CITY HALL City Council wants you to know your lobbyists. After discussing some specific philosophical beliefs about the definition of lobbying, council voted unanimously to have city attorneys draft an ordinance requiring lobbyists to register with City Hall.
The attorneys will come back with a specific ordinance for council's approval, likely sometime next year. “This is done in virtually all cities of our size and particularly of our budget and it's not something that's meant to be punitive or meant to be anything other than transparent,” said Councilmember Sue Himmelrich who introduced the idea along with Mayor Pro Tempore Tony Vazquez.
Mayor Kevin McKeown noted the item seemed to have two components. One would be the ordinance requiring that lobbyists register with City Hall. “The other that I heard, was very interesting, would just be a policy decision,” he said, “that henceforth the records of who meets with whom in the Planning Department are transparently available to members of the public. I'm pretty sure records are already

LAPD and NICB Warn of Bandit Tow Truck Scams The Los Angeles Police Department and the National Insurance Crime Bureau (NICB) are warning motorists of a growing problem with unauthorized tow truck operators in the LA area. These “bandit” tow truck operators monitor police radios and respond to accidents seeking to hook up vehicles and tow them to body shops or storage facilities where they are held hostage until the motorists and their insurance companies pay inflated towing, storage and possibly repair charges to get the vehicle back. “These bandit tow truck drivers are breaking the law by responding without being requested,” said Lieutenant Chris Waters, commanding officer of the Commission Investigation Division. “They often arrive before our officers and pressure the accident victim to sign a release that allows them to take the damaged vehicle,” she added. “Once that form is signed and the vehicle is towed, getting it back is expensive.” “Towing charges, which should amount to a few hundred dollars, often skyrocket to a few thousand dollars once the bandit tow truck operator hauls the vehicle away from the accident scene,” said NICB Special Agent Doreen Sanchez. “The drivers may say they will take the vehicle to a location of the
owner's choice, but they then take it to an undisclosed body shop that is paying them a kickback. In addition to the exorbitant towing charges, the body shop will add on storage fees while the vehicle sits there as the owner and the insurance company are left in the dark as to where it was taken. All of this is designed to maximize the bill to the consumer.” The LAPD and NICB recommend motorists never allow an unknown tow truck operator to tow your vehicle. If you did not request it, reject it. It is illegal for a tow truck operator to respond to an accident scene without being requested. (Section 22513 (b) California Vehicle Code) The LAPD also warns motorists that these bandit tow truck operators also work private parking lots, paying attendants for tips on cars to hook up and haul off to unauthorized locations. If the driver shows up on the scene, the tow truck driver will refuse to unhook the vehicle unless they are given cash to release it. According to California law: Upon request by the owner of the vehicle, a tow driver must immediately and unconditionally release a vehicle that is not yet removed from private property and in transit. (Section 22658 (B) California Vehicle Code) The LAPD and NICB recommend the following: If you are in a non-injury accident, contact police and your insurance company or motor club to request an authorized tow truck. Your insurance company or road side service should provide the name of the tow truck company and expected arrival time. If a tow truck arrives unexpectedly, a call back to the road side service center should be considered to confirm the tow company is the correct company dispatched. Do not be pressured or intimidated into dealing with a tow truck driver that was not requested. Do not sign any towing release form that does not clearly spell out the charges involved and the exact location where you want the vehicle taken. Use your cell phone to take pictures of any tow truck operator and equipment that shows up on the scene. Take pictures of the damage to the vehicles. Some unscrupulous body shops will enhance the damage once they get the vehicle to inflate the repair charges. If you are injured in the accident, do not be forced into signing a release. Let the police handle the tow. If you have any towing issues, call the LAPD Tow Complaint Hotline at (323) 6804TOW. Re: water Rates Dear Editor:
I would like Kevin McKeown to adequately explain just how the 78% water rate hike will directly affect HIS personal pocketbook. It is my understanding that Kevin lives in a rent-controlled apartment, whereby he pays nothing out of his own pocket for water and refuse services. Kevin should have recused himself from the vote altogether. The council will be penalizing landlords and property owners that have no control over how much water their tenants use, then sticking them with up to 13% more in water costs per year, while restricting rent increases to less than 1% per year. This is a true example of communism, alive, well and thriving on the dais. This outrageous 5-year tiered increase plan should motivate new builders and current owners of apartments to install separate meters for each unit, so that tenants will be responsible for their own usage costs. The cost of individual meters may be high for the installation, but will certainly pay off in the long run. Kudos to Sue Himmelrich for being the only voice of reason on our City Council.

