,” reports IBI. “We can use this simple, yet powerful, technology to store 2.2 gigatons of carbon annually by 2050. It’s one of the few technologies that is relatively inexpensive, widely applicable and quickly scalable. SMC proposes new degree Santa Monica College has announced its intent to submit a proposal to offer a Bachelor’s Degree in Interaction Design, to the office of Brice W. Harris, Chancellor of the California Community Colleges. In September, Governor Jerry Brown signed into law a bill authored by Senator Marty Block (D-San Diego) to allow 15 community colleges to offer baccalaureate degrees, in response to an overwhelming demand for skilled workers in fields such as technology, health and science. The legislation, Senate Bill 850, requires that the degree be unique — not duplicated at the California State University (CSU) or University of California (UC). It also requires that the proposed degree meet a local workforce need. Harris called the overwhelming interest shown by community college districts “heartening.” So far about half of the system — 36 districts including Santa Monica — have expressed intent to apply to be part of the pilot. SMC’s proposal for a Baccalaureate degree in Interaction Design, also referred to as “User Experience Design,” comes in direct response to the needs of Los Angeles’s tech industry — especially that of Silicon Beach, in the city’s Westside region. Silicon Beach is home to over 500 tech start-ups and also includes major companies such as Google, Yahoo, and EdgeCast Networks. SMC is located right in the heart of Silicon Beach. “This is an extension of our efforts to create pathways for our students to exciting careers that will pay them well, and a beautiful partnership with the local tech industry,” said Dr. Jennifer Merlic, SMC’s Dean of Instruction. “They’ve told us that this is an area where they have an overwhelming need —where they want to hire our students, at the BA level.” There are thousands of jobs available in this emerging and rapidly evolving field in LA County alone for individuals with an “interaction design” skills set, focused on how to balance functionality and aesthetics into something that works for the end user in the digital world. Only two private universities in California — Art Center College of Design and California College of the Arts — offer a bachelor’s level degree in this new field of interaction design. The programs at these two universities cost around $40,000 per year. If approved by the California Community College’s Board of Governors, a student could earn a degree at SMC at a cost of just over $10,000 for the entire program. “SB 850 is a game changer…students now have another door that can lead to a quality, affordable four-year degree,” said Senator Block. SMC has robust certificate programs in both graphic and web design with a large number of students enrolled in the lower division core courses of the proposed degree. The college has the facilities and resources needed to offer this degree — including the Academy of Entertainment and Technology — highly qualified faculty with industry expertise and strong involvement from the local tech industry. SMC holds a record, for the 24th straight year, as the #1 community college for transfers to the UC system and also transferred more African-American and Latino/Chicano students to the UC than any other community college. It is the only Southern California community college district to propose a degree in the area of Information Technology. “I look forward to working with the districts to create world-class programs that graduate highly trained and marketable students,” said Harris. PORTLAND, Ore. The economic recovery has not been equal among the races, according to a Pew Research Center study released last week. The study found that the wealth gap between white households and minorities has widened in recent years. The wealth of white households was 13 times greater than that of black households in 2013, versus eight times the wealth in 2010. And the wealth of white households was more than 10 times that of Hispanic households, up from nine times the wealth in 2010. Pew researchers — analyzing data from the Federal Reserve’s Survey of Consumer Finances— found that the gap between whites and blacks has reached its highest point since 1989. The wealth ratio for whites-to-Hispanics is at a level not seen since 2001. Net worth is a measure of the difference between the household’s assets and their liabilities. The typical household had a net worth of $81,400 in 2013, according to the Fed’s survey. The recession was universally hard on American families as a stock market crash and plunging house prices ate into their net worth. From 2007 to 2010, the median net worth of American families fell 39
percent. But this is the first time researchers have been able to look closely at the impact of the economic recovery on households. “I think this strikes on what many people have felt, the slow and uneven nature of the recovery,” said Rakesh Kochhar, one of the study’s authors. Researchers say a number of factors may be responsible for the widening gap: falling income, lower savings rate and different asset holdings. The median income in minority households fell 9 percent from 2010 and 2013, versus a 1 percent drop in white households. And in turn, researchers say, minority households may have either been forced to draw down from savings to get by or were unable to replenish their savings as much as white households. Additionally, certain financial assets, such as stocks, recovered more quickly than housing since the recession ended. And white households are more likely than minorities to own stocks, putting them in a better position for a recovery. Still, the researchers say that income has been under pressure across the races. “It’s been almost a decade now since the typical American has seen an increase in income,” Kochhar said. “It’s really historical in the duration of time that incomes have not risen.”