Ye Olde Holiday Wish List YOU ASKED FOR IT. YOU GOT IT. "YE OLDE
Holiday Wish List for 2014." What were you expecting? A whole bunch of new seven and eight floor apartment buildings on Wilshire and Lincoln Boulevards? A new City Manager in 2015 who isn't worshipping on the altar of the almighty dollar is on my holiday list. Yes, fiscal solvency is important, but do we have to constantly sock it to residents by extending parking meter hours, increasing parking rates, raising water rates and garbage fees, increasing sales/use taxes and nickel and diming citizens to death? Street food vendors are on my wish list. Officials in Los Angeles are setting up guidelines for the operation of sidewalk food stalls. I wish we would do the same here. The streets in cities where sidewalk food vendors operate (like at the farmers markets) are alive, exciting and vibrant. Food stalls provide a wide choice of world cuisines. The meals are generally pretty tasty and inexpensive. They're a big draw and the spillover benefits brick and mortar restaurants. Food stalls selling a variety of foods would create a whole new vibe and excitement on many of our major streets. Humm, tasty! And, once again, I wish that City Hall shills would stop blowing smoke up our collective derrieres with phony promises that more development will result in less traffic, less need for parking and “zero demand” for resources. City planners need to knock off the crap and seriously address traffic congestion. All year long, I've been writing about zoning and development issues. Developers want to be able to build tall and massive. They and their land use attorneys and real estate types are working hard to maximize zoning opportunities for big profits. Residents want attractive, shorter, less dense projects that won't negatively impact residential neighborhoods with buildings that loom over adjacent home, generate traffic and add to parking problems. One holiday wish is for planning staff, members of the planning commission and city councilpersons to stop lying, treating us like precocious children and start making decisions in our interests instead of saying, “we gave you an opportunity to be heard, now run to bed. The adults have things to do.” Hotels, restaurants, day-care centers, kids dance studios and other commercial operations in residential neighborhoods bring noise, traffic congestion, disruption, pollution and parking issues. They're a threat to the peace and enjoyment of our homes and have no place in residential neighborhoods. I wish City Hall decision makers - including some city attorneys - would pretend like they're trying to get off drugs and “Just say, 'No!'” I also wish the same folks who claim to care about our community, would stop screwing around and mandate nothing over 84-feet or seven floors for the proposed
Plaza at Santa Monica development on cityowned property at Fourth and Fifth Streets and Arizona Avenue. The longer we let the developer plan a twelve-floor structure, the harder it's going to be to stop it. What? It's a done deal? Never mind. Here's wishing that Armen Melkonian's and his Residocracy.org organization will continue to be a strong voice for a humanscale community. The threat of ballot measures with the public voting down megadevelopments has been their most effective tool at stopping projects completely out of scale with the community such as “the Hines Project” proposed for the PaperMate site at Olympic Boulevard and 26th Street. I wish that everyone who uses our streets would start showing a modicum of respect for each other and I'd still like to see more traffic enforcement to curb the brainless, inattentive, rude and self-absorbed motorists, bicyclists and pedestrians. Illegal and dangerous driving is out of control all over our fair city. Anywhere you walk, you take your life in your hands. Speeding and recklessness is epidemic. I suspect most of this goes on because drivers - and bicyclists know they can get away with it. Pedestrians equally share some blame when they, noses buried in their smartphones, walk in front of cars assuming they'll stop. Another wish is for the current members of the Santa Monica-Malibu Unified School District Board of Education to appoint Jake Wachtel to replace Ben Allen on the school board. The dead wood on the board have ignored or refused to address too many problems for too long. Jake will change that by bringing fresh new energy to a moribund body that desperately needs invigoration. I wish for the days when Montana Avenue wasn't so Chi-Chi. I remember when it was a real neighborhood-serving street with gasoline stations where you could fill up, get your oil changed and have your car serviced. It also had shoe repair shops and loads of markets, dry-cleaners, laundromats and a lunch counter or two. Typical of the street's hipster revolution is “Sleepy Jones” next to the Aero Theater at 1318 B Montana. It's a high-end designer pajama boutique that stocks a full range of “quirky and colorful men's and women's underwear, robes, T-shirts and socks.” It's signature offering of "notquite-ready-to-wear," pajama-style tops ranges from $145 to $275 and bottoms from $128 to $265. Now, I'm feeling very uncool going to bed in my $6.99 Walmart basketball shorts. One last holiday wish: the best to you in wealth, health and happiness this holiday season and in the New Year. showing rising temperatures around the globe in recent decades - along with the increasing frequency of extreme weather events - it's hard to believe there are still any climate change deniers. But a recent survey by the non-profit Center for American Progress found that some 58 percent of Republicans in the U.S. Congress still “refuse to accept climate change.” Meanwhile, still others acknowledge the existence of global warming but cling to the scientifically debunked notion that the cause is natural forces, not greenhouse gas pollution by humans. One of the chief doubters in the U.S. House of Representatives is Texas Republican John Carter, who reports on his website that the United Nations' Intergovernmental Panel on Climate Change (IPCC) and the East Anglia Climatic Research Unit in Great Britain-two of the world's foremost authorities on the extent and severity of global warming-hid their own research results showing that world temperatures have not actually been rising, but in fact have been falling, over the past several years. “We may or may not even be in a warming cycle,” says Carter. “Even if we are, scientific evidence does not conclude that activity by man plays any significant role.” Regardless, Carter supports more research and development of solar, wind, tidal and geothermal energy, along with the continued development of hybrid, natural gas and allelectric vehicles. Another outspoken climate naysayer in Congress is House Science, Space & Technology Committee chair Lamar Smith, another Texas Republican, who calls the
Obama administration's 2014 National Climate Assessment (which squarely pins the blame for global warming on human emissions) “a political document intended to frighten Americans into believing that any abnormal weather we experience is the direct result of human CO2 emissions.” He adds that “the Obama administration feels compelled to stretch the truth in order to drum up support for more costly and unnecessary regulations and subsidies.” Of course, the right side of the aisle in Congress isn't the only place you'll find climate change deniers. In a recent op-ed article that appeared on FoxNews.com, scientist and author Daniel Botkin comments that the 2014 National Climate Assessment “ignores...the real history of life itself: endlessly changing, highly adaptable, and never subject to the kind of stasis that the climate change consensus imagines, wrongly, to be Nature's ideal state.” Plenty of other conservative media voices on Fox News and elsewhere are vocal in their skepticism about humans' (leading) role in climate change. But regardless of how persuasive some of these pundits might sound, the facts speak for themselves. IPCC reports that human influence on the climate system is “clear,” with greenhouse gas emissions driven largely by economic and population growth skyrocketing to record levels and leading to atmospheric conditions unprecedented in at least the last 800,000 years. IPCC adds that greenhouse gas emissions are “extremely likely to have been the dominant cause of the observed warming since the mid-20th century” and that warming will be a “very likely” catalyst for increased heat waves, extreme precipitation events, warmer oceans and higher sea levels.

Faces of Silicon Beach: Michael Carney Michael Carney is a West Coast Editor at technology publication PandoDaily. Michael covers everything including venture capital, financial technologies, ecommerce, ondemand services, and the future of television, among other subjects. Erik Huberman, CEO of Hawke Media, talks to Michael about how he became a journalist, the Silicon Beach scene and PandoDaily. Erik Huberman: What made you want to become a journalist? Michael Carney: It's funny, that's a question I get a lot and the answer I tend to give is that it was a total, fortune accident. Before PandoDaily I was working at small investment firm here in LA. I was doing some technology investing in much wider range of investing which included mining, real estate, a variety of things. When I left that firm, I was looking for ways to better engage with the local technology community. That was something I was excited about and PandoDaily had just launched. I reached out to Sarah Lacy about contributing as a guest columnist and would never have thought it would turn into a job, or even to be paid. It was just something I was interested in and it seemed like a good way to get some thoughts out there and meet some people. It turned out to be this serendipitous thing that I've enjoyed and has blossomed into something much bigger than I expected when I reached out just about two and a half years ago.

E: What do you think of the Silicon Beach scene as you've watched it grow? M: It's been amazing. I've lived here personally for much longer than I've been focused on the technology community. I've lived here for a decade and I've been focused really on technology for about five years. In just that time, the volume and level of excitement in entrepreneurship, technology and innovation happening in LA seems to have accelerated tremendously. Some of it might just be awareness; there was certainly an ecosystem in the community of people building technology here for much longer than that, but something seems to have really caught on and caused a tipping point in the last two to three years and it's incredibly exciting. I think LA is a great place for a technology company to be built and there's a lot of the right ingredients here available and some of the best companies of this generation are currently being built here. I've really enjoyed being part of it. I think it's only going to get better and it takes time and people often talk about it being the next Silicon Valley. I don't think that's a great aspiration, but in terms of it being a sustainable and impactful and meaningful creator of technology, I think LA will be that for a long time.

E: Tell me about PandoDaily M: PandoDaily is a technology publication based in San Francisco looking to tell what I think is the defining story of this era. Which is the intersection of technology and business and politics and culture and all of these things that are creating a power shift, in my opinion, from New York finance and Washington DC politics to the West Coast, specifically Silicon Valley, and more recently Los Angeles, or Silicon Beach. The West Coast is where some of the most powerful and influential companies are being created and changing the way that everyone lives their lives. It's a very important story and we're trying to tell that story, to pull people involved in creating those stories and providing information to entrepreneurs and consumers and investors about what's really going on. E: How are you changing the world? M: If you believe what I just said that some of the most important, or maybe the most important, companies in the world are being created today, and are coming out of this technology ecosystem, then certainly by holding the people behind those companies accountable and telling the real stories about how these companies are built, and what they stand for, and who's involved, and what they potentially have to change the way we live our lives, I think that's incredibly important and has the ability to change the world. I think journalism in general is very impor-
E: You've obviously talked to a lot of entrepreneurs, what would be one piece of advice you'd give them from all your experience that you would want to share to help with their success? M: If you're just starting out, I always say the best companies and products are built by people that are solving problems that they themselves personally and intimately feel and understand. I think it's very difficult to create a solution to a problem you haven't experienced. Starting there is a good thing, and just starting is another good thing. The hardest part of entrepreneurship is taking leaps. Whether that be taking the leap to start a job, or asking for money, or dedicating you time on a project that at the moment is just an idea in your head. Starting is the hardest part. E: Is there anything you'd like to share with the Santa Monica community? M: If you're not already part of the technology community, or you're uncertain about what is happening here. You're reading this column, but you're not apart of it. I'd say this is something that has the ability to be tremendously positive and impactful for Santa Monica and the LA area at large. Anything that the local community, politicians, anything anybody can do to support technology and innovation in LA is an enormously positive thing for everybody involved. I would encourage people be aware of what is going on here.

LOBBY FROM PAGE 1 could require members of council to disclose who they've met with regarding a particular project, as is done at the Planning Commission level. “I would hope that those declarations would really include everyone someone talked to about a project,” said Councilmember Pam O'Connor, “because even if they weren't a paid lobbyist there are people out who have special interests. Whether it's a neighborhood group, a neighborhood political group, I think all of those conversations, I think those should all be there for full transparency.” O'Connor and Councilmember Gleam Davis asked that the ordinance require registration of all lobbyists not just, as the item was worded, “lobbyists representing clients who seek benefits or contracts from the City.”

“Sometimes people lobby not seeking a contract, but to oppose something and that technically isn't covered by the wording here,” Davis pointed out. All six present council members agreed. “I'm very interested in what the definition of a lobbyist is,” Davis said. “It seems to me that there are people in town who may not directly lobby us or staff but may, shall we say, encourage or facilitate the lobbying of others. And if we're really trying to be transparent it seems to me that one of the things that's really important is not just to know who meets with who but who tells soand-so to meet with someone.” She asked city attorneys to keep that in mind when trying to create a definition. “I think that there's a lot of indirect lobbying and I don't know if there's a way to capture that or not,” Davis sad, “but I'd just be interested, when it comes back to us, what the definition of a lobbyist is.” DAVE@smdp.com

Only a few years after these five - Gerardo Hernández, Antonio Guerrero, Ramón Labañino, Fernando González, and René González - were accused of conspiracy to commit espionage among other crimes, Johnson and Sene began monthly movie showings in their home in support of their release. “We've tried to build a little local Cuba support committee,” Johnson said. Their group, Films4Cuban5, brings in about 35 people, each paying $5 every month to see a movie tied to Cuba and learn more about what Johnson and Sene said are the injustices of the imprisonment. “I say they are my heroes, because they were stopping terrorism in Cuba,” Sene said. Black and white movie posters from Havana crowd their walls, with Spanish titles for Charlie Chaplin's “The Kid” and Fresa y chocolate, or “Srawberries and Chocolate.” Underneath, an almost-full suitcase sits on the couch. Johnson and Sene already had a trip planned to Cuba for December 20 through January 2, to visit Sene's family. Cuban-American, Sene was the only member of her family born in the U.S. Under former President George W. Bush, Sene said she could only travel to Cuba to visit her family every three years. Once President Obama took office, it was changed to every one year. Now, Sene said, she can take advantage of the new policies and see her family more. “It's been difficult,” she said. “Now we could go a little more often.” In order to build a greater connection to Cuba in the Santa Monica area, Johnson has also placed names of famous Cuban people or images of their leaders and flag on various buildings he owns in town. “We own different properties in the city, and we put the names of Cuban things on all

of our buildings,” he said. “We've had a huge following here.” The buildings read “Alta Havana” or show stenciled images of Che Guevara. Their daughter is named Clara, also the name of the city where Guevara is buried - Santa Clara. Over the years, Johnson and Sene figure they have raised thousands of dollars from their movie nights to contribute to the International Committee to Free the Cuban Five. They said their trip this winter was made that much more exciting by the news of the prisoners' release. “[It's] totally more exciting,” Sene said. “We want to try to see them when we're down there. We are really hoping to meet them in person. They all know us from over the years.” Sene, 82, has been working for this cause for 14 years now. She said it was surreal hearing the news. “We are so thrilled,” she said. “I thought, 'Are we dreaming? Is this for real?' It was unbelievable.” A mix of regulars and new attendees typically attend the monthly screenings, Sene said. Some didn't know anything about the Cuban Five, she said, and so it was important for her to make the movies accessible so she could share more information with the public. “My main thing was the Cuban Five,” she said. “I could live with the embargo, I could live with not seeing my family, I just wanted them free.” Moving forward, the pair has not decided yet if they will continue to screen films - possibly for other causes Sene said - but definitely want to continue to defend Cuba and fight for greater normalization. Johnson said he hopes in the future Santa Monica and Havana become sister cities, working together to create support and friendship among the communities. “We try to build awareness in Santa Monica of justice issues in Cuba,” Johnson said. Routes 3 and 12 would shift away from local service buses and more toward the Rapid buses, which skip infrequently-used stops to save time. Route 8 would use Ocean Avenue rather than Main Street when Downtown. Route 10 would eliminate weekend service. Route 14 would get rid of some of the congested northern parts of the route and extend to the south. The new Route 15 would go crosstown from the incoming Bundy Expo station to Sunset Boulevard. The new Route 16 would run along Walgrove Avenue, across town from the incoming Bergamot station. The new Route 17 would run along Sawtelle Boulevard and Palms Boulevard. The new Route 43 would also serve the Bergamot area. Route 20, which ran from Santa Monica to the Culver City Expo station (the first phase of the rail line, from Downtown Los Angeles to Culver City, opened in 2012) could be seen, as Councilmember Terry O’Day pointed out, as a sort of test service for the Expo line. It was not a popular route. O’Day asked Ed King, BBB’s director of Transit Services, why it struggled to bring in riders. “We found that, because Culver City offered 600 free parking spaces, the propensity of people in this area was to drive to Culver City,” King said. That lot will soon be reduced to 200 spaces, he said. It’s also an efficient use of the bus, King said, because it needs to get to the area in
order to start a different route. If the bus is already going to make the trip, why not take on passengers. With all the proposed changes is a proposed 9 percent increase in service hours and associated costs, which equates, King said, to 14 or 15 new drivers and more mechanics to support the 10 or 11 buses that will be added to the fleet. “We'll have to adjust our business model and some of the things we’re accustom to and comfortable doing today,” he said, “but I think it's well worth the investment and I think it's a once in a lifetime opportunity to really compliment what we're going to have in our community very soon.” Councilmember Pam O’Connor and others expressed concern that some of the changes are more regionally focused but could have adverse impacts locally. “This has to be not just about Expo integration and how we connect to the regional system but also making sure that people have options for moving around Santa Monica,” she said. She gave the example of Route 18, which is proposed to have less-frequent service in the area of Montana Avenue. “You are going to have folks who are not going to use Big Blue Bus because there's nothing serving them in their neck of the woods,” O’Connor said. Several council members noted the importance of a real-time app to let riders know when a bus is coming. King told the council that they hope to have an app, NextBus, which is currently used by Metro, in place by the end of this summer — prior to Expo’s arrival. Several members of council lauded BBB’s outreach, which included dozens of public meetings and took in 12,300 written and verbal comments on potential changes. (2) Recurring Theme: Two men were arrested easily in Silver City, New Mexico, in December. Thieves had broken into Javalina Coffee House downtown and dragged away the ATM behind their truck. With the help of a witness -- and especially the gouge marks in the street running from the Javalina directly to the nearby residence of the men -- police nabbed the two and were still searching for a third. ■ Won't Make That Mistake Again: (1) Ralik Hansen, 28, suspected in a dramatic New York City jewelry robbery, heard a knock at the door of a Brooklyn home in October, squeezed down under a couch and accidentally shot himself to death. (He thought he was hiding from police; it was a delivery man.) (2) Dennis Emery, 57, according to neighbors a frequent gun-brandisher at home in Pinellas Park, Florida, accidentally mishandled one during a November domestic argument and fatally shot himself in the face.
